same lack of trust threatening to derail president biden's agenda and possibly the u.s. economy at the same time. remember, we have got just two weeks until the united states hits our debt limit, two weeks when the house isn't even in session. and while it is extremely unlikely if the united states does default, we could have an economic catastrophe the likes of which we have never seen, all for playing politics. president biden will be addressing that very issue in just about two hours from now. of course, that is not all commerce has on its plate, not this week. over the weekend, house speaker nancy pelosi tried to reset expectations for that hard infrastructure bill after a vote was delayed multiple times last week. now she says it should be done by halloween. but if last week showed us anything, it is that democrats are still at somewhat of an impasse when it comes to advancing both the hard infrastructure and the human infrastructure bills. solving those differences might not happen in a month, it might not happen in two months, but the white house says it's fine with them. these things take time. >> we don't have a time frame on it. this is about delivering and making sure we deliver both bills to the american people because it meets their needs so we're not using an artificial timeline and we're not concerned with process. we're concerned about delivery. >> let's discuss and bring in shannon pettypiece at the white house and jake sherman and anna pounder. it's clear the white house doesn't want to talk about deadline. how will he get everyone on the same page? if he didn't do it last week, what's the new plan this week? >> first of all, you mentioned this debt ceiling issue. the president, we're going to hear from him in a couple hours on that. look to him to put pressure on republicans to call out our republicans for not voting to support this as of yet and to call on democrats to take some action here. but then, of course, at the same time he is trying to get these two spending bills through. look for the white house this week, according to a white house official, to try and take back control of the messaging and the narrative and get the focus back on the content of these bills, things the white house thinks are very popular with voters, things like lowering prescription drug prices, lowering the price of child care, and getting the attention away from the price tag and what has been dominating washington in the last week. we are going to see the president out on the road. on tuesday he is going to michigan. he indicated to reporters over the weekend that he plans to make other stops, and he acknowledged himself that the messaging here has gotten a bit muddled, that people might think they know what's in the package but they don't necessarily. he's going to try to get that message out there. of course, it is coming late. the president is consumed with natural disasters in afghanistan. even he acknowledged he could have been doing this sooner, but now the white house trying to get him on the road, take control of that messaging and really try to make another sales pitch for these bills. >> but can he? at the end of the day, nobody knows what's going to be in this package. how does the president go on the road and say here's what's in this $3.5 trillion bill. there is no $3.5 trillion bill going to happen. what does he sell? >> it's about process because democrats are all over the place when it comes to prescription drug prices, and kennedy allowed the country to talk about drug prices with medicare patients. usually deadlines help here, but i have to imagine they might even miss the next deadline, which is the end of october, because there is no ironclad agreement at the moment between senate democrats and house democrats, and that needs to happen. i would say this. it's very difficult to walk away from the price tag. it's very difficult because that's what a lot of lawmakers are focused on. this comes up all the time. the president and leadership says it's not about the price tag, it is about the price tag, and they have to come to agreement about the price tag or else this process is going nowhere. >> if it is about the price tag, ana, then did democratic leaders drop the ball? if chuck schumer knew a year and a half ago that 1 trillion or 2 trillion was joe manchin's number, why weren't they grinding off of that? >> it's hard to say exactly what schumer's strategy is here. i do think this is also recognition of where the progressives are, where the energy of the base of the democratic party is, which they wanted $6 trillion, so they feel like they've come down quite a bit here. i do think, to jake's point, the teaming up on the end of october deadline will be hard because they'll have to raise the debt ceiling here in the next two or three weeks. this is something where you'll see the president trying to sell the american people on these broad issues, but the real devil is going to be in the details, and it's going to be on the number, the specifics, and that's why these negotiations are so difficult. >> difficult but important. then, jake, are we misreading this and saying democrats have failed, they missed their deadline, it's over for them? these are difficult negotiations. we're