As of today, roe versus wade is essentially dead in the state Href='https://vimarsana.com/news/of-texas'>Of Texas, the second largest state in the union. The right to abortion, as recognized by the Href='https://vimarsana.com/news/supreme-court'>Supreme Court in 1973 with decades of precedent reviewed over and over decades of jurisprudence. That right is effectively gone in our state of the union. It did not go into the 63 court with fanfare and coverage, instead it came with just total absence, silence, as the court failed to rule on a request to block the new law passed by Href='https://vimarsana.com/news/texas-republicans'>Texas Republicans and signed by Href='https://vimarsana.com/news/governor-greg-abbott'>Governor Greg Abbott. That law, Href='https://vimarsana.com/news/senate-bill'>Senate Bill 8, went into effect today, banning all abortions after about six weeks of pregnancy. It also, and this is key, allows private citizens to sue Href='https://vimarsana.com/news/abortion-providers'>Abortion Providers and Href='https://vimarsana.com/news/anyone-else'>Anyone Else who helps a woman obtain an abortion, including those who give a woman a ride to a clinic or provide financial assistance in obtaining an abortion. Now, the law is obviously unconstitutional under the courts current jurisprudence. It goes against all the Href='https://vimarsana.com/news/supreme-court'>Supreme Court precedent. That precedent prohibits states from banning abortion before 23 or 24 weeks. You dont have to be some fancy, pedigreed Href='https://vimarsana.com/news/court-person'>Court Person to see that. Now, the standard thing to do when a law is unconstitutional is to prohibit it from being enforced pending appeals and arguments. For instance, just a Href='https://vimarsana.com/news/thought-experiment'>Thought Experiment here, lets say the state of Href='https://vimarsana.com/news/new-york'>New York passed a law saying no one can carry a weapon of any kind outside their home, and other people can sue you if you do, this Href='https://vimarsana.com/news/supreme-court'>Supreme Court would enjoy that before it ever went to practice, believe you me. But in this case with the radical texas abortion law, they have not. It went into effect at midnight in the dead of night. It has been nearly 20 hours, and so far silence from the court. We dont know what theyre thinking, what theyre doing, whats going on. Were not going to do anything to stop this from happening. Thats all we got. And believe you me, this signals some ominous about the future of Href='https://vimarsana.com/news/roe-and-abortion'>Roe And Abortion rights and womens rights in this country. That Href='https://vimarsana.com/news/landmark-case'>Landmark Case is already in the crosshairs, as you probably know. Mississippi, of course, has a law in the books banning most abortions after 15 weeks. Pregnancy, the state is petitioning the court to uphold those restrictions and explicitly to overturn roe v. Wade. And, of course, the court now has a 63 conservative majority thanks to tHree trump appointees and thanks to the multidecade project of a seamy partnership between the antiabortion movement in Href='https://vimarsana.com/news/corporate-america'>Corporate America. You have to remember how this all went down. Antiabortion forces who are powerful and organized in this country, they saw how several previous republican Href='https://vimarsana.com/news/supreme-court'>Supreme Court nominees turned out. Sandra day oconner, and where it mattered most. The antiabortion forces in this country undertook an effort after that to make sure that no republican president would ever, ever nominate a Href='https://vimarsana.com/news/squish-on-abortion'>Squish On Abortion again. No suders, no kennedys. They mentored and nurtured them, people who Href='https://vimarsana.com/news/would-hue'>Would Hue to hard right jurisp ru dence. There were other issues, too, but that was the one they were focused on. This network that grew up, its a real thing. They have elevated them to the federal society. It was all done with the specific intent to get rid of abortion. This has been crystal clear for a very long time. What Href='https://vimarsana.com/news/ismaddening-and-rage'>Ismaddening And Rage inducing is 54 believe abortion should be legal. Believe me, Href='https://vimarsana.com/news/abortion-polls'>Abortion Polls are all over the place, but that result is consistent over time. The day that Href='https://vimarsana.com/news/justice-antonin-scalia'>Justice Antonin Scalia died, mcconnell announced a blocking to the senate seat. And Href='https://vimarsana.com/news/barack-obama'>Barack Obama still had nearly a year left in office. Mcconnell refused to even tHrow a hearing for merrick garland. One of the first Href='https://vimarsana.com/news/things-mcconnell'>Things Mcconnell does is blow up the filibuster