Now, as they are returning to school, the covid cases among kids are rising. In miamidade, florida, at least 13 School Employees have died since midaugust and all of Them Unvaccinated and all of them africanamericans and headlines like that are haunting the parents and School Administrators and why today, the Los Angeles Board of education is expected to vote of whether to require all students 12 and older to be fully vaccinated. Nbc news has learned that as part of the sixpoint plan, President Biden is expected to mandate the vaccinations for all federal employees and employees of contractors who do business with the federal government. We know that masking works. We know that et going everyone in your household eligible getting them vaccinated works. We know that getting teachers vaccinated works, and we know that having kids surrounded by vaccinated works. When he signs this Executive Order, they will have 75 days to get vaccinated or then they will face an Hr Process that could lead to progressive disciplinary action, and so in other words, they could lose their jobs if it is determined that they dont have an accept medical or religious reason for not getting these vaccinations. So what is so notable about this is that just in july, one of the options is that you could submit to rigorous testing if you didnt get the shots, but the White House is saying that pfizer at least has been given full fda approval, and because there is so much concern in the White House right now about the Delta Variant that the president wanted to use all of his executive Authority And Mandate this for as you point out millions of federal workers and the contractors and essentially anyone who does business with the u. S. Government, the White House has to comply with the standard. The other interesting part of all of this is that, geoff, we are talking about now fully vaccinated could mean having three doses once the new Booster Shots come into play, and is that what is it going to mean for the federal workers, and those are the details that we are asking and pressing the White House on, and that would change it as well, and right now, it is to get the two shots and dr. Fauci, himself, he believes it is going to have to be expanded to the threedose regimen, and that is what the president is going to announce. He is also going to lean on the private sector to model this mandate, because the White House knows it is something that they cannot do federally across the board within the government scope, geoff. So monica, i hear you say that federal workers will have 7 75 days to get those shots which is 2 1 2 months from now. And heidi, you have information about the president s plans for schools. What more can you tell us about that . Yes, geoff, congress gave states 10 Billion last spring in order to administer tests at every school, and the cdc said that the schools should do it, but as the schools are reopening, they are not doing it or not doing it right which is two rapid Antigen Tests per week, and so they are not testing the correct antigens or not at all. So he is going to double down on the states, and this is the money that we gave you and how we expect you have to be spending the money. The question at this hour is how he is going to be making it more feasible, because the doors have opened, and a lot of the experts say that the tests are not cheap and accessible the way they are in europe. As a matter of fact, we are shipping a lot of these cheaper tests that are not approved here by the fda over to the european, and particularly in the u. K. They are all subsidized by the government as to whether there is an additional step by the federal government to try and make these more affordable and accessible, geoff. I am actually outside of the school in arlington where with the case numbers rising and rising with last week, the cases of the children at the highest levels ever, and administrators are trying to take unique approaches to mitigating the spread, and here at Long Branch elementary, they have decided not to pack the kids into the cafeteria without masks. So they are letting them out, and doing the outdoor lunch, and in fact, every single school here in arlington county, they do have a plan for outdoor lunch. Surrounding counties are taking a look at it, and simple solution, and the administrators vague they did not have to pay money out of the relief fund, and they have parent volunteers and open the doors and let the kids sit in pods around here in the outside Atrium Area here, geoff. Heidi, you have been doing the extensive reporting of how School Districts are handling covid, and it is worthy goal of extensive testing of the kids, but how is it done, because School Districts dont have a nurse and they share nurse staff, and then in arlington, virginia, you are lucky if you can find a class that has less than 25 kids in it, and so how is that working on the practical level of testing every Kid Everyday . That is the challenge, and that is why the experts say if you want to do this and call on the schools to do it, you have to provide more detail from the cdc on how to do it, because like i said, that the tests were designed and especially the rapid Antigen Tests to be one after another 48 hours apart, and a pediatrician said that they have done the Pilot Programs in many states including hers