a schedule that progressives will undermine the larger social spending bill which they say must come first or no deal. of course, adding to the urgency is a looming threat of a disastrous government shutdown in the midst of a pandemic with the deadline to pass a budget resolution to avert that disaster just four days out. and now, in the hands of the senate where no help can be expected from republicans. but that is a foregone conclusion, of course. in this case, it is the party in power that must unite to fulfill the promises it made to the voters that put it there. and that's where we start tonight. joining me now, congresswoman joyce beatty, democrat of ohio and chair of the congressional black caucus. congresswoman, let me start with this. you have got a busy week. thanks for joining us ahead tonight -- ahead of this busy week tonight. because it looks like this may be the most crucial test of how viable the biden agenda is for democrats. you have the $1.5 trillion physical infrastructure bill due for a vote tomorrow. the $3.5 trillion social spending bill which has complicated prospects for the physical bill. both, progressive and moderate democrats with their respective concerns about the legislation is -- is really at -- at -- in the balance here. then, of course, you have this deadline this week to pass a budget resolution that would fund our government into december or risk a shutdown during a pandemic that has harmed us, first and foremost. do you expect democrats to put it all through this week, congresswoman? >> absolutely. first of all, let me say thank you, reverend al, for having me on this show and all that you do. i'm very comfortable that we will come together as you know there's been a lot of meetings. a lot of negotiating. speaker pelosi has been very clear. the congressional black caucus has been very clear about our initiatives that's in the build back better plan because it meets our core values. so we're standing strong on supporting that. and here's the thing. it's not on either/or. it's we need both of these. we need to make sure that we have a strong bill for our infrastructure. but we, also, have to make sure that we support the biden agenda. the biden-harris agenda speaks to our values. the things that we need when we think of our families and our children and our small businesses and housing. so i am very comfortable that we are going to be onboard. i'm not going to say it's easy but the bill is up to be on the floor tomorrow. i'm excited about being in washington and casting my vote to support the build back better agenda. >> now, another issue that's very near and dear to you and i, both, is police reform and the police reform negotiations in congress were announced as dead last week. and with that, what would appear to be the best political chance that i have seen to meaningful police reform. where does your caucus go from here? we are meeting in the civil rights community but where does the cbc go when even this generational moment was not enough with all of the movements, all of the marches, all the protests, some of which you engaged in. this is the moment. what do we do now that the senate conversations/negotiations have seemed to have broken down? >> i think we have to look at what we spent the -- the last nine, ten months as -- as progress. unfortunately, we didn't move the needle all the way. i think with the congressional black caucus, we are very clear in how we have prioritized and we've worked with you and the civil rights movement. so we may have to look at getting each step of the way offering something. there is a lot of options that we're exploring but we're just not going to give up. we know there are some things that they were in agreement on. we're going to hold my republican colleagues to what senator tim scott had said to our negotiating team. congresswoman karen bass and senator cory booker worked very hard and they did make progress. we were at the table. and then, it's the republicans on the other side that decided we didn't -- couldn't get the no choke hold, we couldn't get the no knock warrant, we couldn't get the list of removing bad police officers. so i think that's where we start. we start putting everything on the table but we have a different plan this time. we may have to vote on it with 51 votes to get us there. but speaker pelosi is very clear that the congressional black caucus has this at the top of the list, as well as the john r. lewis voting rights act. so once we get through this week with the build back better plan that we can take care of our communities and our families. based on all of our values -- see, it is not the price tag. people have been too fixed on the $3.5 trillion and not enough on the actual needs for what we need. and the same way with the infrastructure. we have too many people who want to vote on the bipartisan infrastructure bill. and so, it's not an either/or. it's both. and i am very comfortable that if it comes to the floor, it's gonna be voted out. >> well, the one thing we are going to make sure of is that this is not over. we're going to get police reform. >> absolutely. >> and we're going to deal with the voting rights bill. let me bring this up. the congressional black caucus has vigorously responded to the haitian