Probe of the September 11th attacks. In an Executive Order the president demands the Justice Department publicly release those documents over the next six months, and some set to come out as early as next week as the aforementioned 20th Anniversary of the attacks. Meantime, the white House Plan for covid Booster Shots is facing a minor setback. Officials say they dont expect to meet the September 20th deadline to make Booster Shots available for those who received the Moderna Vaccine. Officials, do, however, believe Reg Rarities are on track to make a decision for Pfizers Vaccine. Republican lawmakers are threatening legal action against 13 telecommunications and Social Media Companies if they comply with a request from the January 6th select committee to preserve their Phone Records. Were going to have a lot more on that Coming Up. Were going to go beyond the headlines to nbcs Liz Mclaughlin and heidi at the White House. Were going first to texas, and as we mentioned, some relief for Abortion Providers. We have a State Judge that has granted a temporary Restraining Order against the antiabortion group texas right to life. Now, it comes after the Supreme Court refused to block texas the restrictive new Abortion Law earlier this week. Joining me from austin, nbcs Liz Mclaughlin. Big welcome to you. What has been the reaction to this very latest ruling . Reporter the reaction from both sides has been to continue this battle over Abortion Rights. Frankly, this ruling doesnt change much for women in texas. A Travis County District Court Judge granted this temporary Restraining Order, and it is temporary, ending on september 17th, to Bar Texas right to life, which is an antiabortion group that helped pass s. B. 8. Its a narrow ruling limited the scope of those suing limitations. But anyone else, private citizens, can still sue Planned Parenthood and other Abortion Providers and anyone who helps anyone get an abortion after six weeks. And texas right to life is doing just that, encouraging private citizens to submit Anonymous Tips through an online portal and theres been a reaction on Social Media to try to crash this site, telling people who are womens reproductive rights advocates to send in false information. And as of last look, the site is down. That may be because of the increased traffic. It may also be because Host Godaddy said they were going to terminate hosting that site. But the fact of the matter is until the constitutionality of this law can be reviewed, it remains in place. Planned parenthood is saying this is not relief for texas. The ceo of Plant Parenthood had this to say. Were talking about 10,000 as an incentive to sit in a Parking Lot and write down someones license, take pictures of people. Thats insane and really they do it doing that they had stripped away access to our constitutional right to make decisions for our own selves and thats really, really abominable. Reporter and in this request for the Restraining Order, Planned Parenthood said its providers and Health Care workers felt threatened and harassed by antiabortion groups rallying around clinics. They are complying with that law until something can be done. At the current moment that law is still in place. Abortions after six weeks, when cardiac activity is normally detected, are illegal. So that leaves three options, for women in texas who have an unwanted pregnancy, between 6 and 22 weeks they have three options. They must leave the state, which is unfair to low income women and disproportionately affects women of color. They have to continue an unwanted pregnancy, which some are calling a state mandated pregnancy, or womens health advocates fear that they may, in an act of desperation, try to take things into their own hands, finding an alternative thats loyal and perhaps dangerous. Its just extraordinary, liz. Ill tell you, anybody with a vendetta, anybody who is bored or wants to make money can go out and make accusations on someone and cause a world of trouble for that person. The whole thing defies Logic And Fairness and decency. Its potentially pitting neighbor against neighbor. Were going to do a lot more covering of this story. We move to the white House And President biden is saying the latest Jobs Report is a sign that america is back on track, even as the Delta Variant causes a spike in cases nationwide. Lets go to nbcs heidi at the White House. This has been called disappointing. Give me a sense of the president s interpretation. Reporter the President Yesterday was trying to reassure americans that despite this particularly disappointing report, we are on the right track, trying to have americans focus on the overall numbers here that the average Job Growth is 750,000 per month, that Unemployment Overall is down by a percentage point, wages are up. But also to look for closely at this particular report to see that a lot of the setback is in the Food Service and retail industry, which suggests that the sand in the gears here really is the Delta Variant. Heres what he said. Theres no question the Delta Variant is why Todays Job Report isnt stronger. I know people are looking, and i was hoping for a higher number. But next week ill lay out the next steps were going to need to combat the Delta Variant, to address some of those fears and concerns. Reporter so a single report, alex, will not define a presidency. The question at this hour really is whether this is going to be part of a longerterm trend of a more sluggish economy. The president is talking about the importance of passing the rest of his agenda in congress, although that seems to have a Pretty Steep Hill to climb, given that senator Joe Manchin of West Virginia has said hes not going to support additional spending at this time, that there should be a pause. But, alex, the priority right now inside the White House really is addressing the coronavirus. There is such a clear inverse relationship, that when coronavirus cases go up, when we have these surges, the economy and economic activity go down. You have parents who dont want to return to the workforce, who dont want to send their kids back into school buildings. You have people who dont want to take those lowpaying Service Jobs because theyre potentially dangerous to their health. So the White House next week, like the president said, will be putting out additional information about how they plan to address this. News just in that on tuesday the president will be traveling to New York, to queens and to New Jersey, to tour that stormdamaged region, alex. Yeah, i live in New York. It was pretty epic, i must say. Thank you so much for that. As we turn to Capitol Hill and as heidi mentioned, senator Joe Manchin urging fellow democrats to pause their consideration of a massive 3. 