seven-day case average since mid january. that plus a concerning development in new york where more and more patients admitted to hospitals are children, many not fully vaccinated or not vaccinated at all. we're going to get into that. plus, the incredible strain medical workers are facing nationwide. we'll also dig into severe weather forcing many in the west to dig themselves out. wild blizzards blanketing massive swaths of the west, plunging temperatures below freezing, burying cities under feet of snow and triggering a massive 20-car pileup in nevada. and just weeks after president biden and vladimir putin held a virtual call, the white house confirms a second round of talks planned in just two weeks as tensions rage on the russia/ukraine border. we're going to break down everything we know in minutes. we start with our team covering the latest on the omicron variant across the country. mike memoli is in delaware with president biden.brewster joins . dr. hotez, we want to start with you. in the past hour, mayor de blasio announced new york city schools will reopen on january 3rd with a policy he's calling stay safe and stay open. he says they can pull it off by sending at home test kits to students who test positive. students will have to take two tests over the course of a week. students who test negative and become asymptomatic will be able to return to school. here's more. >> it works because here's the fact we now know based on experience. 98% of close contacts don't turn into positive cases themselves. >> doctor, do those numbers sound right to you? what do you make of this new policy? >> you know, i think we clearly have to get the kids back in school and we can't keep them home. the surgeon general just made an important announcement about the devastating mental health effects of covid-19 on kids. i get all that. the only thing i'm concerned about is when you have a variant with this level of transmission, something more transmissible than measles, you could have all the best plans in the world. it's hard to see how that goes well. i would like to have all of the school districts look at the epidemiologic patterns in the region and say now the numbers are coming down. once they're coming down, we can do that with a lot higher level of safety. if things are still really high january 3rd, i'd feel pretty uncomfortable doing that. i'd rather just a week or two could potentially make a difference. maybe the mayor's office is already looking at that. i don't have the inside baseball on it, but that's my first thought just hearing this just now. >> we want to go to sam right now in florida. these new cdc rules we mentioned mean people who are positive without symptoms now only have to isolate for five days instead of ten, then five more days of masking. one voice of support for the new guidance is delta air lines. the company released a statement that said in part, quote, the updatd guidance allows more flexibility for delta to schedule crews to support a busy holiday season. delta and other airlines have been faced with an onslaught of flight cancellations due to covid outbreaks plus the bad weather in the west. what more can you tell us? >> reporter: you mentioned the bad weather. i apologize. i see everyone else on that screen is bundled up right now, it's 80 degrees in miami. with respect to what's going on with delta and so many other airlines, generally speaking the ceos of these companies are very supportive of this policy which brings the suggested quarantine from ten days down to five days. it will provide more flexibility to be able to reassign flight crews. if you're looking at what's going on right now, we've seen somewhere in the neighborhood of 850 cancellations so far today, 1400 delays. it was 7,700 yesterday. about half the passengers flying united did not get to their destination within four hours of when they were expected to. that was yesterday. it carried over to today. as far as the industry's outlook on these new guidelines, airlines for america, which represents all of the largest carriers, are very supportive of this. but the flight attendants association, the folks interacting the most with people in the cabin, they are not as supportive. they're worried some of their employees are not ready to go back even if they're asymptomatic after five days and could be exposing people to an incredibly transmissible variant. weather is playing a role as we are watching snow blanketing the pacific northwest, arctic temperatures there, frozen runways in washington state, but omicron is such a large portion of this picture. >> mike, let's bring you in here. what can you tell us about the new rules at the federal level? what was the thinking behind this decision? >> reporter: dr. anthony fauci told our colleague kristin welker that most of the transmissibility of this omicron strain comes one to two days before or two to three days after you feel the symptoms of this virus. it also took into account the fact that we don't want to see the kind of major disruptions of american life that we would see given just how high the case count is nationwide. it's important to drill down on the differences between vaccinated and unvaccinated. if you test positive regardless of your vaccination status, it is a five-day period of isolation. only does that isolation end if you no longer have symptoms. as it relates to quarantine, if you are a close contact of someone who tests positive, if you are unvaccinated or haven't gotten a booster more than six months ago, you do need to undergo that five day quarantine period followed by five days of masking. if you have been boosted or you're within six months of your last dose, you're free of that quarantine requirement. that's significant because we've been talking about whether the administration might redefine what it means to be fully vaccinated to include having a booster. they haven't done that yet, but this is a step in that direction. all of these guidelines depend on being able to get a test in the first place. that's a big headache facing this administration. you heard the president saying