Who are the People Clapping . Were going to prevent rape. Were going to get them. To put it simply, here is what abbott is suggesting. Instead of allowing Rape Victims to ever seek an abortion, instead of forcing them to carry pregnancies to term against their will, what abbott is saying a better solution is to round up all the wouldbe rapists no rapists, no Rape Victims, no unwanted pregnancies, right . Quote, the most obvious way in which this strategy is flawed is that prosecuting a rapist does not prevent the rape any more than prosecuting a murderer saved his victims life. After the fact legal actions of course are important. It does not prevent a new rape from occurring. Its his attempt to pivot away from a question he Cant Or Wont answer about a bill he just signed by trying to take a tough on Rapist Stance that leaves the fundamental problems with the bill And its impact on Real Women In Texas Unaddressed And essentially abAndoned by their government. Whats more, other Red States are copying texas. We reported that legislators in at least six states have already expressed interest in copying Texas Law. The governor of South Dakota issued new restrictions on Abortion Medication days after calling for a review of Abortion Laws in her state. As the divide widens with each extreme bill passed by the republicans, pushback in democraticled states is mounting. The Boston Globe reports the City Council in portlAnd, oregon, is expected to vote today on an Emergency Resolution that would ban the government from purchasing goods or services from the state of texas, quote, until the unconstitutional ban on abortion is overturned in court according to a statement from the And-mayor'>PortlAnd Mayor ted wheeler. I wanted to talk to you since this news broke, since it came across our desk, And wonder can we start talking about a woman in texas, maybe spent two years at community college, making her way to ut, found out shes pregnant, shes eight, nine weeks pregnant. What does she do . Thats exactly the point, nicolle. This law basically a week ago a right that women had for nearly 50 years just evaporated overnight. Right now her options are really few. They are to probably go out of state, try to put together the money, the transportation. Now most women in texas live about 250 miles away from the closest abortion provider. Again, i think that will change because more And more are closing down. And thats the part of the story i feel hasnt been told yet And obviously Governor Abbott doesnt want to tell which is the real impact on millions of people in the state of texas. 7 Million women of Childbearing Age just lost the right that they had just a week ago And i think a lot of women are waking up And realizing if this it happen in texas, it can happen anywhere. States are beginning to act And to try to take action, assuming this Supreme Court is not going to intervene. Is that where were heading, that this will happen anywhere And everywhere . I mean, i think it will. We have many this is a Supreme Court, as we know, by a 54 note basically refused to take action on a law that is so clearly unconstitutional that even judge roberts said a law crafted to insulate the state from responsibility for enforcement. And yet they took no action. Theres, of course, another case coming before the Supreme Court from mississippi in just a couple of months, And there are many laws on the books that if this Supreme Court, in fact, refuses to recognize the precedent of the right to seek legal abortion, well have many states where abortion is no longer available. One thing, nicolle, i think is important to remember its not that abortion is not going to exist in texas, its just not going to be legal And its not going to be safe. Of course when roe was decided almost 50 years ago, young, healthy women were routinely dying in Emergency Rooms across this country, And we cannot go back to those days. Lets talk about two things that i dont think have forcefully been put into the public conversation. Forcing a victim of And-incest'>Rape And Incest to carry pregnancy to term, particularly a child, risks their life, endangers their life. Thats an extreme antichoice position. Where the antiChoice Movement has been successful is painting the Choice Movement as extreme. What is the opportunity to turn the tables fashionly And make clear the prolife, antiChoice Movement is so extreme they lost george w. Bushs pick for Chief Justice of the Supreme Court in this decision. Its so out of the mainstream of republican policy ideas, how do you have that conversatiAnd'>On And make that point from Coast To coast . Look, i think its critical that we tell the real lived experiences of people And the results of these actions, because its not like it just came out of nowhere, nicolle. This has been the republican Party Agenda for a long time. They finally have been successful And, again, this is something that anyone can relate to, And i think the clips you showed of Governor Abbott demonstrate the danger of having people who know nothing about Womens Health, about anything about pregnancy making these decisions And making them for political reasons, not where their states And constituents are. These laws were not passed because the state of texas rose up And wanted abortion to be illegal. It happened because of a republican And-governor'>Legislature And Governor who wanted to impose their own politics on the women And families of texas. That is where i think this is where i believe they have gone so far that And were seeing a political upheaval. This is going to begin to determine And enrange women who were already active in the last election. Its not whether a question if roe will be overturned, it was overturned in the state of texas. The only way to change that is to get people to vote. Roe was just overturned gives me chills. We leave men out of the conversation at our own peril. The vigilante aspect of the law. Is there anything you can think of where there is no parallel because only womens bodies carry a pregnancy even though Women Cant get pregnant on their own. I dont know, say if viagra was outlawed And anybody who aided And abetted the pursuit of viagra, the person who sold the coke with which it was swallowed or the pharmacist, could you imagine Vigilante Justice around any other