5 trillion spending package. The West Virginia democrat explaining why he wont support the bill. This in the wall street journal, he writes in part, quote, some in congress have a strange belief that theres an infinite supply of money to deal with any current or future Crisis And Spending trillions upon trillions will have no negative consequence for the future. I disagree. Joining me, a democratic member of the House Budget and judiciary committees, shes also chair of the Congressional Progressive Caucus and a good friend to us. Welcome back to the broadcast. Right off the bat, what is your response to Senator Manchin . Alex, its good to see you as well. I would just ask Senator Manchin, what does he intend to put a pause on . Does he intend to put a pause on our immediate necessity to fight climate change, and were seeing it with the flooding and the fires across the country . Or perhaps he wants to pause on giving Child Care to women so they can get back into the economy . Does he want a pause on Health Care, right at the moment when the Delta Variant is spiking . How about housing . Does he want to pause on giving affordable housing to people across the country . And let me just remind everybody that the deal was that we deliver the entirety of the president s Build Back America Agenda to the president s desk for signing. That means that if Joe Manchin wants to have the Infrastructure Bill that he negotiated, a much smaller, frankly, bill that doesnt do all of the things that we need to do, then we need to come to a quick agreement on the reconciliation, the build back better reconciliation package. Thats where things are, and i would just say that every one of us, alex, has a tremendous role to play in this because we have very narrow margins and we have been clear the progressives are ready to deliver on the president s agenda, the speaker is with us, the Senate Majority Leader is with us, and now we need to just make sure that we actually do what we said we would do for people in this moment of tremendous crises, so many crises that were facing. Absolutely, too many to count. But to your point that you all have a role to play, with regard to the senator, his vote is critical, of course, with a yes needed from him and every single other democrat, and he believes on principle the 3. 5 trillion is too much, too soon. You in the progressive caucus also believe on principle it is the amount that is needed. So if everybody is acting on principle, then who should win out . Is there a compromise to be made or do you believe those folks, like Senator Manchin, those that are moderates, lets say, that theyre thinking politics and not principle . Well, lets remember that this 3. 5 trillion is actually a compromise. If you remember, alex, progressives didnt want to split the bills up to start with because we were afraid of this exact dynamic where people would try to move on something much smaller but not do the entirety of what the president has outlined for people and what we campaigned on. So we wanted it to be one bill. When it was split into two we made it very clear early on, three and a half months ago, that we would be willing to vote on the Infrastructure Bill, but it has to move after the Reconciliation Bill has moved. And that is now the position of the president , the speaker and the Senate Majority Leader. And the vast majority of democrats. Now, also, we had originally wanted a much bigger package because the crisis is so intense. But we settled on 3. 5. That was the deal that was made in the senate, with Senator Manchin agreeing to that deal. So now we need to deliver on the promise that was made and the commitments that were made. So this is already a compromise, i would say. And ill tell you, alex, that there are a lot of progressives who dont like what is in the Infrastructure Bill. They feel that not only does it not go far enough, but there are provisions that they dont like and they think actually move against what we need to do on climate change. But we are willing to move forward, but we need to get what is required into the Reconciliation Bill. So, yeah, there are going to be people that dont love every piece of this. That is the process of legislating. But we need to get it done and we need to get it done by The End of september, as we promised to the american people that we would. Because at The End of the day, alex, this is about making people tangibly feel the difference in their lives, that they can wake up and for the first time in the history of this country be able to provide paid leave to families across this country, be able to provide Child Care, be able to provide access to Community College at a time when Tiffany Cross was covering this earlier on msnbc, when latino and black students are struggling and not going on for higher education at disproportionate rates. If we want this economic recovery to be fair and equitable, we need to invest in the pieces that are in the Reconciliation Bill. So your chronicling of how you got to where you are now that includes a compromise, are you suggesting that senator Joe Manchin, who you said agreed to the amount of 3. 