accusing bannon for not producing documents and not appearing for a deposition. this indictment is a first of its kind. no one has ever been prosecuted for contempt of congress after exerting executive privilege. attorney general garland's justice department sending the clearest signal yet they will uphold congress's subpoena power, and it is not afraid to punish those who defy the orders. it is a major escalation, frankly, a necessary escalation, and a huge win against the maga terrorism attack of january 6th and the january 6th probe. the question is, what is bannon hiding? why doesn't he come in and talk? he was at the willard hotel insurrection headquarters on january 5th with rudy guiliani, bernard kerik and john eastman, the author of the now infamous manual for a coup. there was bannon on his podcast the day before the attempted coup. >> all hell is going to break louis tomorrow. just understand this. all hell is going to break loose tomorrow. it is going to be moving. it's going to be quick. >> that is what the committee wants to know about. and bannon's loyalty to the exblogger in florida could land him behind bars. this move also sends a warning to other trump ally who is are refusing to comply. trump's chief of staff, mark met owes did not appear for deposition today, on trump's orders. now he faces serious legal jeopardy. the committee state, quote, mr. meadows' choosing to defy the law will force the committee to pursue contempt. mr. bannon, mr. meadows, and others who go down that path won't preveal. joining me now, neal cattial. emily -- and former legal prosecutor john flannery. thank you so much. neal, i will start with you, star of billions, and one of the most brilliant legal minds that we know. what is the significance of today? what is the significance of the d.o.j. saying, you are going to jail, do not pass go, do not collect 100,000? you have got to turn yourself in for not showing up before the january th committee? >> it is huge. i couldn't say it better than merrick garland did in beautiful statement today in which he said this investigation is important to protect the rule of law. but also equal justice under law. because we have had a regime for four years in which attorney generals coddled their friends, their trump friends, and threw the rule bucket at enemies. bannon is indicted for a simple reason. he's afraid to go and tell the truth to congress under oath of what he did. i have lost, tre, honestly, of how many times trump advisers have been criminally indicted as a whole. this isn't even bannon's first indictment. he was already indicted, and convicted, once before. but this up with is a bigger deal than the past ones. it is bigger because it is not about the lawlessness, fund-raising shenanigans like his last indictment. this is about the heart of our democracy, what happened on january 6th. and what bannon, trump, and all of these people did to have the first armed attack on our capitol in a couple of hundred years. >> emily, i have to ask you, now that bannon is going to be turning himself in, is this going to have the trickle down effect that the dodge hopes it has? are there going to be other sort of people who have been obstructionists who don't want to come to the committee who will be like, maybe you will do that to steve bannon arc big fish, but you are not going do that to me? or i have other legal avenues to justify not going in front of the committee. do you think this will trickle down or there there be other holdouts. >> bannon wasn't working for white house. he wasn't even working for the government when all this went down. he hadn't worked there since 2017. the idea he is in some zone of protection because of executive privilege is a real stretch. whereas if you worked in the white house at the time, then you are going to maybe have a more plausible claim. someone like mark meadows, who is big fish in this investigation, who is in congress, is also in a different position. but i think it shows that the department of justice is willing to get involved. and we did not know that would be the case. this is the first time the department of justice has issued this kind of indictment in a long time. >> so, john -- >> yes. >> -- as a former federal prosecutor -- look, federal prosecutors tend to be careful, they don't go after people unless they are pretty sure they have got this locked in. what are the likely things they are going the say or what they are going to sort of lay in front of steve bannon on monday? are they going to say, look, we are throwing you in jail for year? are they going to say we will drop the charges if you actually show up and testify? what will they say to bannon when he is in a dark room with one light bulb swinging? >> i don't know what the arraignment on monday will mean. it won't mean very much. but after the district court decision which really doesn't matter whether you are a private person or working for the white house -- it basically says there is no privilege. that's how they are operating. you have to conbetter about a different privilege, the fifth amendment, which would be effective in terms of answering questions, but not for the documents. one of the questions, as we have seen with the house committee, we have seen how long it can delay. this is significant. the timing couldn't be better for those of us who was on the attorney general's case, saying he was inert, where was he, what was he doing? that's improved by the fact that he acted within a couple of days of the district court decision and at a time when meadows is trying to follow what bannon did, which is what he failed to do. a, very complicated facts. i didn't produce the documents. i didn't