Reproductive rights which exploded in dramatic fashion this week when the conservative majority on the Supreme Court helped texas republicans achieve what the gop has been trying to do for decades. Effectively end the protections of roe v. Wade and largely Ban Abortions across an entire american state. The legislative legal template the texans republicans created and in which the Supreme Court signed off is now set to be the model in several Red States very soon including arkansas, florida, idaho, indiana, Oklahoma And South dakota. This blatant attack on womens Rights Wont affect every state. In fact, medical professionals in New Mexico are bracing for an increase in women seeking treatment. That assumes they can afford the travel there from texas. This is a key point. What this blatant attack on womens rights also is is a thin ly veiled attack on the poor and the vulnerable. If you have the ways, means and money, you will still be able to get an abortion by going somewhere else and staying in a hotel in a state that doesnt yet outlaw abortions. If you dont, then you wont. Several groups and some companies are starting to speak out and fight back. Lyft and uber say theyll cover the legal fees for any drivers who are sued under the new Texas Law because the law works by preventing State Government from enforcing it and instead deputizes private citizens to enforce the law via civil lawsuits which can be brought against anyone, anyone who helps, who is associated with an Abortion Treatment even if theyre not from texas including the driver of an uber or lyft. 10,000 per defendant. Lyft is also donating 1 Million to planned parenthood. Social media influencers are doing what they can as you can see from the headline. The same antiabortion group behind the Whistleblower Site being overwhelmed by tiktokers suffered a blow in court last night. A Texas Judge granted a temporary Restraining Order of them enforcing the law against planned parenthood. We have the coauthor of the notorious rbg. Irene helps us understand the history of this situation because for those watching this it was clear for yes that roe v. Wade wasnt going to be overturned outright, but instead that republicans essentially find a way around it or a loophole to render the ruling moot. Thats the part about this law that is surprising. Weve seen State Laws over the year walk that line to try and restrict abortions without getting up in the face of roe v. Wade. This Texas Law gets up in the face of roe v. Wade. It actually prevents abortions, not the size of the hallway in an Abortion Clinic or the distance from something. It actually says after six weeks, no abortions. Yes, good morning. Thank you for having me. A 15second History of roe v. Wade is the author was a republican appointee. This was a bipartisan issue. But Pat Buchanan when he was working for Richard Nixon realized that demagoguing about abortion in a time when there was deep anxiety about womens changing roles would allow them to peel off some catholics to the republican party and make an alliance of evangelicals and catholics for traditionalist values including restricting rights around reproduction. That came to a head in the 1980s. Their most cherished goals of Bans Abortion entirely, and for the past few decades a movement has laser focused on not just overturning these decisions and passing as many opportunities in the states as they can to give the court an opportunity to overturn it, but to make sure idealogically pure justices sit in that seat. The 1992 decision that everyone thought would kill roe, they found a middle ground to save it. When Anthony Kennedy retired under donald trump, that was The End of roe v. Wade in this country. So roe v. Wade and all the decisions that followed said you cannot ban abortion before fetal viability, which many states interpret to be around 24 weeks. Youre right that for the longest time there was an incremental strategy to lull people into complacency. The court, even the more conservative justices were trying to find a way to reach these goals, to ban abortion, to restrict access to contraception but do it in a way that had a Fig Leaf to say theyre regulating clinics. To me, having studied this, reported on tshgs it, watched i is surprising they did it this way. To do this in a short order that was late, that created chaos, that doesnt that doesnt follow the courts usual process on saying, you know what . This law is going to harm a lot of people or this law is going to change a lot of peoples lives in the Bestcase Scenario so lets hold on until we can fully consider it. To me, this has been a legal movement in the works for a long time, born out of a backlash to changing womens roles to who can decide this fundamental things of who stays pregnant, who is born, but to do it this way in the middle of the night without any kind of substantive hearing, without any oral argument, to me that shows this movement is getting cocky, it feels like it doesnt have to explain itself, it doesnt need a pretext that its protecting women. Thank you for that. Thats a good setup and a good history of how we got to where we are today. Irene carmone, Thank You. Joining me now is the president and the ceo for the center of Reproductive Rights, nancy northrup. I couldnt have asked for a better setup on that. Irene