refugee crisis and you led the cbc delegation that met with cedric richmond and other senior-white house leaders last week over the border patrol's treatment of haitian refugees at the del rio texas encampment where i visited last week with my national action network delegation. the biden administration said we'll continue the trump administration policy that mandates the removal of these people due to the threat of covid. two of your caucus members, congressman al greene and bennie thompson, wrote a letter to the administration demanding that these deportations stop. something that we called for as well. citing the extremist ability in haiti was the reason that we raised this. what other actions does the cbc intend to take on this particular issue? >> well, in addition to meeting to -- with the senior staff of the biden-harris administration, we also had a long conversation and i met with, as you did, the u.s. secretary of homeland security. and it was the congressional black caucus that insisted that he go to the border. also, when we witnessed those horrific photos and videos of cowboy-like border patrol using their reigns to chase down people. it reminded me of the slavery and harriet tubman and others. so i was incensed and had a one-hour conversation with the secretary. a few days later, they did halt that process. so we are claiming that along with you and others who were insistent. the report. we cannot wait for a study to take beyond this week when i return to washington. i've asked for the study this week. we also need to take a look at the numbers for those who requested asylum because we know you cannot send people who have not been there for more than a decade. that's not home for them. many of them were children when they left. and we know what's happened with the earthquake, the devastation of the president being assassinated, and all of the unrest there. so we're looking at the numbers. we've asked for a full report. we've asked for the facts. we've also asked to make sure what are the dollars that's being sent to haiti to take care of those individuals? and like you, being there with the families and the children, it's my understanding now that all of those individuals are no longer under the -- that they've stopped that and now they are transitioning people and many of them are going with sponsors. one of the things that we're asking for and congresswoman yvette clark has been very active with our executive board, a member of the cbc, that we're working with groups like yours and with our religious groups. many of these churches and individuals will sponsor and take many of those who have filed for asylum. >> that's right. >> because they are going through our correct process. i want to make that clear. so many of them processed it and we have a process as congressman bennie thompson advised me. he and congressman greg meech shared their letter with me. >> we had congresswoman clark on last night. i am out of time but we are definitely committed to continue to work. we cannot let this atrocity go. thank you for being with us, madam chairman congresswoman joyce beatty. thank you. joining me now is member of the house homeland committee and representative of the district we just spoke about, congressman al green. congressman, your state of texas has been on everyone's mind recently from the fight for abortion rights, voting rights, and now the haitian immigration crisis. so, what do your fellow democrats need to do right now to help fight all of these battles at once? >> excellent question, reverend, thank you for having me on. and um, i'm wearing my mask because of an office policy that we have. excellent question. i think, reverend, that first we have to realize that failure is not an option. failure would create a circumstance that would cause us to forever regret not having taken appropriate action. we are at a seminal moment in time. we have the opportunity to do things now that will impact the rest of time. so here's what i think is most important. we should listen to mr. mcconnell. he gave some sage advice, recently. when he was asked to help us with the debt ceiling, help us with the cr, the continuing resolution. he had, listen, you have the house. you have the senate. you have the presidency. go ahead and take care of your own business if you would, please. but what he was really saying is this, reverend. if we had the house, meaning the republicans, the senate and the presidency, we wouldn't be pleading with you to help us. he was saying we would take care of business. he -- he keeps his people in line. reverend, the filibuster has to go. it -- it's just that simple. all of these issues that you've just outlined in a very, very succinct fashion and i might say very well done, all of them can be dealt with if we eliminate the filibuster. it is for us to do. nobody's going to do it for us. we've got to eliminate the filibuster which really means we have two people that we have to cause to understand the moment in time that we have. >> now, a federal judge set october 1st as the date to hear the bid from the white house to try to block texas draconian anti-abortion law. this, after the house passed legislation on friday that would expand abortion rights with not one republican voting for it. the