for the reasons that you outlined, it is difficult to administer them in schools, especially if you did not plan on this way back in the spring to try and set up all of the logistics for this. One possibility, geoff, she is telling me is that to send them home basically with the parents, and you have to get the parental consent and have the children bring them in as a condition. And this way if the tests are made cheaper and more accessible, you dont have to have a ton of administrators here queuing up the children, administering the tests and waiting for them to come back, geoff. And now doctor, we have seen the state and federal governments using carrots to have the Covax Lottery and paying people to get the shot, and now it appears the sticks, and the White House is expanding the vaccine sticks, and is this the right approach at the right moment . It is the right approach, and we have to appeal to peoples Common Sense and judgment, and Respect And Concern for other Human Beings who share their same time and space, but it is not working. So we cannot wait any longer. This is the time for absolute leadership. And the president is absolutely right to really put a much firmer stake in the ground. Mandates are going to be essential, and im very, very pleased if he is going to get support from the private sector in addition to the authority that he has in the public sector as being the president of the united states, but it is inevitable. We have to have the mandates, because all of the other things that we are doing have failed so far to achieve the goals that we need to achieve in the time that we need to achieve it. Hmm. Dr. Redletter, what are you making of the president s plan in the requirement for the federal workers and contractors considering that most federal employees dontley in washington, d. C. , and so this is a significant effect in every state. Right. And i think that geoff, this is going to have an effect in every state, and it is a very great move by the president , and i agree with Reed Tuxson very much, and we cannot wait any longer, and the mandates are essential. If the federal government was able to issue a mandate across all sectors public and private, fine. But in the federal system, he cannot do that, and so we are hoping that the Pfizer Vaccine got the full approval from the fda, we are hoping that the organizations and the institutions in the private sector, and companies will say, listen, if you cant prove that you are vaccinated, you cant come to work here, and you cant go to this event. We need a serious stick in place now, because obviously, the carrots were not working, and really, they would not be able to work. So the only tool left thats most critical is for everybody, every organization to follow the president s example and require people coming to events and going to any kind of office place, et cetera, those people need to get those shots, and prove it. By the way, the issue of the exemptions and maybe for medical reasons, but i certainly do not agree with the religious exemptions for this step of vaccinating the public in such a deadly Pandemic Crisis that we are experiencing. Dr. Redlener, on that top tick, i am told that the Press Secretary Jen Psaki got that question if federal employees refused to get the shot. This is what she said, some of what she said in response. For the people who dont choose to be vaccinated and dont fall into one of the limited exceptions, what are the consequences to be vaccinated or be Let Go . Well, again, there are limited exceptions, but, yeah, the expectation is that if you want to work for the federal government or be a contractor, you need to be vaccinated unless you are eligible for one of the exemptions. All right. So dr. Tuxson, i want to talk about what is happening in miamidade county, because officials say that at least 13 employees of the public School System there have died of covid since midaugust and those who passed away include teachers, a school bus driver, a cafeteria worker, and so, according to the unin yo, all 13 were unvaccinated and all were africanamerican, and we know about the historicallybased Vaccination Hesitancy among africanamericans. What can we do there . We have to have the trust that we are caring about each other, and we are not divided by race or economic status, and this is one country, and that people do not fear every initiative by the Public Health authorities or others as being a plot against them. So this is a bigger issue, but on a more specific response is that we have to continue to educate the black community with the Trust And Information from trustworthy sources. We have to continue to appeal to conscience, and however, even saying that, we cannot allow our children to go back into the petrie dishes. Right now today, we have 2,000, and almost 400 children in hospitals from covid alone. That is not including all of the other teachers and ancillary personnel who are sick. This has to stop. We can no longer continue to play around with our childrens lives. So this is the time for bold decisive action, and i really am hoping that the president is going to push very hard to use every tool in his disposal to make sure that every eligible school personnel, employee, and eligible children are vaccinated if they are going to be coming into the schools, and above all masks must be