Given his pattern of, you know, spending weeks when we were trying to get his voluntary cooperation, stringing us along, then being subpoenaed, then coming in and refusing to testify, and then on the eve of holding him in contempt, a new claim, this time that hes going to invoke his Fifth Amendment right, that was among all the Many Disparate claims that he made when he showed up for the deposition. Tomorrow, former Trump National security adviser Michael Flynn is scheduled to be deposed by the committee. Relevant documents are also due from a handful of other Subpoena Targets including alex jones of info wars and trump ally roger stone, with more documents and depositions due later in the week. While speed is a factor given the proximity of the midterms next year, you know, the fate of our democracy, the panel appears to be making rapid progress. As Rolling Stone reports, the committee could be sitting on a mountain of material, material that could clarify what happened on january 6th and who is to blame for it. With me to discuss, barbara mcquade, former u. S. Attorney for the Eastern District of michigan and an msnbc legal analyst. Tyler page, White House Reporter for the washington post, and juanita toliver, democratic strategist. John eastman, who helped former President Trump to pressure Vice President pence to overturn the 2020 election, plans to plead the fifth before the january 6th commission. Jeffrey clark, who missed a deposition yesterday due to health reasons, has indicated he plans to do the same. Kyle cheney of politico who broke the story called eastmans position extraordinary. What do you expect to happen, barb, now that these two have pleaded the fifth . The Fifth Amendment is a much stronger privilege than some of the others weve heard about. Executive privilege is one that can yield if there is a more significant public interest, like joe biden has found with regard to the documents in the archives. Attorney client privilege is also out there. But the Fifth Amendment is strong, its a right that all of us have. I dont impute any guilt to anybody, but you have to have a wellfounded fear of criminal prosecution and two, you have to assert it on a question by question basis, you cant just say therefore i dont have to show up. Its not all over because theyve asserted the fifth. Mike flynn is scheduled to be deposed tomorrow by the committee. Listen to what flynn said last year, roughly six weeks after trump lost the election. He could order the umm, within the swing states, if he wanted to he could take military capabilities and he could place them in those states and basically rerun an election in each of those states. Its not unprecedented. I mean, these people out there talking about martial law as if its something weve never done, weve done martial law has been instituted 64, 64 times, greg. Barb, has horrifying as that is to listen to now, as horrifying as it was to listen to at the time he said it, hes talking seizing Voting Machines and invoking a national emergency. What do you think the panel is seeking from him . I think they want information. What was he saying to donald trump . Who was involved in the planning of the january 6th attack on the capitol . Who was involved in financing that . What was the end game here . So i think flynn is a witness. He is somebody who knows a lot about what was being said at the willard hotel, what was said at the oval office meeting. Hes important to understanding was this something that was carefully orchestrated, and by whom. Lets pivot, tyler. We now know a letter sent to Pressure Georgia Officials in 2020 contained document metadata from the White House Communications office. What more can you tell us, why is this potentially a big deal . I think it just shows the level of involvement from the senior officials in the white house who were deeply involved in this widespread effort to try to discredit the Election Results and put pressure on local elected officials to throw out Election Results, as thenPresident Trump wanted, to overturn the election. It shows how many people were involved in this effort. This is what the January 6th Committee has been focused on and is hoping to get more information on as they bring in these people for depositions this week. This has been a huge effort, mostly led by democrats in the house, with obviously some republican exceptions. But they are really hoping to shed more light on the events that preceded the deadly attack on the capitol and show how it stemmed from conversations and efforts happening in the oval office with the president and his senior advisers. So i think this revelation is just the latest piece of furthering our understanding of the event that happened that day. And crucially, the actions that happened to the violence and the bloodshed. I want to talk about and underscore the urgency of all of this and the time factor for the january 6th commission. How important is it for democrats to have this investigation wrapped up before we head into the midterms next year . I think its more critical that they make sure they get to the truth in this timeline versus fully wrapping it up. I think thats the reality democrats are coming to terms with, as they Just Announced a few days ago that they likely have weeks of Testimony Coverage that will be played across the country going into next year. And so as democrats start to continue to unearth these nuggets like the fact that the white house digital fingerprints were on the same letter that clark was defying his superiors to get to Georgia Election officials, and keep in mind, georgia is the same state where trump called the Secretary Of State and asked, hey, can you find 1,780 votes specifically . Those are the types of pieces of information that the select committee is keep getting out, because having that in the minds of voters, reminding people that this happened within the white house, among the most senior aides, and could potentially, lets be real, also include some republicans who