>> should the full house find bannon in contempt the speaker must then refer the matter to the justice department for possible prosecution. questions about how attorney general merrick garland will testify comes up tomorrow. meantime the ongoing biden presidency after all and democrats are working with the white house on salvaging the president's domestic spending plan. today he was back on the road, this time in his hometown of scranton, pa, to promote a slimmed down version of his original proposals to expand several social programs and address climate change. he planned to raise taxes to pay for those proposals is meeting increased resistance from, wait for it, democrat senator sinema. and there's drama around joe manchin, he told associates he is considering leaving the democratic party if they do not agree to cut the infrastructure bill from $3.5 trillion to 1.75. he has said he would declare himself an american independent and he has dedised a detailed strategy for his departure and today there was a colorful response to the point. >> it's -- spelled with a b, capitol b. >> the white house did get an assist today on one aspect of its domestic policy. fda has authorized booster shots of both the j and j and moderna vaccines. and signed off on allowing americans to get a booster of a different brand than the original vaccination and there was a set back for another white house priority for the third time this year, senate republicans have blocked efforts to advance voting rights legislation. every single republican senator just blocked this chamber from having a debate, simply a debate on protecting americans right to vote in free and fair elections. a little over a year ago. our country held the safest most accessible, most on the level elections in modern history. republican obstruction is not a cause for throwing in the towel. as soon as next week, i'm prepared to bring the john lewis voting rights advancement act here to the floor. what we saw from republicans today is not how the senate is supposed to work. the failure to get the needed 60 votes to just debate the measure means pressure on departments to eliminate the filibuster is becoming more intense. those two democratic senators that i made you wait for earlier, sinema and manchin, who oppose getting rid of the filibuster are two reason that changing the senate rules are easier said than done. the head of the republican party said that democrats better figure out a way to lead. >> if someone landed on planet from outer space and asked may i see the majority leader of the united states senate. you know who they would take him to? mitch mcconnell. because mcconnell has played this as if he is still running the senate. has played this as if he has command and control of the operations meaning the votes, and what the senate business will be. and so, if i'm sitting there as a democrat, i'm going to go, damn. how did that happen? didn't we win? >> for my money the most important word spoken on all of cable television, with that let's bring in ashley parker. bureau chief for the washington post, lisa lara, national political correspondent for the new york times and former u.s. attorney, joyce vance who spent 25 years as a federal prosecutor. for good reason she is a co-host of the podcast, sisters in law. good evening and welcome to you all. ashley, you get the tough one. the white house is to put it charitably, stalled, the democrats in the senate are to put it charitably paralyzed, so what political impact is there if the departments indeed do have the numbers for this vote against bannon tomorrow? >> well, the key thing still, i think, is the stalled domestic agenda and infrastructure and reconciliation. that's the key thing. but the vote against bannon does help forward the democratic on objectives in ways, but you are seeing what president biden came in to do which was sort of shoring up the democracy and going after the january 6th attacks. it's something that is incredibly important to this white house and it is again, and it does not detract from sort of being the intractable of nearing on a deal on the president's domestic agenda. but it's politically a problem for the republicans in that it reminds them of everything they disliked about the trump era which culminated on a deadly attack on the u.s. capitol. it's not what they want to talk about at all. >> lisa, as you know, starting tomorrow, this process could go so slowly, and indeed, bannon is banking on you it going so slowly. this could be tanamount of the public opening of a bottle of molasses, what would be the impact on the work of the 1-6 committee should the vote go against bannon tomorrow? >> well, they say that they are talking to many, many other witnesses involved. so that work will proceed. i think the political impact could be a bit less than what ashley is laying out. because it could, as you point out, go on for some time well beyond the mid term elections. it's a test of congress if they don't take the vote and refer him for criminal contempt. it's unclear why anyone would comply with a congressional subpoena. it was about the essence of our democracy, it's a violent attack on the institution itself. if they cannot push it forward there's push in there, and i do think there's also also a question for the administration, obviously, how does doj proceed separately from the administration. they have been stressing their independence. the administration has not been eager to reopen these issues, even when it comes to the january 6th attack. they don't see it as gaining ground with independents. they know that it motivates their base politically. but biden's numbers with inspects have fallen significantly. they will be crucial voters