said that something that some people object to, they say this isnt The End of roe v. Wade, there are lots of other avenues, but practically speaking what are those other avenues right now when the Supreme Court did accept this and did deal with this in the late In The Dark Of Night Without Hearings and without understandings. What are the avenues left right now to stop North Dakota South dakota, im sorry, florida, idaho and other places who have said all right, this one is good with the Supreme Court, well just copy it. Let me start with where you started which is to say that the impact in texas right now is devastating. I want to make sure we talk about the politics and the law but that we dont forget at the center of this is people who cant get access to abortion and its falling hardest on communities of color, people of lowincome, undocumented immigrants, people who have a hard time getting out of the state. This fight in texas is not over. I mean, we still have avenues. Were looking at every legal option. The biden administration, the president came in strongly saying its going to be a whole of Government Effort and, you know, Nancy Pelosi, speaker of the house, announced shes taking a vote when theyre back in september on the Womens Health Protection act. And that is a Bill Congress could fix this right now with the Womens Health Protection act and national legislation. In terms of other states, well continue to be fighting there. We just filed a lawsuit in oklahoma two days ago against their sixweek ban. So its important for people to realize that what you talked about also, that people are coming forward to really show the support. 70 of people in this country want to make sure that access to abortion is legal and available in peoples communities. It is a devastating statement, but the legal fight is in no way over. What we saw from Uber And Lyft was interesting. The idea that anybody associated with helping a woman get an abortion after six weeks in texas can be sued. So you may not want your friend or your partner to be sued, so you take an uber and a lyft so now the driver can be sued. Uber and lyft saying well fund their legal defense. Will american companies that did Step Up for black Lives Matter and that did sort of Step Up in the fight against voting rights, will they come forward and say donations to republicans stop. We will protect peoples legal rights. We will fight for their legal defense. Is that going to be influential in this and do you see that happening . Were only on day three now of this. So we are really going to be hopeful that, again, standing up with the people of texas, standing up with women and pregnant people across the country, we will be seeing this. I think when you see the strong response already from the biden administration, you know, we had a statement from the president , from the Vice President , from the attorney general, weve seen Nancy Pelosi call for a vote on the Womens Health Protection act. People want to make these decisions about their lives and future. These are customers and workers and people across america. We are looking for expecting for companies to show the same standing up for Reproductive Rights, this fundamental constitutional right as in other areas as well like racial Justice And Voting rights. All of this is a piece in a democratic society. Its about people being treated equally and people being able to make decisions for their lives and participate fully in the economic, social and political life of the nation. Those are the words of the Supreme Court about the importance of Reproductive Rights. You talk about what Nancy Pelosi is planning to do, introduce legislation that codiies roe v. Wade, this has been a 50year effort on the part of conservatives. We didnt codify womens protective rights when we could have. Roe v. Wade is a privacy law, its about the state not being involved in the decision of a woman having an abortion. How do you think that might happen now . We cant even get agreement on bipartisan things like infrastructure. Abortion is more partisan than farright republicans would have you believe. Do you think theres a road for Nancy Pelosi to get legislation that codifies a Womans Right to an abortion at this point . Absolutely. I think well be seeing a vote taken in the house in september. I think that vote will see passage of the Womens Health Protection bill. For years elected officials in washington have been able to rely on the Supreme Court. But the Supreme Court turned its back on the constitution, on the rule of law, and on women and pregnant people in the state of texas. It is a new day. Its up to the congress, its up to the president to come in and be the support. We are going to have conservative courts for some time. Well still fight in them and in the federal courts, we need to have national legislation that protects once and for all the right to make these important decisions about our bodies, our lives and our futures. Let me ask you this, theres a lot of women, particularly young women, who do not believe roe v. Wade is something that can go away. That a womans protections against abortion can go away. Youre sounding a hopeful note. For weeks ive spoken to people who are not hopeful. They think this should be seen as the potential end of roe v. Wade, and we should