all right. so we begin tonight with a question. does the republican party trust elections? it is pure and simple. in new jersey what was expected to be an easy re-election for democratic governor phil murphy turned out to be a tight race and republican candidate jack ciattarelli is refusing to concede. in the run up to the election in virginia the republican candidate glenn youngkin repeatedly called for audits of election machines. former president trump said he was ready to yell fraud if the race was even close. then on tuesday youngkin secured a slim victory in the virginia governor's race and lo and behold those results were immediately accepted. remember the calls for audits? suddenly not such an urgent concern. even trupp seemed to accept the results out of virginia. he released a statement thanking his base for showing up for youngkin. do republicans trust elections mow? it depends on whether they win or not. let's remember this. why we are asking in the first place. on this day last year november 7th nbc news called the 2020 presidential election for joe biden. >> the moment the entire country has been waiting for after a very close state, nbc now ready to announce joe biden won the key state pennsylvania and its 20 electoral votes. >> now we can project former vice president joe biden has been elected president of the united states. he is president-elect. >> 365 days later there are still people in this country that deny joe biden's victory including his opponent former president donald trump. earlier this fall trump held a rally in one of the states he lost, georgia, and there he repeatedly complained that georgia's governor brian kemp refused to reverse his defeat or call a special election. >> i said, brian, listen. you have a big election integrity problem in georgia. i hope you can help us out and call a special election and let's get to the bottom of it for the good of the country. let's get to the bottom of it for the good of your state. let's go election integrity. what could be better than that? sir, i'm sorry. i cannot do that. >> those remarks should be of great interest to the fulton county district attorney's office which has been quietly assembling a case against the former president for his attempts to overturn the election there. on saturday we learned the district attorney is close to impaneling a special grand jury in the investigation which may lead to charges against donald trump. a key focus the january 4th phone call between trump and georgia's secretary of state brad raffensberger. you remember. the call where then president pressured raffensberger to, quote, find him the votes to win. >> so tell me, brad, what are we going to do? we won the election and it's not fair to take it away from us like this. and it's going to be very costly in many ways. and i think you have to say that you're going to re-examine it and you can re-examine it but re-examine it with people that want to find answers no the people that don't want to find answers. >> whatever that means. now the man on the other end of the phone call is speaking out in the fall out from the 2020 election raffensberger refused to go along with trump's big lie and by doing so became public enemy number one for trump supporters and was inundated with death threats and escorted out of georgia's state capitol on january 6th when protesters entered the building looking for him. in his new book "integrity counts" he recounts what took place before and after the now infamous phone call. georgia secretary of state brad raffensberger joins me now. >> thank you so much for your time this evening. i wanted to start with that infamous phone call. in your book you say you felt then, you still believe today that the former president threatened you. i know prosecutors in fulton county opened a criminal investigation into trump's efforts to overturn the yo lex results last february. i know you have not been interviewed for that investigation but you have expressed a willingness to do so. if you tell investigators the same details that you've shared in your book that i've read do you believe that it is enough to charge the former president with criminal charges? >> good evening. well, i am a structural engineer and i know numbers but i don't know, don't pretend to practice law so we'll let the lawyers decide on what that rises to or doesn't but i put the full one hour and ten minute conversation in my book and with my observations at various points because during that conversation with president trump i wanted to be respectful but also let him know he just did not win the state of georgia. he said in the phone call 5,000 dead people voted. there's actually less than five. we've run the numbers down. he said thousands of felons voted. there were less than 64. they said under age voters. there weren't a single one. point by point we responded and on january 6th i was writing a letter with my general counsel. we got it up to our congressmen and women and our senator and rebutted every single allegation that was made post election. >> i know that earlier this year you blamed, quote, both sides for tolerating a climate of violence that has in part led to death threats against election officials and against you and your own family. the people who stormed the capitol on january 6th to be clear and forced you to evacuate your own office on that same day in georgia, they were not people from both sides, sir. a few congressional republicans who have spoken out against the president like you have, have either been stripped of leadership positions or they've retired because they don't feel they can win primaries. how do you justify remaining a republican in a party that punished those who don't embrace trump's big lie? >> well, first