Abortion rights supporters in texas days after that restrictive ban went into effect. Well speak to the president of Planned Parenthood about their Restraining Order against an aggressive Antiabortion Group. The president weighing in on the unusual way the ban will be enforced. The most pernicious thing about the Texas Law is sort of creates a vigilante system. Plus desperate pleas for help from pediatricians, childrens hospitals across the country facing an unprecedented strain as the Delta Variant targets the unvaccinated. And sounding the alarm, democrats in California Urge residents to take the Recall Election there seriously. Im lindsey were beginning in texas, a victory, though a small one right now, for Planned Parenthood this morning, a Texas Judge granting a temporary Restraining Order, which stops an Antiabortion Group in the state from enforcing that hotly new contested ban, which took effect earlier this week. Nbc News Correspondent Liz Mclaughlin is in austin, texas and Nbc News white House Reporter Lauren Egan is traveling. What can you tell us about this new Restraining Order, liz, that was filed by Planned Parenthood and what this means going forward . Reporter so travis County District Judge did grant this Restraining Order but for Planned Parenthood it may be a step forward but theres still a long road ahead. Its very limited in scope. Specifically protecting Planned Parenthood from being sued by texas right to life and its associates. Thats an Antiabortion Group that helped pass this law. So anyone else so any other Abortion Providers are still liable and anyone else can still sue Planned Parenthood or any other providers or any private citizens who counsel, finance or otherwise transport patients. So its still very limited and Planned Parenthood said make no mistake there needs to be more relief for the women in texas. As of now, Abortion Clinics have no have no choice but to comply with this rule. So women between 6 and 22 weeks of pregnancy about still in texas do not have access to their constitutional right for an abortion. Lauren egan is with the president in delaware. Lauren, yesterday we saw the President Use really strong language about this bill. He said it could lead to unconstitutional chaos. Hes vowing a whole of government response. What does he realistically hope to achieve given this could face such a tough road in the senate and does this team think the issue will energize democrats. What exactly the White House can do about this is unclear. The president has asked hhs and the Justice Department to review what sort of legal remedies are available to the president to make sure that women in texas have access to safe abortions but that review is going to take some time, lindsey. The president himself yesterday acknowledged that right now he just doesnt have an answer for women in texas who are seeking abortions. Now, the White House has said that the president would support some sort of federal legislation in congress. Some sort of bill that would codify Roe V wade. In the meantime the president has affirmed support for Roe V wade. Take a listen to what general psaki has to say. Why does the President Support Abortion when his own faith believes its wrong. He believes its a womans right. Who does he believe should look out for the unborn child. He believes its up to a woman to make those decisions. I know youve never faced those choices nor have you ever been pregnant but for women out there who have faced those choices this is an incredibly difficult thing the president believes that right should be respected. Some democrats are saying that the renewed focus on Abortion Access will help democrats in the 2022 midterms. That theory will be put to test this fall in virginia where were going to see Governor Terry Mcauliffe run for election, and hes already warned if his republican opponent wins virginia will become the next texas. The President And Ceo of plan the parenthood called it the loudest the President And Ceo Alexis Mcgill Johnson joins us live this morning. Ms. Johnson thank you so much for being here. Really appreciate it. Lets start with that Court Decision we learned about overnight. A win, is it, for your organization . Tell us how you came about with this strategy of this temporary Restraining Order and how it felt to have a Judge Side with the organization, at least at this point. Well, look, i mean, its clear, sb8 was designed not only to deny texans the right to a abortion that theyve been guaranteed for the last almost 50 years, but it also cruelly empowered this vigilante Bounty Hunter Strategy and really was incentivizing, has been incentivizing people to surveil and harass people in our clinics and so weve seen, you know, people staking out health centers, increased surveillance, suspicious calls, threatening our patients and so this is a win for protecting our patients, nurses, clinic staff, and ensuring, you know, that, you know, people have the right to go to work without harassment. And so it is critically important. It is not the relief that we need, of course, for patients seeking access. The largely black and brown low income communities that are going to be most affected by this horrific ban in texas, but it is a step in