>> first and foremost, from a prosecutor's standpoint, it goes towards the president's mind-set on that day. his conduct and his refusal to do certain things, for example, when you have the house majority leader saying please make this stop, shots fired have been heard, and he turns it around back on him, and he is asked to do a video and the first few attempts he doesn't say please go home to the rioters, and that's his mind-set when you are proving intent, prior knowledge, all very, very helpful. add to that, alicia, the instructions he's giving people like steve bannon, don't comply, even with the absence of legal argument of executive privilege. it goes to state of mind and intent. >> trump reportedly asked the director of national intelligence to look into a claim that wireless thermostats from china were being used to manipulate georgia voting machines. as a security expert, as a human being, somebody who i guess will have wi-fi in your own home, what is your reaction to that request? >> we are often torn when we are talking about the former president, wondering whether he's simply grasping at straws or if he believes some external device could flip votes not connected to the voting machine or internet. there's just no valid evidence of this. i often conclude that he's either got a health issue or he simply wants to grasp at anything and inflate it for his own purposes. things are not going to get better, alicia, as this select committee moves forward with its tasking, and the former president continues to paint them as the adversary. >> steve scalise refused to admit that president biden won the 2020 election. take a listen. >> do you think the 2020 election was stolen from donald trump? >> chris, i have been clear from the beginning. if you look at a number of states they did not follow the past state laws -- >> so you think the election was stolen? >> what i said is there are states that did not follow their legislative set rules. >> last time, i promise, do you think the election was stolen or not? >> betsy, they are sticking to the script even if the facts run in the complete opposite direction, and even if the consequence is a threat to our democracy. what does that tell you about trump's grip on the gop? >> total control. when we see scalise appear on fox this morning, republican sources have been saying for quite sometime that scalise is likely to compete against kevin mccarthy if republicans win back the house in the upcoming mid-term election. both men have ambitions to try and be speaker of the house, and it's very telling now that both of them are huing as close to trump as possible. scalise is a political animal. if he thought it would be helpful for him with the house republican conference to tell the truth, he would. the reason he's answering questions the way he's answering, i'm confident, is because he believes it's the politically helpful thing to do. the reason it's politically helpful when you are campaigning among the house conference, as i suspect scalise will do in the coming months, and the reason it's helpful is because the gop conference is in lockstep with trump and the lies about the outcome of the 2020 election. >> let's bring in our former u.s. attorney and professor at the university of alabama school of law. joyce, i am glad we're able to get you in. trump trying to stop advisers from testifying in front of the senate committee. >> at the end of the day, if witnesses can defy a dually lawfully issued subpoena without any kind of consequence, then ultimately congressional oversight doesn't exist and it's hard to argue that congress is a co equal branch of government under that kind of circumstance. >> how can the committee reassert the power of congress? >> well, that representative is directly on point. we will find out if congress had more juice than in the impeachment, and usually these subpoenas are worked out between the legislative branch and the executive branch, and that has never been on the table during the trump administration and even afterwards. the real option here for congress is to go to the justice department and ask the doj to intervene and bring criminal contempt proceedings. it's a very unusual and interesting misdemeanor because it carries a mandatory minimum sentence of 30 days in custody on conviction. so the goal of the prosecutions wouldn't be to put these, for instance, first four witnesses in jail, it would be for them to comply with the subpoenas and testify, rather than being convicted and being in prison, and the whole goal is to use strategy that is available in order to get a full picture of the events on january 6th. >> i have about a minute left, but i have to ask you, you have been reporting on intelligence failures leading up to the january 6th attack. what were the warnings allegedly ignored? >> one new warning sign i reviewed came from a private business, and it was a piece of intelligence show something that a poster on a neo-nazi telegram channel explicitly advocating for trump supporters on january 6th to march into the capitol building if congress didn't vote to try and overturn the election. this person on this neo-nazi channel specifically advocated for them to march into the capitol building to try and terrorize members of congress. it's rare you see something that that accurately predicts the exact type of violence