in the election. it's unclear that if the administration itself wants to spend time talking about. >> joyce, let's get our hands dirty on this one. does garland in your view have it in him to go hard on this? his m.o.thus far has been around cautious and measured. >> i think that's a good way of characterizing the way he has approached these issues so far. today, d.o.j. released a statement saying they would follow a document called the federal principals of prosecution in making the decision. so, here's the step that garland will have to start at with. first, he will have to make sure that he has sufficient evidence to obtain and sustain a conviction against steve bannon for obstruction of congress. if he doesn't think he has the evidence then it's done right there. but look, we have all seen this sort of obstruction crime committed in public. it seems very likely that the evidence is sufficient. so then he will have to consider a couple of other questions. is it in the national interest to prosecute? it would seem that preserving the independence of one of the three branches of government to ensure that we have checks and balances sounds like national interest to me. and then, the final step is considering whether there are alternatives to criminal that prosecution that would be effective. that is where i think, given the rerestraint that we have seen this justice department want to engage in, they may falter. they may decide that because congress has civil litigation options that perhaps those are preferable to criminal prosecution. but you know, at the end of the day, you have to dig in if you are going to defend democracy. unless congress and the oversight function will be paper tigers than merrick garland will have to break the mold and engage in prosecution here. >> we shall see, ashley your colleagues write this about the president. those working closely with biden or familiar with his meetings say the president is now clearly setting guideline force what should on stay in his social safety net bill, and what will have to go. good idea? would on have been a great idea a month ago. what does it mean exactly do you think, ashley? >> well, this is something that lawmakers, democratic lawmakers some of them at least have been eager to see happen for a long time. for a while, the president was conducting listening sessions and bringing lawmakers in, making phone calls and conducting video conferences with them. but as a former senator he was aware that he did not like it himself when he was in that chamber when this president came in and laid down the hammer. now, he is not quite laying down the hammer but he is as we reported giving a clearer sense of what he would prefer, where he thinks both moderates and progressives can compromise and that's something that they find helpful. when you have the president of the united states saying, i think, you know, early childhood education is crucial. we may be able to lose the two years of free community college. even though my wife will be upset with me, it gives them the ability to move on that. it's important as the deadline looms. >> lisa, moving to voting rights which was the big depression trigger of the day for so many democrats looking on. what are their options now? >> well, look, this is once again, reminds me of what was the line in the brady bunch, marsha, marsha, marsha, again, it's manchin, manchin, manchin. the thinking was that the vote had to happen. sohe could get the ten republicans to vote on the bill. and the question now is if he will be more open to eliminating the the filibuster. there's no evidence that that's the case and i think voting rights as critical of an issue that is to the health of our democracy and the democratic base, it's not one that is getting public attention from the white house. they have been much more consumed with the negotiations over the economic bill. you don't hear the president out there giving these big speeches on voting rights frequently or talking about it much at all. they say that, you know, action behind the scenes, legal action and administration action is more important than those kinds of speeches. but it does sort of, you know, raise the question of how much momentum there is to get something like this done. particularly when democrats do not have the votes in congress unless they can agree to up end the filibuster and there's no evidence as of now that it's something that will happen. >> joyce advance, i think this moment calls for the following. i would like to ask you as a southerner, as a democrat, as a woman of the law, as a former fed, to talk about what's at stake. what is going to happen to voting rights in the country what we are watching happen absent any movement at the federal level? >> we are watching an absolute erosion of the righty to vote. and that erosion is not equal kr across the board. it's often targeted to those that will vote democratic. it's targeting communities of color. it's targeting people who have lesser financial means. so, we have a lot of new laws coming out of state legislatures and they all restrict the right to vote. they do it in the name of preventing fraud by and large. but that fraud has never been proven to exist, in fact the evidence is to the contrary, it's really just a boogie mana the legislatures are using in order to enact laws that surpress the right to vote. you may need on get an identification that is difficult or expensive to get. you may no longer be able to drop off your ballot in a drop box or use drive-up voting if for instance, you are someone who has mobility issues or illness. it may be more difficult to get a mail-in ballot. you may find it harder to register and you may be removed from the rolls