In addition to the Infrastructure Bill signing, tomorrow is set to be a big day for the january 6th investigation. Former trump aide and longtime loyalist steve bannon is expected to turn himself over to Law Enforcement officials and appear in court for defying the january 6th committees subpoena. Joining me now, julie swann and hayes brown is a writer the editor for msnbc daily. Betsey, i want to start with you. The fact that steve bannon is turning himself in, yet he hasnt done his homework or gathered the documents that the committee has requested. What can we expect from him . Is he going to be forthright or continue to try to stall the investigation . I see no indication whatsoever that bannon has had any kind of change at all. In fact, for legal purposes, bannons crime has already been committed. This isnt like civil litigation where you can negotiate and try to make things right. If you read the indictment which is pretty short and straightforward, bannons done it. Hes defied the subpoena, refused to get his papers together, refused to figure out what he has that he believes could be covered by the president s very, very strained assertion of Executive Privilege. I think theres no likelihood whatsoever that hell change what he sends. But the signal that it sends to mark meadows and others that doj will not sit on the sidelines on this and they face real serious major legal problems if they defy lawful subpoenas. And one of the things were finding out, hayes, is that theres an extrump official thats already received. And she told cnn that this seems to be a very comprehensive and deliberate investigation by the committee, saying that it was very narrow in scope. And basically trying to telecast to other individuals that it is not a witch hunt, that instead theyre trying to get to the underpinnings of the investigation. Her coming out and saying this, advising the individuals that dont want to come forward for those subpoenas. I think it says to them. That you will not be persecuted once you are talking to the community. It gives you the sign that this will be okay. That the skies will not open up, the earth will not swallow you up if you go speak to this committee. I think thats great considering the number of subpoenas that are out there right now. And the number of people who have been subpoenaed who may not be up there with steve bannon and Stephen Miller and kayleigh mcenayny, who are solid, diehard, steve bannon risks up to two years in jail, and a lot of people that you just showed on screen are not as willing to become a martyr and go to jail for donald trump as some of those other people that were shown just now. That whole screenshot that we showed, it fills the screen. What do you believe, will be the outcome when steve bannon comes forward . Will he testify and be very clear and forthcoming . The reason i ask in a different manner is were seeing mark must meadow, who basically his attorney said, were not going to go ahead and come forward because mark has Executive Privilege. Steve bannon has none of that. Thats right, i think its very unlikely that bannon will testify. In meadows case, they will defer to whatever a court comes down and says. In this case, they are referring to Civil Litigation That Trump and his lawyers have brought. Theyre trying to get a judge to toss out the whole thing. So far, that effort has been a total failure, but theres a couple more steps that they could go through. What meadows is signaling is that at the end of that litigation, if the federal judiciary comes down on the side of the court,. Hayes, one of the things that a lot of folks are focused on is the asymmetrical judgment of the law. The folks right now that are getting subpoenaed, they are not necessarily feeling the repercussions of what it means not to show up with the exception of bannon. However, protesters are getting hit with the book of the law and now getting actually, now getting sentencing versus the individuals that were the perpetrators, the ones that organized it. Theyre getting people lowerlevel sentences, and especially people who were fled guilty. To the fact that the federal judiciary are a little confused to the protesters, but on the flip side, with the january 6th committee, theyre starting at the top and working their way down. Theyre subpoenaing the big fish and working their way down to some of the lowerlevel staffers. Thank you for joining me this early sunday morning. Thank you. Lets bring in democratic congressmen jim clyburn of South Carolina. Hes Majority Whip in the House Of Representatives and chair of the Rural Broadband task force. Congressman, thank you so much for joining me on this sunday. So much to talk to you about. One of the things, though, exploring a little bit of what is in the mind right now of steve bannon, who basically decides he doesnt want to collaborate with what is happening with the january 6th committee. Well, thank you very much for having me. First of all, i dont know how you get into Steve Bannons mind. I dont know why one would think that you can carry Executive Privilege throughout your life. He did serve in the white house at one time. He was in the serving there when all of these incidents occurred and hes not serving there now. For him to exert Executive Privilege is beyond me. But i think that this indictment demonstrates that the department of justice is not going to act in the way his department of justice operated and hes going to have to answer to the committee for his conduct. And i hope that the others will see this and begin to comply with the committees work. I want to read you something that bannon said on his friday podcast, because it relates so much to the work that you do, that youve dedicated yourself to and that is accessing elections and accessing voters to the polls. He said, quote, were going to get to the bottom of november 3rd and were going to decertify the