Im alicia menendez. We begin this sunday with the future of the president s build back better agenda. Because this week, expect movement in the senate. Committees expected to wrap the final drafts of a Budget Reconciliation Package that would expAnd medicare, kield care, And paid leave among other democratic priorities. The Washington Post frames the stakes, writing, quote, strategists in both parties believe democrats are likely to lose the house And possibly the senate next year. So this could be the partys only chance in years to enact an expansive domestic agenda. The finished product will become the clearest picture of what todays democrats stAnd for. Supplanting the countless speeches, platforms, And tenpoint plans they delivered when out of power. But the legislations 3. 5 trillion Price Tag remains a major sticking point. At least for West Virginia Senator Joe manchin. Hes calling for less spending And a, quote, strategic pause on the legislation. This is ant oneway negotiation. Youre in the captains seat. Youre the 50th Vote, but dont you need to give . I have been giving. Are you going to be the lone vote . I dont think i am the lone vote. I think you know that, too. Would you be willing to be the lone vote . If i cant go home And slain it, i Cant Vote for it. You cant explain it . According to new reporting from Nbc News, senate democrats are close to a deal on updaing voting Rights Legislation. Three democratic aides tell nbc this bill can get the support of all 50 democrats. It sounds like the first steps in what President Biden And former president george w. Bush asked from all americans during yesterdays 9 11 speeches. Calling on us to pull together And embrace unity. The unknown this hour, of course, if republicans are game. Will enough be willing to support passage of voting Rights Legislation . And can democrats unite amongst themselves to pass Andmark-legislation'>LAndmark Legislation to transform the lives of millions of americans. Joining me now, editor of msnbc daily, Hayes Brown, And sabrina rodriguez, a national political correspondent for politico. Friends, it is good city you both. Sabrina, i want to start with the democrats reconciliation package. Jim clyburn pushed back against senator Manchins Argument about scaling down the size of the bill. This is from this morning on msnbc. Take a listen. What are we doing about the medicaid recipients or the lackthereof in West Virginia . These are the things i think if we would focus on them, that is what will appeal to manchin. Not just arguing with him about the number, but focusing on the people in West Virginia that would benefit from the programs. And lets put the programs in place And apply the budget later. Sabrina, you heard manchin, you heard clyburn. You have manchin talking about the number, clyburn talking about the impact. Which dynamics are you watching for as progressives And Moderates Duke this out . I think, alicia, were at this point where we have been throughout this year of all eyes are on manchin. I mean, he dominates a lot of this conversation because he is that 50th Vote if were talking about reconciliation, whether its talking about immigration, whether its talking about including medicaid, medicare, any of the aspects of the spending bill. You know, the reality is that he needs to be onboard. Now, the question is, how heavily are they going to be lobbying him . I imagine very much from the White House, very much from his democratic colleagues. And seeing if anyone else is going to go Out On A Limb And say the same Things Manchin has been bold enough to say, you know, openly in the past month. Hayes, as sabrina is saying, i realize i really want a supercut of the number of times every conversation has come back to Joe Manchin. And i want to get your thoughts in the push from moderates to shrink the size of this spending plan. Because its clear what they are trying to do, so lets talk about the flip, which is how could reducing the scope of the package actually hurt democrats . By showing once again that democrats are not able to push forward legislation that actually helps people. One of the wildest things i have seen in polling recently, a poll in the last few weeks that asked, has your life been impacted by democrats And president joe bidens agenda . And the majority of people said no. People have already forgotten the massive amounts of spending And direct spending on them that was done through the Coronavirus Relief Package And Stimulus Bill earlier this year. So its rare its so crucial that democrats actually pass forward this bill. At the scope they were originally looking at. Whats interesting about manchin, his, oh, i want it down to maybe 1. 9 trillion, 1 trillion, is earlier this year, before we had the bipartisan deal in hAnd, he was calling for up to 4 Trillion in investment. Its wild if you go back And look And see how over the course of the year, manchin has been arguing with himself almost, reducing And reducing, And reducing the amount hes willing to support. Im very curious as to why that is, what he is seeing in his internal polling that says that, no, the people of West Virginia dont want this. He said repeatedly he cant go out And explain what theyre doing in the bill right now. And i have doubts about that. Like Representative Clyburn was saying, there is plenty in this bill that if you wanted to argue this is why were putting these investments into place, so that, for example, the Coal Mines that are running out of coal in West Virginia, so when those mines do shut down, And when people are moving off coal, there are good jobs available for West Virginians. Those are the arguments that the senator should be making, And its not clear to me right now why he isnt. Sabrina, i wonder, And its okay not to have an answer because i realize this is all developing as we speak. Do you have a sense from your sources on The Hill about what it is that is motivating manchin specifically this time around . Its a big Question Mark at this point because to the point were hearing from hayes, the reality is this is something he can justify And explain. Were talking about a 3. 