terms of just helping us, you know, ensure the safety of our staff and patients. Yeah, that step, the Restraining Order, expires September 17th. Not too far away from today. Do you expect that many of those Bounty Hunters as you call them will deal with that Judges Order and not try to harass many of your patients as you said . I mean, you know, i think that this is the craziness of this law, you know, again, it really has been a sue thy neighbor strategy, so destructive on the access to abortion but the implications of this on so many issues. You know, what the state of texas has done is really tried To Circumvent The Constitutional Right by Empowering Average citizens to enforce this ban. You know, the State Lawmakers who came up with this, you know, maniacal strategy dont take responsibility for enforcing the ban themselves because they understand its unconstitutional. Theyre giving the power to average citizens. And, you know, and that is crazy, right, i mean, were talking about 10,000 as an incentive to sit in a Parking Lot and write down someones license, take pictures of people, like thats insane. And, you know, and really, you know, they do it without knowing they have stripped away access to our constitutional right to make decisions for our own selves and thats, you know, thats really, really abominable. We know other states are looking into this as well. States like florida. We know governor Ron Desantis has already said hes going to look closely at this law. What does that mean here for the trajectory of where we could see . Do you anticipate other states to enact Copy Cat laws . Absolutely. Thats why i said this is the loudest alarm yet, right, that Abortion Rights are in Grave Danger across the country. This bill is so extreme, and it is purely a part of a national agenda to limit and curtail access to abortion in this country. There are 25 states in addition to texas that are poised to essentially engage in some kind of Copy Cat form and i think the Supreme Court gave a nod to the possibility that this kind of law would go unchallenged. So i you know, yes, of course we expect to see it. We see this as a clear part of trying to overturn roe without even having it be reviewed at the Supreme Court, you know, this fall. You know, we know that congress is going to hold hearings and Speaker Pelosi will introduce a bill in the house to codify Roe V. Wade, which would likely not pass in the senate. The president has vowed and all Governments Response to all of this but weve been down this Road Plenty of times before, not to this point. What is there to do next . Do you need the are you calling for the president and this administration to try to expand the court . What can be done now . Look, all of the options are on the table right now, you know, the Womens Health Protection act is a very vital, important set of legislation that would codify roe and give us federal protections that, you know, are obviously critically important, particularly around the kind of bans. You know, weve seen 600 Abortion Restrictions introduced just this year. 90 of them have been enacted and there have been more restrictions enacted than any year since Roe V. Wade was became law. And so, you know, it is incredibly important. We have a you know, a very conservative court, we are just a little bit less than a year short of when Justice Ginsburg died but we can already see the heartbreaking impact, so, you know, i think that we have to look at all of our options, and we have to make sure that people understand, and make clear to their own lawmakers, you know, what their values are. There is no state in the union that does not believe that we should have access to safe and legal abortion when you look at public opinion and i think its really important for lawmakers to reflect where their constituents lie. And the 70 of abortions in texas in 2019 were provided to women of color. Earlier this summer you told El Magazine that Planned Parenthood is going to make a big bet on equity. Does racial Equity Need to be a bigger part of the conversation . Oh, absolutely. I mean, the impact that we are seeing in the south with these restrictions, and in the midwest, are clearly designed to impact low income women of color, and were talking about largely black and brown communities, were talking about folks who are already suffering from the public Health Crisis that we are currently going through, and adding another layer of restrictions on them, you know, and criminalizing, right, criminalizing the people who would be in their community supporting them getting access to abortion, its just really, again, unconscionable. So yes, there is a very clear, you know, dispa rat impact. Im curious about this, and say youre a young woman in texas right now who may be wanting the services that Planned Parenthood provides, including getting an abortion. And say its after September 17th when that Restraining Order expires. Whats your message to that person, should she go to another state, or should she try to find help right there in texas . Look, i mean, Planned Parenthood as well as other independent providers in texas are complying with the law if she is, you know, before six weeks, and a provider will should be able to see