Insane last night. Reduced to one word, that was my judicial opinion, about the Texas Abortion Law, she was pretty, gray she departed from the unprecedented gentility language, and so im really thankful for that. Because she kind of spoke for those of us who are frustrated by the limits on language, in the way those guys speak. Her first line is, the Courts Order is stunning. And the whole dissent is amazing. Its only three and a half pages, everybody should read, it but you notice when you get to the very end of, it she says, the court should not be so content to ignore a constitutional obligations not only the rate to women, but also the sanctity of its president s in the Rule Of Law period, i dissent period, justice kagans dissent, will also give you blisters, but at The End of kagans dissent, she says i respectively dissent. Shes like no i just doesnt. Yes, i would forget to use that word respectfully a lot. I would just, i would just oops, i forgot to say respectfully, im very sorry. Its an incredible ruling. We will get into it tonight. Lawrence tribe is here, the constitutional Law Professor, also, were going to get into it. Its one of those stories, that continues, you get a Night Sleep on this story, its either just better worse the next day, theres just more to say, more to get into about it. Its a really horrible situation. And in practical terms, we were just discussing this with dahlia lithwick, and i said her bluntly, is there any reason why we should not expect all the other Red States to immediately enact Copycat Laws to have new Abortion Bans in new states instantly . Because of this . And she said no theres no reason not to expect that. So weve each passing day, whether its South Dakota or florida or wherever else its going to be, the place already working, and we are going to see Red States all over the Country Ban Abortion using this as the xerox template, and its gonna go fast. Just start with every republican governor whos running for president , they are demanding of their legislatures right, now send me one of those to sign immediately. Exactly. Even as the country does not want Abortion Law is made more strict, let alone what abortion band, and theres a reason folks in the conservative media are not talking about this ruling right. Now they are the dog that caught the car, they like talking about trying to achieve, this now they have, they realize the country is against this. And the backlash is going to be considerable. If youre a girl, who grows up in texas, and in college meets the person who you think is the love of your life, and you have a loving relationship in every way, and its important to you, in six months or a year into that intimacy, you share the worst thing thats ever happened to you, and you tell your partner, that a few years ago, your father raped you, and you became pregnant, and you went to planned parenthood, and they help you, and the pregnancy, and your partner is very supporting, in loving, and through tiers says, everything right. In that moment. But. For reasons having nothing to do with that moment, just the normal twists and turns of The And Romancer Romance at any age, you eventually feel yourself drifting apart from that person, and at some point you break up. And your partner does not take it well. Your partner becomes enraged. And so this person, you thought you loved this person. You thought loved you. Becomes a Citizen Bounty hunter. In files a lawsuit, in a texas court, to sue everyone involved, who provided abortion services to you. The people who helped you when you needed help the most. The people who helped you in the darkest moments of your life, for years. Every day, for four years, after that abortion is performed, everyone involved in performing that abortion, can be sued at anytime, in those four years. If the Citizen Bounty hunter who betrays you, wins the lawsuit, because for years, later the records are not clear on whether a test was done to establish any cardiac activity in the embryo, then everyone involved in that abortion, except a pregnant woman, it is going to have to pay damages, of at least 10, 000, with no limit on those damages. All paid to a person who betrayed your confidence, who took your most painful experience, to court, for money. In the people involved in performing that abortion, are going to have to pay The Attorney fees, of those Citizen Bounty hunter. Who betrayed that intimacy. To go into a texas courtroom, and sue the people, who ended the pregnancy, that was caused by rape. And incest. The Texas Law does not make an exception for cases of rape, or incest, or both. Because that is a matter of republican religion. It was not always that way, the first Abortion Language to appear in a republican platform, was in 1976, in the platform called for a quote, continuance of the public dialogue on abortion, and supports the effort of those who seek Enactment Of A Constitutional Amendment to restore protection of the right to lifer unborn children, republicans knew they were never be a constitutional amendment. They were just trying to appeal to The Anti abortion vote, thats all. The last debates. Among republicans about what their antiabortion position should be, would it should be on exceptions for Rape And Incest, was 21 years ago. When John Mccain and george w. Bush were running against each other, for the republican president ial