two of our guests joining us tonight. and ruth wrote this masterful piece in the washington post that one, i want to read, it offered the option of listening to it. so i of course will always take that option so i can do some other things. and i went to press the listen button. and it shows you the number of minutes. and i thought it would be like six and a half. but it was almost an hour. something like that. there must be some mistake. and no. it is that long. and it is just a masterful encapsulation of basically my whole adult life of watching the supreme court and what has happened to it. and it is an excellent way to get through a workout, i discovered. and read by ruth in her own voice. then you get some high priced actor to do it. it really is masterful. it really ramps up to tomorrow perfectly. >> ruth's genius, and when you hear tonight you can tell her that if she doesn't feel like reading the next one, i hereby volunteer, because i love reading everything she writes. i would love to do it. >> so rachel, we are starting off tonight with some breaking news that has just been released by federal court in washington d.c. of an fbi interrogation confession by one of the january 6th attackers. and this is the guy who is on video giving electric shocks to officer mr. fanone. electric shops that he thought would kill him. he eventually had a heart attack from what was going on in that video. we have now just pulled into the control room, getting ingested as we speak, some of that video of that fbi discussion. we are going to lead with that tonight. >> that is great, i had seen the ruling from that which had to be released today. we have been waiting for when it was going to come out. i'm really glad you got it. >> thank you rachel. well as rachel just said, judge amy ordered the release of the fbi interrogation video of defendant daniel rodriguez who was seen on video attacking officer michael fanone with a taser. and repeatedly giving officer fanone electric shocks that officer fanone believed were going to kill him. here is some of that video, of the fbi questioning of this defendant on march 31st. this was just released minutes ago. >> what do you want me to tell you? that i chased him, yes? ? >> why did you tasing. i don't know. i'm sorry. i don't know. he is a human being. i would never kill him. and he is not a bad guy. he's just doing his job. >> but why would you go up there with a taser? why would you take that taser that was given to you from your friends and tourism? >> it wasn't given to me by friends, it was given to me by strangers. i swear to god, it is not the same taser. i swear to god, i'm not trying to protect them. >> we are ingesting more of that video as we speak. we will have more of it in a moment. we are leading off our discussion tonight with ryan j. reilly, the senior justice for washington post. ryan you've been covering this, these cases, these defendants. you knew this video was coming. how long is the video? how long is the interrogation? what else do we learn in it? >> the interrogations fans about three hours. and what is nice, is that we already have this transcript that we go through that plays out exactly how this all unfolded. and we could sort of reference that as this video has been released. there have been a bunch of key moments that i have been interested in. one of them, very early on is that this took place about a month after danny rodriguez had been identified. after he was identified by online split. so about a month after our story run, that is when the fbi went to pick him up. and they actually used that fact that he already been identified in a another story, to escort him to the interrogation. a lot of people were telling the danny rodriguez stories, were anti-fascist. they were saying that danny rodriguez stories, and he had to basically come back that. we basically danny rodriguez spilled his guts here and that is really what we see on this video unfolding today. and i think overall there is this sort of ongoing theme that we see in a lot of these january six pieces. there is a lot of rhetoric that we see from a lot of these capital defendants at the beginning. and then on the back end of it, when the consequences come, when they are interviewed by the fbi, or when they are sentenced by a federal judge, suddenly we see them breakdown. and that sort of falls a little bit. >> yes, they are very different people when they are in custody the. we have more the video right now, this is danny rodriguez saying that trump called us to d.c.. let's listen to this. >> how do you get to january six? what else happens within that period of time? >> trump called us. trump called us to d.c.. >> tell me about that. how did he let you guys know that he was going to come to d.c.? >> if he is the commander in chief and the leader of our country, then he is calling for help. we thought he was calling for help. i thought i was doing the right thing. i had no plans of what was going to happen. i didn't know what was going to happen. no matter what leader. i just felt, what was good intentions, of going and joining. i didn't know that was going to happen. i really didn't. >> so this crying guy is the guy who is saying, i had good intentions. he is on video teasing a police officer. tasing officer fanone repeatedly. >> that is right, and afterwards he actually went back to an airbnb where he was saying with a bunch of other trump supporters. they celebrated, drink beers. a local beer here in d.c.. which features the capitol dome on the front. so that is what they did, they were holding a biden flag, and posing for photos. that is would happen when they did this attack on fanone. he thought he was a patriot. he thought he was doing the right