20 years ago i was a senior at the University Of Miami getting into the shower. I remember complaining about how tabloid the Today Show was that day, wishing for something more substantive. I got out of the shower, turned up the tv, and the North Tower of the World Trade Center was on fire. What were you are doing when you heard the news . Would you recognize who you were then or the country we lived in . And what have we gained after 20 years of war . What have we lost . Are we safer now than we were then . People have been asking those questions throughout the day, taking perspective on this 20th Anniversary of the September 11th attacks. Memorial ceremonies took place across the country today. It was a chance for Family Members to honor their Loved Ones and for the nation to honor its promise to never forget. Today President Biden visited the sites of all three memorials. He started in Lower Manhattan alongside former president s clinton and obama. He joined a Wreathlaying Ceremony at the pentagon. At his side, jill biden, kamala harris, and second gentleman doug emhoff. And then pennsylvania where United Flight 93 crashed. Former President Bush spoke there this morning. We have seen growing evidence that the dangers to our country can come not only across borders, but from violence that gathers within. So much of our politics has become a naked appeal to anger, fear, and resentment. That leaves us worried about our nation and our future together. Its no accident President Bush chose this day to highlight the threat of domestic extremism. He not to the unity that many americans felt after the towers fell. Contrast that with the discord over Americas Response to the pandemic. According to cdc data yesterday, nearly 1,900 people died of covid19. On thursday, more than 1,700 people died. Reversing this trend is the primary goal of the new national Vaccine Requirements that the president announced on thursday. This is a pandemic of the unvaccinated. And its caused by the fact that despite america having unprecedented and successful vaccination program, despite the fact that for almost five months, three vaccines have been available in 80,000 different locations, we still have nearly 80 Million americans who have failed to get the shot. The new rules require all federal employees and contractors to be vaccinated. Also, private companies with more than 100 employees must require vaccinations or weekly testing. And employees of Health Care facilities that accept Medicare And Medicaid must also get the shot. In response to this plan, a handful of republican governors have threatened to sue. The president s response . Have at it. Look, i am so disappointed that particularly some republican governors have been so cavalier with the health of these kids, so cavalier with the health of their communities. This is this is were playing for real here. This isnt a game. If you or someone you know is not vaccinated yet, its not too late. The data continue to show that the vaccines are safe and effective, and according to cdc data, Unvaccinated Americans are 11 times more likely to die from the virus. 11 times. Hes a democrat on the Oversight Committee and coronavirus subcommittee. His district includes elgin, schaumburg, and chicagos western suburbs. Congressman krishnamoorthi, good evening. Good evening. Can i start with your thoughts on today, how you spent today, what your reflections are after the ceremonies 20 years after 9 11 . Thank you, joshua. I actually started the day with a Remembrance Ceremony here in schaumburg, illinois. It was a beautiful ceremony. And we remembered the fallen as well as the heroes who selflessly sacrificed themselves to save others. And what i said that they did was they demonstrated the 9 11 spirit. They showed courage in the face of evil, resilience in the face of tragedy, and unity above all. And i believe that today we have to summon that spirit to confront the challenges facing our country now as well, and that would, you know, be the best tribute to the memory of those heroes of 9 11. As we take a live look at Lower Manhattan at the site of the national 9 11 memorial and museum, which, for those of you who have never been, please do go. I made my first visit there yesterday. It was absolutely worth the time, worth seeing. Even on this evening where were talking about unity here in the country, and you can see the empire state building, one of the land marks around New York that is lit up blue tonight. We also have to deal come the new week with the politics of washington, including the Vaccine Requirements which have already drawn a pretty strong response. Congressman, Id Leak your thoughts on what the president said when he announced the Vaccine Requirements, just the frustration in his voice. Watch. Over 200 Million americans have gotten at least one shot. Weve been patient, but our patience is wearing thin. And your refusal has cost all of us. I wonder how you look, congressman, at this idea of unity through the lens of this divisive issue. I would hate to think that what were thinking about and feeling today on 9 11 vanishes with The Dawn tomorrow, that none of it carries over into what we do next. Well, id like to think this 9 11 spirit carries into the discussion about covid. Look, we have to come together as a country to deal with this issue, as you know. Its not just regional or local in scope. Its national. And thats why those 25 of americans who are not vaccinated pose a threat not only to themselves, but to the rest of the country. We cannot go back to a lockdown of schools or businesses. We have to keep both open. And the only way to do that, given the fact that the vast vast majority of people who are hospitalized are unvaccinated people is to get people vaccinated right now. What do you make of the opposition to the plan . I mean, this could go down who knows, but i think some republican governors believe that this would go down the same way as the cdcs evokes moratorium, that they