S good evening from New York, im chris hayes, the first Big High Stakes political test of the biden era and the Post Trump Era is happening one week from today. The Recall Election in california, faced by gavin newsom. Forces have come together to try to replace governor some. And the man best position to replace him as Larry Elder. He is a Farright Talk Radio host, been won four years, no governing experience. He opposes Abortion Rights and the minimum wage. Recently told me that he would replace Diane Feinstein with a republican. He told Stephen Miller he wants to see him become president. Crucially, Larry Elder is also spreading the Big Lie. The 2020 election was full of shenanigans. My fear is, they will try this right here in recall. Go to elect elder. Com, when you see anything suspicious, tell us, we will file lawsuits. Yes, this snooping on your neighbors for suspicious activity, its a fad now in rightwing politics. And one of the highest rated candidates pushing in disinformation, in addition, there have been a slew of rumors going around online. One, got out of hand in torrents, california, where a man was found passed out. Among the many items found in his car were loaded firearm, drugs, thousands of pieces of mail, including more than 300 mailin ballots for the special election, according to police. Some farright websites pounced on this and claimed it was evidence of democrats trying to steal the election. But there is no indication when wear the other, right now. Lets take a step back. We are talking about california. If elder were elected, and newsom were recalled, it would be a shocking upset. It would change the politics in the country. But at the same time, it should not be shocking to conservatives that it is an uphill battle for them to win statewide office in california. I think it is revealing that they have already begun to see the Big Lie as the explanation for the outcome of the recall race. Already folks are blaming it on nefarious forces. Instead of what is obviously true. We dont know, again, it could go either way. But the possibility that Larry Elders ideas, like women should not be able to have abortions, for instance, are just unpopular. Or that after four years of Donald Trump, californians may not want to put a rightwing Talk Radio Host in charge of the fifth largest economy in the world. In the case of the california recall, you can see how insidious and malleable this Big Lie is. How much it looms over conservative politics. If every election is stolen, you never have to confront the realities of why you lost. And maybe the voters dont agree with your policies. This is generally the case for conservatives in california, who have not had a great run. The Big Lie is also useful for Donald Trump, who has called for the most. Thats not an accident. We have had three oneterm President S in the last several decades, who lost their bid for reelection, after being elected by The Public. Since 1980. Jimmy carter, george h. W. Bush, and Donald Trump. Jimmy Carter And Bush were not wielding outsized influence in their parties after being rejected. Far from it. Carter returned to georgia, focused on Human Rights and diplomacy. Bush also moved back home and lived mostly private life. In fact, being a loser tends to be detrimental to your political influence. People dont come running to you for advice. And Donald Trump is a loser. He squandered the advantages of incumbency, and yet retains their Total Control of the republican party, in part because he has fostered the Big Lie. This false story about fraud that trump and his party created continues to spread. It also plays a useful role in their efforts to tilt the Playing Field in their favor. They are still working to make it harder for people who may lean democratic to vote. Most recent example . One of the most egregious today. Republican Governor Greg Abbott have texas signed into law that new restrictive voting bill, which bans measures that make it easier to vote, like 24hour and drivethrough voting. It also prohibits election officials from sending unsolicited Absentee Ballots to voters. Prohibiting voting by mail. And Increases Access by partisan poll watchers. Greg abbott is feeding his partys lies, including the conspiracy of widespread election fraud, thats the reason for the new bill. Claiming that this new bill is good for the enfranchisement of texans. The Texas Law makes it easier than ever before for anyone to go cast a ballot. It also, however, makes it sure it is harder for people to sheet at the Ballot Box in texas. [applause] fascinating. Its partly how we went over the line. But harder to cheat gets all the applause, easier to vote gets no flaws. Notice he said the law will make it harder to cheat. Thats the justification. It doesnt really stand in this case or any case. We have to keep people from cheating. But thats always the justification. We know it is baseless. The case of texas, right . They ran the experiment in texas last year. We covered it, it was one of the most interesting things to happen in Voting Rights recently. In Harris County, which is where houston is located, officials introduced a bunch of these measures that are now banned. Like, for instance, Drivethrough Polling and 24hour voting. There was no cheating. An Election Security Task force even investigated and found nothing. Think about it for a second. Why would coming in a car be more open to cheating then walking in . Why would voting at 10 00 at night be more sheet friendly than 10 am . It does not make any sense. Republicans in texas also did well in the 2020 elections, they won a bunch of contested house seats. Donald