for Href='https://vimarsana.com/news/supreme-court'>Supreme Court nominees which, by the way, was still in place. Just destroyed it, done. And he paved wait for Href='https://vimarsana.com/news/trump-and-gorsuch'>Trump And Gorsuch to take the seats. And then on the allegation of sexual misconduct, Href='https://vimarsana.com/news/mcconnell-ran'>Mcconnell Ran tHrough the last Href='https://vimarsana.com/news/year-election-confirmation'>Year Election Confirmation of amy coney barrett. You may remember the infamous superspreader at the Href='https://vimarsana.com/news/white-house'>White House marking her days to take over Href='https://vimarsana.com/news/judith-ginsburg'>Judith Ginsburg before she was even buried. Much of what this was around was Href='https://vimarsana.com/news/abortion-rights'>Abortion Rights. When you just confronted the right wing about that, when you said the object i didnt say thing, they would just lie. Huh, Href='https://vimarsana.com/news/abortion-rights'>Abortion Rights, no, nothing to see here. I think the likelihood of roe v. Wade being overturned is very minimal. I dont see that happening. This is not a referendum on roe v. Wade. I do not believe Href='https://vimarsana.com/news/brett-kavanaugh'>Brett Kavanaugh will overturn roe v. Wade. The president also is opposed to roe v. Wade. Thats on the ballot as well. You dont know whats on the ballot . Thats not on the ballot. You dont know her view on roe v. Wade. I dont know. Donald trump a stupid man in many ways but with good political instincts, understanding he doesnt want roe v. Wade on the ballot. But he pointed out he only appoints justices who oppose roe v. Wade. So the conservative court under justice john roberts, that court has had a few main projects, one of them protecting corporations from government regulation, and that may mean rolling back the sort of jurisprudence, theyve been laser focused on rolling back Href='https://vimarsana.com/news/voting-rights'>Voting Rights, and making abortion more difficult. Theyve been laser focused on that agenda from the beginning. Do not believe anyone who tells you thats not what theyre doing. They are either idiots or lying to you. Now we have arrived at this moment in which the wolf is at the door. I mean, if you dont like Href='https://vimarsana.com/news/abortion-rights'>Abortion Rights, its not the wolf, its the present you have been praying for. All the people who learned about this court trying to overturn roe, dont worry, they were wrong. So the question is how a majority of this country who supports Href='https://vimarsana.com/news/abortion-rights'>Abortion Rights is going to give their response to this incredible court, or in this case, lack thereof. We bring in melissa murray, professor of constitutional law. She now looks over the strict podcast along with my wife. Really interesting to think it moved at a more leisurely pace. It was a procedural Href='https://vimarsana.com/news/issue-but-one'>Issue But One that allowed a law that is patently constitutional to go into effect in texas, essentially eviscerating Href='https://vimarsana.com/news/abortion-rights'>Abortion Rights. This is an extreme question and the republicans silence really spoke volumes. One of the kind of devious ways it was designed is this private enforcement provision, which is really creepy and dystopian. Maybe we could talk a little about it and then we could talk about how its designed to bring us to this point because theres no one to join because its just the neighbor with the binoculars next Href='https://vimarsana.com/news/door-spying'>Door Spying on you about whether you got an abortion. Yeah, cHris, its a catch22. Because if the law doesnt go into effect, nobody can say they were affected by it, no one can bring a lawsuit. Not only is the neighbor with the binoculars next door, there is a financial incentive for individuals to report violations of this kind. What is this law . It is a Href='https://vimarsana.com/news/sixweek-ban'>Sixweek Ban on abortion. Most people dont even know theyre pregnant at this point. You know this is actually two weeks into pregnancy, just a common way that Href='https://vimarsana.com/news/doctors-date'>Doctors Date pregnancies. So while individuals who know they need an abortion up to six weeks can still get an abortion in texas. Texans woke up today not only with fewer rights and the right of their neighbors to spy on them for a literal bounty placed on their uterus, so to speak, but the Href='https://vimarsana.com/news/supreme-court'>Supreme Court didnt even bother to leave a note. The Href='https://vimarsana.com/news/supreme-court'>Supreme Court did not feel any urgency, did not explain anything about it, and i have to say ive been covering this stuff for a long time, and i find it shocking. Because they have to stay up late and make an explanation. Something else