are also elected officials, whether at the state and local level or even at the federal level, involved in this too. That is going to be critical as a backdrop going into the midterms, because of course thats going to influence Voter Behavior and democrats want the truth out there not only to influence Voter Behavior but to ensure our democracy and our institutions can be protected, because this shows another coordinated attack on the validity of our basic rights to vote in this country. Tyler, to the point that its more important to get this done right than to get it done by some arbitrary deadline, there are a lot of subpoenas out there. The committee has subpoenaed roger stone for remarks he made before the rally, several days before the rally. Hes supposed to turn over relevant documents tomorrow. Whats the panel hoping to get from him and how are they expecting him to respond . There is not a lot of High Expectations for the cooperation of many of these key people involved in this. Even the pattern weve seen with other officials, whether claiming Executive Privilege or the latest, that theyre going to invoke the Fifth Amendment. The committee is finding there is not a lot of cooperation, which is to be expected with these officials involved or seemingly involved in the planning and execution of this january 6th rally. Obviously roger stone is someone that the committee wants to bring in and is hopeful they get some information from him, given that his contacts in the Trump Administration and his involvement in some of these meetings and Planning Efforts that ultimately concluded with this january 6th insurrection. But at the same time, as we have seen all these officials are claiming various legal privileges to not have to share information with the committee. This is something the committee has struggled with, although they are saying they have gotten a lot of documents and evidence so far. But i think for the senior, key officials, theres not a lot of High Expectations that they will be the most cooperative and forthcoming witnesses in this investigation. Bob, Info Wars Head alex jones, the committee wants more info on what he said publicly leading up to the attack. Stone is saying he wants to testify publicly before the panel. Why might he want to do this . Just a provocateur . I think so, but one thing that could still be useful, even if he comes in and says crazy stuff, is the request for documents. The documents were created at a time when they were not intended for show, not intended to respond to the committees questions, so that could be revealing. Its also important to call these people in and lock them into their testimony, even if they lie. It makes it difficult for them to change their story later. Interesting. Juanita, listen to what liz cheney said on thursday. We anticipate next year we will be conducting multiple weeks of Public Hearings, setting out for the American People in vivid color exactly what happened, every minute of the day, on january 6th, here at the capitol and at the white house, and what led to that violent attack. Heres the thing, juanita. Weve all been following this moment to moment, document to document, subpoena to subpoena. There are a lot of americans who understandably have not. And so those Public Hearings become critically important from a Strategy Perspective if you are the democrats, if you are a liz cheney, how are you making sure that this reaches as Many Americans as possible . Thats exactly right, right . Like, we have been paying attention. We will read the report that eventually comes out. But the general American Public is going to expect a highlight reel. And these hearings will be that highlight reel. That can be clipped, that can be shared across social media, across their networks, and get the information and the truth out. I think that is critical, to bring this to life so that its not some arbitrary kind of notion that, okay, congress did another investigation. I think its also critical in demonstrating what the committee has achieved with this investigation, so that it can be explicitly clear to the public, here is what weve unearthed and here is what we can do to ensure it never happens again. The other part of this, again, the basic institutions of our democracy are at risk here. Putting that out and naming names along the way is going to illustrate this and illuminate it in a way that makes it accessible to the public, which will be critical, strategically, politically as we go into the midterms as well. The Supreme Court poised to deal the greatest blow to reproductive rights in decades after Hearing Arguments this week on a mississippi abortion ban. The conservative majority appears willing to overturn roe v. Wade and give states the final say on Abortion Access. It is a move republican lawmakers claim is, quote, common sense. On something as contentious as this, it seems like it would make common sense, it would be practical and not political, to send it back to the states and let every state do what they want to do and live with it and if you dont like it, then go to work within those legislatures. It was never enumerated in the constitution that this would be something that would be done at the federal level. The Gutmacher Institute reports 21 states are certain to outlaw abortion if roe is rolled back. That would leave 40 of use women without the right to terminate a pregnancy. Joining me now, democratic congresswoman barbara lee, cochair of the prochoice caucus. After what we listened to last week, you have shared that this fight is deeply personal for you, saying you were, quote, one of the lucky ones to survive a back alley abortion in the 60s. How dangerous will it be to return to a World Without roe . Thank you very much, alicia, for having me this evening. This is a moment that we have to really understand very clearly that 50 years of roe v. Wade is 50 years of making sure that reproductive freedom and access to Reproductive Health care, including Abortion Care, is available for people. And in fact, if roe v. Wade were not if they rule against roe v. Wade, it would be very dangerous, because part of this issue is women having the ability to have safe, legal, accessible abortions. Its no ones decision except the person who is making that decision and whomever she consults with to make the decision. Its not up to any elected officials, its not up to any Supreme Court justices to decide what you or i will do with our bodies. Its very dangerous. Thats why were working so hard to pass in the senate now, we passed in the house, the Womens Health protection act led by congresswoman judy hsu, who saw this coming in 2013 and authored this bill and many of us cosponsored it, got it out of the house. It would actually codify roe v. Wade into law and make sure that thats a binding law where womens reproductive freedom would not be eroded anymore. 