trump won the state by more than five points. Even in blue counties, where methods were implemented. So whats the big deal . Texas election should bring nothing to fear for republicans. But what are they doing . They are taking proactive steps to make it harder to make it for those folks to vote. People who work shifts, for instance. To limit the people who have the opportunity to go cast a ballot. All to make it, quote, harder to cheat. So the lies continue to spread. Its everywhere now, from california, to texas, everywhere in between. Different states banding about their own audience. The lies are so ubiquitous and insidious, marshall in so many ways, it is an obstacle to the basic mechanism democratic accountability. In every lawsuit, if every Losses Fraud or cheating, if you are not buying into the elections as a determination of democratic politics, you are trying to bring about something that is not a democracy. Our next guest is part of a lawsuit challenging the law that Greg Abbott signed into law. First, tell me about the lawsuit you are part of, to try to block the law that the governor signed into law today. The Harris County elections administrator, brought her lawsuit, and we are joined by several other organizations, including the mexican american Bar Association and others, and civic organizations. They all have the same goal. To make it easier for folks to access the polls and participate in political processes. The governor has made it more difficult so we are taking him to court to advocate. The attorney for this county who implemented these policies, what do you think of when he said, harder to cheat . When you think about the Voting Methods that you are county pioneered . Certainly in texas there are justifications for these restrictions on voting, they are ever moving. He one was purity at the Ballot Box. Im sure we know what that means. And there was uniformity across the state. But what we noted be true is that the fifth Circuit Court of appeals, in a decision that included republican appointed justice, said there is no effort to include persons convicted of in person voting fraud. Its the Big Lie perpetuated by Donald Trump and members of the same party, so they can undermine the innovations in Harris County to expand Voter Access during the pandemic. And stop them from voting. Some texas republicans came quite close to just saying what they are on about here, went back earlier this summer, House Bill to 41, which called for an independent Third Party appointed by the states top gop officials, to conduct an audit of counties with more than 415,000 people. Of the 13 counties that meant that criteria, ten voted for biden. This is the subtext, the big, more diverse and urban counties, thats the Pace Place where the bad votes are. Exactly. These counties, where diverse leaders have been elected, we dont look the same as other leaders. One Gop Leader said he wanted the Session Election to be the worst in texas. And we have seen that with recent laws passed meant to undermine diversity in our state. I have talked to people i went to Law School with, and they think that these laws it is not. That is why we filed this lawsuit, to show State Leaders that we will not sit back and not defend our right to participate in the political process. This information from republicans has played an outsized role in matters leading up to the election. We know that california is going to play a decisive role in the outcome. And early polls show the teen oh strongly supporting the recall. And supporting recalling newsom. Part of that is that there was so much disinformation on Social Media that specifically targeted latinos. The idea of voter fraud, things like this, i had latino relatives of mine sending that very story that you are talking about, believing in it. And it has been incredibly widespread. But now that newsom is making more of an effort to campaign in these communities of color that will be decisive in the outcome, some of that is beginning to change. And now you start to see polls beginning to reflect that, 66 of latinos not trump, im sorry, they are against the recall in support keeping newsom. And they are the ones who are driving the fact that california voters are largely in favor of keeping him in office. Its interesting to see. I saw some conservative pundits, again, speculating, that some sort of nefarious activity would be to blame if newsom were to stay. It does seem that elders politics are a key part of the problem here for republicans. And you would think this occasion would prompt soul searching. The Ex Mayor of san diego is running, he is not someone that i dont think Liberal Democrats would like the guy, but he would be a more plausible alternative. But elder is the one that the base wants, who is attracting the attention. And rather doing soul searching, you see this retreat to the stories about, they are out to get us. Exactly. Because the election this election is fundamentally about discrediting the idea that a multi racial democracy can work. And discrediting the idea that diversity strengthens the economy and improves safety for everyone and that is a reason that the recall was launched in the first placed. Anti immigrant nativist who were upset by newsoms policies. Latino leaders tell me he has been the most latino friendly leader we have seen, extending coverage to undocumented seniors, providing assistance to undocumented workers and investing heavily in education, which helps working class californians. So thats all we have to do, to look at the information guides. It talks about how newsom was too friendly to the chinos. And thats why we see