he understands the federal government needs to do better and will do better. getting those 500 million take home tests out will be the first order of the business in the new year. you heard dr. fauci say that's just the beginning, that the administration has made steps to not just get that 500 million take home tests but having more testing as well. >> dr. hotez, let's get your reaction now to this decision of federal policy. what are your thoughts on it? is this the right move when it comes to loosening quarantine guidelines for those who are asymptomatic? >> i think a lot of it was based on some new information about the transmissibility of the virus in terms of when you're most infectious, either before symptoms or in the couple of days after symptoms. a lot of that is based on daina. we have to keep the country running at some level, so i think this was a balance between the science and the practicality of protecting our health care workers and keeping the country open. last week we heard about the requirement going down to seven days with additional testing. i support that, because if we lose too much of our health care workforce we're not going to be able to take care of people in the icus and the hospital beds. that's the weak link in this whole epidemic. you know, there may be some quibbles here and there for specific issues, but overall i recognize that the cdc is in a tough spot and they have to face the reality that we've been messing up testing in the last two years and it's really difficult to get a test. so i think they were driven to do this in part by the realities of our situation right now. >> you mention health care workers. shaq, let's talk more about that. doctors across the country are preparing for the likelihood of a post holiday surge in cases if they haven't seen it already driven in part by all this holiday travel. you're in indianapolis right now. >> reporter: this is a month long deployment. it features some 20 members of the u.s. navy. i just spoke to some of the senior leadership of that mission. while they were in their full military uniforms, the folks inside are fully integrated with the doctors here, wearing their medical scrubs. we're talking about doctors, navy nurses, respiratory therapists all involved with working with the medical professionals here at this hospital, a hospital by the way that says they are seeing more covid patients than they have ever seen throughout this pandemic. i want you to listen to what a doctor said about the impact the military support is having on operations here. >> it has a big impact. for every patient, if you need health care here and you come in, that's 20 more health care providers that can take care of you. it allows us to open up floors across this hospital to expand and take in patients from all over the place. people are tired. it's been a really tough two years. every added bit of support like that is a big deal. >> reporter: we heard from president biden yesterday when he was talking with governors and saying that that response to this variant is going to be run at a state level, but there will be federal support. so far 15 states have benefitted from some of these surge teams by fema, by the military going in to support some of the hospitals like this. we know later this week there will be another team launched in wisconsin. >> dr. hotez, i want to ask you about an announcement we just got in less than two hours ago. your college was granted emergency use authorization for what's being called the world's covid vaccine. >> this is a partnership between our texas children's center for vaccine development. we've developed vaccine technology, our team of scientists, using a low cost approach that we've been doing for the last 20 years and applied it to covid-19 because we've been working on coronavirus vaccines for the last 15 years and we've licensed its to several vaccine producers in lower to middle income countries. hyderabad in india, they've already made 50 million doses. the fact that we got emergency use authorization is huge. we've now actually wound up matching or doubling the u.s. commitment to global vaccine equity just in one day. so we're really excited about it and over the moon. we think this could be the vaccine to finally vaccinate the southern hemisphere and some all of the emergent variants. it feels really good to be able to make a contribution and difference to the world. >> such incredibly important work, dr. peter hotez, congratulations to you and your colleagues for everything that you're doing. also thank you to mike memoli and shaquille brewster. verdict watch. we're live outside the new york city courthouse where jurors in the ghislaine maxwell case have entered their fourth day of deliberations. and former president trump claims thousands of dead voters have cast ballots in georgia, but they have been found alive and well. eorgia, but they have been found alive and well strokes can be reversed. joints can be 3-d printed. and there isn't one definition of what well feels like. there are millions. we're using our world to make your world a world of well. i'm jonathan lawson here to tell you about life insurance through the colonial penn program. if you're age 50 to 85, and looking to buy life insurance on a fixed budget, remember the three ps. what are the three ps? >> reporter: this is nearly two hours of terror in which this gunman appeared to be killing people at random around denver, get into shootouts with police, then escaping at least twice before he was shot and killed. so far police have not said publicly who the gunman is, nor have they said whether those seven different scenes are linked. here's what we know so far. the shooting started right off the particular broadway through denver. in the first shooting, two women were killed and a man was hurt. at the second shooting, a man was killed. then a shootout in which the gunman was able to disable a police car and get away. then in lakewood police responded to a call founding another person shot and killed. spotted the suspect's car again and gave chase. again, the suspect was