justice department asked the court to allow an emergency order to pause the ban, and the judge gave texas officials until this-upcoming wednesday to respond. what do you see happening with this? >> well, i think that the -- this onerous, invidous, insidious voting rights law -- excuse me, abortion rights law -- is something i believe even this court is going to have a difficult time upholding because of the far-reaching implications of it. it puts a lot of things at risk if you can now determine that you can have citizens to act as vigilantes and put a bounty on persons who are doing things that, quite frankly, are lawful in 49 states but are unlawful in texas right now. i think that the courts are going to have a difficult time upholding it. i want to believe that the courts are going to find a way to say let's take another look at this and let's see what we can do to look at a different law. i think they're going to go over to mississippi, and i think that's the case that we really have to concern ourselves with. >> now, in schools across texas, white-dominated school boards in state gop politicians have been trying to change how young texans learn about the history of our country, and struggles that previous generations and black and brown americans faced. things like watering down the pains of slavery to omitting the civil rights movement from history lessons. this whitewashing of history and how it is taught is not only damaging but extremely racist. how do we stop it? how do we help to stop it? >> well, you're right about the damage that it can do because under this law, we literally could not teach the history of slavery. we couldn't teach the history of -- of black people in this country as it really occurred. and the way we stop it, reverend, is with litigation. there are litigation pending persons who are filing lawsuits. we can also try to negotiate. negotiation is always helpful. but, reverend, at some point, we do have to realize that people taking a stand, a public stand, and doing what you have done so artfully and, that is, protest. you might recall that dr. king and many others -- i think you were part of it -- gave president johnson the authority that he needed because when the protest movement succeeded, he then was able to succeed with passes of civil rights legislation. so i don't see how we avoid that. i know that it's not the thing that we had looked forward to but as congresswoman maxine waters said, sometimes you have to have a little street heat. >> absolutely. and whether we look forward to it or not, it beats the alternative and that is letting them turn back the clock. stories. richard. rev, good to see you. some of the stories that we are following for you this hour. u.s. covid cases now surpassed when you look at the numbers, 42 million. some states are still seeing here double-digit case growth, like alaska and wyoming. idaho funeral homes are running out of space, as well. the cdc says that it has one of the lowest full vaccination rates at only 41% of adults. saturday's amtrak crash in montana killed at least three and injured 50. a train was on its way to washington state from illinois when it slid off the tracks. first responders rescued people trapped inside. over 140 passengers were onboard. the national transportation safety board is investigating. and germany will, soon, have a new chancellor after 16 years of angela merkel's leadership both domestically and abroad. parliamentary elections were held today. early results, too close to call right now but even after the tally could take several weeks for party to negotiate a coalition rise up, i want to talk about immigration. by now, most people have seen the horrific images of border patrol agents terrorizing haitian asylum seekers from horseback. and while the agency has suspended the horse patrols, this incident is just one example of an immigration system in crisis. but how did we get here? with the notable exception of native americans and those of us whose ancestors were brought here in chains, every single american family has an immigration story. and yet, many of those people would slam the door that their own forefathers used in the face of immigrants and asylum seekers today. a common claim is that their ancestors, quote, followed the rules. but the truth is very few rules existed for european immigrants in the early-20th century. there were no passports, no visas, no requirement of credible asylum claim. millions of european immigrants came through ellis island and fewer than 2% of them were turned away. meanwhile, on the west coast, the angel island immigration center that progressed mostly chinese immigrants detained 60% of those who arrived because the american immigration system has, for most of our history, been based on the values of white supremacy. during the great depression, the united states forcibly deported a million of its own citizens to texas. rounding up people of mexican descent without regard for their citizenship status, and expelling them from the country. the callousness of this systemic racism extended to world war ii when japanese-american citizens were interned in camps and the american government turned away european-jewish refugees fleeing the nazis following the end of the war. immigration