Larry Elder, he represents that White Supremacist worldview. I know it sounds crazy to a lot of people, because he is a black man, but he has made a career out of advancing White Supremacist talking points, including a wellknown White Supremacist named jared taylor, Who Maligns Black and brown united states. He quoted him and he is the reason why Stephen Miller has a lot of his beliefs. He mentored Stephen Miller from the time he was a teenager. The fact that, if you malign and demonize black and brown communities, you are not necessarily racist, that idea. But that of course is completely false. Yes, i should note that elder has taken the new face of White Supremacy line. And taylors his Campaign Talks with that line. But people should check out your book, jean guerrero, thank you so much. Thank you. Next, despite Kevin Mccarthys very temps to derail the investigation, the Committees Work keeps turning. How about a massive document requests, records, communications for that day. As the house January 6th select committee moves forward with its investigation into the causes of the insurrection, republicans are trying to pull a Jedi Mind Trick and make everyone forget about everything they did leading up to that day. Last week, in response to the House Select Committee requesting Telecom Companies preserve records of a group of republican lawmakers, Kevin Mccarthy threaten those companies not to comply. Saying a future republican majority would punish them. This week, during a live news appearance, mccarthy tried to scrub the record clean for Donald Trump. Another question that the democrats want to know, hes how deeply was the president involved . You know it is interesting, thats where Law Enforcement comes in. The fbi has investigated. The senate has bipartisan committees that have come back. You know they have found . There is no involvement. This is purely political and how Nancy Pelosi has handled this. Thats interesting. It seems that mccarthy is basing that claim, and guess what, nothing to see here, off of this reuters report that quotes former officials. But chairman bennie thompson, and Vice Chair Liz cheney, shot that down, saying when the report was published, the select Committee Query the agencies involved. Weve received answers and briefings from the relevant entities, and its been made clear to us that these reports are baseless. We will continue to pursue all elements impartially. The report is likely to have something to do with the agencies demanding records from agencies, including from rudy giuliani, mark meadows, trumps three eldest children, first lady melania trump, Michael Flynn and former white House Strategist stephen bannon. A deadline of September 9th has been set. Our next guest is fromthe daily beast, asawin suebsaeng. Lets start on that document request, this is different from the Telecom Companies, and those federal agencies are in a position to furnish this stuff. This is not something we anticipate, i think, to get hung up in court. What is your understanding . My understanding is that for the past several Weeks Trump has been huddling with close advisers in order to Game Plan different ways to address these different requests. As you mentioned, there are different facets to the investigation, when it comes to records requests, to try to see which elements he will be able to try to stall, if not completely hobble the investigation. By invoking executive privilege. That may sound we are to some viewers, because Donald J Trump is obviously no longer president. By the Day Something he and his lawyers have discussed behind the scenes, to try to use to make an argument about not just his presidency, but all future presidencies. The funny thing is, when you talk to people who have spoken to trump about this in recent weeks or days, they will tell you that one of the people he brings that most frequently, when he talks about executive privilege, his former white House Chief of Staff Mark meadows. He gets in a tizzy about why any Chief Of Staff would have to be six subjected to this quote unquote harassment. Kevin mccarthy and his answer to the News Program was interesting. I thought the response from Thompson And Johnny was also interesting. A piece about something that had vanished down the memory hole, which is that mccarthy himself had called for some kind of inquiry into January 6th. You followed up on that and found that, basically, there is no appetite for that anymore. Chris, wouldnt shock your audience, that this wasnt the most good Faith Declaration . This was a situation, we are back in july, Kevin Mccarthy said in response to the moves that pelosi and others were making, that republicans would mount a counter investigation, to trot out another narrative that happened during the lead up and during the Prodrum Riot on Capitol Hill. Obviously, months have passed, we followed up with various sources on and around Capitol Hill and elsewhere in the senior ranks of the republican party, to ask about movement on this. We could not find barely a shred of evidence, that there actually is any movement. Its something that even Donald Trump has moved on and doesnt care about anymore. This was almost certainly, unless something dramatically changes, another, hey, look at this shiny object over here, a trick that the republican party has been doing ever since january 7th, basically. There is also that letter from House Republicans to the Telecom Companies. That is very interesting, partly because mccarthy is subject, it appears, to that records request. That could be a big legal showdown. A bunch of republican house including marissa mayor, who left Yahoo Years