thing. he was listening to him for work. he was listening to all this garbage news online. and he actually literally believe that the election was stolen. which a lot of people do believe. the problem with that is not some of those reporters who believe those ridiculous lies actually are going to do something about it. and that is where we are today. >> let's listen to more of what he told the fbi, including which after trump became president, he tried to join the army, to serve not the united states but to serve america. so trump became president? and then you wanted to join the army in response to him becoming president? >> yes, i actually did. i actually went to go to the recruiting office. and at that time trump was still seen as not a good person. well it was at the very beginning. i volunteer. i did door to door and everything. i came there with my trump shirt, i got some weird looks. and i was confused because, they weren't okay with trump. >> ryan, what is the status of the deadly rodriguez case? >> so there is going to be a hearing next week actually to determine whether or not, basically, this entire interview is going to be admissible in court. then rod greg -- has suggested that the miranda warning that he gets at the very beginning and the forms that he signs advising of his miranda writes wasn't significant in this case. so i think that right now most of the general theory is that it will get through based on what we heard from court from andy berman jackson, just a few weeks back. but really it doesn't matter in danny rodriguez's guilt. what could come to play, is whether he gets domestic terrorists sentencing. because a lot of what he said in their shows the political motivation behind this crime. and it shows what he was trying to accomplish. it shows that this was in fact an act of domestic terrorism. and if that is not allowed to be introduced, that could allow advance mint. once he is actually punished for his crime. he is looking at a lot of time behind bars. he almost killed mike fanone,. >> ryan riley, thank you for staying on this piece. staying dedicated to it. and thank you for joining us tonight, really appreciate it. >> thank you so much for having me. >> well the house select committee investigating the one six, has been considering holding trump white house chief of staff in criminal contempt for defying the committee subpoenas, has now reached a deal. with mark meadows, in which mark meadows will cooperated with the committee. the committee has already received documents from mark meadows including 6000 emails. the chair of the committee, betty thompson, released a statement today saying, quote, mr. meadows has been engaging with the select -- committee through his attorney. he has produced records to the committee and will soon appear for an initial deposition. the committee will continue to assess his degree of compliance with a subpoena after the deposition. today, georgia secretary of state raffensperger, spent over four hours in discussion with the committee. a discussion that reportedly focused on donald trump's phone call to him on january 2nd in which donald trump appears to commit the federal and state crime of election fraud. >> so, look, all i want to do is this, i just want to find 11,780 votes which is one more than we have. >> secretary raffensperger told the atlantic journal-constitution that the trump phone call was an important part of today's discussion with the committee. he said, quote, we talked about that and everything else leading into the election. that was their focus, because that was where the greatest disinformation was foisted upon our nation. that phone call is also the focus of a criminal investigation of possible election fraud by donald trump in fulton county, georgia. we're he has paneled a grand jury to consider that evidence. donald trump's lawyers had a very difficult time in a federal appeals court in washington d.c. today because, as judge patricia miller put it, we have one president at a time under our constitution. private citizen donald trump has brought a lawsuit to try and overruled the decision of the president of the united states, joe biden, to have the federal archives hand over trump white house records to the january six committee for his investigation. one of the judges, on today's judge panel, judge tom g brown jackson, a biden appointee, said this. >> this all boils down to two decisions. to who decides when it is in the best interest of the united states to disclose presidential records? is it the current occupant of the white house or is it the former. is there a circumstance where the former president ever gets to make this kind of call and why should he? >> joining us now is mathew miller an jill wine-banks, prosecutor and the former general counsel of the army. both are msnbc contributors. and jill wine-banks, i want to get your reaction to what you heard in that appeals court discussion today. the one president at a time beat was struck more than once. >> it was, and it started actually in the district court when the decision was made. the judge said that there was only one president. and donald trump is not the president. and it goes back to that. and i think what has to happen is, in terms of the crucial question of what is the interest of the united states, only the current president can decide what is of such national significance that you need to waive any privileged executive privilege or anything else. and under the current presidential records act. under the current supreme court cases of u.s. v. nixon. and gsa versus nixon. i think that the answer is clear that these records will be and should be disclosed. and that the committee can get them and can go about its business