electors. While congress is focused on the Infrastructure Bills, how are lawmakers pushing for federal protections . And the other thing that he said in that podcast, is that how he is now training poll workers and Election Officials to make sure that all of the elections are won locally. What do you say to that . Poppycock. I think hes trying to divert attention from the real issues at hand. There are some people that still look back at november 2020. But every court thats looked at this, all of the judges including those appointed by 45, they have determined that this is one of if not the most transparent and effective, Fair Elections ever. And he knows that, most of the public know that, and he should just really stop trying to divert attention from the problems that we need to deal with. How important is it to pass the freedom to vote act, given what the steve bannon is telegraphing about what he wants to do in the Midterm Election . Its very, very important. We looked at both of these bills and i have been advocating for a long time now that some people have problems before the vote. Some people have problems, with some parts of john lewis. Combine the two. The senates got it sitting over there. Just look at the policies that make sense and advance them as one comprehensive piece of legislation that will not allow states to nullify elections. Youve got texas and georgia passing laws in other states as well, that not only will impede and suppress the vote, but allow the vote results to be overturned or nullifying if you dont like the result. You cannot run a country this way, because this country has been a beacon to the world on how to conduct elections. I have been on election reviews committees. Ive gone into other countries, and i have overturned elections because of wrongdoing. Some of the same things these people are proposing to do in this country, i have been a part of overturning in other countries, because they violate that every sensibility that one would have when it comes to elections. How do you think ive got this Little Committee sitting here. And if it doesnt come out the way i want it to come out, we will have the authority to nullify the result. Thats what king was talking about in his speech in the march on washington. He wasnt talking about a dream. He was really talking about nullification. These things are coming to the forefront and i recall upon the American People to wake up and really be sure that we do not succumb to this Identify Autocracy that these guys are right to put in place. And congressman, i just want to underscore that the president has often said that we are right now in a battle for our democracy, because we are facing an autocratic governance if we do not step up. But i want to applaud the bill that you just recently introduced, recognizing the efforts of africanamerican world war ii veterans and how their ancestors now will be able to receive the allocations of the gi bill that before they were not eligible because of the color of their skin. Can you elaborate on that bill you introduced . Thank you very much for allowing me to do that. I have joined with representative seth moulton of massachusetts to honor two sergeants. One, Sergeant Maddox from massachusetts and Sergeant Isaac woodward from South Carolina. I think if people were to look at what happened to these two gentlemen coming back from world war ii, having just saved this country from an autocracy and have be punished, not even being allowed to participate in the gi bill. A lot of people did rebuild their lives as a result of the gi bill. But these two gentlemen and thousands of others were denied access. Sergeant woodard was blinded by in South Carolina while in his uniform. All he was trying to do was be an american. He is the one who gave the that incentivized brown board of education, if you look at the story of isaac woodard, you will see how a federal judge here in South Carolina looked at what happened to him and decided that he was no longer going to be a southern judge, he was going to be an american judge. And these kinds of things need to be rectified. He was the one the harry truman. When i see Something Like this, its got to come to an end. So sergeant mad dox was denied n education. All around him could get it with the gi bill, is seth moulton and i are trying hard to do what is necessary to right them wrongs for their children or their descendants. Congressman, oftentimes people say, why does representation matter, and you are emblematic of why its important for americans to be able to choose their representatives that reflect their values and who they are. If you listen to conservatives, the far right, and even some moderate democrats, you might think the socalled woke mob is to blame for americas problems. The debate has been simmering among democrats, is the party too progressive . No. And for years, Republicans En Masse Have Crusaded against wokeness, while rousing a base animated by culture wars. Woke has become so animated by the right, it has become unwoke. The war against wokism is used to mask inequities and suppress freedoms. Unequal pay, prejudice against who you love, brutality based on skin color, agency over our bodies and climate upheaval. And the antiwoke crowd conveniently forgets to mention everything woke has got us towards a more equitable, perfect union. Obamacare, abortion rights, minimum wage, the child tax credit, climate justice, and just about everything in the bipartisan Infrastructure Bill were all at one point in time considered too progressive to ever be reality. Lets look at the child tax credit. It alone lists 50 of americans out of poverty. The fact that we have Child Poverty in america is a conversation for a later day. But here we are in 2021, and all of these lifechanging policies are now the norm. It and doesnt matter if youre a democrat or a republican, all americans benefit from these policies. Take the Infrastructure Bill, for example. The investments in the once in a Generation Legislation will have a Transformative Impact on local communities while addressing Structural Racism inherent in the majority of past government policies. Heres a headline from the Shreveport Times of louisiana. State to get 7 billion so far from the biden bill. Infrastructure passage is, quote, a major victory for louisiana. And in the miami herald, billions of dollars coming to florida when bidens Infrastructure Bill is law. And one more. The texas to get 35. 