One week after that Nbc News has learned there is another far right Wing Rally planned for the u. S. Capitol. Believe it or not its goal is to demand justice for the hundreds of people charged in connection with the events of the last time there was a right Wing Rally at the capitol, the January 6th insurrection. By justice by the way i dont mean convictions and jail time. They want the opposite. This comes as a House Committee investigating the January 6 attacks continues to annoy republicans due to its insistence on finding out the truth about what happened on January 6th. Now republicans are unhappy that the committee has told Social Media and telecom companies to save records that are relevant to the investigation. In other words, standard stuff, including those of several house republicans, including the Minority Leader Kevin Mccarthy. Contrary to common sense republicans are also annoyed that one of their own, a republican, has been appointed to the Committees Number two position, representative Liz Cheney, has been tapped for the vice chair position. Some in the party are even demanding that Cheney And Representative Adam Kinzinger the other company assigned by Speaker Nancy Pelosi to the committee be booted out of the republican conference all together, deeming them, quote, spies for democrats. For having the gall to want to know the truth about the attack on democracy on January 6th. And now cheney and the select committee chair, benny thompson, are hitting back slamming mccarthy for making, quote, baseless claims during a recent interview, falsely stating that the Department Of Justice has concluded that the former president was not involved in the insurrection. Congresswoman dingell, good morning to youment thank you for being with us. Let me ask you about this first of all, the January 6th committee, the idea Liz Cheney is number two on that committee and they are asking for communications. We know Kevin Mccarthy was in communication with Donald Trump that day and if you want to get to the bottom of who knew what was happening and how, it seems to be standard procedures that we need to find out what those communications were all about. Ali, i think people have to look, the american people knew better what was happening than those of us who were trapped on the House Floor at the beginning because we did not have cameras. Anybody who has dealt with some of these people, i am someone who has had men in front of my house with assault weapons, knew what the potential would be that day because the president had been calling for this for days. We do need to know what happened. It was an assault on our democracy. There were people that died that day. Our Law Enforcement fought and gave their lives to protect and defend us. The Hate And Fear that is in this country is as Big A danger to democracy as anything i have seen. So this not wanting to get to the facts, denying the truth and the reality of the facts is deeply disturbing and i think one of the most fundamental i want to ask you about what happened in texas and the Supreme Court this week. You and your husband before you have been involved in many fights that led to women having Abortion Rights and the survival of roe v. Wade over time in this country. It is not gone but this is a blow that many people did not expect would sustain a visit to the Supreme Court. You know, this has stunned people across the country. It is an issue that has been resolved and codified as a Rule Of Law for 50 years. It is probably one of the not probably it is the most difficult decision a woman has to make and it is a personal decision between a woman, her husband, her faith, and her doctor. For this to suddenly turn up and turn the world upside down is putting reproductive rights and Womens Health back decades, and it is deeply disturbing and just going to be one more thing to divide this country quite frankly. I want to ask you, boy, there are so many big stories this week including the weather story, The Onethird of americans live in a county that has been affected by a Natural Disaster in the last month, at least this summer, including you. Youve had six floods in your district. We have had six floods since the last weekend in june. When the Rain Prediction comes people panic. I have three streets that the minute the rain starts the water is over the first floor in their homes. Fema has been here since The End of june. People are scared. They are desperate. They dont know what to do. Global warming is real. We have got to fix our broken infrastructure. Weve got to work together. You know, by the way, people in the midwest are frustrated this has been going on for what has been now almost months and that nobody cares. We all care. We got to work together to do something about this because just my hometown of Dearborn Has had 20,000 homes that have been impacted by these floods, some destroyed. I want to talk to you, we just mentioned we saw these Unemployment Numbers slow down, affected by delta virus, by the Delta Variant of the coronavirus. There is another problem going on that we are all Understanding But None better than people in dearborn, michigan. That is this Chip Shortage that has caused a shortage for cars. Youre actually headed for another shutdown not related to coronavirus but related to the Chip Shortage at a plant in your area. I thank you for bringing that up. I have talked to friday i called every person i knew at the white house, called the speaker steny hoyer, the senators. We have a crisis. We want to talk about what is going to happen in this country and all the other problems. We have an auto industry shutdown. There are things it is time for congress to act on in a responsible way together. Weve got to bring Chip Production back to this country. For the short term we need to be supporting other countries with covid precautions making sure theyre getting the vaccine. We shouldnt be dependent on foreign manufacturers to begin with. That Supply Chain needs to come back home. Those need to be dropped. Very basic stuff. Right now we arent