between the lawyers and the judge, and testimony from rittenhouse himself, the jury may begin deliberating as soon as later today. rittenhouse faces multiple homicide charges for killing two protesters and injuring another during unrest last august. he was charged with being a minor in possession of a dangerous weapon. that charge was dismissed by the judge earlier this morning. protests broke out in kenosha last summer after jacob blake, a black man was shot by a white officer. rittenhouse then 17 was among other armed civilians who say they came to kenosha to protect businesses from the protesters. when the jury receives the case, they'll have to consider if rittenhouse was acting in self-defense and if the amount of force he used was reasonable in response to the amount of danger he was in. joining us now to break this down, shaq brewster, covering the trial from kenosha, wisconsin. and i'm joined by legal analysts. in a moment danny have a us. give us the latest, shaq. >> reporter: garrett, we're in the break right now, the lunch break. jurors in the courtroom are going to eat right now. but it was a busy morning in the courtroom. as we started the closing arguments, we're now in the closing arguments which means we're potentially hours away from the jury having this case and having the decision in their hands, and you mentioned it started with the sixth count, the possession of a deadly weapon by someone who is under 18. that one was dropped. it was dismissed by the judge after an apparent technicality over the length of the gun. that law gets complex there. but then we went right into the jury instructions. the jury being told how they should apply the law and then we heard the start of the closing arguments. i want you to listen to the crux of the arguments from the prosecution as they began their presentation. >> in the entire sequence of events, from the shooting of jacob blake on sunday, august 23rd, 2020, all the way after that, everything this community went through, the only person who shot and killed anyone was the defendant. yes. there was property damage. no one is here to defend that. no one is here to tell you it's okay to commit arson or looting. no one is here okay to tell you it's okay to be rioters. i'm not defending any of that. you know because you've been told in the testimony, i'm prosecuting one person for arson. that's not okay. but what you don't get to do is kill someone on the street for committing arson. >> reporter: one claim that you heard the prosecutors come back to is this idea that you can't claim self-defense for a danger that you created. we, of course, know, that is his main defense, he was acting in self-defense, being chased. one of the people was armed. you hear the prosecution trying to attack that principle. i'll underscore timing. the jury could have this in on hands later today where they begin deliberations this evening or, and the judge left this as a possibility, after the closing arguments, they could go home for the night and come back tomorrow and start fresh. i think bottom line, we're entering the final phases of this trial. >> and carol, this prosecutor has had a rough go of it the last week or so where i think a lot of the nation has been tuned into this trial. i'm curious how important are the closing arguments after everything else we've seen over the last two weeks and how would you rate the way the prosecution is handling things so far. >> we're about 20 minutes into the prosecutor's closing argument. and, of course, closing arguments are very, very important in trials. and probably even more important in a trial like this. because in this trial, we didn't have the kinds of very clear video that we had, say, in the george floyd trial. these videos are at night. they're from far away. they're blurry. a lot of interpretation has to take place in understanding what was going on. so on the prosecutor's job here, and i think he's doing a decent job at this point, is to put everything in context, and to argue reasonable inferences from the evidence that the jury has seen. and i think the clip that was just played was significant. i think he did a good job in saying that hey, how come the whole night the only person who killed anybody was kyle rittenhouse, even though there were lots of people wandering the steets with guns in open carry. i think that's really important, because what the jury is going to be asked to assess, and the jury instructions are incredibly complicated in this case. what ultimately they're going to be asked to assess is the reasonableness of what kyle rittenhouse thought he was doing that night. in many, many different ways. and so putting that all in context, i think was very important. >> right. the facts of what happened that night don't seem to be in very much dispute. i mean, how much of this is going to come down to rittenhouse's state of mind and how important do you think his testimony will end up being when the jurors retire to deliberate? >> well, rittenhouse's state of mind is extremely important, but it's important in this way. the jury has to decide for certain very serious charges whether his state of mind, whether his conclusions or his thoughts were reasonable. but then in assessing both his intent to kill and also his belief that he needed to defend himself, they have to decide whether he had a good faith belief, but even if he did, if it was an unreasonable belief, they can find him guilty of some lesser included charges which do carry some substantial penalties. >> and danny, i think we have you with us now. as you're listening to the closing arguments being put in place by the prosecution, what's going to be the job of the defense as they close this out. what do you make as someone who has been on the other side of the case like this to having to respond to what the prosecutors are putting on the table in the final day? >> the magic word of the day is provocation. you've already heard it a couple times in the prosecution's closing arguments. i expect you may hear it 50 to 100 times more once we come back. because provocation is the prosecution's salvation. it is their way to use a trump card on