Over a key piece of the president s domestic agenda. And plus what a member of the January 6 committee is saying about the s word, subpoenas. Why lawmakers might skip asking people to testify and instead try to require them. And just who might be on that list. We have a lot to get to with you. Good to be with you. Im Hallie Jackson in washington and were joined by our newly minted Nbc News senior congressional correspondent garrett haake, Tony Sporting a new title, congressional economic Policy Reporter for the Washington Post. He is also an msnbc cribber. And Shannon Pettypiece is at the White House. So here is the deal. You have the house possibly as soon as tonight ready to pass a bill that would avoid a shutdown by keeping the government open and running through early december. Suspend the Debt Limit through The End of next year. Which means the u. S. Wouldnt default on its debts, money that has already been spent, not new spending. And it would provide about 35 Billion in Emergency Money for Afghan Refugees and disaster recovery. But republicans are basically united against this and that sets up really a standoff that could be a huge problem for the countrys economy. And by the way, this is on top of Democrats Self imposed deadline six days from now to pass an Infrastructure Bill which could end up decoupled from that huge 3. 5 trillion spending plan. I hope that is critical clear to you. Problem is, garrett, it is really not all that crystal clear to even members of congress. Fair to say it is a bit of a mess. How does it get sorted out, what happens from here . How much time do we have . Look, there is the Must Dos and the want to dos. Funding the government may have the clearest path here because everybody wants to keep the government open at least until december, finish a longer term Funding Bill. The house is going to vote on something that twins that with the Debt Ceiling as you laid out, that will pass the house but it will run into problems in the senate. Senate republicans are super dug in on the Debt Ceiling question. With mostly what is frankly a bad Faith Argument about who racked up the debt, when, and whose responsibility it needs to be to clear it. That being said, democrats will have to find some way around it because without at least some republican votes to lift the Debt Ceiling, it becomes politically perilous. That is the most complicated. Well set that aside for now. The self imposed deadlines are also tricky. They are almost absolutely house focused. In this case you will see that Infrastructure Vote come on monday. Senior democratic leaders have all said today it is happening. And we expect a meeting at some point this afternoon between Nancy Pelosi and head of the House Progressive Caucus about whether or not that will be acceptable to progressives who say they are not voting for that until the bigger Budget Bill is done. And that being looks almost impossible from where i stand right now that that could be finished and voted on by monday. There just isnt enough time in this version of the physical universe for that to happen. So all of this will come to a head on monday with the Infrastructure Bill and we could be having some very late nights the next several weeks to figure out the Debt Ceiling thing because nobody has really laid out what the democratic Plan B is if republicans dont blink. In the physical universe in which we exist at this moment, i know weve heard i think from Senator Schumer and senator mel mcconnell. Anything new from them or at this point are the positions the positions and that is where we are . Largely the latter. Senator schumer is furious here. He thinks that mcconnell has dug in being political here, he thinks that we in the press are asking the wrong questions about who is going to blink. And he is placing blame for a potential default at the foot of republicans who wont do what has been done time and time again to raise the Debt Ceiling on a bipartisan basis. But we are stuck in this position at least for now while lawmakers try to get a little more creative to find ways that satisfies everyone politically and does the thing that No One disagrees needs to be done. Which is find a way to overt that default whenever we run out of Spending Cash sometime in mid to late october. And to be clear the stakes on that are super high. Were talking about a major market moving event if that were to happen. Tony, let me go to you. I think that youve been on 17 bylines for the Washington Post this afternoon alone and i know that you are reporting on some of the more centrist democrats. All of this is woven together, pull back the curtain, tell us what is happening behind the scenes. Half of the fight here has to do with President Bidens economic agenda. The loss of that by the way would be a huge political hit for democrats, but it wouldnt shut down the country as garrett was saying. Here we have pretty much two signature issues. The first is how big should some of these packages be particularly around reconciliation where we have a 3. 