is going on here. Im not sure if its attempted negotiation or what, but they had several days to contemplate a law that if you mentioned it to a court, you would be laughed out of court. The die was cast when kennedy retired. It was cast when trump released a list of justices that were going to overturn roe v. Wade, and now every texan is empowered to spy on people who are pregnant to see if they violated this law this year. I want to go tHrough the provisions here, and again, part of the deviousness here is since the state is not enforcing it, the theory is like, well, you Href='https://vimarsana.com/news/cant-award'>Cant Award the state. The award for a successful case is not less than 10,000 and attorneys fees. If your case was wrong, theyre not allowed attorneys fees. Obviously the asymmetry is there, and melissa, just to put a Fine Point on this, my understanding of the way this law is drafted, if a woman in texas has a miscarriage, someone with a vendetta against her, an exboyfriend, for instance, could sue under this law claiming an illegal abortion, then she would have to, like, go to court and defend herself. If she wins, shes out the money of that. And if she loses, she would wen pay that person 10,000. So the Href='https://vimarsana.com/news/law-targets-providers'>Law Targets Providers and those who skpad a bet. Providers or pregnant women yes, yes. Shes off the table. The law has a couple different purposes. One is to isolate the pregnant person from any networks of support, to make providers fear the prospect of actually performing these procedures for their patients. Not only is there the repercussions of actually being sued and possibly having to pay not only the Href='https://vimarsana.com/news/lawyers-fee'>Lawyers Fee for the opponent but some particular fine. Any doctor in the state Href='https://vimarsana.com/news/of-texas'>Of Texas who is subject to a lawsuit has to disclose that going forward for purposes of licensure, and they have to be so clear what the law is and whats permissible. The providers in texas are already fighting so much. With the law in place, they are afraid to even attempt to provide abortions here that would then bring forward this kind of lawsuit, because they simply cannot afford 10,000 for every court, so this is a way to shut down the process entirely. I should add the attorneys for the clinics dont accept that they cant sue Href='https://vimarsana.com/news/government-officials'>Government Officials on this. In fact, Href='https://vimarsana.com/news/government-officials'>Government Officials do have a role here. The Href='https://vimarsana.com/news/supreme-court'>Supreme Court can stop it. But if texas prevails, theyll have a successful trap. To reiterate what you just said, women are sort of cut out of the Href='https://vimarsana.com/news/twoel-thing'>Twoel Thing which is consistent from the rhetoric from the antily and yet not subject to this thing, another bizarre are rekaegss of the law. Were asking that we cease prescribing ivermectin for treatment of covid19, because we allow it in a Clinical Trial, but we do not want it prescribed outside an established Clinical Trial. We understand why folks are grasping at things such as these novel treatments in the middle of a pandemic for which there is not a whole lot of established effective treatments, at least at the front lines, so doctors should be cautious in their zeal to provide something for patients. I understand the law will try to help patients, but lets stay on the side of science and give safe, effective medications and ivermectin has not shown to be one of those, to be effective for the covid19 virus. The argument that ive seen from doctors who are doing this, and i think, you know i dont know what peoples intentions are, i think some are probably grifters, some are genuine and trying to help people. They say, look, we do stuff like this all the time, its a free country. Theyve been behind the curve all the time and you bureaucrats dont know what youre talking about. I can understand the zeal because my patients are asking me to do things such as prescribe hydrochloroquine, ivermectin for treating covid. You need to monitor yourself, and if you require treatment, there are other safe approved treatments by the ama. Well even use steroids. There are other specific treatments we can use that are very well established and have safe parameters for them. The ivermectin as you described, its a Href='https://vimarsana.com/news/deworming-medicine'>Deworming Medicine. Its also used for Href='https://vimarsana.com/news/head-lice'>Head Lice and its approved for various conditions. There is some serious interaction with things like blood thinners. And the tHread that keeps all that together is the demonization of the left and the democrats are the evil actors that are going to disrupt those wedge issues for you.