2013, when people were saying that this was hysterical and hyperbolic to suggest that roe could ever be under attack, its the thing we dont want to be proven right on. To your point about codifying Abortion Rights at the federal level, what is your plan to get that through the senate . You know, this is a very its a plan that involves people throughout our country making sure that they hold their senators accountable. The public, over60 of the public believes that women should have the right to make their own decisions about their own reproductive choices. So this is a political struggle. We have to hold members of the senate accountable. And we have to, in no uncertain terms, make sure they know this is a decision that we should make ourselves, not members of the senate. And in fact, Political Action means voter registration. It means organizing. We have some wonderful activists and organizations around the country who know how to get this done. And so im hoping that members of the senate understand that their constituents too want to have reproductive freedom and that they should support the Womens Health protection act, because thats extremely important, because we cannot allow the Supreme Court to take away and i believe this would be one of the first times that they have actually taken away a right that we have that is so important. Its a matter, in many respects, of life and death. Focusing on the piece of this you can control legislatively, you were urging the house to repeal the Hyde Amendment. What would that mean for Abortion Access nationwide . Sure. We talk about abortion should be equitable, they should be accessible, and they should ensure Racial Equity and racial justice. You know, henry hyde, way back, who was a member of congress in the 70s, decided that he wanted to make sure that Abortion Rights did not exist for anyone, but knowing that he could not address roe v. Wade at that point, decided to institute the Hyde Amendment which would deny low income women, who are primarily women of color, the same access to Abortion Care that everyone who has money or insurance would have. And so the Hyde Amendment, which were trying to repeal, would make sure that everyone, regardless of their background, regardless of their zip code or their income, have equal access to the full range of reproductive choices, including Abortion Care. You talked a little bit about the mobilizing force around Abortion Care and how democrats will need to sort of make that front and center. It also strikes me that this is part of a broader picture, right . Its about access to contraception. Its about quality Sex Education in this country. Its about the internal inconsistency of arguing you have to carry a pregnancy to term but you cant live in a country where you get paid family leave. These issues are becoming front and center in 2022, way beyond abortion itself. They all intersect with each other. For years ive been trying to get comprehensive Sex Education in my legislation passed so young people will be able to learn about sex ed and prevent Sexually Transmitted Infections and diseases and know how to prevent early and unintended pregnancy. So we have to do that. Abstinence only just doesnt work. Secondly, there are those who really and you should hear some of the debate about birth control. There are some who in congress who dont believe that women should have access to birth control. They dont want women to have access to abortions. They dont want women to have women and young people to have access to Sex Education. What in the world do they want . This is a larger attack and assault, i believe, on our democracy, because these are issues that are fundamental to how we live our lives and how we move forward and create the type of life that we want to create with our families. And so these fundamental rights are being attacked, and youre right, not just Abortion Rights. These are rights that are being attacked in terms of racial justice, in terms of income inequality, equity, criminal justice. You name it. Theyre trying to roll the clock back to the days that some of us remember, which, you know, i hate to even think about the days of jim crow. Theyre trying to take away our voting rights. Again, theyre trying to take away each and every right that we have fought so hard over the years, african americans, 401 years ago, were brought here enslaved. Weve been fighting ever since to be free and to be part of this wonderful society in terms of equal opportunity and Racial Equity. And we have a long way to go. Weve come a long way, a long way to go. But theyre trying to take us back. All of these issues intersect with each other. And i hope this is a wakeup call, especially for young people who have not lived in a world where Abortion Rights were taken away. Congressman lee, as always, thank you so much for your time. The administration hoping to pass the build back better act by the end of the year. But they still need to get hold of senators joe manchin and Kyrsten Sinema on board. So i want to make sure that if we are crafting legislation, were doing it in a lean and efficient