off, i back the blue. i don't support any violence against law enforcement be it the capitol or out in porl. as it relates to the election process i want to be sure we have fair and honest elections and i fight hard to do that. we've been fighting this narrative of stolen election claims from stacey abrams and president trump. he ramped it up to a higher level but she set the platform. many of trump's court cases were almost word for word what stacey abrams' people were alleging. hers was voter suppression. his is voter fraud. neither one were supported by the truth. the candidates when they lose need to learn to lose gracefully and if they want to run again that is their decision but they have to accept the will of the people when they come up short. >> i've been watching your interviews this week. you've been referencing stacey abrams so i anticipated you'd make that reference. for me, it just seems it is a bit of a stretch to be honest. stacey abrams did not call you, did not threaten you. did not ask you to find votes. she did not call on her followers to storm the capitol. i know you said you've been, that donald trump came along and ramped up the rhetoric that you say stacey abrams started. i want to if i can play for you the row ax -- reaction from stacey abrams and donald trump. >> as i've always said i acknowledge that the very beginning that i, brian kemp won under the rules that were in place. but i object to the rules that permitted thousands of georgia voters to be denied their participation in this election, to have their votes cast out. so i will continue to disagree with the system until it is fixed. >> let me play for you what donald trump said speaking to you in a phone call last december. >> so look. all i want to do is this. i just want to find 11,780 votes. which is one more than we have because we won the state. >> again to be clear it was never stacey abrams' goal to overturn the election but change rules for future elections. trump asked you to, quote, find votes to overturn the results. you do accept that difference, right? >> what i do accept is that both of them, though, what they've done is really tried to undermine the legitimacy of the election process. >> that point of distinction if i can sir, you do acknowledge she is not asking to overturn the results of an election. you do acknowledge that, right? she is not asking to overturn the results of an election. >> well, what she said in her statement she played was not based on anything that could be supported by facts. what she hit us with was nine lawsuits and we won every single one of them. they weren't supported by the facts. just like with president trump. his team had lawsuits and none was fact based so it got kicked out in a court of law. we prevailed in every single case. what it does is it destabilizes and really destroys voters' trust in the election process and that is not helpful for america. >> sorry. so the exact match lawsuit stacey abrams has filed is still working its way through the courts, no? >> no. what is working through the courts right now is actually going back to the old dr machines -- >> right but her argument about claims in georgia have still, and are still working their way through legal proceeding in georgia. they are not resolved. let me put this on the screen to show you. if you look at what donald trump did on the day of his challenge to the results in georgia they were dismissed the very next day is that correct? >> virtually the very next day in all cases yes. >> when you look at what stacey abrams did, again, some things she was arguing for in the state of georgia actually worked their way through legal proceedings which i think you would concede is a normal process in elections. if you have a complaint you have the legitimate right to pursue those challenges in legal courts is that not correct? >> and we make sure that before we reject anyone's -- the old rule was signature match -- that you have other sets of eyes to review and make sure the signature truly was them and then actually give people an opportunity to cure that. that is one of the reasons we moved away from signature match because we've been sued by both the democrat party and the republican party on signature match. we went to an objective measure they've been using in minnesota for over ten years. driver's license number and photo i.d. >> so it is something the courts essentially agreed with, with stacey abrams that that was something that could have been done better. >> well, we're always looking at how to improve the process. >> right. but you're making a moral equivalency between donald trump and stacey abrams and i am saying is that not part of the problem that you are trying to equate somebody who tried to overturn an election with somebody who is trying to improve an election? and i just am surprised you can't see the similarities, sorry, the differences between the two arguments. you think they are one and the same. >> well, stacey abrams three weeks ago in virginia said just because you win doesn't mean you've won. and so right there it tells you she still hasn't conceded she did lose. it is really not helpful and really destabilizes society. left or right i think we really need to hold both sides accountable. >> all right. i know a section of your book outlines why you had the strength to stand against those attacks and misinformation. you write your parents instilled values and you think it is important to have grit, honesty, courage, integrity, hard work, respect. loyalty, faithfulness, manners, perseverance are words you use in your book. i want to read a tweet you sent out last week after the braves won the world series. congrats to the braves on becoming world series champs. let's hope stacey