would be able to make the case that this is an administrative overreach, an overreach by the administration, that this is not the right way around it even though im sure these governors would say they dont want the pandemic to last any longer than it has to. What about the possibility that this might go that same way . I dont think its going to go that way. First of all, i think this is a rather cynical move on the part of these governors. I think privately a lot of them are probably glad the president mandated these vaccines because, as you know, covid is raging in their states, and they just have the courage or the conviction right now to encourage people to get vaccinated or to mandate it. And so its easy for them to have the president do this and blame him at the same time. As far as the merits of their case, i think its going to be very flimsy because this is a public Health Emergency on a national scope. And so the courts routinelily side with the president exercising his powers to protect the nation and the public in this type of situation. How much do you think that this 9 11 spirit will extend to your colleagues on Capitol Hill when they come back this september . Theres a lot to do. The bipartisan infrastructure plan, hurricane relief, afghan resettlement funds, paying to fund the united states government, whats your sense of how thats going to go . I would like to think the 9 11 spirit will carry into the rest of september, but of course we run up against the ghost of trump. And unfortunately, although Donald Trump is no longer president , he casts a long shadow over congress, especially the republican caucus in the house. But really, its up to them to decide do they please Donald Trump and say no to almost every reasonable measure put forward by democrats to deal with covid or the economy . Or do they please their constituents who want upgraded infrastructure, who want all the other measures that the president is currently seeking in congress . I hope they choose wise. I are you confident they can be convinced that the way we pay for it is acceptable to their constituents. Thats one of the big stated concerns is how we pay for it all. Just give you one example. You know, one of the things that makes my constituents, republicans and democrats, absolutely furious is the fact that, you know, 75 of the Fortune 500 companies out there dont pay anything in taxes. And, you know, to say that setting a minimum Tax Level for these corporations would somehow be unreasonable would really fly in the face of what their constituents would want. There are other similar tax measures such as that, which i think are reasonable, which the american people want and would accept, especially when they know what theyre getting in return, weather its universal prek or whether its upgraded infrastructure. Defense Secretary Lloyd Austin spoke today at the pentagon in a ceremony remembering the attacks of 9 11. 125 people died when flight 77 crashed into the West Wall of the complex. Those attacks prompted the War In Afghanistan. By december of 2001, the taliban had fallen. 20 years later, the u. S. Military completed its withdrawal from the country, and this week the taliban announced the formation of an interim government. The new cabinet is entirely male, some of its members are senior taliban figures notorious for attacks on u. S. Forces. What started out as a dramatic Military Campaign ended as something of a mess. But it was messy from the start in a number of ways. What does that tell us about what american Military Power can achieve . And what it cannot . Joining us now are Craig Whit lock, investigative reporter for the Washington Post. His excellent new book is called the afghanistan papers a secret history of the war. Jeremy surrey is a professor of history and Public Affairs at the university of texas at austin. Good to have both of you with us. Craig, if i might start with you, there is a ton in this book worth digging into, comes from a lot of public documents, including one the Washington Post sued to make public for years and finally did. Theres one quote in The Book Where You Quote Todd Green Tree a foreign Service Officer who highlighted an example of our ignorance of the country. You write in part, quote, one of the unfortunate errors this is quoting him one of the unfortunate errors was in our eagerness to get revenge. When one side wins, the other side puts down their arms and reconciles with the side that one. This is what the taliban wanted to do, he said in a diplomatic Oral History interview. Our insistence on hunting them down was what provoked the rise of the insurgency more than anything else. Sounds like we could have ended this war, like, 20 years ago. We thought we had tended War Back in the spring of 2002. The taliban was removed from power and Al Qaedas leaders had all been captured, killed, or fled afghanistan. So we thought the war was over. And the mistake we made is we thought the taliban had been vanquished, in fact, they hadnt. Unlike Al Qaeda, they were very much part of the afghan society. While they had gone back to the hills and back to their villages, they werent destroyed or eliminated. There was an opportunity in those early months to try and bring the taliban back into the political system that we were helping to set up, this new government, new constitution of afghanistan. But the Bush Administration at that point put the taliban in the same category as Al Qaeda and called them terrorist and said we dont negotiate with terrorists. Members of the taliban have two choices. They can surrender or die. And retrospect, that was clearly the biggest mistake in the early years of the war that we essentially wrote off the taliban saying they couldnt become part of the afghan political system, we couldnt negotiate with them. Now, of course in recent years, thats exactly what weve tried to do, but by then the taliban has grown stronger and could dictate terms a lot more than they could have 20 years