if for instance, you skip an election. when you take all of these surpressive laws in combination, it paint s a bleak picture for voting in '22 and here's the lynch pin. we used to have the voting rights act which was a mechanism that d.o.j. could use to keep the overly surpressive and restrictive laws from going in to affect particularly in jurisdictions with a history of discrimination. but the voting rights act was abdocated by the supreme court, john lewis's voting act is essential to reestablishing the voting rights act. it too with some sort of change to the filibuster seems to be doomed to failure. >> exactly why i asked. with great appreciation to our starting line. ashley parker, lisa lair, joyce vance, thank you for starting us off. republicans take a stand on democracy, they voted against voting rights. that is kind of a stand. james carvel and mike murphy standing by. he treats covid patients and recently got it himself. it's for good reason that one of the docs we check in to ask about covid, today, especially is to talk about the news on booster shots among other subjects. all of it as our broadcast is just getting under way. on this wednesday night. this w. was made possible by what you don't see. cause when you're not looking, i go to work. ♪♪ strength isn't a given. it's grown. earned and tested. strength isn't a given. ♪♪ we all have the strength to see what's possible. it's up to us to unlock it. tonal. be your strongest. ♪darling, i, i can't get enough of your love babe♪ ♪girl, i don't know, i don't know,♪ ♪i don't know why i can't get enough of your love babe♪ ♪oh no, babe girl, if i could only make you see♪ ♪and make you understand♪ get a dozen double crunch shrimp for $1 with any steak entrée. only at applebee's. now that's eatin' good in the neighborhood. >> we have 50 votes. it's hard to do a lot had the of things you want to. now, since manchin was involved in this, i know he is supportive of voting rights and the only way to pass it is to carve out the filibuster. it's the simple math in the votes. it's horrible in the country. mike and i tried to convince people to vote for someone and now all of the politics is about who votes and stopping people voting. it's ridiculous. i suspect that since schumer is not going to let this go, that they will revisit it in someplace or another and i think the game is not over yet. >> mike murphy, same question. >> well with, i think, i mean, i agree with james, bottom line is they don't have the votes. but i don't think they are sobbing in the war rooms today on the democratic side because well, they don't have the votes but they have the issue. so, they are going to bring it up and pound away. it will help the democrats in the cold hard calculation of politics. one, it will help rile up the base and help minority turn out in the mid terms where it's often not as high and two, it will play in the suburbs. we talk about the house. but the suburbs are where a lotity of the senate races are going to be decided. so, i am a synic, to see that he is happy to have the issue to bang like a gauntlet now, which is what they will do. >> mike is any part of you surprised that let's just go ahead and talk about tomorrow. the huge majority of republicans on the house, they are going to take a dive on behalf of steve bannon. it's a, kind of badly groomed hill to die on, is it not? >> yeah. it's disgusting. i mean, we are talking about rule of law here. and except for a handful of a brave few the rest are running to the tall grass. they know better. >> james, i guess, you are beyond surprised about something like that? >> no. yeah, jim jordan, you know, he and his pervert wrestling coach never said a word about it. he doesn't remember he talked to the president. that committee has all of the records. they know what is going on. liz cheney said that steve bannon was involved in the planning of this and trump was. i'm not surprised jim jordan wants to stop this, he has his hands all over the mess too. that committee is moving ahead and if bannon doesn't go, and merrick garland has to lock him up pronto. you cannot decide you are not going to comply with a subpoena in this country, that is absurd. >> i want to play more of michael steele and it's its own kind of frog boiling experiment. maybe the viewers forget. as you listen to this man, remember, he used to run the republican party. here he is today talking about secrets from inside their locker room vis-a-vis the democrats. >> let he me share a bit behind the curtain of how republicans look and see these things strategically having been in the strategic space. we know the democrats wopt act. it's not complicated, people. call their bluff. democrats won't call their bluff. on nothing. or anything. they talk. they whine, they wring their hands and it changes nothing. how do you hold them accountable? how do you force the issue? >> james you have never been above tough love for your party. that's tough love for your party. >> well, you know, i love mike he is a great guy. and i have become friendly with some of the never trumpers that mike and i have been friends. he makes a good point. and it, if we don't rally around this 6th january commission and just take biden, i mean, bannon and throw him in jail. the only person i feel sorry for is his cell mate. you can imagine what this guy smells like, geez. that is their problem. you are right, you don't need to fool with these people. if they don't comply, then merrick garland lock them up. >> i'm sure anyone unsure about bannon's role should buy the book. right, james? >> these guys was indicted for fleecing the people in building the wall. he said he is not going to do it. i think that they are not fooling around. i think