5 trillion, agreed to that compromise, is he now going back on the deal he agreed to . Well, look, i dont want to focus on one individual person. What i want to say is that this is is democratic agenda. This is the president s agenda. This is the speaker of the houses agenda. And this is the agenda that all of us campaigned on when we asked voters, voters of color, young voters, women voters, poor voters across the country to give us the house, the senate and the White House. So the idea that were going to stop any progress towards actually delivering on these things urgently is simply not acceptable, and it wont happen. I have said before that, look, were in a position of either mutually assured success or mutually assured destruction. We need to make sure its mutually assured success and we need everybody to understand that theres no single linchpin here. Everybody has to come together. And we have already done that, progressives have compromised significantly and we need to make sure that we are now moving this forward. Okay. Were going to switch topics and talk about the restrictive Abortion Law in texas. You posted on twitter a lot in response to this, including the tweet which reads, in part, for me, terminating my pregnancy was not an easy choice, but it was any choice and that is what we must preserve for every pregnant person throughout texas and across america. And then you reshared the 2019 oped that you wrote on the story of your abortion. What did your experience teach you about reproductive choice and what kind of impact could a restrictive law have on people if it stays in place . Alex, this is so personal for me and millions of pregnant people across the country. This is a choice that one in four women across america have already made, one in four women have had an abortion. And the complexities that i tried to share in my piece and the nuances of all of the things that go into our decisionmaking when we are pregnant and we have to choose to terminate that pregnancy. There are so many factors involved in that and it is a very personal choice, because obviously the pregnancy is mine, and all of the consequences of any choice that i make, whether its to have the baby or to terminate the fetus, the reality is i have to live with those choices. My doctor, the people i choose to bring into it. And thats what i tried to articulate. The reality is that it was a difficult choice for me. It isnt necessarily a difficult choice for everybody. There are economic factors, there are all kinds of factors that weigh in. And this Texas Law is not going to stop abortion. What it is going to do is make abortion unsafe and in the context of people having to have Back Room Abortions where they might die. So its putting lives at risk, and of course poor women and women of color in particular will be disproportionately burdened by this. It is an enormous step backward and a violation of our constitutional rights. So the supreme Courts Lack of action is outrageous, awful, terrible, but it puts the focus right back on congress that we have to codify roe v. Wade and that is why we have made sure to bring up the Womens Health Protection act. The speaker has said that is going to be a bill were going to vote on. And we need to have the senate recognize that over half of this Countrys Population and all the families that are connected to these decisions are deeply impacted by this and agree that abortion should be safe and legal and we should protect this ability for people to make choices about their own bodies. And i should say it is an extraordinary oped that you wrote in june of 2019. You chronicled it. It was heartbreaking and inspiring at the same time. The Bottom Line was, you just said every woman needs to have a right to choose what happens to her body. And well just leave it there right now. Congresswoman, always good to see you. Safe travels. Lets go to california where early voting is under way in the Recall Election and it comes as Governor Gavin Newsom received encouraging new numbers this week. 58 of californians plan to vote against the recall, 39 will support it. Lets go to an early Voting Center in north hollywood, california. Emily, good to see you. Its a pretty good position for newsom to be in about ten days or so before the election. What all is behind the numbers were seeing in this polling . Reporter alex, i would say a good position, at least compared to just a matter of a few weeks ago when it was looking like the race could really go either way. As you mentioned, early voting begins in some california counties today. Were at a Polling Center here. People will be piling in within the next hour or so. But millions of californians have already cast their ballots and democrats are Showing Up in a big way, at least so far, mailing in more than two times the number of ballots than republicans. You mentioned that new poll showing 58 of likely voters to say that they would say no to recalling Governor Gavin Newsom. Political analysts credit the improvement with playing into the number one issue for california voters right now, covid19. Listen here. A few months ago what was being said was a critique of governor newsoms stewardship. He changed the conversation to a choice between his governorship and what he cast as the right Wing Trump republican effort to recall it. And he got an additional boost from larry elder. And thats mobilizing democrats . Reporter but, of course, it will ultimately come down to Voter Turnout and Thats Something that can be difficult to predict in an off year, unusual election like this. The poll i mentioned earlier shows republicans are feeling more enthusiastic about voting in this Recall Election compared to democrats. Alex . And really quickly, the early