abrams accepts the results. does that feel like good manners to you? is this all just a strategy to appeal to the base with the party that you're on the outs with? i see you're laughing but quite honestly you didn't go after donald trump. you went after stacey abrams. does that sound like good manners to you? >> well, every once in a while it is fun to tweet people and we lost a probably, they say a hundred million dollars when we lost the all-star game all based on untruths, she talked about sb 202. we increased the days of early voting from 16 to 17. >> so you don't think that is good manners. i understand what you're saying about sb 202 and i don't mind getting into that but do you think that was good manners not to go after the president who tried to overturn the elections but going after stacey abrams who was trying to improve elections? and even save with special offers just for movers. really? yep! so while you handle that, you can keep your internet and all those shows you love, and save money while you're at it with special offers just for movers at xfinity.com/moving. throw this was a busy significant week for the supreme court. on monday they heard oral arguments on texas's controversial abortion law. the state seems to believe that it unreviewable. the justices weren't so sure. on wednesday the court indicated skepticism on another high profile case the one involving a new york state law that imposes strict limits on carrying guns in public. it is unclear how broad or narrow the court will go. joining me now two of the best court watchers in the game. great to vogt you with us. mark, let's start with the case involving the texas abortion law. remind us again the contours and particular aspects of the case and why texas believes it is unreviewable and implications for other states. >> so this law bans abortion after six weeks of pregnancy but rather than allowing state officials to enforce it, essentially random bounty hunters to sue any abortion provider or anyone who aids or abets an abortion provider for $10,000 in state court. the whole idea is to deprief abortion supporters of any official to sue forces them to simply shut down all operations, clinics to close their doors for fear of crippling lawsuits that could rain in if they dare to defy the law. it has so far successfully evaded federal judicial review. in an order last september the supreme court essentially shrugged it off and said there is nothing we can do about it right now. that seems like it might change after these arguments. >> what did you make of monday's arguments, jessica, and the way the questions and the way justices went about watching those questions. many court watchers believe a majority of the court may be willing to let texas abortion providers continue their challenge against this state law. >> i agree based on the questions and basically because the supreme court realizes they don't want to give up their power and they don't want federal courts to give up their power when it comes to similar law. imagine other states start passing similar laws that basically out source enforcement to private individuals or laws dealing with other issues like let's say gun rights. the main thing i heard is the supreme court understanding why would we ever say that a state can insulate itself from us? why would we give up our responsibility and our power? then what i also saw, heard justice kavanaugh saying is really focusing on this idea, blue states could do this too maybe with respect to gun rights? out source its enforcement for laws that might be un-constitutional but really protective of really pro gun control. and so i think for those reasons the supreme court is going to say, no. let that law go forward. let that suit go forward. >> just to pick up on that point about the guns for a moment the case involving the new york gun law how likely is it that this law gets thrown out? what are the implications of that for the rest of the country? >> i think it is very likely that the supreme court strikes down the new york law that really limits concealed carry. and that will have ramifications in the six other states including california that have nearly identical laws. the biggest question to me is what kind of language does the court use? does it use sweeping rhetoric that calls all kinds of other gun restrictions into question as well? and i think it might. you know, we had justice alito asking a question about the heldish subways of new york essentially a mad max distaupe ya in his mind where everyone needs a gun just to be safe from all of the crooks and criminals lurking around every corner. these are very privileged people with very perversailles december about the perils of the world and seem to empathize with similar folks who believe they have to be packing at all times to defend themselves and their families. >> experts have suggested it is likely the court could issue a narrow decision by ruling against the new york gun law but not in a sweeping way as mark was just alluding to there. do you agree with that? could that mean we'll see similar narrow ruling on abortion? >> that is a great question. so a couple things to pick up on. mark points to this idea there are six other laws. even if the court writes a narrow ruling what does it really mean? it is worth emphasizing 25% of the american population lives in one of those states. that is still a really big impact even if a narrow ruling. could they write that language narrowly? i think it depends on which flank of the supreme court, which flank of the conservative supreme court really wins. are you going to see justice thomas, justice alito say no we're going big, i've been waiting ten years for a second amendment case or see justice roberts pull back