Cases skyrocket, and students, the majority of whom are not yet eligible to be vaccinated head back to class. Welcome to mtp daily. A couple of big victories for republicans in texas with national implications. The biden administration and democrats in congress are looking on after a summer of broken quorums and bolt from the statehouse, the controversial Voting Bill got greg Abbotts Signature in the last hour. The final Version Bans drive through and 24 hour voting, establishes new Id Requirements for mailin balloting. Criminal penalties for Voting Law Violations and empowers partisan poll watchers. The Supreme Court Let Texas near total Abortion Stay on the books for now, effectively bans abortions after six weeks, before many know theyre pregnant. No exception for Rape Or Incest and gives 10,000 to anyone that sues someone that helps give an abortion. They have public opinion on their side. Heres what they dont have. Options, or not many of them. Speaker Nancy Pelosi is promising action on Voting Rights and you know for row versus weighed to be law would need 60 votes in the senate. Almost certainly a nonstarter. Also need a change in procedural rules if that doesnt happen, given moderate democratic opposition, that also is almost certain not to happen. Lawsuits have already been filed against the Texas Laws with a judge temporarily shielding some Abortion Clinics from lawsuits. Those cases may take awhile, they may run into judges less sympathetic. On the federal level, the Attorney General pledges to look at all options, to challenge the texas abortion law, protect clinics and reproductive rights. It is not clear what the Justice Department can do, what power they have in the wake of a Supreme Court decision. Bring in Priscilla Thompson and Jane Tim who follows all things Voting Rights. Abby livingston, Washington Bureau chief is with us as well. Talk about reaction from democrats in texas as of 1 00 eastern this afternoon. Reporter yeah. You know, hallie, democrats knew this moment was coming a few weeks ago whenever that House Hearing was held on the bill before it went to committee and made its way to the governors desk. What i heard from them then, what i am hearing from them today is that there are still 90 days until the bill goes into effect, theres still time for something to happen at the federal level. They are pointing to what the house has already done working to protect federal Voting Rights, and calling more urgently on the senate to act and do what must be done to protect Voting Rights, certainly before the bill goes into effect in texas, but if not that, before Election Day comes and goes, and we saw that Bill Signing happen just a little while ago. The governor holding the bill up, proudly proclaiming that Election Integrity is now the law in texas, republicans continuing to say this bill will make it easier for eligible voters to vote and harder for people to cheat, but democrats do not see it that way. When they look at restrictions like the ban on overnight and drive through voting, the new Id Requirements for vote by mail and new criminal penalties for Election Workers who want to do things like perhaps send unsolicited vote by mail applications to people already qualified, democrats are saying this isnt going to make it easier for people to vote, it is going to disenfranchise black and brown voters, voters with disabilities. Thats why over the summer we saw hours of hearings on the bills, these protests, quorum breaks that democrats did, and all for this to happen. I have been asking democrats, was it worth it. They see the action on the house side, and that they expect action on the senate side. They bought them time. On the legal side of this, jane, talk about the legal challenges to the law, what might be out there, what might be possible, what might be realistic. So we know theres two challenges before the law was signed moments ago. Democrats voting Rights Attorney Mark elias filed a third challenge, arguing it is unconstitutional, that it violates Voting Rights by making it harder to cast a ballot. I think democrats learned in the past they cant keep relying on courts to overthrow these voting rules they dont like that we have seen time and time again, federal Voting Rights laws essentially limited. Saw section two limited, Saw Section five, tossed that effectively. Again and again, democrats need to pass better legislation. Were just not seeing appetite for movement in congress. Theres such a long to do list in september and october going into it, im not seeing the attention to doing that. Democrats are going to have trouble trying to get these loss tossed out in court. President trump also filled a lot of the federal bench with a lot of his appointees who may not be as open to tossing laws out as maybe someone else. Abby, pick up on that thread that jane is laying out, the idea that any movement on the filibuster as relates to getting roe into law. Stay with me in the weeds as relates to Capitol Hill where we are. I cover washington, too, i just dont see in talking to folks here a ton of appetite for the filibuster for procedural rules to change to get it through the senate. Very likely to get through the house, right, support for it in the house. Different story in the senate. Gut check me, abby. It is the same thing, when i talked to state legislators, theres so much hope that we seasoned washington people have seen this over and over are less bullish on. What i can say is House Leaders told me over and over while maybe jaded people like me were skeptical that the Lobbying Effort over the summer were successful, they did feel the pressure, they did feel the national spotlight. I think there were some moral victories, but theyve got an up hill climb. The other thing adding urgency, the texas elections are typically early in the primary season. Lets talk about texas politics. You are both a national Politics Watcher that knows