Human Behavior . No, And, look, i think its important to what you say, nicolle. The importance of people being able to make decisions about their own bodies, about their pregnancies, these are issues that dont only affect women. And this is a country where, again, people support the ability that for people to make their decisions about pregnancy not politicians And i have seen outraged expressed by men as well about this. It affects their families. It may affect their daughters, their wives, women that they know. This is something i believe were never going to win this if its only a womens issue. I dont believe it is. Im encouraged men are speaking up And out. Were going to need them as well to turn this around. Kim, i know youve been scrutinizing And covering the legal size of this. Can you play forward what cecile is articulating . Roe was overturned in the state of texas. It effectively was by the supreme Courts Decision not to step in. Although, yes, John Roberts was on the side with those saying that he wouldnt have let it move forward, that was based on the procedural posture. He didnt want to do that without full briefing. I believe the decision will be 63 based on what was said in the past. Its a very huge jump from when i was in Law School And roe was a fundamental legal principle that existed for my entire lifetime. I think its important to note the cynicism of whats happening here. If the real goal was to eliminate abortions, then republicans wouldnt be doing this. I think this is like the big lie of Election Fraud. Republicans use the lie of Election Fraud in order to pass restrictive voting laws. The lie is the way to make abortions disappear is to restrict access to it. Just as cecile laid out, people will still get abortions. It will just be less safe. What its really about is restricting the ability of women to control their own bodies. Its really about control. Abortions have gone down in this country And the Reason Theyve gone down is access to reproductive Health Care, greater access to more people in a more affordable way that gives families, men And women, the ability to plan their families as they see fit And results in more unwanted pregnancies. So expAnding abscess to Health Care is the way to rid abortions by every Mess Euram measurable data we have, to move And restrict the choices And it is important to remember when we have this discussion. Tim miller, you And i worked in republican politics at a time when cecile usually was able to muster really effective messages that divided the kind of voters we both wanted And needed to vote for republicans. Republicans are now in the position of advocating such an extreme position it jeopardizes republicans if they embrace something so extreme that as was said people wont stop having sex And womens bodies havent lost the functions of being the one to carry pregnancy. Almost No One knows theyre pregnant when theyre four weeks pregnant. Its not six weeks, its four weeks of pregnancy. And certainly not enough time to make a decision. What do you think about the republican party planting a flag around the most extreme Abortion Law . I think its a political mistake And even deeper than that i hi it is a Policy Mistake for those within the republican party for the sum who have a good faith genuine belief in wanting to expAnd the movement, to minimize abortion as much as possible this is a bad law if that is your goal, a bad law for them. Its important for people to hear about this from my perspective. I consider myself prolife, somebody who believes in the Human Dignity of every soul. For me that also means the mothers, right . That has to include the mothers who have And-meaning'>Dignity And Meaning And purpose in their life. A bill like texas that allows Bounties Targeting Women And people that are supportive of women without any Support Structure for them, that is not a prolife position. That doesnt represent fostering a culture of respect for Human Life in this country. That is targeting women directly And it is going to turn people off. It is not a political winner. If you can find an issue of Ceciles Point of view or to the left of her to someone like me who considers himself pro life And we can say this is unconscionable, that puts them in a small corner. This will be a big challenge, not that thats a silver lining. Anyone who has future ambitions is going to be asked And will feel political pressure to go along with something unconscionable And will actually hurt the objectives they claim they want to put forward. I appreciate your views And i hope you feel you have space to share them. Cecile, i want to come back to you on the politics. After the trauma women And some couples are experiencing, And i think its worth pointing out how vast texas is. Its not like living in the tristate area where you can get in your car And be in texas And New Jersey in one day. Its also not bordered by a lot of places its that much easier to get an abortion. What do like minded people who feel this trauma, want to support women or couples experiencing this trauma do . Well, i wish there was a simple answer to that, nicolle, that we could wave a wAnd. This is going to be a long haul to turn things around in texas. There are political things they can do, vote, call their legislator, call Greg Abbott. I think thats incredibly important. Right now people are supporting funds that are helping women And pregnant people leave the state, get to other places i think has been made abundantly clear thats not possible for everyone. Were seeing in the state of New Mexico theyre booked for weeks now for women coming from texas trying to get there. Of course the cruelty of this, i think we have to come back to, this is going to impact And already is impacting people with the least access to Health Care already. Young people, as you mentioned earlier in your example, women that live in Rural Texas where already they were in pretty much a Health Care desert. Women of color who have had disproportionately less access. Its a state where the governor has refused to expAnd Medicaid Access so even basic Health Care is hard to come by for many in texas. The most important thing we can do is to educate people And show them what the impact, the cruelty that i think has been mentioned so many times on this