show up. and i gave you the thumb. and i said my defense is whatever the privilege was that the president says. and the court has basically said, sorry, the person who has that privilege is biden. just as in an earlier case when we had ford and carter both agree there was no privilege when nixon wanted certain documents and exhibits not disclosed. so i think, basically, we have a frivolous defense here. but we have a justice department that's awakened and is doing what it needs to do. if we continue on this trend, the next thing i would like to see is an assistant u.s. attorney or u.s. attorney appointed to look at crimes. because the best that the hill can do at the end is perhaps to write a law, legislation and a report that may or may not be redacted and runs up against whatever may happen in changing the house to mccarthy or someone else, a terrible result in my personal political person. but if we had a u.s. attorney investigating this, he would have powers that historically as we have learned from watergate are much more powerful. that's my wrap on that. it is a big day, a great day and gives courage to me and otherwise who think it is past due to have a reckoning for all of these people i go moring the law and i go neuroing the constitution. >> emily, i'm curious -- i am no legal expert, but i can think of plenty committees that convene in congress all the time that invite people and nobody shows up. i remember they had asked the owners for the founders of social media groups to come in and they had empty chairs and things like that. what is different about the january 6th committee? are we setting a precedent that forever more, if somebody wants to blow off congress then the d.o.j. may get involved? or does the january 6th committee have a symbolic power that made this administration and the d.o.j. seem the say we are not blowing off things about steroids, we are not talking about teenagers on ig. what is different withb this committee? >> they wrote to the d.o.j. and asked for this indictment. you are right that people don't show up all the time. and congress has subpoena power which has existed throughout the anything's history has been weakened by the fact we haven't had an indictment like this. congress hasn't sent its own sergeant of arms to get someone who won't testify since the early 20th century. we have had a long kind of fallow period where it was really unclear exactly what kind of enforcement mechanism there is. now we know you can get criminal contempt of court. you can get an indictment from the department of justice. congress can get that if someone doesn't show up, and if congress asks for it. >> neal, in my fan flick, bannon is dragged in front of congress in a striped jumpsuit and ball and i chain on his leg. but. ly said, congress has the power, they can come in and testify. if that person ignores it, they can send the cops the drag this person in. will the congressional committee, will the january 6th committee be bold enough and brave enough to use this power one day against the former president who is hiding out in florida? >> i think all -- got used to them not having any consequences for failing to show up, and the like. that's definite low changed. there is two routes congress can take. one is something emily is referring to, the irn harnt power of congress the enforce its subpoena power. that's not each involving the executive branch. congress uses the sergeant at arms to tail someone who is refusing to tell the truth. that was not invoked today. what was invoked today is the second route, a congressional vote to recommend that someone be held in criminal content and then have the executive branch, the justice department, decide whether to enforce it. they did that today. i tell you, you know, if you are mark meadows, or even donald trump, i think you have to be really worried about the action that took place today because this was not like your usual 100-page complex legal document fulfilled with legalisms to rebut trump's bizarre claims of immunity and other things. this is a nine-page, crisp document. and every hope that bannon had to evade accountability is shredded in this document. the audience here -- this is a unique document. i don't think it is written for lawyers. i think it is written for you, and frankly, even donald trump might be able to understand it. what it says is, the congress says we need information from you, and you refuse to each show up because you are afraid to tell the truth under oath? we are going after you. and i think, absolutely, they should after the -- bannon is just the start. it starts with bannon, and then it goes to meadows. and then it goes to possibly donald trump himself. and so i think it's a long process, but one that's -- i am glad is finally kicked off. we are almost a year after january 6th. it's about time. >> neal, i have got to disagree with you there, you know donald trump doesn't read. so he's not going to look at that document. i want to play some sound. one of the things i found most compelling about a lot of the investigation into trump and his cronies, these guys talk a lot, they talk a lot and sort of make it easier the bring them in. i want to play this mash up. >> he is telling steve beenon over at the willard hotel we need to kill the biden presidency in the crib. that was the phrase, based on our reporting, in that conversation. >> yeah, because legitimacy. 