her. But the reality is most of us dont know that we are pregnant at six weeks, thats just two weeks after a missed period. So, you know, thats the thats essentially how they are gutting roe in this moment, right, so, yes, think about what that patient has to go through. Theyre already grappling with a state mandated counseling, theyre grappling with other barriers like 24hour waiting periods, mandated ultrasounds. What should that person who eventually finds out that person is going to after six weeks, that person is going to have to take off work, theyre going to have to, you know, likely identify Child Care and Travel Hundreds of miles outside of texas. We have seen, you know, our clinics in New Mexico are booked out three weeks from now because people are already making that journey. Theyre already making their plans to get out of state. Thats what the law is designed to do. Its designed to limit your access to Health Care in state. Okay. Going to have to leave it there. Really appreciate your time. The mayor of Baton Rouge tell us they really thought this community would be in the eye of the storm. Instead it seemed to skirt the area and the infrastructure for the most part did hold up, guys. Good news in Baton Rouge. Now to gary where the Death Toll is rising, were hearing at least 25 people have died from wednesdays severe weather there. Reporter kendis, yes, across the state of New Jersey its a weekend of recovery. The Pasaic River was the last river to crest overnight. Thats good news for the residents there. The waters will start to recede. Down in south jersey, we went the Day Yesterday after an ef 3 tornado ripped through a neighborhood, and destroyed homes, one of the bright spots about that incident was one that nobody was injured and nobody died from that incident which is good news but also just the community that got together after that and they were going to each others houses asking if they needed lunch, needed help, gags, groceries, anything to do to be able to help the situation there. I do want to have you watch this video of one man who experienced the tornado from inside his home. This is it. Come on, buddy. Comin. Holy holy [ bleep ]. Reporter im here in central New Jersey in manville, this is a house that exploded after what residents believe was a Gas Leak due to the Flood Waters in the basement but the Emergency Crews Couldnt get here because water was so high it was over the cars on the street. So you couldnt have anybody put out the fire that ended up happening at this house, which means the House Next Door also caught on fire and was unable to be saved. Theres not even anything you can salvage from this house behind me. So as you mentioned there are 25 dead across the state. In northern New Jersey also a number of people missing as well. Youve covered so many disasters over the years, over more than a decade now and every disaster is different, still, all of that said, how does this one compare to many of the others that youve been to, and is it more than just our imagination that these are really becoming more and more frequent . What we saw in Baton Rouge, the Damage Wasnt quite as widespread but just outside of this area, in New Orleans and the parishes around that area they have really been hard hit, many communities remain under water. They are still without power now five days after the storm came and many folks say they need electricity to power not just airconditioning which is not a luxury for many folks but a necessity to get back onto their feet that has not happened so its devastating to see how these impacts from these natural disasters keeps getting bigger and bigger and affecting so many people as we continue through the years. First of all we knew from the beginning that there were going to be mutations and variants of the original Covid19 Virus and this is exactly what were seeing. We went through alpha, we went through delta, were still in the midst of a major delta surge. The new Mu Mutation is something that originated in south america, in colombia and is now being seen in a very small number of cases in the united states. The concerns and by the way, this is not a variant of socalled concern, its a variant of interest, as you pointed out but the possibility of this being resistant, this particular strain, to the vaccines that are out there, its mostly from laboratory findings. We have no idea whether the vaccine will be diminished in its effect as opposed to, say, dealing with the Delta Variant of the virus but in the meantime were just watching it. Theres no particular reason for alarm except there is reason to continue to be attentive and to continue to track where this particular variant shows up around the country. And new data found that kids accounted for more than 20 of weekly u. S. Cases, childrens hospitals around the country are asking for help, they say theyre running out of beds. Do you think this has to do with kids going back to the classroom, and, of course, the fact that kids younger than 12 dont have access to the vaccine yet . I think that certainly is part of the issue, lindsey, but i would point out that for a very long time after the pandemic started we were under the impression that children would not be very