5 billion over five years from the biden Infrastructure Bill. Allaround good news for all americans, even the red states. It doesnt matter that all but 13 republican members of the house voted against Infrastructure Bill, their states and constituents will still reap the benefits and i bet those republicans will still show up to Ribbon Cutting and tout the investments made by a bill they didnt support. You wont hear them complaining about wokeness. Woke is not a detriment to the nation. Its addressing the root cause of systemic inequities we have faced because moderates have failed to walk in the shoes of most americans. Woke is the mandate for the majority of a multicollateral american, who voted their hearts out in 2018, wringing in the most Representative Congress in our nations history. The house passed 400 bills that spoke our priorities. But mcconnell refused to bring most of those bills to the floor for a vote. Voters delivered the house, the white house, and the senate in 2020 to finish the job. The fact that moderate democrats now went through all of that Organizing Effort and voting to stay in its lane is charming and defeatist. In 2020, americans of all colors, gender, and creeds showed up and voted for change if the democrats want to change to stay the course, heed the mandate, pass bidens build back better plan and give the 80 million voters a reason to vote again. And pass the freedom to vote act. Think about that awkward parent who may not quite wokeness, but embrace it. The trial for the white men charged with killing Ahmaud Arbery has been contentious from the start. One of the Defense Lawyers lodged a complaint to the judge saying, quote, we dont want anymore black pastors coming here. Reverend sharpton had this to say on msnbcs Politics Nation last night. The arrogant insensitivity of that attorney in asking a judge to bar me or any minister of the familys choice underscores the disregard for the family of the human life lost and the grieving of a family in need of spiritual and community support. The judge presiding over the case, judge Timothy Walmsley stated that he will not be making any Blanket Rules over the attendance of the public in the courtroom and that my present was not a distraction to the proceedings. Thats why thursday, they tried to ban one, were coming back with a hundred. Reverend sharpton and family Attorney Ben Crump are now calling on black clergy members to gather at the glenn county courthouse on thursday. Joining mow now is paul butler, a former federal prosecutor and an msnbc legal analyst. Paul, i want to start with that statement about black pastors, how is that going to impact, if at all, the jury . Its a great question. The judge will instruct the jury to ignore everything thats going on outside of the courtroom, but obviously, the jury will notice whos in the audience. And whether the prosecution thinks that this helps advance its case is kind of not relevant. You know, this is the same Defense Attorney who complained that there werent enough white men over 40 in the jury pool. Now, he wants to control which black people are allowed to attend a public trial. Thats not only racist, its unconstitutional. And so this case has been underlied with so much racism, so much the undertones, everything about the case. How does this play out with the jury, as well . Because it seems to be another point of contention that again, that basically says that the killing of a black men was all a form of modern day lynching and that the Defense Attorney may be lying under that camp. What do you say to that . Thats a great question, because its the defense who keeps bringing up race, but the prosecution has important evidence of racism that it has not yet presented to the jury. Right after Travis Mcmichael shot mr. Aubrey three times, he stood over his body and he said the nword. Its important for the jury to hear this evidence, to make it clear that this killing wasnt just reckless, it was racist. If mr. Aubrey were white, he would most likely still be live. So thats curious. Why hasnt the prosecutor brought that up . The prosecution seems to be waiting for the defense to open the door to this evidence. By claiming that the defendants didnt treat mr. Aubrey differently because of his race. But the skblunlg has allowed some evidence like the image of a Confederate Flag on the License Plate of one of the cars that was chasing mr. Aubrey. So in this case and in the Kyle Rittenhouse case, both defenses are claiming selfdefense, even though it seems that they actively went to the area areas to cause harm . What do you say about these current selfdefense laws that are on the book. In this case, we have three white men essentially accused of lynching an africanamerican man, and these Defense Attorneys have a weak ways. Theyre taking the low road in this trial. Theyre attacking mr. Aubreys character. Theyre playing the race card. The important thing is for the judges to make sure that both sides and both trials get equal justice under the law. In this aubrey killers trial, the judge made a bizarre designation last week, where he said that the Defense Attorneys had intentionally selfincriminated against prospective black jurors, but there was nothing that he could do about it, leaving a jury where 11 out of 12 are white in a county in which one out of three are africanamerican. And