emerge into just how sim pa theting our last president was to the insurrectionists that threaten his vice president's life. and while the president's infrastructure victory does provide democrats with something substantive to run on next year, they still have to do so against the enduring legacy of trumpism, assisted by gop state lawmakers pushing voter suppression laws and jerry manned maps. as you can tell, we got a big political show tonight. plus, in a moment, the saga of the late ahmaud aubrey joins me after what i can personally tell you was an intense week in the trial of the three georgia men charged with his murder. joining us, aubrey family attorney ben crump, who promises with me not one, not two, but possibly 100 black pastors will join us come this thursday at the court to support the aubrey family will, in fact, not just that trial, but also the first week of kyle rittenhouse trial in wisconsin. we'll tell you why there is more on trial in that case than the defendant. but first, joining me now congressman hakeem jeffreys, democrat of new york and chair of the house democratic caucus. congressman jeffreys, welcome back to politics nation. before we talk infrastructure, though, and other politics, i have to ask you two questions briefly. first though, what are your thoughts as you follow the developments in the january 6th investigation steve bannon indicted, mark meadows a no show for his deposition. and a federal appeals court temporarily blocking the house select committee question for trump white house records, your thoughts an all of this congressman? >> well, great to be with you, reverend al. at the end of the day in america, no one is above the law, not the president, not the president's chief of staff, not one of the president's lackies and steve bannon and the january 6th commission on a bipartisan basis is going to continue to follow the facts, apply the law, be guided by the constitution and uncover and present the truth to the american people, no matter where it leads. >> all right. well, my second question, congressman, is in a moment, we'll get into the courtroom drama in georgia earlier this week at the murder trial of the three men who killed ahmed aubrey, a lawyer for the defense said he does not want to see anymore black pastors in court a day after i visited the family there. so between that trial and the trial of kyle rittenhouse in wisconsin, america is, once again, debating the role of race in our criminal justice system. your response to this week's proceedings, congressman. >> well, it certainly has an intense week. we need to see justice done and make sure that these basic principles of the rule of law of liberty and justice for all, of equal protection under the law apply when there is a white defendant as in the case of both of these trials and certainly when we see compelling evidence that has been presented in terms of the vigilante-like behavior resulting in the death of ahmaud aubrey. >> now, let me go to this. this week the national action network of which i'm president you are a member joined the national urban league and the naacp to release our first ever civil rights scorecard of all 100 sitting u.s. senators based on their voting rights records. how they voted on covid recovery and where they stand on eliminating the filibuster. bs and cser were not an option. you either passed or failed or got an incomplete. if you say you voted for covid recovery and voting rights but not common in out in favor of let's say not coming out in favor of altering, if not eliminating the filibuster. as you might imagine, every republican, senator, failed. but several democrats received average scores resulting in grades of incomplete, usually over their stance on the filibuster, even with the infrastructure bill behind you now. is the window closing to install the kind of federal voting rights legislation that can or could have curtailed what we are seeing out v at a state level? >> two things in front of us that we have to accomplish before the independent of the year. one, we have to get the build back better act over the finish line. the bipartisan infrastructure agreement was a victory for every day americans. we're going to fix our crumbling bridges, roads, tunnels, airports, our mass transit system. the largest and most meaningful federal investment in infrastructure in at least a century and it's going to create millions of good paying jobs. with respect to the build back better act, we're going to cut taxes for working families. we're going to lower healthcare costs and child care costs and other expenses confronting the american people, but at the same time, we have to defend our democracy with the fierce urgency of now. and the only way to do that is to get both the protect the freedom to vote act over the finish line as well as the john robert lewis voting rights advancement act over the finish line and dealing with the filibuster appears to be the only way to do it. so i'm just thankful that the civil rights groups and your voice and the voices of others continue to be raised and holding all of us accountable for such a time as this, failure cannot be an option. >> this session we're talking about. now, house democrats are now past the legislative hurdle of passing the bipartisan infrastructure framework. but you still have to go out and sell it. by that, i mean run on it next year in the mid-terms. but i'd imagine that under even the best circumstances, many of the physical benefits won't be tangible for some time. how do you bridge the gap with voters ahead of the mid-terms? >> well, it's important to deliver for the people, the build back better. and we've done that with the infrastructure agreement. we will do that with the build back better act. there will be some policies that will continue to be immediately felt. such as the, tension of the child tax credit where millions of american families with children lower income families, lower families and middle class families are receiving a monthly tax credit, hundreds of dollars that is being used to pay the child care or for food or