and say no a little more narrow. in terms of abortion, obviously when it comes to the substantive question where do we stand on roe v. wade that case will be argued on december 1st dealing with mississippi's law. ien ceasingly suspect because you hear the court defend itself so much lately in public speeches that they will write a fairly narrow ruling but uphold mississippi's law and totally eviscerate roe. >> that is quite a prediction. you have to wonder if there is a pr push by the justices going out and public speaking in tandem the last couple week. how conscious given the fact there are all these public statements, how conscious do you think the court is or seems to be of the fact that a sweeping decision on any of these high profile cases could panic half the country, could alarm half the country? how would you like to be, your name to be pronounced? >> i have gone through all the different names in my book if you listen to audio. it is, i'm sure you can. it is pronounced huma but most people say huma and i respond to both but it is pronounced huma. >> i'll go with the proper pronunciation. it is great to have you here. i appreciate you taking time. i know it has been a busy week. i want to first of all talk to you about your book and get your thoughts. as someone very close to power in washington, d.c., and the lessons you learned in terms of election losses. this was a bit of a setback for democrats this week with some of the elections. what lessons do you have for some of the candidates and those in politics based on your experience and what democrats in virginia just went through? >> look, he think the best advice i can give is we just have to stay focused and get organized and keep energy and enthusiasm. elections are cycles. president biden is trying to do some very difficult things in washington. he just got one very big thing done this morning. >> yes. >> and woe just have to stay focused. i mean, it is a long -- >> a long road. >> a long road ahead. >> i know you write in the book about being a muslim woman, growing up in saudi arabia, and the world view shaped by your experiences overseas and how your parents raised you. i was wondering, i know you talked about this a little in the book but elaborate on your world view and the experiences that you had growing up before you came to the university in washington, d.c., how they shaped the experience you had at the height of american political power. >> well, you know, my parents were two immigrants. my father from india my mother from pakistan. they were fulbright scholars. for them education was a religion. they met at the university of pennsylvania. when i was 2, he was born in michigan, my father was diagnosed with renal failure and told he had 5 to 10 years to live. one of the first lines in the book was my father was told he was dying and we moved to saudi arabia. one of the greatest gifts my parents gave us was this curiosity about the world. they took us to a different places and cultures and we learned different languages and religions and i think it is because my father, what motivated both my parents was this notion of trying to understand the other. his colleagues would say don't go into these places and have conversations where even angels fear to tread. and my father was exactly the opposite. like it is important to talk to the other side and try to understand it. i think what i landed in the white house in 1996 as a 21-year-old intern having that grounding, appreciating and understanding different culture and also bringing a whole new culture, there weren't a lot of muslims wandering around the white house in 1996. it was an administration that really welcomed and was curious about me and my life experience and as a result i had the opportunity to do amazing things. how many 24-year-olds were wandering around camp david peace talks and i was there. i had the privilege of being there thanks to president clinton. >> i'll get into that in a minute. i know your identity was weaponized and used against you and something i think a lot of muslims in this country have had to endure at various points in their professional lives. i wanted to play for you this sound bite. i know in 2012 michelle backman attacked you. by this sound bite by then congressman sean duffy had something to say about your identity as well. >> why are we talking about huma and her ties to the muslim brotherhood, why aren't woe talking about the fact she was an editor -- >> she does not have ties to the muslim brotherhood. >> when you heard elected officials talk about you that way and weaponize your faith and identity and try to say that a member of the muslim brotherhood infiltrated the highest levels of u.s. government what did that make you feel? what impact did that have on your family? did it ever impact the work that you do? >> it was arguably the most devastating personal experience that i've had in my years in government. for me, i come from that part of the world where your represent -- reputation is everything. to have it sullied, what made me infuriated about it, and it wasn't just me. they attacked other high ranking muslims in government. it was an appetizer really for what was coming in 2016 and 2020. but the fact that it was the very opposite of what my father and mother's journal stood for, that it was all about understanding and faith. it was hypocrisy. and it was shocking. i really had a very hard time dealing with it. when john mccain went to the floor of senate to defend my family and president obama at the time did the same thing they were defending me but they were defending not just me but american values and ideals. this is not who we are as americans. it is one of the many reasons i wrote the book. muslims can be, part of