The storm drenched public transit, highways, streets and homes in a few hour and brought much of the city to a standstill. Much of philadelphia as well, forcing rivers to rise several feet. In New Jersey towns were swamped with water while tornados rampaged across several communities. The storm has killed 43 people from maryland to connecticut. In louisiana four days after Hurricane Ida, nearly One Million homes and businesses remain without electricity as we head into the holiday week end. Tomorrow president biden will be on the ground in louisiana to see the damage up close. Today the president said what the storm was an urgent warning about the dangers of Climate Change. The past few days of Hurricane Ida and the wild fires in the west and the unprecedented Flash Floods in New York and New Jersey is yet another reminder that these extreme storms in the Climate Crisis are here. We need to act. This isnt about politics. Hurricane ida didnt care if you were a democrat or a republican. Rural or urban. This destruction is everywhere. Its a matter of life and death. Today senate democratic Leader Chuck Schumer was more direct making the link for the storm and legislation. Global warming is upon us and it will get worse and worse and worse unless we do something about it. Thats why it is so imperative to pass the two bills, the Infrastructure Bill and the budget reconciliation bill. Out west, the fire thats been burning near Lake Tahoe has expanded to more than 210,000 acres. Part of the area has been evacuated and officials are warning residents to stay away for now. Were also following the latest developments from the texas abortion ban. A Texas Law outlaws abortions after six weeks of pregnancy. The vote in the Supreme Court was 54 with the three Trump Appointed Justices joining two other conservative justices. Dissenting John Roberts and the courts three liberal justices. Today the president slammed the ruling and said he planned to launch a whole of Government Effort looking specifically to hhs and doj to see what steps the federal government can take to insulate those in texas from this law. Almost in all quarters from Hurricane Ida in the south to the battering it gave the East Coast. And this fire, which is just one of many that we have already seen this year threatening the livelihoods and lives and homes of people in and around the Lake Tahoe area. Youre absolutely correct. This was an unforeseeable idea. Even a few years ago you could not imagine you would be facing a situation where 22,000 people are evacuated and the mainstay of the economy here is off. Telling people to away from Lake Tahoe, but what we are seeing in the larger picture here is just a srt of the Cross Section of across the country of everything that is happening around the world. You can find the parallels between the terrible scenes that we are seeing in New York, New Jersey, and pennsylvania and along with what we are seeing in africa where more than 1 Million people have been displaced by floods and heavy rains in 2021. So all of this stuff has been in the offing for a while, and now it is suddenly, literally pouring through our windows and whether you are talking about fire and people having to evacuate here, and people living in the basements on the East Coast finding themselves trapped by floodwaters and all of this is happening in front of us, and i suppose that the only thing that we can hope to come from that is that it is going to trigger something ancient and prime evil that is going to make us heroic and do something big is what we are hoping for. That is an optimistic outlook which i appreciate, jacob. Shannon, the president did not shy away from Link Igt to Climate Change, and talking about Climate Change, and we have heard what others have said including chuck schumer, and he is going to louisiana tomorrow, and what do we expect . Well, i dont know if we can expect much more than your typical Hurricane Storm and where the president surveys the damage and shows people there that it is a issue that he is serious and cares about and he not going to forget about them, and makes some remarks and then there you could see the Climate Change front, and this White House has obviously prioritized Climate Change of certainly much more than the past administration to say the least, but you could say to some extent more than the Obama Administration and the president has identified this as a number of crises that the country has faced, but as the Obama Administration officials there learned as well, there is only so much that they can do without any sort of action from congress. There are stems that the administration has taken recently with the Fuel Emission standards and named John Kerry as the Climate Czar and traveled around with World Leaders and reentered the paris accord, and so this is not a problem to be solved solely from the Executive Branch despite how many people look to the president and the White House to do big things and solve this. You know, at the end of the day, a lot of it is going to be coming from congress, and there is the nearly 4 Trillion in spending that congress is discussing that they could pass that could have a lot of money to make a dent in this crisis, but that really