Ive talked to people, a number of people, who have told me if they make me take the vaccine, im going to be fired. Im not going to do it. But you say its a personal choice. In fact, to attend school in your state of nebraska, children must be vaccinated against a number of diseases. Let me put them up on the screen. They must be vaccinated against diththeria, tetanus, pertussis, polio, measles, mumps and Rubella And Chicken pox. Why are those mandates parents in your state must comply with and do comply with routinely, why is it that they are not so objectionable and such a violation of personal freedom but Bidens Vaccine mandates are . Well, for all those that you just listed, theres a long history that parents have had the opportunity to see how those things have been implemented. There are a lot of people who dont know what to trust. Because of people like you. But its not just happening in nebraska. The New York times this weekend exposed the hypocrisy of the republican position against Vaccine Mandates in Red States all across this country. Writing this, quote, resistance to Vaccine Mandates was once a Fringe Position in both parties, more the realm of misinformed celebrities than mainstream thought. The fury over president Bidens Mandate shows how a once extreme stance has moved to the center of the Republican Party. The Governors Opposition reflects the Anger And Fear about the vaccine among constituents now central to their base while ignoring longstanding Policy And Precedent in favor of similar vaccine requirements. Each of these republicanled states, indeed every state in the country, already mandates certain vaccinations for children and sometimes for adults including Health Care workers and patients in certain facilities. In fact, The Times highlights a couple of examples. Mississippi, which has one of the lowest Coronavirus Vaccination rates in the country, has consistently led the u. S. In childhood vaccinations. Something its Health Officials and lawmakers have actually bragged about. Alabama, a state whose governor called president Bidens Vaccine Requirements Nonsense is actually among the strictest of states when it comes to refusing to accept any philosophical, moral or ethical exemptions for those mandatory childhood vaccinations. And pointing out the hypocrisy is Chris Wallace matters, matters now more than ever when you consider the Life And Death stakes. A new study stressing the lifesaving importance of the Covid Vaccine, finding the unvaccinated are nearly five times more likely to contract the virus or ten times more likely to be hospitalized and 11 times more likely to die of covid than someone who has been fully vaccinated against the disease. And even though those numbers seemingly are not enough to convince the Republican Party to throw its full support behind president Bidens Vaccination policies. A new report in the Washington Post says this puts the gop at odds with its own constituency in the business community. The new Covid Plan drew backing from some National Business Groups such as the business roundtable, the National Association Of Manufacturers and the american Apparel And Footwear association. The post adds this from a political scientist at the university of michigan, quote, the reality is there are a number of businesses that are wanting the government to step in. This gives them the cover to do what they want to do anyway. The gop at odds with truth, science and now even some of its own corporate supporters. Republicans are i wont say are on an island because i know there are people out there that have these views, but theyre in the same cycle as the election lies. They have to back the Big Lie because their voters are mad about fraud. Their voters are mad about fraud because they back the Big Lie. They have to push back against Vaccine Mandates that will save the very citizens they portend to represent because the citizens they represent are skeptical about the vaccines. Its another deadly cycle for the Republican Party. It is. They are an island, nicolle, but its a crowded island. Its about 20 . Its about 20 of the electorate that is on that island with them and it is an outsized portion of those people who show up in primaries. So if youre trying lets take missouri, for example. Its a very crowded primary to be the nominee for the United States Senate next year. Roy blunt is retiring. You have one of the candidates who is the Attorney General who used to be a thoughtful guy who was all out front for helping parents of children with disabilities and autism. Im sure he was totally supportive of the very strict requirements of vaccination we have in missouri for public schools. And now hes leading the charge on all these ridiculous lawsuits, no Mask Mandates i mean, you should have seen them all falling over themselves to go after that sliver of the electorate that will, in fact, control who is the republican nominee. So therein lies the problem, and theyre killing people. If you look at these conservatives, these conservative Talk Show Host that is were antivax that have died. People are dying. This is what is just astounding about this is death is happening. You know, tim, theres a debate going on about how you treat the unvaccinated, and i cant read stories about young moms and dads dying and leaving orphans without feeling extreme sympathy and empathy. They are The End of this Disinformation Food Chain and, of course, people should go out and get better information. The purveyors of death dont just say fine, lets do it. It is in some ways a Way Out Of The Box republicans have locked themselves into. Nicolle, look, i think thats exactly right. I have Nothing But Sympathy for the unvaccinated, the Family Members of people who died. You read these stories theres one in time magazine just over the weekend, and your heart just crumbles reading about these things. And this is where it coincides with the politics and what Senator Mccaskill said is exactly right. People like pete ricketts, theyre scamming the very voters they claim to care about. J. D. Vance who says hes a man of the people and a populist and cares about the working man. Hes going to represent them. Its those people that are dying. Its not Ron Desantis in florida who we have an article Coming Up in a minute about how he had a Press Conference Today with antivaxxers where they were spreading misinformation behind the seal of florida. Its not Ron Desantis thats dying. He got the vaccine. Its the people he invited to the Press Conference that is going to die. And all of these people all of these republicans who are making this argument in the posture of saying they are the populists, they are there for the people. It is a scam. And so, yeah, i dont see how you cannot feel sympathy for victims of a scam and that is whats happening right now to the tune of over 1,000 people a day dying. Not all of them are victims of the scam but an overwhelming majority are people that supported the former President And Support these socalled populist politicians. Claire, let me show you one more thing on this topic. This is Adam Kinzinger on whats happening in Red States. We all hear stories of people in very red areas that are embarrassed to say theyre vaccinated. That is insane and silly, and that is a problem with leaders, particularly republican leaders, that dont Stand Up and give cover to people and say, look, this is not what Republicanism Or Conservatism should be. And you see these governors that do. Mike dewine in ohio. And they get pushed aside by some of those that are out to simply manipulate our base, raise money off of them and not care about their life, only care about what it means for their votes and their Bottom Line as politicians. Its actually pretty sad. It is sad. Its dangerous. To tims point, i think it was j. D. Vance who was tweeting about rising up in opposition to the vaccine and or Testing Requirement for businesses. But why is this the Sort Of hill to die on if youre a republican . This seems like