Sonia sotomayor called the Courts Order stunning. But while the Texas Law and the Courts Decision might have stunned us with this brazenness, we cannot be surprised. The current court with five of its nine members appointed by republican president s who did not win the popular vote. While theyve shown Nothing But Disdain for the fundamental rights of americas most marginalized people, this court has continuously disregarded not just the right to choose but also the Singlemost Right of citizens in a socalled democracy. The right to vote and choose their own leaders. The two are inextricably in connected. Both fundamental issues about the right to selfdetermination. In a truly free society, people should get to decide whether and when to become parents without interference from the government. Just as we should have guaranteed access to the Ballot Box without fear of intimidation, suppression, or retaliation. Thats why we marched on the capitol last saturday, last week today. And why we will not stop. We cannot wait and watch as our rights are stripped away. By next years midterm election, it may be too late. Conservatives on the court in congress and in State Legislatures across the country are determined to defile the sanctity of the Voting Booth and the privacy of your doctors office. And so, we start tonight in the state of texas where, without federal action, they have so far succeeded in both. Joining me now is congressman al green, democrat of texas and member of the Homeland Security and financial services committees. Well, congressman, first of all, thank you for joining me. I i want to start in your Home State where the Supreme Courts inactions has allowed the most draconian Abortion Law in nearly a half a century to stand. I, particularly, want to ask you about the part of the law that turns ordinary people into vigilantes because the state did not enforce this ban but, rather, deputized texans into suing anyone involved in aiding and abetting the procedure for 10,000. What will this look like on the ground . And and do you expect to see republicans try this trick for things other than abortion . Well, thank you for having me, reverend. And im wearing my mask simply because i have staff working with me and in our office, we have a policy of wearing our mask when we are in the office, together. Thank you, also, for your intro. Um, i would like to associate myself with your comments and the portion wherein you said that we should not be surprised is entirely correct because, after all, texas is where Roe Versus Wade took place. This is up in dallas county. The wade and Roe Versus Wade was henry wade, the District Attorney up there who was sued. And texas is also the place, reverend, where we had white primaries. So you are white its linked to voting, as well. And after white primaries were outlawed by the Supreme Court, texas had white preprimaries. Yes, i believe that there are those who will seek to have this reward accorded them. They will go out and try to find ways to literally bring people before the borough of justice in court in a civil lawsuit to try to acquire 10,000 because they may suspect that someone has sought to get an abortion within this sixweeks period. I would also say to you that i dont understand how Rape And Incest can be eliminated because if a Youngteenage Daughter is raped, what parent would not want to help that daughter receive the choice that she might have of not carrying to term . Its just amazing to me and i support, totally, the opposition to this. Speaker pelosi has said that we would codify this law so that it would not become something that the Supreme Court might act on in this arbitrary, capricious way. I support that. We need to codify the law. Now, and and as you mention, this law says even in the case of rape or incest, you cant get an abortion if you have been pregnant over six weeks. And many women dont even know theyre pregnant in the firstsix weeks. But other states are looking to follow Texass Example on on this. South Dakota Governor Kristi Noem has already directed her staff to look into emulating this attack on the constitutional right to choose. And other republicanled states arent far behind. What actions can congress take to stop this assault on Reproductive Justice since the Supreme Court has refused to step in . Yes, sir. Of course, we can codify laws that protect the rights of women. We already have such a law pending. And Speaker Pelosi has already indicated that well have a vote on it. Im convinced that we can pass it in the house. And im optimistic about the senate because i believe that there are republicans who are concerned about the lack of an opportunity to deal with incest and rape. And im, also um eager to say to you, reverend, there is a higher court than the Supreme Court that has to rule and has to make its opinion known and, that is, the Court Of Public Opinion. Its time for the Court Of Public Opinion to issue its thoughts. Its time for people to do what is lawful and that, reverend, is engage in peaceful protest. If the public says this is not something that we want, the Supreme Court eventually will come around. Maybe not immediately, but eventually. Now, congressman, let me turn to the aftermath of the january6th insurrection. Freshman republican Congressman Madison Cawthorn of North Carolina referred to insurrectionists as, quote, political prisoners at a Party Event this week. He also falsely claimed the recent election rigged, and said there would be bloodshed this is a quote he said bloodshed despite denial from his office that seems like a pretty clear threat to me. What what is it like to come to work every day with someone like cawthorn . Will there be consequences for his threat, congressman . Reverend, i