the "both/and." i can be an american patriot and also a practicing muslim. >> so how did that i guess also the flip side to that, were there ever moments, because also you worked at the state department and certainly worked on issues of foreign policy. were there ever moments where you found that foreign policy was at odds with your own personal values and tried to shape it based on what you had experienced and what you had seen? were there ever moments where the policy rubbed up against things you personally thought were going m the wrong direction that you tried to change? >> i just want to reiterate. i was not a policy person and i am not. i did appreciate from day one that in the clinton white house we celebrated ramadan for the first time and every time i would have an idea or suggestion it was welcomed and accepted. i wroit in the book the painful night of the iraq war vote under president george w. bush's administration that was personally very difficult for me. i recount the scene where my syrian american calls me and says i hope hillary clinton is not going to vote for this war and i knew how she was going to vote. those were difficult personal moments. i had no problem expressing my views. obviously the arab spring i had lots of personal opinions working at the state department but also because as a young woman who grew up in saudi arabia it was very hard to explain that i did not, i personally do not believe democracy the way a lot of the western governments, a lot of western governments see it is what other countries is how they -- believe is how their governments should be run. there is a lot that we still -- >> absolutely and the chapter is still to be written it seems. let me ask you just because you work with one of the most influential, most important women politicians in this country's history we've had since a woman elected to the role of vice president. talk to us about the glass ceiling that has been broken and given how toxic our current politics are what should this country do to recruit more women politicians and get more to the highest levels of government? >> for me i am doing right now the thing with you that scares me the most. that is sitting and speaking and being out in the world. one piece of advice to any young woman is do the thing that scares you the most. if you are i think 2016 i try to look at all of the benefits or advantages in one of those things i think a lot of young women, women in this country woke up and said this is not the kind of government or world i want to see and i'll participate and change that and the record number of women who ran in 2020 and 2018 is phenomenal. watching kamala harris take that oath of office was nothing less than awe inspiring. i think it is really important for the rest of us women who care about our country to support leaders like her. >> all right. huma abedin thank you so much. it's been a real pleasure. thank you. >> thank you for having me. >> any time. coming up how backlash against telling the truth about american history in the classroom is impacting indigenous people. i'll speak live with the indian collective president nick tilson. got a couple of bogeys on your six, limu. they need customized car insurance from liberty mutual so they only pay for what they need. what do you say we see what this bird can do? >> thanks for having me on. i mean, it's massive. there's 26 states in the united states that don't teach any american indian history. 26 states in the united states in which it's in the not part of any of the curriculum. in north dakota they're trying to reduce the understanding. it has a profound impact on native people and society. because education has been one of the fundamental ways to try to actively erase indigenous people from history. and if we're in a time in this country where we're beginning to actually have a reckoning with our past we have to teach accurate history. critical race theory has become this talking point that is overpoliticized. let's tell the truth. the next generation of kids need to know the kids, and the truth needs to be taught in all k-12 schools in america. >> there was a native activist who recounted a story in which a woman said i thought we killed all of you. it's horrifying to read something like this. what happens if some people in positions of power are successful in further limiting the teaching of history in classrooms across this country? >> well, it will impact every aspect of life for indigenous people. they doing amazing things for their communities and people. many are on the front lines of the climate justice movement and fighting for liberation of our lands and our people. and the more and more that they make attempts to try to erase us the harder, the harder that it has an impact on our people. and i think that, you know, indigenous people in this country are experiencing huge amounts of income inequality and poverty and challenges. we need to lean in and move forward by teaching the true history of this country. if we do, it makes it better for all society. it's a way to combat racism. just the other week, the major league baseball team, the atlanta braves, who openly practice the tomahawk chop and call themselves the braves is highly racist. but it's accepted this society today because we, because history books have made it okay. they've made it okay to treat us like that. and us, as native people we're done being treated that way. we're done being treated that way because we come from such a rich culture and history and have so many things to offer society. >> let me ask you finally, i know we're speaking a few weeks before thanksgiving. i'm guessing we find it very different than american natives. how do you think we approach a problem like that?
