Whats been the reaction overnight to the decision by the local judge . Reporter so here in travis county, a District Judge granted a restraining order, a temporary restraining order, ending on september 17th, so theres a limited Liability Protection here solely for Planned Parenthood against texas right to life, an antiabortion group that helped pass the law. Other antiabortion groups can still sue and private citizens, which texas right to life is still encouraging. Even today on twitter, saying, reminder, anyone can sue. It doesnt have to be us. And theyre encouraging others to do so. They built a website with an online portal where people can submit anonymous tips. The reaction from those who care about womens reproductive rights has been outraged on Social Media. Some have been encouraging folks to go to that website and submit false tips. That website as of last look is down, likely because of the flood of traffic there. But, you know, the reaction, granted from this ruling or the law itself, this ruling doesnt change much. This law is still in place and women in texas, 6 to 22 weeks of pregnancy, still do not have access to a safe abortion, alex. So this legislation, liz, where does it stand now, and then the legal implications going forward are what . Reporter the constitutionality of this law is still yet to be determined. Thats what We Saw when the Supreme Court failed to act on wednesday night. And weve seen an increase of these Shadow Docket decisions that legal scholars are concerned about, not only in the volume of the decisions, there are more of them happening and that latenighttiming before a holiday weekend, i dont think was a mistake. Those sort of latenight decisions, one was pushed through right before thanksgiving. Theyre happening more often. So the volume is increasing and the impact is increasing. There are more and more consequences involved here to these decisions theyre making. Its not some, you know, technicality that theyre just passing on. Within the texas legislation, theres a lot of peculiarities here, even the procedural terms violate texas own constitution, according to the Law Professor here at the university of Texas School of law. They also use language like Aiding And Abetting, so anyone who assists a patient, patients are not allowed to be sued but anyone who counsels, finances or transports them can be sued. The language Aiding And Abetting has a lot of criminal to it. Its a novel legal strategy, kind of clever way to get around the normal rules, so were seeing copycat legislation, roe v. Wade effectively not in place in texas, but still in place in the constitution. The Supreme Court will have a chance to repeal that when they make a decision about mississippi in the fall. Lets turn to the White House, everyone, as President Biden is planning to make Booster Shots widely available by The End of the month. Its now facing new challenges. Heidi, welcome to you. Is the president still on track to meet his September 20th deadline or not . What could be a hiccup here . Reporter alex, regulators warned the White House, the president s advisers on thursday they may not have enough data to support that promise that the president made to deliver Booster Shots to all americans at about the eightmonth mark, saying that they likely only have enough data to support recommending the Booster Shots for certain recipients of the pfizer vaccine, another Question Mark that is holding this up is whether and what amount of Dosage Recipients of moderna would need if they need a second booster or third Booster Shot at all, alex. And this coming as the president was hoping to use this as another example of how hes trying to combat the coronavirus, which is very tightly linked to what were seeing right now in the economy, with that Jobs Report coming out for august with disappointing numbers, only about 250,000 jobs gained, compared to what economists are expected of about 750,000 jobs. You would think that this Wouldbe Leader would counsel others to do the same and call out a member of his conference, madison hawthorne, who is stoking the Big Lie continuously, who is threatening violence, who is absolutely, sadly, caught up in the insurrection event. So what it says to me is that mr. Mccarthy is mighty afraid. What about the Capitol Police . They say they are closely monitoring that planned September 18th rally in support of the people charged in connection with the insurrection. It amounts to some 600,000 arrests there. The ap reports far right extremist groups like the proud boys and Oath Keepers are planning to attend. Any concerns about this event . Should Capitol Police consider reinstalling the Perimeter Fence to protect the building . You know what, i have been in touch with some of the police who ive now become friends with because of their heroic work all year long, but certainly a january the 6th. And they assure me that this is being watched very carefully. What i hope and theyre not telling me the ins and outs, of course, but what i hope is that Capitol Police, metropolitan police, Take A Look at the recommendations of the commission, what did that commission say immediately in the aftermath. We have to beef up Man And Woman power around the capitol. We have to beef up infrastructure around the capitol. Very importantly, we have to monitor and partner with those who are monitoring the intelligence, Social Media, to know exactly what is going on. I hope all of those things are happening as we head toward September 18th. Yeah. So you mentioned the rough week and thats all relative to the devastation of ida, which killed at least 48 people across New Jersey, new york, connecticut, pennsylvania. The remnants of this hurricane absolutely decimating the northeast with rare tornadoes and record flooding. I know your district was seriously impacted by this extreme weather, including at least three deaths there in mon montgomery county. You went to survey the damage this week. What did you see . The last two days weve been out with local leaders and with Governor Wolf and with fema. What We Saw is devastating. We have lost lives, now four of my residents, of my constituents have perished as a result of Hurricane Ida and the flooding and the tornado that went through the center of my district. Weve lost houses, literally we drove the governor through a neighborhood where houses were pulled right off their foundations, if they werent obliterated. We lost businesses, small and larger. Weve had schools damage, tremendous damage to schools, police departments. Its changed our geography. Weve lost power and water. So from Norristown