a sick, sick political issue. Well, theyre addicted to a Culture War, and the Culture War embraces that you go after anybody in authority that is from the government. And especially if theyre not the same party as donald trump. So its not any more complicated than that, nicolle. I do think that journalists across america when they are covering antivax politicians, when they are covering antivax rallies, i think the first question that should always be asked is did you take the vaccine . Tims right. Thats the really the scam thats going on, all of these politicians have protected themselves, and then theyre running out there and enforcing a Point Of View that says you shouldnt get the vaccine. How insulting is that . You talk about not being of the people. Tims right. You couldnt be any more antipopulist getting the vaccine and pretending you didnt. Dr. Patel, i want to put the facts out there, too, because i know people end up this debates with Family Members, if you live in a politically diverse family. Its not a mandate. Workers can agree to testing instead of shots. The Supreme Court has ruled in favor of Vaccine Mandates starting with jacobson versus massachusetts. Its been posted by many, many people covering this. Osha has mandated Worker Protections since 1970. A point of personal privilege this is what real president s do. I worked for a president who was concerned about the avian flu, and we had drills on saturdays where we would go in and talk about how to protect the country from a pandemic. It may feel weird to republicans but, frankly, protecting all americans not just The Ones who vote for you is precisely his job. Why are republican state and local leaders so offended by that . I think it has so much to do, also, with not just what Senator Mccaskill and tim said but this effective misinformation campaign. Nicolle, all you have to do is scroll on twitter and you can find that accurate history of mandates in our country or what happened when we had the polio mandate. I can find 100 more, probably 1,000 more tweets, articles or mentions, facts, videos, youtube, that have what seem like, quote unquote, credible people. These are people with mds behind their name, too, putting together and proffering simple lies. This is complicated on some level but its not. If the vaccine, as you pointed out, that will save lives. If youre unvaccinated 11 times more likely to die. Ten times more likely to be hospitalized. And the Delta Variant kept ticking up those numbers. And i just want to offer one more to ground us in fact. Weve passed the threshold in the last 24 hours where weve had over 660,000 americans who died. We have 1 in 500. If you think about your or my high School Graduating Class that would be one person who died of covid. And think about how then can you stand in opposition to it. And then here is what i ask, i will accept that there are doubts. I will accept theres hesitancy, skepticism or resistance, but at what point are we going to say that these are real benefits that outweigh the risks . The Risk Bes that have been brought up are really on a foundation of lies and every time we try to bring science forward all we do are here to Senator Mccaskills point, all you do are hear politicians come forward and then carry the media for the day. And if youre a scientist, whether its dr. Fauci or even just a humble clinical Trial Investigator who does not care about politics, that just gets drowned out by being inflammatory, that minority thats vocal, kind of crowding out the majority of us who just want to be healthy and not have 1 in 500 people die. Thats not too much to ask for. Dr. Patel, how does this manifest in an Exam Room . Because youre Sort Of where the rubber hits the road. And in all parts of the country there are consumers of disinformation, on facebook, as i said, youre responsible for getting better information. As tim is pointing out theyre reading things posted and retweeted and things that have shown up on Fox News and other places by vaccinated anchors. Do you have success with people who are skeptical who come from that Sort Of Information Stream and have heard it day after day after day . I do. And more latino and latina community, but their misinformation is spread on similar streams. I dont do, here is why i got vaccinated because i meet them for 15 minutes and then i go away. I actually say, who is the most important person in your life . Who is on the phone. What i think is critical in the united states, were blessed to have this. I have vaccinations right here. We will do this right now. And i can tell you that is going to save your life. And so it has a lot of psychology in it, nicolle. When you are oneonone, thats when you can make a breakthrough. It takes time. This is not something you can do in five minutes. Its why im notoriously late in clinic. Its the right fight to have. And i will just say it doesnt have to be a doctor that does it. Ive had houses of worship where its who you respect. Ive had schoolteachers who were hesitant who ive talked with and we sat in a group. And when i said you dont want your students to get sick, do you . And they all say, no. You know what, ill do this. Ill try it. And then they ask about the brands, what the Side Effects are, and you get them in a discussion. Its possible, nicolle, but, man, theres so much information to break through. I can only do it when they come into the office. Think about how many people you reach, how many people on the internet and Social Media channels that dwarfs anything i can do in 15 minutes. You know, tim, i dont want to understate or overstate the importance of what Chris Wallace is doing there on Fox News. He is confronting republican newsmakers with the truths and the cravenness of their views and doing that work. I think what is interesting the wide majorities of The Public Supports President Bidens plan, not just the coalition that elect him. I want to put up the new polling encouraging states to require vaccines for all school employees, 62 . Requiring vaccinations for Health Care workers, 60 . Requiring employers with 100 or more workers to mandate vaccinations or testing 58 . Requiring federal employees and contractors to get vaccinated with no optout, still 56 . This is a general election loser. This is a primary play, that plays with peoples lives. This is a political public Health Winner for President Biden. People spoke with their arms. Were up over 60 , 70 of people who have gotten the vaccine, one or two shots. Some of those people will be opposed to mandates. There will be a little bit of a gap in between there. This works in President Bidens favor. To your point on what Chris Wallace is saying, and the interesting thing about that interview with governor ricketts of nebraska he really revealed the crux of the scam here. If you were a republican who really believed freedom extended to freedom to Risk Death via the coronavirus, and this was a good Faith Position and youre just someone who is so committed to freedom, you do not believe the government can mandate anything like this at any time, then what you would be doing is pairing your pushback to the president with a message from dr. Patel or dr. Jha or your Surgeon General of your state or your local hospital. I dont want this to be mandated but i want everyone to get vaccinated. I dont like this policy but i want every single person in my state to get mandated. I dont want you to have to read between the lines at all whether i think this is trustworthy. That is not what hes doing. He was playing into their antivax views by saying theres a lack of trust. Governor desantis, as i said, is doing the same thing in a Press Conference. I think that is a really important distinction that shows how irresponsible it is for republicans, and i also think in The End its going to be really bad politics for those, unfortunately not governor ricketts who is in a safe red state. Others i think will not work in their favor. I want to pull politics aside and