show, the cruelty of whats happened in real peoples lives because the impact is immediate. And there isnt a Magic Solution to this. To me its going to make sure people who take these extreme positions that vote against the interests of the people of texas, that they lose their jobs. And until that happens, i dont nope that the republican party is going to take a different positiAnd'>On And, as you said in the show, its very dangerous because this could easily spread to florida, ohio, South Dakota And the list goes And'>On And on. You And i have both covered the reaction to trumps win And i talked about this last week, that you saw women organizing among themselves after his victory And inauguration. Do you see this as that galvanizing moment again . I think well have to see especially at a time when voting yes that is a solution but its being made more difficult at a time we have more divisive politics. There are also women who vote for a lot of the politicians that we see passing these very bills. I dont think its cut And dried on this either. Its a very complicated state. I think what people need to realize is listening to people talk about this is very immediate. And how now it is up to lawmakers both in And-state'>Congress And State legislatures to protect access to all aspects of Reproductive Health. Terminating a Pregnancy Isnt used as a form of Birth Control by everyone. There are Gut Wrenching times And taking that away is inexcusable. Make no mistake, too, this is something being done that does affect the less fortunate, the people with wealth And with privilege will still have access to abortions even in texas. Certainly in other parts of the country. This is stopping certain women, controlling certain americans bodies. When we put it in that sense that should be unacceptable to everyone And thats the way i would like to see people talk about this And describe this. It is not the easiest thing to talk about. The republicans uniting behind a moderate republican who is in line with the state on Climate Change And things like this, the republican party mirrors the party everywhere And they got behind Larry Elder, who is absolutely insane. Hes talking about Rebbe Racials for Slave Owners. Reparations against Slave Owners . Is against vaccine mAndates. Elder is a foil has made the democrats go from bedwetting i know thats one of davids terms but im going to steal it. This weird off year whether enough democrats return their ballots. Just really quick on his point about california taking a long time to vote, i think its incumbent on democratic states to now make adjustments to the way that we hold elections. Its not fair that it should be this way but you have to respond to this bad Faith Attempt to overthrow our democracy. But we need to count votes faster. I think the new Yorks Mayor Race went on for three weeks. Part of why January 6th happened is because of how long it took to call the election in 2020. I think we need to make adjustments. About a month ago a number of us who were medical experts in The Department of health And human services looked at the data And starting to recognize there was a dip in protection against mild to moderate disease, not against hospitalizatiAnd'>On And severe disease. Looking ahead our feeling was boosters would be required And why we laid out a plan to start to offer boosters And that is contingent on the And-cdc'>Fda And Cdc weighing in. We want them to do a thorough review on issues related to safety. If you are fully vaccinated now, you are in good shape. Thats what people need to remember. If you are not, its incredibly important you get vaccinated as soon as possible And as soon as the And-cdc'>Fda And Cdc weigh in we will start to roll out our plan on boosters. The last time we spoke i asked you about the Approval Process for kids under 12. Every parent i know, every And-dad'>Mom And Dad in every part of the country is besides themselves with worry And fear. Can you give us an update on when the vaccine may be avail able . Nicolle, the picture still looks similar in that we are looking forward to the data from the companies regarding trials in children. And the fda is ready to evaluate the data as soon as it comes in. Im still optimistic for my kids, for all of our kids who are under 12 And really in need of that protection. Until we have that, its important to know that we do have pathways to which we can protect our children. The data tells us clearly, nicolle, Kids Risk is dependent on how much risk there is in their community And whether people around them are vaccinated. In our schools through masking, through regular testing, through distancing whenever possible, we can reduce the risk of our children getting sick even if theyre not vaccinated. What worries me, nicolle, when i see so many schools that are still not implementing these measures, in part because some of them are being blocked by their states And local elected officials, we cannot allow anything to get in the way of us taking measures required to keep our kids safe. Let me ask you about the state of texas near complete ban on any abortion after the sixweek mark, which is essentially 85 of all abortions performed in the state of texas. What are the risks to maternal And Infant Mortality with a law like that in place in a state the size of texas . Nicolle, it was disappointing to see this from a public Andpoint'>Health StAndpoint because we know these types of near total bans actually increase risk And reduce safety for women who are seeking reproductive Health Care services. My belief as a doctor who has cared for many patients over the years And worked with patients through really difficult decisions is these are some of the hardest decision when is it comes to Reproductive Health that a woman makes. Its really up to that individual And their Health Care provider to make decisions to figure out what is right for them. What they need is a Health Care system And a broader structure that supports them in their Decision Making And allows them to get care safely. And my worry is the recent actions will move us in the opposite direction, put more Womens Health at risk. Is there anything the federal government can do to help those women now at risk . Theres certainly a lot thats under discussion right now, nicolle. I wont get ahead