To Bridgeport to upper dublin, to collegeville, we have had devastating losses. We desperately need aid, which im sure well get, and we invite the White House, i invite the president in his tour to come Visit Pennsylvania and see the devastating losses. I urge resources here for people who have lost everything. All of this is raising some very serious and challenging questions about Climate Change and infrastructure. What can congress do right now to better address the climate crisis, and how can we enhance and protect our infrastructure to better try to absorb the increasing frequency of these extreme weather incidents . Im so glad you asked. Because congress is poised to do just that. If and when we get back to work, and i would love to come back even sooner than we are scheduled to come back. But were scheduled to come back in just a little more than a week and what we need to do is to pass the bipartisan infrastructure bill, which will have some money, resources that will get at climate Change And Resiliency in our infrastructure, and just as importantly, perhaps much more importantly, we need to pass the build back better act, which is the budget reconciliation act. Take a look at what has happened to our waterways, Take A Look at this historic flooding, and we can contrast that with what weve learned. Take a look after katrina, the billions of dollars that were poured into New Orleans, as they should have been. Saved lives. We need to learn from that and do the same. This is our moment. This is our obligation to this generation and to the next, to recognize that Climate Change is real. A group of about 30 afghan women bravely protesting in kabul this week, demanding equal rights and representation as the taliban gets ready to announce its new government. These protests began on thursday in the western city of Herot And Today we heard about more protests in kabul, women trying to march toward the president ial pal its, Demanding Female Representation in government. According to the associated press, this protest in Kabul Today was dispersed by force by the taliban. Taliban Special Forces firing into the air, shooting tear gas, and breaking up that protest. Now, the taliban are saying that they plan to form and unveil a, quote, inclusive government next week, but the spokesman also saying there will be no women in that government. In some ways, thats not a surprise, given what we know about the taliban. But there had been some thinking that maybe the taliban would try to appease the international community by including women in some more minor roles. They say women can serve in Administrator Positions but we cannot be leaders. We expect the leader to be mullah baradar. Hes not a Household Name in the united states, but he is very well known to the u. S. Government. He was arrested in pakistan in 2010, but then released from prison in 2018 at the request of the Trump Administration when they were looking around for somebody to make a Peace Deal with. What are you seeing and how are people picking up the pieces . Just look at the pieces of whatever that is behind you. Reporter hey, there, alex. The impact of the storm in manville was twofold. First the flooding that weve seen images of, unbelievable images, but the second part is what is behind me here. This used to be a Banquet Hall, which was a big Banquet Hall in the area. Now it looks like theres not anything salvageable from it. You see the smoke still rising from the Explosion Due to a suspected Gas Leak more than two days ago. This is what is happening all over the place. Theres a number of businesses and local homes that exploded because of these Gas Leaks and were seeing, were talking to a number of Business Owners in the area. We talked to ron from Manville Pastry shop. He says his business is a Total Loss in items of whats inside. He says he hasnt seen a flood like this since Hurricane Floyd in 1999. But he is committed to rebuilding. Its tough to continue to pick up the pieces after this kind of devastation. It really is. Thank god were all safe, this can be replaced and hopefully well get through it. Reporter hey, there. And its really interesting here because Business Owners are living here as well. Remember, ron lives here in manville as well. So not only is his business flooded, but his home is flooded as well. Its really a double whammy on that end as well, alex. Thank you. Reporter yeah, alex, the president came right here to laplace, where there was incredible damage from the hurricane. Some folks had 5 feet of water or more in their homes. And the president s goal with this trip was really to show that his administration is competently responding to this hurricane. Not only because of the experience so many folks had here during hurricane katrina, but also frankly in light of what weve seen in the last few weeks in afghanistan and the administration trying to show they have it together, they are doing everything they can to help people in need. And we heard the president trying very hard to show that he is on the side of the folks who are here in louisiana and other hardhit parts of the Gulf Coast where the president wants people to know that the government is doing what it can to make sure they get what they need, including from Insurance Companies, with the president warning a lot of these Insurance Companies are looking to technicalities to try to prevent people from getting the money they need. Lets go right to nbcs Vaughn Hillyard joining me. Houma Got Hit pretty hard, so this should not be surprising to some. Extraordinary having an Emergency Room in a Parking Lot. Whats the story behind it . Reporter exactly. This is houma, this is a community that essentially didnt have Cell Service up until 24 or 48 hours ago here, and so many of these streets theres still electrical lines that are down in the streets, homes, walls and roofs that are blown into the streets. It was actually our photo journalists this morning, while we were driving through town, saw this Parking Lot and called us up and said weve got to get over here. After the hurricane, they had to evacuate 120 of their patients out of the facility because of the damage that this hospital sustained, windows crashed in, flooding inside of hospital rooms, roofs torn off. The amount of damage that was sustained could not allow them to continue to operate this sort of a facility, this sort of a major medical facility here in houma. That is where just yesterday they popped up essentially a makeshift Emergency Department here at this Parking Lot. They had about 40 people yesterday, theyre expecting potentially