across the finish line? >> and we are following breaking news of the coast of southern california. a major oil spill has prompted the closure of several beaches, and is being described as a potential ecological disaster. >> and just days before the start of the supreme court, hearing that could decide the future of roe v. wade, protesters filled the streets nationwide with a resounding message to conservative judges and lawmakers. >> we have to fight, just to show why elections matter. legislators are going to pass these draconian laws, then we need to change the lawmakers. >> how dare they? >> yes, 8:20 pm, yes. stick to news! >> this is what happens when i try to talk sports! >> the folks at nbc have been trying to keep really quiet about this game. they decided, you know, they will not have leicester talk about it, anyone talk about it. it is a big deal, a great game! >> a fun matchup, for sure. good morning, it is october 3rd, i am lindsay reiser. >> i'm candice gibson. great to be with you, we are live on hq new york city, let's look at the team we are fortunate to have with us this morning. do you of course of correspondents joining us from all across the country. but we are going to begin with breaking news story on the west coast this morning, specifically, orange county and what's at least one official calls a potential ecological disaster in the making. officials are waiting right now to get their best look yet at a massive oil spill. >> of course, it is dark over there right now. but we did get this overnight video during daytime hours. we will tell you where this is, the spill is three miles off the coast of newport beach in orange county. you see those dark spots in the water on your screen? the coast guard says this oil spill is about 13 square miles in size. >> this is some prime real estate in orange county. the officials told people in that area that oil will start to wash ashore last night, and it did so. crews are waiting for sunrise to get a better idea of the impact that is about four hours away, on the west coast. right now, obviously they are asking the public to avoid the area. the l.a. times reports the offshore oil producer tied to this spill, we are also told the airshow scheduled to happen today it was canceled as a result of this in newport beach. officials say the oil is still spilling from the source right now. >> yes, it already has a ripple effect, the air show as been going on the last two days, the final they canceled suppose crews can have an easier time with cleanup. we will stay on top of this, continue to watch this as candace has been saying, they are waiting for daylight hours to fully assess, we will bring you updates as they come in. >> let's move on to the drama taking place in washington, d.c.. and there is a certain senator who is trying plenty of criticism from her own party, and she speaking out for the first time. senator christian sent about, releasing a statement calling the delay on the infrastructure vote a failure. she went on to say, over the past nine months democratic leaders have made conflicting promises and that delaying the infrastructure vote has eroded trust. >> she was not mincing words in that statement. by the way, speaker pelosi set a new deadline for this vote, october 31st -- halloween! right now, the house is on a two-week recess, but those negotiations will continue. in fact, the white house is laying out president biden's next steps, saying he plans to host lawmakers next week to continue those negotiations. these are pictures of the president meeting with senators kyrsten sinema and joe manchin in a previous week in the oval office, biden acknowledged he does see the physical and human infrastructure bill is linked. so the bipartisan infrastructure bill, and the budget reconciliation, he expects the size of that human infrastructure bill to come down, still working on a number and what will be cut. >> let's go to nbc news reporter -- who is on capitol hill with us. julie, good morning, that's a strong statement got overnight from senator sinema, it was surprising. we rarely hear from her. what's been the reaction so far? >> yes, guys. it is an extremely critical statement of democratic leadership. and one senior democratic aide actually text me, flabbergasted that sinema was saying this about her own party. but look, she has not been shy to criticize democratic leadership in the past. she is part of this enigmatic presence on capitol hill. she only speaks to her reporters on her own terms. it is often hard to get inside her head. she does not disclose her private conversations. this is brewing frustration amongst many democrats across the country, including, in congress, who publicly went out and attacked for this, including congressman roxana, in a private democratic caucus meeting last week, our team reported, sort of grew frustrated with her, out of all of the senators and moderators in the house, that he is frustrated with, for holding up this human infrastructure package. you know, he accused her of essentially not knowing what she wants in the bill. we had other democrats, from her state also do this. they were like, tell us what you want, in this human infrastructure package. but i spoke to an aide close to senator sinema last week or told me she has been disclosing what she wants to president biden, two democratic leadership. i think that is part of the frustration in her statement, in which she feels like they turned on her, and are not defending her, knowing very well what she wants. she is just not publicly disclosing it. but look, senator kyrsten sinema has always been this sort of figure, when she was in the house a few years ago, including, she used to be a great party activist, climate change is hard on her priority list. i am told she has never been this sort of liberal democrat that these progressive sort of won her to be, as they are negotiating this human infrastructure package. and people across the country, democrats in arizona and washington are growing frustrated. they say she is holding up president biden's agenda, as the democrats control the house, senate and white house. they just want her to get in line behind this human