seems up in the air even more so today than yesterday with now Joe Manchin raising questions, so that where we are at when it comes to the White House and Washingtons Response to this right now. And now, the climate and the detrimental effects are the top stories to us, but not to a lot of republicans in washington which is afghanistan and the exit of afghanistan and who remains in that country. What is your take on how the administration is handling this . Well, look, i think that we are beginning, ali, to understand some key points that the president got it right, and when he said to get out of afghanistan, he was correct, but to assess that the afghans would not fight for their own capital, so it was improper and not prudent to ask one more american to die for their capital, and so it was right. And the decisions were assumptions that were wrong for the government, but it was reasonable at the time, and the evacuation was a master stroke tactic, the and the 82nd airborne got out 120,000 people in peril, but further, the ali, the Refugee And Asylum policy is a mess, because we have had the extreme vetting under the Trump Administration and the congressional policy has been tied up in knots in that extreme muslims would come over the border and kill us, and so we need a total revamping here, and this is the most important point at this hour that the veterans of the last 20 years of war are channeling the incredible Competence And Pate terrorism to help afghans in peril, and right now they are in transit and in thirdcountries at this point that need to be in completed that unfinished business. Well, similar to the issue of Climate Change, i think that oftentimes a lot of people are looking to the White House and the Executive Branch to solve these big problems, but it is unclear exactly what can be done from the White House, from the level of the president when it comes to the state law. The administration put out some strong words about how how much they disagree with Texas Law and they want to have the Counsel Office to work with the doj and they did not appoint a high official to shephard this like we saw with the other laws, but they did not give a Time Line or specific, and the White House also isnt getting behind any specific legislation. So this cant be Hand Frld the Executive Branch and what about the legislative branch and Press Secretary Jen Psaki said there is no actual piece of legislation they are getting behind either, and if they did, there is a crowded legislative agenda and so little time left to get anything done before the midterm elections that route seems unlikely, so maybe there is something they can do to nibble around the edges from the doj perspective, but i dont think that there is a lot of expecttation that something big is going to be coming out of the White House here. And Jake Ward, from the legislative and the leadership perspective, this administration has taken a big step in terms of Climate Change in terms of policy and appointees and stuff in the Infrastructure Bill that passed that speaks directly to climate, and there is stuff in this new bill that is continuing to be in peril that speaks about the Climate Change. At this point, you made a point that with the number of americans witnessing the effects of Climate Change, in the last week, and in last few year, there may be some wind in the sails of those who actually want to legislate in a way that can help the earth. Well, ali, it is possible that it could create the kind of Oground Swell Support that we would need to create what experts would say is a trillion Dollar Kind of effort, and i mean, truly, a global reshaping in order to make ourselves not go beyond the 1. 5 Celsius Increase from the late 1800s that experts say that we have to achieve. I think that if you are looking across the world, you can see that there are places where this kind of Big Societal Reorganization has happened, because people have had firsthand experiences with the disaster. Jeremy, i wanted to ask you about the comments that we have had from your old department, the department of defense, and the Defense Secretary that is the Secretary Of State and the military about what we do about the taliban given that they are now in control of things there, and what we will do in terms of participating with the taliban and the Fighting Off of the Isis Affiliate if you will that is in afghan with whom they are adversaries and if the government will ever be recognized as the legitimate government of afghanistan. I would not argue for that, because i dont believe that we should trust the taliban, thauz because they hold against everything that we hold dear, but if we have to do a deal with the devil to protect those interests and cooperate with them to get the afghans out in peril or protect against isisk, i am all for it, but we should not have a diplomatic recognition of the taliban or welcomed by the world community, but we should redouble our Terrorism Efforts in afghanistan and our military leaders have to be engaged in this for a very long time to come. All four decenting judges filed an opinion and some scathing of the majority to block that law of texas that bans abortion. Chief Justice Roberts who joined the three