Who never got that meeting with President Trump, but he will be getting that meeting in White House today. And now, a new Abortion Law that is going to ban most abortions in texas and that is after the Supreme Court did not act to stop it. And now, a new evacuation in afghanistan and we have heard from Defense Secretary Lloyd austin and the joint Chiefs Milley and watching that last Plane Leave and then it got personal. My pain and angry is coming from the Grieving Family and the soldiers who were injured on the ground, and war is tough stuff. It is brutal and unforgiving and yes, we have Pain And Anger and seeing what has unfolded over the last 20 years and the last 20 days, that is creating Pain And Anger, and mine is coming from 242 of my soldiers killed in action over 20 years in iraq and afghanistan, and so, yeah, i have that, but im a professional soldier, and i will contain my Pain And Anger and continue to execute my mission. Joining us now is courtney Kube And Executive editor of defense one Karen Baron and Pbs Newshour Correspondent our friend yami shshgs alcindor, and also a soldier working to evacuate some on the ground on her own. And now, courtney, it is a way to say to the rank and file, we know how you are feeling. Yes, you matter and your service matters. I think that this is underscoring one of the things that we have been hearing and more and more over the last several days, that is the a difficult period for a lot of veterans in afghanistan and take aside the decision for the u. S. To leave the war. It is not that. It is these images coming out for the last couple of weeks of this evacuation mission. And when you are adding to that the fact that many of the men and women know afghan, and people who they work with and people they considered to be their Brothers And Sisters in arms in afghanistan trying to get out and sometimes desperately trying to get out and could not leave the country, that mental Anguish And Concern of how that could impact the veterans of the war in afghanistan, and people like kristen on the panel right now who feel this personally, and we heard that from Secretary Austin and milley and a real tone of humility today. And a tone of the you need help, reach out to get it and their service mattered. They talked about the men and women in service and the Men And Women In Uniform in a way that we have not heard from them, and it is important to point out that these are the first administration people who have taken the questions from the press, and only a couple of them, the but questions from the press since the u. S. Has completely withdrawn from afghanistan. And kristen rauch, you have been working trying to evacuate an interpreter that you worked with for ten years. And what is your reaction there . It is resonating, because we have been Mourning Loss of life there for many years. My first deployment was not until 2006 and a colleague of mine was killed by the taliban. There were so many friends of friends and in Sister Units and, you know, in 2010, i was sorry, in 2006 deployed with the 10th Mountain Division and they took that year and many other years so many, so many grievous losses to the conflict in afghanistan. And on other tours as well, we lost people. It has been years of mourning. And it has been a time of reflecting back on all of those losses that even the most recent at Kabul Airport and that horrific suicide bombing. So many of us dont want to see anymore lives lost to this conflict. We want this to be success. We want to say, we got everybody out that no one is in Harms Way anymore on the u. S. Side, on the allied side on the coalition side. But yet, so many of us are still in touch with our comrades, and with those who wore the same uniform with us, and worked Side By side with us, and enabled us to do the mission, and whose, our mission completely depended on the afghans who taught Us Culture and who translated for us. And they are telling us that we are in hiding, we are going to be killed, we are being hunted doortodoor and having to move locations. They are moving, many of them moving out of kabul to get out of, you know, what feels like just a rash of doortodoor searches, and only the find that they dont feel safer in other places where they have gone. And theres no coherent plan to get any of these folks out by even contracted airlift or any of the airlift that has been offered to take people out of airfields around afghanistan. We are hearing some stories of people getting out with pakistan or tajikistan, but in many cases the countries are saying that we dont have a Visa Process for you, and actually, we dont want afghans coming over here, and so these folks are locked in and fearing for their lives and we dont want them to die. We dont want anymore bloodshed of our friends or allies over this conflict in afghanistan that has gone on for so long. Yeah. Kevin baron, looking ahead, we heard the chairman of the joint chiefs, Mark Milley saying that the military phase is clearly over, but the evacuations will continue through the department of state. Practically, how will that work if there are no u. S. Boots on the ground . Yeah, that is the good question. I mean, it has to become a Partner Country Effort or independent effort, and John Kirby would say the u. S. Military flights would stop, but not all flights would stop, but we know that behind the scenes there are other american agents that are still involved with americans on the ground there, but they have to have a continued Civilian Airlift of some kind, and