self-defense. they don't even have to disprove self-defense if they can prove provocation which is why they're going to focus heavily on it. then once they do that, the defense is going to stand up likely, point to the prosecution and say, provocation was so important to the prosecution that they mentioned it in their opening several days ago, exactly 0 .0 times. because it's known that the prosecution came up with this theory late in the middle of the trial with the emergence of some video and photographic evidence they enlarged. the defense is going to fight back hard on prosecution and stress the prosecution has the burden to prove that provocation beyond a reasonable doubt. and that even if they do prove provocation, kyle rittenhouse met the statutory requirements by retreating, withdraw and also communicating that withdrawal by running away. ladies and gentlemen, you see him running away. that's pretty much mostly what you see him doing in addition to shooting. so that is going to be the way the defense has to attack provocation. >> carol, there's been some technical elements that i think will be very important. the jury is being allowed to consider a second degree charge. if they don't feel like the defendant was acting in self-defense, but if they don't feel like it reaches the first degree, let's listen to the judge on this, and then i'd like you to break down what this could mean after. >> the forthcoming information charges at the same time and place the defendant caused the death of another human being, anthony huber with intent to kill that person. this is a charge of intentional homicide in the first degree and you must consider first whether the defendant is guilty of that offense. if you are not satisfied the defendant is guilty of first degree intentional homicide, you may consider whether or not the defendant is guilty of second degree intentional homicide or first degree reckless homicide which are less serious degrees of criminal homicide. >> how important is that possibility of a second degree conviction here? do juries like having a middle option when they look at cases like this? >> i think it depends on the jury. obviously, what this means is if the jury decides to acquit on the most serious charge alleged, they can then go to the next level which carries a lesser penalty, but it permits them to find the defendant guilty because the prosecution has a lower burden of proof here, not a lower burden of proof, but it has to prove fewer elements and they can show, for example, that the defendant didn't intend to kill, but he had, for example, a disregard for human life in the way he acted. so i think if there's a lot of dissension in the jury, and if you were to listen to danny and me talking right now, you could see how reasonable people could disagree on what they're seeing. these lesser included offenses gives the jury an ability to say okay, well, if we can't agree on this more serious charge, let's take a look at the less serious charge and see if we can agree there. that's why the prosecution asked for the lesser included offenses. >> danny, we just had a graphic on the screen of the charges that rittenhouse still faces not on that graphic was the possession of gun by a minor charge which he had at the start of this. which the judge threw out today. does that make an impact on a jury? does that put wind in the sails of the defense to have something like that thrown out on the last day? >> it does. and i quietly think this is a major event, because leading up to this dismissal, at least if you think about the gun possession charge, it seemed like the easiest one to convict him on. after all, he was under 17. he had a firearm. that's not where the wisconsin statute ends. and it has additional subsections and i'm going to summarize them basically. the statute only applies if kyle rittenhouse additionally violated some section that only applies to people under 16 years old. now we're getting into whacky philosophy. how can kyle rittenhouse, a 17-year-old violate a statute that requires you to be under 16 years old. the judge expressed concern with this early on, and now he dismissed it. the reason i think that's a problem for the prosecution is that they can't -- this is not the legal argument. kind of the moral argument that here's this guy on the street illegally with a firearm. that gives them that original sin, but i caution that's not even the theory of provocation that the prosecution is proceeding with. it's just sort of an overall gloom that the prosecution could have laid at the feet of kyle rittenhouse. by the way, even though it's been dismissed, they're still arguing it in the closing saying kyle rittenhouse shouldn't have been on the street as a 17-year-old with a gun. the prosecution seems unper teshed by the fact they lost that misdemeanor charge. >> >> earlier today we saw steve bannon turn himself in at the fbi field office not far from here. and talk to hid supporters on the way in waying they shouldn't take their way off the main goal which is to disrupt the biden regime as he put it. so appearing rather defiant there. he haven't seen him outside of court yet. the arraignment is expected to begin at any moment, and it's going to be a pro forma sort of affair where he gets a chance to enter a plea. there's no issue of bail. they carry penalties of a minimum of 30 days and a maximum of a year in jail per count. as well as some fines. they are not insignificant. the real question here is you heard adam schiff talking about moving expeditiously. the question is how expeditiously could the criminal trial move? if it moves at the pace of a normal criminal trial and takes about a year, that puts bannon out of the reach of this committee which is trying to get a report out in the spring. it has a political calendar. really, perhaps what the congress is hoping with this case is to send the message of deterrents to some of the other witnesses resisting. bannon didn't even show up. that seems to make his case difficult to surround. it's not that he came and incited executive privilege. >> and bannon may be out of the reach of the committee regardless because even if