bannon, and i hope i'm proven right and merrick garland, you know, better get off the dime here t justice department exists for one reason, not the institution or anything like that. it exists to enforce the laws of the united states. that is simple. that is his job. and when people violate the laws of the united states like bannon is doing. you, you bring down the whole thing on him. it's simple. that's why they, that's why we have a justice department. >> mike? [ chuckles ] well, he may have friends, but he rides alone. that's jeremy, right there! we're literally riding together. he gets touchy when you talk about his lack of friends. can you help me out here? no matter why you ride, progressive has you covered with protection starting at $79 a year. well, we're new friends. to be fair. eh, still. ♪ ♪ virginia, you have a lot of responsibility this year. not only are you choosing your next governor, you are making a statement about what direction we are headed in as a country. i know terry mcauliffe and no one worked harder for their state. >> it's for good reason that is the latest add, the mcauliffe campaign is putting on the air in the virginia markets. the latest monmouth poll has terry mcauliffe in a dead heat with glenn youngkin, 46% a piece with two weeks to go. still with us, james carvell and mike murphy. mike, do you agree with obama that it's a national statement election? >> well, i, you known, election s are more complicated than that, particularly governor's elections. right now the country is so polarized, there's some truth. biden's numbers are down, it looks to casual voters in the suburbs which are the key swing group that the left wingers have taken over the democratic party. youngkin is not a scary trumpian republican. he has had a bit of a comeback in the suburbs. and it's now a tied race. if i had to bet, i try to avoid betting. if i had to bet, i bet he is going to win this thing. >> james, the same dynamic we have seen with national democrats, i swear we just witnessed in virginia. i think mcauliffe may have assumed that the public reaction to the use of a flag from 1-6 at a youngkin rally a flag that may have been used to beat a police officer would be abhorant to most people and i think the democrats continue to kind of assign and assume attributes to people that have not been the case since bonanza was on the air. what do you make of where this race is? >> look, first of all, it's close. it's a toss up. if they have a toss up and it's been blunt that we are in a tight race and democrats need to be activated. i do think that trump is a, has a tug against youngkin, i have seen research on that. he said that he would not be running without trump. then runs away from it. it's close and i'm scared to death. and other democrats should be. and the solution to that, if you know people in virginia, call them and ask them to vote. if you are in virginia, call and ask other people to vote. it is the only thing i can tell you, it's a close race. >> the rule of thumb in your line of work is if you are explaining, you are losing. i heard mcauliffe a week ago complaining about the senate. u.s. senate procedure and so on. that's probably not a great marker for a race for governor in the common wealth of virginia to go deep on the filibuster. >> well with, these races are getting nationalized and terry is the kind of can-do guy, he said, let's just get in the room and work it out. i think there was a level of frustration at that. but i think underneath that, what was kind of a level, it was truth. you know, it would, i think it helped him a bit that we have seen momentum coming out of washington. there's something happening. but i will be frank with you and frank with the viewers of this program, it is a tough race. i have spent 47 e-mails on behalf of terry. so, i will do anything i can to help him. he is a dear friend and a great guy. >> gentlemen, i cannot thank you both enough for taking our questions and being candid about your answers tonight as always, it's for good reason you are both good friends of the broadcast. coming up important news on the booster shots, on vaccines for kids. we will have an update on our favorite indiana er doc on his situation and the situation unfolding in his hospital. cutting-edge tech, and a world-class interior. the exhilarating mercedes-benz glc. extraordinary runs in the family. ♪♪ (calls dog) buttercup... >> yeah, i think that the way things are going every time a headline comes out, it's showing that something is just a slight bit better on this on that, i think you will have the moderna gang and pfizer gang and j and j guys in the back saying hey, what about us? i think you will see more brand demand. i have no doubt. i got any flu shot and i have no idea who made it or where it was from, i just put it in my arm. >> coming up, a new hurdle, it's an specially difficult communication strategy challenge for this white house on top of what we have witnessed as no one needs to tell you living in a red state. and that's the drive to vaccinate children. starting at the age of 5. i want play for you some of the comments of dr. fauci on this topic. >> in the era of delta, children get infected as readily as adults do and transmit the infection as readily as theed a -- as the adults do. if we get the majority of the 28 million children vaccinated. i think that would play a major role in diminishing the spread of infection in the community. >> so doc no one needs to remind you how many anti-vaxxers are out there and how many have been anti-vax because of what people are seeing and hearing politically. a lot of them are parents of 5-12-year-old kids. i think it may be a steep climb for the administration. do you agree?
