Eat less start with the news. Senate majority leader Chuck Schumer has set up a vote tomorrow on a house bill that would raise the debt ceiling. It comes amid a standoff between democrats and republicans over spending. Ten republicans would need to break ranks, something thats looking increasingly unlikely. If passed, the bill would extend the debt ceiling in 2022 after the midterm elections. Treasury secretary janet yellen said the limit must be raised by october 18th or the government wont be able to pay its bills. The fact is we dont have the luxury of waiting until october 18th to raise the debt ceiling. Even a near miss can have consequences. Every single day we delay taking action, we increase the chances of doing irreversible damage to our Global Economic system, our economic recovery, and our countrys trust to pay its debts. It must pass legislation to avoid a default. We arent asking that rubs pass it, but we only ask that they get out of our way as the democrats pass it on their own as they did in terrell 2000s. Its really that simple. Twice in the past two weeks republicans have blocked the chamber from taking action. On Floor Yesterday Minority Leader Mitch Mcconnell reiterated it will be up to the democrats to do something. The majority needs to stop sleepwalking toward yet another preventible crisis. Democrats need to tackle the debt limit. We gave them a roadmap and three months notice. I suggest that our colleagues get moving. Earlier in the day, mcconnell sent a letter to President Biden urging him to encourage democrats to increase the debt limit without republican support. He wrote in part this. We have no list of demands. For 2 1 2 months we have simply warned that since your party wishes to goerch alone, it must handle the debt alone. To the battle over infrastructure where democrats remain divided over the price tag for a social spending bill. Two sources tell nbc news in a meeting with progressives yesterday, President Biden expressed optimism that he could get joe manchin and Kyrsten Sinema to agree on a bill. However, this is 100 million less than the range he gave House Democrats during a closed door meeting on friday and more than a trillion dollars less than the Figure Progressives are asking for. Following yesterdays meeting, vermont senator Bernie Sanders scoffed at the idea for voting for a 2 trillion bill. Were going negotiate. Its going to be give and take. At the end of the day, my own view is 3. 5 is a conservator number, that, in fact, if were going to deal with climate, we have do more. Are you willing to do thank you. Nbc news also caught up with sanders later in the night following the second of two meetings he had with Senate Majority leader Chuck Schumer. There he appeared to send a message to the moderates in the senate that concessions are, quote, a twoway street. On it, President Biden and the progressives are changing tactics. As he meets with representative elise slotkin, telling American People whats in the bill and saying that infrastructure should happen, whether or not reconciliation does. Lets start with the Virtual Meetings the president had. Tell us what was said, what was their reaction . Good morning, jonathan. President biden said the number was most likely going to have to be between 1. 9 trillion and 2. 2 trillion because he thinks thats where he can get joe manchin and Kyrsten Sinema. We havent heard well get support from joe manchin and we dont know where Kyrsten Sinema stands. Thats the range he thinks is doable. I was told by sources on my call the president would support whatever number he was able to get, and so thats significant because while you have senator Bernie Sanders fighting the fight, were still pushing for 3. 5 trillion publicly, you have progressives in the house stalling on the Infrastructure Bill last week, playing very nice with the president saying they will do what he is able to do. Also on that call, im told there was a lot of discussion about how this bill is going to be scaled back and that progressives want to keep all of the priorities in the 3. 5 trillion plan, but fund them for a shorter period of time, so that is what decreases the top line number and the amount of spending rather than picking and choosing programs they think they want to fund everything, make it a shorter period of time. I was also told President Biden said there is no decision on how to scale back that bill, jonathan. And the president is going to have a similarly virtual call with more moderates later in the week. And as i just reported, officials tell me, theyre really trying to highlight whats in the package. Thats part of why hes going to michigan today, to try to sell this to the American People and put more pressure on lawmakers, we all agreed do this, lets get this done in the weeks ahead. Lets shift gears. Does senator majority leader Chuck Schumer actually believe he can get republican Fos Break Rank or is that another showboat . Walk us through this and tell us why it matters so much. I think they would obviously like to get the ten republicans, but its most likely going to be another showboat. Theres been no indication in talking to them that they plan to break ranks with Minority Leader Mitch Mcconnell on this. Leader mcconnell said hes not going to provide any republicans. This is critical because, of course, the credit of the United States is on the line, but theres a lot of precedent here as well. The reason is whilelys been a lot of bipartisan vote in the past, the Minority Party has filibustered, blocked the Majority Party from even being able to vote on the debt limit, and this is deep in politics, jonathan. I was speaking with senator scott last night. He said undoubtedly democrats who control both Chambers Of Commerce will be blamed. He