of the administration in terms of what they may announce on that. Then of course those additional two guilty pleas today, one from someone whose mom bragged about their antics on facebook after the riot And live streamed inside And another who chartered four buses from pennsylvania to d. C. On January 6th. That individual is going to have some information thats going to be really valuable for prosecutors going forward, because of course when they review all the social media information, they can come up with a list of people who went in those buses to the capitol potentially And try to match those Up With People who were actually inside And probably also has direct knowledge of who from the buses went inside the capitol that day. Ryan, i know youve written a lot about the Sedition Hunters. I always enjoy reading your reporting on that And i want to understAnd how thats being used by prosecutors as an investigative tool. What is your sense of what the prosecution is building toward . With Sedition Hunters its really remarkable what an impact they have had both before individuals are charged And actually during the prosecution. You know, a few weeks ago we had an instance where based off of sedition Hunters Information there was basically a sentencing that was held up because there was new evidence surfaced of an individual who was going to be sentenced for a misdemeanor actually assaulting an officer. So that was a remarkable time. Theres a number of cases where Sedition Hunters have found information thats used to hold individuals in jail. Theres one case last week where this individual from pennsylvania who is wearing all of this sort of Military Gear had been appearing at Rudy Giuliani events while he was wanted by the fbi, And encouraged other rioters to steal officers weapons. There was like a chance it was sort of on the fence that he was going to be released pretrial, but the judge actually said this lastminute evidence that was surfaced by Online Sleuths which showed this individual holding guns when he was banned from owning weapons changed that decision. So he is now held in jail. So its really been really remarkable. Ive got a list in the other room of dozens of cases that are going to come Down The Line who havent been arrested yet. Theres going to be a lot of influence that the Sedition Hunters had And will continue to have as these cases move forward. Its really a remarkable set of circumstances where the government is leaning pretty heavily upon these outside organizations that sort of Connect The Dots in these cases. When you commit a crime in plain view, i guess that happens. Real quick, does September 18th And the events planned for September 18th in support of the insurrectionists play into any of these cases . Yeah, i think Thats Something judges will keep in minding. I dont know if its come up explicitly but the overall political season that were in where people are talking about this idea that Donald Trump is going to come back into office is certainly something that judges have mentioned And that belief is something that they worry about because theres this widespread belief that the election was stolen. Thats going to have indications for what someone is going to do. If you honestly believe the election is stolen, youll take action based off of that And might not be willing to follow the law And follow the instructions the court puts out in order to get you on pretrial release. Democrats And reproductive Rights Activists pressed the biden administration on tuesday to take more aggressive action to stop a Texas Law that prohibits abortions after six weeks of pregnancy, even as administration officials And legal experts acknowledged it would be difficult to curtail the law in the coming months. The new law doesnt just stop at outlawing abortions after six weeks. The aspect you heard President Biden call pernicious And unamerican is the empowering of texas citizens to sue anyone performing or aiding And abetting an abortiAnd'>On And reward them 10,000 if theyre successful. 23 House Democrats led by House Judiciary Committee Chairman Jerry Nadler penned a letter to Attorney General And'>Merrick GarlAnd requesting he use the full power of the Justice Department to protect a womans right to choose And to combat that pernicious provision. We urge you to take legal action up to And including the criminal prosecution of would be vigilantes attempting to use the private right of action established by that blatantly unconstitutional law. What weve heard from the Attorney General so far was a statement released the day before that letter was sent from House Democrats. It reads in part, quote, The Department will provide support from federal Law Enforcement when an Abortion Clinic or reproductive Health Center is under attack. We will not tolerate violence against those seeking to obtain or provide Reproductive Health services. This turning of texas residents into Bounty Hunters is where the legal battles against the law could be fought. Thats according to lawrence tribe, professor of constitutional Law Emeritus at harvard Law School. Here he is last night with our colleague, rachel maddow. Since this Texas Law operates by Chilling Abortion helpers And abortion providers, frightening them out of business, what they can do is say you sue us for 10,000 or 10 Million because there is No Limit put on the statute And well sue you for double that. You want to try . Even a justice who doesnt believe in roe v. Meanwhile the harsh impact of texas new law is already being felt. Some providers now booked solid for weeks. Pressure on the president And the White House to wage war against texas new Abortion Law is where we start this hour with some of our favorite reporters And friends. Congresswoman Madeleine Dean of pennsylvania is here. She was one of the 23 House Democrats who signed that letter we quoted to the Attorney General. Also joining us, mike schmidt, New York times washington correspondent. And Brian Fallon is here, former Press Secretary for Hillary Clintons campaign, now the Executive Director of And-justice'>DemAnd Justice. Congresswoman, we start with you. Whats your reaction to whats happening not just in texas but the stated intent to copycat that law, which is essentially a ban on about 85 of abortions that are performed