made a note because this is such an important issue. He also said he would dread having to pick up arms against a fellow american. Thats pretty strong language, reverend. And it does make it difficult for persons to um do the things that we have to do to pass legislation. We like to believe that we can visit with each other, and we can talk to each other. And that we dont have any intentionality associated with harming another american when these conversations are taking place. This is very much regrettable. Its a very sensitive issue. And i would hope that this member would retract this so as to let the other members know that this is not something we should be concerned about. Now, the threats arent limited to freshmen republicans like cawthorn. This week, House Minority Leader Kevin Mccarthy threatened American Technology Companies that have been asked to preserve their Phone Records relating to January 6th and the insurrection. Why is republican leadership so desperate to keep the truth from coming out . Reverend, that is the question. Why, as opposed to what are they doing, but why are they doing this . Reverend, its obvious that they are attempting to cover something up. Some would say whitewash. Others would say that this is an obstruction of congress, an official congressional investigation. Others might even say its obstruction of justice. And heres what i say. I say that this is a part of the effort to bring back a president that they have been trying to protect since he left office. Remember, mr. Mccarthy did not want the committee to be established. And he has fought putting persons on the committee. This is an effort to look forward to 2022 when there will be an effort to take the house back, but they will fail. And in 2024, when there will be an effort to reclaim the presidency, wherein, they must fail. We have to take to the streets. But more importantly, we have got to vote. This is a time for every person to register and vote notwithstanding senate bills here in texas that are going to thwart our efforts. Cant get 24hour voting. In texas, we ban things we choose not to understand. And i said choose not to because theres No One so blind as he who refuses to see. And we banned 24hour voting. We have banned drivethru voting. We have made it difficult to vote, generally speaking. And when this happens, youve got to conclude, at some point, that this is about upcoming elections. And they, i believe, are preparing for what they perceive as the return of a president who was impeached twice and should not be returned to office. Congressman green, briefly please, as a member of the house Homeland Security committee, i wonder if you could corroborate on reporting friday that Homeland Security is concerned about farright groups praising the taliban in their online platforms. Where the Takeover Of Afghanistan has been cast as a model for the kind of Civil War many of these groups are trying to foment domestically because it struck me in the reading that 20 years after 9 11. And all the antiislamic sentiment that it channeled from the right wing. Organized White Supremacists are now looking past race and religion, and seeing a violent Success Story in afghanistan even as they demonize afghan refugees as part of a racialreplacement campaign. Have you heard these concerns from dhs, congressman . Well, the concerns i am aware of have not gotten it directly from dhs but the concerns im aware of and concerned about and heres why. The insurrection that took place has been something that has inspired these White Supremacists. They dont see this as the last attempt to assault the capitol. And many of them believe that what happened was a good thing. And i believe that we must do all that we can to make sure that the capitol is protected. Never, again, should such a thing occur. Speaker pelosi has done on outstanding job in bringing on new personnel, new people to help with the capitol police. So, im looking forward to doing what we can, as members of congress, to not only say that it shouldnt happen again. But, reverend, we should memorialize January 6th the same way we memorialize 9 11. Congress passed a resolution. The president signed it. We need to memorialize January 6th so that people will know where the congress stands on an insurrection that took place on our watch. I i i want to start with the texas antiAbortion Law that has rattled the nation. The Supreme Court denying to step in by a 54 vote as women now face being turned down in abortion after only six weeks of pregnancy. The conservativeleaning supreme Court Decision was a direct consequence of the Trump Presidency which led to three Supreme Court appointments. Is this just a taste of what is to come during this battle for a fight for womens right to choose . Well, this story really epitomizes what the republican party is today, rev, and its a party of hypocrisy. On the one hand, they say our body, our choice, no masks. On the other, well, women, we want to tell you what to do with your body. Women make up over half this country and what texas legislators have told us is that Freedom Isnt free for everyone. And so, what i really feel today is disappointment because im not surprised. I knew this. I knew when senator collins said what she said, i knew that in the back of her head, she knew better. And if she had Ruth Bader Ginsburg today, no doubt, would the Supreme Court have had a different decision. But dont lose faith, anyone listening. Please, dont. Our democracy demands that we get out there now and we educate and we advocate for those who cannot do for themselves. I am a lover of freedom. I may be prolife, myself. But i am prochoice for other women and that, i believe, is the view of that many more republicans out there than we