talking about trillions of dollars and major policy changes that are going to impact this country for years to come. couldn't one argue, irrelevant of how you feel about the bill, it's a good thing they're still working on it. their pencils aren't down, they're not not talking to each other. they are working on it. >> yeah, i think it's irrelevant they've blown through this. i think it's a temporary blow to the process. they have plenty of time left in the year. but ana makes a good point. this debt limit point is going to interfere here and joe biden coming out today and trying to pressure republicans into doing this is not going to make an inch of a difference, i hate to say, with republicans who have been just pretty firm that they have no interest in raising the debt ceiling, and they've shown they're not really interested in being lectured on it, which you could have an opinion about. i think it's ridiculous not to raise the debt ceiling, but they haven't been interested in engaging this debate. >> they don't need to get lectured by the president. they're going to hear from their voters across this country. like, ana, let's have a reality check. are we really going to possibly default two weeks from now? that will mean economic catastrophe for this country. is this, or let's hope this is just political performance. come on. >> i do think that there is some political performance here, obviously, by both parties, the republicans and the democrats in terms of how they're positioning themselves on this issue. however, there is a timeline and they're still in it to kind of use this reconciliation mode, which means democrats would have those 50 votes in the senate. i think we're getting precariously close to really potentially falling on the debt. >> anna, thank you. i want to bring in democratic congressman from the state of new jersey, tom molinowski. tom, where do we go from here? how do we keep pushing? >> i want to step back and build on something you just said. that is that we used to have two responsible governing parties in the united states. i disagreed with the republicans on a lot of things, but at the end of the day they felt a responsibility to the country. at a moment when they're refusing to extend the debt limit, when the overwhelming majority of them are refusing to vote for a bipartisan highway bill, what we have to understand is that the well-being of the country is now exclusively on the shoulders of democrats. we have to do our work with a zero vote majority in the senate, with only three votes to spare in the house, which means all of us have to agree on this stuff to move forward. that's not easy. it takes time. it requires negotiation. it looks messy, but i much prefer the messiness on our sides to the forced conformity and irresponsibility on the other side. so the next step very simply is that we need to take the time to find consensus among democrats on the second bill, on the build back better bill. it's not going to be $3.5 trillion. we made a lot of progress in the last week at getting to a more realistic number, now we have to figure out how do we get to that more realistic number? what are we prepared to sacrifice, what are our core priorities? that's a healthy debate we're going to have. >> then let's talk about that. i feel like everything we're discussing is about whether we're going to spend or not spend, about the programs we want to fund. but i'm hearing very little about pay-fors. we're hearing almost nothing about closing tax loopholes, right? there is not a lawmaker i speak to that ever says, oh, i really like the hookups for the private equity industry, the hookups for the real estate industry. but when it comes time to us, last i checked, exchanges are still in there. why aren't they being closed because that attacks the super rich, you know, the big donors. >> i actually think there is a lot of agreement on pay-fors. joe manchin, who doesn't agree on everything, came out and said he's happy to raise the corporate tax rate. i think he supports the minimum corporate tax and an increase in the corporate tax rate. back home in my district, and this is what i really care about, i don't meet a single person, republican or democrat, who argues that amazon should pay zero taxes. so this stuff is actually fairly popular among not just the democratic base but among the american people, and i think most members in the house and senate will be supportive. i think given how much we can raise by doing those things, we have to have what is still a much harder debate about what priorities we're willing to fund within those limits. and that's what we're going to do, and i'm very calm about this. i believe we're going to be successful. >> does that believe we will expect to see things like the carried interest loophole for private equity closed and the 2031 exchange for massive real estate investment firms, are those things going to be closed? we always hear about amazon because that's a great headline, but i want to hear about that smaller group of rich people that really get hooked up. >> i do, too. but to be frank, those aren't the big revenue raisers. people are understandably upset about those aspects of the tax code, yet that's not how we raise 1.5 or$2 