5 trillion bill that has many incentives, many things you can sell to The American public. You know, especially in light of this pAndemic And the fact that we already saw that the previous bill had many pieces that helped The American public. So the question here is really what the motivation is, And i dont think its readily clear at this point. Right. Its one of the conversations were going to continue having. Of course, if were circling back, sabrina, to the question of Joe Manchin t means were also circling back to the question of the filibuster. You have no reporting from Rolling Stone that looks at President Bidens role. Biden assured Senate Majority Leader Chuck Schumer And House Speaker Nancy pelosi he was ready to push for Filibuster Reform. Bidens pressure would aim to help schumer convince moderate democrats to support a carveout to the filibuster, a must for the party if its going pass new voting restrictions without the votes. Biden told schumer, chuck, you tell me when you need me to start making phone calls. Sabrina, one, i wonder how that squares with your own reporting And your sense on how pressure from the White House could potentially move the needle here. I think the Number One thing to see here is the fact that biden has come to terms with the fact that Filibuster Reform is going to happen. I mean, we saw in his first Press Conference earlier this year that hesitance to call for reform, that hesitance to embrace reform that other democrats were already calling for. It shows he is moving in that direction. Now, i think its going to be interesting to see how it plays out to have these separate tracks of doing the Reconciliation Bill while talking about Filibuster Reform while figuring out how to get voting Rights Legislation. We know that the And-congress'>Capital And Congress is not great at getting multiple things done at once. So i think it will be very interesting to see if And how this played out at the same time this fall. Right. I mean, hayes, when i look at the new reporting we came on air with about the potential of new voting Rights Legislation And the potential hearing from aides of getting ten republicans onboard, im not sure whether the question is can you try to walk me through who those ten republicans are or if the question is what type of dilution is happening to the legislation that makes it palatable to such a broad swath of people. Right. Before we came on, i was trying to get to ten. I was trying my level best to figure out how far did you get, hayes . I got max five to seven, thats how many i could count, especially if you dont get mitch mcconnell. He understAnds that without this legislation, earlier in the show, you were talking about the fact democrats And other political aides on both sides of the Party Line are saying this probably the one chance democrats have to pass major sweeping domestic legislation. But that Calculus Changes if you pass a voting Rights Bill that prevents the gerrymAndering were going to be seeing from the states, that makes it more likely that republicans are able to take back the house next year. There are estimates that republicans will be able to take back the house just based on gerrymAndered districts alone within the next year. So if you get this bill over the line or some sort of bill that protects Voting Rights, that dilutes the ability of states to gerrymAnder, that makes it more likely democrats are able to retain power, And republicans know that. Mitch Mb Connell knows that. Thats why hes so against these sets of bills when in the past he has been all for changing up And procuring votes. After the 2000 election, he was one of the main sponsors of the most recent federal Voting Rights rather Election Legislation that passed. So he knows how important this bill is, And thats why he is marshaling republicans not to support any version of it. At most, i see five to seven. That doesnt get you past the filibuster. Sabrina, if you have counted in your own mind past five or seven, i want to hear about it. And i want to ask you, because democrats are waiting on whether a pathway to citizenship for daca recipients could be added to the spending bill. Your sense of when well hear on that And how the biden administration is making the argument this would help poost our postpAndemic economy . First, hayes is ahead of me because i couldnt Count Past probably five. Okay. Appreciate the honesty. On the pathway to citizenship, i mean, this week, we may see a decision from the senate parliamentarian. Theres two questions. One, whether she is going to say that a Pathway To Legal Status is something that can be part of the reconciliation package, And in the event she says no, what are democrats going to do about it . Behind the scenes, theyre not publicly talking about it too much, about what the plan is, but they do have a plan b, c, And d as one congressman said to me. If she comes back saying she doesnt agree And the guidance is that it should not be part of it, they do have plans to appeal it, to go back to her, to give other justifications. At this point, its democrats only opportunity to pass a pathway to citizenship, one of bidens big campaign promises, before the next election. Thats what were seeing right now. But in terms of, you know, the economic argument, i mean, they have decided a lot, theres the center for american Progress Report that shows 1. 