thinks this is a political issue and we know he operates in the realm of politics. I dont see how the standoff breaks. One thing that democrats are also really frustrated with is because like i mentioned at the top, this is something that has been partisan in the sense that the parties have asked for concessions in the debate over the debt limit, but this is the first time that it has been blocked. And democrats think that this is creating a cycle of chaos that not even lifting the debt limit can be done on capitol hill and its just showing that the partisanship is just getting deeper and deeper and people are being unworkable, jonathan. This is certainly a dangerous political standoff, and its hard to many would say defend other republicans playing this. Shifting gears, Facebook Says its up and running again after a, quote, Faulty Configuration Change caused world wide outages. Service was out for more than six hours including whatsapp and instagram. A Whatsapp Employee said no internal services were working at the companys headquarters including emails and calendars. The republicans have to just let us do our job. Just get out of the way. If you dont want to help save the country, get out of the way so you dont destroy it. This is their debt that they chalked up themselves. This is a period of time where we could easily solve this in the next two days and easily do that through allowing democrats to be the adults in the room despite the fact that republicans spent like drunken sailors over the last four years before President Biden took office. Do you think Mitch Mcconnell will think twice about whether he wants republicans blamed for a tanking economy and crashing 401 k s . Im not going to venture to guess what Mitch Mcconnell thinks about anything. Smart guess. Theres a lot of political gamesmanship going on on both sides. You could see the president yesterday trying to get out ahead of this on the messaging and shift that blame to republicans, bringing up the point that it is spending under previous administrations including significant spending under the Trump Administration that has contributed to the debt and the need to raise the debt ceiling. Saw him calling out mcconnell by name specifically. You saw him calling out republicans in general, and you see a bit of a preview of what the white house plans and intends to do over the coming days as this issue progresses. Obviously the white house wants to resolve this by this week. They have until about october 18th. At least congress has until october 18th to act, and, you know, you see where the white house would like the political winds on this to be blowing. Republicans have also made a political calculus in their own political strategy and now you have a classic game of washington chicken, and when we have seen past instances of washington dysfunction like a Government Shutdown as kind of the most typical public display of washington dysfunction we see, its kind of hard to see which side takes the blame. Weve seen it backfire on republicans. Weve seen it backfire on democrats too. Were definitely, definitely in Uncharted Territory when it comes to hitting the dell ceiling. Its extraordinary how much pessimism there is on both sides. What are your sources telling you, shannon, about the endgame . How do white house officials see this playing out in the coming days . You can see how theyre trying to have this play out. No one, i think, really knows at this point how it is going to play out, but theyre trying to get out publicly on the message on this. The president has the bully pulpit here, so you can see him using that to continue to put pressure on republicans. Republicans on the hill have indicated they think democrats will essentially blink and go it alone. You can hear that in the messaging from some of them. But, of course, at the same time, the white house has two other bills theyre trying to get through. They dont have a pressing deadline like this one, but they are so crucial to the president s Campaign Pledge and what the president has committed so much for his first term to doing this Infrastructure Bill and this broader social spending bill that, you know, this is one more issue detracting from those and getting those passed. So youre going to see the president today in michigan. Hes going to try and get the focus on those bills and whats in them and rallying public support for them, but, of course, a bit hard to do when you have such a catastrophic event potentially on the horizon in really less than two weeks now. Shannon, one last quick one. You mention the michigan trip. Theyre going to try to get on the road more, get the president out there after being largely holed up in washington the last couple of weeks, true toy sell the bill, whats in it, whats popular, according to polling, and also reach out to moderates and democrats in the house who have felt ignored in recent days and weeks during negotiations. Talk about what you expect to hear from the president today and what their pitch is going to be on the bills as they try to take it on the road even though negotiations still seem far apart on capitol hill. Yeah. I think all of those points i think the white house has said from polling a lot of elements of these packages are really popular, Prescription Drug prices, a program to try to lower Prescription Drug prices, a program to try to lower child care. They want to get the message on to those topics and away from the process, the democratic infighting, the price tag, which really have dominated the conversation over the past couple of weeks. I would add one more thing about the message toochl i talked to a white house official about this. They emphasized michigan is a heavy union state. They think this is a message that resonated