infrastructure package. >> people have been growing frustrated. they were frustrated with both manchin and sinema, maybe some frustration dwindled a bit when manchin came out with that 1.5 trillion dollar figure of reconciliation, at least we know where he stood. you are mentioning that sinema has not gone public with that. we will talk about that with our next guest, who is a lawmaker, to see if he might know about top line is. but julie tsirkin in the meantime, thanks for starting us off. >> all right, let's bring in one of those lawmakers who did meet with president biden last week, michigan congressman and chief deputy rep of the progressive caucus, dan kildee. >> by the, way he is in favor of both bills and tweeted, what is in the human infrastructure bill, especially for seniors in his state, pointing out that expanded medicare and lower costs of prescriptions from retirement, security and on, here he goes. >> let's go ahead and welcome back congressman kildee back to the show this morning. congressman, thanks for being with us after a marathon week, no doubt. i will read you a little bit more of senator sinema statement. she writes, democratic leaders may conflicting promises that can all be kept, and other times, pretend the differences of opinion within our party did not exist. what do you make of this statement, and her role in this process? >> well, obviously, her role is he, as is senator manchin. so is everyone else. we do have differences of opinion, within our caucus. that is a good thing, that is how a democracy is supposed to work. we all come with the same ideas, some of those are not necessary. but what we see right now is a process, playing out. sometimes it is not pretty. but it is a matter of negotiation. and while there are conflicts, our commitment is to submit those conflicts to this process, negotiate something. i think the progressive wing of the party is going to have to accept, the 3.5 trillion will not be the top line, it will be something less than that. more moderate members will have to accept that we will move forward on the hard infrastructure bill, when we have that other aspect of this whole build back better plan put together. so, i understand people are frustrated. the goal is to get this done. i think we are on the path to doing that. >> i'm curious about one particular part in her statement over there, or the senator says that she found that the delay on the infrastructure vote, she called it a failure. there are a lot of people who would say she is the reason for the delay. do you think so as well? >> i think everybody has their opinion about who is in the way. >> who do you think is in the way? >> i would prefer that both senator manchin and sinema were explicit about what they are willing to accept in the build a better act. if they were to do that, we could move forward much more quickly. but look, everyone has the right to their views. she has a right to hers. but i do not appreciate is characterizing something that is not over with yet, as a failure. we are going to get this done. all of the democrats support the bipartisan infrastructure bill. we will passed, it but we have another piece that needs to get done as a part of it. i think it is less productive for us to start blaming one another for how this turns out when we are not finished yet with it. we will get this done. >> congressman, quickly, we want to go on to the debt ceiling, another important issue that is facing your chamber. but do you have a top line from kyrsten sinema? we just heard our reporter julie tsirkin say the public is frustrated, they do not know where she stands. but inside, do you? >> i have not heard from her, what her top line is. we know from senator manchin where he stands, you know, the understanding that he has into senator schumer to help move the ball a bit. but i have not heard, it is not that she does not have, one i have not heard a top line from her. >> congressman, when you guys went to washington and got sworn in earlier this year, and you had a democratic house and senate, did you expect it would be this difficult to get things passed? >> i knew it would be tough. we all talked about what it is like, to have really thin margins. to have a three vote margin in the house, a zero vote margin in the senate. we talked about it in the abstract, this is what it is like you have to govern with such thin margins. but, you know, one of the things that happened in washington is we focus so much on the process, that we forget that the people out there, people who we represent are only concerned about what the ultimate result is. but we are going to get this done, we have to get out of our own way and i think everybody is watching every move we make. where they really want to know is, we get this across the finish line, will it do something? give me a tax cut if i have kids? make sure i have health care? all of the things we are trying to deliver. when we deliver, that that is going to be the thing that people will understand and realize. not so much all of the machinations that are going on, in trying to get this across the finish line. >> all right, congressman. good to see you, again. of course, we will now be watching the biggest game today, the lions up against the bears, hoping it -- >> i can do this over the show, we keep going over the lines! >> if you went over the lines, it will be easier! >> no, when we are working. we are working on it! >> we are working on it [laughs] >> that's escape line one congressman. >> i think they will be easier than the lines. congressman, thank you! appreciate it! all right, so tomorrow is gearing up to be a very big day for the supreme court. in court, rather, i should say for some of the january 6th rioters. >> the day is coming. a former trump administration appointed to the state department as well as two people accused of assaulting capitol hill officer brian sicknick will face a judge. by the, way we've already been reporting the house committee investigating the attacks are saying more subpoenas are on the way. nbc news washington investigative reporter scott mcfarland catches up on the latest. >> here we are, nearly nine months since the u.s. capital