read a story that undid me this weekend. Nbc news reported a California Couple died of covid, left behind five kids including a newborn daughter. Im not going to read from it because i cant, but the couple was unvaccinated. They leave behind five kids. I read everything i could find. The kids are living with their grandparents. These are the stories that dont make sense to me afterward. No Mom Or Dad wants to leave their kids on this earth without seeing their lives, without seeing them grow up. They loved their family, they had a new baby. How does that not break through . It is hard to imagine that people who are intelligent enough to have garnered a measure of success in the public arena, whether its Ron Desantis or whether its the governor of texas or the governor of nebraska. It is hard to imagine theyre not smart enough to know the damage theyre doing. And what is the next step, nicolle . Are they going to remove these mandates for children to be vaccinated to go to school . Are we going to go back to the days where children get polio or children die of mumps or smallpox or Chicken Pox . Is that the next stem here . Is this going to be a Threealarm Fire as it relates to the health of those children including those that have been orphaned by this relentless disease . We are blessed in the united states to have great scientists and a wonderful medical community, and they have always been respected in our country and maybe the lasting damage here is what theyre doing to them, people like dr. Patel, that somehow now its been an allamerican activity to give the back of your hand to the doctor who has chosen a profession because they want to help others live a healthy life. Theres no greater sign that the Republican Party has turned its back on protecting the right to vote, one of the most fundamental rights in our democracy, than the fact that just one republican senator, Lisa Murkowski of alaska, supports the John Lewis Voting rights act. Nbc news reports that in view of voting Rights Legislation Coming Up a wall of Obstruction Democrats are close to a deal that can get the support of all 50 democratic senators. Of course, as we cover all the time around here that bill will not pass with the filibuster in place. And on that front sources telling rolling stone, quote, biden will pressure Wavering Democrats to support reforming the filibuster if necessary to pass the voting bill. We spent a lot of time when abbott signed into Law Texas voting restrictions. It yielded zero fraud in 2020. I wonder if you can tell us what were not necessarily paying attention to but that is equally concerning to you. Thanks for having me again, nicolle. Youre right. As our attention as a society moves from one topic to the next, and its not to suggest these are not important topics to be covered, its important to recognize that republican legislatures around the country are still hard at work undermining democracy and passing antivoting legislation. The Texas Bill that went into effect, sb1, is actually the third Texas Bill passed this year that targeted Voting Rights. It was the big one, The One that got most of the attention, but there had been two prior bills already in place that targeted the Voting Rights of texans. Thats on top of laws in Georgia And Florida and bad Voting Laws in arkansas, in kansas, in montana, in iowa. So its really the Big Lie has infected every Nook And Cranny of the Republican Party and its legislative efforts to pass antiVoting Laws. And, i mean, what i think is really the dangerous thing to ignore is that when you pin them down No One can point to any fraud because there wasnt any, not bill barr, not chris krebs, not mitch mcconnell. So these laws are being pushed through with extraordinary support in the republican legislature, republican voters, all based on that lie. When you pull the thread, where does that lapped in your view . So, first of all, its not just that there was no evidence of fraud but the bills themselves dont even make any sense as efforts to prevent fraud. The Texas Bill you mentioned or we started with, it bans drivethrough voting which means it bans allowing people to cast their ballots on Voting Machines while sitting in their cars as opposed to standing outside their cars on foot. Theres no way to organize thats an antifraud bill. Theres no fraud associated with drop boxes. So when you match up the bills to what they claim about fraud, they dont make sense. Where this is going is pretty clear which is that republicans believe that they cannot win elections fair and square, by attracting the voters eligible to vote. So they are left to change the rules of the game to make it harder to register, harder to vote, to make it harder to have your Vote Count and then finally to eventually undermine the way in which elections are certified and reported out. We dont spend enough time to explain. Its happening in georgia where theyre reviewing the largest pocket of votes. They are literally rigging the counting, so these really arent just Voter Restriction laws, potentially Voter Nullification laws. Explain what that means in practical terms. When im asked how did i get into this field, i took an unusual path, i began as a Recount Lawyer and how ballots are counted and elections certified. It was during the 2020 general Election Aftermath that we saw first the state of texas seek to invalidate, that failed in the Supreme Court, and then what did we see . The president of the united states himself calling local Canvass Board officials in michigan asking them first not to certify the results or include the results in detroit and then not to certify the state at all, the weak point that were seeing Republicans Target and if they can put in place people who see the certification of the elections, if the democrats got five votes and the republicans got three votes, either the three is larger than five or that five doesnt exist and that is what we are going to have to fight against along with the other laws dealing with voting itself. Lives were put in danger, thats how hostage they are to trump and trumpism. The only Thing Trump cared more about killing a bipartisan equally represented commission was rigging the vote. Making his call to a steve bannonlike person. Where does this delusion come from that there could be a bipartisan solution to Voting Rights . I think the solution to this is not going to be found in bipartisanship. Part of the piece i wrote today is just time to throw in the towel and realize there are more republicans in the House Of Representatives with a Failing Grade in nra than voted for the John Lewis Voting rights advancement act. Think about that. Not fitzpatrick, not kinzinger, not a single socalled moderate republican you might think would break on this or that was willing to break on Voting Rights because it is The One thing that holds the modern Republican Party together. Even, you know, Kinzinger And Liz cheney, who are otherwise being sensible on the January 6th Commission Cant Stomach the idea of allowing everyone to vote because that is the existential threat to the republican Party Today is that everyone is able to participate and elections are certified accurately. The republican idea needs to be put to rest. What is your blunt message on doing away with the filibuster when it comes to voting Rights Legislation . Look, i think the sooner we come to terms with the fact this is going to be a party line vote, the better. I recall, as im sure you do, in 2009 and 2010 how much time was spent trying to find that miraculous senator who would vote for the affordable care act. It wasted precious time on the Senate Calendar and meant a delay in the implementation of the muchneeded law. Now we look back, you know, more than a decade later and see 31 Million americans have been covered as a result. History will judge not the process by getting this law passed but it was passed. Those who Stand Up in favor of Voting Rights will be rewarded by the historians for what they did in this time of trouble and they will not be viewed as unnecessarily partisan and why didnt they work with republicans. 