restrictions were tightened even further. building to the system we have today. former-president donald trump said the quiet part out loud about our modern-immigration system when he whined about immigrants from african countries, central america, and haiti. calling them, quote, s-hole countries and wondering why more people didn't immigrate from majority-white nations like norway. the answer's obvious. people are fleeing haiti and central america, in part, due to conditions caused by botched american foreign policy over the last century. that's why i went down to del rio, texas, this week to meet and pray with these asylum seekers. some of whom are being forcibly returned to a country that has suffered from centuries of imperialism and just in the last year, has seen the assassination of its leader, multiple natural disasters. people often say that the american immigration system is broken. but it seems to me that it's functioning this way by design. it is long past time for comprehensive immigration reform, and that's a goal we can only achieve if we rise up, together. we have to demand that president joe biden do better than his predecessors on this issue. and hold him accountable for the human rights violations occurring under his administration. the promise of this country as one with liberty and justice for all can still be fulfilled but only if we all rise up, together, and demand it. e pandec just to end up with the flu. i with such urgency, i like to turn to my friends and colleagues to help break things down. this has been one such of weeks. so, joining me now is my little sister, joy reid, host of "reidout" here on msnbc. joy, there is a lot to cover. i'd like to start with immigration, though. like so many americans, i had a visceral reaction to the images of the border patrol agents in del rio, texas, using their horses to intimidate asylum seekers. and the sight of at least one agent using his whip reins as a whip was particularly upsetting. that's why i went down to texas to meet with those immigrants -- cruelty toward immigrants became the expected norm from the previous administration. why hasn't the biden administration curtailed this attitude from enforcement agencies like the border patrol? can this kind of thing even be reformed? >> you know, rev, it's always great to be here, first of all. to be here with my big brother, reverend al sharpton. but yeah, i had the same reaction and particular play as somebody whose parents were both immigrants, who both came from what donald trump used to call s-hole countries and who went through the immigration system. my mother did for herself and her family. um i think for any human being, those images had to be jarring. what's also interesting was for people on the right, what they objected to was not what they saw happen but that people talked about the whip being used. about those reins being used as a whip. they didn't like that jargon. they didn't like that being referred to. they didn't mind what they saw. so that was very interesting. imi had the opportunity to speak with department of homeland security mayorkas. he also did a bunch of other interviews as you know and i have to be honest, i wasn't satisfied with his answers because what he was saying was that the images were disturbing. okay. we know that. but he stood by the policy which is to mass return people to haiti which as you know, rev, is a country that is full of instability. where the president was assassinated. where natural disasters have made an already-bad situation for people who are making something, like, $2 a day on average, 60% of people in haiti. returning people there en masse, some of whom haven't been there in a decade because they fled a previous natural disaster and have been in central america. i believe is unconscionable. so, no, it can't be reformed. >> i -- i totally agree, which is why i went down there and i talked to secretary mayorkas as -- mayorkas as well. and said that. i mean, they have got to stop this. this is not about splitting hairs. this is about totally wrong. and, you know, texas seems to have put itself squarely in the middle of national controversies. its recent abortion ban deputizes private citizens as vigilantes. and the supreme court refused to block it. some legal experts are taking that shadow docket ruling as a preview of the court's likely decision in the upcoming mississippi abortion case. slated for december. if the supreme court does overturn roe versus wade, 11 states have law on the book that would immediately ban abortion. so like so many injustices, this would hit black and brown folks, poor folks, and lgbtq folks the hardest. would you say simply that the texas abortion law is a human rights crisis, joy? >> it absolutely is a human rights crisis. and texas has become sort of a lab experiment for every kind of bad governance. you and i were in south africa a couple of years ago and they are going for extreme minority rule that is reminiscent in some ways of that old government. they are trying to make it harder for black and brown texans to vote. um, you know, while unleashing more -- um -- people to have guns without even having to have training or any sort of licensure. they are just sort of a free for all in terms of firearms. while