for medicine or for educational expenses or for clothing or for housing. that's a tangible benefit. the republicans want to take it away. we are going to extend it. we are going to expand access to child care, expand access to elder care and home care and healthcare. these are all benefits that should be felt immediately and there is not a single republican is going to vote to support. so we're going to have to draw the contrast about what we've done for every day americans and what the other side does, which is just continue to focus on the wealthy, the welloff and the well-connected and then we will have a great shot to hold the house and hold the senate. we can't mo lose. because losing means kevin mccarthy is in the majority along with marjorie taylor green, lauren boburg and matt gaetz who will be oner running the house of representatives. that will be a disaster for every day americans. >> all right. i have to leave it there. thank you, congressman hakeem jeffreys. by now, you have all haebd about the comments made by one of the defense attorneys given gogh during the ahmaud aubrey murder trial. listen. just like all of you, i was taken aback when i heard his words as i said in a statement this week, my presence was at the invitation of the aubrey family, asking the judge to bar me or any minnister for that matter of the family's choice undisclosed the disregard for the value of human life that was lost and the greebing of a family in need of spiritual and community support. with me now civil rights attorney i call him the attorney general of black america benjamin crump and marcus aubrey, ahmed aubrey's father. let me go to you first, attorney crump. i want to start with you and have you weigh in here on the madness that occurred this week after hearing and seeing what i can only describe as a side show to the trial at the hand of the defense attorney, his mention of me into the courtroom completely off road from the task at hand, which is to seek justice for ahmed. have you ever heard of such a ridiculous notion in a courtroom before? i mean, take a listen to this now we have the tape. >> the idea that we're going to be serially brigg these people in to sit with the victim's family one after another, obviously, there is only so many pastors they can have and the pastor is al sharpton right now. that's fine. we don't want any more black pastors or jesse jackson, whoever was in here earlier of the week, sitting with the victim's family trying to influence the injury. i'm asking to court to take appropriate steps to make sure the gallery, which is already limited if this case isn't being utilized for a purpose that could be view as improper. >> now attorney crump, i have been in the civil rights struggle for decades. i went to numerous trials, police killings, and racial killings. i have never had anyone suggest that i or minnisters should not be allowed to sit with the family at a trial where they are waxing people that killed their child. have you any reference to this at all in your experience? >> it is a completely assenine position that he took, reverend al. it is offensive on every 11, especially to marcus aubrey and one the mother and father of ahmaud aubrey who invited you to be with them as they go through this very trying time, just trying to get justice for their son, who was lynched for jogging while black and so, reverend al, attorney merritt and i, we think it's an effort for him to try to get a mistrial because the evidence is so overwhelming that they pursued, profiled and shot aubrey down like a dog and so, hopefully, you will find it in your schedule thursday 11:00 a.m. to bring as many black pastors as possible down to brunswick, georgia, to say that we depend on our faith leaders in our community just for our basic culture. >> no way, well, we'll be there thursday. i'm talking to many minnisters around the country for a national day to show up and to be standing there for the family. mr. aubrey, this attorney also went on to say my presence or any presence of high profile members of the african-american community would intimidate the jury. now, i was there for spiritual support as a member of the ministry to help you and wanda seek comfort and strength at your request. you came and wanda came to savannah three weeks ago, you sat through the whole service i preached at and asked me to come. but what the attorney failed to comprehend here is how intimidated your family must be and i couldn't really see it graphically until i was sitting there. you are sitting in a courtroom day after day just a few feet away from those who killed your son behind their families there supporting them. i mean, what is your thoughts and feelings as you sit there, which is why i assume you need the comfort and people out there to support you? >> reverend al, number one, i give all glory to god because god led you all to me and my family. you know it really does something to my family. they think we don't want to be there when these three men lynched and killed my son for nothing. killed our son for nothing. you all are there for the right reasons, you know, to give us peace and prayer. and you know so the reasons are terrible. it's timeout for it. you know, it's just, i really can't explain it no more. because it's so terrible. >> is it your feeling, though, that it was necessary, you wanted this kind of presence and comfort is the reason you invited me to come? >> yes, sir. yes, sir. and i'm thanking god for you. because [ inaudible ] this fight is for equal justice for african-american people. we thanking god for you. when you just make me feel you know relaxed and just hear a lot of my prayers, because i know you are all there trying to help us get justice. are you a preacher, what more can a person ask for? >> mr. aubrey, when i came and sat in that courtroom, it was to help and support your family. ahmed's death was a tragedy that showed that the america of today is still no different from generations past. what i described as a 21st century lynching. i have said to many before that ahmed could have been my son. he was