breach. and the number of defendants still rising, more than 600 and counting. that includes a newly unsealed case, against a man named jeremy brown, of florida. according to court filings, he is a former congressional candidate from florida, who brought an rv with him to d.c., in january. an rv, the feds say that he called ground force one. he's also accused of having tactical beer gear on him, including zip ties. no defense lawyer yet listed for jeremy brown, no plea entered yet. also, rising has been good for this, week and a number of plea agreements reached in the january six cases. almost exclusively, in the lower level of cases, misdemeanor cases. but there was a seminal moment as the week ended. the first two defendants to plead guilty to misdemeanors and get jail sentences from the judge. there jen car and eric brow, both acknowledge being unlawfully on the grounds of january six. both had tactical gear with them, both are accused of proceeding into the capital, despite seeing warning signs of unrest. the judge gave each of them 45 days in jail. in, monday promises to be one of the busiest days get on the capitol riot prosecutions. full docket, including feathery go climb, the former trump administration appointee who has pleaded not guilty, and the two defendants accused of the specific assault against fallen capitol police officer brian sicknick, who later died of natural causes. they appear on monday afternoon. that is the latest in washington. i am scott macfarlane, now back to you. >> thank, you scott, so much for that. tomorrow morning, 13,000 department of education staffers could be out of work, unless they get the vaccine. but, one of the country's strictest mandates will force their hand? >> yes, basically this was a study last month out of california that showed that unmasked, unvaccinated teachers, spread covid to half of their classroom. this was a teacher who was supposed to be wearing a mask in the classroom. but took it off sometimes to read to the kids. what we're finding is that just we really need to be leering protection in the classroom. especially right now when the kids are not vaccinated, under 12. so, having the teacher both mast and vaccinated is really the protocol that the cdc is recommending, to what make sense. >> yes, so those are the guidelines that the science here. but i want your thoughts to what the mayor is seeing as this mandate takes effect tomorrow. well evidence are you seeing that these mandates do in fact work? >> yes, actually we're seeing a lot of evidence of that right now. if you look at united airlines, more than 99% vaccinated now, with their mandate. tyson foods, more than 90% vaccinated. new york city teachers, more than 90% vaccinated. and new york city health and hospitals, also very high vaccination rate. a lot of people will say if you make me get a vaccine, i'm not going to come to work. but the truth is, when push comes to shove, a lot of them do. the other thing to keep in mind about teachers is, they are not a very vaccine hesitant group. i mean, more than two thirds's -- around two thirds support mandates for themselves. and more than 90% are vaccinated already. >> we heard mayor de blasio they're urging other mayors to institute mandates like this. do you have any reporting that indicates whether we may see more cities going this route. or do you think some of them are teaching taking the wait and see approach? >> i think there are some other ones already. los angeles, chicago, oregon, washington washington. but i think we are probably going to start seeing more and more. as one propels another. we've already seen that actually with airlines, were united announced their mandate a while ago, and now we see alaska, jetblue and american following suit. so, i think one mandate can definitely propel another, and we've been seeing a lot of that lately. >> real quick, hilary, last question. we talked about evidence that this monday is working and other industries. tyson for example in food preparation, united in airlines. are we seeing evidence that this is leading to significant staffing shortages? >> i think that not all voices are heard. the voices of women are oppressed. >> a woman's march on this scale, the largest since 2017, the day after president trump was inaugurated. >> texas is the restrictive abortion law, empowering the step of hundreds here in l.a.. and thousands across the country. >> now, in effect for a month, it bans abortions once a fetal heartbeat is detected, as early as the sixth week of pregnancy. before many women even know they are pregnant. it makes no exceptions for rape or incest. americans divided on the issue. in d.c., a smaller gathering outside of the supreme court today. and i abortion rights advocates, praying for the unborn. >> today we come before you, almighty father. >> congresswoman -- defending texas's law on capitol hill this week. >> i would not be here had it been for the very brave choice that my mother made, 33 years ago. >> but opponents say that was her mom's personal decision. and all women deserve that choice. >> no one, specifically the government has a right to step in and say hey, we will take that away from you. >> the supreme court will take up a challenge to row the wait in december, in what could be the greatest threat to abortion protections in decades. lindsey, kendis? >> i'm not 100 percent sure about. that i thought i saw a pdf of globe sports from this morning and my article on brady and belichick. i thought that was front and center. so, obviously this is a huge game and it has been all week. for everyone here in boston. and when i said it felt like a super bowl, it really does. not only has the sports pages midfield up every day, but we've got metro side, business reporters, everyone kind of chipping into this coverage. so, it's only week for, but this is the biggest regular season event i would see, in boston history. just the magnitude of tom brady coming back, facing bill belichick after all those years together. we're never going to see anything like this again. >> correction to you sort of, the online version is different, celebrating alex caress. gets you guys a little bit closer to