liberals of the court wrote the statutory scheme before the court is not only unusual, but unprecedented, end quote. Justice sotomayor was much more direct quote saying, quote, a majority of the justices have opted to bury their heads in the sand. She goes on the say it cannot be the case that a state can evade federal judicial scrutiny by outsourcing the enforcement of unconstitutional laws to its citizenry. With us again tonight, Neil Cottier who is the former Acting Solicitor General who has argued dozens of cases before the united states Supreme Court, and thank you for being with us, because we need your clarity on this. What did Chief Justice John Roberts mean in describing this as unusual and unprecedented. Well, ali, the Bottom Line is that the Supreme Court basically gave a thumbs up to the overruling of roe versus wade, so Abortion Clinics as of yesterday in texas are essentially closed to all patients. And what the court blessed for Texas Yesterday can be enacted tomorrow in other states and indeed will, and other states are going to say that they will try to enact such legislation, and what the Chief Justice is referring to is that this is a really weird Texas Scheme and outlawing abortion after six weeks effectively, and the state is not going enforce it, and instead, it allowed vigilante justice. So if you like take an uber to the abortion clinic, and this law says that you can sue the Uber Driver and sue them anywhere in texas, including far away from their homes and seek 10,000 in damages against them and plus Attorneys Fees which is designed to intimidate and create fear and that is of course what has happen and why Abortion Clinics are essentially closed now to all patients. And you wrote in the Washington Post on June 7th when the Supreme Court accepted a major Abortion Case in mississippi said that reproductive rights not depend on roe because the constitution says that federal law reigns supreme over State Laws and this insight means that congress can sweep away State Laws that conflict with the federal protections, and this is becoming unusually important and these words of yours from june to today and what does this mean for Nancy Pelosi saying that we will codify Abortion Rights or roe v. Wade . For more than a year, i sad they writing is on the wall for roe v. Wade like it or not, and the Supreme Court is likely to overrule it. In the constitutional system two ways to guarantee Abortion Rights and one is the way that roe does a Court Decision saying that texas or louisiana or whatever, you cannot have that law, and it is unconstitutional and off of the table in our democracy. And one way, but there is a separate way which is congress, itself, can guarantee it, and thinking about employment discrimination, and that is something that congress guaranteed in title seven in 1965 and not part of the constitution. And so Congress Tomorrow by simple Majority Vote can pass a Bill To Codify roe v. Wade and so happy to see Speaker Pelosi to say she is going to take that up right away. On the other hand, you can see the people looking at the Texas Example and the tweet from Kristi Noem saying that to leave that Texas Law in place, i have the unborn Child Advocate in my office to review the Texas Law and South Dakota laws to say that we have the strongest Pro Life Laws On The Books South Dakota and similar ones coming out of florida and other states could start to do this and we could end up having a De Facto overcoming of roe v. Wade . Yes, that is the danger of Yesterdays Decision greenlighting every state to do what texas did and it is not specific to texas. And ali, the most important thing to leave the viewers with is this, and there a lot of heartache tonight, and my view is one way or another, this Decision Yesterday will not stand. You know, the history teaches us that the supreme Court Cant be Out Of Step with the public opinion for too long, and it never works and so the Supreme Court always conforms to it, and so whether it is a change in the composition of the court or the number of justices or a change in the decisions and the votes that they make or a federal legislation like what we have been talking about which is going to prevent that South Dakota law from taking effect, one way or another, my view is that we will have a way to secure roe v. Wade, and so it will only bend for justice if we bend it. So we all have to fight like heck at the elections and putting the pressure on our elected officials who will protect the roe v. Wade, but it is taking up the vote in congress, and anyone who thinks that it cannot be done by simple Majority Vote is antidemocracy on something as fundamental as Womens Health and the right to choose. But the court likes to point out that it does not bend to public Will Or Public will, so what does that look like, and you have mentioned something that Nancy Pelosi and democrats do, and the way that we have discussed earlier in the show with Shannon Pettypiece and what the White House and the administration can do with the white House Administration and hhs and what does the public opinion manifest, and in what way does it manifest to influence the outcome of this, and you are saying Voting Rights and get out there to vote to