able to get away and another shootout. the suspect ran into a hyatt hotel, shot the clerk before finally being cornered by police. that third gun battle lasted several minutes. police say at that point the suspect was shot and killed. but investigators are still unsure if the suspect killed himself or may have died from a shot fired by a police officer. so, again, four out of the seven victims have died. three were hurt, including a police officer. police say they are still trying to establish a motive. they are unclear if there was any link between any of those several locations. again, joe, no identity released yet of the gunman. this morning jurors in the ghislaine maxwell trial have started their fourth day of deliberations. maxwell is charged with recruiting and grooming girls as young as 14 to be sexual assaulted by the late billionaire jeffrey epstein. joining me now is ron allen and barbara mcquaid. ron, walk us through what we've heard from the jury and what we might expect today. >> reporter: well, we might get a verdict, we may not. who knows. we're at 27 hours or so. it was interrupted by four days off over the christmas holiday. now this is the second full day they've been back. again, it's near 27 hours total. they've asked a lot of questions. they've wanted transcripts of the testimony of the four oh women who are accusers in the case. they asked for a white board and stickie notes to put notice on a board. they've asked for transcripts of testimony of other witnesses as well. and they've asked for clarification of a keyword in all of this. the word is "enticement." it's one of the counts that maxwell faces about enticing young women to participate and be involved in sexual activities with jeffrey epstein. her attorneys have said she's a scapegoat. they've questioned these women's memories. they say their motivation is money. all of this comes down to whether the jury believes these young women or not. again, it's a very unusual deliberation in that there's been an interruption. we're reading tea leaves if we have any explanation as to what all that could mean. the judge has also said that the jury is likely to deliberate until 6:00 tonight instead of 5:00. she's concerned about what she described as an astronomical surge in the number of covid cases and that that could affect these jurors. they're not sequestered. >> barbara, if you're a prosecutor in this case, you see the jury entering day four of deliberations with no signal they're close to a decision. what's going through your mind? >> one of the rules of thumb that prosecutors use is that typically juries take about a day of deliberation for each week of trial. this was a three week trial. i guess that would mean about three days of deliberation. we're a little beyond that. but i also think there are two factors that would extend that time frame. one is the complexity of the case. there's a lot to digest here, which would explain asking for the transcripts and the white board. that suggests to me they're looking through things very meticulously, which is exactly what a prosecutor would want. on monday they almost had to start over and remind each other where they were and get their heads back in the game, so to speak. i could see that extending it a bit. the thing they're racing against here is the covid outbreak. if they go through all their jurors and alternates, they'd have to declare a mistrial and retry the case. i don't think anybody wants that to happen. >> it's hard to image anything like this. we've had court cases in the pandemic, but we're having this surge in new york. they're not sequestered. does that impact anything about this? >> i think it's just a factor. but i could imagine if i were a juror and i got this instruction from the court that you we ought to work a little later today and skip our day off because we're worried about the surge, i would feel a little more pressure to make a decision a little more quickly than i otherwise would. i think that adds a little bit of urgency to it. i think that factors in favor of the defense. it's the prosecution's burden to prove the case. if at some point it looks like there are some holdouts, i could imagine people saying, well, we just decide not guilty and move onto it. i give a slight edge to the defense in terms of that dynamic. . former president trump lost the election in georgia by about 12,000 votes. it became ground zero for his false claims of election fraud. check out this headline from "the atlanta journal constitution." most of the dead georgia voters found alive and well after the 2020 election. we're going to talk about that story, next. election. we're going to talk about that story, next. with nicorette. which can lead to something big. start stopping with nicorette. go back to 2020 and the false claims that thousands of dead people cast ballots in georgia during the presidential election. now those claims can rest in peace. the atlanta journal constitution reports those dead voters are live and well. quote, election investigators found just four absentee ballots in the 2020 presidential election from voters who had died, all of them returned by relatives. joining me now is the reporter behind that story, mark niecy and eugene daniels, a politico reporter. trump claimed there were 5,000 dead voters in georgia. this investigation found four. who were they, what can you tell us? >> these were four voters who had died and their ballots were returned, often by their spouses after they had died. in a state election board meeting earlier this month, their spouses or representatives or attorneys said, well, we were voting as we thought that our deceased relatives would have wanted us to vote. one attorney said, i'm very sorry, please don't do anything to punish us. the state election board said, well, looks like it's illegal. we need to refer this to the attorney general's office for potential fines. >> so georgia has already passed changes to its voting laws for 2022. there will be some high profile races there. how will these new laws change elections there during the midterms? >> there's so much, most