trillion to be able to pay responsibly for the priorities of the investments in this bill. one thing that ironically distinguishes us from the republicans right now is that we do want to be fiscally responsible. we don't want to just push more money into the economy without raising revenue in a way that is responsible. >> the one way you are looking to do it is to raise taxes on families making $400,000 or more. in your state of new jersey, there is pushback from those saying what about the s.a.l.t. deduction. where are we on that? >> i strongly support full s.a.l.t. deduction. that will be in the bill. i've made clear i can't vote for it. i've had many conversations with folks in the house and the senate. i'm confident it will be there. we were saying, a lot of us, no s.a.l.t., no deal. now i'm reversed that, it's no deal, no s.a.l.t. this is why it's important to my constituents in new jersey that we land both these bills. we need the infrastructure, we need the jobs, we also need the s.a.l.t. deduction, the investments in child care, low drug prices. all of these things go together, and democrats, we don't agree on all the priorities, but we do agree that it's incredibly important to the success of our democracy that we get this done. that's why i believe we will. >> it's a lot of work, and if it takes a little more time, so be it. congressman, thank you for joining me this morning. i appreciate it. >> thank you so much. now let's turn to developing news out of southern california where crews are frantically trying to limit the damage from one of the largest oil spills in recent history. nbc's erin mclaughlin joins me now. erin, what's the latest? >> reporter: hey, stephanie, well, beta offshore, the company responsible for the pipeline in question, says it's still searching for the source of the oil leak. they were searching with a team of divers throughout the day yesterday. they believe the leak is about 4.5 miles offshore, but the pipeline is located 100 feet below the surface of the water, complicating efforts. that said, they say they have managed to shut the pipeline down and suction it off, however, local officials say the damage has already been done, some 126,000 gallons of oil released into the ocean, and it's a damage that the company appears to have been aware was a possibility, according to a report that nbc has obtained a copy of dated to 2012. they were calling this a worst-case scenario, an oil leak in this area of that size, saying, quote, that it could cause significant and substantial harm to the environment because of its proximity to navigable waters and adjoining shoreline areas designated as environmentally sensitive. already oil has seeped into protected wetlands, protected areas, areas that they have worked hard to build up, damaged in the matter of a day. they've closed down entire stretches of beaches as well as fisheries. the economic impact of all of this still being estimated and the cleanup effort is well underway. we have reached out to amplify energy which owns abeta offshore for comment on that 2012 report. we have yet to hear back. stephanie? what are we facing here? >> just to hear, roe versus wade, you're kind of like, what? >> the table has been set with a conservative minority, 6-3. as you mentioned, roe v. wade is probably the one that faces the biggest challenge for the first time in a long time. this is the case causing a lot of concern because it flies directly in the face of roe versus wade. it says it allows prohibition of abortion in the first several weeks. they only take up cases when they think there is a significant legal question, so that signals there is a very strong appetite on the court here to reverse roe versus wade. i think that's what has people concerned. >> we saw thousands of women marching about this very topic over the weekend. but pete, should we be surprised? one of the reasons the president had so much -- former president trump had so much evangelical support over the last four years was this laser beam focus on supreme court openings, federal judgeships. none of this should be a surprise to us. >> i suppose not, and of course the big issue in the roe case is the question of viability. what roe followed on a case called casey said, is they can restrict it but they can't ban it on availability which the court said 24 to 26 weeks. that's what so objective to roe because mississippi law says you can ban it after 15 weeks, and the texas law which may return to the supreme court before this term is over, would, of course, ban it after six weeks. >> barb, make us smarter. we keep hearing about the use of this shadow document. now judge leto is calling criticism of the shadow document misleading. is there reason to be concerned here? the shadow document is what got us here. >> the shadow document is a nickname for procedural issues to be made off the docket of the court. for instance, over the summer, when the court is off, all kinds of things are still happening in the law. people are asking for relief from the death penalty, for example, or an emergency stay to enjoin that case. what is happening, as elena kagan, one of the justices in the court herself said, more and more the court is using that procedural opportunity to