Loyalty. The grand jury has indicted bannon on two counts of Contempt Of Congress. That comes 23 days after the criminal referral was sent to the Justice Department because bannon refused to comply with investigators. Bannon is expected to turn himself over to Law Enforcement on monday and scheduled to appear in court that afternoon. He faces up to one year in prison and 100,000 fine if convicted. This is notable because no one ever claimed Executive Privilege which is the excuse he gave for not cooperating has ever been indicted by the grand jury for Contempt Of Congress. Only time will tell if the bannon Executive Privilege defense will hold. Here is why it is so interested in talking to him. Investigators pointed to a Conversation Bannon had with trump on december 30th. Bannon reportedly urged trump to focus on the electoral college. They are looking at the days leading up to january 6th. He said all hell is going to break loose. And his participation in the January 5th Meeting at the hotel where the plans to overturn the elections were discussed. That, of course, was the day before the Trump Supporters stormed the capitol. Then Vice President mike pence was there to preside that day and how the mob of Trump Supporters chanted hang mike pence. In a interview conducted by abc news chief correspondent Jonathan Karl asked if he was worried about pence. Were you worried about him . No, i thought he was well protected. I heard he was in good shape. I had heard he was in very good shape. You heard the chants. It was terrible. The people were very angry. Saying hang mike pence. Its common sense its common sense you are supposed to protect. If you know a vote is fraudulent, how can you pass on a fraudulent vote to congress . Common sense. That was trumps response against the violent threats against his own Vice President. Joining me now is kyle chaney who has been covering the aftermath of the insurrection on january 6th and joyce vance. Kyle, walk us through on how we got here today and what we can expect from Attorney General garland. So, this was a major moment for the January 6th Committee. Bannon was a test case for them. They knew they were going to get resistance from trumps inner circle or advisers who helped him in advance of january 6th. The fact the Justice Department is bringing criminal charges against someone who refused to cooperate may be a warning shot to others thinking about resisting. Mark meadows. He may now think twice if i will refuse to appear or not remotely cooperate. The fact the Justice Department moved as quickly as they did three weeks is nothing in doj time. The committee may benefit from this. Joyce, what kind of criminal charges do you think will stick right now against bannon . So the charges against bannon are relatively simple and clear. Hes charged with two counts of two usc 192 which makes it a crime to ignore a congressional subpoena. He is charged with both failing to produce documents and failing to testify. And the most interesting line in this entire indictment is the conclusion before doj gets down to the Charging Language where bannon failed to comply in any way. He did not make an effort or try. He thumbed his nose at congress. That is the basis for this indictment. Kyle, one of the things he is asserting is Executive Privilege. For the claim that steve bannon had right to assert Executive Privilege or trump could do that for any conversation he had with bannon is thin. It made it an easy call for doj now. The history of Contempt Charges from doj is not that great. It is not many cases which have gone through conviction in the history of the Contempt Of Congress charges. This was as easy a case it gets in terms of the outside adviser. Not someone in the white house. Not someone in regular touch with donald trump. Happening to helped him strategize. What happens now, joyce . One certain is a lot of individuals are looking at what happens to steve bannon and if mark meadows will appear now. What will unfold . We have a couple of things happening at the same time. The Bannon Indictment shows doj has the fortitude to protect congressional ability to engage with its witnesses. Also in the District Of Columbia courts, we have the Lawsuit Proceeding where Trump Administration is trying to block turnover of papers and Executive Privilege is at stake in the lawsuit. A District Judge held that trump cant assert Executive Privilege once biden decided it is not merited. Biden has articulated a clear reason for turning over papers in the situation which is the importance of getting to the bottom of january 6th. If the d. C. Circuit as analysts expect, it will be difficult to assert Executive Privilege. I think we have gotten used to talking about Executive Privilege in the glorified terms. It is meant to protect iternal deliberations in the white house. Not campaign activity. I think some of these folks are now at the point where they will have to face the reality that they either comply with the subpoenas or they face serious consequences and for those who hope to have a Second Act Or Third act in political life, those consequences are startling. I think the committee is getting ready to rock and roll. One thing you are mentions is how unusual it is. One thing trump is trying to claim and why he doesnt want to hand over his notes is trying to protect future presidencies. Lets keep in mind this is the man who tested all of the boundaries of democracy and stretched the constitution to its limits. What do you say to individuals trying to say, yes, he is trying to protect the future of the democratic democracy and other individuals who may hold the oval office in the future . One thing we can be certain about is the former president is not trying to engage in principled stance to protect the office of the presidency. I dont think we have