he's convicted, that doesn't compel him to testify. it means he would have to serve his time. sahil, what will this do for the committee itself? does this embolden them to make more referrals to the justice department regardless of the pace of the judicial system even to have this indictment today? >> to an extent, it does. because now they've seen the justice department will act on a criminal contempt referral. this is a unique situation where executive privilege is applied. there was always a little bit of ununcertainty. steve bannon did get the indictment. he's appearing in court, and the committee said they hope this sends a chilling message to anyone who tries to defy a subpoena that they will not be able to skate and get away with it. and of course, mark meadows is the next person on the committee's list to try to get testimony. he did not show up for his deposition last week and the committee has threatened consequences in terrorism dilemma here is as you note, that if they go this route of criminal contempt, that doesn't compel meadows to testify. they're in a bit of a question mark situation as to whether they throw the book at him and risk him walking away without actually testifying or as they appear to be doing, giving him another chance to come to the table. meadows was the former president's chief of staff on the day of january 6th. he has more inside information than someone like steve bannon who had not served in the white house since 2017. >> right. there might be a certain value to squeezing bannon who doesn't necessarily know as much as you want to find out if it shakes loose, something from the other folks who they subpoenaed. ari, if you're looking at steve bannon here, does he just want to go down with the ship and be a martyr here, or does he have any actual legal strategy to play? >> they have not approached this as a clear legal strategy. they've much more made this a political and public show of force and defiance. indeed, there's a lot of space between what donald trump asked for through his lawyers on paper and what steve bannon is doing. by which i mean, trump's lawyers tried to keep trump in the clear on this and said well, hold back anything that might be privileged. bannon is not even claiming to do that, and to the point you played from congressman schiff, those debates take longer and can sometimes reach accommodations. instead they said we won't give you any documents or show up. that's why it's two counts. he's stiff arming them on all counts, on all requests. and that doesn't leave a lot of legal room for him. these types of charges are relatively rare in this space where you're just being indicted for not participating or cooperating at all. but this is right in the strike zone of when the doj would go for it. bannon is not even pretending to try to have a legal agent or defense. that's why if you read the indictment, it's clear and buttoned up. most of what the indictment says, the justice department reaching it own view there is a crime here, mostly just says here's what the committee asked for. bannon said no with no good reason. here you go. >> kind of the nexus of the political and legal here, what do you make of -- we're seeing a bannon perp walk. bannon likes this. he likes to be seen as a fighter for the president. if you're the former body man or mid to high level white house official, if you're somebody who was behind the scenes your whole lifer, how are you potentially looking at what's playing out today and how does that fold into the committee's strategy to try to get information out of folks like that who don't want to show up on msnbc walking out in front of a courthouse? >> well, it's a great point. really, when we think about perp walks and generally this process, most lawyers and you see this debated in high profile cases, will go the extra mile to keep their client from that kind of scrutiny and attention. here they're self-broadcasting it in addition to the news cameras. this fits into the entire bannon of it all. but not everyone who is working in government or around trump has the same gut tendencies, if you want to call it that, nor do they have as much money to withstand what will be a costly and lengthy battle regardless of who gets power in the house. the self-broadcasting sort of instagram bannon parlor whatever vibe is not necessarily what people who are mid career or don't delight in referring to themselves in the third person as darth vader, may not appeal to other people the same way. >> understandably so. sahil, is there going to be an element of turn about is fair play? we're talking about the possibility that this committee might no longer exist in the next congress if republicans win back control of the house. they might not just shut this down. they might use the same authority that would be available to them to go after some of the current president's allies. might they not? >> yeah. some republicans in the house have suggested exactly that. now, it should be noted most republicans have been quiet about this. steve bannon does not have a lot of friends in capitol hill. he's alienated. some see him as a political bomb thrower. he's targeted a lot of them in the past. several of the staunchest allies have jumped to bannon's defense. that includes the number three house republican who describeed this as a politically motivated prosecution. others on the far right have suggested that republicans will use this precedent on executive privilege to go after president joe biden's aides next year and haul them into testify and try to throw consequences at them in the form of the law. the democrats and the republicans on this committee have not been impressed be i the claims. they say this is a deadly serious investigation of an insurrection and attempted coup. it has nothing to do with politics and there is the layer of the simple fact that donald trump is a former president. joe biden is the current@. because the doj accepted a criminal contempt citation and went for a prosecution of an aide to a former president doesn't necessarily mean they'll do the same thing to a current president in the form of joe biden next year. but