nomination. By that time the republican Platform Or Post on abortion, without exception, for Rape And Incest. Do you believe in exemption for abortion for Rape And Incest . Its interesting youre talking about printed material, heres one that says, that george w. Bush supports the pro life plank. So in other words, your position is that there is no exemption for Rape And Incest, but you want the platform that youre supposed to be leading to have no exception. The platform talks about, it doesnt talk about what specifically should be in the constitutional amendment. Please let me finish. Let me finish. The platform speaks about a constitutional amendment, it does not refer to how that constitutional amendment ought to be fined. It does not john. Read the platform. Has no exceptions. John, i think we need to keep the platform the way it. Is this is a prolife party. May i finish. Please may i finish. Please please. We need to be a prolife party. We need to, say life is precious, and thats what our platform refers to, and thats why we need to leave at the same. During that campaign, John Mccain was asked by a reporter on his campaign, bus if he would tells than 15 year old daughter, that she could not have an abortion if she became pregnant. And John Mccain said. No, i would discuss this issue with Cindy And Meghan in this would be a private decision that we would share within our family. Obviously i would encourage her to know that the baby would be brought up in a warm loving family. The final decision will be made by meghan with our Advice And Counsel and i think thats such a private matter. In all reasonable people, agreed with that answer, but immediately a panic, set in among the campaign staff. Over that answer. And John Mccain took it back. The New York Times report of that day, says the short time later mr. Mccain telephone reporters and said i misspoke. But i believe i intended to say, this is a Family Decision in the decision will be made by the family. Not by meghan alone. Eight years later, John Mccain was the republican president Ial Nominee of the party that believes in no exceptions for Rape Or Incest or both. And he chose as his Vice President Ial Nominee, the governor of alaska who fully embraced the republican doctrine of no exceptions. Four years later, the nominee was mitt romney, who embrace the republican doctrine of no exceptions. When running for office in massachusetts, he ran in support of Roe V. Wade, romney went from completely prochoice in massachusetts to completely antiabortion, with no exceptions. Mitt romney changed his position to comply with the demands of republican politics. John mccain did the same thing. George h. W. Bush did the same to become ronald reagans Running Mate in 1980. Those are not deeply held beliefs. Those are political beliefs adopted in service of ambition. And as the republican party became ever more insistent about The Absolutism of there are no exceptions position, Young Republicans in law schools, dreaming of a coming Supreme Court justices, knew it they had to think in order to become Supreme Court justices chosen by republican president s. And so you have the majority of the supreme Court Tonight who have said Roe V. Wade that if you are a Rape Victim or incest victim, and you end a pregnancy that results from those crimes, everyone involved in ending the pregnancy can be sued. And that is why he wont be able to end those pregnancies in texas, because Abortion Providers cannot run the risk of losing their homes to provide services to women in need. People working in abortion services have been taking their lives in their hands for decades in this country. People who claim all life is precious have shot and killed Abortion Providers in this country. And now this. Now they want to bankrupt them. Supreme court justices appointed by george h. W. Bush, and george w. Bush and Donald Trump have delivered whatever he republican president Ial Nominee since reagan has promised their voters they would deliver. It may be that all of the republican president ial candidates who ran as antiabortion candidates with no exceptions did not believe they were when they were saying. But the Supreme Court justices, chosen by republican president s are now and forcing the words that those president s at least pretended to believe. Leading off our Discussion Tonight are carol sanger, Law Professor and author of the book about abortion, terminating pregnancy in the 21st century. Also with us, President And Ceo of vote latino. Let me begin with the evolution of republican thinking on abortion, obviously something that law students, with judicial ambitions, were paying attention to. Knowing where they would have to go on this if they were ever to make it on to the federal bench and above. And it seems to me that the message, whether politicians believe what they were saying or not, has been accepted by the judiciary that appointed them. Well, i try to keep republican and democratic politics out of the class. But there certainly our interest groups now, the Federalist Society and others, that Support Prolife and prochoice positions. Imagine that what you are asking. I want to get your reaction to the decision, with providers basically shutting down. This is incredibly dangerous because what you are doing is putting so many womens lives at risk and the women you are putting at risk are not the wealthy