time to go through the litany of all of the occasions where he abused that office and tried to use the white House Counsel as his personal lawyer. The white House Counsel is the lawyer for the presidency itself. This defense, i dont think, holds up long run. Trump was not engaging Executive Privilege. He was engaging in self protection. One of the things we are hearing as the indictments are still unfolding is the experience of the day and how unprecedented it was with the transfer of power in a non peaceful way. You were there. Can you remind us how it felt to be there that day . When i was on the floor and whisked away. The Vice President and others and although the Vice President was whisked away from the senate. I dont think we understood what was going on. We didnt have access to televisions and did not see what was happening. They came in and told us to get out our gas masks. Then we heard the crowds and we heard the banging and smelled chemicals in the air. That day, we were one. Republicans, some of the younger and newer republican members were trying to make sure we were safe. They didnt know where to take us. We couldnt escape. People came to the capitol that day to kill us. I dont think we really understood that until we did the job we were supposed to do. I dont want anyone to forget that people came to the capitol to kill elected members of congress. That that hate and violence that is dividing our country is something we all need to worry about because it is attacking the very fundamental principles of democracy. I think what was harrowing was there were so many people there that did not expect this and to your point, it was there to cause grave harm. Some folks are saying the January 6th Committee is taking too long. What do you say to that . I think it is very important that the work be done as meticulously and thoughtfully and thoroughly as possible. First of all, you should never hurry anything when you talk about the fundamental insist tense of our country. Two a lot of people have not been cooperating. We have basic freedoms. You see people not willing to come forward. Not willing and refusing to respect the authority of congress and oversight. We have to be very careful that we not harm any individual right, but we get to the truth and i hope americans watching this will really think about what they are watching in this country. I want to pivot a little bit to the work that folks are actually elected you to do. We saw the Infrastructure Bill that got passed. Now were seeing whether or not were going to get the Human Infrastructure passed in the next couple weeks. One concern were hearing from Senator Manchin is saying inflation is too high and we should postpone the Infrastructure Bill. At the same time, put the build back together bill. What do you say to that . First of all, there are many economists and nobel prize economists and larry summers. I dont like calling it a human Infrastructure Bill. There are a lot of things in it. We know Small Businesses need to get people and big businesses need to get people back to work. We had 4 million women leave the work force because they cannot find child care. Thats in the bill. There is additional money in there to get lead out of every water pipe in america. 50 of children tested in the country have lead in their blood. It is going to help Build Resiliency in the supply chain. It will build out ev chargers. It deals with a lot of things like Global Climate. We have seen the hurricanes and wildfires. It is doing things to build up manufacturing and keep us at the forefront of the Global Economy and addressing Global Climate issues. There are so many things in the bill that will help every single american. I think we are not getting whats in there out well and we are letting the Talking Points in a war of words and we are also seeing a war of action. Its not okay. I think some of the things were way out of line. The comment of the asian food, for example. I do think that this has two interesting points. This is the reason that people sometimes oppose the idea of cameras in the courtroom. It may be the judge is grandstanding a bit because this is his big moment of fame. To the extent he is acting in the way he would not act if cameras were not in the courtroom, it is not a good outcome if it has an impact on the outcome of the case. Maria, the other thing is judges work hard to protect the rights of the defendant. It appears it is not fair when the judge says you cant call them victims, but rioters and shooters. It is Kyle Rittenhouse who is presumed innocent. For that reason, words like victims are frequently kept out of the trial because it suggests to the jury that the defendant is already guilty. It is an Uphill Battle for the prosecution. We live in a system where we believe it is better that ten guilty go free and one innocent be convicted. I embrace that system. I think we are seeing sometimes when it is a particularly repugnant defendant, the way that creates tension and challenges for the prosecution. I think a lot of the debate of whether or not to call these individuals victims or rioters or looters, sadly, they have passed and cannot be convicted for what he is trying on attribute them to be. That, i think, is what caused discord. One of the things i want to pop up is the oped you wrote talking about how Kyle Rittenhouses Self Defense Claims play out. You know, a person is entitled to use self defense if they reasonably believe their life is in danger. You know, you imagine being cornered by a gunman. You are allowed to shoot back or use fatal force. Under wisconsin law, you lose that privilege if you are the provoker. You cant start a fight and when you lose, say it is all your fault. Even under wisconsin law, in that scenario, if you believe that you have no other choice, no alternative, your last resort is to kill or be killed. You are still allowed to use it. All of those have the word reasonable attached to them. That is going to be the jurys task. If he acted reasonably. One could argue showing up with a weapon caused provocation. They will look at each of the six counts separately. If they find that perhaps he was when he fired at the man who is charged with simply wounding, who pulled the gun on him, if that was reasonable, was it reasonable earlier when he shot the first victim . The second man he shot came because they saw him shoot. They believed he was an active shooter. Each of the episodes separately is important here. On april 20th, 1999, the country endured a memorable tragedy, two students opened fire in the halls of columbine high school. 