know. So i hope they use this time to get out there and actually share their stories of stories of when they needed a medicallynecessary abortion. Insurance companies now cover genetic testing. During both my pregnancies, that was covered. Genetic abnormalities show up to make a pregnancy nonviable. Share stories. You know this is not a blackandwhite issue. You know you need to share and we need to do this work now because we have seen what happens. We sEe What they will do in the dead of night. And and and youre right. You could be prolife, yourself, but still fight for people to have the right of choice. Danielle, it it it its not lost on me that in texas people have more of a right to spread deadly virus and not wear a mask than women are to control over have control over their own body. I mean, this week the biden administrations punching back criticizing the Supreme Court and calling the antiAbortion Law almost unamerican. As we near the midterms, will this force democrats to get their act together to prevent more laws like this . I mean, the reality is that nobody should be shocked and especially democrats should not have been shocked about where texas has gone. We have been in a constant battle to preserve roe v. Wade. We have been in a constant battle to preserve our democracy. And we are at a place where we knew what was gonna happen when Mitch Mcconnell decided to jam through the um the appointment of Amy Coney Barrett um thrEe Weeks before the election. Three Supreme Court justices that Mitch Mcconnell was able to put on the courts because, guess what . Democrats dont talk about the courts. And its one of the most important things that we need to talk about when we are talking about Voting Rights, when we are talking about lgbtq rights, when we are talking about womens rights, where does that come from . It doesnt come from Congress And Congress alone. It comes from the courts and Mitch Mcconnell was able to appoint 300 over 300 federal justices and we have we have now the most conservative court that we have ever seen. And so, yeah, i wish that democrats would stop Playing Defense and start playing offense. And use the power that the people gave them in the midst of a pandemic in 2020 and came out in a historic election. Look. Voting is extremely important. We know that. But also, the conversations and whose feet we need to lay this battle at is the feet of republicans. And democrats do not do that. So, i hope that we see a sense of urgency that we have yet to see. We are not in a collaborative place. We are not in a let me talk to my friend from across the Aisle Type of place. We need to start utilizing the power that the people gave the democrats, and move forward because we are running out of time. Now, rena, private companies are fighting back against texas oppressive antiAbortion Law, s. B. 8 is the title of it. The ridesharing app, lyft, has issued a statement saying they have created a legal Defense Fund that will cover 100 of all drivers legal expenses if sued by texas for taking a passenger to an abortion clinic. They also announced they will be donating 1 Million to planned parenthood. Why is it that when democracy fails, its up to private companies to step in to fight . Well to me, this isnt even enough. This is because the texas Abortion Law is so cruel. I mean, theyre talking about civil lawsuits against people who even drive a woman to an abortion. This is just so, absolutely gray and beyond the pail that of course these companies have to step in because so many of us use rideshare opportunities nowadays. And so, im glad they did but we need to see far more corporations do something. Again, as was mentioned in the segment, that women oftentimes dont even know they are pregnant at six weeks. For both my pregnancies, i didnt know until well after six weeks. I was really surprised and i was married at that point. So, you know, this is this is just something to say that corporations owe us more. And and yes, they do have to step in, in this era when republicans are doing many people very dirty but we need more corporations to actually put their money where their mouth is. Actually, stop funding some of these lawmakers and stop giving money to their pacs because we are watching. We know what you do and these corporations need to step up and step up for the american women because we hold the pocket. Danielle and rena, please stay with us. It finally came to a head this week as the conservative wing of the Supreme Court allowed a draconian Texas Law to stand. One that will effectively outlaw abortion in the lone star state, and open defines of the constitutional precedent set by Roe Versus Wade. This development is a violation of the bodily autonomy of millions of texans. And it will disproportionately hurt women of color, disabled women, and poor folks. I leave the details of the law for someone else. Its been covered very well by my colleagues on this network. Instead, i want to address i want to really get to the hypocrisy of the party that calls itself, quote, prolife. But only when it comes to abortion because these are the same folks who have consistently been progun, prowar, and prodeath penalty. Meanwhile, once these pregnancies come to term, these people are nowhere to be found for the rest of that childs life. No paid family leave. No food stamps. No universal childcare. No eviction moratorium. No funding for public education. And now, no Mask Or Vaccine mandates to keep those children safe from coronavirus. And yet, they have the gull to call themselves prolife . This is the party who spent decades stacking the courts with antiabortion judges. All while lying to the american people about their real goals. I think the likelihood of roe v. Wade being overturned is very