the playoffs for the red sox. and then continues on. but i hear you on the excitement that is. there >> yes, and we know every player and coach goes into game wanting to win a, but you can't deny there some eagle involved here. they have scores two settles. let's talk about belichick. because he's not necessarily a guy who wears his emotions on his sleeve. do you have any idea how he's feeling leading up to this matchup? >> i think bill belichick definitely wants to win tonight. it's been a tough several months for him. ever since tom brady and the bucs went on that great playoff run last january, february, belichick has taken a little bit of a beaten with his ego and his reputation. a lot of people see, maybe it really was all tom brady who won all those championships in new england. and a lot of people, like myself, are seeing, why couldn't you figure this out? why is tom brady doing this in tampa and not a new england? why couldn't you find a way to keep tom brady as a patriot for the rest of his career? so, i think belichick, kind of quite the doubters a little bit, really could use a win tonight. and it would be a nice feather in his cap. because patriots are definitely the underdogs tonight. the buccaneers are the number one offense in the league. tom brady's got the ball rolling right now. the patriots might be a little shorthanded, personnel wise. they have a look quite as good this year. but if belichick can pull this off, i think that would look very good for him. at the end of the day though, brady, by winning the super bowl last year, he still has kind of the ultimate trump card. no matter who wins tonight, tom brady can still see, yeah, well i still want a. super bowl [laughs] >> brady does have the bucks ruling in the deep. that meantime, rumor has it that a lot of the beds are coming in for tonight's game. mostly for the buccaneers to cover the seven point spread. according to fan dual. what is behind all of that? >> i think it has to do with the fact that the bucks offense has been soggy this year. number one in the league in scoring over 34 points a game. pro bowlers, up and down the line of scrimmage. unfortunately for them, robert kasky is not going to be there tonight. he's got a injury. he's been ruled out. so, a lot of fans were hoping to see him return to. he's not going to be there. that they have great receivers, mike evans, chris -- antonio brown. tom brady, even at 44 is playing some of the best football of his career. just not showing his age. and the patriots have been struggling a little bit. they have a rookie quarterback in matt jones. they've only scored four touchdowns in three games. they had a bad lost last week to the new orleans saints. so it, hasn't been an easy start to the season to for the new england patriots. but the bucks, like i said, they are scuffling a little bit. and during this game, they don't have rob gronkowski. they just signed richard sherman this week, and he's going to be active on sunday night. so, i think belichick might be able to keep the game close. and if it comes down to one possession in the fourth quarter, you know, who knows? >> yes, kendis. i will also start by saying thanks for the mansion from a fellow boss tony, and i appreciate that. so, i think that risk assessment that the state was still living in the middle of a pandemic we do have new tools. and the vaccines are those tools. we are sort of seeing this as well as another mitigation layer. we do not pay enough attention to this, the ventilation part. that's why you are mentioning that outdoor component, the cdc is also mentioning the idea of opening up windows, moving the air through the room. but i want to say, for people who are traveling this winter, the assessment will be, who is going on the trip, and who is not vaccinated? to get there, part of it is that as well. and the decision that folks have to make. if you want to travel, what is the risk you are willing to take? this year, if everyone in your group is vaccinated, that risk might be smaller, vaccination increases your chance of getting infected by five times, getting sick by ten, hospitalize or dying by ten. so before travel, get vaccinated. if you are going to travel, travel to places that have high vaccination rates, low transmission rates and of course, taking all the mitigation layers while you are traveling. masking, keeping a rapid test with, you will really make the holiday travel much safer. >> should i, if i have relatives in the south, should i just avoid seeing them this holiday season, based on the infection rate? >> here is where i would say. it is the risk you are willing to take. if everybody who is in your group in the south is vaccinated, and if you are able to take all those layers, get tested, it adds an extra layer of safety, right? the other thing that i will say is, for groups who are not yet vaccinated, with -- particularly if you have family in the south were not qualifying, getting that dose for now, getting that amped up in you no response currently for those who qualify for pfizer, and soon potentially, a group of people within the moderna as well as the j&j, getting that booster will make it safer by the time the holidays come around as well. >> i have to ask you about the window fan thing. what is the takeaway from this new recommendation? it is so specific, they might as well just had the brand as well, with the recommendation from the cdc? >> yes, i think for myself, for other infectious disease folks, a big part of what we missed in the messaging throughout this is that, it matters, the air you breathe. this virus travels through the air. so, moving, the window fan is an example of a cheaper solution. you are not going to get an air purifier that is industrial, or a hippo filter which is what we use in the medical settings. but using a window allows the air, circulating in the room. it allows the outdoor, the advantages of being outdoor being brought a little bit into the indoors. i think this is particularly important, particularly when you gather a lot of people in a small room, which happens over the holidays. >> we'll have to leave it there with doctor nahid bhadelia. who do you have for the game?