meanwhile, the military mission, even though there are flights coming out of kabul, there are afghans all over the world sitting in military bases trying to go to united states or partner countries, and so there is quite a big job for the military to do. I would like to add to that Hearing Milley and Austin Today with the personal, you know, expressions, i think it is very important for the veterans to hear, but also for the current active force to hear inside of the pentagon to hear, because it is a tough couple of weeks for anyone involved in this war, and whether it was ten years ago or ten months ago, the difference of having a Secretary Austin who is a former general and many people criticize by putting another former general there, and he is a centcom commander, and regardless of the politics, that there is a job to do and dont undervalue that message. And today, Secretary Austin is talking about working with the taliban in the evacuation and they were coordinating around a narrow set of issues to get as many people out as possible, and you have exclusive reporting on the surprising extent that, you know, the taliban cooperated with the u. S. Forces. Yes, i was surprised by the extent of the u. S. Military and the taliban were coordinating on the ground there, and we knew some level of cooperation, and something that the mission is now over, and we can talk about the details. Essentially the State Department would reach out, and give them a Text Message and show up on the East Side or the West Side of the airport and there they would be met for the taliban and the taliban would be processing The Americans and checking the names and The Americans would show them a piece of paper that was like a pass to get through to gate, and then in some cases the taliban would clear the roads so that clear out potential civilians there, and secure the roads so that americans could pass safely and even cases where they were carrying the luggage to the gate. It is a real level of coordination that we had not heard, and i have to point out that despite the help from the taliban, there are many, many cases that we had heard of where they were brutally beating people, and allowing them to pass, and particularly afghan citizens is, and this is not a perfect situation or solution, but it is surprising that they were working to help secure americans, and we also know that general Frank Mckenzie said recently, there were cases that the taliban had thwarted attacks, and we know that of one possible case that on one case that there was a bus headed to the airport with american citizen and six daughters and the taliban stopped it and made everybody get off and said that there is a bomb on board and maybe two Suicide Attackers and The American and the daughters hid in a Drainage Ditch until it was clear to make it to the airport but they never made it out of afghanistan and still there, and we are not releasing the names for the security, but it is sundz scoring that there was a level of cooperation by the taliban. It is also important to point out, geoff, the Defense Officials that we are speaking with are not optimistic and skeptical about the idea that the u. S. Would continue to work on the taliban on some militarytomilitary level. Got it. Aneesh, i want to speak with you, because yesterday in an interview with ron klain, taking the same position as President Biden, and klain strongly defended the evacuation and squarely pointed the finger at two other president s. Take a listen to this. In july the taliban had not yet conquered a single provincial capital in the country, and as general milley said, i dont think that there is anyone who thought they would go from no provincial capital to marching in kabul. President trump left us with the strongest Military Position since 2001, but the point is that kabul, itself, the president had substantial troops, and that army lost the will to fight, and the president fled the country. That is what led to rapid fall of kabul. And hamish, now that the evacuation is done, and the president in this case, the white House Chief of staff is speaking beyond the current moment, and trying to speak their way into the History Books and defending and justifying not only their decision, but also the Evacuation Process there at the very end. That is right. You hear the president forcefully defending himself and not just against the critics, but forcefully defending himself into the History Books. The President Yesterday stood at the podium and not taking the questions and spent 30 minutes saying that this is a decision that was wise Decision And Decision that needed to be made and said over and over that this is a war that needed to end. Then when the president says i needed to take full responsibility, he balanced it with this is my Predecessors Fault because he set the deadline, and the taliban marched into afghanistan, and the afghanistan government fell much quicker than we thought they would have fallen, and the u. S. Needs to learn from the mistakes and i pressed the white House Secretary Yesterday and i said, does the president have any mistakes that he thinks that he made in the withdraw or the evacuation, and the response from her was that they did not believe that the afghan government would fall as quickly as they did. Today, we heard a different tone from the military leaders and more humility and more idea of there being a focused Look And Investigation at the evacuation and this Evacuation Effort and the mistakes that might have been made and the lessons