minimal. Um, i i dont see that happening. This is not a referendum on roe v. Wade. I do not believe that Brett Kavanaugh will overturn roe v. Wade. I would never presume how judge Amy Coney Barrett would rule on the Supreme Court of the united states. The point is that the president also is opposed to roe v. Wade. Thats on the ballot, as well. You dont know its on the ballot. Why is it in the ballot . Because because you said its not on the ballot. You dont know her view on roe v. Wade. You dont know her view. They have been lying to us for years because they had to. The american public does not want abortion to be banned. In fact, a resounding majority of americans have wanted abortion to be legal in some or all circumstances since gallup began asking the question in 1975. And do you know why . Because the american people know that banning abortions does not stop people from getting abortions. It stops them from getting safe abortions. We cannot let these socalled prolife laws drag us back to the days of backalley death. So, heres what we can do about it. If you truly want to see fewer abortions in this country, the answer is not banning the procedure. But advocating for conditions that will make it less necessary. Things like paid family leave, universal prenatal care, easy access to contraception and comprehensive sex education. Make your voice heard. And let your elected representatives know that prochoice voters are every bit as passionate about the issue as those who opposed abortion rights. And if they dont take action to undo damage done by the court, particularly this court, we will hold them accountable at the Ballot Box. Because Reproductive Justice is not just a womans issue. Danielle, on tuesday, House Gop Leader Kevin Mccarthy warned multiple companies not to cooperate with the House Select Committee looking into what occurred on January 6th. Now, this comes after the committee asked 35 communication and social media companies, like verizon and twitter, to preserve their records since it may be valuable in the investigation. The reason may be to look into how gop lawmakers were communicating with formerPresident Trump leading up to the violence. Could turning over these records be why Leader Mccarthy is so against it . I mean, what does he have to hide . Um, rev, he has everything to hide, as does every single republican that was vocal at the stop the steal rally that was held right before the insurrection occurred. I mean, the reality is that we need to know whether or not our leaders were in conversation with insurrectionists, provided them with plans of the capitol so that they knew where to go and who to attack and when. We need to understand how this republican party is currently operating. We are supposed to be in a democracy, right, that is supposed to have a Twoparty System that is about working for the betterment of america. And what we have come to understand about this political party, under trump and before, is that they do not want america to be better. If they did, then they would tell people to go get vaccines. If they did, then they would tell their constituents to wear masks. If they did, then they would be about doing everything they can to do get Ous Ut of the public Health Pandemic so we can be economically viable, again. But that is not what they want. They want biden to fail. They want america to fail so that they can they can bring in and usher in their authoritarian regime. This is not something new. This is the playbook that republicans have been using for quite some time. And so, with Leader Mccarthy, we need to ask why dont you want us to see your Phone Records . Why dont you want to tell us Jim Jordan who what conversation you had with President Trump and when . Did you talk to him that day . Did you talk to him the day before . What were those conversations . And why . It even goes it even goes deeper than that. Rina, we already know that Leader Mccarthy was a person of great interest during formerPresident Trumps second impeachment trial. Mccarthy is known for having close communications with trump. Is it ethical for him to be encouraging private companies not to comply with the house Committees Investigation . Because what i really want to underscore here is if a committee investigating what happened that could lead to crimes, he is interfering what could be a criminal procedure which could, in itself, be a crime. Thats right, rev. This is whats really at stake here. He knows its unethical, number one. But here, he is also basically breaking u. S. Code. People are saying he can be referred to the Department Of Justice for breaking a code and and that code essentially says you cannot threaten um anybody trying to comply with the orders of the select committee. This select committee has reached out to 35 corporations, as far as i i know that they want to know these records. They want to get these records. And and and i think, as americans, we should want to see these records. If we have people who have been sitting in congress who said questionable things that were part of that rioting, the insurrection on January 6th, we, american taxpayers, deserve to know because they are getting protection every day in the halls of u. S. Congress with our dime. So Thats Number one. And i i do hope that this goes a step further because what we saw on January 6th. That was extremism. And if Leader Mccarthy chooses to go this route, we need to be extreme with him and these 11 others who sent a threatening letter to 13 corporations, including google, twitter, verizon, at t. They sent this threatening letter. Why . Republicans, you are threatening corporations here . What is going on . Threatening them about cooperating with a Committee Investigation of the