Voting Center that youre standing near, is it up and running today and have you seen Foot Traffic thus far . Reporter it will open at 10 00 a. M. And so were going to try to talk to voters as soon as they start lining up. It will be difficult to predict whether or not were going to see a big line or not because there has been so much traction when it comes to mailin ballots. Destruction from Hurricane Ida and new video of the moment a tornado touched down in New Jersey on wednesday. Ida left a trail of destruction over several days, battering southern and northeastern states and a total of 64 people are believed to have died in the storm related deaths, with New Jersey, New York and louisiana suffering the most fatalities. Meanwhile, a new investigation has begun into the death of four Nursing Home patients. They were among 800 patients packed inside a warehouse, taken there before ida struck louisiana. Health officials say they have significant concerns about conditions at that facility. One woman was relieved when she was able to talk to her 84yearold mom. I spoke to her a little earlier today, but she couldnt hear me and really understand me. I could tell she was very upset, but at least i knew she was alive. If we would have known it would have been a place like this, i would have took her with me, no matter how hard it would have been. Covering the latest fallout from Hurricane Ida this hour, Allison Barber in New Orleans and Gabe Gutierrez in New Jersey. Lets go to the northeast where the Tail End proved more deadly than when it first made landfall. Gabe, what are you seeing today . Reporter this is the swollen Passaic River that crested overnight and right now its about 2 feet above flood stage. The water is receding in many parts of the state, but following natural disasters, some communities feel the impacts of the storm days later because all of that water needs to head downstream. Here in New Jersey, the governor says at least 25 people have died and six are still missing. The terrifying wall of Water Burst into this basement in New Jersey. Idas remnants unlike anything the northeast had seen. Some rivers are still rising after record rainfall. Its terrifying, especially with the kids. Its horrible. Our house like this, its terrible. Across the region, officials facing criticism for seemingly being caught off guard. Climate change is not a hypothetical. Whats the latest on, first of all, the Power Outage Situation . How are people coping . Reporter yeah, power outage, thats been the big thing in New Orleans. Right now entergy say theyve gotten Power Back on for about 27 of New Orleans. They expect to have power on for the majority of New Orleans by next week. Wednesday, september 8th, for some of the really hardhit areas, they say they probably wont have Power Back on until The End of the month. It has been days since many people have had a hot meal. We met one man, as he was going around to as many fema Distribution Food sites as he could because he was trying to get mres, meals ready to eat, prepackaged in a bag to feed his four young grandchildren. Things are hard for a lot of people right now. But i want to show you some of the helpers. This is the howling wolf, normally it is a music venue. Instead, they have volunteers, making food, Feeding Anyone who needs it. They have fed about 15,000 people since monday. Its not just sandwiches. They have hot food on the grills. They keep this going. The owner tells us they were here feeding people until almost midnight last night. I want to introduce you to him. This is howie. He is the owner of the howling wolf. First of all, walk us through what you all are doing here, where did you get all this food and how are you making this happen . It just kind of happened by accident. Monday we were sitting here checking to see if there was any damage from the storm. The power was out and people just started Showing Up, 8 00 in the morning, asking if we were going to be doing meals. We had started a Program Called Meals for musicians, and people thought that they needed to be fed. This is coming from over 100 different restaurants. We have refrigerated trucks to keep food safe. Volunteers started Showing Up, grills started Showing Up. Weve got awardwinning chefs that are out here manning the grill. We can see some of those refrigerated trucks. When we were talking earlier, one of the things you said to me is this is what people in New Orleans do. Explain what you mean by that. We take care of our own. We take care of Each Other and we do it with a certain degree of Flair And Class and passion. You dont live in New Orleans and not feel it. You know how to take care of your neighbors. Nobody is out here talking politics. Everybody is talking about what they can do to help the people around here. Reporter these trucks in the back is where you have people unloading massive amounts of food. All of this is from restaurants that lost power but had some generation. Yeah, his is one of the most lasting images from that harrowing day here on Capitol Hill, and now his is one of the most closely watched Court Cases as it makes its way through the u. S. Justice system. This morning, the January 6th rioter known as the Qanon Shaman awaiting his sentence. Jacob chansley pled guilty in federal court this week for his role in the Capitol Riot, obstruction of an official proceeding, a felony. He faces up to 51 months in prison. Chansley, face painted, wielding a spear and wearing a horned hat, became one of the most nor torous faces from that deadly January Day and insurrectionists sought to stop congress from certifying the election results. Chansley left a noit. Its only a matter of time, justice is coming. Reporter the day after the riot, he called the day a win. Since then, a different look and a different tone. Chansley arguing he only entered the capitol that day on then president