is it better than nothing? that's the question. it's "way too early" for this. good morning and welcome to "way too early," the show that thinks that election day is the best day of the year. i'm jonathan lemire on this tuesday, november 2nd. we'll begin with the news, and, indeed, we start with one of the most highly anticipated off-year election days in history. in hours americans will be casting their votes in consequential races across the east coast. in virginia democrat terry mcauliffe will look to hold off the surging republican glenn youngkin of what many say is a test of the political landscape. youngkin who entered as a largely unknown candidate has capitalized on hot-button issues like critical race theory. in new jersey recent polls show that republican challenger jack ciattarelli cutting into the lead of democrat phil murphy after republicans were down by 17 points in august, recent polls have him in single digits in a state, mind you, that president biden won by 16 points last year. and just across the hudson river, democrat eric adams seeks to become just the second black mayor in new york city with a win over guardian angels founder curtis sliwa. though polls show him well behind, sliwa is attempting to buck recent history since mike bloomberg did it in 2005. senator joe manchin of west virginia, meanwhile circumstance not ready to vote for joe biden's build back better plan. speaking to reporters, senator manchin called on democrats to slow progress on the bill. he said he won't announce his support for it until after the fiscal effects of the legislation can be assessed. >> sim simply put, i will not support a bill that's this consequential without thoroughly understanding the impact it will have on the debt, our american economy, and the american people. every american needs to know the impact it will have. i'm hoping to vote on a bill that will push our country forward, but i'm equally against voting for a bill that will hurt us. for the sake of the country, ours is the house to vote and pass the bipartisan infrastructure bill. holding this bill hostage is not going to work, and getting my support for the reconciliation bill. >> president biden pledged to pass his build back better agenda during a speech at the united nations climate change conference. the spending bill includes a huge investment in clean energy and the president is insisting he'll get it done. >> this is a chance in my view to make a generational investment in our economic resilience and in our workers and communities throughout the world. that's what we're going to do in the united states. my build back better framework will make historic investments in clean energy. the most significant investment to deal with the climate crisis that any advanced nation has made ever will demonstrate to the world the united states is not only back at the table but hopefully leading by the power of our example. i know it hasn't been the case, and that's why my administration is working overtime to show that our climate commitment is action, not words. >> joining us now from scotland, nbc news correspondent josh lederman. good morning. thanks so much for being here. tell us to begin with what kind of reception the president is getting at this climate change conference. he also interestingly offered an apology of sorts for the u.s. with drawing from the paris climate agreement. what is the story climate you're hearing so far? >> reporter: well, jon, there's certainly a sense of relief here in scotland that the u.s. is back at the table after nearly four years of inaction over climate change. but were seeing the fault chains start to emerge here in scotland, particularly between the rich and developing neighs with a lot of these poorer nations, especially some of the island nations that are particularly vulnerable to climate change saying, hey, look, it's well and good for the u.s. and all its wealth and the largest akum la active global warming and cajoling of the other countries to step up on the mission, but how are you going to help us? where is the money that will make it possible for us to tackle climate change? president biden as you noted has tried to take a more humble approach given the way the u.s. has acted in the last few years, even apologizing for impromptu remarks over what his predecessor did. take a listen. [ indiscernible ] >> reporter: president biden also spent much of yesterday here at the climate summit talking up his build back better agenda, talking up that $555 billion of climate-related spending that will be in the democratic spending bilk so the big question i am watching today, jon, how are these other countries going to respond now that we've heard from senator manchin, now that it's clear this is not exactly the done deal that (would like to portray it as being. >> yeah. white house aides i heard from yesterday, not exactly thrilled at senator joe manchin's timing while the president is overseas here on the wake of what had been, they believe, a successful g20 with some successful trade news, and now these commitments on climate change. and related, the u.s. is expected to make a major announcement on methane today. what can you tell us, josh? >> reporter: this is one of the more significant announcements from the biden administration since president biden took office related to climate. the u.s. today will be introducing the first methane regulations on new sources of methane, so basically new wells that are being drilled and also toughening them on about a million existing wells that are leak methane. while it's a portion of the smaller greenhouse gases going into the air, it's far more potent than the one we're all talking about, carbon dioxide. 