make substantive decisions, and they do it without the benefit of full briefing or full argument. in that way there is a stealth process going on. i think justice kagan is correct that when they make these critical decisions, they ought to do it in the light of day so everybody has the chance to participate in that decision-making process. >> a lot is happening in the court in the next couple months. it gives you chills just to see what's coming um. barbara, pete, thank you for being here. up next, vaccine mandates are now in place in major states and companies. and guess what, guys? >> you know, morgan, it's just too soon to tell. we've just got to concentrate on continuing to get those numbers down and not try to jump ahead by weeks or months and say what we're going to do at a particular time. let's focus like a laser on continuing to get those cases down. >> well, at the same time, former fda commissioner scott gottlieb says we can get together. joining me now to discuss, cnbc "squawk box" co-anchor and founder angela sorkin. american airlines, jetblue now requiring vaccinations for their employees, but we're still not seeing requirements for passengers. any sign that's going to come soon? >> i think that's actually unlikely and we've heard from a number of airlines who said they don't want to push for that. if it were to come, it would have have been something mandated unless the airlines did it voluntarily. given their in business, they don't want to do that. having said that, of course, they received an enormous amount of money from the u.s. government in taxpayers, so i think there is a question from a sociability perspective whether they should do that. >> so many businesses are requiring vaccines and it's working. can you speak to this? tyson foods is a great example. before they put their mandate in force, even more shortages we would be facing. >> the truth is there are a number of companies who deserve credit for their quote, unquote, leadership. it all came too late. there are a lot of folks talking about these issues and the idea that businesses could get ahead of it and change the game. they're now changing the game. i don't want to say it's a little too late, but it is a little too late. here we are and it is starting to work. having said that, it's creating operation issues where employees are saying, not so fast. i don't necessarily want to do this. >> let's talk about employees going to bat. corporate america delayed the reopening until january of '22. that is the height of winter and who knows if covid will be surging again. you and i both know privately, with the exception of a few tech ceos who save money working from home, a number of ceos out there want their employees back yesterday. realistically, when do you think it's going to happen? >> stephanie, they're going to get passed because they have to get passed. when you think about what president biden is trying to do here, we haven't seen something like this since probably fdr. he has taken a very ambitious program, because right now the american people need investment in them and their families and their communities and the infrastructure. and president biden has taken the agenda that he promised the american people he would do on the presidential campaign trail and he's bringing that together right now. is it easy? no, it's not easy. sausage making is not pretty. legislating is not pretty as well. but we're going to make sure we move forward and deliver for the american people. that is our message going into 2022. democrats deliver, republicans obstruct. >> democrats are the ones who do set these deadlines, though. it was speaker pelosi who said this was going to happen last week, and that's what's giving people pause, if it had to pass, if it needed to happen last week but didn't, what gives you confidence now? every time you hear krysten sinema speak, they say, is she talking to pelosi or the president? it makes a lot of people scared. >> i know there is a lot of hand wringing in this process. i used to crack the whip for jim clyburn. we had deadlines, the deadlines slipped, but at the end of the day we got it done and we got it passed. listen, i didn't have hair before this, i'm not growing any any time soon. but we're going to get this done because we have to get this done, because the american people expect us to get it done. and so we're a very diverse party, so we will have diverse thoughts about what the scope of this is going to be. but look at the contrast we have right now, stephanie. the democratic party is debating the scope of how we deliver for the american people. the republican party on the contrast is just sitting on the sidelines trying to figure out ways to obstruct. we see it on the debt ceiling, we see it on so much. they're trying to protect the tax cut for jeff bezos where we're trying to get the mom and pop shops on main street to make sure they stay open. >> republicans are not in power, you are. i'm not saying they're right and he's wrong, but is the democratic party a party in which joe manchin and far left progressives can exist in the same party? because love or hate republicans, they get behind -- they get on the same page even when they hold the nose and hate their own