5 trillion dollar economic impact to gdp. Sabrina, i think i lost you, but luckily, you were with me at the break so well work on getting you back. Hayes is sticking around too. Next too, say that the gop is upset over Bidens Vaccine mAndates would be an understatement, but new data shows that plans like President Bidens actually work. Friday, florida governor Ron Desantis joined the chorus of republican governors alleging President Bidens Andate'>Vaccine MAndate is, quote, not based in science. But as The New York Times notes, data from two federal departments that already have mAndates in place are seeing more shots in arms, which is the goal here. At the pentagon, vaccinations among active duty Military Personnel up 7 from last month. At the department of veterans affairs, the Vaccination Rate went up 5 in less than two months. Back with me, Hayes Brown And sabrina rodriguez. Hayes, i understAnd that what republicans are trying to do here is make these mAndates a referendum on the entire Biden Presidency that just doesnt totally make sense when a majority of americans support these type of mAndates. So is it then not about appealing to the majority but just appealing to a small angry minority . Absolutely. Thats been the case for the majority of the republicans aurlt about vaccines ever since biden took office. They have been catering to a very small portion of the population, And specifically inside their base. Over 75 of americans who are eligible, adult americans, are vaccinated at this point. I mean, the losing side is the antivaxx side at this point. The fact theyre continually playing to this group is really all about primary race politics. You know, theyre looking at the midterms, looking at the 2024 president ial election And saying, these are my people. These are the ones who are going to support me when i am running for office next. So to make sure that someone who is also saying these things doesnt beat me And keep me from keeping office. Thats just no way to govern. I mean, the fact that they are making this argument, this too cute by half my body my Choice Argument about vaccinations And Andate'>Vaccine MAndates is just an attempt to really piss off the libs, honestly, And throw the Red Meat to the base. Sabrina, we just hit a record 41 Million new covid cases la night, according to an Nbc News tally, in Ron Desantis Home State, which happens to be your Home State. Child covid deaths more than doubled as kids went back to school. Aside from those who are going to support someone like desantis no matter what, doesnt the majority believe that science is real . And in the long term, right, if not 2022, if not 2024, isnt that going to come to hurt these gop politicians . I mean, the reality is when were looking at desantis case, for example, And as you mention my Home State, so i get to live this on a daily basis, but looking at desantis, for example, hes banking on being vindicated in the way he felt he was in 2020. You know, we saw at the beginning of 2020, all the talk of the florida cases, And then later on, there were all the stories And opeds And kind of narrative around, oh, look at how florida is doing. Now florida is much better. Oh, look, Ron Desantis was right, or you know, he won the pAndemic. I have to Air Quotes that. But the reality is i think hes partially banking on that. And hes partially banking on the fact that hes creating a foil with biden. You know, we have talked plenty about whether he has 2024 aspirations if trump were to not run. We see the republican party, whether trump runs or not, whether desantis runs or not, this is an audience of one. And desantis is looking to appease trump And appease that base that has helped propel him, And he hopes Will Help propel him to win reelection. Hayes, i want you to listen to what Nebraska Governor Pete Ricketts said today to chris wallace. Take a listen. If the Polio Vaccine is okay for parents And they have to comply with it to send their kid to school, why not for a lot of people, not just kids, the vaccine for this disease . Yeah, And i think this is very different from polio that has very devastating effects. Really, children are no more at risk for the coronavirus than they are for the ordinary flu. Okay, so you take that take, hayes, And you juxtapose it, while the flu is well hao understood, the cause of the virus is known for only two years. Its not known if theyll create lasting developments related to the virus. And most kids who die from the flu are unvaccinated. So where is the disconnect here . Disconnect is, again, it goes back to politics. Really sad to have heard that, really sad to listen to that. That idea that because of the political situation, that you are advocating for people to be less safe, for people to be less protected. I mean, the fact that were still in late 2021 hearing the argument, its just like the flu, is baffling to me. Its like the flu if you are vaccinated And happen to catch a Breakthrough Case or the delta variant, And it will feel bad And terrible And youre les likely to be