80 times more powerful. it stays in the atmosphere more. you'll see the quick payoff to curbing the effects of global warming. in addition to what the u.s. is going to be doing state side, jon, the u.s. also saying 80 countries will be joining a pledge that the u.s. and european union have made to dramatically cut down methane by the end of 2030. really, so far, this is one of the biggest deliverables we've seen these countries be able to cough up here at the climate summit in scotland. >> of course, the president will be wrapping up a series and a news conference later today. we'll be covering that here on msnbc. civil rights leader reverend jesse jackson was hospitalized last night after falling at howard university. he sustained an injury. his rainbow coalition tells nbc news the 80-year-old was supporting students from warnds, who are protesting their living conditions at campus dorms. the organization added that the two-time presidential candidate was taken to howard university hospital. a ct scan found he didn't have any internal injuries, but he was kept overnight as a precaution. in a tweet his daughter santita said, he's doing well. he was tested for parkinson's disease after testing for covid. we certainly hope him a speedy recovery. still ahead, we'll dig deeper in today's elections. donald trump parachuted into that race. whether the republican candidate wanted him or not. first the supreme court signals it may allow a challenge to the controversial abortion law in texas. those stories and a check of the weather when we come right back. folks, it's election day. we're glad you're watching with us. and i help walk the dog from wherever. *door unlocks* ♪ ♪ well, i can bust curfew-breakers in an instant. well, you all have xfinity home, with cameras to home security monitored by the pros. *laughs* learn more about home security or get our self-monitored solution starting at just $10 per month. a jury has been selected for the trial of kyle rittenhouse who is accused of killing two people and wounding another during a kenosha, wisconsin, protest over race and police brutality. the jury includes nine men and 11 women, and all appear to be white. the trial could take about two weeks and by its end, 12 jurors will decide the case and the rest will be released. according to "the washington post," experts say while the context surrounding the case is political and charged, the legal issues are not. the trial, they say, will come down to whether jurors accept rittenhouse's argument that he fired in self-defense. the supreme court heard arguments in go cases challenging the law in texas that has virtually ended abortion in that state and empowers citizens to enforce it. now some are signaling they be allowed to proceed. nbc correspondent pete williams has more. >> reporter: opponents of abortion rallied outside the supreme caught, sb-8, the abortion law that bans abortion after a heart beat is detected at six weeks. >> there's no question that a heart beat signifies life and the beating heart in the womb is the life of a human child. >> reporter: the supreme court has long said state officials cannot ban abortion early in the pregnancy, so they handed off enforcement to private individuals, allowing anyone to sue a doctor who provides an abortion or anyone who helps out. texas ran into a wave of skepticism from even some of the court's conservatives including amy coney barrett and brett kavanaugh who earlier blocked sb-8. justice barrett said she doubted waiting for challengers to be sued aloud them to defend their rights. >> i'm wondering -- >> reporter: and some worry about a host of constitutional rights. >> we would be open for business. there's nothing the supreme court could do about it. guns, same-sex marriage, religious rights, whatever you don't like, go ahead. >> reporter: justice kavanaugh said they could allow guns they wanted to ban. >> everyone with an ar-15 is liable for a million dollars. >> the court will take up the challenge in a month. the assistant director for the film "rust" is speaking publicly for the first time. the "new york post" reports david halls did not report details of the incident or respond to previous reports that he handed alec baldwin the gun and told him it was safe to use. but in a statement he called hutchins one of the most talented people to work with and said he's a friend. i'm shocked and saddened by her death, halls said. it's my hope the industry really evaluates its values and practices to make sure no one is harmed in the process again. nbc news reached out to halls. this comes days after a cameraman resigned citing safety concerns. looper informed producers safety procedures were, quote, fast and loose. a source close to the production told nbc news that during the first ten days of production there were three safety meetings held, including one of the day of the incident. still ahead t chiefs overcome a giant hurdle on "monday night football." sports is next. -i'm so good! ♪ this is what healthier looks like. ♪ welcome back to "way too early." just before 5:30 on