that need to be made, and President Biden hinted at it, but it felt that the administration officials were taking more of a thought to say, yes, we were also part of the problem, and we want to figure this out, and all of that said, the president and the White House officials keep underscoring that this is the largest airlift that they think that most country or any country in the world has completed something like 123,000 or 124,000 civilians, people lifted out of afghanistan in 18 days. So you can hear in the president and in the White House officials voices, they are solemn about the lives that it took to get out of the evacuation, and out of this mission, but it also feels like they want to take a sort of the Victory Lap in saying that we came to do what we came to do. Geoff, this shooting happened at Mount Tabor high school in a residential area we understand of winstonsalem, and from the Winstonsalem And Forsythe sheriffs office, we understand that the campus has been secured. There are about 1,000 students who attend school there grades 9 through 12. One student has been apparently injured in this school shooting. They are now trying to reunite the students and the parents together. Other schools in the area are also on lockdown, but that they say is out of an abundance of caution. Geoff. The most restrictive Abortion Law in the country is now in effect in texas and already clinics are turning women away. The law bans all abortions if a fetal Heart Beat can be detected around the sixth week of pregnancy and well before most women realize they are pregnant. The law allows private citizens to sue anyone who helps a woman get an abortion. The Supreme Court did not allow the state to block the law, and we are joined by a reporter for knrp and also nbc reporter, and so, ashley, walk us through what this means for texas . The bill prohibits anyone from getting an abortion when a fetal heartbeat could be detected which is five to six weeks in a pregnancy which is way early in a pregnancy and that is long before most women know they are pregnant, and so 85 of people who are seeking an abortion will not be able to get one in a clinic here in texas. This is similar to other Heartbeat Bills except that the state is not enforcing it. The mechanism is private citizens and private people can sue someone, a Provider Or Anyone who provides any type of support for someone who gets a abortion outside of the ban, and they can fine someone up to 10,000 for violating the ban, and this is something different. And so this is rendering roe v. Wade obsolete in texas. How did the Supreme Court not intervene, and roe v. Wade is one of the most important rulings of the Supreme Court and the other is brown v. Board of education, and to do nothing is rending the Court Abdicating its duty. That is the question that many are asking this morning. The Supreme Court has shown that even on the Emergency Appeals on an expedited basis, they can move quickly, and we have seen that with the remain in Mexico Policy and the moratorium eviction policy, but in this case, the court was in great pains and more leisurely pace than we have seen. So one might take from this that the court is expressing its own view of what these rights mean, and that the constitutional rights can be held in abeyance while this Court Case continue, and that is what is to come on the Merits Docket in the 2021 term. This law is going to deputize private citizens to enforce it. What is for clinic employees and social service employees or an Uber Driver to get a ride to a clinic. The risk is getting caught in a legal battle, and possible 10,000 fine and for a Social Worker who has done Social Work that is a big chunk of the salary. So this could be really devastating for some people who work in the space of helping women get abortions or even providing abortions in the state. So for the most part, clinics are going to comply, or they have said they will comply with the law or shutdown. In san antonio, there have been multiple clinks that have shutdown, and abortions are going to be that much harder to go there. So if you are a Social Worker, you are weighing the options and the Code Of Ethics as a Social Worker with what could be a steep fine at the end of the day. Melissa, you used to be a Supreme Court clerk, and based on what we know about the current makeup of the court, you know, a lot of people are reading what is happening now, and saying that roe v. Wade is basically on the chopping block. Is that a fair assessment in your view . Well, first, i was not a Supreme Court clerk, but i clerked for supreme Court Sotomayor while she was on the court, but i think that roe v. Wade has been in the cross heirs in planned Parenthood Versus Casey and they had a chance to overturn roe and did not. So the court has been in Overturning Roe either in piecemeal by Overturning Roe by an explicit ruling, and this 6 4 majority seems to be a prime opportunity to make a run at roe and that certainly what we are seeing. And looking at that in laying tout Foreign Policy and what americas role in that is, and looking at yesterday in the look of afghanistan and saying it is not in the national Security Interests to stay in afghanistan and they did not see a current pressing threat of terrorism there, and one that could not be handled without capabilities and then contrast that to ukraine where the president and the administration officials have said that the support is Iron Clad in ukraine and fending off russian aggression, because certainly there is at least