Dealing with right now. Weve got multiple Critical Issues here that hang in the balance, infrastructure, weve got budget reconciliation. We, of course, have the Migration Crisis right now at the texasmexico border. But former President Trump is occupied with the past and some State Politicians are placating him. Hes pushing his big lie and partisan reviews of the election and it is now extended to a state he won. Yeah, this time in texas, where Governor Greg Abbott ordered a so called audit of the results in the states four biggest counties. The congress now wants to talk to the ceo Of Cyberninjas, the group that just released its findings in the arizona audit. And that group, by the way, had no experience in election audits prior to this. The entire process has really been defined by partisanship and secrecy. Meanwhile, four of trumps former advisers are now facing subpoenas from the Committee Investigating the january 6th insurrection. And tonight trump takes the stage for another rally and well surely have plenty to say about all of this. Capitol hill is going to be busy, very busy over the next week or so. Nbc News Reporter Julie Tsirkin is there for us. What do we know about how these subpoenas are going to work out and what might be the next move for the committee . Reporter good morning, guys, the house elect Committee Investigating january 6th, taking its first major step by issuing these four subpoenas to former President Trumps inner circle and this really defines the scope of their investigation, focusing in on what the former president knew and when. Theyve issued these subpoenas to four individuals, you see them on your screen now. Former Chief Of Staff mark meadows, a Communications Aid for the president , dan scadino, kash patel, and steve bannon who only spent a few months at the white house but helped organize the stop the steal rally. I want to hear from Benny Thompson, he said when he announced the subpoenas the select committee is investigating the facts in order to identify and evaluate Lessons Learned and to recommend to the house and its relevant committees corrective laws, policies, procedures, rules or regulations. Thats chairman Benny Thompson of the january 6th select committee. Those guys you saw on the beginning of your screen there theyre subpoenaed to appear before the committee in october but the 7th Of October is the date for them to turn over all of the documents they have. Now, remember, this is a two pronged approach the committee is taking. Theyve sent a request, normal request for documents to others that they said are likely to comply but the subpoenas are just the beginning. Were told by a source familiar to the committees plans, this is just the beginning. Theyre planning to subpoena many more individuals in the coming days so well see if those four show up to testify and if they wont those on the panel will consider holding them in criminal contempt, which will surely drag out the investigation. Julie, we know the House Oversight committee wants to talk to the ceo of the cyberninjas, the Arizona Group that ran the audit. What role might Congress Take in essentially reviewing the reviews, or maybe how these play out in the future . Reporter yeah, the House Oversight committee for months now has been asking the ceo Of Cyberninjas to turn over documents to comply with their request because its a privately funded audit. Now, the Arizona Senate republicans hired this group as you mentioned at the top theyve had no previous experience in conducting these audits. The audit was done of Maricopa County specifically in arizona. The results yesterday showed what we all knew, that joe biden won the election in arizona, but what the House Oversight Committee Led by democrat Carolyn Maloney of new york and jamie raskin of maryland, theyre saying they want to know why the privately funded group was involved, what kind of process they used to conduct this audit and because they didnt comply with the prior letters and requests, they now want to hear from the ceo in a hearing on october 7th. Guys . All right, Julie Tsirkin joining us from capitol hill where it will be busy the next week. You le, thank you. Plenty of other questions still to be answered with all of this. Lets bring in our panel right now. Joined by msnbc legal analyst Danny Zavalas and emily tish. What sort of legal battle are we looking at here. We know these four trump aides who got subpoenaed. They dont want to cooperate. We know that the select committee came out with the strongest that they could, instead of asking them or encouraging them, theyre compelling them with these subpoenas. These subpoenas ask for documents, they ask for testimony. And in the normal world you think well, a subpoena isnt optional, you have to comply. But in these political contexts theyre a little more optional than you may think because its all about what are you going to do, congress, to get us to actually show up . What if we say no . And the answer is, congress has a couple options. They can file a civil suit. They can ask the doj to enforce the subpoenas or they can even get this mythical sergeant of arms to go out and theoretically run around, grab people, hold them in a cell and bring them to congress. And the reality is, congress doesnt want to do that. So in this case it should come down to negotiations but there have been indications so far that congress is not interested in negotiating. They want everything theyve asked for. But on the other hand the republicans would probably welcome a court battle. It would mean delay and it would mean an opportunity to put on a show in court. Lets talk about the Executive Privilege Aspect of all of this. Is it even possible for trump to claim Executive Privilege . Executive privilege is not a blanket thing. We learned that just last year, i believe, in the Supreme Court case involving trump and maizers, simply because something is in the orbit of the president doesnt mean its covered by Executive Privilege. Executive privilege the former president . Even more so a former president. But if it was something theoretically that dealt with during the persons time as president , a president ial communication, Something Like that. It might wall within the am bit of Executive Privilege. Once hes left office, it diminishes. The reality is, with Executive Privilege we dont fully know the contours of it but with each case that deals with it we get a little more clarity. We dont know exactly how far Executive Privilege goes. But it probably doesnt go this far. Emily, lets talk about these right wing vote recounts. Now going into a state that trump won four specific counties in texas, he won one of those counties, whats the end game here . And do you think that yes, the fear and the concern is that this is Sowing Discord and sowing doubt of Election Integrity. Could it