that played out, and this was intelligence that was ignored, and i still just can't get over it. shocking. >> thank you all so much for getting us started. he has signaled he wants another stab at it. what does it mean for our democracy? those risks. and then you also have the actual threats happening legislatively to dismantle u.s. elections that we are seeing across the country. what i want you to do for me is tie those two together. what is the threat, the big picture of having all of these trump supporters out there, who know longer believe in facts, if they ever did, and then also having state governments that are actively doing his bidding and changing the nature of our free and fair elections? >> well, this is how the big lie turns into the big con of what they are hoping for in the 2024 election, no matter what happens donald trump wins. donald trump sets out the lies, puts out the, you know, conspiracy theories, and then those turn into the marching orders that dangerously get implemented with voter suppression legislation, and bogus recounts that we have seen in arizona and in a number of other states, including in texas, and the upshot of that is that it also softens the ground of confidence that people have in the 2024 election, and it make it more likely with their legal maneuvering and the lack of confidence voters have in the outcome, this time after the 2024 elections, they can actually get away with the big lie. >> that's exactly, that's exactly how voter suppression works. secretary castro, as always, thank you for your time. new reporting that republicans in washington are not thrilled with the thought of trump running a third time. senate republicans are hoping with a few exceptions are hoping former president trump does not announce his intention to run. they are fearing it could sink their hopes of winning back the senate. political white house correspondent, eugene daniels, and a associate professor of political science at fordham university. quite the pickle republicans have themselves in. on one hand they are standing side by side accepting his endorsement and singing his praises, and on the other hand when he's not in the room and they are alone, they are saying please, do not let this guy run again. the calculous is clear, but talk about the if -- the position that it leaves republicans in. >> it's a pickle they all put themselves in. january 6th, it seems like a million years ago, but the republican party was seemingly ready to be done with trump, and then you start to see leaders go to mar-a-lago to kiss the ring, and then the whitewashing of january 6th, the whitewashing of his presidency, that's where we got where we are right now. for months, lawmakers on one side have been clear, they want him to stay out of the 2022 mid-term primaries because the people he's choosing they may not be able to win in the general election in 2022, and they also are concerned about, you know, him actually running. if he's not going to run, right, they want an answer. they want an answer because what he's do something keeping all of the other gop senators and lawmakers, former secretaries and ambassadors from being able to run themselves. so it keeps the bench empty, essentially. that's something they are worried about going into 2022, and 2024. >> does it actually keep the bench empty, or just doesn't keep that bench as well funded as they would be if they were able to publicly say to donors right now, i am definitely going to make a run for it? >> exactly. exactly. how can they get any -- people don't run for president for one year, we know that, they run for many years, and they start talking and cultivating a group of donors, because there are only so many rich people with money. so it also makes it really difficult because for years in the republican party, if you disagree with donald trump, you are cast aside. how do you then run against him whenever time that you are on a debate stage with the man you don't disagree with him, you just say he did a great job, and why are you running for president? >> yeah, the world's least interesting debate. >> and the other thing about watching the grassley sound bite, they have all of these trump supporters and elected gop leaders who just completely disregard, deny facts, and then on top of that, they are up against the state legislators that are trying to change the rules of the game, so where are democrats supposed to go in all of this? >> i say this to you all the time, i wish democrats would be forceful in calling out the republican colleagues. there's a lot of miele mouthness on both sides of the party, and they say, actually i agree with you in the hallway, but they say i am being held hostage. you can't have senator grassley essentially saying i am up here because if i am not i have no chance of being re-elected, so here i am. >> yeah, a truly inspiring message. >> republicans have no inspiring message, and their message, we are going to stop joe biden, no facts or reason why, and it's like when barack obama was president, and their vision is making sure immigrants and people of color can't vote and push forward whatever it is that donald trump is into that particular day. there isn't a real mission of the democratic or of the republican party, sadly, because they are held hostage by a man that is not just unstable politically, but