texas well, Texas Laws that we talked about, pretty outside the grasp of National Democrats at least right now. Can you talk a little about a year ago, you know what i mean . You and i were talking about is texas going to be up for grabs in the election, right . You now have two huge conservative priorities on Voting And Abortion pass in texas. What is the State Of Play in texas politics now . Thats a good question that i am trying to answer. It is hard. Two years ago, texas republicans took pretty significant hits, especially at the state legislature. They had a pretty conservative, and i dont necessarily mean ideological, but small ball legislature. Theyve gone all the way this year on Legislation Theyve had on guns, abortion. The question is the texas urban rural divide. How much backlash will there be in West Houston where theres a lot of motivated prochoice women. Those are questions ahead, how Big A backlash is coming. As we have been talking about, Attorney General Merrick Garland said the Justice Department is exploring all options to challenge one of the laws in texas. The restrictive one on abortions, and promising to give Support Seeking and providing services. Okay. What does that mean . Let me bring in Julia Ainsley and cynthia oxney. Good afternoon to you both. Julia, let me put up his statement and what he said, saying all options are basically on the table here. Urgently exploring these options to try to challenge the texas law. People see this and a lot of people wonder what are the options. I get that doj may not know what the options are right now, but what is even in the realm of whats being discussed . Well, it is hard for them, hallie. This law was passed in a way to try to be challenge proof. In the past, if there was antiabortion law coming from states, it would be routine for the Justice Department to say this is a violation of Roe Vs wade, therefore will go to the Supreme Court, have them weigh in and it will be struck down. This particular law from texas really didnt address rowe versus wade because it doesnt put enforcement on the state, puts it on the citizen, the person that decides to privately sue anyone related to helping a woman get an abortion. Until one of the lawsuits actually happens and the federal government can challenge it and see that make its way to the Supreme Court and there can be open, oral argument before the Supreme Court about whether or not that person has standing, it is hard for them to challenge the law. And it was written that way, hallie, written to be challenge proof. All that Merrick Garland is talking about is using the face act, supposed to protect women that might be intimidated out of getting an abortion, protects the physical property of a clinic. As we know in texas, by and large, most abortions have come to a halt after the Supreme Court decisions. There arent enough people going in there to protect let alone abortions being provided that could trigger one of the lawsuits that would then make its way to the Supreme Court for the arguments that i talked about to happen. Theres a lot of Chicken And Egg coming here, and it is tough to see exactly what they could do honestly. So good point, julia. Cynthia, talk short term and longer term hypothetical. Before any kind of lawsuit is filed and this potentially goes to the Supreme Court, is there anything else from your perch as an observer, somebody that knows about Inner Workings of legalities, is there anything else the Justice Department should or could be doing now in the short term that would make a difference . I really dont think there is. Thats the problem. You can protect those people that are seeking an abortion who are fit within the Texas Statute prior to six weeks. Theres a lot of talk about using 241 and 242, civil rights statutes, but i dont think thats going to happen because given that the Supreme Court said this statute can go forward, garlands hands are really tied. I would like some action, but i have to say, i dont think you can criticize the Attorney General at this point, he doesnt have a lot of options. We really need the congress to act. Theres all of this discussion about well, they shouldnt bother because they cant get the votes, cant go with the filibuster, they cant, they cant, they cant. I am over that. Put something on the floor, get a vote. Put people on notice. If you cant get it now, well run against them and have a record. Republicans have been able to sort of hide behind this, we havent put anything on the floor, been able to hide and get away with it a long time. Thats part of the problem. We need to put people on the record now and regularly. Choice act and then a Choice Act with or without exceptions for rape and incest, come up with creative acts over and over so the republicans have to make a record and we can beat them because the american people support having a woman be able to control her own body, and lets take advantage of that. Talking about Polling Showing from Nbc News showing a majority of americans, over 50 , believe women should have safe and legal access to abortion. About 40 think that should not be the case. Cynthia, youve talked about what can be done legislatively. Let me talk about the judicial piece. Julia notes and notes well, the law was crafted, designed to be challenge proof, thats the attempt. I wonder if the crux of the challenge, the vigilanteism, bounty hunter provision, that lets people that dont live in texas or have connection to the patient seeking an abortion sue people who help anyone get an abortion past six weeks. Do you see the legal challenge we get to eventually here if a lawsuit is filed, if it gets to the Supreme Court, is that the construction of it, that provision . I dont think so. I think the Supreme Court will rule in the Mississippi And Theyll overturn Roe V wade and that will be it. The way it is designed with the bounty hunter system, it was designed to give the Supreme