govern ourselves accordingly in terms of what we think about politics, demonstrations, pressure on politicians. Do you think this is The End of the beginning of The End of roe v. Wade or do you not . I mean, its obviously not a good signal from the Supreme Court. The center of Reproductive Rights will be arguing this question in the Supreme Court this term. The court has taken a case out of the state of mississippi, jackson Womens Health Organization versus dobbs. Were representing the one last Abortion Clinic in the state of mississippi. Mississippi has flat out asked and the court has granted a full examination of whether roe v. Wade should be overturned. If they follow their legal precedent, they wont do that. But of course, no, this is a tough, tough fight. The court has in the dead of night turned its back. They should have put a stay in place in texas. Theyre going to be looking at this question coming out of mississippi, should roe v. Wade be overturned. So, no. Its a very live issue. The point is that people are coming forward, theyre joining this battle now because they know we cant necessarily rely on the courts. The Supreme Court should its integrity demands that It Follow Precedent but we wont just rely on the Supreme Court. Were going to the congress, looking to the administration and looking to activists to take to the streets and make the point that people are not going back. Nancy, Thank You for your time. Shes been trying for years to get an actual bill passed through congress that would codify the protections of roe v. Wade. Speaker Nancy Pelosi, as we discussed this morning, has pledged that her bill will get a vote in the House And Representative chu, Thank You for joining us. Its actually possible and likely that that will pass the house. Maybe there are even republicans who understand that moderates in moderate republicans are not interested in the elimination of roe v. Wade protections. Tell me about your bill and its likelihood of becoming law. First of all, we did see the number of cosponsors in the House Increase dramatically. This is the reason we introduced the bill over so many congresses. In fact, in the last congress we had the greatest number of cosponsors that we ever had, 216. So the support for a bill like this has grown substantially. And, in fact, weve had a tremendous partner in the senate since the beginning, Senator Richard Blumenthal took up this bill from the very beginning when we did. Now he has 48 cosponsors for the bill. Remember also that we have two republicans that are pro choice. So we do have majority of people in the senate who are, indeed, supportive of the Womens Health Protection act. Later on this morning ill speak to Representative Clyburn who has said that there should be carve out of the filibuster for things as important as voting rights. Do you think this should fall into the same category . Youre saying it can pass the house and the senate with a simple majority but its not getting past the filibuster. Were not getting ten republicans in the senate to vote for this. Do you think this should also be something that is an exception to the filibuster . I absolutely do. This would certainly help our chances for getting this very, very important bill passed. And this has to be high on the Priority List for us to get past this filibuster. This is too important for america. This is too important for Womens Freedom of choice. We need to get this passed. Let me ask you about the way we should think about this legislatively. A lot of americans dont realize that a Womans Right to an abortion is not on the books in its not on the legislative books in america. Its something that i dont know whether it would have been easier to do 50 years ago, 40 years ago, 30 years ago. Now in this tribal politicized, polarized environment, how do we do this . Most western countries do have a Womans Right to reproductive Health And Abortion as a lay that is legislatively put into place. Is it a failure of ours that we have not done this legislatively all these decades . We have had roe v. Wade in effect for 50 years. We have been protected by that. It wasnt until 2011 in which we saw the states pass these medically unnecessary laws which dictated the width of Clinic Doors and forced doctors to have medically unnecessary admitting privileges or where they required an ultrasound that we saw that we just have to get the Womens Health Protection act in place so that we werent fighting state by statement we werent playing whack a mole with each of these states and their laws. We put this in place since 2013. Weve been ready to enact this law. I have to say in the majority of the years since 2013, republicans were in control of the house, so we couldnt get it up for a vote. Now is the chance. We are ready. We do certainly have the votes in the house. Im so gratified that Nancy Pelosi is putting it on the floor for a vote when we get back and also that President Biden is in support. First white House Press Secretary Jen Psaki did not mince words with a male reporter when asked about womens Reproductive Rights. He believes its up to a woman to make those decisions and up to a woman to make those decisions with her doctor. I know you have never faced those choices nor never been pregnant, for women out there who have faced those choices, this is an incredibly difficult thing. The crusade led by the republican legislature to restrict voting has passed the State Senate but the bill is being challenged in court. At least two lawsuits by opponents of the sweeping Voter Suppression Bill have been filed by Governor Greg Abbott. Critics have called It Jim Crow 2. 