ago. Not a great look. Not sure who is doing the staffing. To make real on the threats that others and mccarthy have been offering. Yes, and it goes to show the seriousness that they are examining that come with a congressional probe like this. Its yet another example of how, especially during the trump era, that republicans have largely disposed with this idea of leaving Big Business alone, and having this small government conservatism, that was barely hanging by a scene before Donald Trump came along. But it is something that they have complete turn the mask off of during the trump presidency, wherever He Nightmare about a far left democrat getting into the white house, or taking the reins in washington, and cracking down on business, they are doing exactly that. So they can protect their dear leader Donald Trump. Boebert won a republican primary, Riding The Wave of controversy she generated when the Gun Themed Restaurant she owned defied local Covid Orders and continue to operate despite a Cease And Desist letter from the sheriffs office. Congresswoman boebert has reliably generated outrage with her trumpish style of politics, after clashing with security over Metal Detectors after what was or when she showed up for a zoom congressional hearing with a massive unsecured guns piled behind her. Or last week, when she said she has a plan to remove biden, Harris And Speaker pelosi from office. That is congresswoman laura boebert, a mega republican from a deep red district, whose Number One Policy Idea is carrying guns, without worrying about them being reelected. This is what it could look like in the future, we shaping the entire western half of the state, which geographically speaking is currently almost all of bobers district. This is still a work in progress but it is possible that Boeberts District could be merged with that of Joe Neguse, the Liberal Democrats who rose to prominence as an Impeachment Manager during trumps second impeachment trial. Nothing set in stone, and boebert can decide in a different district. But Joe Neguse believes there is an incredible chance that boebert could be his opponent next year. He currently represents colorado second congressional district. He joins me now. First of all i am always fascinated by how members of congress get their information about redistricting. Because obviously it is massively important inconsequential for you. What is your understanding of where things stand and how possible it would be that you would square off with Congresswoman Boebert . Good evening chris, i found out the same way that members of The Public did, when the map was released by the commission on friday evening. As you said, the maps could change, and i suspect they are likely to change. The commission is independent here in colorado, working to try to emulate the independent style of redistricting that we have here in colorado. Time will tell, ultimately, and still we will see with the final math looks like. We will be prepared for any outcome, of course. But this particular campaign, to the extent that the lines are finalized, will be an interesting one, as you astutely described. Our World Views could not be more different. Our worlds you and represent vision will make for an interesting campaign. I want to talk about that in the second. But you mentioned the independent commission. Some states like colorado have an independent commission. There are others, virginia and oregon. And as the Colorado Sun pointed out, in virginia and oregon, new congressional maps drawn by commission are unlikely to give the party its advantages that it could have otherwise enjoyed. Meanwhile, republicans havent given up their power. I think both you and i agree that, as a policy matter, these commissions are better who then politicians picking their voters. But there is a weird unilateral disarmament where democratic controlled states do that, while the republicans maximize the states seats that they can put together. I take your point. And i agree with you that extreme gerrymandering has been pervasive and insidious across the country, in particular republican led states, like texas and florida. We are clearly you have legislatures that will work to corrupt the redistricting process. Ll wbut i dont believe that Tht Fact compels democrats to be the same. Far from it. As a policy matter, republicans democrats believe in good governance. That means nonpartisan redistricting. That is wildly popular on a nonpartisan basis. Colorado, has a relatively new style of redistricting. It was approved by voters themselves on an overwhelming basis three years ago. Voters made the right call. Politicians shouldnt be in charge of drawing district lines, that job should be handled by a Non Partisan Commission like colorado has. This underscores the real necessity for us to recognize gerrymandering as a form of voter suppression, and why legislation like hr1 needs to get across the President S desks. Because, as you know, many states have already we embarked on this redistricting process. Last point, just to bring it back. To me, what this example shows is that it is so powerful when you control the lines. Because you could put a map where you could face off against bober, where you would trans her, or she would trans you. Regardless of your abilities as a member of congress, there is a certain degree to which drawing the map is determinative of outcomes. Not entirely, but pretty far. And you can see it when you think through these thought experiments. Yes, look. I think its a reason why nonpartisan Redistricting And Reapportionment commitments, in terms of legislative maps, are the way to go. The