nevertheless, these are republicans who are threatening political payback. it certainly is something to keep an eye on in terms of what a potential republican-led house, republican-led congress would look like next year as the political climate suggests is more likely than not. >> all right. sahil, thank you. ken, i know you have a busy hour ahead. we'll check with you later. ari, thank you all. up next, for the white house passing this massive infrastructure bill might have been the easy part. now they've got to implement it and sell the benefits of it to voters. transportation secretary pete buttigieg is the white house's point man on both. he joins us next. s next (man 2 vo) i'm living longer. supported this legislation some of whom received death threats will appear at the signing ceremony. that's just another indication of just how toxic and how challenging this political environment is for this administration to deal with. and a lot is now riding on this $1.2 trillion bill for the democrats politically and economically for the country. as the administration turns its focus to the complicated task of implementing this massive bill, and then selling the benefits to the voters. joining me is one of the top white house officials tasked with implementing the bill and selling it to voters. transportation secretary pete buttigieg. thank you for coming on. i guess my first question is how soon do you think money will start going out the door, and the american people will start feeling the effects of what's in the bill? >> well, i'll tell you. the moment the president's ink is dry and his signature, we'll get down to work. we've been preparing for weeks and months to make sure that we're getting these dollars out efficiently and effectively. there are ports 'bridges waiting for years, often decades for the kinds of investments we're going to be able to do. presidents, administrations, congresses, have sought to do this, tried to do this, wanted to do this for literally as long as i've been alive. it's finally happening. we have some programs right now, they already exist. my department set them up, discretionary grants. we have more dollars to work with. those are the first things to flow. we have to stand up whole new programs like the safety program, the safe streets for all program created by this bill or the protect initiative. that's about resilience in areas like where you have a road getting washed out again and again because of climate change and the only right answer is to move the road. in addition to the work being done immediately, we'll be developing and putting out programming for years to come thanks so this landmark historic piece of legislation. >> you've obviously been involved with the creation of this bill with marketing it to the country. the white house brought in the former mayor of new orleans to be involved in this. the buck stops where with the implementation of this bill? >> well, obviously i take very seriously the responsibilities that we have for everything that flows through the department of transportation. that's over $280 billion of new funding in addition to the baseline funding that was in the bill that we were planning on the whole time. and can i tell you that everyone in my organization feels the same way. we know that we have a responsibility to be creative, to be smart, to be entrepreneurial, but also to be careful, cautious, and accountable if these dollars. of course, the work we do reflects on the administration as a whole which is why i'm so glad my friend, the new orleans mayor, the president to the conference of mayors when i was relatively new to the job. his role at the white house, looking across different departments. my department, the department of energy, epa, just to name a few are part of the task force, making sure the big picture looks good even as we're going into our respective individual areas of responsibility. partners with others to get this done. >> the fraternity of mayors working on this is an interesting subplot. i wonder how do you balance the fact that so much of the country is talking about other issues that might feel more immediate like inflation? i mean, you're going to say we're going to spend. we're going to build. we're going to put this out here, and the rest of the country might look at a country like inflation that says hang on. this is not my biggest concern right now. how do you balance that? >> this is one of the walk and chew gum moments. we're you're headed to the store, you're worried about the price you're going to see there. also when you're headed to the store, you're going on a road. you're going across a bridge. you're hopping on the bus or subway, and you know that needs work, too. this is why the president has been working on so many levels at the same time. so many areas of american life have needed attention for so long. and now we're actually getting the action that's going to be required to meet the moment and prepare for the future. >> are there short-term steps? i mean, you mentioned the child car part of this. i understand it could have a downward pressure on inflation when it's up and running. are there short-term steps the administration is planning to take on the issue? >> the work we've been doing on the supply chain side will help relieve some of the pressure. that's something where there are a lot of different factors at play. a lot of disruptions are related to covid. stepping up the vaccination campaign as the white house has done. this is in an indirect but powerful way going to have a relationship to inflation. another thing is the extension of those child tax credits, making sure families have more wiggle room in their budgets as they are facing some of those price pressures on things like gas and other items that have gone up. >> i want to ask you about the political struggle that democrats are in. some people you may dispute the premise, but you look at the new washington post poll, for example, that just came out after this bill was passed. the president's handling of the economy under water. 39% approved. 