Five republican Supreme Court justices, including three appointed by donald trump, a man who lost the Popular Vote in 2016, by neither 3 Million votes. They destroyed the womans right to Bodily Autonomy and reproductive choice. First in the state of texas, who knows whats next. And they did it shortly before midnight. With no big public announcement. With an order that is barely more than a page long. I am struggling to come up with the proper words to describe to you, how both cynically reckless and contemptuous the actions of the court were last night. It was essentially a middle finger, from those five justices. As if to say, we are here, we are here for life, and we can do whatever we want. Lobby damned, precedent be damned, harm be damned. In fact chief justice John Roberts, who is clearly aligned with the objective of those five justices, issued one of the dissents. Basically saying, guys, im not sure we can do it this way. Quoting from his dissent he says, i would like to stop the law from going into effect, so that the courts may consider whether a State Something im about to discuss. So in essence, robert seem to be saying, hey, lets wait, since the Supreme Court already teed up to overturning roe v. Wade for this fall. Theyve already said it up. They have a case out of mississippi. In 2018, mississippi passed a law that bans abortion after 15 weeks. Several months later, a set federal drugs, block that Law Firm going into effect. As is normal, because its not constitutional. In Appeals Court upheld that decision in 2019. Defining that the law was quote, facially unconstitutional because it directly conflicts with unquote, prior Supreme Court precedent. Thats correct. But earlier this year, the Supreme Court decided to hear that case. The case of Dobbs Versus Jackson Womens Health organization. They plucked it out, lots of cases dont get to the Supreme Court. But they wanted that one. And we all know why they wanted. It there it is. So they had already decided to review mississippis 15week Abortion Ban, which is on its face, unconstitutional. But even given, that in more defensible law than what came out of texas. The five conservative justices, roberts notwithstanding, they were so anxious and chomping at the bit to kill off, road to take away abortion, rights they could not wait. They could not weigh. They couldnt wait a few months to hear arguments about mississippis law. And then a few more months to actually write an opinion in announcing and go through all the rigmarole. Instead, they took this wildly essentially lawless position, less than 24 hours after the Texas Law went into effect. In the dead of night. They issued an order, that amounts to a shrug. Well, you know, this ones procedurally tricky. So its out of our hands. So too bad all Year Abortion clinics have to close. Hence the nothing to fence from national republicans. But if you really have to understand, hear about this law, and about what is happened, is that this Texas Abortion Law was crafted, precisely to achieve this, they made the law so as to prevent federal courts from blocking it. They crafted the law and then handed it to the conservative justices of the Supreme Court who said europe checks out. Its an attempt at a kind of magic trick, or maybe more like a common, like a sidewalk con. With a deck of cards. To make the law magically go away. And its worth taking a second to explain, how agree just it is, searches bear with me here. Usually what happens, when a law goes into effect, that is arguably unconstitutional, in this case flatly unconstitutional. The people that are harmed by that law, or think they are going to be harmed, seek something called Injunctive Relief. They go to the court and they say you cant let this legault intuitive fact its unconstitutional, the plaintiffs they name when they file that lawsuit, to stop the law from going into effect, is usually, the Government Official that will enforce the law. For instance, the case to stop the Bush Administration from putting Guantanamo Bay detainees on trial, before Military Commissions was hung dead versus rumsfeld. Then secretary of defense. More recently they sued Texas Governor Gehrig abbott, on behalf of one of the womens shelter providers on the u. S. Mexican border. The Attorney General and governors names around the lawsuits, okay, that i usually get objective relief is to sow in the government. So what a Texas Lawmakers due to avoid that . They decide that the law, will not be enforced by the government at all, in fact they goes step further, they make it illegal for Government Officials in texas to enforce this Texas Law. Which is nuts, but the reason they do is, well theres No One to sue. Who will you sue for Injunctive Relief . Who will enforce . At a high, private actors will. So thats the structure law, its a state law, not enforced by the, state enforced by private vigilantes, with a bound to dangling in front of them. And that whole structure, which is obviously dystopian, and ridiculous, and despicable. Its part of the trick, its the card trick, its the hack, so there can be no named plaintiffs for Injunctive Relief. Are you following . When the new, say well i guess the State Courts would ultimately enforce it because its under State Courts, the lawsuits get, filed so you can name state judges. A hot. No. Not clear you can sue adjudged for Injunctive Relief. So the whole thing is constructed, again, by design, not to be a good law, not to create the conditions for human flourishing, not to order society in a way that promotes the general welfare, its designed as a trick, so that it cannot stand up to actual review, and be struck down before it goes into effect, its a dirty trick. But a cheap one, punitively to make it tough for the court even hear the case. And in this case, the people who wrote that law, and the judges judging it, its like the three card monty khan, where there is the guy at the sidewalk taken the, money in the other guy walks on and pretend sieges got their needs a goal, but theyre on the same team, its all the same team here. The judges in the people who wrote this law. They are on the same team. They are