backfire . Is it only sowing doubt about Election Integrity among republicans . I love that you presume that trump has an end game here, which im not sure weve seen his track record. I think its a lot of fly by the seat of his pants, great, great rally lines, things he can go out to his email list with, even yesterday, when the independent audit, as you point out, should have Great Questions about his integrity to begin with in arizona, even they, the republican funded, all his supporters, a firm hand picked, having never worked in elections before, but was picked because the ceo said he had doubts in the results of the president ial election, even they came back saying that biden won by even more votes. It didnt matter. Trump still went out with his own statement and to his own email list saying, oh, they found all these instances of fraud and the place that he does go to is the exactly to the point that you made, it is sowing doubt in the fact that there could be doubt in Election Results that our process is not good and so, therefore, it gives a backing for these republicanled legislatures to go out with even further restrictions. Weve been seeing this trend for more than ten years, when the legislature flips the republican, we saw that after the 2010 election. They tend to bring up a lot of voter restricting laws, like laws that make it harder for voters to vote and in democratic led states they tend to open up the Voting Process and were seeing that on hyperspeed right now with the 2020 election because theres a new basis, a theoretical basis that trump won the election and they believe that he actually won and that someone is going to come and appoint him. The basis thats not rooted in fact. Exactly. But its given them a new basis to come out with even more restrictive voter laws. Quick here, youre a democratic strategist, what should the democrat stat apology be . To fight every one of these voting laws, to not accept the basis, and to not start to move the line. Look, trump comes in with a big heavy hand, but actually the way he makes progress is incrementally through voting laws, incrementally through challenging republicans who voted for the impeachment, who wont stand by him 100 . But i think erring on the side of caution is always a good thing. So a false positive in this case occasionally happens. But thats exactly what you do, you back it up with the more detailed and more accurate test and move forward from there. Gotcha. Well, doctor, i want to ask you about kids too. Because they are very concerned that even if theyre able to somehow get agreement between the moderates and the progressives in the house, that over in the senate, joe manchin and some of the other democrats there might not be on board with whatever number they come up with. And that is raising some real questions because according to Chuck Schumer the Senate Majority leader theres not even a procedural tactic available to them to be able to hold a vote on that, as early as monday. Now, President Joe Biden has been working feverishly over the past few days to get meeting separately at the white house with progressives and moderates and speaking yesterday afternoon with the two democratic leaders, nancy pelosi in the house and Chuck Schumer in the senate trying to find where theres agreement between the two sides on their Top Priorities as well as finding ways to pay for it that could potentially offset some of the concerns that moderates have about the high spending levels in this measure, particularly as were facing, once again, that Debt Limit Increase that needs to happen one way or another with republicans saying they dont want any part of that. The president expected over this weekend, while hes at camp david, to continue speaking by phone with leaders in the house and senate as they try to find some way forward. But in the meantime you really just have nancy pelosi saying dont fret, weve got a plan, were feeling good about it. Without a lot of detail at this point about how exactly thats going to play out in a way thats successful for them and at stake here, not only pretty much all of President Joe Bidens domestic agenda, but also political stakes for democrats as they head into the midterms next year, wanting to show theyve been able to accomplish something on behalf of the American People, kendis. And that plan includes both the bipartisan Infrastructure Bill and the build back better plan that is going to deliver so much for the American People. I have every confidence today, this very day on saturday, were going to have the Budget Committee have a markup. Im sitting right here in my dining room and were going to have a markup thats going to go on most of the day to make sure that we do our part. If this is moving ahead quickly, and, you know, this kind of extreme concern about getting it done, i really dont have that because i think we are going to get both things done. But let me say one thing, yesterday was a historic day and it would be a mistake if we pass over the fact that we passed the Womens Health protection act, the first bill ever passed in the United States congress and the House Of Representatives that would give abortion rights, the choice, the decision for women to make that passed in a law, or at least, you know, at least in the house yesterday, that never happened before. This is a huge victory for women across the country who want to make the decision on their own. But it will go nowhere in the senate. Pardon me . It will go nowhere in the senate. You know what, this shows the momentum, though, that we have. This is a sea change in the american electorate and in the American People that this is something that we want. Passing this for the first time in history is a landmark. It represents a sea change of opinion among the people and especially among women. Okay. So this in and of itself, this is a huge victory. So lets talk about because you guys were out there on the Capitol Steps celebrating that victory. And then there was a little bit of a dustup that took place with your colleague Marjorie Taylor greene, heres a look. And also congresswoman Debbie Dingells reaction to it this morning. This is a 25,000 acre wildlife refuge, and it is located just about 13 miles from the laundrie family home. The terrain here is very challenging, its mostly marsh land, swampland, multiple agencies have been out here, taking part in this search all week long. Theyve been battling heat, humidity, bringing in drones, helicopters, Swamp Buggies and other equipment trying to locate Brian Laundrie. Now, Law Enforcement officials have zeroed in on this location because this is where the laundrie family says that Brian Laundrie came On September 14th to go for a hike. He has not been seen since. His ford mustang was here in the parking lot, that was retrieved and then taken by Law Enforcement.