Court an out so the antichoice people had a way to look the other way when essentially Roe V wade has been overturned and will be copied in the south. It has given them excuse to pretend theyre not doing what theyre doing. If the constitutional right had been gun rights, if massachusetts said im sorry, we dont believe you have a second amendment right, and were not going to enforce it, well use Bounty Hunters to enforce, it would have taken a par a second for the Supreme Court to overturn that. I think it is sneaky, disingenuous that they looked the other way, i have no tolerance for it. My guess is my legal Opinion And Guess is that when the Mississippi Case comes up this term, theyll overturn Roe V wade. Thanks to you both for your reporting and perspective. As a Health Care worker, professional in this space, how do you communicate about the trajectory when people might be feeling desensitized frankly to some of the warnings in the last year and a half. New york times i think headline put it like this, unvaccinated people might be underestimating the risk, vaccinated people overestimating the risk. We somehow feel like were not just living in two worlds, talking about the pandemic of the unvaccinated, i think that created a lot more confusion to be honest in retrospect. I think the way to talk about the trajectory is Number One, the pandemic is global and it is not over. Number two, this is something that is actually different than last year, hallie, within our grasp. We can see rapid declining cases and continue to actually have hopefully a more normal prospectus on fall. I know were going to talk about that because of our ability to get vaccinated. The amazing thing thats different is effectiveness of the vaccine. Theres no question. Might be breakthrough infections, New York times talking about overestimating the effect is true. At the same time, take a step back. The trajectory can be altered because of our ability to vaccinate. You talk about effectiveness of the vaccine. Theres now a question of the Mu Variant and is it, whats the term the professionals use, evasive, can it evade the vaccine. Is it resistant to the vaccine. We dont know much. When will we know more about that. When you talk to people, how do you frame the level of concern that you have . Yeah. I think about everything in levels of concern that one, im always concerned when i see variants where we have the potential for evading immunity. That just means we need to keep an eye on it, dont want to be blindsided. Number two, the way i talk with family and friends, the majority of what we are seeing is delta, and vaccines work against delta. We have to get data about mu, thats on point. And we also need to know we are surveilling the country to watch for mu which we are doing. Were now taking 10 of samples of covid tests, doing genetic analysis. Thats good news. We can catch things before alpha and other variants where we got blindsided by it. It is critical to remind people we are in the thick of it now with delta, and mu is being dwarfed by delta. Globally, cases of mu are decreasing. That means where else are we seeing cases, with the Delta Variant. Thats what we have. Three effective vaccines against it now. Thats right. Thats the predominant variant, what were seeing most, and vaccines are resistant to that. Talk about booster shots, dr. P. We are two weeksish, dont know exactly when theyll be made available, probably for pfizer first. Last year, Mass Vaccination sites opened up, convention centers, football stadiums. How does that look when it comes to boosters . I smile not because it is funny, youre asking the questions that all of us are asking internally as Health Care professionals. When are we getting more information on boosters. We are already hearing about millions finding their way to get boosters, whether theyre supposed to or not. People that can walk in, get one with no questions. Some that are challenged and asked about medication lists. What it means in pharmacies and clinics is that september 20th, priority will be to make sure we have enough vaccines for anyone unvaccinated and that we give boosters as recommended once we get guidance from the fda and cdc. I expect pfizer will be the first with guidance. Millions that received moderna, myself included, wont be able to get boosters september 20th. We need better understanding how to talk to patients about this. And number two, i want people to hear this. Just because youre eight months out from second dose, dont mean at eight months and 14 days youre not protected. We likely have protection from eight to probably 12 months past the second dose. We just want to make sure high risk people, longterm care workers, Nursing Home residents, Health Care workers, people that have immune conditions can get boosters when they need it. I think thats critical. Im not scared but i think it would be nice to get a little more guidance. What we are telling patients, youre protected. For now, youre protected until evidence tells us otherwise. I see no evidence that tells us current vaccines arent protecting us. Great to talk with you. Oh, and the government set to shutdown the end of the month unless congress can agree on funding. Leigh Ann Caldwell on The Hill following this. I hope you had a nice and relaxing august. Your september is going to be bananas. Democrats have a lot to get done. Are lawmakers worried about the deadlines Coming Up . Reporter hallie, it will be a busy september and perhaps busy october as well. Probably the understatement of the year. And those are just things that crisises we know about, doesnt include things that are unpredictable. Theres a lot to be done, and democratic leaders are very well aware of the challenges they have, as far as the human Infrastructure Bill and bipartisan Infrastructure Bill. This is going to be very difficult for Speaker Pelosi and Leader Schumer to keep their party together, to