at the same time, putting a bounty on pregnant women and allowing anyone to sue anyone involved in them seeking healthcare. it's frightening because this isn't going to be a one off. this is going to be copied by states like florida and other southern states because these southern governors are all in a footrace to be the most like donald trump. and to be the most outrageously far-right wing. so, it is frightening and it is an absolute human rights violation. what we are seeing happen to women in texas right now is that they are being essentially reduced to second-class status. really, third-class status. first-class status would be white christian men who are free to vote at will, don't have any restrictions on them whatsoever. second-class status in their mind would be -- um -- fetuses. people who don't yet exist. people who are not yet alive and women would be reduced to third-class status. they simply can only exist essentially at the whim of the state. that is not first-class citizenship. that is absolutely a human rights violation. >> now, finally, to the pandemic. one of my favorite things about your show is that you don't shy away from calling out the worst perpetrators of covid disinformation. nearly three-quarters of eligible americans have gotten at least one shot. but those who aren't yet vaccinated seem to be getting more entrenched in conspiracy theories and anti-vax rhetoric. do you think the time for persuasion is over? are mandates the only way out of this, joy? >> i do believe so. i just was telling my husband that i spoke with my husband -- i just spoke with -- sorry with my god mother who is in jamaica right now and dealing with two people she knew very well, both of whom died. a young man lost his mom. also, lost his brother-in-law and still refuses to get vaccinated. all of them, unvaccinated. at this point, these are illnesses by choice and if it was just the choice of people to remain unvaccinated and get sick and that didn't have any further impact, it would be tragic. but it wouldn't be a systemic, you know, larger problem for the country. but what's happening is the unvaccinated are not only choosing to open themselves up to getting covid. they are also shutting down our icus. they are making it harder for people who have other illnesses. if you have a stroke or a heart attack, you're now going to have to compete for access to the emergency room and to icus with the unvaccinated who are crowding into our emergency rooms. and we are also seeing a situation where the treatments for covid. you wind up -- doctors wind up giving them more to the unvaccinated because they come in sicker than the vaccinated. so if you did all the right things, did everything you could, masked up, and got vaccinated, you are actually in a worse position if you inside up in the hospital because you are not going to be necessarily as sick. and so, the unvaccinated are pushing to the front of the line and they are taking up more healthcare resources than their numbers would necessarily indicate. so at this point, we risk collapsing the healthcare systems in several red states. that's a larger systemic problem and at this point persuasion time is done. i think the president made the right call in saying we're not going to be doing any more begging. we are not going to give y'all $1 million lotteries. at this point, get vaccinated or don't get on this plane and maybe don't have this job. >> thank you, always great to have originating from the home of kenneth chamberlain senior. a 68-year-old black man with a chronic heart condition, whose medical alert necklace was triggered accidentally. when chamberlain explained that he did not need assistance and refused to admit to officers, they demand that he open his door and proceeded to break it down which was when according to police reports, chamberlain, a former marine and corrections officer, were allegedly charged at officers with a knife requiring them to ultimately use lethal force. that, of course, the story from the white plains police department. but a 2019 film now in theaters and featured on netflix is dramatically retelling the killing of kenneth chamberlain from the chamberlain family perspective from an assist from one of our most recognizable voices. joining me now, actor and filmmaker, morgan freeman. in this case, executive producer of this film and kenneth chamberlain's son, kenneth chamberlain, jr. gentlemen, first of all, we're glad to have you. we're honored to have you with us. the film is profound in many ways. and -- and, morgan, i want to go to you first and -- and thank you for coming on. you have been on the show before. but i want to go to you simply because we've seen so few of these kinds of tragedies dramatized with the victims and their families, not just in mind but in the air of filmmakers. and in your case, you have a black filmmaker with real a-list reach which enables you to go and get phenomenal actors and sensitive directors. what brought you to this story and kept you here? and -- and tell those who did not see the movie about how racist front and center, the n word was used here throughout but certainly at its ending, it has an n word from one of the officers. >> thank you for having me on this show, al. i'm not part of the making of