getting what we need for supplies because covid is shutting down plants overseas. This is a real crisis and i hope Everybody Listening understands we need to work together to bring the Supply Chain back permanently to this country. It is one thing when we didnt have personal protective equipment and that stuff. We could figure out how to do that. But very important parts of our Supply Chain that affect computers, cars, and that kind of stuff. Bun includes the Budget Battle on Capitol Hill. Tell us what you know. Well, i also miss saying your face i should say. Its been a while since ive seen you in person. As far as the Budget Battle on Capitol Hill goes, the latest sort of turn is House Moderates are piping up and making their demands known to Speaker Nancy Pelosi in a Letter Theyve sent on friday. What theyre saying is they want the House And Senate democrats to work out their differences before hand so they dont have to vote multiple times on controversial provisions. They are saying that theyre willing to spend more on Climate Initiatives basically without offsetting those with Tax Increases because they think that the cost of inaction is not factored in by budgeteers and they also want a 72hour Period to read anything theyre going to vote on. All right. What part of that is a nonstarter for progressives . I mean, the thing is it is actually i think in a way a path forward for the progressives, because while The House moderates are saying theyre not going to vote on anything the Senate And House cant agree to ahead of time, we kind of already knew that, right . If Joe Manchin is going to go for 3. 5 trillion theyre all going to. If Joe Manchin is not willing to go over a trillion dollars they end up with a trillion dollars. I think this bolsters Manchins Position and at the same time shows a path forward for Speaker Pelosi and progressives. Jonathan, weve been talking a lot about the texas abortion situation. There is also a lot of talk about Judy Chu and her law she has been trying to pass since 2013, Nancy Pelosi saying she is willing to bring to a vote the idea of codifying Abortion Legislation, something we dont actually have in the united states. But then the question like the question on every other piece of legislation becomes what happens in the senate . Ten republicans are not going to come over to make Abortion Legislation a right in america. So what happens to this . In the short term it doesnt go anywhere. But i think that the speaker is trying to load up the senate with as much progressive legislation as possible to put pressure on the senate to change its rules, put pressure on members of the senate rather than members of The House when progressives are upset things arent happening. So that wouldnt surprise me at all if The House were to move that bill but at the same time theres either going to be a change to the rules or legislation like that is going to be stuck. Some major developments into the investigations into the deaths of Elijah Mclain and ahmaud arbery. You likely remember the video of two white men chasing and fatally shooting the 25yearold Black Man while he jogged in brunswick, georgia last year. Their trial is set to begin in february. Jackie johnson the former District Attorney who handled the case has been indicted for allegedly shielding the two men accused of Killing Arbery from being charged. Charges against johnson include violating her oath of office and obstruction. One of the two alleged shooters was a former investigator under johnson. After an a eight month grand Jury Investigation into the death of Elijah Mcclain clarjs will be faced in that young mans death. Colorados Attorney General says the five defendants will be charged with one count each of manslaughter, criminally negligent homicide, and other charges. Mclain was 23 years old when he died in 2019 after being placed in a chokehold by police. Paramedics arrived on the scene and injected mclain with ketamine to sedate him. An independent commission found the dosage would have been enough for someone 50 pounds heavier than he was. The deaths sparked protests and Police Reform in georgia, colorado, and around the country. Charges being filed against both a former prosecutor and paramedics in these high profile cases is a reminder it is not just our Police Departments that need to be reformed. According to the post researchers used several analytical tools to review thousands of Facebook Page publishers and found right leaning sources were far more likely to post misleading information than left leaning outlets and the Kicker Outlets on the far right received nearly 70 of all engagement on facebook. We should note a Facebook Spokesperson released a statement on the study that reads, quote, this report looks mostly at how people engage with content which should not be confused with how many people actually see It On facebook. When you look at the content that gets the most reach across facebook it is not at all like what this study suggests. The findings are particularly worrying in our current times of crises and public health emergencies. In the last year alone Weve Seen Ads and recipes for Phony Covid Cures go viral and millions of people still denying the science that says vaccines work. Perhaps the most concerning part of all of this is the proliferation of fake News And Misinformation is actually on the rise. Years after weve started talking about this. Last year researchers found that on Facebook Misinformation was more popular leading up to the 2020 election than it was in 2016. In fact, engagement with misinformation on facebook has just about tripled since the 2016 election. You see on your screen there were just over half A Billion interactions with Fake News per quarter in 2017 or just after the election. By 2020 there were about 2 Billion interactions with Fake News per quarter. Joining me now an early Facebook And Google investor and the author of zuk waking up to the Facebook Catastrophe and cohost of the sisters in law podcast. Welcome both and thank you for being with us. Roger, i want to