5 trillion Price Tag right now that moderates want to whittle down and second what should be the order of operations in which we move those packages particularly given the September 27th deadline In The House over infrastructure and the reality that there is just simply no way that they can wrap up work on the Reconciliation Package before that. And so what were hearing is exactly what we have been hearing for weeks now, which is that progressives are not going to vote for an Infrastructure Package if they dont get a Reconciliation Bill first. And that puts democrats in a very difficult bind because remember Nancy Pelosi can only afford to lose three votes and were talking about dozens of democrats who will not go along with the isnt 27th Infrastructure Vote. And so it is kind of a game of chicken. And it may even depend on republicans perhaps for this Infrastructure Bill to pass on the Time Line that some of these moderates have sketched out. Tony, i know that you have to do your actual day job. Ill release you from your duties reporting for us here on the show. Thank you. Garrett, stand by for a second. Shannon, i want to bring you into the conversation. The crux of all of this is the biden agenda. This is so critically important to the White House. What are they doing right now, what is happening behind the scenes on their end or are they taking a hey, this is Congress Thing now and well just see how it unfolds . Reporter i think that it is really important that you put that into this bigger context of what is going on at this White House. Obviously this Infrastructure Package is hugely important to them. This was one of the president s key campaign promises, this is the one thing that they really want to get done this year. And then of course certainly you have a pandemic going on. You have issues overseas. The president was talking to the u. N. Today meeting with world leaders. There is new tension among the allies, among the french. So many things going on. But of course underlying this is the potential for this enormous shattering event that if the u. S. Were to default, it will potentially make those look like rather small problems when you think about the practical implications here. So the White House has started to ratchet up the pressure on congress. Last week they had Janet Yellen Call senator mcconnell, talk to him about what the consequences could be and what yellen has said is that the fed has been taking extraordinary measures in the treasury to keep the funds flowing. That can only go until october. So mid october, they are going to run out of tools and levers that they can pull. Press Secretary Jen Psaki said they support the bill In The House. A reporter asked there is an issue about israeli funding in that house package. Psaki said she couldnt comment on that but the spending portion, the Debt Limit portion of this house vote, that is what the White House is supporting and they will put out a statement after that. And the Talking Point that they are putting out there is that this should be a bipartisan issue. Senator mcconnell has voted in the past to raise the Debt Ceiling. Other republicans have. It should not be a partisan issue this time around. And they are urging republicans to step up and come on board because of the serious consequences of this. But of course that has had no effect yet as garrett can certainly explain to you, they are not seeing it budge. So the president coming back from new York Today and i get the sense that this will be really where his attention shifts over the next few days. It will have to be. Garrett, quickly to you, is there anything that President Biden could or should do right now that would help unlock this puzzle . Boy, that is a great question. You could convince some of those senate moderates to start supporting the Infrastructure Bill, that could move the progressives and move the agenda items. On Government Funding and the Debt Ceiling, that is a bit more complicated. I dont see how he or anyone else has the tools to budge mcconnell on this if he wants do what he does so well which is sit there and let everyone in politics criticize him and not change his position. Garrett, shannon, thanks to you both for breaking that down for us. I want to bring in now somebody who knows a bit about the maneuvering behind the scene, congresswoman jackie speier, members of armed services committee. Congresswoman, thank you for being back on the show. How are you. I would ask you that question. How does this play out, what is going to happen the lets say six hours and then week and a half . Well, high drama is the only way we operate here. And unfortunately, we have a recalcitrant republican leadership in michigan they will who by the way has three times in the Trump Administration lifted the Debt Limit, has said that it would be a disaster if we defaulted. And now all of a sudden he is using this as a political football. Well, tell that to the Social Security Recipients who arent going to get their checks. Tell that to all the banks and everyone who has got money in accounts when the Interest Rate goes up, when we create a financial disaster across the world. This is reckless, this is beyond reckless. And i think weve got to call out the republicans who think that this is just a fine political game to be played. You described it here on this show as reckless, congresswoman, but i dont know that that changes the facts of what is at hand in front of you here which is that there is absolutely no sign that the gop will back down. So the question to you then, what is the Plan B . Is there one . No, there cant be a Plan B. Weve already incurred these debts. In fact 27 of the debt that has been created has been created by Donald Trump during his administration. Only 3 under the biden administration. The money that we spend on the rescue plan, where we propped up businesses, we propped up people who were unemployed, that is all spent. Everyone supported it. We had 44 republicans who supported