women. They will always have access to abortion care, may be able to go to different states. You are putting at risk the most vulnerable. Lets be clear, women seeking abortion there in the second trimester are often women who have found that there is something wrong with the fetus. Or they found out in six weeks that theyre pregnant, and they realize that the best decision for themselves and their family is to make the hard personal decision of ending a pregnancy. With the republicans have done today is tell women that not only do they not have agency over their body, but they are also telling them that they do not know how to best value they are priorities to make sure that their existing children and family are safe. This is incredibly devastating and we cannot take it lightly. It demonstrates what the stakes are in the fight continues. The Midterm Election has the stakes. It involves ownership of the body, what we can do when it comes to The Ability to communicate our health and priorities. It has been shift away. The fact that justice roberts said that this decision was unprecedented, and he sided with Elena Kagan and sotomayor, demonstrates that this is not only unusual, but they have politicized the Supreme Court in the era of a womans right to choose. And justice breyers dissent, he referred to running the financial and other risks that come from waiting for a private person to sue them under the Texas Law. And the Texas Law, as i said, give them four years. And so for 48 months, after every abortion, that might be performed, if any are performed under this law, everyone involved would be waiting for 48 months if they will get sued to find out. Yes and it has huge societal cultural implications. It turns a community into something like a surveillance state. And its not clear yet what kind of evidence you have to show or bring in. But we know that if you are going to get your 10, 000, you must prove that this was an illegal abortion. So you have to have records, calendars, dates, you have to have testimony. All this is being assembled. And it is a very it is very uncommunity like. And gives a financial incentive to hunt down your neighbor, your cousin, your friend. To hunt them down for financial reasons or perhaps for truly held beliefs. Biden any case its not the kind of culture that we pride ourselves on having. So, yes, breyer has the right, a right, its a long time to be under suspicion. And even abortions outside of texas, find that abortions come back to haunt them in future aspects of their lives. An early abortion can come up in a Family Law Custody fight. And there are a number of examples of that. An early abortion can come up in a job interview, even though that is not supposed to happen. So abortion is an excellent tool to holdover womens heads at various points, long after the event. And thats one of the powerful things about having such a powerful abortion ridden culture. It stays with everyone. It stays with everyone in a negative way. And maria Teresa Kumar, my point about the Citizen Bounty hunter, as Justice Sonia sotomayor, called them, they may not have to hunt. It could be an intimate, it could be a sibling. At some point in those four years, and you share that secret with that person, at some point down the road that person gets angry with you, if that happens, they say, okay, i know how to get back at you. Im going to go to court and i am going to be the person who sues over The Abortion you told me about in a moment of intimate sharing. Well, lawrence, what you are describing and whats sotomayor was describing is weaponizing a womans most vulnerable moment. That should chin send chills up and down our spines. At your most vulnerable moment, you share something with someone, that was Heart Wrenching to do, then they turn around and weaponize it. It is not only immoral but it also makes women vulnerable. Folks know that often women will look for other services, when an abortion happens, so that they can have a conversation on mental wellness. This will prevent many of those conversations from happening. And we need to make sure we are moving forward with full support. And the idea that your Neighbor Or Lover has The Ability to put something private, a private decision over your head, it creates a Gender Imbalance for women. They are not on the same Playing Field as men and i put instead on a place where they cannot fully exercise their Agency And Ability to choose. Unprecedented, thats the Word Rachel and i were discussing at the beginning of this hour, and thats the word that appears repeatedly in the opinions from the justices to believe the Texas Abortion Law should be stopped and extract. Unprecedented is a very strong word for judges, but it has lost its meaning in public discourse, especially in The Age of trump. Justice sonia, just couldnt take it anymore. She just could not go along, with this semantic decorum of the court. And use such understated language as unprecedented. And as rachel pointed out, the first sentence in her dissent is, the Courts Order is stunning. And she goes on from there. Quote, the extraordinary step of enlisting private citizens to do with the state could not. The Texas Legislature has Deputize The State citizens as bounty hunters, offering them cash prizes for civilly prosecuting their navels medical procedures. She then calls them quote, Citizen Bounty hunters. A