ago. Professor, i wonder in light of the trauma we all collectively felt after 9 11, how we might have gone about that a different way. You had an oped in the New York times where you recently wrote, quote, history is clear, we would be better off with more modest, restrained military and strategic goals. You go on to write, quote, the War In Afghanistan is much more than a failed intervention. It is stark evidence of how counterproductive global Military Dominance is to american interests. Global Military Dominance as a counterproductive thing . That almost feels heretical. If you read my email, it is very much in the eyes of the people. American global dominance has produced more problems in the united states than benefits. It has gotten us involved in wars and as craig said, its also created unreasonable expectations, believing we could go into a country like afghanistan and dictate the solutions on the ground with a minimal force because our force is so strong. Its hard to imagine our negotiating effectively with the Taliban In November of 2001. But we would have been more likely to do it if we didnt believe we had overwhelming Military Dominance, which in The End proved unsatisfying and unsuccessful for our aims. One of the other aspects of this is not just our military errors, but craig, you wrote it about the war expands through the bush, obama, and trump presidencies. You talk about the way the Obama Administration spent money. In part you write, quote, since the 2001 invasion, the united states had fueled the corruption by dispensing vast sums of money to protect and rebuild afghanistan with no regard for the consequences. Limitless opportunities for Bribery And Fraud arose because u. S. Spending on Aid And Defense contracts far exceeded what indigent afghanistan could digest. The basic assumption was that corruption is an afghan problem and we are a solution, the State Department Adviser said, but there is one ingredient for corruption, money, and they were The Ones who had the money. Craig, one of the things that comes up in this book over and over from the beginning is that we thought we could just solve the problem through an american lens instead of through an afghan lens and understand what we were actually dealing with on the ground and these are the results. Thats right. One of the huge ironies is they all promised the american people we would not engage in nationbuilding in afghanistan. Nationbuilding has has had this negative connotation politically and rebuilding a devastating country halfway Around The World. In fact, all three of them tried to engage in nationbuilding and The One who spent the most was obama. Part of his strategy revolved around the idea that the more we spend in afghanistan to build up their Government And Army and schools and roads and clinics, the more we could stabilize it. But again, as the passages from the Book Point out, we spent so much Money Throughthrough so much at afghanistan that we caused more problems than we were solving by creating corruption and sending more money there than they could possibly absorb. Craig, the way you describe afghanistan in this book, it almost makes it feel like its a nation in name only. Like, some of the institutions that we have, some of the Literacy Level you need to be a member of a Government Institution or a sense of an ability to pounce or recognize colors or to understand tides or to not sell the gun we gave you for extra money because you need it to be a soldier, all those things were fungible depending on who you were dealing with in the afghan defense forces or in the national police, which is staggering. It is. I mean, i think the best way to describe afghanistan is its a broken country and has been for 40 years. Even before the soviets invaded in 1979, this was a very poor country. But since then its been at war continually up till now. You know, i certainly think afghans have a sense of national pride and nationalism. They see themselves as a country, but this is a country that has needed help. But a lot of times the help its gotten has been counterproductive. Theres no question that when we invaded in 2001 and toppled the taliban, afghanistan needed international help very, very badly. It needed help setting up a new government. People hadnt been able to go to school there for years. There were millions of refugees. There was real fear of a famine. So they needed help but we were reluctant to do it and then we did it in ways that we thought would benefit us instead of trying to figure out what would benefit afghanistan the most. Professor, i wonder what your outlook is on where we go from here. There was a column about president Bidens Speech and it noted in part, quote, gone was the sweeping post9 11 weve seen from both republicans and democrats about remaking the muslim world , what biden presented was an acknowledgment of the limits of american power. Now, on one hand i understand because were not fighting like in World War ii. Go beat up the bad guys and come home. This is clearly a different kind of War And Weve known for years the american people are, like, are we done yet . President trump spoke to that, President Biden pulled the troops out. What is your sense of whether were learning the lessons of history going forward regardless of what afghanistan turns into from here . Its a great question. One of the things ive been writing about and researching are the alternative military traditions in our past. We have many military traditions beyond the efforts to dominate the global landscape, one of them involves actually interdiction of Bad Behavior by criminal or terrorist entities. A Counterterrorism Strategy which is what the president spoke about would require having some force in the region, minimal force in the region that could be used to try to stop the Organization Or Planning or execution of terrorist activities. Theres also a multilateral alternative where you have to remember that after 9 11 the united states