required full time for children and all people in schools in communities that have a significant viral load, and by the way, that is almost every community in america. And so ralph, you had to move around and tell us about what you know about the passengers on board . Yes, geoff, this is extraordinary, because we watched the tired but happy people coming down the steps here in doha. They have had a heck of a day if you think about it. They started off in kabul, and passed through the airport controlled by the taliban, that is threatened still by this day by isisk, and the same airport where they carried out the suicide bombing, and ending it this evening in the relative safety of doha, qatar, and we caught up with some of the people passing through immigration. Just because they are physically safe, their journeys are far from over, and the people did not know what was in store next for them. We spoke to a canadian father there with his 6yearold daughter, but his wife was unable to get on that plane with them. She is coming by Land To pakistan, and her hope is that the family be reunited back in canada some day. This is, as you said, a product of unprecedented coordination between the u. S. And the taliban and the qataris acting as the go between and they are instrumental of getting the Hamid Karzai up and running again. Do you know, raf, if any of the people on that flight were the people trying to leave from that flight in afghanistan of the Ma Czar El Mazar E sharif. I dont know the exact number of americans off of the plane, but the americans were not the largest contingent of people on board. So we do not know how many if any of the people who made it safely here to doha today are also the folks who have been trying to get out of mazar e sharif. So what do we know about the talks between the taliban and this interim government . Well, you have to describe it as liaison, because we dont have a embassy, but points of communication, and the important player here is qatar who has been our intermediary, and they sent the flight, and got the people on the flight, and perhaps most important has reopen the airport, and sent a tactical team there to reopen on what is a regular basis there. Is supposed to be another Qatar Flight to leave tomorrow. They have been a crucial partner for us. I think that finally shows that the taliban whether it is in indirect communication with us through qatar or some direct contact does respond to pressure. The insistance that the dual nationals of americans has been coming from Secretary Blinken and others, the taliban seems to be responding, and they understand that they have to be careful about what they are doing internationally, and they said much the same thing to the u. I wanted to ask you about the political implications of all of this at home, because this is a moment of vindication it appears for the biden administration, and earlier this week, you wrote that President Biden needs a new beginning after a particularly bad august. When it comes to afghanistan, what does a new beginning look like for the president . Well, you could argue it looks a little bit like this. That is to say that the united states is not directly involved. We are out. We dont have an embassy, and the promise that we made that we would get every american, and every afghan that helped us would be out, and the early stages, and biden has to press forward with that and deliver. I think that if he can keep faith with The Americans In Afghanistan and all of the people who helped us to get them to safety over the next several months, he can look back and he can say i did what i promised. The troops are out, and the people we worked with are out, and afghanistan is now guiding its own destiny. They are not specifically discussing any specific threats at the capitol, but they are taking precaution, and they will not be caught flat footed again as they were January 6th, and they will have every available officer in case things escalate, and they are planning to install new fencing around the capitol complex. Unclear fit is going to be the inner fencing, and no indication of outer fencing as was the case after January 6th, and communicating with the top members of congress about this. There is a briefing this coming week with Nancy Pelosi who has invited other congressional leaders and expected to be led by Tom Manger who has the mandate to make sure that nothing like January 6th happens again. This is a serious situation that is going to be given the gravity that it deserve, because it is a rally in explicit support of those who participated in the attack on this capitol of January 6th, geoff. While we have you. Lets talk about the Spending Showdown in congress. You have five House Committees who are marking up their portions of the bill. And you are seeing the divisions within the democrats of this 3. 