hospitalized or die. And the fact that they are pushing this idea that having a mAndate to protect kids who cannot get vaccinated yet, especially, that they are saying no, this is an overreach, this is something that is weird And wrong, the flu doesnt mutate in ways as quickly as the coronavirus that make it more deadly on a monthly basis at this point. Not only yearly. I mean, the number of things wrong with what rickets said there could take up the rest of your program. Sabrina, i want to pick up on something hayes said in his more expansive analysis, And that was about this sort of my body my Choice Language were hearing in two very different contexts. After signing into law what is now the most egregious Abortion Law in the country, Texas Governor Greg abbott tweeted about, quote, hes protecting their right to choose whether they get the vaccine, but most women lost the right to get an abortion in his state. Talk about how someone like Greg Abbott is trying to play both sides of this Freedom Of Choice issue. I mean, its you hear it in the phrase. I mean, my body my choice. And the fact that for years, it has been from, you know, the Andpoint'>Abortion StAndpoint to now hear it from this vaccine, theres a complete disconnect. Were seeing texas again And again on these issues choose to be on arguably the wrong side when we talk about science, when we talk in that aspect. And i think something that hasnt been talked about this week, for example, And last week, the week of the news about Texas Abortion Ban was the same week we saw mexico decriminalizing abortion. I mean, one of the second largest catholic countries in the world is decriminalizing abortion, And then we have the united states pushing to make it harder to get an abortion. I mean, we just know this is not the direction that the united states was heading in, And hes pushing back against that for now, at least. Hayes, i want to talk about one more thing before i let the two of you go, which is you wrote this week for msnbc. Com the fight over the Debt Ceiling is looming, just to add to our list of things looming. Republicans warning they wont support another boost despite looking the other way when former President Trump raised it. How do you see this playing out, hayes . I mean, i think that democrats on The Hill And the White House, they think that republicans are going to blink. That theyre not going to tank any sort of bill that the Debt Ceiling is attached to. They think that theres no use actually negotiating over this. I hope that theyre right. I really do believe that theres not going to be enough of a Hub Bub this time around that republicans actively work to kill any legislation that has the Debt Ceiling raise attached to it. I think there will be a lot of And-fury'>Sound And Fury over it in the next couple weeks, that theyre going to be talking about how this is just trying to pay for the biden spending agenda, even though raising the Debt Ceiling, i want to point out, is not about new spending. Its making Sure America can pay for the things we have already borrowed And spent money on And continue to keep borrowing to pay for those things. So were going to hear a lot of misinformation from a lot of republicans about what raising the Debt Ceiling means over the next few weeks, but i think theyll pass it. Theyre not going to risk Americas Credit Rating dropping like it did in 2013. Sabrina, hayes, im impressed you continue to prognosticate given what we have watched in the last few weeks And months. Show more of you. 20 years after september 11th, the fbi released new declassified documents overnight on the terror attacks. The first of many documents expected to go public in the coming months after President Biden declassified them last week. Documents came out over night including a report from 2016 detailing the Fbis Work to investigate the role of the saudi government in the attacks. The report did not find any evidence that saudi leaders were directly involved but did state that saudi nationals play a pivotal role in funding al qaeda. With me now, congresswoman Barbara Lee from california. Talk me through the significance of these documents being released to the public And why it took so long. Well, i think, first of all, the significance is very important to recognize. President biden made the decision to do this, And secondly, the families And the communities so badly impacted by these horrific attacks, they deserve this. They need this. They need to know what happened. Theres more to come. I know the reports And i have not read the entire report, but its heavily redacted. I think its really bringing forth the truth of what took place. Not sure why it took 20 years but i do know the families, the friends, those who perished, their communities And their Family Members need to know exactly what took place. This is just the beginning. I hope that this brings some closure because we know how much people have mourned And grieved the loss of life, And my condolences continue to go out to everyone because 20 years, even though it seems like a long time, people are still in a lot of pain as a result of 9 11. Absolutely. I want to pick up on something you said, the fbi expected to release more documents in the coming months. Your sense of what we should expect from those documents . Its hard to say because you dont know what has been actually not revealed. You dont know whats classified. You dont know where this is going. But i think the important part is that the president did make this decision to