went in a very unilateral direction. We had a president who said you were with us or against us. Thats not how you would conduct multilateral operations. We have a lot of longtime relationships in this region, in Central Asia and the middle east. We should be drawing on those relationships to manage our Security Interests in the region more than trying to do it alone. One of the problems with having an overly large military is youre impatient and you seek to do everything yourself. Its not that we spent too much money, its that we spent money the wrong way and try to do everything ourselves rather than working with others and sticking to our national interests. I hope were working beyond that now. What is your sense of where Al Qaeda is now . We just got a Video Today that had been released that criticizes the recent Peace Deals between israel and arab countries, a video from Al Qaeda. Its unclear the time this was put out or any of the other identifying details of the video. But another video came out today. What is our sense of where Al Qaeda stands now 20 years after 9 11 before we go . That video featured an egyptian who was bin Ladens Number one two. More than anything, its his way of staying were still here. Al qaeda has changed over the years. Theyve metastasized and really inspired Affiliate Groups who share their ideology. The original Core Group has been hollowed out, but they inspired groups in north africa, the middle east, afghanistan, and even followers in europe and the united states. Thats the situation we have to figure out how to we effectively counter that rather than using drones or military tactics. We need to think a little more smartly about it. The Department Of Justice filed a civil suit challenging texas over its controversial new Abortion Law. Attorney general Merrick Garland argued that the law is unconstitutional and described it as a statutory scheme. Last week the Supreme Court declined to issue an injunction against this law, sb 8. Its also known as the texas heartbreak act. Justice Stephen Breyer called that decision, quote, very, very, very wrong. That ruling was not on the constitutionality of the law. It allowed the law to stand while the legal battles around it continued. Sb 8 is unique. Its designed to keep enforcement out of the hands of government officials. Instead, it sets up a bounty system. Private citizens can sue anyone involved in providing an abortion after six weeks of pregnancy. The bounty would be worth up to 10,000. This raises big questions over the future of abortion rights, especially as the Supreme Court is set to hear a pivotal case on the future of roe v. Wade in the fall term. Joining us now is melissa murray, a professor of law at nyu and an msnbc legal analyst. Professor murray, let me start with your sense of whether or not the doj has a case with your reactions to these remarks from attorney general Merrick Garland. Watch. The obvious and expressly acknowledged intention of this statutory scheme is to prevent women from exercising their constitutional rights. This kind of Scheme To Nullify Constitution Of The United States is one that all americans, whatever their politics or party, should fear. If it prevails, it may become a model for action in other areas by other states and with respect to other constitutional rights and educational precedence. Professor, what do you think of the Dojs Case . Do they have an argument . The doj certainly has strong case on the merits, but the real question is can they first get into court on those procedural issues . Its notable that the united states can sue another sovereign state like texas. Texas doesnt have any sovereign immunity from that suit. So that gets around one aspect of this. The Doj Suit can arguably get to those legal actors in texas, like the judges and the county clerks who are charged with processing these lawsuits as they come in but raises a question to the private citizens. I think theres still very much a question of whether the Doj Suit can actually enjoin the entire universe of those plaintiffs going forward. And there may also be questions about whether the united states has suffered an injury sufficient to confer jurisdiction. You said if a barista at a Coffee Shop overhears someone talking about an abortion that took place in texas, that potential they could sue the clinic and get a bounty. I did say that. I want to be clear here. Texas knows that this law on its face is patently unconstitutional. The private Enforcement Scheme is ultimately about avoiding federal Court Review and, more importantly, avoiding a federal Court Injunction that would prevent this law from going into effect. Texas knows the Name Of The Game here is to get this law on the ground and enforced in texas so that the clinics will close. Because if the clinics close, even if this law is later found unconstitutional, those clinics are not likely to reopen in the future. So the Name Of The Game in all of these abortion challenges is preventing the law from going into effect, and thats exactly what texas has done. Its a Fiendishly Clever Scheme that was bedeviled advocates trying to fight it. This goes beyond texas. Theres also an Abortion Law in South Carolina that 20 states have gotten together to kind of target and challenge. Tell us more about that legislation and how perhaps it differs from what were seeing in texas. Well, it is a variation on the kind of Heartbreak Laws were seeing in texas and in mississippi. Theres a challenge in the Supreme Court to a mississippi heartbreak bill, but this requires physicians to perform an ultrasound in advance of an abortion. If any Cardiac Activity is detected, the abortion cannot be performed unless it was caused by rape, incest, or where the pregnant Persons Life would be in danger. Again, the law which imposes this requirement of an ultrasound adds to the cost of an abortion and the idea is to make abortion more expensive, or alternatively, to allow the pregnant person to know the