more of a moment, a national Security Interest from the united states in counters russia, especially in the area of cyber, and ukraine has Facedcountless Cyber Attacks from russia, and they have faced countless attacks from russia and other countries that they have attacked with the united states included. So the u. S. Supporting ukraine, and the congress has given them 60 Million this year to help including direct Military Support there, and for ukraine, the significance of this meeting they have been trying to get for years now, and they are hoping for having the president in the Oval Office will reaffirm that support that the u. S. Has for russia essentially saying, sorry, that the u. S. Has ukraines back, and that is going to send a signal to Putin And Russia to back off if they dont want a big confrontation with the ukrainians and the u. S. And that is what donald trumps first impeachment when president zelensky was a central figure of the trump, and the trump the administration tried to pressure him into investigating biden in order to get assistance in a White House meeting. It is remarkable how it is all interconnect and the afghanistan wrinkle, too, because as they are drawing down the u. S. And now, new word from the White House from President Biden, he will be touring Louisiana And Talk to the local leaders about the emergency crisis. And that crisis is deepening. Hundreds of thousands of people are without power, and there is one parish with a full lockdown, because of a water outage. And six people are confirmed dead because of the storm so far with the flood watches and warnings in effect from the midatlantic to New England as the storm is continuing to move north. We talked yesterday, and the Word Yesterday was that as you reported people didnt know where to go because the phones were dead. Yeah, that a huge issue is one, figuring out where to go, and other people say, that even if they know where to go, they dont know if there are enough services available right now, and Food Distributions, and charging stations, and things like that, and there are no Emergency Shelters open in New Orleans, and there are some lights coming on back on as of this morning, and able to get some lights and power back on in eastern New Orleans, but not many. For most people, the Power Company has been clear, because there is extensive damage, it is going to take quite a while. They will focus on getting the power first to the critical places like hospitals and 911 centers and then try to deal with everyone else. Some people that we have spoken to, they say it is unacceptable, and they dont have enough help right now, and they should not be in this situation, because they feel that the Power Company and the infrastructure should have been better prepared for something like this to take place, and others, they say they understand why something like this might happen, and it is really a disaster within a disaster, and people are doing everything they can. Actually ellison, before we go to the sound, can you give us a sense of what is happening behind you, an older man helped by people, and he fainted or something happened he collapsed. Yeah, this is, we are at an Ice Distribution Center here, and people are waiting hours, and i was going to walk you through this, and this man, i heard some commotion behind me, and he has collapsed and this is not the first time i have seen this happen in a live shot, because it is so hot, and people dont have water at home, and waiting for hour on their feet here just to get basic necessities, and for this man, a block of ice, and this is our team there, and my producer and one of the photographers trying to help him here, but this is a reality for a lot of people here, and they say this is not as horrific as New Orleans, but people dont have basic thing, and waiting hours and hours to get blocks of ice. This is not free. These are 5 a block, and i had waited someone who had waited over one hour to get this. And i met one woman who had medicine in the freezer, and she needed ice to take the shots she needed later and she had run out of the freezer capability, and people dont have enough help here, and they dont necessarily know where to go, and this man, we will check to see if we can do anything else to help, but this is the second Person Today in the line to seem to suffer from Heat And Lack of water, and we saw it happen at a Food Distribution where the people were waiting for hours for basic help. It is so hot. Not having power is a huge deal and causes a ripple effect, and this is dangerous, and one example of that right now. Geoff. It is good to see that man back on his feet, ellison and glad to know that our team jumped in to help. Desperate situation there. Thank you for the reporting. The Caldor Fire is in a critical stage outside of lake tahoe. They are ordering the mandatory evacuation, and the firefighters say that the wind is not as strong as possible, and now at 20 containment, the Caldor Fire has burned over 300 square miles and destroyed hundreds of homes. It is spreading so big and quickly, it is dangerously close to Crossing State Lines and combining with another fire, the nearby tamarack fire. Were following Breaking News out of colorado where prosecutors announced charges against police officers and paramedics involved in the death of Elijah Mclean two years ago. The Grand Jury has issued a 32count Indictment against two current Aurora Police officers and two aurora paramedics. Charges include manslaughter, criminally negligent