that. So on the one hand, they want to support it, but then they dont want It Pay for it . I mean it is just irresponsible and we have to call them out and make everyone aware of what this means to every single american if the republicans go through with this political game. I dont want to belabor the point here but i want to be real clear. You clearly, and your colleagues, are very clearly hoping that republicans change their mind. You are calling them out live On The Air right now, right, to say you need to change your position on this. You are hoping they do so. If that hope does not come to fruition, which again it doesnt look like it will, what do you do . Well, there is going to be blood on their hands. You will see the Stock Market plummet. You will see the increase in Interest Rates. Youre going to see Social Security Recipients not receiving their checks and well point to the republicans and say this this is the reckless behavior of republicans who are so irresponsible they wont even pay for something that they have already voted for. Let me ask you, and again, i hear what youre saying. I think our viewers hear what you are saying. I just am not sure that that changes the game on the ground here, the mechanism by which this would happen because it doesnt sound like democrats are willing to change to uncouple these things, right . No, were not going to. We need a continuing resolution. We need the Debt Limit suspended. And were going to demand that happens. Let me ask but some of the other things happening in the next week and a half or so. Do you believe the vote will happen September 27th on the Infrastructure Bill as had been planned by House Leadership . I think that there will probably be a vote. I dont know if there will be the requisite number of votes to pass it. I think we have to remember that that Infrastructure Bill as important as it is, 91 of the jobs created by that bill are going to go to men. Meanwhile weve had the greatest loss of jobs by women in the Labor Market since 1988. We have got to recognize that part of lifting these Jobs Up requires us to lift Jobs Up for women as well and that is why the second part is so important. Making sure that we have parental leave, that we have Child Care that is going to be available to everyone and no more than 7 of your income is going to be subject to being used to pay for that Child Care, that we restore the 120,000 jobs that have been lost by Child Care workers who have gone on to other jobs because they couldnt make it on 11 an hour. So its got to be a package over the long term. The plan had long been at least for a matter of months now that those two pieces of legislation that you are talking about would essentially be working on a parallel two tract process, would be coupled. Is it inevitable that those end up decoupled at this point . I cant say that it will be decoupled. I think in The End both bills have to pass. Both bills will pass. And were, you know, negotiating right now. Were deal making. And that is what our responsibility is here. President biden used his biggest moment so far to try to repair alliances and break from the Trump America first policies. The president covering a lot of territory. Reporter indeed. And it was about as traditional a speech as you will hear here at the u. N. The american president pointing out american policies and priorities around the world on all kinds of issues, emphasizing the theme of cooperation and not confrontation, truly a break from president trump. And on the issue of cooperation, he pointed out that the united states is back into the paris climate accords. He mentioned the world health organization. And he also said in terms of not being confrontational that the united states does not want to a Cold War with china. I thought one of the most interesting things he said is when he pointed out that he is the first american president to address this body in 20 years when the nation is not at war. Of course a reference to afghanistan. And the united states has now turned the page on that. And that of course was a reference to afghanistan and response to some of the criticism that hes heard from people like Boris Johnson and other European Allies about how chaotic it was, that they were left out of the loop on all of that. Covid was another big issue. The world of course wants to know what the united states, wealthiest nation in the world, is going to do to help Combat Covid around the world. The president was somewhat defensive on that issue when he pointed out how the united states has so far he said given out 160 Million doses of vaccine. Of course around the world the amount of vaccinated population is in the single digits i still believe and i think people still want to hear more from the united states. There is a Summit Tomorrow at the White House, a big gather about covid19. So the president will continue to talk about that. Interesting he spent very little time here, made his speech, had a meeting with the australian Prime Minister in New York and then went back to the White House for that meeting with Boris Johnson. Some of that because of covid, some of that because he has so much work do and wanted to get back down to business. But again a traditional Speech And Nothing like we heard from president trump. Ron allen, thank you. New reporting back in washington just in this afternoon on just how fast this January 6 Select committee is ramping up their work. Here is what Adam Schiff is telling reporters. That they could go straight to