questions as to whether or not mentally he should be involved in any political endeavor in 2024. and donald trump knows he's not interested in doing the work of the presidency, but he's trying to smooth over the ego because he lost fair and square to somebody like joe biden, and he's equal to him, and so sadly, as eugene mentioned, after january 6th so many republicans tapped into a decency that they used to have and said this is actually absolutely bismol, and we can't move forward with this, and then we see the spine of the republican party evaporate yet again and they become the party of trump and not any party of policy ideas that we need in the 21st century. >> if it's not going to be like some profile encouraged, then what is the republicans theory of this, they give him enough time to implode on his own, or somehow he comes to his senses and chooses not to run again? >> i think they are not sure. i think they have no idea how this is going to shake out, and that's how it works when you are depending on one human being out of millions to make a decision. you cannot operate in a political way or otherwise, that would you want to do, right? you look at the last five or six years when they said, you know, they allowed him to say all types of terrible things, and do all types of things that now they say they have not done behind closed doors, and now you have empowered him. it almost doesn't matter. until donald trump makes the decision, this is the party of donald trump. there's also an aspect that donald trump really likes to be part of the conversation. he wants to be seen as powerful and the leader of the party, so it's -- he knows that a president who -- a former president that has been impeached will get a lot less media coverage than a man gearing up for a run, and he could be looking for attention as well. >> my panel is sticking around. next, the one issue and the two democrats stalling two pieces of the president's agenda. we address what is at stake if democrats lower the price tag. plus, most believe the time is now, but is congress able and ready to meet the moment? for people who have been denied, discriminated against and excluded in every sector of our society, and simply to say that this is too much money and reject particularly housing and child care and climate change and all of this is baffling to me. i don't get it. >> new polling out today by cbs news find 54% of americans approve of the president's built back better plan. details of the plan, like expanding medicare and paid family leave gained even higher support. my panel is back with me. dr. greer, you find americans overwhelmingly support paid family leave, and not particularly surprising, and it comes as this analysis from the "new york times" reporting the united states, a major outlier, when compared to how other richer nations contribute to child care for their citizens. other countries contribute an average of $14,000 per year for a toddler's care. is that compared with $500 in america. my question, doctor, we talked about rage moms throughout the pandemic, all of these women who were forced to either leave their jobs, take time away from their jobs, become both tutor and child care provider, and simultaneously do their jobs, are they watching what is happening on capitol hill? if manchin gets his way and dems pick among three of these programs, who are these rage moms going to take that out on? >> that remains to be seen. before we get to that step we need to make sure that our democratic members of congress are going and selling this plan to the voters within their respective states. this is one of the biggest frustrations with the democratic party. we actually continuously build the social safety net. we just don't market it to americans. we know that republicans are just fine ripping out a social safety net away from all americans, including their supporters. what i really hope democrats can do is explain to those mothers and let them be the advocates and messen jurors of what joe biden is trying to do so they can go out in their communities and put pressure on their elected officials to make sure it happens. also we might want to think about what bill clinton did when he was president, and he had certain policies and he would let republicans take them and say they are their own policies, and as long as it gets passed i will give you the credit and that's fine. we need to figure out a way, if that's what is going to help this 3.5 trillion pass, give republicans something that they can tell their constituents that it's their idea. i am fine with that, because so many families are at stake right now. i mean, so many parts of this bill will really save american families, democrat and republicans, from falling off an economic cliff. it's frustrating to say the least that we have manchin and kyrsten sinema who are self-serving democrats and are slowing up the progress that so many democrats are trying to push forward during a covid crisis and economic crisis, and for so many communities, especially communities of color, a real depression. >> well, one senator spoke to my colleague a little more about senator kyrsten sinema and manchin. >> the two of them don't agree with each other yet, and 98% of us do, agree with the president and ourselves and with the american people. that's the challenge disturbance >> they don't