quickly. and the decisions need to be made as soon as possible so that they don't run the timeout before congress is not in session anymore. mathew miller, the court has not seen a case like this. they have to nixon cases, one while he was president. and another one he was a former president. so neither one of those cases fit exactly what we are talking about here. and it seemed to me, that the judges spent an enormous amount of time today in a very repetitive discussion simply because this exact case had never passed through the court before. >> yes, that is right lawrence. this really is a case of first impression. this isn't it's a good case -- usually in executive cases you are seeing the core trying to mediate between two branches of government. the executive branch of the legislative branch. they have different priorities, equities. and the courts are asking to intervene to help to bounce those equities. the executive branch at this point representative joe biden, agree that these on documents ought to be turned over. so the documents, as judge ketanja brown said. it is clear that partly from the supreme court cases from the nixon era, that former presidents are owed some sort of difference. they do get to make some sort of-limited insertion. but i think what the judges make clear today is whether there is a dispute between a former president and the current president, only the current president is situated to speak for the executive branch. and i think that they are going to rule unanimously against him. and to jill wine-banks's point. it is important to move quickly. and they have been moving quickly. i think what donald trump did, by trying to win by delay, it only took the district court 23 days, in this case, from the time the case was filed to when it was ruled. and it has only been 20 today since he appealed to the hearing today. i two more weeks before we hear to the decision. we >> jill wine-banks, we see mark meadows and some form of cooperation with the january six committee. he could though, in his testifying to the committee, at certain points, refused to answer questions. he could use the fifth amendment. he could also claim executive privilege in response to individual questions. and that could in itself lead to other legal battles. >> it could lead to delay. i don't think it will change the ultimate outcome. but i agree with what was said which is that we have to wait until after the deposition to evaluate his actual level of cooperation. pardon me if i am a little skeptical but i am glad he has turned over some documents and i am glad that he has agreed to testify because that it least avoids the total contempt of congress by not even showing up. they will show up, but i am suspicious and suspect that he may actually not answer the key questions that we all want to hear the answers to. he is a key player in this. he is with president trump throughout this day. he knows a lot. but as we get the documents, things like phone records, people are saying how big of a deal is that? our viewers will be listening, they don't have your expertise on what to listen for from each justice. >> lawrence, i think that one of the things that was really magisterial about roots piece was what happens when you got six justices on the court that they are about to get everything they want. and we clearly have three justices that really want everything they want. and they want it now. and then we have three justices and i hesitate to call them the middle, but ruth marcus doesn't call them the minute. we have them who may not have everything they want right this second for fear of looking buzzer. so what i am going to look for is what happens if there is clearly six votes to overturn roe. you have six justices who were, i think, groomed to overturn roe. three of them really want to write the sentence roe v. wade is overruled. and three of them are kind of triangulating against a whole bunch of other interest. so looking for cracks in those three and those three, is what we are looking for. >> and ruth marcus, is there any version of this missive sipping case where the court upholds the mississippi law but doesn't overturn roe v. wade? >> i think we have to, first of all take a step back and remember our first enemy -- which is delta. we saw a country that are struggling. there is a delta surge in many parts of the country that almost bring hospitals to dysfunction. so we have to keep getting people vaccinated for that purpose. as doctor fauci said, not only that is the first doses for people not yet vaccinated, but the boost of doses. we have over 100 million people that received over all their doses. we need to concentrate on that. we have to prepare for ourselves in a much better way. before the strain shows up here. >> what should we expect about the efficacy of the vaccines against this new variant? >> you heard conflicting information just today, reported out of israel said it's going really well. the ceo of the van dam matt vaccine manufacturer has been said it's been a challenge. some were obviously between those two extremes, we can see from previous days of vaccines that were done in the south africa and south america earlier this year, is that beta and gamma variance. these were two that had the same types of mutations. and in both of those instances, vaccine protection was substantially reduced in terms of infection. at the same time it showed that you could reduce substantially the number of people who got seriously ill, or hospitalized and die, so even using the curve vaccines. if you are fully vaccinated, you are standing in much better chance of not having a severe infection with the new variant. >> what is the developmental process for tuning up these vaccines?