way thats fiscally responsible and doesnt impact things like inflation or make our businesses less competitive. Well get to all the arguments shes making there. But aside from the Spending Bill that urgently needs to get passed, the administration continues to deal with a wide range of issues at home and abroad. Among them, a raging pandemic. The president , we know he has a lot on his plate, but sometimes when you tick through things like that, you realize the scope. And there are many things we didnt mention. Lets talk specifically about the domestic agenda first and the pressure to get build back better done before the end of the year. Right, alicia, i think i had a bit of whiplash there when you were going through all those points. Theres a lot on bidens plate right now. In august we were talking about the same thing around Foreign Policy, whats happening at both, and then also the Infrastructure Bill and the social Spending Bill. Were back at where we were just a few months ago. Now with all that youve mentioned, looking at the big priority on democrats plate in the u. S. On a domestic level, the time is ticking and running out. Weve heard again and again that theres confidence that this will likely hopefully be done before christmas. But that does not seem near at all, when we consider the two holdouts we might be seeing in the senate, when it comes to how do we responsibly pay for this. Those questions are still up in the air. And the messaging isnt clear to americans who are worried about inflation, who are worried about gas prices, who are worried about this new variant of coronavirus, who have thinking about this big picture, the Spending Plan is up in the air. The clock is running out on child tax payments that will be ending very soon and need to be reevaluated and added to that Spending Bill. Those are things that are really that theyre up against. If they cant indicate why this is so important to pass before the end of the year, theyre going to see a lot of failures going into next year, as you mentioned, in midterm year. Juanita, i promise ill give you a chance to respond to all of that. Before i do, i want to go to tyler because Senators Manchin and sinema still sound skeptical of the price tag. Manchin said he believed Budget Gimmicks might be hiding the true cost. I want you to listen to what treasury secretary janet yellen said this week after senator john kennedy of louisiana questioned if the bill was actually paid for. Take a listen. I disagree with your assessment of build back better. It is fully paid for or even more than fully paid for. And cbo just completed a comprehensive review of it in which they found essentially the same thing. And i believe it was important that it be fully paid for. Tyler, given that the treasury secretary and the Congressional Budget Office are both saying the same thing, that it is paid for, why still the pushback, specifically from manchin and sinema . Yeah, i think we have seen from the start of these negotiations that Senators Manchin and sinema have had concerns about just overall spending from the government this year. Remember, its not just the build back better bill that theyre trying to push forward but theyve already passed the 1. 9 trillion dollar Stimulus Bill in march. So the next tranche of spending is something manchin and sinema have been concerned about. As weve seen inflation rising, as we heard in that interview that sinema did with cnn, she outlined that americans are feeling everyday price increases on gas and food and other things that americans need every day. So i think while the administration looks to pass this bill, theyre dealing with some economic headwinds that are impacting americans every day. And while the build back better bill is not adding money right away, it is a difficult messaging effort to deal with rising inflation and wanting to spend a lot more money there. So i think one of the strategies that the administration is deploying is having economists like janet yellen and others, as youll often hear from President Biden, nobelprizewinning economists assuring lawmakers that this bill wont add to the deficit, wont add to inflation, and is fully paid for. But i think that is a difficult message for some senators to take in, given what were seeing in the economy right now, after the Coronavirus Relief package and this Infrastructure Bill that were massive government spending, a lot of it on this Infrastructure Bill is paid for as well, but i think the big numbers are scaring some senators and that is the full corps press we see from the administration and janet yellen and other senior aides, to meet with lawmakers and review the nuts and bolts. The build back better bill includes quite a bit of spending in programs. Theyre working through all the various things that senators are concerned about. While it is senator manchin and sinema who get the most attention for their concerns, there are other senators that have pet projects or concerns on other smaller items that they also have to work through with them as well. So juanita, referring to all of those nobelprizewinning economists, is that strategy going to be sufficient . I think potentially on the hill, but definitely not for regular people who dont know the names of these awardwinning economists, right . They need to hear from people who look like them, who are standing to also benefit from the provisions of these bills. One of my former colleagues talks about the power of telling Human Interest stories, telling people what they stand to gain. Thats where this stands. The first thing that can be emphasized is the Childcare Tax Credit and that 2 to 300 that families and parents have come to expect since, what, august, is likely to end come january if this bill is not passed in time. And so getting that out there, getting the important stuff, reminding people, hey, that 2 to 300 that helps you pay your bills, pay your rent, pay for childcare, and keep a roof over your head, is likely to be ending, so make