put to you what facebook gave us as an explanation. Youre looking at the wrong thing. This is about engagement not how many people saw it. You understand the stuff much more than i do. What do you make of that response . Well, it is complete nonsense. The first part of the problem here is that engagement is what motivates people to bhauf. If you think about facebooks underlying Business Model, theyre in The Business Of Generating Engagement because engaged users are worth more to them. The best way to engage people is by provoking them to make them either outraged or afraid. And hate speech, disinformation, conspiracy theories, are the best kind of content for that. So facebooks algorithms promoted and the Recommendation Engines drive people toward it. When facebook says, this is not the right data to look at, the other problem is facebook doesnt give us any data. People have to guess. This particular group At Nyu has done extraordinary work for which facebook blocked the key researchers recently to try to keep this report from coming out. I will just tell you this is facebook operating exactly as it was designed. In my opinion it is such a threat to democracy, such a threat to our entire social organization. I just think something has to be done here. And joyce, i put that to you because you were a prosecutor for a long time. You teach law. But what is that something that needs to be done . There is the deliberate spreading of misinformation, not facebook is not spreading the Misinformation But Facebook gets a lot of money out of the spread of misinformation and disinformation. In the real world, nonvirtual, nondigital world, but how do we think about how we regulate this . It affects our politics, pandemic, our health that this is happening at this scale. It is a complicated and difficult question and to some extent that is exactly why people havent taken It On. For instance, there would be first amendment implications if the government tried to step any further into this space than it already is. But just like you Cant Cry Fire in a crowded movie theater, there are some legitimate reobstructions on speech. And so right now government essentially leaves it to the Social Media platforms to decide who does and who doesnt get banned, what sort of comments are taken down. There needs to be a thoughtful engagement between government, between the big Social Media platforms, and other stakeholders to come up with the forward Leaning Sort of a view in this area that protects americans from false information. That is the key here. How do we protect americans when information puts their health or even their democracy at risk . Roger, you said something interesting and you have said it for years, that this isnt a bug. This is actually what it was designed to do. And i dont know whether you and early investors in facebook knew it at the beginning or very close to the beginning that the salacious, the misinformation, that stuff just engages people more. People click on that stuff more than they click on real news, which is comparatively boring. So in Facebooks History this kind of stuff is relatively recent. It is really something they developed in their Business Model between 2011 and 2014. And they really pushed it hard and very aggressively. To Joys Point i think there are a couple things to think about. Facebook is like a government. And they have so much more control over our daily lives than our actual government has that i think we just simply as a democracy have to ask the question whether that is appropriate. But the second part of this is that were not talking about free speech here. I am not in favor as a generalization of banning people. What i am against is using algorithms to amplify the most dangerous voices in our society. That is a Business Choice Facebook is making for profit. It is not something theyre doing in the national interest. It is not in the interest of the users. And so i just believe this is much clearer than many people realize because it is really about whether we prioritize the people of the united states, whether we prioritize our way of life, or whether we allow companies like facebook, like google, to have their way and set the rules by which we live. Joyce, i want to ask you about another topic weve been discussing and that is the Texas Law and the supreme Courts Response to it. Weve heard the term a lot, Shadow Docket. Can you tell me a bit about what that means . So Shadow Docket sounds sort of devious and dangerous, but in reality this is one of the Courts Case Management tools in essence. Cases that are heard on an Emergency Basis often come up through this docket. For instance appeals on capital cases, lastminute appeals by prisoners about to be executed, but, also, these sorts of Emergency Requests like The One in texas to keep a law thats being challenged over its constitutionality from going into effect while litigation continues. It can take a long time. It can take years for a case on the constitutionality of a statute to work its way through the courts. So the basic notion here is that you enjoin the statute to preserve the Status Quo to present, prevent irreparable harm to people while that litigation is ongoing. The supreme Courts Decision not to do that in texas is very unusual. It stands in contrast to how theyve acted in other cases particularly ones involving religious liberty this year. And so while Shadow Docket might sound nefarious it is more how this current court has used it, making important decisions without leaving written decisions that explain their reasoning behind than the docket itself that is the problem i am substantially smarter for this few minutes with the two of you. Were starting to get a clearer picture of where things stand in californias upcoming recall election. New polling released this week may have Governor Gavin Newsom breathing a bit easier. 58 of likely voters in california say they do not support his recall. 