0. It will limit ballot dropboxes, make it harder for mailin ballots and gives authority to partisan poll watchers, all things that will impact poor people and voters of color. Once the Voting Bill is signed into law by Governor Greg Abbott it will be one of more than 650 new laws enacted in texas. Thank you for being with us this morning. It is a rough week to be in texas right now, to be anybody in texas, but to be a woman, to be a person of color, to be a person of modest economic means. What is going on in your state . My state has lost their minds honestly. Good morning. Its great to see you. When i was in d. C. There was a rally we did with dr. Barber, one thing i told the people at this rally is that we just got sick and tired of being sick and tired. People didnt realize how terrible our regular session was. People are just now starting to understand why we walked out that very first time. Theyre understanding the level of frustration and how much we have truly been abused the entire session and how inflexible our colleagues have been the entire session on all these bills from saying that white supremacists could go ahead and carry with permitless carry, saying even if a child, at the Tender Age of 10 years old is raped and impregnated has to carry this child, we could not get decent amendments on any of these bills when it came to voting, permitless carry and when it came to crt and so many other things. So ultimately when it came down to our democracy, they gave us no choice because they were inflexible with that and that is the foundation of everything that we do in this country. Elections have consequences. One of the things thats been happening in the state of texas is that its been evolving in terms of its population, a population thats becoming more demographically diverse and that would actually favor democrats over time except what republicans have done in this legislative session is theyve done things to reverse that trend. So the idea that eventually republicans, unless they became more mainstream and did things that appealed to a broader group of people in texas would be voted out of power, they have undone with these voter restrictions. They extended their time in power. Absolutely. That was one of the things we kept saying is that this was a power grab. It wasnt about democracy. They were afraid of the number of people of color. You brought that up. When we look at the census, we know that 95 of the growth was due to people of color in the state of texas. But honestly, i would say its higher than that. We know historically theres always an undercount when it comes to specifically black and brown people. Those were two of the largest categories of growth that we had in the state of texas. Now were heading into yet another depressing portion of Texas History and thats going to be redistricting. Because they know that they Cant Win on the substance. They know they lose because they dont have any good substance. They dont appeal to a broad crosssection of people. So now were heading into redistricting probably in the next couple of weeks in the state of texas. Let me be clear, in fact the republicans have said, well, elections have consequences. The people elected us to be in control. But honestly, when you look at the numbers, theres 83 republicans, 67 democrats, but it was only 8,000 to 10,000 votes that kept us from flipping the house. Theyre dead set on changing those lines because they know some of them won by a razor thin margin. Which means they can win with thinner margins under this new way of doing things. Theres a world in which conservatives in texas and around the country could appeal to black and brown people. There are conservative streaks amongst black people and hispanic people. It could be won on the basis of good policy but they decided black and brown people are not likely to vote for us for decades to come, so well just try to not have them vote. Thats absolutely right. You heard from our Lieutenant Governor not long ago who said the reason were having the problem with covid is because of black people. Then he said we know black people, theyre democrats, so this is a democratic issue. Thats why we have terrible spread in the state of texas. They continue to basically just evidence their racism. The reality is im the child of a preacher, so many black folk are really rooted in a very a level of conservativism. There is a way to appeal to black people. Theres a way to appeal to my brown brothers and sisters which many of them are catholic. So they really do have the ability to appeal on very conservative issues, they choose not to. They choose to support white supremacy. They choose to go to the far right. They choose to do those things that isolate the majority of what texas looks like. Just to be clear, gop, i know you know this, maybe the rest of the country doesnt know this, texas is a majority minority state. Its time to start to pass policies that will respect each and every texan instead of a