of it dealing with absentee ballots. the direct impact is that it's very likely that fewer people will vote by absentee ballot and they'll have to vote by person in the 2022 elections in georgia, which will be very important. we have elections for governor, involving democrat stacey abrams and republican brian kemp and former republican senator david purdue recently got in the race. most of georgia's voting law limited drop boxes, required additional forms of id to vote absentee. it also restricted handing out food and water to voters waiting in line. it shortened deadlines for returning absentee ballot applications. all of these add up to a likely decrease in absentee voting aftera record number of people voted remotely in 2020's elections in large part because of the covid pandemic. we had about one-quarter of all voters return absentee ballots in georgia in the 2020 presidential election. now as a result of georgia's new voting law, it's more likely that people will be voting in person, just because it's not as easy to vote absentee this year or in 2022 as it was in 2020. >> eugene, georgia is one state in the spotlight with all the changes we've seen in the wake of 2020. president biden now is renewing his push for a federal voting rights bill to try and get through congress. where does it stand right now, especially with build back better still on the legislative agenda? how big of a priority is this? >> democrats and also the white house are trying to prioritize voting rights over the build back better agenda because they still have a lot to work through when it comes to that, figuring out what especially joe manchin wants and is willing to accept. voting rights is where they seem very focused and doing a push when the new year starts. i think they're going to start tying that to january 6th on that upcoming first anniversary, making the case basically about how sacred america's democracy is under siege since january 6th and on and tying all of those things together to make it feel a lot more urgent for folks, not just people who have been talking about this for months and months, but also people like joe manchin and kyrsten sinema who have been trying to move forward with a carveout for vote rights in the filibuster. they have a lot to get done on voting rights if they want to get it done. most of that is convincing people to do so. president biden himself has moved and changed his mind on the filibuster, saying the other day that he is willing to make an exception of voting rights for the filibuster, something that he had not really been saying out loud as much as advocates wanted him to. now what people are wanting him to do is move forward and talk to those senators who are reticent and make sure they understand the urgency. they're talking about all of these changes, including in georgia, so shoring up federal voting rights is the only way to make sure that what's happening in these states don't stop people from voting, especially black and brown folks. >> i want to get your reaction to something that vice president kamala harris said about this. take a listen. >> people around the world watch what we do as americans. right now we're about to take ourselves off the map as a role model if we let people destroy one of the most important pillars of a democracy, which is free and fair election. >> you're talking about what's happening in state capitols around the country? >> i am. and i'm talking about what's not happening in this capitol in washington, d.c. >> that's a pretty stark warning from the vice president. i know you touched on this a little already, but what is the white house strategy to actually get this done, knowing it has no republican support right now? >> they are making sure they tie everything to it, whether that is america's standing in the world, saying how can we was a country go to these other countries and talk to dictators in places where they don't have free and fair elections and tell them what to do when we haven't cleaned up our own house. also looking at tying it to every other kitchen table issues, that voting rights is the most sacred right that people have and people have fought and died for those rights. that is something they want to make sure people completely understand. and due to outside pressure and also pressure from the inside, will that work on democrats? we do know as we see republicans in state houses making it tougher for people to vote, we're unlikely to see congress pushing for federal legislation that would change and make it easier for people to vote. that's just not going to happen. so democrats know they're not going to get a lot of republican support and definitely not ten republicans' support for any kind of federal voting rights legislation. thousands of russian trips amassed on ukraine's border and tensions rising, the white house confirms that the u.s. and russia will hold talks on the brewing conflict in two weeks. that's two days ahead of russia's talks with nato. vladimir putin remains opposes to ukraine becoming a nato member and is demanding guarantees nato will not expand eastward. joining me is jason crow, who recently led a bipartisan congressional trip to ukraine. good to have you with us. i know you're recovering from a breakthrough covid infection. how are you doing right now? >> thanks for having me. i'm feeling pretty good, thank god for the vaccine and the booster. i had a pretty moderate more substantial cold-like symptoms for a couple of days, but had i not had the vaccine, god only knows what would have been the case. i'm feeling good. thanks for asking. >> let's talk about russia. russia and the u.s. set to hold talks on ukraine on january 10th. as someone who's just back from ukraine, what would you like to see emerge from this second round of talks? >> it's always better to be talking than shooting, in my opinion. i've been to war three times in iraq and afghanistan in my life. war is not something that anybody wants and welcomes. let's not forget a couple of things here. they invaded in 2014 and they are currently in the crimean peninsula, which is