42% of the american people, four-two, percent of the american people think biden did not win the presidency legitimately. uh-huh, it killed itself. you have got to jump -- call it martial law, insurrection. chill, take a deep breathe. >> this is a complete charade, the january 6th committee, this is what they are trying to to, basically bring charges against president trump to stop his sweeping victory that's going to come. >> neal, all of these things he said obviously are protected under the first amendment. he can say whatever he wants. but is there anything he has been saying or is it likely they will find things in his radio program or podcast that he said that will make him liable to the committee. >> my reaction to that montage is, my god, this person was advising the president of the united states? apart from january 6th and everything else, that is astounding the me. that person belongs nowhere near the oval office or anywhere close to it. second, i think you are absolutely right these statements call into question this guy's involvement with january 6th set of events, and probably others as well. i think the most important piece is it may go to his state of mine. in order to get the kind of criminal indictment that john is talking about -- not on contempt for failing to show up, but actually the january 6th violations themselves, what bannon's intent was at the time is going to be important. so this information -- i suspect the prosecutors will ultimately seek to get is, you know, notes, and text messages and things like that. all of that will bear on it. most importantly, what was bannon doing on january 6th? what was he saying? who was he talking to? all of that. >> emily, i want to go to you real quick on this. he is facing up to potentially a year in jail, a $100,000 fine. is it possible that steve bannon will say i am no snitch and he will serve jail time like a good mobster, a good main man to donald trump or do you think he will flip? >> it was a lot like that, jason. that excerpt is a terrific representation of what bannon is like every single day, just about every single phone call that i ever was a part of. you know, and it really -- it just shows, this is steve bannon. this posture, this i'm going to bully and use through sheer force of personality and i guess vocabulary, we'll call it -- i'm going to use these things as instruments to impose my will on whoever i want to achieve, whatever my agenda is. and that's how he felt towards the january 6 select committee, how he felt towards congress. he really believes that he is above it all. he believes that he can beat the other side into submission, that the other side doesn't have the stomach for this kind of fight narcs the other side doesn't have the resolve that he has, and that ultimately, they will back down and he will survive and he will win. bannon is the ultimate cockroach jason, this is a guy i watched from buddying up to rand paul, to cruz, ben carson, back in the day it was sarah palin. ultimately, it fell onto donald trump. and he is someone who has always been in search of that host, a parasite to attach himself onto in order to achieve more visibility, more fame, more money, more access, more power. in this dynamic that we are seeing right now, with this recent indictment, and i will say this partly because neal is on with us, i am a big billions fan, steve bannon thinks he is dollar billster. gets arrested by chuck rhodes, and he sets there across from him and he says i don't recognize your authority, i'm kaiser sosa. that's what bannon thinks of himself as in this situation. >> here's the thing, neal. this is interesting to me. when you see -- obviously, donald trump is not as nices as he acts. not as charming and charismatic. when you see steve bannon in av like that, cussing, r, insulting folks, anywhere that a person who is going to inspire loyalty. look there are people loyal to trump or trump's remaining power. but if they had been abusive, terrible horrible bosses to people is there likely there will be people who want to turn on bannon and put the screws on him? is that something that the d.o.j. has access to? >> i have been on a lot of tv with both of you guys, i don't think i have ever disagreed with you. but i have got to disagree with both of you. jason, the idea that bannon is like the emperor in sfwarz or like dollar bill in billions -- those people are competent in what they do. they know -- they actually get evil done. bannon is a joke. he's kind of like trump. he has the anti-midas touch, everything he touches turns into -- you know what the word is. so, absolutely, jason, i think, like, the most important point here is that if you are trump or if you are frankly anyone else in january 6th, you have got to worry that bannon could turn against you. this is not a guy known for his loyalty. so it's always about what's in it for himself. there is no, like, underlying principle as curt said, behind him. that's your classic prisoner's dilemma situation that prosecutors use all the time. whether you are trump, or whether you are mark meadows or anywhere -- you know, someone lower, you have got to worry that bannon might be thinking about trying to make a deal. now, he didn't have to worry about that in the last administration. yes, he was indicted before for cheating on his build the wall campaign and ultimately convicted. but he knew at the end of the day he had a get out of jail free card because president trump was -- he was the president at the time, and pardoned him. there is no get out of jail free card anymore. so a self interested frankly evil person like bannon is probably going to think about what's best for him and not anything else. >> in visage and confidence he is more skeletor. i get it. how effective are these kinds of prosecutions? i am looking at the sheet here. you know, congress doesn't necessarily have a great track record when it comes to prosecuting people, you know, go back to the '50s sort