the east coast, 2:30 on the west coast. in the latest nprpbs news hour and marist poll, just 36% of democras say joe biden will win. 44% say a different nominee gives them a better chance. all republicans and gop-leaning independents give donald trump the best chance in 2024 while 35% says someone else does. speaking of donald trump, he made a brief appearance last night with an 11-minute phone call telerally encouraging people to vote for young king for governor. he said, quote, he's a fantastic job and do a job like nobody can do. original comments there. the former president released a statement earlier in the day accusing the news media and, quote, some of the perverts doing ads primarily on fox creating the impression he and youngkin are at odds. they have not campaigned in a state president biden won last year. the young king campaign said it was not affiliated with last night's tell rally. meanwhile a top election person is giving mcauliffe the lead. in a late move the news letter changed its yourt look from leans democratic to leans republican and explained the decision. sabato writes thi -- joining us now for much more on this, one of the more evenly watched races we've had in a long time, national reporter from the hill, julia manchester. here we are. voters are going to the polls in just a couple of hours. what we're hearing from pundits and some polls we've seen is a very tight race. why don't you give us a state on the ground, where do you think things stand as election day begins? >> jon, i started out in north virginia last night. there was a rally for mcauliffe. it featured quite democratic heavy hitters as well as labor union leaders and such really encapsulating mcauliffe's agenda there in virginia. you had senator mark warner as well as speaker of the virginia house. they're urging them to get out and vote tomorrow. mcauliffe's record as governor and touting ralph northam's record saying it could only be a continuation of that. and then i travelled to lee county with glenn youngkin where he had probably hundreds of supporters there. i didn't get a crowd count, but it was out in the field in leesburg. that was built as a parents matter rally. that was important because it was in loudoun county, which has really become the epicenter of this battle between conservatives and amity -- activists. he said if you elect me, your voice is going to matter. another thing about ta, the mcauliffe rally, he talked about his record but also about former president trump and a vote for glenn youngkin would equal that. at glenn youngkin's rally, there was no mention of that. >> that's really interesting. the youngkin campaign has seemed to have done a pretty good job at keeping trump at arm's length and also at the same time not being so antagonistic that it would anger trump. we certainly know what his wrath can be like. do you think last night's final, you know, trump's brief appearance on the telecall will have an impact here? we know terry mcauliffe is still hammering on that. talk about this parents matter. it seems education is the closing argument here for the republican side. >> you know, in terms of the trump telerally to answer your first question, it's unclear. however, it seems that looking at the polling, talking to the voters on the ground and such, that doesn't have as much of an impact because voters are concerned about what's happening in the here and now, and they're concerned about kitchen table issues like the economy, for example. so i'm not sure how terry mcauliffe bringing up trump constantly is going to play. now democrats will argue that president biden is very unpopular in virginia. he lost the state two elections in a row. that's going to be a question that a lot of 2022 candidates will be looking out for. is this a winning strategy, should i do this next year. in terms of parents matter rally and the issue of education, we're seeing lots of polling that shows that it is a number one issue for republican voters, but it's also starting to gain some momentum with independent voters or even in some cases -- and this is a minority vote -- the democratic-leaning voters. some have suggested this is a major issue for them particularly in the suburbs. we're seeing a lot of high-stakes national races or statewide races often come down to the suburbs. i'll be fascinated to see how this issue of education is going to play next year in the midterms. this will be a litmus test for that. >> it certainly seems the youngkin campaign may have created a playbook for republican candidates how to deal with trump last year. one last quick one for you. in talking about the campaigns, is there any sense how early voting has gone and what do they think how high turnout will be today? >> it's interesting that republicans and democrats for youngkin have urged supporters to get out and vote early. voting in virginia ended on saturday. the initial data we see has democrats in the lead, and that's par for the course. democrats do tend to vote earlier than republicans. i think you're going to see that gap close today. i think you're probably going to see a large number of republicans, republican-leaning independent voters get out and vote for youngkin, but i do think it's going to be a late night regardless. >> i'm certain of that. the problems began with high winds last week that cut hub capacity in dallas. created a domino effect, forcing