5 trillion biden spending proposal. And any movement toward a resolution or people are doing the posturing, the political posturing of where they want it to hit . It is more on the political Posturing End of the spectrum right now, geoff. There is no movement toward a final Price Tag in part because the centrists like Joe Manchin and Krysten Sinema have said they are skeptical of the figure. And the democrats have said they dont want to negotiate down from that figure, because the progressives will bolt, and they dont know where the figure will be. There is movement in that multiple House Committees are marking up major portions of the bill, so it is looking like the democratic leaders are going to let this play out, and see where the chips fall, and ultimately make a Judgment Call to where it needs to be, and the policy writers according to sources i am talking to are keeping the options open to reduce the Price Tag. One of the things they are looking at is setting the Child Tax Creditor subsidies to expire sooner. You see the peoples worldly possessions out here on the curb, and then you can look through and see the childrens toys and booster seats, and you realize the devastation for the family, and you can imagine what the past 12 hours or so have been like for the families and waiting to see what the next storm would bring. Lickily, it did not bring any major flash flooding, but it did bring a lot of rain. Up to four inches in some places fell in a span of six hours. So a lot of rain coming down. Officials here are still pushing to get more federal aid for people here in New Jersey. And you can see house after house here with piles like this outside. That as ida in the south, people are still recovering from while some have gotten the power back, there are still hundreds of thousands of people without power, and then you have tropical Storm Mindy coming ashore overnight, and bringing a lot of rain to the south as well. So areas that just keep getting hit by these Storm Systems coming through. Here is a little bit of the sense of relief that things were not worse, but the rain didnt help with cleanup, and that is what the people are focused on here today. So much cleanup that we do see the power crews, that are out, and helping with the gaslines, and helping with the powerlines and so the recovery here continues even as so many around here are still looking for help, geoff. We are a waiting a News Conference from Attorney General Merrick Garland about to start ten minutes ago and the expectation is that garland is going to announce civil action against texas with the near total abortion ban. According to the report from the wall street journal, the d. O. J. Is going to argue that the new Texas Law legally interferes with the federal interests, and Nbc News has not independently verified that report. Joining us is the Justice Correspondent Julia Ainsley and Assistant Professor at the University Of Baltimore law kim wayly, and Kim Ruesell who is attorney for Planned Parenthood. So when the president said he looked at the law, he said that he was not clear if the d. O. J. Could do anything with it, so tell us about the argument that the doj could do here, and what are the federal interests that the law could be interfering with. Well, all we understand now, geoff, is that this is a civil case, and there is a empty space waiting in the western District Docket where it can be filed shortly, and this is a civil case challenging the lawsuit, and not criminal, but there are a number of federal interests at stake here, and they could argue that it is violating the civil rights which the Justice Department has to uphold for all american citizens and that it is within their interests to make sure that roe v. Wade is upheld, and in short, they may be looking at the law is not lawful because it gives, it allows texas to give an ability to their citizens, that texas, itself, the government does not have. In other words, for the government of texas to tell the citizens they can have an interest of suing anyone connected to a Womans Abortion is not lawful because texas as a state, it does not have that right, so we expect the arguments to be coming up, and what tactic they take here is great curiosity to me, because it is a hard law to challenge, because none of the lawsuits where someone is suing where someone connected to an abortion has taken place, so it is going to be interesting how they frame the argument today. And kim, taking up with julias great point, the way it is written, it is written intentionally for the opponents to find legal standing in court. Right. That is why the Supreme Court at least a majority will reportedly refuse to step in and have Injunctive Relief, and that is a mistaken interpretation of the basic interpretation of the Injunctive Relief unless there is Status Quo and harmful interest of the law. And this is a gray area, and roe v. Wade is well establish and the Supreme Court has another case on the docket to have a thoughtful and thorough analysis of what to do with the roe and done on the emergency relief, and leaving Merrick Garland in an awkward position, because it is unprecedented and so in my view, if the case is brought against someone who is going to get an abortion for the 10,000 bounty, that person would not have standing or injury, because there is no real interest in Bounty Hunters and Someone Elses medical treatment. The problem right now is that unless someone tries to enforce it, there is nothing for the doj to stop. There something called the all Writ Act going back to 1879 that the doj could say that we need the courts to enforce the constitution itself, but there is some creative lawyering that i expect to come out in this filing today. And melanie, paint a picture for us if you will of the impact that this Texas Law has had on