subpoenas in some cases. What does that mean . It means that they might skip those typical preliminary steps we might see when talking with witnesses and dealing with witnesses who might be less than cooperative. So when could those subpoenas come . Within a week. That means that we may see those maybe by friday, maybe by next monday. Possible targets include the people you see right now, former officials, Trump Family members, organizations, anybody yet to address the huge document and records requests that the committee has issued. And they can keeping the Witness List pretty close as they get into what they are now calling an aggressive phase of their investigation. Leigh Ann Caldwell has it covered from capitol hill. I know ive been working your sources. It feels like we are in some posture where were waiting any minute no this other shoe to drop including importantly on whether any members of congress might get subpoenas themselves. This is something that ive asked members of the January 6 committee and so far nobody has ruled it out, they havent committed to it yet either. Reporter thats right, No One has ruled it out and that is what is critically important. The members of the January 6 Select committee, they met Behind Closed Doors for 5 1 2 hours last night. This was the first time they have seen Each Other and met in person in seven weeks. Of course they communicated over Zoom And Text message, but they had a lot to go through. And coming out of that meeting, why they didnt have any specific answers of what next steps are, but they are indicating that they are in an aggressive stage of their process and subpoenas could come very soon. Now, lets rewind here. Who would be included in those subpoenas . The committee has already asked governor agencies and Media Companies to send over documents. Were told that some of those companies have complied. And some are not complying. We also know there have been record preservation requests for a long list of individuals including members of congress, including Gop Leader kevin mccarthy. And so those people could be wrapped up in the subpoena. Are they going to subpoena the actual individuals, are they going to subpoena the companies for information, these are all questions that were waiting to get answers on. And in addition one thing that they keep talking about a lot that im really interested this is they keep talking about the finances of what led up to January 6, who funded this entire movement if it was a well funded movement. So these are questions that we hope to get answers to. And also what sort of hearing they will hold next because we should expect that in the next few weeks too. A lot to watch for. Among other things, it would rein in a president s Pardon Power and require president ial candidates to be transparent with their tax records. Yeah, things that really ticked off democrats during the trump presidency. Neither Donald Trump nor president Donald Trump ever released his tax returns. Which was a first for a modern Day Campaign and president. And some of his 143 pardons went to people closest to him. Steve bannon, Michael Flynn for example, even though that number is lower than under Barack Obama or george bush. So pete williams, this is an interesting new move. But lets talk about the Pardon Power specifically. That is given to the president constitutionally. So what can congress really do to try to rein that in . Nobody knows because nobody knows exactly the extent of the president ial Pardon Power. And the Big Question Is Congress would make it illegal for the president to pardon him or herself and the question is can congress do that. People who say yes say that the President Cant Pardon himself so congress can easily make that illegal because the President Couldnt do it anyway. But nobody knows whether the president can pardon himself and that could be a constitutional problem. I will say this, if congress does pass this law and then a president tries to pardon himself and it goes to court, that would provide a simple way of finding out whether the president actually has the power do that or not because without a law like that, it is unclear who would have the standing to sue a president who decided to pardon himself. So there would simple be a relative term. Pete williams, thank you very much for keeping an eye on that. We also want to talk about something else going down today, the biden administration facing new questions over the handling of that migrant surge at the border in texas. As Nbc News has learned, as many as 20,000 migrants in colombia are considering making the same trip, Something Governor Abbott referenced during comments he made in Del Rio just this afternoon. Warning migrants not to come to texas. Also Homeland Secretary was grilled in this exchange with senator josh hawley. Do you bear responsibility for the humanitarian crisis in Del Rio . Yes or no. Senator, it is my responsibility to address the Human Tragedy in Del Rio, to address that and we are doing so. You dont think you played any role in your policies played any role in fostering and gomenting this crisis has ensnared so many thousands . What were learning from our interviews is they are receiving false Information And Misinformation from the Smuggling Organizations that traffic in the exploitation of vulnerable individuals. Were also hearing now from Vice President Kamala Harris about those images that i know youve seen of Border Patrol agents using reins on horseback. Watch. What i saw depicted about those