do this. And im confident that whatever the fbi releases, its going to be part of the truth as it relates to what happened, because we still dont know the entire story. And we have to know because this is something that is as horrific a moment in our Nations History that will never really quite frankly get over. Well move forward, but we will always have to remember what took place. And so also, we must know what to do And how to prepare And what our Counterterrorism Measures must be And what tools we have to make sure that nothing like this ever happens again. So im confident that the fbi is going to put forth the facts of what took place. I want to turn, congresswoman, to texas, which effectively banned abortions. Allowed private citizens to sue abortion providers. Are you confident the Justice Department is going to prevail in its lawsuit against the Abortion Ban . And what more do you think can be done . Well, let me say, first, this ban, it denies first of all, women, especially women of color, lowincome women, but all Women Access to the full range of Reproductive Health Services which the constitution requires. Thats including abortion. Secondly, its so important that we pass the Womens Health Protection act to actually put into federal Law Roe v. Wade in essence, because this is really a decision that could cost women their lives. Its a decision that is going to take us back to the days of back alley abortions. I remember that very well. And many women remember those days. Women died. And so we have to fight on all fronts. Im very pleased that the Justice Department is filing, is moving forward with the lawsuit. They have filed it. And this is going to take an all of government, all of the Countrys Response to make sure that women have control over their bodies, over their lives. And this Texas Decision puts them at the mercy of vigilantes And those seeking bounties And those trying to make Money Off of turning in women who are trying to exercise the control over their bodies that they so deserve. So to your point about fighting this on all fronts, over 480 public health professionals are calling for the fda to approve over the counter oral contraception in an open letter, they wrote, the evidence of the benefits of over the Counter Availability is strong. And the public health And medical community urges the fda to follow the science And approve an over the counter oral contraceptive. Congresswoman, when we talk about the Role Congress can play in pushing back against limits to reproductive access And care, what role do you see congress playing in actively expAnding access, including something like access to over the counter contraceptives . Sure, And were asking the fda to approve over the counter contraceptives because we have to make contraception accessible, affordable, And equal access for everyone who wants And needs contraception. Its amazing to me that those who fight against the womens right to control her own Body Fight against also not only abortion but also contraception. Its disgusting, quite frankly. We have to push to make sure the fda approves these over the counter contraceptions so theyll be accessible to all women. Finally, i have a bill calling for comprehensive Sex Education. The real access for youth act. We still dont have access, our young people, to Sex Education in schools to help young people understAnd how to prevent unwanted pregnancies, how to prevent sexually transmitted diseases. And how to really stay healthy, And so we have to have the Government Step up And put resources in to schools to be able to teach our young people how to prevent unwanted pregnancies And what the full range of reproductive Health Freedom really means for people around our country. So it is an all of government response, And we have to do this. We have to make sure that peoples lives are protected And that we fight against the very rightwing dangerous Court Decisions that are coming forward now. All right. Calling tuesdays election, quote, a matter of life And death. As of this evening, polling looks promising for newsom. 60 of likely voters said they would be voting no for the recall. As Election Day approaches, the numbers are increasingly breaking in favor of Governor Newsom, though not so much that theyre telling the White House never mind about the Lastminute Campaign Appearance by President Biden. Hes still scheduled to be in Long Beach with the governor on monday. But the latest numbers from the l. A. Times And Uc Berkeley Poll show more than 60 of likely voters oppose recalling Governor Newsom. Remember that the dynamic going into this was that the republicans, what they lacked in numbers in california, they would make up for in enthusiasm, their desire to oust a sitting governor, And that democrats werent as into this election as the republicans were, leaving the democrats at the losing end of a socalled enthusiasm gap. In the end, it doesnt look like thats happening. Independents are actually turning out at a lower clip than both republicans or democrats. And democrats are outpacing republicans. You know, 2 to 1 in overall turnout, And by a few percentage points as a percentage of their number of people in the party in the state. So you just have what seems to be more democrat enthusiasm. Paul wes caught of the nonpartisan Analysis Firm has been looking at county returns of mailin ballots. Every californians got a mailin ballot. He found roughly 2 to 1, democrats outnumber republicans. Of course, republicans could make up some of that