u. S. Congress. Lets be real clear what he is threatening them about. He is really telling them to defy the request of a committee. But, danielle, let me ask you this. The Recall Election in california is just ten days away with democratic Governor Gavin Newsom battling it out to stay in power. Vice president Kamala Harris will be campaigning for newsom in the final stretch ahead of the election. Californians must also vote on who should replace him if they choose to vote yes to the recall. California has gone red, before. What do you see happening this time . I mean, rev, i got to be i got to say that im really concerned. Im concerned with the radical right that they have on the ballot in california. Im concerned with the trumpism that they are willing to follow. And the reality is this. Everybody in california has got to get out to vote. Everybody in california has got to show up. Everyone in california has got to say that they are not about this recall. That Gavin Newsom should and should continue as the governor of this state because we cannot lose a senate seat, right, because that is exactly what will happen. We cannot lose the state of california. We are at a very critical time in our democracy. I dont think that folks understand the urgency that we are in, and i hope that texas is raising the alarm that needs to go around the country. Not just people shrug it off saying at least i dont live in texas. No, what is happening in texas will happen everywhere and folks need to pay attention to what is happening there, what is happening in california. The fbi releasing its annual Hate Crime Statistics for 2020 and finding that our nation has reached a 12year high in reports of biasmotivated attacks. The most chilling numbers being the exponential increases in attacks on the on the black and aapi communities. Fueled by a year of covidconspiracy theories and historic clashes over criminal justice. Joining me now, civil rights attorney, Ben Crump. Thank you for being with us. We have a lot to talk about. Starting with this new Fbi Report that found Hate Crimes rose, again, in 2020. The sixth time in the lastseven years. The highest level since barack obamas election. Nearly 7,800 criminal Hate Crimes reported last year by more than 15,000 Law Enforcement agencies. A 6 increase over 2019 and about 40 increase in just the last six years. But then, you add this offenses targeting black people up approximately 42 . While attacks against people of asian descent were up more than 70 . We have heard from Attorney General Merrick Garland that the prosecution of Hate Crimes is being enhanced by the justice department. And i certainly understand the targeting of extremist groups. But i wonder, from a Law Enforcement perspective, how you stop individual actors before they can actually commit their crimes . We have seen, over and over again, that minority communities that have been marginalized in america have been engaged and been empowered. We started with the election in georgia turning it blue. And that black and brown people are becoming more the america that we see is becoming more diverse. And so, you have an egregious, horrific reaction by those on the far right following the six or seven years of this rhetoric of Make America great again. Well, does that mean that they can start back making it great again where they were lynching black people and then we saw in 2020, Ahmaud Arbery was lynched . When they were discriminating overtly against asianamericans and now we see this rise in Hate Crime against asians. And so, i believe this is their response they are afraid of a more diverse america, Ee W whom was revealed to be a retired Veteran Investigator in her office. Because the indictment of Jacqueline Lee Johnson by Georgias Attorney General this week alleges that she violated her office and obstructed the investigation into Arberys Death by, quote, showing Favor And Affection to formerpolice officer greg mcmichael. And directing that his son Travis Mcmichael should not be placed under arrest. Both men now stand accused of felony murder. I know you, attorney lee merritt, and Ahmaud Arberys parents held a Press Conference yesterday. How does this indictment impact this case . It is so important not only for this case, reverend al, but also for other cases where the message is sent loud and clear. That when prosecutors abuse their authority to put their hands on the scales of justice to show an utter lack of disrespect. And use their position to make sure that minority victims, black and brown victims are not given the same Due Process of the law that should be enjoyed by all american citizens, that they will be held accountable. Da Jackie Johnson that was clear from [ inaudible ] sent the message that she may not have killed Ahmaud Arbery but as i believe, she certainly played a starring role in the coverup, reverend al, that you and i know. We thought over and over again to say that based on the video, Day One, we didnt see it until 72 hours later. They knew on Day One that those murderous duo, fatherson, had lynched this young Black Man for jogging while black. And so, this is huge. This is huge, reverend al. Yeah. Ben, as you mention, politicsnation is celebrating ten years on the air. And looking back, it itll be an understatement to call you a friend of this show. And weve always been grateful to have your insights on abuses. Going back to the first case that really gave our program its voice, the delayed investigation into the death of Trayvon Martin in the spring of 2012. And the eventual Murder Trial for that death. And and and i hope that you recognize what we have tried to do here on this show, to set ourselves apart for the last decade. The audiences weve tried to speak to and speak for, of course.