problematic. number two, russia and more specifically vladimir putin really believes the ukraine belongs as part of russia. this is part of his world view and i don't think he is going to stop until he's able to accomplish that world view. we have to be very sober about what we're dealing with here and not let him set the terms of the conversation. we have to make sure we're sending a very strong message against putin. >> we know putin once guaranteed nato would not expand east to the ukraine. how does america strike a balance standing firm and sending a message while not contributing to the tensions? >> i think we need to be really clear about something here. nato and the united states and the nato european countries have never been the aggressattacked . we've never said we're going to invade russia and we never would. that's putin projecting on us. he tries to switch the narrative around and say this is about russian security. it's not. he's the one who invaded ukraine. let's not let him flip the narrative here. a second point here is that no country should set the terms of what a sovereign country can and can't do. ukraine is a sovereign, democratic, independent nation. if they want to join nato, that's their prerogative. they can work towards that end. there's criteria, there's eligibility standards that have to be met. it's going to take them some time to meet those standards. but nobody should allow russia to set the terms of what an independent ukraine can do. ukraine is not the same ukraine it was 30 years ago. this is a different country. this is a country of free and independent people who want to be free and independent. they want to move towards nato and nobody should tell them they can't. >> we want to get your reaction to the shooting spree in the denver area last night. at least four people have died, several others injured, including a police officer. i believe this was near your district. what more can you tell us after hearing the news? >> i'm always devastated when i hear this. i represent a district that's been disproportionately impacted by gun violence. i'm also the person who represents the aurora theater shooting location. we've seen our share of mass shootings. it's heartbreaking whenever it happens. we need to make sure we have a serious conversation about gun violence in this country. i'm somebody who grew up around guns. i started hunting at 12. never has a gun defined my life or my identity and who i am as a person. we are in this era where elected officials and leaders tend to define themselves by guns, sending holiday cards with guns, posting selfies with guns. this has got to stop. this can't be an essential element of who we are as a people. >> thank you so much for your time this morning. just stay inside and hunker low as 50 blow zero are now in the forecast. steve paterson is in big bear lake. plenty of snow, how are people dealing with this rare winter weather. >> as you eluded to, it entirely depends on where you are. in big bear it is not 50 below, we got a fresh dumping of snow overnight. there is fresh powder on the ground. this place was built for snow, it is fuelled on snow, and the residents and the tourists here are happy. anywhere else that we're talking about snow especially in places where it is unexpected, it is a different story. different story in seattle where there is different temperatures. state of emergency, different story in oregon where there is more snow. colorado more snow they didn't need, and in lake tahoe, a place you expect would welcome snow, got more than they bargained for. they got dumped on. interstates shut down. highway there is too many drivers and spinouts and accidents and roadside rescues and people there are not happy being stuck in town. we spoke to a few, here is what they're dealing with. listen to this. >> we had two feet in a day kind of storms. as far as christmas, this is the most snow we have had in at least 12 years. >> meanwhile, as far as december snowfall totals, especially when you talk about the sierra nevada mountains. it is good because of the snow pack. 193 inches in december alone, that breaks a record set in 1970. that runs into the reservoirs. filling up some reservoirs leading to more water in the system that we event had for years and years because of this historic drought. meanwhile if you live in these places that are especially sub zero 50 degrees, the advice is stay inside. hopefully that is how people are dealing with it, joe, back to you. >> absolutely, that is not outdoor weather at all. steve paterson, thank you, my friend. many of us are feeling burned out from the stress of the pandemic. that is especially true for health care workers. as vicky wynn tells us, pharmacy technicians as well. >> heidi spent 15 years working as a pharmacy technician. >> all of the parts of my job that i have started to love have gone away with pandemic stress and just all of the unpleasantness in health care and retail today. >> they support the pharmacists, count pills, work the register and more but they're increasingly quitting. in a third of pharmacy owners nearly 90% say they can't find technicians. >> why are they so fed up. >>. >> i think a lot of it coming from the fact that we are grossly under paid. >> it's not just wages. >> it was routine in my store when i was leaving to be 300 to 500 scripts past due at any time. >> that meant that people were going without prescriptions they needed. >> their biggest concern was patient safety. >> in some states there are 60 or 70 pharmacies closing for days on end because they don't have the appropriate staff. >> now the shortage of pharmacy teches lead to a spike in complaints and mistakes. >> i received probably double the number of patient letters that i have in the last year. >> we reached out to the leading pharmacy chains. rite-aid said we're closing most of our pharmacies an hour earlier. they say they continue to review staffing levels and impacted stores may have adjusted hours. they are flexible in the parents needs in a dynamic environment. all three say they're actively recruiting increasing starting