Homicide And Seconddegree assault. Make no mistake, we recognize that this case will be difficult to prosecute. These types of cases always are. Our goal is to seek justice for Elijah Mcclain, for his family and friends and for our state. In so doing, we advance the Rule Of Law and the commitment that everyone is accountable and equal under the law. Mcclain died after he was stopped by three Aurora Police officers in 2019 as he walked home from a Convenience Store. The officers first Tackled Mcclain and then put him in a hold while paramedics administered ketamine to sedate him. The 23yearold was declared brain dead at the hospital and was removed from Life Support Throw days later. Joining us now are georgetown University Law Professor and former federal prosecutor Fred Butler and former federal prosecutor david henderson. David, well start with you because the d. A. Said that, you know, they didnt find enough evidence to prove that the officers violated Colorado Law in connection with mcclain owes death, but then the governor gave it to the a. G. And now weve got charges. How did all of this unfold . Jeff, i think this is simply a matter of perspective in terms of whether or not they are going to participate in equitable investigation. Lets put it this way. The police have the right to approach you the same way a normal citizen would approach you. They can walk up to you and start asking questions the same way a normal citizen would. The problem is that when they operate beyond the law and get physical with you when they have no legal right to do so they typically are not held accountable. In order to stop him and detain him, they needed reasonable suspicion that he was involved in criminal activity. They did not have that. And they proceeded to kill a young man who went to the corner store. They should be held accountable the same way any other private citizen would be since they were operating outside the law. I think the current prosecutor investigating the case understood that. Paul, each of the five defendants face one count of manslaughter and one count of criminally negligent hole side. What does that mean in plain english, and what is sort of the legal burden . The first officer who responded put his hands on mr. Mcclain ten seconds after he left his patrol car. After the Officer Beat mr. Mcclain up for no reason, one threatened to call a Police Dog all while mr. Mcclain was not resisting. For manslaughter just as in the Derek Chauvin Case they will have to prove that the officers caused mr. Mcclains death and just as Derek Chauvin tried to make It Sound like mr. Floyd killed himself or was responsible for his own death, they will say that here, but evidence of recklessness is overwhelming and its not overwhelming from the video because the officers claimed that their Video Cameras fell off during this encounter. We really must have in all of these officerinvolved cases investigations. The City Council Investigation found that the top person covered this up and didnt ask any questions when they were investigating this and the only reason these charges happened is activists pressured the governor of colorado to appoint a special prosecutor. David henderson, one of the things thats so particular about this case, as you mentioned based on everything we know for it, theres no reason for Elijah Mcclain to be stopped in the first place. He was walk at negotiate and had a Ski Mask on. It was cold. It was colorado, and he said he was anemic and thats why he had a Ski Mask on and he was set upon by police and was drugged by paramedics. They gave him 500 milligrams of this powerful sedative. This kid was 56 and weighed 140 pounds and they gave him enough sedative that you would give to someone who weighed 220 pounds and his final words are haunting and tragic. He says god. Take your time. He says i cant breathe. I have my id right here. My name is Elijah Mcclain. Thats my house. I was just going home. Im an introvert. Im just different. Thats all. Im so sorry. I have no gun. I dont do that stuff. I dont do any fighting why are you attacking me . If Elijah Mcclain isnt safe, who is . Who is, david henderson, Paul Butler . Who is safe . Im sorry. Im sorry. No, thats why were here and i appreciate you drawing attention to whats important about this case and, that Number One, do any of us want to live in a world where young People Cant go to the Convenience Store and make it back home when they are not committing a crime and they are not doing anything wrong . Number two, what does it mean when the people who are supposed to protect us are the most quick to resort to violence, even lethal violence . Not only did they kill him but some of the officers that killed him went back and took photographs at the Memorial Site mock the way he died. People who say they are there to keep us safe, how they treated someone who wasnt a threat to anyones safety. They killed a young man because he was different, and when he told them so they wouldnt stop to listen. They choked him and drugged him to death. Paul butler, in the time that we have in this hour, i just want to get your final thoughts here. Two of these officers who were charged today are still sworn officers. Jeff, that means that you or david and i would not be safe on the streets of aurora, colorado. There must be accountability, and we cant depend on the stakes. The united States Justice Department has to continue to step up and demand Transparency And Accounting in policing, none of which we saw in the aurora local police department.