the concern is that if these defendants are found not guilty, many people will not have confidence in this verdict based on the jury. He was a creole man who deliberate took a seat in a whites only rail car back in 1902. Plessy didnt make this stand by chance. It was part of an effort to test out louisianas separate car act. A law that required trains to have separate but supposedly equal accommodations for white and black passengers. Plessy challenged the louisiana law, saying it was unconstitutional. He went to court, but ultimately the judge presiding over the case, John Howard Ferguson did not rule in his favor, and so the state was free to enforce the law. Plessy then took that fight all the way to the Supreme Court, in the landmark case now known as plessy versus ferguson. However, in a 71 ruling with the Supreme Court found that equal but separate institutes did not violate the constitution. That ruling allowed segregation to continue for nearly six more decades and until it was finally overturned in 1954. Despite it no longer being a crime, plessy died in 1925 with a conviction on his record. Fast forward to this week, and it looks like plessy will soon see justice. Two days ago, a state board in louisiana voted unanimously to pardon plessy posthumously. The effort was thanks to the defendants of homer plessy and john ferguson. Keith plessy and Phoebe Ferguson got together to start the movement to clear plessys name. After the success of the vote, louisiana governor John Bell Edwards now says he looks forward to receiving the state boards recommendations before he can sign off on the pardon and make it official. And coming up, unrest in the capitol. Dozens of democrats have condemned congressman paul gosar for posting a vile video aimed at representative ocasiocortez and the president , but when it comes to republicans, theres been crickets. And before we go to break, republicans who voted in favor of the bipartisan Infrastructure Bill have been getting a lot of heat from their gop colleagues and their constituents. One of the most striking things theyll have to deal with is a potential vote on whether to censure paul gosar for the anime video he posted last week depicting him killing ocasiocortez. On the republican side, the silence had been deafening. The threat of violence against a sitting United States congresswoman is literally coming from inside the house. And we havent heard a word from House Minority leader Kevin Mccarthy or the House Republican leaders and their lack of response does speak volumes. For more on this, im joined by dr. Joanne friedman, an awardwinning professor of history and american studies at yale university. And shes the author of The Field Of Blood the violence in congress and the road to civil war. Joan, thank you so much for joining me today. I have so many questions for you, but it seems to be an increased pattern from the republican party, not only to fan the flames of violence, but then not to say anything to denounce it. What do you say about the moment that were living in . I think youve put your finger on precisely one of the biggest problems that we have right now, among the many problems that we have right now. And the silence that youve referred to, thats not how a functioning democracy works, the silence is essentially normalizing it. And i think on a lot of fronts, were seeing things that are to many people obviously not how a functioning democracy worse. People being shouted down at School Board Meetings, the banning of books, the gosar video. There are any number of things that i think are happening that people are perhaps shocked by, but theres, as you put it in some cases crickets. The silence means were letting those things float by and declaring them in some ways normal. One of the things that are striking, you are a history buff. You have actually documented past American History where this type of animosity percolates and actually leads to something very deadly, a civil war. Talk about what we can learn from the past and how Americans Everyday americans, can ensure that were turning down to temperature to help avoid what can be the wrecking of our democracy. Sure. Well, indeed, my most recent book, The Field Of Blood, is lurking over my shoulder there, was about basically a population of politicians who understood that the demographics were not necessarily in their favor, and they turned to violence to maintain their hold on power. And in the case of the time im talking about, im talking about the 1840s, the 1850s and southern Slave Holders who were worried about losing the reign of the slave power, basically, that they were going to lose power. And so they used threats is violence. But significantly, in relation to what were talking about today, threats suggesting that they were going to be violence, showing that they were armed, but not necessarily using their weapons. Using threats to suggest that if they didnt get cooperation, then there might be something worse. And thats the power of the kind of threatening behavior were seeing now. You actually dont have to act on the threat. You just have to be believable in offering it. Well, and the parallel that you have described of the i think its leading up to the sill war are the dynamic demographic changes that were experiencing today in america. Oftentimes people call it latinos and africanamericans minorities, but when you look at the numbers, were talking about 40 million americans strong. And that by im sorry, 40 of americans that are people of color. That by any means is not a small population. Do you see parallels of why we are seeing this rise in rhetoric against members that might be of a different race and origin because of this idea that america is no longer as white as it was, but at the same time recognizing that the majority of americans came out and voted was a multicultural america of all hues and colors and that is