12 students and a teacher were killed and more than 20 others were wounded. At the time, it was the Deadliest School shooting this u. S. History. In the wake of the attack, the National Rifle Association Began thinking about its own image, soon after the shooting nra leadership huddled privately to plan a public response to this National Tragedy. Not much has been known about these discussions until now. This week nprs tim mack revealed that he obtained over 2 1 2 hours of recordings from those private nra Conference Calls back in april of 1999. In one section of the tape, you can hear the nra brass confront a choice, whether to approach this National Tragedy with empathy and compassion or not. And this is what they decided. Take a listen. If there is something concrete that we can offer . Not because guns are responsible, but because we care about these people, is there anything . Does that look crass or like a victims fund or yeah, we create a victims fund and we give the victims a Million Dollars or Something Like that. Does that look bad or does it look well, i mean, that can be twisted too. I mean, why are you giving money . You feel responsible . Well, youre true, it can be twisted. But we feel sympathetic and respectful. Joining me now is the journalist who broke the story, tim mack from npr and author of the book misfire. Tim, thank you for joining me. I was curious, how and why were these tapes revealed after almost 20 years since the incident happened . Why now . Well, i cant really get into sourcing details, but it was just something that came out over the last few weeks and something that we tried to analyze and get into and report out as quickly as possible. Im wondering of the timing. One of the things that was quite interesting as i took a listen to one of your interviews was how they were trying to do the morally correct thing and acknowledge that there was a tragedy and how perhaps their implicit support of a lot of these guns that were used might actually help ease some of the national pain. But they chose the other side. They chose to say this was not their fault. They doubled down. Talk a little bit about that and what you think it did to imp pli indicate them for their future of where they are today. Well, what is so interesting about this is that you can really see the wheels in motion. You can hear on these tapes senior nra officials thinking about the different processes and different options that they could take and then choosing one in particular. You hear them thinking about a softer tone, one in which they might cancel their convention which was being held not long after the shootings this denver not far from the site of the shootings. You hear them as you heard on that clip consider a 1 million victim fund. But instead what they conclude is that any sort of softer tone will be an admission of responsibility or some sort of admission of complicity. And that is where the nra kind of decides on its longer term strategy, from that shooting on and sadly more shootings to come after, that they are not going to concede any ground and they are going to take a double down no compromise approach. Take a listen to what Wayne Lapierre said right after the sandy hook shooting. The only way to stop a monster from killing our kids is to be personally involved and invested in a plan of absolute protection. The only thing that stops a bad guy with a gun is a good guy with a gun. Tim, what strikes me most is that after the Columbine Shooting to today, weve had over 231 school shootings. Of those, 304 deaths. And 485 related injuries. It is as if they doubled down and did not care and they turned their backs on families that could have been not grieving for the loss of their children. Speak a little bit about where we are now based on those findings address the fact that the nra basically imploded. Well, you know, the nra is in its most serious financial and legal trouble it has ever been in more than 150 years. They are in incredible danger, Mortal Danger almost. The new York Attorney generals investigation and lawsuit into the organization seeks to shut the organization down completely. You played some tape from Wayne Lapierre after sandy hook and it is really interesting to kind of see the echos from columbine and sandy hook to parkland and onwards and the strategy the nra has used over that period of time. In my book, we kind of discuss how the nra came up with that line that you had Wayne Lapierre speaking to. And kind of the alarm that that position created actually within the nra itself. There are a lot of folks who didnt believe and agree in that sentiment. And one of the last things that i found most striking is how they talked about some of their own members. They called them whackos, hillbillies and idiots. And i cant imagine that going well with their membership. Sadly it seemed as if they knew that the tension that they were creating among some individuals that were Gun Object Owners were going to impact and who knew that they were forecasting what is happening now.