trumps invitation, adding he now feels betrayed by the former president. His lawyers saying chansley feels remorseful and has disavowed the Qa Noun conspiracy theory. This was not a case that involved a question of guilt. This has been a case, always. Reporter one of 600 people arrested for breaching the capitol on January 6th, the legal proceedings could drag on for years. Republican congresswoman Liz Cheney, an outspoken critic of Trumps Role in this day, elevated to a top spot on the democraticled committee. Were asked to preserve records of a group of lawmakers, including House Minority Leader, Kevin Mccarthy, who spoke to trump on the 6th. I have nothing to hide but i have nothing to add. When i spoke to the president was after people broke in. Reporter mccarthy is not the only one making threats here, either. Republicans, other republicans in his caucus are also threatening companies that could comply about that new demand from the January 6th committee. Theyre not just going against the tech companies. Theyre also saying that they want congressmen and women like Liz Cheney and add many kinzinger to be taken off the committee. No Surprise Politics at play. We talked about the House Select Committee that is investigating the January 6th attack. Its eyeing Phone Records of republican lawmakers like lauren bobert, jim jordan, mat gates, marjorie taylor greene, scott perry, andy biggs. How concerned would you be if you were among that group . Oh, i would be incredibly concerned, and its why theyre trying to make all of these threats to the phone companies, which, as we know, have no basis and legal standing, right . Because they dont want the public to hear what they have been saying, which was inciting some of the violence as well. If they had nothing to hide, they wouldnt be angry that there might be a subpoena for these records. And so if i was them, i would be a little bit scared and thats why theyre deflecting and having these baseless comments. To be clear, these republicans, they are threatening the telecom and some Social Media Companies and you have House Minority Leader Kevin Mccarthy saying if those companies comply with the house committee request, republicans, quote, will not forget whenever they retake control of congress, potentially costing these companies their ability to operate in the united states. Thats pretty stunning. What do you make of that . Why the veiled threats if they have nothing to hide . What it sounds like to me is obstruction of justice, obstruction of an ongoing congressional investigation, and anybody, including Kevin Mccarthy who engages in that type of conduct should be held accountable to the fullest extent of the law. If this had happened during obama years, if the leader of the democratic party at the type had said, dont cooperate with subpoenas, dont cooperate with congressional investigations, and if you do there will be payback for you, there will be revenge sought upon you if we ever get back in power, republicans would have lost their mine. They would have tried to throw someone out who said that, impeach somebody who said that. Now the shoe is on the other foot and i think the democrats need to hold firm. But in this case, given the high profile nature, the passions around it, it is extraordinary the only ones to write about their reasonings for opposing it were the three liberal justices, as well as the chief justice, john roberts, who said i dont agree. What happened there . Its sneaky, thats what it is. We just have to call it what it is. They want to overturn roe v. Wade, they cant wait to do it until the Mississippi Case comes up. They want to get it done and theyve done it in a back doorway. Its outrageous. Let me tell you what, weve had 48 years to get the legislative protection for women done in the congress and they havent done it. And this, i hope, is the impetus for them to actually do what they need to do. They need to have this vote and they need to vote over and over and over and over again until everybody is on the record and there is a federal right to control your own body. So to that end, they voted not to block this bill, but the Supreme Court is likely going to have to review the merits of this law if more challenges are brought against it. Is this an indicator of what the final decision will be . Yes, yes. Yes, it is. They overruled 48 years of precedent and didnt even bother to mention thats what they were doing. They clearly have been saying, the republicans have been saying for almost 50 years were going to do this. The Trump Hang on a second. Look, roe v. Wade in its entirety or are they going to take a piecemeal approach to doing it . Which is the more likely . You know what, i think i used to think that they were going to do it sort of quietly, sneakily, back to the states, try to say its all procedure. But this is so brazen that my guess would be when the Mississippi Case comes, they just overruled roe v. Wade. And let me tell you what, if they overrule roe v. Wade, there are 11 states in this country that say the Minute Roe v. Wade is sent to the states, its illegal in our state. We are months away from women all over the south not having an option. And you know what that means . That means rich women, my kids, have an option because they can just fly to california or New York or massachusetts. But poor women have no options and these people dont care at all. And if you ever wonder about that, read the Dissenting Opinion of kavanaugh in the Abortion Case that came up to him when he was a federal district judge. No empathy for poor people. Theyre trying to overrule roe v. Wade and they have effectively done it in texas and theyre going to do it in this country. Everybody better call their congressperson and get on the move to get a federal law. Otherwise, poor women have no choices. This is going to ignite something extraordinarily polarizing.