your son. >> yes. >> he was wanda's son. >> yes, sir. >> but it was your son. what do you think about him today and the trial, when you think about the trial and think about your son, what comes to mind? >> because my boy called me every day, missing him. there ain't a day he missed not calling me. now i'm missing them calls. because you know he was a young man that loved his family. he called his mama every day. he called his brother. you know, and that's a double mistake, my children. i got the grandchildren, they asked where their uncle at. i look at them, i can't explain that to them. i'm at a pause, i don't know what to tell them when they asked where their uncle at. i can't tell them he got killed by three white men. i can't tell them that. they ask where he is at. >> attorney crump, you and attorney lee merritt have stood by this family and fought vigorously. i also see some parallels between this case u case and the kyle rittenhouse trial that is also under way. both cases have nearly all white juries, also the way the judges have handled the sensitive racial components and allowed obvious double standard in the courtroom is staggering to me. in the rittenhouse trial the two people shot dead are not even allowed to be called victims by the prosecution. taking note of this. do you think there is an alarming pattern in our legal system when it comes to making it difficult. for racial justice to be served? >> reverend al, as you know, in my fought overseas in the legalized genocide of colored people, it's almost as if they're killing ahmed aubrey again in brunswick, georgia with the implicit intellectual justification of discrimination and when you think about kyle rittenhouse, the obvious bias of the judge in favor of a young white man who killed two unarmed people and he just continues to grant ruling after ruling in his favor. could you imagine if that was a young african-american man and he killed two unarmed people, the judge would not give him any favorable rulings. and reverend al, i have to say this, we always speak truth to power. could you imagine if it was a black father in and a black son who profiled and chased a young unarmed white man and shot him down, what will they be saying in brunswick, georgia? much of the blame belongs to the former guy, donald trump, who uses bully pulpit to spread lies and madeup information about the pandemic throughout 2020. but trump has been gone from the white house for nearly a year and plenty of other republicans are still spewing disinformation. like wisconsin senator ron johnson, who said in october there was no approved covid vaccine in america. even though the fda approved the pfizer shot in august. or florida's senator marco rubio, who has been on a year long crusade to fire fauci. it kicked off late last year. with a treat falsely complaim claiming the nih administration lied about masks failing to provide the full comments of dr. fauci's comments. speaking of lies in the early days, florida's governor ron desantis falsely claimed in april 2020 the coronavirus hadn't killed a single american under 25 as he fought to keep schools in sessions and beaches wide opened for unmasked party and spring breakers. these are just a few examples of how nearly two years republicans have talked out of both sides of their mouth about covid. giving their voters license to believe whatever they want to believe. science be dammed. even republican who's don't engage in outright lies often speak of vaccines and masks and coded terms, emphasizeing freedom of choice over safety and personal responsibility. and we are now seeing the steep calls we all paid for these tactics. republicans have aided and abetted covid disinformation for short-term gains, but it doesn't take a brilliant pundit to see a political strategy that literally kills off your most loyal supportersers is a long-term loser. i gotcha. here comes the interception. oh... -shawn? >> well, so, the investigation is certainly a good thing. this is no doubt a step in the right direction. let's look at all the steps that it took to get here. this is because of congressional force. this is because the house voted and said, listen, we will uphold our subpoena power here. there were republicans that also voted for that. my verdict has always been the speed of the committee. nor for results. for people like meadows as well as bannon, they ultimately know they can try to hold on tight as long as possible, but there are junior members of trump world complying. it's liking like the committee may look toothless, the speed about which the american public is coming to learn from the committee about the very details we deserve to know of january 6th. i've always worried about information. i truly believe we need to see an avalanche of information about the insight of january 6th make its way to the american people. we need that. >> maria. >> well, it's what's really important is you see the department of justice coming into act. it sends a signal specifically to mark meadows and others reluctant to show up. they doth thought the subpoenas didn't have taste and allows people seeing people creating an american insurrection for a peaceful transfer of power, there will be consequences. my biggest concern is we won't do it fast enough. they will wait it out until there is a republican congress now dom nighting the house. so that investigation goes out the door. it's important for american people to pay attention and make sure there is accountability by the department of justice and it will be interesting to see how steve bannon reacts on monday. so far the information we've learned is he has done zero home in trying to get the papers demanded from him. zero home in trying to do the checkoff list that he is required by law that was done by congress and the fact that he's so reticent and he hasn't started the process demonstrates he feel his se not touchable. the other thing, let's remember, he keeps touting executive privilege. steve bannon he was not an employee of the president at the time. he was a private sid. so again it's demonstrating that no