of during the red scare, they were pretty effective. how likely is it that congress will be effective in going all the way through not just with an indictment, but a full-fledged legal criminal process with steve bannon? is that something we are likely to see? or is this sort of a scare tactic to get him to come in and financially fess up? >> curt, do you want to take that. >> oh, that was to you, neal. >> sure. i think the question, jason, is not really about whether congress will be effective. now whether the justice department will be effective. this is now an official prosecution by the united states government headed by the attorney general of the united states. so congress is actually now moved out of the picture when it comes to bannon, and it is just a standard law enforcement action lick everything else. yes, kang made a criminal referral and asked merrick garland to indict steve bannon. now they have actually done it. the question whether it will be successful, this prosecution, is a rather difficult one because, honestly, we don't have them very much. the last one we had was 38 years ago. and the reason is, because when congress says, hey, come forward and tell us the truth under oath, most normal people comply with that. to the extent they don't, they have some really good reason, and that's why congress doesn't vote a criminal referral. here they voted that criminal referral. the attorney general studied it very carefully and made the decision that we should have -- you know, that the indictment should be presented to the grand jury. and the grand jury has now signed off on that indictment. so the criminal process has begun. if you are bannon, i think you have got no hope. i think this is not a hard case. he could hire clarence daro, it's not going to matter. >> fantastic conversation. thank you guys so much. still ahead, we'll talk to michael steele about trump's stunning defense of the rioters who chanted "hang mike pence". and then we'll show you how an accused killer has conclude a folk hero on the right. stay with us. this is "the beat" with jason johnson. ity. [ chanting ] trump just saying, oh, the people were angry. with pence fleeing to a secure location to protect his life. all of this because of trump's election fraud, the lie he continued and that new tape supporting the insurrectionists, falsely calling the vote fraud lend. today his ally steve bannon facing jail time for refusing to talk to the january 6 select committee. michael steele jones us tonight. i have to start-up front. you as a life long republican, you have interacted with a lot of presidents and vice presidents, right? sometimes they are close. sometimes they are just working buddies. you know, there is not always tango and cash. >> right. >> what is wrong with the relationship between donald trump and mike pence when they were in office that leads to such a callous reaction to pence being threatened with death earlier this year by the former president? >> it really goes to the heart of any relationship with donald trump. you need to understand that that relationship is first and foremost transactional. what can you do for me? not what i can do for you. so you are looking at two transactional relationships here. one between president trump and his vice president, right? and one between trump and his supporters, in the case, the group of the rioters who were calling for the death of his vice president. in the former, that is, again, a one-way transaction in which it is expected mike pence does what he's expected to do to benefit donald trump. not the country, not the people who voted for him. not even pence himself. when the vice president walks away from that, as he did leading up to the vote on january 6th, indicating that he was going to follow the constitution and the rule of law, that abridgeated the relationship with trump. trump no longer feels allegiance to mike pence because pence has clearly broken his allegiance to trump. when he has an alternative, in supporters who blindly go where no one previously would be willing to go. so he is going to honor the transaction calling for his blood saying, yeah, well, they were angry. because guess what, trump sees that pence didn't do what he was asked to do. and therefore, he's going to turn to those who support his anger and his frustration and give them the love that he will not give his vice president. so it is purely transactional for trump. this man doesn't have a feeling for any of these individuals, by the way, on either side of the transaction. hissupporters or his vice president. this is all about how he's benefiting. when one side breaks down he will use the other to exact the punishment from the other side. >> so, michael, when donald trump was president of the united states, i could understand some of the loyalty and feelty to him, because, look, he was the president of the united states. he could pardon you, he could offer you thing like that. but he doesn't have a particularly good track record electorally, lost the popular vote in 2016, gets booted out of the white house in 2020. candidates he supports are not necessarily successful. glen youngkin sid stay off my back, don't get involved, and he ended up winning in virginia. why would anyone now, people like steve bannon and mark meadows, why would anyone continue to be loyal to donald trump today when he doesn't have any official power and doesn't even seem to have the electoral juice he had three or four years ago? >> because a lot of that electoral juice still plays it self out in republican primaries. you are looking at a glen youngkin who did not go through a primary. he went through a prefabricated convention system in which