Abortion Access and womens access to Health Care services provided by Planned Parenthood in just the last week. Well, sure. We know that our Health Care providers at the Health Centers in texas were providing abortions up ton till very last minute possible before the enactment of this law, and the providers are following the law which means that people in texas are seeking Health Care access elsewhere. This law has made access to abortion not available virtually in the state of texas. So there are people right now who are traveling as far as illinois, New Mexico seeking access to an abortion that they cannot get in their home state, because this law has made it impossible, and so the impact is very real, and we are grateful if the News Reports are accurate to see the Justice Department taking this step forward to protect the access to Health Care for texans. And kim, we know that the Supreme Court is expected to hear this case in mississippi, some time this term that bans abortion after 15 weeks. What impact could the doj civil Action Today have on that case . Are they completely separate situations here . Yeah, i believe my expectation is that it goes to the merits and roe v. Wade and what to do with the roe v. Wade and the wrinkle with what is happening in texas is as indicated by julia earlier is this maneuver, and the cynical get around and this idea of the judicial review. Normally it is Police Officers or others who enforce the law, and you go to court if there is a bad law and ask for an Injunction Or Something to stop the enforcement before it starts. This outmaneuvering basically says that we are out. We are government, and we are on the sidelines and so we are going to wait for the private citizens to enforce it. So essentially the Supreme Court, and the majority said that there is no one to enjoin or stop the texas government. So that is going to be a separate question from the merits of abortion under this dobbs case. But as a practical matter, as a practical matter, roe v. And the House Speaker said that later this month the chamber would be voting on legislation to codify roe v. Their remains have yet to be identified. The painstaking work to bring the families a little bit of closure continues to this day. Joining us now from Ground Zero in manhattan is Nbc News correspondent stephy gosk. So this mission to identify the victims of September 11th has been underway now for two decades. It is hard to wrap your head around. How has this effort evolved over the last 20 years . Well, jeff, there have been enormous advances in technology they use to analyze dna. They used to use a Mortar And Pestle To Grind Bone in 2001. It allowed them to identify people but they still have so many, 40 that they have not identified. And the Medical Examiners tell me typically they like to separate the motions from the job. But when it comes to the remains of the victims of 9 11, it is their connection that energizes their commitment. Medical examiners are not first responders. But that Day Mark Desire went straight to Ground Zero. When south tower cracked, i looked up, you were under. His team barely survived. It was the start of one of the most complex forensic challenges in Human Hist rich. 40 of the victims are still unaccounted for 20 years later. Its going to be surprising to hear there are so many people who arent identified. Everything that destroys dna was president at Ground Zero. So fire, water, sunlight, jet fuel, diesel. Nearly 22,000 remains were collected in the years that followed. And while some families got the call, others like the stacks did not. Im waiting for that phone call. Waiting. Hey, we got we identified a piece. But it never happens. Larry stack was a firefighter. 32 years on the job. They rose up to the rank of Battalion Chief and loved every part of his job. That love transferred to his sons who were firefighters themselves. In 2001, Larry Stack was considering retirement. While they were looking at the first tower burning, the plane hit the second one. He put the binoculars down. Of he looked at the guys and he said i think theyre going to need us now. Stack was helping an injured man when the buildings came down. Typical of the kind of man he was. He would have never left. They held a funeral in 2016. Burying a Blood Donation Larry made before his death. It was a sight to see. Families like the stacks are at the heart of Medical Examiners work. We had to evolve. We had to push p the science out of that necessity to make more ids. Just this week they made two Dorothy Morgan an Insurance Broker and another unidentified victim. The technology has come a long way. Especially with extracting dna from bone. So this looks very different than it did in 2001. Yes. Yeah, there is no Mortar And Pessel here. The lab showed us the process. And that commitment is as strong today as it was 20 years ago. His ripped jacket from 9 11 hangs in the lab. A reminder there is still work to be done. There are families that have told the medical Examiners Office they dont want to be notified if their loved one is identified and real you, jeff this is about People Grieving in different kinds of ways. These families just dont want to have to wait for that phone call. Theyre trying to move on. Gosh. The Medical Examiner trying to make good on a commitment some 20 years later, incredible story.