62 of most americans support most of these measures. 64 to make it easier not harder. There was a moment. And then it didnt last very long and then it went away. And we started to divide. There was another moment for the Republican Party after romney lost to obama, and claire would know better than i, but priebus said we need to open the tent and be more inclusive and he got the door slammed in his face there were the days of Tip Oneill and ron reagan, took a Couple Drinks in the room, shut the door and came out with a deal. Boehner and obama were at least talking about a grand bargain, and then boehner got his leash jerked, and he took it and went right out of congress. I think its up to the Republican Party. You know, the Republican Party, i grew up in that house. My dad was a republican. My mom was a republican. I guess in the old sense, you know. And theyre there. Theyre still there. I agree with your previous guest who was saying Voting Rights is the Death Knell for them, the Republican Party. In the runup to the election, the emd of the Republican Party. Which when they tried to get Sarah Palin through, theyve just been off the rails. And i think out in the midwest where i live in michigan, were not stupid. We know bs when we see it. And i think the people im around, and, yes, there are those who are very protrump and flying the flags and still singing the songs, but there are a lot of people who are over it. They just want someone to tell them the truth like in the Swing County in michigan. They were reagan democrats or biden republicans and trump came through michigan in 2016 and promised these men and women of all race that is were going to im going to get your job back, that specific job you lost, im going to get it back. And he didnt do it. They voted for him, he didnt do it. He lied to him. Michigan went biden. Theyre just looking for somebody, a democrat, a republican, anybody who will tell them the truth and make this world a better place for their kids or grandkids. I dont know if partial unity is possible but 60 40 is. If republicans look at the polls, maybe i should maybe i should Stand Up, maybe now is the time. And i would hope there would be people that could do that in the next year or so and that there would be a change where we could get the guardrails of the rule of Law And Nobody gets everything they want. Democrats or republicans and everybody has to compromise and you come out with a deal. And thats what a democracy is. It is a tool for people who disagreed to stay in the room and get a deal. First of all, to make sure you and i are always good, you know i played a hand in Sarah Palin being hoisted upon this country. You were in the room. I was in the room. But your point on democracy, The One thing the anniversary afforded us was the opportunity to talk about the men and women on flight 93. That before they charged the cockpit they held a vote. Even in what may have been their final moments on this earth it was important enough that they werent going to do it unless everybody was for it. What do we do now to move back toward thinking about doing something that might cost you your loif to spare another tower from being flown into . What are the things we can salvage going forward . One of the things is recognize theres a New America. There are people in this country who do not want that to come. A lot of its based on White People now being in the minority. They want white Minority Rule in a country where the majority is supposed to carry the day. And those there are people that i think if we get in the same room again and were able to do that, then maybe we can come to an agreement on something. I dont know. Its hard right now. I dont think we need another tragedy to come together but need people to understand maybe this New America will be better, an allinclusive america will be the best and the brightest. Aaron sorkin wrote that speech that was delivered at northwestern. It will outlive me and aaron. And people go, its the speech about, oh, its not the greatest country in the world. Yeah, thats how it starts. The second half of that speech is, yeah, but it could be. And its going to take work. Its going to take compromise. Its going to take people to sit in the same room and listen instead of yell at Each Other. People need to put their phones down and stop reading things that only they agree with. All of that stuff matters. We dont have time for any of this. With climate change, with covid killing, what, almost 700,000 people now, we dont have time for this. This is really the adults need to get in the room and get back into congress and back into the White House and lead this country like we want them to lead us. Take us to tomorrow. Take us to this New America that will be better for all of us. I think its a great moment in history, and i hope were able to see it through in a positive way. White people are The Ones who need to hear it, and aticus in aaron Sorkins Play of the book, aticus faces his own white blindness. He also faces a question, too, which is that he believes Theres Goodness in everyone. You just have to care enough to look for it. I think thats on the table right now. I think thats one of the questions that aarons play of the book throws at this predominantly white audience as they face the issue of systemic racism which is, you know, what To Kill A Mockingbird is all about. Jeff, first, it is great to see you, and anyone who has had the chance to see you play Aticus Finch, especially for somebody who was a young girl and that book not only really had an impact on my career choices, it also had a huge impact on how i viewed race in this country and my obligation towards the racial divide. But im really curious about Chief Harris versus Aticus Finch. You are from a town in michigan where you understand the people that are in American Rust. I grew up in a small town in missouri, very similar. The grievance is palpable. Thats what donald trumps genius was. He tapped into that main line of grievance and he played to grievance instead of uniting our country with aspiration and inspiration. He said, hey, i get you, i get you, why youre mad, i get you that you feel like you have been screwed over. Talk about the difference between Aticus Finch seeing good in people and Chief Harris in this town where people are stewing in their grievances, and many times through no fault of their own. They both want to do the right thing. As a Police Chief, Dale Harris is trying to do the right thing. Sometimes he and American Rust is full of people who are like him, who at least have reached The End of their road and this is where he is going to be and this is his lot in life and hes going to do the best he can. He can see the bottom from where he is. Some of these people are at the bottom, but hes still trying to do the right thing in a world full of wrong. Aticus almost comes into this like everyone believes the same thing he does, i believe in the law, Theres Goodness in everyone, and shes not a racist, she is just very sick and very ill and hes an apologist and in a way an enabler. I think both of those guys are being faced with what does it take to hang on to what is right, and hanging on to what is right aint easy. You know, hate is easy. Love takes a little more effort. It is real easy to hate right now, real easy to hate. People dont know where to turn, you know. Theyre not democrats or republicans. Theyre people who just want somebody to tell them the truth, like i was saying before. Thats what i see out in the midwest, and it depends what News Show you watch and theyre trying to get information, and at The End of it some of them dont even care. Some of them, claire, like i dont even pay attention to any of it, you know. It is time to. It is time to pay attention enough to decide what you stand for and what you believe in, and certainly with Atticus Finch he gets