55% approved. on accomplishments, 35% of the country think he's accomplished a great deal. 63% say little to nothing. how do you go out and tell this story where voters don't think you guys are getting stuff done? i was there when the rescue package got passed. i was there when the infrastructure bill got passed. you'll be there when it's signed. there's clearly a disconnect with the american people who don't think this administration is getting much done for them. >> well, to me it's not just about tell and sell. it's about show and tell. it's about pointing directly to the areas where people will literally see concrete improvements in their lives and their communities thanks to this bill. look, it has always been true that it takes a little bit of time for public satisfaction to follow achievements here in washington, because people are waiting to see whether the things that are talked about and even the things passed and signed here affect them. we recognize that and accept that. we also know that people are going to see in short order both in their pockets in terms of things like the child tax credit once the build back better act passes. and in their communities with this infrastructure deal. people are going to see a ton of improvement of big impact. it is our job to make sure there is no doubt in anybody's mind why those improvements are happening. they're happening because of the president's leadership and because with the president's leadership, even in today's washington, he was able to bring republicans and democrats together to get something done. that's how we got here with this historic bill for american infrastructure. >> is the how this got done as important or on the scale of importance to what got done, the fact that it did have republicans coming along with it. and what does that say about the process on the other big bill you've been trying to move through congress? >> i think it does say a lot. even with frankly low expectations for the possibility of cooperating on anything, you saw a large number of senate republicans voting with senate democrats to get this done, and a healthy number of house republicans crossing over, too. i don't think a lot of people thought that was possible. the president often talks about how people thought he was almost unserious when he said that people could come together and yet, that's exactly what happened. and yeah, it was a complicated process with all kinds of twists and turns and give and take, but at the end of the day, we are delivering something that has been talked about and dreamed of for decades. and i think that's a testament to the possibility even today, even in this very, very challenging political environment, of getting things done when you have the right ideas, the right policies and right leadership. >> you mentioned earlier the fact that sometimes it takes a while for people to see and understand the benefits of major programs. you look at whether it's the affordable care act, democrats got whacked in the next midterm. then the law became more increasingly popular. there are some people, the republican side of the aisle who like the president's tax cut bill in 2017. they got whacked in 2018 in the midterms. how do you avoid that historic trend and make sure that you get the credit for your accomplishments in the short-term so you're not on the outs with the republican-controlled congress come early the following year? >> i was one of those democrats. my first time running for office in 2010 when we were getting whacked over the affordable care act. and then over time, because americans saw how it improved their lives, it became a winning issue us. good policy makes good politics. nobody wants to make years and years for people to gradually recognize the benefits that have come to them from this legislation. i think the big difference, of course, is that we don't have to wait years for these measures to be popular. they are wildly popular right now. there's no lag time between the day the president signs the bill and the moment the american people come to believe it's good policy. they already believe it's good policy correctly to invest in our roads and bridges and ports and airports and trains and transit. and by the way, as to the second half of the build back better legislation, if you look at the components of that, there too, americans overwhelmingly agree that we ought to have pre-k in this country and extend the child tax credits. that we ought to step forward to bring down the cost of health care and pharmaceuticals. bring down the cost of having a loved one be at home and get care at home. there's no convince that we have to do in terms of americans believing it's a good idea. they do. the convincing is to make sure washington catches up to where the american people already are. >> we'll be watching it closely. thank you for president biden will make good on a major campaign promise this afternoon. he's set to sign into law an infrastructure bill that is sorely needed cash infusion for the fraying physical infrastructure including billions on roads and bridges and expanded broadband. this bridge in ohio has become one of the enduring symbols of the infrastructure issues talked about by presidents for years. that's where we find cal perry today across the river from cincinnati on the kentucky side of the bridge. cal, what kind of impact does this bill stand to have on projects like that bridge that state have not had the money to handle on their own. >> yeah. look, you've laid it out perfectly. this bridge is a symbol of american infrastructure. it was built in 1963. in 1985 we removed the energy lanes and almost doubled the amount of traffic that goes across the bridge, 150,000 cars a day. even though the bridge was designed to only carry 85,000 cars a day. so the department of transportation has named it functionally obsolete. it's my phrase of the day. functionally obsolete. that is where much of america's infrastructure is. this bridge carries 3% of american gdp over the course of a year. it's vermont longtime senator pat leahy has announced he will not seek reelection to a ninth term. the 81-year-old is the fifth longest serving senator in united states history and as senate president pro