many crew members to miss their other flights. seymour says he expects operations to stabilize in the coming days. meanwhile millionaire robert durst who was recently sentenced to life in prison for the murder of a friend 20 years ago now faces charges for the murder of his wife. the district attorney issued a warrant for durst's arrest. when his wife disappeared in 1982, he family was left with pain, anger, and questions. durst is serving a life sentence in california for killing a confidante who helped cover up his wife's killing. he's been hospitalized and on a ventilator for covid-19. still ahead, for many progressives, things are far less clear than ever. as we go to they're looking to pass bills this week. jamila jayapal told reporters she's letting the president negotiate with the senator. >> i have to believe what the president said. the president said right after the senator vote he's confident he can deliver 51 votes. i'm going to trust the president. our members are going to trust the president, and we're going to do the job that we need to do, which is pass both bills through the house, and whatever senator manchin says is up to him. >> expect president biden to be asked about that in his news conference later. mondaire jones said let's vote these two bills out of the house this week. a statement from press secretary jen psaki points out, quote, senator manchin said he's prepared to vote on a build back better plan and that the plan the house is finalizing meets those tests. house speaker nancy pelosi also reresponsibled to manchin but did not mention his name. in a statement attempting to counter all of his arguments against the bill. most notablying pelosi's statement ends by saying democrats look forward to passing both the infrastructure and social spending bills but did not give any timeline for votes, signaling the speaker is not intending to hold any votes in the coming day. we'll see about that. jake sherman, co-founder of punchbowl news and msnbc contributor. there we go again. this is despite some believing this could have been done this week. let's start there. what does this delay mean for democrats who had hopes, so many of them anyway, to finalize this week and get ready for the vote. >> well, jon, a few important things here. not only did manchin shift course and say, listen, i'm sick of being held hostage, so did democrats. they say they're going to support this. in is a big see change for progressives no matter what they say because they wanted that for manchin and sinema in the past. now they're saying we'll trust the president to deal with this. at the same time they're going to report that moderate democrats, the blue dogs, middle of the democratic caucus, they're getting very worried in the house of representatives they're going to be forced to vote and be forced to take a vote on a bill that doesn't have a budgetary score -- analysis of budgetary impact, all very important, jon, as we get into this last week. i would say, listen, i'm quite skeptical we'll get to a vote. i know the leadership wants to, but there's a lot of things i want and i don't get. i imagine this is something leadership wants that they won't get. >> jake, i can't imagine there are things you want that you won't get. what's the frustration level? like a common story line here during the negotiations are just a lack of trust between the progressives and conservatives like manchin. yesterday could have blown that apart. i know we heard from congresswoman jayapal saying, hey, we'll still do this. where do they feel about each other? >> listen. they're frustrated with each other, and that's quite obvious. i would say the frustration with manchin is boiling over, but manchin -- i mean this is one of those situations where unfortunately for democrats, for many democrats, this is the government that they have. you know, democrats are very keen on saying 98% of house and senate democrats support this agenda as written. that's interesting to know, but that's not -- that's not the game that we're playing here. they need to have joe manchin and kyrsten sinema on board, and they don't have at least manchin on board at this moment. >> jake, where does this leave us now. voters are going to virginia today. terry mcauliffe said he wanted this done by today. that's obviously not happening. as polls suggest, he could go down to a narrow defeat. talk about the political implications puts swirly on the shoulders. some one who came to the office, i know how to negotiate with my former colleagues getting deals like this done. yes, it's some of his senators were the hold out here. we heard from congress members who are saying look, this is up to biden to bring manchin on board. how does he do that? >> this is not particularly enlightening. there are two situations. democrats could feel nervous about following the president. and number two, they could be and less likely prompted and pushed to support this agenda more aggressively if they take away from this election that terry mcauliffe lost because he was not able to get this across the finish line. i am a bit skeptical if that's the big reason. i can't imagine that's theover arching season that he'll lose. i have not heard much about that on the campaign trail. it's interesting that manchin is as you reported wanting more of the game to come to him, progressive feels like they guynn up a lot more