off the porch and takes the case to defend Tom Robinson and learns in the Play Version versus the movie and book, he learns to become he learns to face the racism. You know, thats one of the things about the play that is so great. You know, you watch the movie, you read the book, but you feel the play. When they shut the doors behind you, you are in the room when Tom Robinson is taken out and you know him and you care for him, and it hurts you. I stand on that stage eight times a week. I did it for a year eight times a week and to a predominantly white audience, i deliver that closing argument. At The End of it i turn to the audience and i treat them like the 12 white angry jurors, and 1,400 of the most sophisticated theater goers, predominantly white, dont move. Dont move. Capitol police arrested a man from california outside the headquarters of dnc in washington, d. C. We will warn you that the images we show you display an image of hate. These are pictures from the Capitol Police showing the Man Ace Pickup truck with a swastika and other symbols painted on it. The man told police he was on patrol and began talking to them about things pertaining to white supremacy. Police said in their report they do not know if he was planning to attend upcoming demonstrations or if he has ties to previous cases in the area. This arrest comes as the city is already on high alert. A rally in support of those arrested for their roles in the Capitol Riot called justice for j6 is set to be held this saturday in washington, d. C. Law enforcement is taking steps to make sure it doesnt turn into anything resembling another January 6th. Earlier today u. S. From that reporting, quote, soon after the Recall Race was announced in early july, the embers of 2020 Election Denialism ignited into new false claims on rightwing News Sites and Social Media channels. This vote, too, would supposedly be stolen with malfeasance ranging from deceptively designed ballots to nefariousness by corrupt postal workers. This swift embrace of false allegations of cheating in the California Recall reflects a growing instinct on the right to argue that any lost election or any ongoing race that might result in defeat must be marred by flaw. The relentless falsehood spread by mr. Trump and his allies about the 2020 election have only fuelled such fears. The ongoing fight against extremism and protect our democracy is where we start. It dawns on me should Governor Newsom prevail and all of the polls should he will, you could have the president of the united states and the governor of the largest state viewed as illegitimate by, you know, nearly 40 of their constituents. Yeah, and i think were already seeing that. I know former President Trump Today released a statement calling the California Election rigged and a few days ago he said the same thing. I predict it will be a rigged election. It just kind of follows what weve seen on Social Media and in conservative News Sites for the past few months ever since the California Recall election became a reality. Theres been, you know, mentions of Fraud Kind of continually fuelled by former President Trumps continual statements about the 2020 election, and then when it looked like Governor Newsom was doing a little better in polling and he was expanding his advantage there, then it got way more accelerated and way more prevalent. You saw on Fox News hosts like Tomi Hahrin saying it was fraud. An Election Integrity Outfit was set up for any voters, designed for voters out there trying to find fraud ascendant tips. It has been this Bed Rock almost of the republican base to just view Voter Fraud as endemic to the united states, especially when theyre losing and it is something that only benefits democrats and it has been fed to them by everyone that they trust from President Trump to some of their most trusted news sources. So no matter what it looks like in the immediate future this is going to be a reality when you have a clear victor with no evidence of fraud, be that the president of the united states, possibly Governor Newsom tomorrow, viewed as illegitimate simply because theres been such a corrosive attempt to undermine their success by these false claims of fraud. Clint, it is not just illegitimate and therefore weakening their authority to mandate vaccines, to convince their constituents that theyre safe, george w. Bush tied those lies to domestic terrorism. I mean to tie the president who pursued policies that are divisive to the hour of this day, to say that the threat from Al Qaeda is the same as what is today the threat from within, there arent threats in both parties. Theres threats in one party. There are lies being told by one party, and theyre being told by republicans at the highest level, because by refusing to knock them down you are green lighting them. They are being swallowed hook, Line And Sinker but american voters. What do you make of that . Was it overdue . Will it sink in . Nicolle, i think it was long overdue. It was remarkable that the War On Terror, at least for me, the global War On Terror was two decades and it was book ended by two speeches by george w. Bush. I remember him down at the World Trade Center after the attack, and to hear him that day and so poignantly point out that what we worried about the last 20 years is really not a global War On Terror but it is an american War On Terror within, you know, at this point. Thats where we have come to, is this divisiveness. It was a remarkable speech. I think it also points that the driving factor of this is when elected leaders and political candidates drive their supporters to believe things that are false and mobilize them to violence. Over the last 20 years we talked about guys like bin laden, albaghdadi. They were The Ones putting up the vision, the justifications for violence. Instead today what we worry about is will elected leaders come up with bogus claims about election fraud. Will they make up some Sort Of conspiracies about vaccines . Will they put out some Sort Of lie about covid19 being real, and in so doing either kill their voters and supporters just through negligence as the case of covid19 and vaccines at this point, or mobilize them to violence. I mean on January 6th i believe it was five people that died in the course of that, and most of those were still trump supporters. Those were people that went there and they died that day over a completely bogus story. So to watch our elected leaders continue to foment that, what usually ends up happening is those will find out the Election Wasnt Rig or there was no fraud and the vaccines do work will come for them. It could be at a capital, a state or local capital, in any towns around america at this point. Donna, it is now an argument that must be made with the exception of Liz Cheney and Adam Kinzinger, the Republican Party is awol on the threat of terrorism here at home. Well, they are, and i think that we have to keep in mind, nicolle, that January 6th we were told by the organizers that it was going to be a peaceful rally. This rally thats Coming Up on the coming saturday, there are 700 participants. Well, remember that Law Enforcement estimates that 800 of those supposed Peaceful Rally Goers stormed the capitol and caused great damage, fear and tried to destroy our democracy. So i dont trust at all that what will happen on saturday will not be a continued outgrowth of the anger, the disinformation and the allegations of fraud that continue to animate the right. It is puzzling to me and probably to all of the audience that, you know, save for a handful no republican leaders are really coming out and calling it, as George Bush did and, you know, i wasnt a great fan of the former President Bush when he was in office, but i have become a greater fan afterwards because he is speaking the truth of the Republican Party and calling it out as a handful of others are doing. But we are in danger right now and the arrest last night of the, you know, guy carrying a machete is really just