gestational age of the fetus. Theres a lot of debate in the medical community about whether or not that Cardiac Activity heard on the ultrasound is actually a fetal heartbreak because the fetal heart doesnt develop until nine weeks of pregnancy, although this Cardiac Activity can be heard as early as six weeks. Theres a lot of debate about these and whether theyre actually necessary. I wonder what your sense is of the future of roe v. Wade. Theres a case out of mississippi that the Supreme Court is going to take up. You used to clerk for justice sonia sotomayor, what is your expectation in terms of the future of this precedent . I think we know that we have a 63 conservative supermajority on this court with three justices who were put on the court by Donald Trump who vowed as a president ial candidate to appoint justices and justice who were hostile to abortion rights. And i think we saw in that earlier procedural decision that although the majority there did not weigh in on the substance of the merits claims, in allowing the Texas Law to go into effect, they did signal there is a deep skepticism on that court. These numbers prompted the World Health Organization to say we knew to focus on getting the whole world vaccinated. The Covid Variants emerged in countries with low Vaccination Rates. Until the global Vaccination Rate increases, we could see more mutations, including possibly variants that can get around our vaccines. Lets start with the situation in the u. S. Whats our best read so far on the impacts that President Bidens new plan might have . Look, we talked to a lot of sources inside administration working on the Covid19 Task Force and Health Agencies who say they view this as a major step forward for the administration. They believe this is sort of their best chance at getting large swaths of this country whove been holding out on the vaccine vaccinated. One of the biggest prongs of the strategy is calling on all Health Care facilities that receive federal funding, Health Care workers, and staff getting that vaccine. Of course theres already that call for federal workers. It also includes a prong that companies to implement mandates where companies over 100 people will have to get vaccinated or submit to regular testing. So, it is a step forward. I think there are some folks out there who believe that theres more the administration could be doing to push dates, for example, to to issue mandates in their own states. I think the concern for Health Officials right now is how many more people can we get vaccinated before we see another potential surge this fall with a new variant as you mentioned earlier that could potentially evade our vaccines, completely. Well, with regard to potential for a new surge, one of the concerns is trying to protect vulnerable populations like the elderly. I believe you had some new reporting about new cdc data in terms of the effectiveness on the vaccines in the elderly. Its capacity to prevent hospitalizations in the elderly seems to be decreasing . Thats right. So the cdc has put out a handful of studies over the last several weeks. Um, three of them came out on friday which really the numbers dont look good for people over the age of 65. And then, even more so over the age of 75 for waning immunity to the vaccine. And then, were also starting to see numbers tick up in terms of hospitalizations for individuals in this country who are age 75 and older. Vaccine immunity is waning in the younger age groups, as well. But it seems that the administration is trying to focus perhaps more on that elderly population which weve been worried about all along. And the plans for potential Booster Rollout are still quite hazy. We havent seen any real plan for that, yet. But we do think that, you know, those first Booster Shots at least will go to the immunocompromised and the elderly. What about the w. H. O. s concern in terms of vaccinating people Around The World . There is a gigantic dispayty Around The World, partly because wealthier countries like the u. S. And uk could just afford to buy a bunch of Vaccine Doses before they were ever made. We mentioned about a significant portion of the u. S. Population is vaccinated, at least partly. Only about 3 of africa is vaccinated. Meanwhile, we have more doses than we are administering and are actually throwing millions of Vaccine Doses away that just never end up in anybodys body. So i understand the complaint from the w. H. O. In terms of the need Around The World. But where does that go from here . Thats right. I mean, this is a huge problem for the biden administration. Its not just for the optics of it. There are officials in the top echelons of the administration who continue to believe that the u. S. Has enough supply to be able to give out Booster Shots this fall, and to donate millionsmore doses overseas to lower and middleincome countries. In fact, the administration has doled out tens of millions of those doses overseas but its just not enough. And there is more that the u. S. Could be doing. Part of the biggest problem right now is that the u. S. And other wealthy European Nations have eaten up the supply chain. Which means that theres not much room left in terms of Manufacturing And Production capacity for lowerandmiddleincome countries who are trying to receive buy their own doses or or get their doses through covax. And this has been a problem that we knew was going to come. Our Manufacturing Capacity worldwide. These kinds of vaccines is very, very minimal. Thankfully, there is some hopeful news in the fight against climate change. Iceland just opened the worlds largest carbon capture plant. It mixes carbon with water and pumps it underground where it turns into rock. The new plant can capture 4,000 Metric Tons of Carbon Dioxide per year. That is equal to the annual emissions of about 800 cars. Thats a pretty small slice of our carbon footprint. But the company that built it says the plant could capture far more in the future. A u. N.