affected by covid19 for a variety of reasons. I think one of the things weve learned, if nothing else, that this virus and the variants associated with it are extremely unpredictable, lindsey, and i think any old news about children being, you know, not vulnerable to the virus needs to be discarded right now. We have to watch closely, going back into classrooms is a problem because the possibility of spreading among children is there. And the thing that really does concern me is i have to keep asking this question. Why are we letting teachers and other adults into schools who have not been vaccinated . I think we should be having an absolutely hard and fast rule, a policy that if you want to work in the school as a teacher, as an administrator, as a bus driver, you must be vaccinated and be able to prove it, period, no exemptions. And i think that were failing our children but not insisting on that, and masking in schools. So were setting up ourselves up for some ongoing problems with children and covid, lindsey. Dr. Fauci talked with our colleague Chris Hayes Last Night who said he didnt want to guess but he did give insoogt into when we could see a vaccine for kids 12 and under. Lets listen. You cant criticize the fda for moving slowly unless the companies submit the data to the fda. For example, to apply for an Emergency Use Authorization. When they do the fda is going to make a determination, is this truly an Emergency Situation . And if it is theyll seriously consider an eua. That being the case, if they do that, and thats an if, i dont want to second guess them, then you could probably have approval for at least one of the products as you get into october. What do you think, could we see a vaccine for young kids by october . We could, but heres the thing. You know, im a pediatrician in my background. I am certainly concerned we want to get the Emergency Use Authorization as quickly as possible but we dont want to skip over parts of the process that will assure us that the that the vaccine is safe. And by the way, children, you know, are not little adults. The doses will vary according to the weight. And age of the child, and this is something that has to be processed by the fda. What is the right dose for a 5yearold, a 7yearold . We dont quite know yet and thats the information that we have to understand before we issue an Emergency Use Authorization but i totally agree with dr. Fauci, we could see the vaccine for kids next month but certainly by The End of the year, lindsey. Good to know dr. We need paid Family Leave now, education priorities and so on. But those criticisms and backlash from progressives arent going to change Joe Manchins mind alone and this Isnt Anything new. Before they left for recess he sure did let democrats get on that budget resolution, he voted for that 3. 5 trillion which set the ball rolling, set the plan in motion. While hes calling for a pause, by the way, the last few weeks democrats in the House And Senate have been spending weeks crafting this immensely complicated legislation. And so hes coming out with this oped now saying i dont know what the rush is in doing this now. He, in fact, said the Words Inflation and debt more times than i can count in that Opinion Piece alone. But hes not alone. Although it seems like he holds the keys to the castle here there are a handful of moderate democrats who also feel the same way and democratic leadership needs to work to get them on board. Us some early voting centers in california opened today in the special election on whether to recall Governor Gavin Newsom. Latest polling shows only 38 of people supporting recalling newsom while 58 oppose. Conservative Talk Show Host Larry Elder known for extreme views is emerging as the republican front runner, joining us is the chair of the California Democrat Party rusty hicks. Thank you for being here, i know its early out there. How much will this rely on Voter Turnout . Well its great to be with you. Let me just say, this is not a persuasion election. This is a turnout election. Far right extremists that started this national republicans that embraced this, the democrats, if we turn out, we have the opportunity to defeat this recall on question one. So how are you doing that . How are you trying to get people on a regular saturday, or a regular September Day to come out and find that its important to do this . Well, were we as california democrats are doing what we have always done, the belief in a Person To person, a voter to Voter Conversation is what makes the difference. So for weeks and in many ways months we have been texting and phoning. Were now canvassing, postcarding, ensuring that every california democrat communicates with their friends, their family, their neighbors their coworkers to let folks know just how high the stakes really are in this republican Recall Election. We recognize that the eyes of the nation are upon california. And were ready to step up and make it happen. You know, Larry Elder has been around for three decades in california pushing some pretty extremist views, recently pushing Covid Misinformation as well. Lets listen. I dont believe the science suggests that young people should be vaccinated. I dont believe the science suggests