another sign that we have to be ever vigilant of this threat of domestic terrorism. Yeah. I mean, clint, let me come Back To You. I mean what the department of Homeland Security Bulletin says is that at the intersection of the threat to the homeland is an ideology that shares grievances of covid restrictions and adherence to the Big Lie. I mean nick is talking about california, a blue state, where the republicans there are likely to become radicalized by this belief that should a democrat prevail again, who is the current governor, it will only be possible if fraud on a massive scale big enough to affect an election in california has taken place. I mean how do you deal with the threat if one of the two parties is repeating the lies that incite it . It is extremely problematic. Just imagine being part of an Fbi Task Force or even a local Police Force and you are trying to deal with these issues, and in some cases if theyre elected Law Enforcement, you know, Sheriffs Department assigned to the Republican Party legitimately win, but then how do they Sort Of deal with those issues . Theyre going to be in conflict with the national or state party level, right . It is just extremely convoluted and it is difficult to know what to believe. Over the longer term though it has two big effects. In the acute Sort Of way it creates mobilization to violence like we saw on January 6th and in other places we have seen around the country since. Separately though, over the long term it really creates apathy. If people dont believe that their votes are going to count, even if theyre on the side that wins, over time they just may not want to invest in democracy. They may not want to participate in it. It creates a longterm apathy. You know, i dont want to go too much into the russian approach of this, but it is about subversion, and americans have done this. This isnt a russian operation, but the idea is essentially that you just lull people into apathy. You make them so disgusted with what is going on and not sure what to believe that they ultimately just exit the system, and thats just extremely damaging for our country. Notions of fraud will do more to destroy our democracy than Al Qaeda or isis or any other foreign power ever would. It is just this stunning thing to hear said out loud. Nick, i want to come Back To You because what your Reporting Today does, i mean you focused on these Voter Restriction laws that had the greatest chance of passing and theyre mostly in states where a republican governor was going to sign the bill, there are almost 400 racing through 48 legislatures, but democratic governors have been vetoing them. What this reporting reveals is that the fraud allegations are doing damage in states even where the Voter Restrictions will not become law. Pennsylvania is probably another place thats going to deal with the Tectonic Plates pushing against Each Other from republican disinformation agitating, and even if there isnt a phony audit there will still be Energy And Heat around the conflict. Where are the other places where you are seeing, if not Voter Restriction laws passed, this friction and this heat around the Big Lie . I think across the country. I mean theres really it is pockets, but it is also a consistent, you know, bumbling brook of disinformation on Social Media, on conservative News Sites. This obsession with these false allegations of Voter Fraud is really across the country, and we will see more pronounced moments where it bubbles up to a level of an investigation or an audit like were probably about to see or we are seeing in pennsylvania. And then elections that are coming down the road, in two Blue States we have governors races in virginia and new jersey, i bet it is probably a Safe Bet that we might see some other allegations of false false allegations of fraud in those two states as well just because it has become part of the playbook, but this isnt to say that this is, you know, thrilling a lot of republican officials. I talked to a few for this story who are very dismayed at this because they view it simply as a losing message. If you are constantly telling your voters that their votes dont count or not to trust the prevalent way of voting which in virginia is to vote by mail, telling them not to trust that then theyre not going to vote and youre going to lose. I spoke to the Lieutenant Governor of georgia who experienced it in 2020 and points to the recall, where there were 750,000 who didnt show up for the recall, more than half of those, significantly more than half were from republican leaning areas. That came as former President Trump was launching his crusade against the georgia elections, making all of these false allegations of fraud. If you look at the California Recall right now, the numbers for republicans right now in terms of returning ballots and early votes are not good. If you are continuing to tell all of your voters that, you know, your vote doesnt count or that it is not secure, they might not turn out and, you know, the California Republican Party has been really trying to get their voters out and get them to trust vote by mail, and theyre caught in a very difficult position. So it is almost, you know, that the base is almost fighting against some of the officials who noted what it takes to win an election. It is an interesting time, but to looking ahead i think we will see false allegations of fraud in almost every major election for the foreseeable future. It is just the most disturbing reality. Im sure you are right, but it is so disturbing that thats what were going to be covering. Donna, i want to put two pieces of information up and get your thoughts on them. Believing that trump, who lost, they believe one in 2020 is this important to being a republican. Among republicans, 59 , almost 60 say it is very or somewhat important. Adjacent to that news, donna, that Capitol Police who looked into January 6th and their own workforce have recommended disciplining six officers. Let me read from The Times reporting on this. Capitol police investigators recommended disciplinary actions against six Police Officers for their actions during the January 6th riot at the capitol. Three officers were singled out for unbecoming conduct, one officer for failing to comply with directives, one officer for improper remarks and one officer for improper dissemination of information. The Capitol Police said in a statement on sunday, we dont have no more information than that here. No criminal charges will be filed. The Attorneys Office didnt find sufficient evidence. I wonder what you make of Sort Of, one, the state of Capitol Police and these disciplinary actions and nicks reporting, this is the new normal, this is the new battlefield on which elections will be waged . Well, i think one of the things that we knew after January 6th is that none of our institutions is immune to the infiltration of this rightwing conspiracydriven ideology. We certainly saw that in the immediate aftermath as Secretary Austin began to look in the military. We see it within regular Law Enforcement and the Capitol Police. There are six officers out of hundreds of Capitol Police officers who really serve, you know, diligently and professionally, but i think it is important for all of our institutions, whether they are government or private, to root this out before it becomes the new normal for real in our governance and institutions. But it should not be a surprise to us that as much as this ideology has and cult has permeated us in our communities and in our neighborhoods that it also is deep within our institutions. Just last week we saw the court again by a 5 to 4 Vote Refuse to block a Texas Law on abortion, even though it directly contradicts nearly a half centurys worth of abortion precedence. Why shouldnt these events lead people, the general populous to believe that the court has been politicized already . Look, i thought the last decision you mentioned was very, very, very wrong. I will add one more very, and