in this country in many other republicanled states. Thank you for having me on, nicolle, to talk about this incredibly important topic. What i kept reading all day long as i was going through some of the articles about this, i kept thinking that this is really a series of profiles in cruelty And in power. Im talking about the texas republican majority who passed this bill. This is not just an antiabortion bill. It is extreme. It is grotesque frankly, draconian, no exceptions for Rape Or Incest. How about a texas Governor Cowardice And cruelty who has absolutely no idea what hes talking about in terms of Womens Health care And how about a Supreme Court who In The Night allows this law to go into effect, a law that these legal scholars know is unconstitutional. Its profiles in cowardice And cruelty. Congresswoman, have you heard back from the Justice Department . We read what the Attorney General has put his name to. Its a statement about i believe in enforcing existing law using federal Law Enforcement to protect anyone going into or working inside reproductive Health Care clinics but it doesnt specifically get at what youve asked of the Justice Department. Have you heard anything since this reporting . Not that im aware of. I serve on the judiciary committee, did sign that letter, but not that im aware of. We have not heard back. Brian fallon, i want to show you what White House Press Secretary Jen Psaki had to say about what is already been named i guess the supreme Court Commission And the idea of expAnding the court. Is he misleading supporters of expAnding the court . This would take a legislative change, not something he could change on his own. Why doesnt he come out And say how difficult this would be. I think its clear its difficult. But the president s view on the expansion of courts has not changed. He also wants this group, this commission, to take a close look at a range of issues, not just court expansion, which is an important question for them to examine, but Term Limits And a range of questions the commission is looking at. I would also note, jeff, in the president s Statement Today he also made very clear in pretty strong terms his viewpoints on the ruling of the Supreme Court And this case. Rulings like that do raise concerns, not just for the president but for people out there in the country about how the court is operating. Brian fallon, ill deal with the elephant in the room. Obviously my complicity in the current makeup of the court. But for anyone who cares about this issue And has been watching the voting Rights Battle where the White House And democrats in the senate have been unwilling to set aside a tradition, its not a rule, its not the constitution, to stop 412 proposed voting restrictions racing through 48 states, 22 of them already signed into law, the latest in texas, not coincidentally, what is the hope that expAnding the court is viable in todays democratic party. Well, i think youre right to pose the question in terms of referencing both the assault thats happening on Abortion Rights And voting rights. Literally Governor Abbott in texas signed a Voting Suppression Law this week, one week after the restrictive Abortion Law went into effect. These two issues are paired, i think, in the sense that todays republican party is the political minority so they are taking steps to entrench their power despite their Minority Status in the country And be able to enact an agenda that would never prevail at the ballot box. Theyre able to do that, because they have a 63 Supreme Court that they know will uphold these laws when it comes to both Voter Suppression And abortion restrictions. And so i think it puts President Biden in a very tough situation since hes not yet willing to Add Seats to the Supreme Court. Hes having to come out And call for things like a whole of Government Approach And pursuing all avenues. This is really washington speak for not knowing what else to say. At some point theres going to have to be a recognition from the biden administration that the Justice Department, i hope they use every creative tool in the toolbox. I hope they find ways to enforce the Ku Klux Klan Act like Professor Tribe has discussed or find ways to creatively prosecute the law from the 1990s that was to protect against physical attacks outside Abortion Clinics. But this is a Patchwork Solution at best. The reason these State Legislatures are passing these laws is because they have a Supreme Court thats friendly to them. Democrats needs a solution to address the makeup of the Supreme Court. I think thats why more legislators are endorsing the Judiciary Act. There were four new members of the house that endorsed it this week. Brian, let me ask you a blunt question. Again, not through any fault of their own but because of the unmooring of the republicans to anything even resembling republican Mainstream Views on abortion, this is way outside what has been marketable to mainstream republican voters. Its vigilanteism. Its placing bounties on And-lyft'>Uber And Lyft drivers who may unknowingly drive a woman to a reproductive Health Care services facility. What is the conversation what is the wisdom of i mean why isnt the filibuster annihilated . Why are we leaving in place what is the biggest obstacle to Codifying Roe, to codifying federal voting Rights Legislation, to reestablish And-equilibrium'>Stasis And Equilibrium against a republican party that is malevolent No Doubt but extremely effective in using their power in statehouses . Well, i think for democrats, the default in these situations is to fall back on two types of strategy. A litigationfocused strategy, so to maybe find a different way to articulate the harm And take another bite at the apple at seeking at getting this law enjoined or an electoral strategy. Youre seeing a lot of democratic politicians say the solution is to register more voters And outorganize the oppositiAnd'>On And win more seats in the 2022 election. I think both of those strategies will fall short. For one thing we did just outorganize the other side And won both chambers of congress And the White House in 2020 so its very frustrating to hear we always need to look towards the next election to solve these problems. The Litigation Strategy is not going to work because the judiciary has been rigged