well with union households. It represents a lot of things that unions have been working toward, and so that adds to the reason theyre in michigan today. Theyre really bringing this message to a blue collar Working Class Union Type of household and see if they can rally support and really get this to resonate there. Certainly President Biden not shy about expressing his fondness for union households. Ill be on that trip. Ill have more on tomorrows show. Reporter the court will take up a mississippi law that would ban virtually all abortions after 15 weeks of pregnpregnanc. The state says the landmark roe v. Wade law should be out of date. The court will also decide whether the Second Amendment provides the right to carry a gun outside the house and whether the states can block giving public tuition money to schools offering religious education. Judge Brett Kavanaugh was absent. Hes listening to the arguments remotely, but hell probably be back next week. Everyone is fully vaccinated. Judge kavanaugh will be back once his quarantine is over. Joining us now, secretary and ceo of the Phi Beta Kappa society and former president of Brandeis University and author of the hook Publishing Hate bias laws under america. Thanks so much for being here today. Thanks for having me. Lets start with important matters that will be before the Supreme Court this year. Tell us a little bit about what to watch out for, what to expect as the new term begins. Clearly abortion will be the headline in this term and it could well be this is the time after 50 years that roe v. Wade is finally overturned. This has been a concerted effort among conservators and prolife advocates, justices, and they may have the votes now. Mississippi when it originally asked this case to be heard did not ask for roe v. Wade to be overturned and in subsequent pleadings did ask for it, so thats going to be on the table. You know, its hard to remember now, but row against wade almost 50 years ago, 20 years later when there were eight of the nine justices appointed by justices, the court upheld the right to abortion in Planned Parenthood against casey. The question is now whether it will stand up. Theres good reason to believe roe v. Wade will actually be overturned. Thats a big case everybody will be watching. The gun case is out of New York City. The Supreme Court has upheld an individual right under the Second Amendment to bear arms. The question is does that apply outside, and the city of new york for good reason is considering having sensible reasonable gun control which could be consistent with the Second Amendment according to those very Supreme Court rulings that allow the right to bear arms. And the last one about support for religious schools. Lets see if that stands up too. Every so often we get a surprise from a Supreme Court justice. To some it was surprising Justice Roberts supported the Affordable Care act. Lets talk about which justices are most likely to potentially break ranks from where we think they would be ideologically and what matters. Probably the chief Justice John Roberts as you said and possibly justice Brett Kavanaugh whos already shown himself to be a little bit more of a pragmatist than an ideological conservator. Those are the two to watch. Justice Amy Coney Barrett has been interesting in her early time on the court, probably not going to break ranks on a three conservatives, hard to imagine them breaking ranks. I will be watching the Chief Justice and judge kavanaugh. Hanging all over this will be the speculative of Justice Briar with many liberals hoping hell step down. Well, the Inherit Contradiction there he said we should not rule out anything the other thing was, the idea of using reconciliation to get this thing passed. This is the core question for democrats. You want to take all this time to do this thing that is obviously required if you dont want financial we are right at the end of the conceivable time frame here. You have to say yes lets go down that path right now if you want to do it. You should do it. It seems like he was alone here. Other democrats are not going to back him and well end up in a real dramatic stalemate in a couple weeks times. It takes weeks to do this reconciliation and a complicated process. I do think with so much focus of bidens agenda and this sort of slit under the radar. Only now people are realizing what a big deal this would be. Yeah, go ahead. In part because of the white house didnt prioritize it. They had a couple of options to push the debt ceiling through. Up until the couple days ago, they argued somehow they could get republicans on the table here. What you saw is theyre up in the anti now. October 18th is the day. Theyre trying to now and the question is i hope its not too late. Shifting gears, the u. S. Chamber commerce withdraws support of 1. 2 trillion bipartisan Infrastructure Bill. Where does this lead negotiations on the hill . We were franticly trying to figure out what the heck was going on at the chamber news . The truth is behind the scenes, the chamber is not the institution it was 10 or 12 years ago. Right now the biden warehouse, what it needs support for is putting pressure on republicans over the debt ceiling which is what we are talking about. The chambers influence have weighed dramatically on different sides. A host of issues from the president. Republicans basically have, we dont value your input anymore. Its dramatic if it does. I dont think its going to be consequential one way or another. There is so many headlines last week about not being able to get the negotiations done. There is been some cautious offense behind the scene if they are working there. Whats the latest you are hearing . First of all, i am shocked that my last question is not about the red sox.