39 do. Now, there is a lot going on right now in the world so unless you live in california this may be the first youre really thinking about this recall. Youre probably wondering how a democratic governor with over a 50 Approval Rating in one of the bluest states in the country is facing a recall. Here is how the process works. Ballots have already been mailed out to California Voters ahead of the September 14th election. Theyre simple. Two questions for voters. The first, shall Gavin Newsom be recalled . Aka removed from the office of governor. Yes or no. If more than 50 vote yes, newsom is out of a job. Whoever gets the most votes of the 46 candidates on Question Number two will replace him. That candidate does not have to get a majority of the votes. They just have to get more than anyone else. That is how newsom who got almost 62 of the vote when elected in 2018 could be replaced by someone with just a tiny fraction of that. The current frontrunner is this guy, Conservative Radio Talk Host Larry elder. 26 of likely voters say theyd pick him to replace newsom. About half of likely voters say they are either unsure, they dont like any of the replacement candidates, or they wont vote. Elder has a history by the way of making inflammatory comments. In a 2000 column for Capitalism Magazine Elder wrote, quote, women know less than men about political issues, economics, and current events, unquote. According to elder that makes women easier for democrats to manipulate. Perhaps most worrying to parents in California Elder said this week he doesnt think kids should be vaccinated, wear masks at schools, or that they really face any threat from the coronavirus at all. While Newsoms Position is looking somewhat safe at the moment one thing is for sure. The recall is the product of a flawed system. It is entirely too easy to launch a recall in the state of california in a state with a population of almost 40 Million people all it takes is about A Million and a half signatures to launch a recall, 12 of the votes that were cast in the 2018 gubernatorial election. In america if you dont like your elected official you vote them out in the next election which is by the way scheduled for the fall of 2022. As newsom attempts to fend off an ouster left leaning members of hollywood are campaigning against the recall. Actor Rob Reiner tweeting, while so much is going on the gop quietly attempts to add to their Power Grab by targeting california. We cannot let a party that stands for Nothing Control the most pop unite Louse State in the country. Save democracy. Vote no on the recall. The new Texas Law known as sb8 effectively banning abortions before most people even know they are pregnant is not just a disaster for women but could be a harbinger of things to come from a u. S. Supreme court that is shifting to the right. Or has shifted to the right. Chief justice John Roberts has in the past almost always voted with his fellow conservatives for abortion restrictions. But he disagreed in the Texas Case calling the ruling unprecedented because it not only bans abortions after six weeks but delegates the enforcement to private citizens, any private citizen regardless of whether they would typically have standing or even live in texas who decides to take the law into their own hands. Roberts argued the best move was to block the law and preserve the Status Quo while courts weighed whether texas could legally shield public officials from responsibility. But he failed to convince even one of the conservative justices to join him in those arguments leaving President Biden to wonder what other remedies were possible at the federal level. The most pernicious thing about the Texas Law is it sort of creates a vigilante system. I am not certain. I was told that there are possibilities within the existing law to have the Justice Department Look and see whether there are things that can be done that can limit the independent action of individuals. Putting aside the issue of whether the Department Of Justice can in fact limit the law one thing seems certain. The Texas Decision marks a significant loss for the Chief Justice. Joining me to dig into this my guests. Welcome to both of you and thank you for being with us. Melissa, let me start with you about the court itself. What this says about the court, what it says about John Roberts, and his influence over the court. And whether or not this is this case was thought about in the right way because there are criticisms even by sitting justices that this wasnt handled correctly. I think we need to compare what happened this week with almost a year ago in june medical services Versus Russo where there was a 54 majority. Justice ginsburg was on the court at that point. Chief justice roberts joined with the liberals to strike down a louisiana admitting law. He did so in terms of a lot like his opinion in the Texas Abortion Case from this week. He emphasized the procedural aspects, fidelity, and he had the numbers. This time he really didnt have the numbers. Justice ginsburg has been replaced by Justice Amy Coney barret and the Chief Justice is a head of a 63 super majority less concerned than he is with the courts institutional legitimacy and the optics of what these wildly aggressive moves mean and look like to the public. One of the things that you talked about when justice roberts did things that looked like they were not as unfriendly to Abortion Or Roe v. Wade you warned a long time ago dont go fooled by that. When it comes down to it this is not going to be a court that necessarily protects roe v. Wade. Well, we were not guessing there, ali. We knew because he had a long, long record. He was very, very transparent that he was not a fan of roe v. Wade, not a fan of casey and the cases that came after. As melissa says, what he is a fan of is the appearance that the court takes these things soberly and seriously. And so i think it is exactly right and i would just note a year ago when the Case Melissa is describing came down both she and i wrote he kind of changed the test. While he held out the idea that he was upholding precedent he was also slightly, subtly changing the test even there. So i think it is