breathtaking act of defiance of the constitution. This is untenable. It cannot be the case that is state can evade federal judicial scrutiny by outsourcing the enforcement of unconstitutional laws to its its citizenry. Justice sotomayor ended with whats for the court, is a version of pounding the table in anger. Her last sentence is simply, i dissent. Instead of the traditional, i respectfully dissent. Joining us now is the University Professor of constitutional law laurence tribe. He has won 35 cases in the united states Supreme Court, his new article for the, guardian is entitled, Roe V. Wade died with nearly a whimper. But thats not. All professor, thank you so much for joining us tonight, and i want to give you an open field, here to comment in any way you want on this decision, and let american know what they should be thinking about. The one thing i would ask, is that you begin with, a Judge Sotomayor points, about this peculiar deputizing of the citizenry, to be the civil prosecutors, of actions that have no relationship to them whatsoever. It establishes a class of plaintiffs that have never existed in american law. That i am aware of. This Texas Law, seems to have no relationship, to american law. Federal or state law, in saying that it would be citizens to enforce this law, not the law and forces of the state. And the Supreme Court used that apparently as the reason, why they could not stop it. Its truly stunning. Justice sotomayor had it exactly right. Its not exactly unprecedented, back in the early sleeve years, Fugitive Slave Laws were enforced, by bounty hunters. They went out and sought to return, even freed slaves, to their socalled owners. To collect a bounty. So it has a kind of ugly dark history. But, as Justice Sotomayor said, it simply cannot be the case. Although five justices say that they think it is. It cannot be the case, that the state can pass a flagrantly unconstitutional law, constitutional lesson until Roe V. Wade is formally overturned. And then, avoid any judicial review, by deputizing strangers, total strangers, and they dont have to be texans. They can be from california, from france, the law clearly allows anyone on the planet earth, to come in to texas core, during as you say, that four Year Period after an abortion, and get 10, 000, from anybody, friend, neighbor, the Ex Lover of the uber driver, the person who funded The Abortion, anybody who is involved in The Abortion, unless somehow, the evidence has accumulated that there was no heartbeat. That is, not only stunning. Its abominable. Its breathtaking. And im hopeful, that even though we know this court does not believe that Roe V. Wade should stand, that maybe one of the five justices, in a lawsuit that attacks specifically the bounty hunting aspect, by preventing officers of courts from actually transferring the bounties, and thereby taking in the financial incentive out of it. Maybe, a justice will be so upset by the idea of privatizing law, that we would get a fifth vote, not all likely. But theres very little else that can be done. The whole idea of legislating Roe V. Wade, making it part of statutory law, which i favored for a long time, is something that is going to happen in the house, but it feels like it will die in the senate. Even if it were passed, the court that just a little while ago, in 2007, said that the congress power, the power of congress is brought, enough so that congress can ban a particular late term abortion procedure, they probably will turn around and say, oh but now weve discovered new power. They cant do. That just imagine if we were talking about a right that conservatives, liked like gun rights. Suppose massachusetts, the state relives, decided to disregard the Supreme Court precedents about guns, and made it a crime, for any private citizen to own a pistol. Without special government permission, without showing the flagrantly unconstitutional. And if they didnt have public prosecutors in forcing it, and had an army of citizen vigilantes, making sure that nobody could have a gun at home, do you think this Court Wouldve applied its logic to say, oh will let that Go Into Effect . Not on your life so they are not act all consistent, all of these procedural Mumbo Jumbo things that they said. Make it very hard for us to figure out how to review this law, that was just really concocted for the purpose of evading review and was most stunning, injustice is consent, is how her compelling her arguments were. There was a motion. But the logic was impeccable. She said, she couldve added, to what she had. She shouldve said, when you deputize private citizens, to enforce the, law they become arms of the state, in so you should be able to go after them in the same you can go after other state officers. Instead the majority said well were not sure that these judges who were sued, are proper defendants, were not sure you can sue a judge, a state judge, theres nothing in the constitution that says that you cannot have federal suits against a judges, were not sure that these judges would enforce the law. Are there going to be scoff laws . Its all made up. So the majority, is just tipping its hand, they hate Roe V. Wade. They ducked and did not want to say that its overruled. They claim not to be judging that, but in the very same time, they are simply obliterating the rights of all of the women of texas to control their own lives