pass this in the next three weeks. The senate doesnt come back in session until monday. The house doesnt come back into session until september 20th. And thats why you hear some moderates, including senator Joe Manchin who said just last week that democrats should take a pause, especially on this major 3 Trillion reconciliation human Infrastructure Bill. Hallie, these are also things that are part of the president s priorities, when you come to government spending, the government shuts down end of the month, they dont by chance, if theyre not able to fund the government, those are things that congress has to do. So this fall is mixed with things that the president and democrats want to do and things that congress has to do in order for the country to function, hallie. Leigh Ann Caldwell live on The Hill. Down the street, President Biden will depart from there to california at some point to campaign with Governor Gavin newsom ahead of the recall election. The trip will be early next week. Democrats try to line up Star Power for the final stretch before the recall. Their Closing Message is all about covid. New ads make a Final Push for Governor Gavin newsom as proscience, provaccine candidate. A notable approach, considering his handling of the pandemic is a big reason the recall is happening in the first place. Steve kornacki is at the Big Board. Great to see you. Give us the numbers. Where does the Race Stand at the moment . Hey, hallie, it changed. Let me take you through it. The backdrop in california, when newsom was elected in 2018, it was a landslide for him. 24 points over his republican opponent, almost always a landslide for democrats. State that Joe Biden carried by 29 points over donald trump. One of the bluest states in the country. And this recall is playing out. You look at polls three weeks ago, the recall looked like something close to a 50 50 race. These are the most recent polls that we have. Within the last ten days. Keep, meaning keep Gavin Newsom as governor, dont recall him. You see the Newsom Side has been winning in every recent poll. Not just that, you see a bunch of these clocking in in double digits. If you average everything together thats out there now, newsoms side, keep newsom as governor, now with a double Digit Lead on average in the race. Couple things have changed the last couple of weeks. Democrats paid a lot more attention, you are talking about that. Theres been more media coverage. And also, every voter in california got a ballot. California does something a lot of states dont do, not just that they have mail voting, they automatically send out Mail Ballots to every voter in the state. That might have gotten attention from people, too. Democrats hope the newsom folks have that strong partisan lean in the state kicks in. A week out, double Digit Advantage for newsom. By the way, we have one modern point of comparison. The recall in 2003, gray davis, he was recalled, schwarzenegger became the governor. A week out in 2003 the Recall Side was leading on average by 12 points. So the Recall Side was leading a week out by double digits. Davis was recalled by double digits in 2003. Now very different story in the polls a week out. Hey, polls have been wrong. Still a week to go. Well see what happens. And one quick post script. If newsom were to get recalled, second thing on the ballot, elect the new governor on the spot. Wide open race. Democrat strategy is to ignore this, telling folks just vote against the recall, dont vote in this election, theres not a consensus democratic candidate. Theres something close to a consensus republican candidate though, larry elder, conservative commentator, tv, radio. Polling suggests he would be best positioned to win that replacement race. Democrats are taking a bit of a chance here. Think newsom can survive the recall and thats it. But if that changes at all, this could be the biggest surprise of them all. Real quick, steve. Flash forward a week from tonight, youll be sucking up your Steve Kornacki juice, staying up all night. How soon after polls close will we know. Days after or basically this. We get a ton early in california. 11 00 p. M. Eastern, polls close in california. In the first hour, 11 00 p. M. To midnight i would say next tuesday night, were going to get something like twothirds of all of the votes. All the Mail Ballots, theyre counting them, Theyll Release them. If this is a landslide, lopsided race, well probably know then and there. But if it is close, comes down to a couple points, it might not be days, it might be weeks in california. It is a plank in todays republican party. We will not defeat covid19 if we dont beat back misinformation. It is not enough any more to just promote the science. We have been doing that 18 months. We have to aggressively and intentionally tackle the misinformation that is taking hold and costing people their lives. How do you do that, right, with all due respect, you dont run facebook. You cant get out there and take stuff down off social media. How do you hope to do it, what do you want to see of it . The surgeon general, look, this is a national problem. It was their report on misinformation that got us moving, it was their recommendations we put into action. A national problem will require local action. San diego, we have seen success, more than we are engaging with Health Care experts confronting. You may have heard this. This is why it is not true. So much of the success of trucks is replicated here. We are after 15 hours of misinformation. We will go to a panel of doctors to repute what is inaccurate. We will do everything we can to save every life possible. You talked about trust in mess owners. That is important when combating mi misinformation. People shutdown and turn away. That is not the way to get people who are taking in the misinformation to not get vaccinated. I wonder what percentage of people in the county who are not vaccinated.