select few. Representative jasmine crockett, good to see you this morning. Thank you for being with us. Its a prime example of a natural event made more dangerous by the Climate Crisis. Ida came ashore in louisiana On Sunday as a fierce category 4 hurricane with sustained winds of 150 miles per hour. Hundreds of thousands of people are still without power nearly a week After The Storm Made Landfall and then, wham, just a little more juice left in her, ida lashed the northeast on wednesday. New York City shattered its record for the most rain to fall in a single hour. That record, by the way, was just set a few weeks ago. Raging currents flooded the subway. This is actually water coming in to 28th street. Looking more like a Hollywood Production than a typical commute home. The remnants of ida caused more deaths in the northeast by a lot than it did in the Gulf Coast where it came ashore. Think about that. This storm was so strong that at its weakest point after making its way all up the country it still caused catastrophic and fatal damage. These Weather Events are not new. We had flooding and hurricanes since the world began but its the increasing Strength And Frequency of these events that should scare you. Humanmade Climate Change is exacerbating extreme weather. You better get used to it because until we take tangible action to fight Climate Change things will get worse. We wasted decades arguing with and convincing people that Climate Change is real and that it is here. At least most of us are on the same side of this issue. Convincing people to accept the reality of Climate Change is only a small part of the battle. We are not all on the same page about what to do with it and how fast to do it. And thats when australians came facetoface with Climate Change. Now here, as you note, were coming facetoface with Climate Change. Many of us are stuck in a system and we have to operate within the system that exists. When polluters try to convince us its just a matter of individual lifestyle change, the reality is we have to live within the system. People work, they need to make a living. Its the system that we need to change. Yes. We need incentives that decarbonize rapidly. Lets talk about that. Yes, people should drive cars that consume less gas. Yes, we can all behave in a way that consumes less energy. Yes, that will be impactful. But in The End there has to be a commitment to ending or at least drastically changing our relationship to Fossil Fuels. Were not there yet. When Gas Prices started to go up in recent months, we had the president of the United States asking opec to produce more oil. We have more Drilling Permits that have been issued in the United States. I understand why the president wants to keep Gas Prices low for americans who have been struggling for the last year and a half. How do we break this business . How do we let Gas Prices go up so that we are forced to find alternatives without having people suffer . Thats absolutely right. Look, the biden administration, its a change from what we had before. They have taken some bold action and real leadership. At the same time theres what we call an Implementation Gap between the words that the administration is using, the commitment to lower Carbon Emissions by 50 within the decade, which is what we need to do worldwide if were going to avert warming the planet by 3 degrees fahrenheit. Theres a gap between those words, the pledges, and the policies on the ground because we are still seeing support for additional fossil fuel infrastructure, new pipeline construction. When the conservative international energy agency, generally not been very bullish on renewable energy, has said that if we are to prevent catastrophic warming of the planet, there can be no new fossil fuel infrastructure, no new oil, no new natural gas, no new coal. And that means, again, we need policies this Infrastructure Bill thats working its way through congress, the reconciliation package, there are major items in the current version of that package that will move us in the direction we need to go. But theyre vulnerable. We need to make sure that those elements of the package remain in it as congress continues to debate. I wanted to talk to you about the price of renewable energies that are not Fossil Fuels. The argument used to be theyre too expensive. Solarvoltaic power dropped 85 . Concentrated solar power down 68 . Onshore wind, down 56 . Hydro is still cheaper. Yet when we saw the ipcc report, which was a Witt Cal Warning that underscored the degree to which scientists like you are not of differing views of what causes Climate Change we still do not see fullthroated condemnation of a system which which relies on Fossil Fuels and is not fundamentally willing to change. Why . What is everybody scared of . Why cant we have an allout assault on our reliance of Fossil Fuels . And that could include my lifestyle changing, and i get that and that will be difficult, but we have to do it. I like that you emphasize we should all try to live lifestyles that decrease our Carbon Footprint, but there is a reason that bp gave us the first widely used individual Carbon Footprint calculator, they wanted us so focus on our own Carbon Footprint that we failed to take note of theirs. 