in their bodies. I do, think its not clear, that they can lead for the state. Without creating vulnerabilities. If i pay somebody to help them get a Bus Ticket to go to a neighboring state, where she can get an abortion, i might be Aiding And Abetting in a legal abortion. Even though its not illegal at the state where she goes to. That may not be true it is ambiguous. But as long as the Chilling Effect is, there as long as you dont know, when youre a helping a Woman Deal with a tragic situation in her life, as long as you dont know whether youll be stopped short or sued for 10,000 here 10,000 there, youre likely not to reach out and help her, this is a devastating decision, i say in my Oped Piece in the guardian, welcome to the nightmarish place in the handmaids tail, thats the world this core is creating. His father was a senior Operating Officer of the Trump Organization and has not yet been subpoenaed. Jeffrey mcconney, a top Finance Official at the Trump Organization is also believed to have testified. It is the second time he has provided testimony in the same investigation. In july, District Attorney charged him and Allen Weisselberg with tax fraud. Tim obrien, arthur of Trump Nation and of bloomberg opinion news. Tim, what do you make of this news about Matthew Calamari Junior testifying today. Its an incremental development, lawrence, but i think its significant in that it shows the manhattan The A is going down and up the Food Chain at the Trump Organization to gather information and gather testimony to apply pressure to anyone in the Trump Organization who might have knowledge of illegalities there. If whats the calamaris were asked about was consistent with everything else that the main Hand Issue to attorney has been probing, it was probably about whether or not they got undeclared compensated, in the form of freebies like apartments and automobiles that were not properly declared to the irs. The consequence that will matter if the calamaris are exposed, it turns them into potential witnesses against others in the Trump Organization, including Donald Trump himself. It involves the question of whether the trump children will be called to testify on the same issues, and whether others in the Trump Organization, including Allen Weisselberg all of them have to be looking at what Allen Weisselberg is looking at, which is the possibility of a severe prison sentence, if this goes in as bad direction as it might, which of course it may not. The other thing to think about when it comes to the calamaris themselves, is that trump hired calamari as a bodyguard, and years along the way he got transformed into Donald Trumps chief Operating Officer. Its a reminder of how comically absurd and cartoonish the Trump Organization is as an entity. This person who was elected because of his supposed business prowess, was hiring people willynilly, four roles that were far above their expertise or experience. But he did not care. It was a mirror of what he did in the white house. Isnt that just the title, chief Operating Officer . Donald trump is a chief Operating Officer, along with the kids, presumably. And that title was there to give away to someone not named trump. 100 . And remember this was essentially a Mom And Pop operation. This wasnt a large sophisticated Fortune 500 company. This was a small group of people, intensely loyal to Donald Trump. And at The End of the day, two or three people they are called all of the shots. And out of them did anything of significance without Donald Trump signing off on it. Now Jeff Mcconney, if i have him placed correctly, he is in the financial structure of the operation. Is he the kind of guy who would be in the room with Allen Weisselberg a lot . Hes the kind of guy who helped the trumps do their tax returns, and the kind of guy who has knowledge of what the scope of their business really looks like. Who some of their financial partners were, how they structured deals on paper. I think at The End of the day, it was really Allen Weisselberg and Donald Trump and maybe one or two other people that had the deciding roles and all of this. And i dont think that Jeff Mcconney was always there. But he was certainly there, frequently enough, he is a very material witness, and he is someone whose testimony could be damaging to Donald Trump. There is something that has always been fascinating about this investigation. The District Attorney is leaving office, basically at The End of the year. Which is unusual in these kinds of investigations and so we have all had this timeframe, of thinking what is going to happen will happen, within this calendar year. Or at least get started in a serious way. And so thats why every time there is a witness going in, the News Media thinks we are closer and closer to that point of what happens next. Well, i think that maybe an artificial timeframe, lawrence, because he Cy Vance has put in a sophisticated team of investigators. They are being methodical, as they should be. They are trying to build a bulletproof case, as they should. I think he is very cognizant of the fact that there is a likelihood this case will run past his time as the fda, which it most likely will. Thats a good thing. It may not happen quickly enough to satisfy Everyones Appetite for quick justice. But it is i do think its an indicator of the kind of formidable investigative team he has put in place.