that young people should have to wear masks at school. Im not sure the science has said that at all. And young people are not likely to contract the coronavirus and when they do their symptoms are likely to be mild and not likely to be hospitalized. And certainly not likely to die. What would this mean if you were to be elected for the trajectory of your state in terms of covid, we know your state, and many communities within your state, have kind of been on the forefront of some pretty strict covid measures. Well, Larry Elder has been a Talk Show Host for several decades, and much like the national republican party, and even the california republican party, hes not sought to moderate those views in this election. Hes actually doubled down on those extremist views. And so whether its covid restrictions, essentially saying that he would roll back all of the mandates that we have in place here in california, whether its in choice, and reproductive justice for women here in california, and across the nation, whether its in compensation, the fact that he doesnt believe in a minimum wage, means that if he is elected governor we are essentially taking our state back to some incredibly dark days and so thats why this election is so incredibly important for folks to get out and vote and vote no. And defeat this republican recall. Lets look beyond just the election itself because in theory, in possibility and realistically elder could become governor of california with just 12 of the vote. What would that say, not just about this election, but the system that you guys have out there . Well, it means that we need to make some changes. You know, california has one of the lowest thresholds to qualify a recall. This is actually the sixth recall against Governor Gavin Newsom whos only been in office a little over 2 1 2 years. What it means is that we need to make some changes in this system, whatever the outcome is. I believe the outcome is that Governor Newsom will retain his seat, and will continue to move california forward. But youre right, i mean, governor Governor Newsom could get 49 of california voters to vote no on question one, and then one of the 46 alternative candidates could get less than 20 and become the governor. That system just doesnt work. It disenfranchises california voters and we need to make sure we make changes in that system going forward. Well be watching. Rusty hicks, thank you very much. Jacksons wife was released from the hospital after a Twoweek Battle with the coronavirus. The Jackson Family said in a statement that the reverend continues treatment at a Rehab Facility for lingering covid effects that have aggravated his parkinson. The couple tested positive last month and were hospitalized for just about 11 days. The Dixie Fire continues to grow in california but there is cautious optimism this weekend about the Caldor Fire. Steve patterson joins us live in south Lake Tahoe, california where the Tourism Industry has taken a big hit this weekend and beyond that so many people are just concerned about their homes. Theres no other way to put it. Firefighters here especially are exhausted. Theyve been battling this for more than 20 days. Yet the fire is still a threat but theres optimism because of the weather. The weather made a dramatic turn. Less wind, more humidity, cooler temperatures. All of those factors putting firefighters in a position where they can attack the fire, go on the offensive. Still the Caldor Fire rages. It is more than 200,000 acres, threatening tens of thousands of homes in the area. Burning dangerously close to the core of south Lake Tahoe. Only about five miles or so away from the area. Meanwhile, you said it, this should be one of the biggest days, weekends of the year for this region. They have seen an influx of about 100,000 people. Thats a blow to businesses, particularly resorts in the area who had to shut down from the pandemic over and over again and now shutting down for this fire. This town still a Ghost Town and theyre feeling it. I spoke to a Resort Manager up the road here. Heres what he tells me about how heartbreaking it is to see the city like this. The property opened in 1991. To see the town this empty, theres checkpoints through town, thats it. Theres no tourists, no locals, no supply trucks, no contractors, nothing. Have you ever seen it like this . Never. Never. Again, this is a major blow to the economy here but the fire continues to grow. Its more than 200,000 acres. The 15th largest wildfire in california history. Firefighters still have their work cut out for them. Back to you. Its going to be a long Labor Day Weekend for everybody out there. Daily new cases are consistently above 150,000 per day, daily deaths are once again around 1,500 per day. It continues to affect everything from president bidens approval rating, which a slew of recent polls show is the lowest of his presidency now in the mid 40s, to the economy. Yesterdays Jobs Numbers were a terrible sign of a deltainfused slowdown. To make matters worse, the Health Care systems in several states are at or beyond their capacity. Theyre literally turning people away from hospitals. The gop seems uninterested in fighting this pandemic or making things better.