they did rank choice voiting, number one. number two, they mate sure that the candidates that were in there were largely palatable, they could manage that process. it is no wild, wild west that you may see in some of the other primaries around the country which, again, trump will use to his greatest advantage. here's the question for those candidates. so you are begging for trump's endorsement. is that just all you need or want? what about the cash? trump is sitting on three quarters of a billion dollars, right? is he sharing the love with all of those candidates that he is endorsing who are standing in line breaking their back, you know, and bending over to bend the knee for trump? how did this sort of come about? how did this relationship get built? >> i started learning about the other children in our community who had childhood cancer. i was close to the site my entire life. we started a change.org petition and that's where i met nicholas and the smith brothers. they came lack baiter and said we realized we can't fit the story into something seven minutes long and we'd like to tell a bigger story. we realized that would be an opportunity for people to really experience what it's like to have their child have cancer and live in a community that's day will in danger of radio active contamination. >> nicolaus, i want to play you sound from daniel hersch. he's at the university of california santa cruz. he gives background on what you got in the ground there. i want to get your thoughts on the other side of the sound. >> the field laboratory is on a mountain. gravity wants to carry that contamination downhill. when it rains, the surface water carries the radioactivity down into streams and you're contaminating everything along the l.a. river and various streams that lead did it. >> nicholas, when you see that and have those interviews, how did that affect you as a director? did it make you want to scream from the camera and say why haven't people talked about this all along? is it something you've seen in the documentaries you've done? how does it affect you putting it together? >> absolutely. i think et really does hit hard. i think one how little was known play clips like that and how easily it is for these to get off site it's pretty amazing it isn't bigger news. we were -- people from our crew who live in that area never heard of it until we brought the project to them and we had hired these people to work with us and we're still getting emails, our film is playing at festivals and we're still getting emails from people in the neighborhood that have told us this is the first they've heard of it and their family members are lived there around the site for decades and are ill. so it hits pretty hard that something like this has been kind of swept under the rug for so long. >> i want to play you another clip from the documentary and it's one of the other mothers who is advocaing and talking about the challenges. i want to get your thoughts on the other side. >> these women have given so selflessly of themselves and fought and continue to fight. this is not what they want to talk about over dinner. they don't want to sit up and read epa documents. they want to have a good time. >> you know, melissa, it's always in sort of political environments like we need to listen to suburban moms but sometimes you can't get politicians, you can't get the press to pay attention. share with the audience what are some of the challenges that you and other mothers have faced trying to bring attention to the fact that not only are you guys basically on a former nuclear site pumping out chemicals but there are increased cancer rates for children and adults in that area. >> well, i think, you know, pretty much in every situation we have to overcome the hysterical mom stereo type is an easy way to silence people that maybe not scientists but they notice in their community that it just doesn't feel right. they -- we have government officials who have listened to us representatives brownly and sherman who have been fantastic out here in california but seems like as far as you go, there is an invisible force kicking us back and i think that's because there is corruption within some of the government agencies that are meant to be protecting us and we find not only in our site but even in the 107 other nuclear sites across america of radio active sites owned by the american government, it's the same story. they want to minimize the danger and the risk. they don't want to take responsibility and they're willing to let children suffer from it. >> there is one instance of people doing research is legitimate because most times the communities are forced to dig up their data to find out what is pumped into their water. nicholas, as you've had this documentary as its been around the country at festivals, showing it on msnbc sunday night, what do you want viewers to take from it? do you want them to call the member of congress and donate to organizations? is something you want people to take from this? >> i want the audience to feel how we felt making this movie. we want them to feel angry. we want them to feel empathy for these families that we talked to that are constantly every day staring down the barrel of this gun. so we want people to get acclimated and just do some research and see how close you live to one of these sites because the matter of the fact is you probably live closer than you think because they're everywhere and, you know, these are dangerous and they need to be cleaned up. >> nicholas and melissa, thank you so much for your work. thank you so much for this documentary. watch "in the dark of the valley" sunday on msnbc. that does it for me.