upwards of 100 today. I want to let you hear from the president and ceo, phyllis peoples. We sustained catastrophic damage to our organization, wind was coming through, sounded like a freight train, cement from our roof was breaking loose and broke into the Patient Rooms while we had patients and staff in there. Water is pouring in from everywhere. As were try to go mitigate some of that to make sure were safe and our patients are safe, we just went through the night that way. In the morning we were able to assess the damage and we recognized that it pretty much blew holes in the four corners of our roof. Reporter this hospital, terrabonne, when you talk to the doctors and hospital administrators, it is hot out here, yet theyre going to do what they need to do at a time in which covid is also special of concern. They had covid patients that had to be evacuated, but they said theyve had individuals coming up asking to be tested here in the heart of a pandemic, a hurricane that struck this community so hard. Over time, either through, unfortunately, infections or getting vaccinated, we are slowly building that immunity and the goal, what were all hoping, when we reach that number, the number itself is what is elusive, particularly in the setting of new variants, were hopefully going to see a Drop And Decrease in transmission, hospitalizations and deaths. Youre already seeing that in states that have high rates of vaccinations, may have also had high infections. This study from July Of 2020 through May Of 2021 is looking at Blood Donors and the one thing ill caution people on, its a study of Blood Donors and our Blood Donors are different than the regular population. The other part is it ended in may and what we know is since then weve had the Delta Variant which has shown that you might need higher rates of antibodies. Its not just antibody positivity, but you may need more antibodies and potentially a decrease in immunity, even in those with prior infection or vaccines. So take it with a Grain Of Salt but its news that were moving toward potential higher rates of population immunity. What about the Booster Shots . What is your take on whether theyre necessary and how soon we should be getting them . Yeah, and these are both tied, because part of the change in the equation has been the Delta Variant. Theres data showing with the Delta Variant that an amount of antibodies are going down, but also the efficacy is potentially reducing against infection. The concern here is that, although were seeing this decrease in immunity and there are very good cases to be made for people who are immunocompromised to get the third dose, i think a case to be made for people that are elderly, Theres Data that shows in people under 60 who are healthy, actually theres still protection against hospitalization and deaths. And so i do think that the proponents of the booster are saying, look, eventually this is going to have to be a threedose shot. Its a series like with hepatitis and some of the other vaccines. People who are, in my opinion, i would like to see more data on those under 60. The good thing the biden administration did, was they said, look, boosters may be needed. Its clear boosters are potentially going to be needed for some people earlier, some later. The only problem is that setting that September 20th date gets ahead of the Fda And Cdc and also declaring that its for everybody early before that Fda And Cdc review, i think, you know, just doesnt breed as much trust. We want those agencies to go through that process and give those recommendations. Definitely it does add a lot more trust to things. Doctor, thank you so much. Surprise announcement this week two years after Elijah Mcclain died following a physical encounter with colorado police. The State Attorney general announcing a 32count Indictment and criminal charges against three Aurora Police officers and two paramedics. A secret Grand Jury had been meeting since january 8th. They voted for charges including manslaughter, criminally negligent homicide, Assault And Use of a deadly weapon, namely ket mine. Mcclain was walking home from a Convenience Store when police stopped him. The officers first tackled him, then pinned him on the ground while paramedics administered the ketamine. In terms of what happened, it was deeply concerning because initially we didnt even see any charges at all given the fact that the Police Officers were engaged in unlawful behavior from the beginning, but it is a relief to know that the attorney Generals Office is now doing the right thing. You know, theres a point in the body cam video, and it is when an officer speaks to the person that called 911 and verifies mcclain didnt do anything criminal. I mean they would have known by then he was not armed. Why not say, okay, you didnt do anything wrong, this was a mistake. Why still have him injected . Alex, i think that characterizes what they were doing from the beginning. What is really startling here is that the Police Officer who initiates all of the contact with him is a Training Officer, which reflects that these problems are systemic. What that Training Officer knew from the beginning was despite what he may have been told, there was no evidence to his knowledge that elijah was involved in criminal activity or that he had reasonable suspicion that he was, which is the standard for stopping him and questioning him. So from the beginning the contact with him was unlawful and it just spiralled out of control from there. In fact, these two paramedics, they each face 11 charges, day, including second Degree Assault charges related to the use of the ketamine. How unusual is it for paramedics the face criminal charges like this and does the fact that this drug was legal at the time, does that give any cover to those that have been charged . It is extremely unusual to see this, and i think to understand why this is so significant, youve got to contrast it to another case we remember, and that was the murder of george floyd. If you remember in the trial when the paramedics arrived, their job was to provide life saving measures. They were there to help. They forced the Police Officers to get off of him. They uncuffed him. They started trying to administer chest compressions. Thats what the paramedics should have done here. They should not have been an extension of the police trying to subdue someone, especially when they never examined elijah, they never tried to assess what his condition was or talk to him. They just started Pumping Drugs into him at the request of Police Officers who were unlawfully trying to subdue him.