the friction that were seeing. Well, absolutely. Thats where a lot of this is being aimed, right . It is a matter of demographics. It is realization. That the United States is shifting in its components, as all nations do, different populations have more or less numbers. And the United States is increasingly becoming a notwhite population or to put that differently, a more diverse population, which is in line with what the United States has always been and should be. But people who are tlebd threatened by that are, indeed, trying to close down conversations, normalize violence and do a number of things, like my southern Slave Holders to encourage people who disagree with them to be compliant. If youre at a School Board Meeting and being shouted down, some people will decide not to be part of the school board anymore. If youre in congress and theres this ongoing threatening behavior, you might decide not to run for a second term and then this kind of bullying is having the precise impact that people wanted it to. In 2013, Southern California resident melissas 4yearold daughter grace was diagnosed with a rare aggressive form of leukemia. But as her child underwent treatment at local los angeles hospital, she noticed there were several other kids there from the same neighborhood who were also suffering from the same disease. It turned out the children all had something in common. They lived directly downhill from a Nuclear Research lab that had a history of Mishandling Waste and even had an accident that was covered up for years. The story is now the subject of a new documentary from msnbc films called in the dark of the valley. It airs tonight at 10 00 p. M. Eastern. Heres a clip. I met a family that said, we live on your street. And granted we live on a long boulevard, it is three miles, but they lived on our street. And she said, and my neighbor had the same exact brain cancer that my son had. And there were two of them. Neighbors, plus my daughter, thats three on the same street. And for a long time we couldnt find the connections. And it was about a year after that that someone mentioned for the first time the Santa Susana Field Lab. I never heard of it. We had to start wrestling with the fact that maybe our childrens cancers could have been avoided. Maybe other children were in danger. Maybe our government hadnt protected us the way they should have. Melissa joins me now, a Grassroots Coordinator at parents against the Santa Susana Field Lab. Her daughter was diagnosed with leukemia in 2014. Thank you for joining us. Before we start the conversation, i want to see how is your daughter doing. Thank you for asking. She is actually almost four years cancer free after a bone Marrow Transplant that saved her life. I think what was one thing that the way the clip ended, it was chilling, you said you felt the government wasnt there. How were you able to galvanize other parents, how were you able to shed light on this without the resources often needed for these types of investigations . Well, the hard thing about our situation, which is actually unfortunately common across america, there is every 1300 super fund sites, 107 are radioactive. The parents are often the ones who have to come up with the studies, they have to come up with the resources. We were very fortunate that that work had already been laid out for us, they had done a 40 million radiological survey in 2007. So we had some of the resources we needed. But as you said, it is exalting and the burden often falls on the people who already suffered to try to make the difference so that no other children suffer. And something that were learning more basically is how the fires in Southern California have impacted this the containment, so to speak, of a lot of the carcinogens. Can you speak about that . Well, the woolsey fire was the thing that we had been most afraid of for years, because when you have 3,000 acres almost of fields and wildlife, it absorbs those contaminants into themselves and when they catch on fire, it releases chemical and radioactive waste into the ash and the smoke and there was actually a recent study that found contamination after the woolsey fire specifically identified from the Santa Susana Field Lab over nine miles away in one of the local cities. So the woolsey fire has shown us how Mobile Contamination can be and we think with, you know, Global Warming and climate change, the risks of People Living near sites like ours, those risks are only going to go up until those sites are completely cleaned. Melissa, in the documentary, i can only imagine how hard it must be to have to relive those moments. How were you able to not only persevere having im sure something so difficult in those conversations, but also bring other parents to the forefront to have conversations of children that are still maybe sick . Well, i think for me my faith had a lot to do with me being able to do this, the support that i had from my family, from our team, from other organizations who have been doing this even longer than i have. But it wasnt until we started sharing this stories of our children as painful as that was for me and the other families that youll meet in the documentary, i think people didnt realize that there is a face, you know, i think for a lot of elected officials, were just statistics and for the department of energy, who is one of the main polluters, boeing and nasa, you know, it is easy to it is easy to make choices when youre only dealing with statistics, but i think when they start to see children and they start to know our faces, you know, it is harder to do that. And i think realizing thats the cost helped it to be not easier, because it still is always painful, to have to go through i relive that story every day. But thats the only way that well keep other children safe and i would rather deal with my pain, rather than seeing new children in my community diagnosed.