this film. i don't have any part of that. i didn't even see it until about a year and a half ago. but seeing it and realizing that it had no distribution whatsoever, my partner and i, we decided we just had to come onboard and see if we couldn't get this movie distributed, get it out there. get it seen because one of the most important parts of this entire situation is -- just got talking about it with joy reid -- it's the systemic racism, especially evident in our police departments. this movie demonstrates a situation that got out of hand to no fault of anybody's but the police. just -- it did not have to happen. um, the way the movie came about, kenneth himself can explain to you. we just came onboard after we saw it. >> i think, again, as i said, having you on as an a-lister and you seeing the systemic racism here as we have seen in other cases, i think that it is important people use their platforms to deal with issues that sometimes are uncomfortable to some but imagine the discomfort of the victims. which brings me to you, kenneth. i want to extend condolences to you and your family for your loss. we talked years ago, i believe, on my radio show. and in terms legal proceedings, we know that in june, the district attorney of west chester county announced that your father's case would be reviewed after a federal jury in 2016 declined charges against white plains and the other -- and the officer that fired the fatal shot that killed your father. your -- your family has since appealed and from that, some charges have emerged. that lawsuit pending. do i have that right? >> yes. um, but there are two different situations there. the westchester county district attorney is taking a second look at it on a local level. um, and it's my belief -- i just want to see what the grand jury findings were, originally. what did, at that time, janet, what charges did she put on the table for the grand jury to even consider? but in june of 2020, we won the appeal with the second circuit court of appeals and one of the most powerful pieces in that decision, the judges said that instead of treating mr. chamberlain like a critically ill patient, you treated him like a criminal suspect. >> morgan, i want to play a clip from the film. get some context on what we were seeing when we come back. roll the clip. >> mr. chamberlain, are you there? hi, sir, can you hear me? hello? >> the police are still outside my door. they got my i.d. now. >> mr. chamberlain, do you want me to call and cancel the dispatch? >> yes. >> now, morgan, apart from when you saw what happened in police reform last week, what are your feelings that when you see this acting that -- that captured you and your partner? >> same thing as you see any time you watch situations like this. we -- we've seen them on television. too many people have cameras now and they can document stuff and the police themselves. it seems to me like we somehow become complacent. and point now is that we got to be un-complacent. can't just let things like this happen and say, well, that's the way it is. we have to do something. we have to change our entire thinking about our police. and policing. >> before i let you go, i want to hear your opinion on a broader issue. the movie reflects the need for an alternative to police responding to mental-health crisis calls. that alternative is emerging in places like eugene, oregon, and denver, colorado. it will, hopefully, happen soon in westchester county, new york, where this tragic event took place. so, this is a win-win component of police reform. police can focus their resources on policing, while folks in crisis are better served. what -- what are your thoughts about that? >> well, i definitely agree with that. crisis intervention teams are very important. i mean, you have to build mental-health services into emergency responses. why? because police officers are not mental-health professionals. so when you have a person that's in crisis, you would rather see a clinician or a social worker coming to deal with their situation, rather than the person that's having the crisis, the first person they see is a badge, someone with a badge and a gun. um, police officers have to understand, again, your job is to diffuse the situation, not create one. so having crisis intervention teams are great. but at the end of the day, and you know it, reverend al, like i do, the bottom line is accountability. we have to have prosecutors in place who are not afraid to prosecute police officers when they commit these types of acts. >> morgan, as i let you go, would you like to see more movies like this and more people step forward like you have so we can have that conversation and lead toward change in this country? >> on the one hand, al, yes. on the other hand, no because it means it's still going on. if we continue to be able to make movies about this type of situation, that means to me that we're continuing to have this type of situation. however, if we do, then we must air it. >> we must out it if if we do. hopefully, we will see new situations. maybe we can learn from the situations of the past and dramatize them if people like you put their platform and their stature on the line. and people should watch this film. morgan freeman and kenneth chamberlain, jr., thank