both in on the con, republicans crafted the, line the five conservative justices who decided they would not block Texass Sixweek Abortion from going into effect, because this is just procedural trick away, theres No One to sue, theres no way to get injunction relief. That this is what is going to happen, that we are not going to have a legal and accessible abortion. But i would argue that there have been hundreds of moments, over decades, that have led up to this. And in those moments many people have pointed, out this is the direction we are heading. And many of those people have been ignored. Theyve been talked down too. They have been said that theyre being hysterical and overdramatic. And there again, its a stunning a lot, and as you pointed out at the beginning of your monologue. The way in which it was done, first of, all sitting quietly on it for a night, we know from this court, they are willing to get up in the middle of the nights, to protect religious gatherings. We know that they can act quickly. In the fact that they did this weird performance of just not saying anything for 24 hours. Just remaining silent. And then when they finally did it, saying. In a way that actually undercuts the courts own authority. That says, yeah this is unconstitutional. This is in the face of precedent set here in this court, even if we obviously are going to overturn that, On A Mission to overturn row. At the moment, and still the Courts Decision. We are going to let this thing go. There is messaging there. That reflects the absolute disdain for, for the rights to Bodily Autonomy, dig wishing flourishing. Heres my take away. The kind of middle of the night, one paragraph quarter, is that they were able to allow this Abortion Ban, without the headline of roe v. Wade is overturned. Without the kind of shockwave and convulsions it would cause if that happened. Theyre almost sort of Culture Aiding people, to a world of illegal abortion. So that when they do overturn, row when they do rule on this less extreme, 15week mississippi ban. It will be hard to arouse people. The Bottom Line is, we have to build back better, and we have to make sure that we address climate change, so that we do not continue to exceed this exasperated every single year. And that is the other piece the president has put into the root reconciliation, bill the bill that the agenda is to make sure we get 100 of our electricity, from clean sources, by 2035, and we incentivize the build out of renewable and clean energy across this country, so that we can, wed, not just our country, but help to lead the world is we pressure other countries to do the same thing. We have not at this point in time, we have not had legal counsel to advise us as to what we are allowed to, do are not allowed to. Do specific to them vaccinations. So you dont have, you dont have a Vaccination Requirement in your School District . No we do not have a Vaccination Requirement in my School District at this. Time when were talking about levels of mitigation, one level would be having vaccinated teachers, hopefully a lot of them are vaccinated. A second level would be masks. Why did you decide, to require masks inside the schools, despite the fact that the government said he would take away funding for your School District . This decision was something that was very difficult for us to consider. And to look into. And to make a decision on. When it happened, is the numbers here in the county were starting to spike. And our numbers. And we continue to see spreads that were happening throughout our county. We are now also starting to see where the hospitalisation rates, in the Pediatric Icu Beds were also increasing, and so whereas originally in the summertime we were thinking we are going to be able to make a optional, it just got to the point where unfortunately, the data for our county, was very alarming and very concerning. And were coming Back To School, all back in person, so we knew that the strategy was separate by six feet or three, feet its just nearly impossible inside of a classroom. So with the Positivity Rate increasing, and knowing that we needed to take as many mitigating factors into play as possible, that was Wire Board made that decision. A very difficult decision. We did not want to go against the governor. But at the same time, they are responsible, their constitutional duties require for them to provide that safe environment, here locally. Within the county. What is it mean for the county, in Terms Of, i am still a little unclear about what the actual stick the governments wielding against the School District. So, what he did is actually we have two different sanctions, that are in place. The first sanction that he is doing, is withholding the School Board member salaries. For each month that we are not in compliance. Thats important also to realize that even though our board made this decision, we were revisiting the decision, after labor day. So we will continue to monitor. Its not a decision thats been made for the entire year. So our School Board members, prior to the commissioner coming out and saying that they were going to withhold their funds, they withheld an august 26. It was 35, 000, a little bit over that. That they did. And when withholding those funds, and the other thing that they also put in sanctions for, was paperwork. As you might say. So on a daily basis, every one of my schools, every one of them, that those principles at this point in time have to certify, a report that basically goes into, listing the names of students, the parents information, the Contact Information for any student that we had to discipline. Or, if a parent or the student themselves, or a caregiver, just reports that the child has been harassed. Were doing that because even in the order they gave us was so vague. So they are punishing you, with some paperwork. For a masking requirement. To try to protect the school. Have parents been generally how parents been about this . Overwhelmingly supportive, everywhere im going, when im interacting with the community members, when im interacting out at our school sites, of course there are parents there as well.