one is above the law. >> i know you have all heard this audio, president trump was on abc jonathan karl responding to the insurrectionist chant to hang former vice president mike pence and essentially saying he understood the insurrectionist' anger. they felt the elect e lex had been stolen. rina, how do republican lawmakers hear that kind of callousness toward other conservatives who served him? and yet they still carry his water and try to curry his favor? >> all this is a bad sign for mike pence. this is all about mike pence having had his eye on becoming the next president of the united states after joe biden. this is all that pence wanted. he conducted himself in a way that speaks to both sides almost. but now i think we can really expect to see pence lose his cool because trump with his signals for 2024 and people still coalescing and almost supporting trump from the republican establishment all bodes very poorly for pence. this is unfortunately normalizing today's republican party. people know if they stand out of step with trump, they stand to lose fundraising, but more so, more so what is a danger for democracy, what i alluded to is the real lack of faith that voters on the republican side have in our cons tuesday. i hyde tied it to the faith of the american public, in large, not just republican voters. we need to see that government is functioning and meeting the moment at the time we need it to meet. otherwise, people have short attention spans. they forget. we have so for away from january 6th, 2021. my worry is mike pence will move forward as glen duncan is governor elect and mike pence will take on the veneer more so and think he can capitalize. we must remind these folks they are tried to trump world over and over. >> nau maria, teresa, the republican dominated state legislature in wisconsin unveiled this latest congressional map for the statement one which like texas locks in gop dominance of the state's electoral districts. the difference in wisconsin's case is that you have a democrat governor who has vowed not to sign it, setting the stage for legal fight. so both states serve as reminders of what gop state lawmakers are attempting or have succeeded in doing to add restrictions, often under the guise of voter integrity. given your work on behalf of latino votes or voting rights, am i wrong to assume that you see this where the biden administration should throw its full weight domestically, finally? ask your health care provider today about once-weekly ozempic®. oh, oh, oh, ozempic®! you may pay as little as $25 for a 3-month prescription. this week i was elected to be the first secretary of the commission on the social status of black men and boys. this federal commission is examining the social disparties that disproportionately affect black males in america. it was introduced by representative frederica wilson, a democrat of florida, who joins me now to tell us more. congresswoman wilson, you have been fighting for several years to pass this legislation and now either it is a national law. together you and i and the commission will review police brutality, gun violence, fatherhood, recruiting black male teachers, welfare reform crime bill which includes the three strikes provision and harsh sentencing guidelines. the school-to-prison pipeline. all of those topics will be re-visited. tell our audience what the commission's underlying goals are, you fought for it, you were elected chairman. tell us what the underlying goals are. >> well, thank you so much for being a leader on this issue. we have been together for decades in the trenches. i appreciate you having adding you as a partner as we move along this line. you know, i consider black men and boys as an endangered species. this government spend billions of dollars to help endanger species like the bald eagle, nothing, this is transformational legislation. it is so tranlz formational because no one has ever filed any legislation to address black men and boys. we just hesitate to even use the word black. but this is black men and boys who have been disproportionately side lined throughout this whole cycle we call life. black men built the capitol on their backs. they were brought to the capitol every day and as they were brought, they became human ladders. back then when the capitol was built, we didn't have any cranes or tall ladders, so they were brought to build the capitol. they were human ladders. and they would fall to their death. as they fell to their deaths, they would build common graves or mass graves and throw them in there. cover them up and the next day, they would bring a few group of black slaves and men. so when we walk across the parking lot in the capitol, we're really walking on consecrated land. >> wow. >> so this is something that is overdue, as i speak with you now, black boys who almost died in their community are shooting each other. and we know that all have a little tiny thing on their record and when that happens, that they're side lining them for life. so this commission is going to counter all of the injustices they have been doing from slaveing to -- we have a lot of work ahead of us. i'm excited to work with you and 17 other members. we have to look at all of the -- we have assistant attorney, larry elder and i was moved by his overwhelming support. >> yeah. this is a bipartisan, it's a bipartisan commission. we may not agree on politics, but it's bipartisan. which is amazing. you know, studies show that perhaps the most dangerous issue facing black boys in our country is racism, itself. too often they are perceived as criminals. by the time they reach the age of 5. they are labeled thing went, not rowdy. they are viewed as hardened criminals, not misguided youth. then as they grow, they have low rates of high school retention, the records related to joblessness and incarceration, more than two-thirds of black males end up serving time in state or federal prison. while black males overall make up roughly 13% of the population they represent nearly 40% of all men serving time in prisons. how can that be solved, congresswoman?