with trump appointees unfriendly to any of these claims that groups like Planned Parenthood will bring to the courts. So we need a political And legislative strategy that engages in the necessary Arm Twisting to get the votes for the filibuster And then to pass the John Lewis act, h. R1, Codifying Roe v. Wade And a bill to Add Seats to the Supreme Court. Even if you pass a codification of roe, this 63 court will be unfriend ly to those measures. You need a solution that deals with the makeup of the court itself. Mike schmidt, i want to ask you about some reporting in this piece that we havent seen anywhere else. You write Senator Sheldon Whitehouse also called on democrats to investigate whether the Texas Law was part of a national campaign being waged by conservative groups And funded by unnamed donors that was intended to push certain legislation, like Voter Suppression laws. He tells you this. We have done a rotten job at exposing that, mr. Whitehouse said. We have been negligent, not just weak in letting this transpire And not doing the work to tell the american public about this. Theres been some incredible reporting in mother jones, some leaked video that shows heritage working on crafting these laws. I wonder What Whitehouse is getting at. Is he getting at simply revealing the dark money behind this or is he getting at something about its legality . I think what hes saying And we should obviously let him speak for himself, but he has been a huge hawk on this issue about dark money, about how anonymous donors or people who dont have to identify themselves are able to fund different types of litigatiAnd'>On And laws across the country designed to push far right causes, whether this is lawsuits being brought across the country by skilled litigators who are, you know, pushing the issue in the direction that the right wants or if its State Legislatures who are putting out laws like the laws in texas. What whitehouse is deeply skeptical about And trying to bring attention to is whether this is a coordinated campaign on the right to do this. And what is truly behind it And who is funding it And where are those funds coming from. And what hes expressing in that quote is a deep frustration with his own party for its unwillingness to take on this Issue Head on, to do more than just have him out there as the one talking about this. You know, because of that, he says of his own party they have done a rotten job at exposing this problem. Look, it gets written about in the media, it gets some attention, but it has not really broken through to the sort of mainstream, you know, democratic base as a key issue. I mean i think its something that is important to democrats, but it is something that its a nuanced issue, its not the easiest one to grasp. He is trying to push his fellow democrats to join him in trying to bring scrutiny to this issue, something that they have struggled to do. Congresswoman, i think he sees it, as brian sees it, as connected. Whats happening in legislatures is tied to whats happening with choice And the copycatting of it is also whats happening. Ill say it again, it is malevolent but it is working. I think republicans feel right now without control of the house or the senate or the White House, they are i dont know if theyd say Wreaking Havoc but having notching more successes And wins on their belt than democrats. Is that true . Well, thank you for asking me because i was thinking one of the other things i make sure we lift up is judy chus Womens Health Protection Act which will codify roe v. Wade. We have to with Urgency Pass that bill. It is something that has been introduced year after year knowing that this day was coming. I used to serve in the pennsylvania legislature. These kinds of heartbeat bills, antiabortion bills were in a drawer introduced in the pennsylvania legislature, republicancontrolled legislature the time that i was there And still to this day so i fear well see another one in pennsylvania. And we literally would ask the author of the bill what medical providers did you have testify or offer information in order to draft this bill . Nobody. What women, pregnant women, women who have had to face tough choices in their Health Care, including abortion services, who did you talk to . Nobody. This stuff is boilerplate, its baked, And theyre hAnding it out to receptive republican legislators. Sadly, i think texas, its an abominatiAnd'>On And sadly i think other states will follow suit trying it. And of course this is all a prelude to the Mississippi Case before the Supreme Court. Brian, if the house passes it, what will happen in the senate . It will encounter the same fate that hr1 is encountering right now, which is an impasse until we summon the resolve to get rid of the filibuster. I do think there are steps under way in the senate to try to get there, to try to set up votes on provisions in hr1 to establish if the republicans are going to block everything, in so doing to convince Senator Sinema And manchin to reform the filibuster in order to pass the most needed, popular parts of hr1. I hope that that happens And i hope that we dont stop there And that we use those changes to the filibuster to then be able to pass things like not just hr1 And the John Lewis Voting Rights Act but the Womens Health Protection Act that the congresswoman just referenced And ultimately supreme Court Reform. Because absent that, none of these bills are going anywhere. We have a limited window of time to be able to do this. Republicans are engaging in partisan redistricting. The window where the democrats have the house, senate And White House at the same time may not arrive for 10, 20 years after that. Mike, the broader piece of reporting that is in your piece is almost this acknowledgement that despite the outrage And despite the popularity of settled law, this view that roe is settled law, something that all Supreme Court Nominees Mutter on capitol hill, the Administration Cant do much. Where do you sense the most sort of thinking or sort of attempt to do something is happening . Is it at doj . Is it at hhs . Where are they working the hardest to be creative . Im not sure. Its clear that the Justice Department is trying to come up with something. The first iteration of biden comes out after the supreme Court Decision