really fair to say there are two John Roberts and if John Roberts could just strike down Roe Tomorrow and find a way to do it that looked principled and sober he would do it in a heart beat. I dont think it would surprise anyone. What John Roberts doesnt like is sloppiness, the appearance that the court has gone rogue, and that is why he pushed back this week. Absolutely nothing to do with his personal preferences about roe which have been amply clear for a very long time. While he articulated that in a dissent, all the dissenting judges wrote about this, sonia sotomayor, melissa, has said this. She wrote this. The Courts Order is stunning. Presented with an application to enjoin a flagrantly unconstitutional law, engineered to prohibit women from exercising their constitutional rights and evade judicial scrutiny a majority of justices have opted to bury their heads in the sand. I truly have not read a lot of decisions in which that kind of strong language is used. Is she criticizing their judicial decision or is she criticizing the way in which this decision was arrived at . I think she is criticizing all the things. It is worth noting that although she wrote this decision in which Justices Kagan and breyer joined the Chief Justice did not join her decision nor did she join his dissent. She was making it very clear that not only has the court allowed a law that flagrantly violates existing constitutional precedence it did so under the cover of the Shadow Docket. We didnt really talk about this as a particular threat to Abortion Rights in the lead up in part because this case came up on the Shadow Docket. It wasnt on the merits docket. There wasnt a lot of anticipation. There wasnt full briefing or Oral Argument or a chance to ventilate all of the different arguments and i think she resentence the fact that this decision has substantive implications even though it is nominally a procedural Emergency Decision that the court issued. Wade but it is something evaluate that statement that adam has made. We seem to not be hearing her. Im going to ask melissa to answer that question. In effect what we have seen by virtue of allowing this to go into effect in texas is that the court has essentially allowed the surreptitious gutting of row. They are not performing abortions because they fear being held liable under this law which allows private individual to sue for any violations, and to Gain A 10,000 bounty from the clinics if they are actually to prevail on those claims. So, again, its a formal versus a functional distinction. As a formal Matter Roe is good law. As a practical Matter Roe is a dead letter. Interesting. Dahlia, i saw you had something to say about it. Now i think we can hear what that is. Sorry for the tech difficulties. I think that what i was going to say is it reminds me more than anything of mitch mcconnell. Remember when they were blockading Merrick Garland . How can they not hold a hearing with almost a year left in President Obamas presidency. Because they can. Were not talking about law. Were not talking even about norms. Were just talking about power now. So the way the court did It On the Shadow Docket, as melissa said, without precedent, without briefing, without argument, how could they do that . How could they nullify a law in the second most populous state in the nation . Because they can, because its power. They can. Melissa, let me ask you about the law. Lets say someone sues someone because this law allows kind of anybody to sue anybody who was involved in helping a woman get an abortion in texas. So, they sue an uber driver. Will a judge in texas say that they violated this Texas Law . Or will they be able to look toward roe v. Wade and say, but a womans right to get an abortion is protected under the constitution . Are they in conflict or does this Texas Law reign supreme with respect to women trying to get an abortion in texas . I think were going to find out as we see this law go into effect. It is worth noting that the reproductive Rights Group that challenged this law in the federal court sued in state court, texas right to life. The court has enjoined the enforcement of that law as to texas right to life. Unclear whether that injunction actually applies to the range of prospective plaintiffs and litigants that are encompassed here. Anyone can sue anyone and they might need a separate injunction every single time. This law is fine dishly clever in being able to avoid the typical Enforcement And Injunction mechanism many as mechanisms where it applies in Supreme Court precedent. But, dahlia, it may have the desired effect because people dont want to face a 10,000 fine or more for being involved in this thing. For particularly women who do not have a lot of means, this will have the Chilling Effect necessary. Weve already seen that. Weve seen six weeks is now the cutoff in texas. Clinic providers are no longer, although it is perfectly constitutional, are no longer providing services once there is a heartbeat detected at six weeks. We are seeing huge uptick in women who are having to travel out of state. As melissa said, thats only the wealthiest women. Other women will not be allowed to do that. It is having the exact Chilling Effect and this is so important, its chilling the people who want to help those women. The abortion fund, the groups that are supposed to be reaching out and helping women in these times, they are also chilled from even speaking to these women because they face multiple frivolous lawsuits, and the possibility that theyre going to have to pay lawyers fees for all of them. This sunday, the fallout from the new Abortion Law in texas is growing. A Texas District Court judge has granted a temporary Restraining Order to planned parenthood against an antiabortion group as the most restrictive Abortion Law in the country goes into effect. It bans the procedure once a heartbeat is detected, which is about six weeks after conception, and essentially deputizes residents for turning in their neighbor. This gives the gop the Victory Theyve been looking for for