president. >> well, stephanie, if we had a monolithic party like that, it would be much easier to do that, but we don't. this party, the democratic party, looks like america. the diversity of this great country is the diversity that you see in a democratic party. and with diversity, you got strength but you also have challenges sometimes bringing folks together on the same page to make sure that the priorities are the same. but i'd much rather the diversity that we have on our party, because at the end of the day, the end product is stronger. the nation is stronger. so, yes, the republicans are on the lens, but they still have the need to do what's best for this country. hanging on the debt ceiling does not do that. we're going to do what we have to do on the democratic side and continue to move forward. like my grandfather used to say, the train is going to move. you can either get on the train, you can sit on the sidelines and watch the train or get off the train. we're going to continue to serve the american people. >> and you definitely don't want to be on the wrong side of a train. thank you for being here. i appreciate it. >> thanks, stephanie. what's blowing my mind, ozy's fall from grace. the company and ceo speaking out this morning after one of its co-founders reportedly pretended to be a youtube executive to make investors think the company is hot, hot, hot. the party that broke the story to all of this joins us next. to all of this joins us next [ laughs ] ♪♪ [ humming ] [ door creaks ] oh. that is an insane lie. >> i guess i think of it as incredible spin, but you're the finance professional. >> what will be the consequences of all this? >> i think it depends. if what happened here is advertisers got deceived, in the end. i think if it turns out that that phone call with investors was not the only time that they explicitly lied to investors, that's where it becomes fbi or securities and exchange commission issue. which could be securities fraud or wire fraud. the fbi certainly looked into it initially. i don't know the status of that investigation. >> well, they say they may be down, but they're not out and they're moving forward, producing shows and news letters. how are they going to do that? in what scenario would it be normal that they would say, yes, we have financial backers. we're just not telling you who they are and we're not tell you who's on our board. this is a media company, a news organization. why would you trust a news organization that's not telling you what's behind them? >> reporter: well, stephanie, they are going all out to counter the image that miss haugen portrayed of a company that she said had essentially ran right over its safeguards and made possible the january 6th riot. she also, as you know, turns out to have been the source for the "wall street journal's" explosive set of reports. at this point, facebook, however, is coming out with several statements about it. most recently, they talk about the extraordinary efforts that they are making to create a safer place. they say, every day, our teams have to balance protecting the right of billions of people to express themselves openly with a need to keep our platform a safe and positive space. this is rhetoric we're going to be hearing certainly throughout the week and from their officials. we have not heard from mark zuckerberg. we have not heard from sheryl sandberg. but other top officials at facebook coming forward to speak this week, stephanie. >> but here's the thing. this hearing is going to happen tomorrow. it's going to be explosive. we're going to say, i can't believe this. i can't believe we're not hearing from cheryl, i can't believe we're not hearing from mark. but the beat goes on. is there anything significant that should make any of us believe that regulation is really coming down the pike that's going to change anything? this is bad press for facebook. i don't see any advertisers pulling or users, for that matter. >> reporter: certainly, their bottom line has not been hit, stephanie. that is correct. >> and that's what matters. >> the hearing tomorrow will be very interesting to watch. we saw a little preview last week of davis being grilled by senators and we're starting to see people like frances haugen, really well-placed people inside of facebook walking out with tens of thousands of documents. we are also starting to see a shift in the legal structure around people who speak out against their former employees. where i'm standing here in san francisco is the kind of place that i have to go to meet people in secret from this industry. it is an extraordinarily secretive industry. i would say it rivals national intelligence agencies for its secrecy. and now we're going to have a new law here in california. it's on the governor's desk right now, that will protect possible whistle-blowers against ndas, the confidential agreements that are typically signed. i think the legal framework could be change here, steph. >> that's really important. it's important for whistle-blowers and journalists. but for everyday americans, mothers and fathers who are panicked about their kids on social media and the negative influence on their kids' lives, are we one inch closer to regulation that could change that?