sure your senators get in on this. And i assure you, alicia, voters are over hearing about manchin and sinema because even if theyre not the only ones who are hesitant, theyre the most vocal and poll after poll shows the voters dont care. Democrats have a mandate after winning the white house, the house, and the senate in 2020. Thats the point i keep coming back to, being able to show voters that democrats can actually deliver is absolutely paramount. Kadey, tyler, juanita, thank you all. What happens when a Family Member becomes so consumed by Internet Conspiracy Theories it can ultimately cost them their life . An msnbc podcast investigates the case of one of the five people who died during the january 6th insurrection. An american radical hosted by msnbcs Ayman Mohyeldin. He goes back to her hometown and tries to piece together how she went from being someone who had never before shown any interest in politics to becoming a devout trump supporter, fueled by Internet Conspiracy Theories. Roseanne began to withdraw from Family Commitments and instead went down a qanon rabbia qanon rabbit hole of child trafficking Conspiracy Theories. She researched it. I left there at probably 5 00 in the evening, and she texted me at 7 00 in the morning she had been up all night watching youtube. Msnbc anchor Ayman Mohyeldin joins me now. Ayman, they came to you for this story, right . Yeah. I mean its a very personal story in the sense that roseannes brotherinlaw and i went to high school together. In fact, roseanne and i went to the same high school a few years apart. What most people dont know is obviously i was born and lived overseas, but when we moved to the u. S. , i went to high school in kennesaw georgia. After january 6th and the first couple of days afterwards, i didnt know who she was. I didnt know who all the individuals that were who had died that day were. And then on january 9th, i got a message from justin on facebook saying, you know, ayman, you probably saw i made a statement. My sisterinlaw, roseanne, died on the events of wednesday, january 6th, and my wife and i believe that she had been radicalized in the span of six months. And for me, that was immediately, whoa, what is going on here because the word radicalization for me was, you know, just shocking. And, two, the fact that they used that word to describe what had happened to her and what she had gone through over six months was also very alarming. So immediately i connected back with justin. I hadnt seen him for 20 years, went down ja, saw his family, met his family. They gave us incredible access to her journals, her diaries. We interviewed the family, friends, people that knew her, people that were with her that final day. So that for me was the beginning of this journey into roseannes life and radicalization. Why dont we know more about her . Thats a really good question, and i think in the early days after january 6th, the focus was on Ashli Babbitt, and the way the victims of and, again, the victims here being portrayed by the far right was that these were people who had gone to peacefully protest and were killed by the police while they were engaged in peaceful protests. Obviously thats not the reality, and anyone who was watching the events of that day knew that. But people like Ashli Babbitt were symbolized and became martyrs of the far right, and people like President Trump talked about them, and there was this huge push online to find out who shot and who killed Ashli Babbitt. Roseanne had been forgotten because the circumstances of her death at that time were unknown. It was not clear what had exactly happened to her, and we wouldnt find out what had happened to her for several months later when the chief medical Examiners Office released her autopsy. But it wasnt enough for the family. The family had a lot of questions because they were concerned not only with the final minutes of her life, where she was that day, what happened to her, was she subject to any violence, did she die of natural causes, did she die of a Drug Overdose . But also what happened in the six months prior. Why did this person who had a long history of Substance Abuse and personal challenges also go down a rabbit hole of Conspiracy Theories that led her to becoming a hard core trump supporter and ultimately having that tragic end on the steps of the capitol. This happened very quickly in the eyes of her family. Very quickly. Six months. They say prior to the six months, this was an individual very committed to her bright although she struggled with. She played an Important Role in her family. She took care of her nieces. She was responsible enough to pick her up from school. Her family knew about her challenges but at the same time they knew over the span of those six months, she started going down this rabbit hole of Internet Conspiracies and qanon. She starts using hashtags popular by qanon believers. She became in their eyes a q believer and her social media posts, her messages to her friends reflected that. And it happened so quickly, and there was this moment in their life where they were not sure about trying to confront her and trying to talk to her about it, but also afraid that may push her back and alienate her, or to let her be even though they didnt know much about qanon, didnt think it was going to be a serious or dangerous rabbit hole. But ultimately they were wrong. It took her down this road and took her to the steps of the capitol, where she ultimately died in belief of qanon. I have 30 seconds. You know exactly what that means. Whats the biggest question her family has . They want to know exactly what happened to her in those final minutes of her life. I dont feel they have gotten sufficient answers yet. Obviously there is the autopsy report. We get into that in the podcast. There are a lot of eyewitnesses there. But for them, they have a lot more questions about those final five minutes, and they want to just see evidence emerge one way or the other. Ayman, thank you so much.