And basically says i have instructed my government to come up with possibilities. Ive instructed the Justice Department And hhs to look at this issue And come up with ways of trying to stop it. And the first version of that came out on monday when And'>Merrick GarlAnd puts out that statement that was written about earlier this week in which he talks about enforcing this law, in talking to the fbi And u. S. Attorneys offices in texas about allowing women to get to clinics And trying to shield them from harassment. When you speak to legal experts, though, they say that is not enough. That is not going to be nearly enough to stop this legislatiAnd'>On And that that law that garlAnd is fighting is not really designed to take on the current problem in texas. And even if those they try And take legal action, it will end up in the courts And the courts would toss it out anyway. Underlying brians point, which is that sort of even if things get into the courts And even if the democrats try to move things into the courts, thats not necessarily a favorable place for them either because the courts have been so beefed up with trump nominees through Don Mcgahn over the past during trumps tenure. Let me give you the last word, Brian Fallon, And ask you if this reality, which is laid bare in mikes reporting, even if the house does muster the votes for their law, i think were all saying the same thing. It meets a certain fate in the senate or in the courts. Does it reanimate the conversation about Court Reform in your view . And is that an effort that you are engaged in actively right now with this White House . It is. By the way, can you still hear me, nicolle . Yes. It is an effort we are engaged in. Mike was right when he said this issue does not come natural to democrats. Republicans have capitalized on this issue for decades. From an Andpoint'>Infrastructure StAndpoint we are way behind organizing on the courts but were trying to make investments. Were stAnding up a program inside my organization And-justice'>DemAnd Justice to seek meetings with members of congress to encourage them to endorse the Judiciary Act of 2021. Congresswoman Deans Office was kind enough to grant us a meeting just last week. Weve met with over 35 offices so far. In the last two weeks weve had six new members of Congress Support the bill. So i think were getting there. Unfortunately bad rulings like the supreme Court Ruling last week on the Texas Case And potentially god forbid in the Dobbs Case arising out of mississippi later this term will only help build the case for why this piece of legislation is needed. It certainly is like a kaleidoscope shifting the conversation around that. There hasnt been a ton of heat around this. Certainly we knew when we made this decision that it was possible it would be a very controversial one. We did not know what the reaction would be like. We have a very diverse set of riders, drivers And stakeholders. Overwhelmingly the Feedback Weve received has been very positive. People sharing highly personal stories thanking us for taking a stAnd And wondering why other companies havent done the same. What is your theory for why other companies havent followed the path that you charted without sort of sticking your finger in the wind And taking the temperature of the politics, which by the way are pretty good. Most people are in the mainstream And think that this law is outrageous. Yeah, i wish i knew. I think abortion has been historically considered a third rail issue, one that businesses dont take a stAnd on. I hope that that changes. I hope that this is the moment that that changes. Im very proud to work at lyft where we bring our values to the forefront, And im very proud to have two male cofounders, john And logan, who actually this idea originated with logan, our ceo, And of course i was very happy to stAnd in support of it And am happy to be speaking with you now. Many women And many men, nearly everybody, knows a loved one, maybe themselves, a partner who has had an abortion. This is a womens rights, a Womens Health issue, so this should be an issue that every company is willing to speak out on. Just to help companies who are sitting on their hAnds or havent done What Lyft has done, can you tell me about that situation with the male cofounders . Yeah, absolutely. Late wednesday night, so a week ago today, logan emailed And said, you know, this was the day, if you remember, that the Supreme Court failed to take action. And he said this law seems egregious. What can we do in response . And in parallel we were hearing from drivers who were concerned, whats going to happen to me . Am i going to get in trouble . Because as you know this law provides for a private right of action so it encourages private citizens to sue one another. Basically the citizens are texas are going to be living in fear of civil litigation. And he said what can we do about this . And, you know, there was some internal debate And discussion. We decided collectively because the law itself was so bad that we were going to take the really bold step. That was both the creation of this driver legal Defense Fund covering 100 of legal costs as well as a 1 Million donation to Planned Parenthood And that is with an intent to help women get to appointments that they need to get to, you know, for the time being in other states, which texas is a very big state so this is a huge burden on the women of the state of texas. Kristin, can you tell me what the reaction has been among your workforce . Do they feel reassured . Have you seen an uptick in people applying And being drawn to working for the company . Has there been any sort of notable reaction there . Yes, nicolle. I lead the legal team at lyft And i have gotten the most amazing, heartwarming messages from members of my team And all teams at lyft actually, individuals sharing really personal stories And telling me that they are so glad to see that we have taken a stAnd around lyft. Its being considered a sort of galvanizing company culture moment. Really in a way that we couldnt have predicted when we made this stAnd on friday. Well, i really believe that were seeing the last vestiges of a Power Structure that knows that its time And power is coming to an end. Its not just demographic changes, nicolle. I represent a district that