i wrote a dissent and thats the way it works. Supreme Court Justice Stephen breyer defending the united states Supreme Court against claims that it has been politicized after the courts highly controversial decision not to block texass near complete ban on abortion. Brandnew reporting in the New York times examines how this law was, in fact, a highly political and focused crusade on the part of one man years in the making. From that new times reporting, quote, jonathan f. Mitchell grew increasingly dismayed as he read the Supreme Courts decision in June 2016 striking down a major portion of a Texas Antiabortion Bill he helped write. Not only had the court gutted the legislation, Which Mitchell had quietly worked on, but it also had called out his attempt to structure the law in a way that would prevent judicial action to block it, essentially saying, nice try. Quote, we reject Texass Invitation to pave take way for legislatures to immunize their statues from a general review. In the majoritys opinion the decision was a stinging Rebuke And Mitchell vowed that if he ever had a chance to write another law he would make sure it survived the Supreme Court. Unfortunately, he was successful. Mike schmidt whose byline is on that reporting we read from, and donna edwards, msnbc contributor, is still here. Mike, tell us how this was for him. Was he obsessed with getting something on the books that would withstand scrutiny . Did it become personal . What are his views of the court and does he feel like he prevailed finally . I think it is a combination of several different things. I think that this is someone who spent his time as the Texas State Solicitor general from in the early 2010s for about four years. In that position he was able to see how Texas Laws were being gutted by the courts, and he learned through that, came up with different ways that he thought he could create a bill that would withstand a judicial review and that would flummox the courts. He tried this in 2014, failing as you were pointing out when breyer smacks it down in 2016. But when he gets another chance at it in 2021, he has a new device, a new device to put into the law which he had used throughout texas to help Ban Abortion in several cities in texas throughout 2020 and 2021. He had been galvanized by that, encouraged by that, and thats what led him to take to include this in this bill. It was a deliberate move to try and allow the law to stand regardless of what the courts did. Well, i dont know ultimately what the Success Or Failure will be of this Texas Law when it does finally reach at least a hearing stage, an Argument Stage in the Supreme Court. What is really disturbing is the prospect that your neighbors, your coworkers, anyone in your purview could stake you out and report you and sue you and then get a 10,000 reward for it. It is, indeed, a bounty. I Cant Think of any other laws where your constitutional rights are up for grabs by bounty hunters, and so this is really dangerous. The Supreme Court, as politicized as it is, and it is highly politicized now, has entered into a territory that none of us would necessarily have projected where the court indeed is giving license to private individuals to curtail constitutional rights. So i think we are in a very dangerous stage here, nicolle, and it is a reminder that as persistent as the right and the antiabortion the antiabortion forces have been that those of us who believe in a womans right to make decisions about her own body and even to choose an abortion have to be as persistent in our legislature, our congress and, of course, at the Supreme Court. Mike schmidt, what do legal experts say about this loophole . I mean because if the Supreme Court is fine with loopholes for this, what is to say that the left or their forces couldnt say, fine, were going to ban guns. Not the state, were just going to have a Neighbor Call if you are toting around a gun and you dont have a permit. Were going to have a neighbor can sue you if you are carrying an automatic weapon. Is the court really on the precipice of green Lighting Vigilante Justice as a loophole for things that cant otherwise withstand judicial review . One of the legal experts who we spoke to in the story basically said that, you know, this is not a genius thing. What it is is that this Texas State Legislature found a receptive court, a different court than that was there in 2016 when texas had a different law struck down, and that this is more about the makeup of the court than it is about what is in the law. And that when the law is eventually heard, as it makes its way through the court, it wont survive. Now, that may turn out to be the case, but that is a very, very long process that takes many, many months to go through, and initially here it has survived at least the first few weeks which in and of itself is remarkable and has made this such a huge national story. I mean you could tell when you talk to democratic sources in the state, you know, a couple of weeks ago they were more nervous, but as weve seen more polling, as theyve spent tens of millions of dollars turning out the vote, as weve seen the mailin ballots coming in with democrats casting twice as many as republicans theyre growing more confident. These events, whether Vipt Harris or President Biden coming in to rescue, so now it seems more like a celebration or helping him run up the margin. We wont know what happened until tomorrow because obviously a lot of republicans are waiting to vote on election day, but we are seeing people including President Trump earlier today saying that this election is rigged and Sort Of laying out the Ground Work to challenge the results. It feels like one of the more dangerous new practices. I mean theyre sore losers, jacob, and then there are people who damage the democracy in the process of being sore losers. I would put republican and i worked for republicans who lost and none of them claimed fraud. It is hard to win in california if you are a republican. What is behind this strategy . Are there strings being pulled by trump and his allies . Reporter in a 2 to 1 democratic state, nicolle, Larry Elder or any republican who is going to win needs not only high turnout but in some measure a miracle that a large defection will happen from the other party. The odds are quite literally stacked against any republican trying to win statewide office. You asked about President Trump. This is straight out of the trump playbook, what were hearing now from Larry Elder. I had a chance as you were talking about earlier to talk oneonone to the republican frontrunner on the Replacement Ballot about whether or not he would even accept the results, win or lose, come tomorrow. Lets watch again what he told me. Whether or not you win or lose, will you accept the results of the Election Tomorrow . I think we all ought to be looking at election integrity, no matter whether you are a democrat, an independent or republican. Is that a lets all do that together. Lets work together on both sides of the aisle to make sure it is a fair election. Is that a commitment to accept the results of the Election Tomorrow . Lets work together to find out whether the Election Tomorrow is a fair election, lets work together to do that. It is not a commitment to accept the Election Tomorrow. Jacob, honestly i answered your question. Lets work together. We should have a vested interest in making sure it is a fair election and one conducted with integrity. Not only, nicolle, is that not a commitment to honor the results of the election come tomorrow, page out of the trump playbook, but devoid of any specifics about what might be wrong with the election process. Take it from me firsthand who spent time inside the Los Angeles County Mailin Ballot Processing center, not just the largest Election Jurisdiction in california but the largest election injuries in the country, they are matching each and every signature automatically in that facility. Signatures that dont match are kicked