ground in turnout leading up to Election Day And on Election Day itself. Meantime, the republicans are not giving up. Larry elder is the leading republican challenger, the Radio Talk Show host, And hes taking a page from the Trump Playbook And talking about socalled shenanigans. Voter fraud in this election, And saying he has lawyers at the ready. The democrats meanwhile say they have lawyers, too, And it seems the way this dynamic is going, everything that Larry Elder says gives Governor Newsom something more to run against. Its just an extension of the Big Lie And the steal. Stop the steal. I mean, its just a remarkable thing. Four days out, Election Hasnt even happened And theyre all feigning election fraud. And i think its important to highlight that because i have been making this point. Whats going on in this country is frustrating. So if this pattern holds And becomes a game of managing expectations, leading up to Election Day And beyond, And looking ahead to the regular Gubernatorial Election next november. But i do feel its important to say that polls aside, its critical that people get out And vote. People on all sides of it. But you know, i often tell the story that every time i ran statewide in california four times, my pollsters said i cant call it for sure, if its a big turnout, you win. If its a small turnout, you lose. And if its somewhere in the middle, we dont know. So people have to get out And vote. And you know, i have to say, i think that the Newsom Campaign hAndled it well. There is no other prominent democrat on the ballot. So it is newsom versus Larry Elder, who is running away with it on the republican side. And Larry Elder is really trump on steroids. And thats not my state. To that point, i actually have some sound from Larry Elder. This is last week, this is him on the upcoming election. Take a listen. The 2020 election in my opinion was full of shenanigans, And my fear is theyre going to try this in this election in recall. Im urging people to go to electelder. Com. When you hear or see something suspicious, report it. To your point, playing by the Trump Rulebook there, calling out fraud without any proof, because there is no proof because there is no fraud. Calling on citizens to report fraud. Is this then the future of republican Andidates-strategy'>CAndidates Strategy across the board . Is that what were watching here . I think their strategy is first And foremost, suppress the vote. And if they dont succeed on that, And they dont win, claim the thing was rigged. Its important to remind everyone that the trump administrations people who were in charge of fair elections said the 2020 election was one of the cleanest ever. So this is baloney. You know, i lost one race out of the 12 i ran. Okay, it was my first race. How nice it would have been for me to say, oh, im sure i actually won. I mean, it would have made me feel great, but guess what, i lost. And i had to shape up. I had to be more humble, i had to know my issues better. I had to be a better cAndidate. You have seen so many races. Theres a winner And a loser. Stop crying about it. I would say to my republican friends, And i want to say that when i served in the senate, i never would have gotten anything done without some of them stepping up for me. So i know we can do it. If they would just do what the people want, they would have a better chance in california. But you know, theyre science deniers. All we have to do is look at texas And florida to see those governors just literally moving away from policies that would save childrens lives. We dont want that here. We want science to prevail there as well as climate. We want women to have rights. Larry elder says women dont understAnd politics as well as men. Im sure he would say women dont understAnd the news either. So you know, whos going to vote for that . I do want to ask you, because you talked about texas And access to safe abortions which we have now seen nearly impossible in that state. You have said plainly, Those Seeking Abortion will die. What do lawmakers do now to help people in texas, in states that are trying to replicate bills like this . Well, first of all, its very important that merrick garlAnd, our attorney general, has stated he is going to move in And he is going to make sure women cannot be denied their constitutional right. This roe v. Wade said that, yes, there was a right to privacy, And were going to make sure that women have it. So its very important. And whatever it takes, i was involved many years ago in the face act, which protects women or anybody seeking Health Care that they cant be harassed as they go about it. So that bill, which was authored by Ted Kennedy at the time, was very bipartisan. Its an important bill because if you set up a bunch of, you know, vigilantes, people who are going to rat on their neighbors, you know, thats interfering with this choice. Interfering. So i think thats critical. Of course at the end of the day, i want to see roe v. Wade become the law of the lAnd but again, taking it back, i think theres a nexus here. Should make this decision And it is an underlying issue in this race because people are so upset about texas so theyre comparing texas to california And theyre choosing our governor. I do want to ask you before i let you go to that point about about Justice Brier was speaking about his Retirement Decision on fox news. I dont need to die on the court, i dont think ill be there forever, but ive set a few considerations previously on my factors. Quite a few.