just four years ago was represented by pete sessions. Your former boss is my constituent who voted for me And a lot of them also voted for him And theyre turning off those voters too And accelerating that change. People who pay attentiAnd'>On And know whats going on in our state recognize that we had dozens of texans die because our electric grid didnt work. We have kids in Record Numbers in our hospitals, so much so that we dont have any icu beds for them available across the state. And so thats whats going to be their political demise. Its, yes, our demographic changes. But its also just showing texans that theyre not serious about governing. I mean i like that you broadened the picture because i think people want to understAnd how a party that leaves kids to get sick And die by banning mask mAndates, leaders should be mAndating masks to protect their youngest, most vulnerable citizens who are registered with no party, who could be the victim of parents who dont vaccinate. It is Governments Job to protect everybody, especially the most vulnerable. How is a party that leaves people texans to die with the failed power grid, to fend for themselves with And-death'>Disease And Death in texas schools, to take away the kinds of Voting Measures that made it safe for people to vote in the midst of a pAndemic And which were according to the New York times some of the most secure Voting Measures. An Austin American States Reporter said there was no fraud he had heard of from the measures that were bAnd yesterday. How does that happen . This is why you need to have open elections that are free And fair. When we have gerrymAndered districts where they know, these legislators know in this next session so theyll be safe in the next elections. They dont have to worry what their voters care about. We see how gerrymAndering affects that. We also see how having a state have one Party Rule for too long can impact the impulses in that party. Theyre not talking to texans. Theyre having an internal conversation with each other about who can be the most far right wing, who can be the hardest And the furthest out there. Our governor is responding right now to a couple of really fringe primary cAndidates that are running against him And hes leading this entire state, you know, off the rails, leading kids, like my kids are in school right now into extremely dangerous situations. Banning something they used to care about, which was local control. It used to be a texas value, a conservative value, you allowed local communities to have their own control. So theyre abAndoning their own precepts And concepts And theyre doing it in a way which will accelerate their political demise but is more importantly damaging our democracy. What is your answer to democrats who feel like with control of statehouses And legislatures, republicans are exerting more control over american life than democrats are with control of the house, the senate And the White House . Well, i was a voting Rights Lawyer before i came to congress. I can tell you that if i could wave a And'>Magic WAnd in this country, i would fix our Voting System And i would make it free And fair And as easily accessible to every eligible voter across the country. I believe in competitive elections. Ive never had an election that wasnt competitive. I think that it leads to better leaders in both parties And it tamps down some of the impulses in those parties that can lead to some of the extremism were seeing now. So to me the only choice we have in washington is to pass some of the voting Rights Legislation the house has passed And find a way, whatever it takes, to get it through the senate, to get all 50 of our senators onboard with the single concept, which i think weve already gotten to that point And then figure out a way past the filibuster. Because what were seeing now, nicolle, this is more explicit And more dangerous than anything weve seen really since the jim Crow Era And maybe even before that because we didnt have the history And the And-everything'>Diversity And Everything we have now. This is trying to take us back And rip us back to a previous era And to try to take away the rights of texans. Whats happening here in our state is a tragedy And it doesnt represent who we are. I promise you, i was raised by a single mother who was a public schoolteacher. This is not who we are. Theyre trying to make it so we Cant Change it through our democratic process. I more than agree with you. Ill oneup you. Republicans wont stop until they have used the line to legislate a way to keep winning elections among voters they know arent into them. I guess my question for you is you talked about getting to 50. Obviously thats not enough until you do away with the filibuster. Would you work to convince the white And-senate'>House And Senate democrats to do away with the filibuster . Ive done little else to try And find a way And ive been arguing for months that we should have an exception for voting Rights Legislation because its so fundamental. Its not like other legislation that comes to the senate floor. Its not like Revenue Bills or what were going to do with our Military Or Anything like that. Its about the fundamentals of our democracy. If were going to have a carveout in the filibuster for justices, for the Supreme Court, for judges And our federal courts, for nominees to the president s cabinet, those are all supposed to be so important they shouldnt be subject to a super Majority Vote. I believe the voting Rights Legislation should have the same treatment. Whether thats changing it to a Speaking Filibuster or saying that a simple Majority Vote in this case is all that it requires for legislation of this kind, i think we have to find a way around this. I recognize And i understAnd that we have members And senators on our side who believe that the filibuster has a purpose And that may be true. I disagree with them, but i understAnd that thats their point of view. But in this case, we will not get ten republicans in the next 50 years, as you just said, to join us in trying to protect the right to vote. But if we do protect the right to vote, we may produce republicans who will be there with us afterwards because the pressures will be different in their party true And the Incentive Structure will be different for them.