over for a manual look by Election Workers inside that facility. There will be hundreds if not thousands of Election Workers making sure that the integrity of this election is upheld come tomorrow. By the way, over the course of the past several weeks while people have been voting early, look, there are really legitimate issues out here. You mentioned wildfires. Covid is a huge one. Economic inequality is worse in this state than anywhere else across the country, really legitimate things to talk about in the Recall Election. Whether or not the election is going to be secure based on the facts is not one of them. Well, it is not one of them. You know, seema, have any republicans who have been successful in california or in any locality ever questioned the result of an Election Theyve won . Is there any history of that happening . No. No . I dont recall that ever happening. To be fair, some of the other republicans like former San Diego mayor said he will accept the results. There are people who worked for Governor Schwarzenegger who said State Republicans need to speak out against what President Trump said this morning. It is not all republicans, but there are certainly, theyre certainly not willing to commit and the state Republican Party is obviously taking notice of any irregularities that develop, you know, ballot places, you know, with poll workers, that kind of thing and saying they might consider a legal challenge. It would need documentation. But i do not to answer your question, no, i do not recall republicans questioning the rigor of the election before now. We looked and never found an example of a republican who prevailed and questioned the results or the integrity of the election. I will admit i cried when i heard that, a promising prediction from former Fda Commissioner and Pfizer Board Member Scott Gottlieb on when the pfizer Covid Vaccine will be available for Kids Age 5 to 11. He said there by halloween. Pressure is mounting on vaccine makers and the Fda And Everyone in charge. There are 48 Million children not eligible for the vaccines and parents, all of us, sending our kids back to inperson school, putting hundreds of Thousands Today right here in new York City, the city literally bustling this morning, humming. The largest district in the country and were all desperately seeking the option of vaccinating our kids. On friday the fda had to warn parents again against seeking offlabel shots from pediatricians before its official recommendations. In this reporting from The Times, quote, parental anxiety has fuelled the demand for slots in Childrens Vaccine trials and made appointments scarce. Pfizer, for instance, is fully booked in its clinical trials a spokesperson said. That includes 4,500 children. Joining our conversation from childrens national hospital at washington, d. C. , you have on television and in real life been one of the people i have turned to for reassurance. It has been really, really agonizing for a lot of parents to send kids back to a third potentially interrupted and risky School Year this year without ago sets to the vaccine. Why did it take so long and can we really hold on to the hope that halloween is a realistic prospect . Yeah, i think scott is spot on that it sounds like it is coming down the pike, and the optimist would say data to the Fda End of september, thorough review and then recommendation by october. Then we have a lot of work to do. We have to have our nations pediatricians on how to administer the vaccine, probably age 5 to 6 up to age 12. It has taken a long time and my own Grandchildrens Pediatrician has a study and there are literally people knocking down the door to get kids in the study because they realize two things. It could be very good for the individual child and then the overall goodness, if you will, for our nation is really important. Of course, the manufacturers and the fda first and foremost have to make sure that these vaccines are safe. We want to be able to tell parents that these vaccines have been studied in large numbers of kids, that first theyre safe and, second, theyre effective. It sounds like pfizer is going to be able to submit that data hopefully by The End of september. I like that halloween is Sort Of being the goal. I think then moderna probably will be a little ways behind that. I remember covering the astrazeneca trials and if people dropped out or there were reactions it was in the news. Is it a decent assumption if the trials werent going well we would have heard about it by now and does it inspire confidence in it . It should. We know in Children Ages 12 to 17 there are very, repeat, very rare instances of an inflammation of the heart that the cdc, the fda, everyone has looked at and yet we are still vaccinating children safely between age 12 and 17. I think that to me says, boy, we we have a really low barometer to report things. We are focused first and foremost on safety, and i think when that data comes in from pfizer, eventually comes in from moderna, were all going to feel confident that this is the right time to get our kids vaccinated because youre right, a third School Year where we are dealing with all of this is just heartbreaking. I live in new York City. Obviously we took an extraordinary toll in the first wave of covid, and yesterday i was or saturday i started my day at ground zero. I ended my day above 120th, baseballrelated activities, and everyone had masks on. I mean kids, adults, in playgrounds, even outside, the new York City parks if you are not vaccinated require masks for outdoor activities. We spent so much time covering dangerous ways to go back to school, as we should, but can you just talk about safe ways to go back to school, maybe to wayo go back to school to reassure millions of parents who sent kids back today. I think President Biden outlined it nicely last week. Its three basic elements. Number one is spot on. Its about masks. Masks should not be political. Masks are not dangerous. Masks help contain the spread. The second is vaccinating those who can be vaccinated. So high school and middle school kids, 12 to 17, we have to get a higher percentage of those kids vaccinated and the staff that is in contact with these beautiful kids each and every day, we have to be sure that vaccination is permeaing that environment. The cdc showed those areas where the community has the lowest rate of vaccine has the highest percentage of kids seeking care in the Emergency Department for covid. The third is robust testing. I know testing has waxed and waned. But if we have a concentrated amount of kids, we have to test rapidly those unvaccinated or when theres a child thats symptomatic. So i think the president really nicely outlined if we can stick to these three things, we can do a better job at getting the adult community vaccinated and we can work towards, like we said, end of october, early november, for a kids vaccine. I think well see a nicer fall and winter. I know youre a doctor, but its not lost on you that the right went Bat Bleep crazy at the president s plan. It was laid out in the kindest terms possible for the unvaccinated who are most at risk. I think 11 times more at risk of dying than vaccinated people. At what point do you just throw up your hands and say weve done all we can do . Do we continue i mean its my sense that we rise or fall together. You read the stories of people who lost their struggles against covid and theyre devastating. There are heart breaking stories, this young couple leaving five orphans. I saw that. What do you say to someone in the room that says, no, i dont trust it. I just if you dont do it for yourself, lets go back to the data i just shared about kids. Childrens hospitals right now are flooded with patients. Its rsv, its covid and mental health. So childrens beds are so precious. Once again back to that data that shows a vaccinated community has a lower incidence of kids. If youre not going to vaccinate for you, youre not going to mask, do it for your kids.