well, something more fundamental than political scientists who stuied the Supreme Court over two centuries found out that the Supreme Court may make a decision Out Of Step with the public, but eventually it will conform with it, so that obvious and most destructive or high Point Example is fdr and the new deal when the Supreme Court was striking down new Deal Legislation after new Deal Legislation, and then he threatened to pack the court, and the Supreme Court, some of the justices changed the vote and it is called the switch in time that saved nine, and i am not advocating for them, but this Decision Yesterday is so important and going to essence of what the Supreme Court is about and the popular outcry is so dramatic that one of the solutions is going to take Form And Shape and remove and hopefully remove the effect. This is an animating issue for primary republican Voter And Core base voters in the republican primary and for the protections of roe and although many, many republicans and as Rachel Maddow said it is like the car who caught the car, and animating in a way that good for republican politics, until they achieved goal at which point they realized that they have now captured something that is very unpopular and by the way, when we talk about the republican snitches, does Anybody Doubt that if men could get pregnant they would be getting free abortions in the Locker Rooms . Well, you are right on that. Cornell, lets talk about susan kol lin, Senator Susan collins who has called this Texas Law, this decision extreme and hurtful, but she is getting some kickback on this, because she supported the appointment of Justice Kavanaugh with the understanding that she believed or she conveyed that he wouldnt work against roe v. Wade. Yeah, she has to own this, right. She was vocal and out front about how, you know, what is happening would not happen because of the vote for kavanaugh and others she has voted to put on the Supreme Court and gave us assurances that what is happening would not happen, but in fact, kavanaugh turns out to be exactly who we thought that he was. But sort of double down on the point that my friend on the right was making that republicans perhaps have awoken a sleeping giant, and i say that because he is right, this is a primary Voting Issue for republicans, but voters in the mid of the electorate and women voter, it is not an energizing Voting Issue for them. I tell you that the moment that white women, College Educated Women in the suburbs who have been helping the republicans hold on to congress and the senate for years and the moment they think that they are right to choice is going to be taken away from them by republicans, i think they do animate these voter and awaken a sleeping giant, and they are doing something that democrats have not been able to do and that is to make women more of a singleissue Voting Bloc around choice which can very much change the dynamics of the midterms, but also down ballot as well. If democrats can connect the dots to this overwhelmingly unpopular piece of legislation that republicans are pushing through the state legislative bodies as well, i think they you are creating a dynamic for the midterms and handing the democrats if they are smart and able to use it, they are handing the democrats a Wedge Issue to energize the Women Voters up and down the ballot. Mark, talk about what we heard from Kristi Noem, the governor from South Dakota and Ron Desantis and implying and messaging to the voters and i cant tell if they are voters of South Dakota or florida or two president ial candidates potentially appealing to the republican base who might vote for them to be the president ial candidate the next time, but both of them want to take a close look to the Texas Law to apply them in their states. Well, no question. They are going to enact these laws as quickly as possible, and any republican governor is going to be applying to the lowest common denominator of the republican base, and this is so hypocr hypocritical, because the fundamental message is limited government and freedom, and in texas, they give you the freedom to carry a gun without a freedom or not the Wear A Mask or to vaccinate or not, but not to choose for a woman. That the problem. So you have two campaign hacks, Like Mckinnon and i on to talk about Policy Stuff to leaves a side, but the politics is very clear. I think that there is a way for the democrats to do what republicans do all of the time which is to nationalize the elections around one or two Big Issues. They are giving us a Big Issue to nationalize this campaign, and the midterms around, and around choice which is again 77 of americans dont think that roe v. Wade should go away. This is potentially a largest mobilizing issue for Women Voters that we have seen in quite a while if in fact they fear that roe v. Wade is going to go away and this is why fox is not talking about and republicans dont want to talk about it because they dont want to drive up this fear of Women Voters that their right to choice is going to be actually going away, and democrats have to play the politics here, and they have to push forward this narrative that in fact, your right to choose is going to go away unless you act.