voters should be in charge at the end of the day, and by extension the citizen based commission that we have in corrode colorado, and that we have in many other states. Politicians and candidates ultimately need to be comfortable with letting the chips fall where there may. So im certainly supportive of the measures we have taken in colorado. It is important to keep in mind how these vaccines have been holding up, even with delta. My best attempt is to say that the covid risks for most vaccinate people are of the same order of magnitude that people except every day, like riding in a vehicle. But of course now, again, and of summer, Something Front of mind for policymakers and parents, is the fact that we have a huge unvaccinated population entering indoor spaces. School children are entering the third School Year affected by the pandemic, and looking once again at a huge increase in transmission as the year progresses. Where delta has been running rampant. You see those Dark Red Counties where cases are running high. In florida, where the governors fighting School Mask mandates, Hillsborough County public schools saw 8400 students in isolation because of a positive test or in quarantine after coming into close contact with someone who tested positive. That was after just one week into the School Year. Meanwhile, in texas, nearly 52,000 students have tested positive in the past three weeks. People generally felt like, oh, they are not reliable, they get false positives. My understanding is that they have gotten better and they are now being used quite well. What is your general feeling about their accuracy . Its a terrific question. The rapid tests are very accurate, if your goal is to ask the question, am i infectious right now . And for that question, they are extremely accurate. We continue to compare them to medical diagnostics, which are not designed to give you an immediate results. Instead you get greater sensitivity. But they can be sensitive for a long time, continuing to tell people if they are positive even after theyre not infectious. So they tell you, am i infectious right now, and if so, that means you should be isolating because you dont want to spread to other people. I think that is a great way to frame the question. Thats where it does seem so crucial in transmission. I have to say, i have used them a bit. First of all, for folks who have not, they are kind of like pregnancy tests. You do a nasal swab, and it gives you the bans 15 minutes later. So the question of am i infectious right now . Like, if you are going to see some friends. That is a useful thing to answer. And it seems like if we were doing that at scale, we could stamp out a lot of outbreaks, certainly prevent superspreader events. Thats exactly right. In fact, we published earlier in 2020, we started Publishing Papers that show exactly that. That if you can have enough people, Finding Out that they are infectious, and be able to self quarantine, it doesnt need to be near perfect, but just enough people, then you can actually sever Transmission Chances and stop outbreaks from growing. And not having to lock down schools, Lockdown Schools or businesses. We could have truly prevented the massive outbreaks that we saw this past Fall And Winter. And we could have prevented major lockdowns, and ideally save hundreds of thousands of lives, potentially. The netherlands is a place where they are making these fairly available. How important is it to bring down the Cost And Scale up availability . Its the most crucial thing we can do right now. To scale up availability is when i have been calling for for over a year. Im glad that people are now starting to see with their own eyes what exactly these tests are. And we can give these two massive numbers, scale them so that each american can have access to these, on an ongoing basis, and help us get through this pandemic. These tests can be produced, especially the rapid antigen tests, they can be produced for very little money. We are seeing across the globe that they are actually selling for one or 2. Usually, thats with government subsidies. We could be doing that in the united states here as well. Yeah. And i read that somewhere per Unit Price Cost is about 80 cents. Lowering the barrier as well, getting a Pcr Test is an undertaking. Even if you are careful, like, lets say your kid coughs a little bit. You are thinking, oh, i dont know. You could take them to go get a Pcr Test, wait online, wait a few days. But if you have one of these around, its like, ok, you coughed a little bit, lets just see. And i just think it would really be a gamechanger, on top of vaccination, obviously, which is the most important way to fight this to have that level of accessibility for people. Absolutely. Its the bandaid model. If people didnt have any bandaids in their home, and their kid gets a cut and you have to go to the doctor to clean up that cut and put a bandaid on it, most people would just not go with a bandaid and you would get more infections. Accessibility is the Number One thing we need here. I want to see a day where people, especially during this pandemic, can just go pull one out of their cupboard without thinking about it. And say, hey, my kid is not feeling well, before they go to school, lets use a simple rapid test, a 32nd test, and be down with it. That alone could lead to massive gains to stop spread across our population. The other thing i note here, as we are up against this barrier, with tens of millions of people not vaccinated, and some of those folks hardtoreach, some dead set against it, i dont think there is the same mobilization against Rapid Testing.