70 of global Carbon Emissions come from 100 polluters. Any meaningful action has to be focused on them. If you look at the ipcc report, despite the dramatic impacts that it lays out in detail, it is many some sense in some sense reticent and conservative when it comes to the Policy Side of the matter and the political side. Because scientists by their nature tend to be conserve in that regard. They dont want to get ahead of the science and wade into politics. They are afraid frankly of being attacked. Ive been at the center of a massive, you know, attack campaign, the Fossil Fuel Industry has funded attacks against Climate Scientists for decades now. And any scientist who would speak out about the threat of Climate Change would be villified on, you know the pages of the Wall Street Journal and on fox news. And youd have carb get angry politicians demanding youre fired from your job at your university. There has been a concerted campaign to intimidate scientists. And to some extent its been successful. Thats why i wanted to speak to you specifically this morning because i know youre at the Receiving End of that. And i Thank You for your bravery. Michael mann, the new book, the climate war. A small Texas Town gained notoriety when a video as far ased of students shouting the nword. The School Board sought to address it but dozens of conserve parents stood in the way. Way before critical Race Theory became a nationwide debate and a conservative boogeyman, a Dallas Texas suburbs with the epicenter of the crusade against critical Race Theory. The town of southlake, black was thrust in the national spotlight after a video surfaced of students chanting the nword. The town of the School Board faced backlash after trying to implement a cultural Competence Action Plan supposed to address the ongoing issues of Racism And Prejudice in the district. The focus of the next episode of the new nbc podcast southlake, takes us inside a fiery School Board meeting where conservative parents lined up to explain why they object to changes to the curriculum and disciplinary measures to protect students of color. As you mentioned there, there is the 2018 viral video, students chanting the nword, a plan ends up proposed. But the plan is not ready until just a couple months after george Floyds Murder in to you. The man is seen in the highlily rationalized context. Backlash begins. Hundreds of thousands of dollars are raised, a lawsuit leading to a Restraining Order till . Place today that bars the district from work on any kind of diversity inclusion plan. This episode makes sense of the level of investment in opposition. And i want to you meet one of the parents who has been on the front lines of this opposition at a conversation with this Gentleman Name Juan salvobarp his views are representative of the opposition to this diversity plan. Essentially he believes that incidents of racism can be addressed individually independently within systemic racism is not real. Take a listen. Juan is Mexican American and the former army officer. He has a daughter in Elementary School in carell. The media in general has an approval right around congresss. Im going to protect myself. By having her. I cant stop you from filming. Despite his mistrust, juan agreed to speak with me outside a School Board Meeting Hast Winter with Someone Filming to ensure his words werent taken out of context. So the Action Plan when you read it, you start to very quickly find out that the cultural Competence Definition is nowhere in the plan. And in the 34 pages you find equity, equity, equity, microaggression, never defined, microaggression is defined as verbal, nonverbal, intentional, unintentional, in other words its in the mind of the beholder. And so i know that the opponents if i give them the benefit of the doubt, you know, they want a plan, because they have their life experiences. But i also have mine. I mean, i grau up as a child in the 70s and the 80s as a Mexican American. And i i was called all kinds of names. And i was in a lot of fights. And i will tell you that i was getting it from both sides. I was get going from white children and black children. So does that mean that im supposed to assume that there is systemic racism in the black community . No, i reject that. Its important to know that his response there is also coming on the heels of hundreds of student testimonials. The that describe not only racist incidents between students in the school district, but actually adults, administers failing to respond. Either overhearing these things not taking action, or Launching Investigations that lead to little to know consequences for the offenders. And so part of what the community of color in this town of southlake asked for what is a plan addressing this in a systemic way because it wasnt just about, you know, what one kid said to another on the playground. It was about the adults refusing to take action. And that is sort of some of the tension here you can hear him explaining there. You know, its not that he denies that racist incidents exist at all. But he doesnt believe the school that School System and that parents and administrators and teachers really need to be involved in the action taken to guardians it. Its a microcosm of the debate going on across the country around how do we teach and mitigate racism . And and tonia thanks for the great reporting.