see eye to eye with democrats or republicans or each other. so what is your sourcing of what it will take for the lawmakers that lost sight of what americans want and need? >> that's one of the biggest frustrations when we talk about members and lawmakers and people that work in the white house, they don't know what manchin and sinema want, and they don't have a handle on that, and the two of them don't agree. it would be easier if manchin and sinema had things they could agree on, and everybody else could get onboard so it passes and passes quickly. but that's not where we are. what we are think something going to happen, first, they will have to start from scratch, right? president biden, the $3.5 trillion and what is in it came from president biden, and now congress has to figure out what they want in there. kyrsten sinema is more interested in the climate change, and that's not really something joe manchin of west virginia is keen on, right? they will fight about that, and figure out how to whittle down this number, do we take on aspects of the package or do we change how long it lasts, five years versus ten, and that whittles down the price tag. what we know is that once you give americans a benefit, it's really hard to take away, right? what they think, as long as we get this in there, as long as american people get to see how parental leave can change their live, and how more medicaid makes your life better, then they will continue to want that and it will be harder for congress and another president to not add more money into that pocket. >> i think there's no better illustration of that than the tiktok videos of parents celebrating when they got their check, and that is it. thank you as always. eugene is sticking around, because next a social media reckoning. is congress ready, willing and able to regulate facebook? >> well, the company did things where they said it would curb misinformation and it did the opposite. i am old enough to remember a few years ago when they had a massive misinformation problem that they said was the middle of the country talking things through, which i thought was pretty paternalistic. what they did at that time is say we are not going to deal with misinformation in news feeds, but we will push people towards groups. what does that serve to do? it hid all the misinformation into spaces where people could talk about it by themselves away from public scrutiny, and that's how you end up with ivermectin facebook pages. at this point now people are in these groups literally huffing hydroperoxide through a nebulizer. that's what facebook is built to do, it's built to do the opposite. it's built to tell people to increase in engagement by disa degreeing with each other, and we are seeing people die because of it. >> these new safety features facebook is rolling out for younger users, and it's a response to what we have seen in the past few weeks. can any of it work? >> we don't know what it is yet, right? from what i can tell, it's people -- instagram will nudge teenagers to calm down a little bit when it's using too much service. i am not sure this is a real solution here. you know, the bones of these platforms are built on very bad stuff. i'm not sure if there's some sort of content solution at this point that will override that stuff. maybe it will help with a few things. they do piecemeal things, so users will have safer experiences on facebook, and the misinformation on facebook is better than two or three years ago, but it's still a platform built to spread it. >> it brings us to this conversation about whether or not there needs to be a legislative fix. klobuchar said there needs to be legislation to protect users, and it was said we don't have nationwide -- is there an appetite for this and what would it take to get federal privacy legislation in place? >> maybe not just privacy legislation, but regulation of facebook and instagram and twitter and all of the other social media platforms. up to this point, there has been -- everybody is mad at facebook and twitter, right? democrats and republicans, but the agreement on what the problem is has not been there, right? democrats have been mostly concerned with foreign actors, damage to kids and all of our psyches, how it reinforces unhealthy habits. you have republicans who were focussed on shadow banning, and it's the fact that they are routinely at the top of the most click list on facebook. i think what is different now is the focus we saw this earlier in the hearing this week, the focus on the algorithm, and it goes against what facebook used to tell us, which is this the public square on vine, right? this is just us talking to each other in a different way than we have before. we all knew that that was not really how it works, and now the american people are starting to understand that this is a highly curated experience and somebody behind the curtain moving things and putting things at the top of their feed, i think, that's a thread that congress can pull that they have not been able to pull or talk about or agree on in a while, and i think the average american can easily understand that and make it easier to pass legislation. >> before i let you go, klobuchar said the u.s. needs an updated competition policy when it comes to social media networks. do you think there's an appetite for breaking facebook up?