individuals on horseback treating Human Beings the way they were is horrible. And i fully support what is happening right now which is a thorough investigation into exactly what is going on there. But Human Beings should never be treated that way. And we are experiencing just a brief break from the Triple Digit Temperatures that have been plaguing this area for the better part of the past week making it even tougher beneath that Border Bridge not too far away from where im standing. But it is still very much a fluid and dire situation. At last check about 9,000 migrants, mostly haitian Men Women And Children children, are still waiting there not knowing who will stay, not knowing who will go, but knowing that deportations are only ramping up. Hi hundreds already flown to part owe Prince And Dhs saying those flights will only increase in the days ahead. In the meantime, we know that thousands have already been taken to nearby processing centers. I had a chance to visit one shelter here in Del Rio where i spoke to a 25yearold haitian man who made the journey from chile, South America starting in july, arriving here over the last week with his pregnant wife. And he said conditions under that bridge were so bad that he chose to swim back into mexico to buy food, to buy supplies to bring back to his wife because simply there was not enough being handed out by authorities here at the scene. He says that he is hopeful that they will be able to stay in the united states because his wife is pregnant. Dhs saying that they will give priority to families who claim asylum. And also to unaccompanied children. But if you are a single haitian adult or a family not claiming asylum, you likely will be deported to haiti. Secretary mayorkas defending that decision because after the earthquake a month ago, the administration believes that it is at least stable enough to send these people back to. But important to note here, some of these folks may be going back to a country that they left years ago when they left after the 2010 earthquake to go live and work in South America. Over in missouri they may be getting closer to a near total ban on abortions, all of It Hinging on what happens this court, part of a legal fight unfolding since 2019 when this particular law were talking about was blocked before it went into effect. This is as Nbc News has learned that the hoist Oversight Committee will hold a hearing on this thing, states pushes to try to restrict abortion access. I want to bring in Moa Barrett who is covering this for us. When do you think that we can expect a decision . As you mentioned, Todays Hearing has been years in the making. And one of the sticking pointses that weve seen this year is around another provision in the law which criminalizes abortions if the fetus has been diagnosed with Down Syndrome. So if he pass forward to 2019, it was blocked again after it was brought to a federal appeals court, a panel of 3 judges, they blocked it because there was a lot of confusion about whether this was a ban or a regulation around fetuses diagnosed with Down Syndrome and that was brought up again today as the case was brought before the entire 8th circuit bench. And again, this question really argued here because the state is pushing that all lives regardless of Ability Or Disability are sacred, saying that it is a form of discrimination if a fetus is aborted because of this diagnosis. And the judges continue to have a lot of questions about whether it was a ban or a regulation. Also around the fact of if it is discrimination, why arent they attacking whether a person decides to terminate their pregnancy based on sex or race. And so this was something that was definitely highly contentious as obviously this would come as the second state to have such an intense Abortion Restriction after texas just a few weeks ago. Think big picture this was very good news for the 15 Million or so americans who have gotten the Johnson Johnson vaccine. The company looked at two different regimens, one dose which is what people have been getting so far, and two doses. With one dose, what we see is that the protection against hospitalization which is really the most critical outcome that we focus on here, that protection against hospitalization remains in the 80 to 85 ballpark even with time since vaccination and even the emergence of the delta variant. So that is really quite good when you consider that with Pfizer And Moderna were seeing about 85 to 90 protection against hospitalization. Those numbers are very close. With two doses of the Johnson Johnson vaccine at two months after being vaccinated with the second dose, were seeing that people are essentially 100 protected against severe covid. So the bottom line is one dose of J J is very good. Two doses appear to be excellent. But as with everything in the pandemic, we do need to keep following, gathering data and making sure those numbers hold up. You talk about something that i think is interesting, this idea of a Mix And Match strategy. Can you talk more about that . If you got J J, what should you do. And this other independent study that found that the J J vaccine specifically unlike Pfizer And Moderna kept its effectiveness over time, maintained it over time. So does that mean if you got J J your Heed Need to get a booste less urgent . I think that were still waiting for a bit more data in particular on what the second dose should be. Should it be another dose of the Johnson Johnson vaccine, should it be a dose of pfizer or moderna.
