Committee can do about it. Judge for yourself, is it working or not . We think that it is. Plus as kids go Back To School, how pro covid governors are putting backlash ahead of the health of their constituents. Letting my people have freedom. It starts right now. Good evening from new york. Im chris hayes. After a week of Breath Taking revelations about the scope of Donald Trumps failed coup plot, the investigation into that plot is accelerating. Political reporting, the Senate Judiciary Committee is scheduled to interview former acting Attorney General Jeffrey Rosen and former acting Deputy Attorney general Richard Donahue in the coming days. Based on Great Reporting and emails obtained and released by the House Oversight Committee it is clear that they were pivotal in stopping part of trumps coup. Trumps ally Jeffrey Clark proposed that they sign a letter to officials in multiple states encouraging their State Legislatures to send new electors, overturning the election, essentially. Top hue said, quote, there is no chance that i would sign this Letter Or Anything remotely like il. Rosen agreed. Quote. I confirmed again today i am not prepared to sign such a letter. New york times reports that when clark then went behind rosens back and plotted with trump permanently to replace the acting Attorney General with clark himself, the wheeling compliant Coup Plotter as acting Attorney General so that clark himself could sign the letter. Thats when donahue convened a late Afternoon Call laying out clarks efforts to replace mr. Rosen. Should mr. Rosen be fired, they all agreed to resign en masse. That coup that almost came off, right, was a product of two things, the antist democratic, Flatly Dick that Toerl Aspirationings of Donald Trump, which have always been there for decades, as well as Mark Meadows and Jeffrey Clark, men whose names should live in infamiliary. It was part of a tradition that is being cultivated and revived on the right that comes from a contempt for the voters and a contempt more deeply for democracy. Freedom, liberty and democracy. Theres been a long conservative lineage in rejecting democracy. You envount countered it, im sure. Drawn from the fact that indeed our Founding Document has a complicated relationship to democracy, to selfrule. The fact that the Electoral College is enshrined as an institution, we dont have a popular vote for. Even though we should. The current system has resulted in dafrsz. The idea that supreme Court Justice Antonin scalia explained is, quote, the individual citizen has no right to vote for electors of president of the united states. Rick hassan explains article 2 of the constitution of the united states provide that State Legislatures get to set the manner for setting elections. Similarly article 1 section 4 gives the legislature the power, place, time, manner for conducting congress elections subject to override. For the most Part Weve intercepted this to mean legislatures make the law around president ial elections. State courts intercept the laws like other laws, right . Thats how It Works. As hassan explained, some are already going no, no, no, no, no. Even if the State Legislature would be violating the State Constitution as determined by the state Supreme Court, this is the independent legislation doctrine. Now, if that sounds a little nutty to you, it is. One implication is if a republican legislature, say, georgia, it believes the election is tainted it can overrule and send it to electors and thats exactly what Jeffrey Clark was advocating in his letter that he drafted that he wanted to get the acting Attorney General to sign. Wanted him to sign so badly he conspired with trump to replace him to do it. This only works, right, presumably if you can get enough people to buy it, particularly judges, judges appointed by republicans. As Rick Hassan points out, this is as wacky theory but four Supreme Court justices, alito, Kavanagh And Clarence thomas expressed support for. This dock troichb supremacy, radical obnoxious idea that politicians can just substitute their judgment for voters, thats what everybody needs to keep their eyes on in the up coming election. Bassett pointed out that in january, a bill was introduced giving the legislature the power to toss out Election Results that didnt go anywhere. That woman is running to the Arizona Secretary of state. To be in charge of arizonas elections. We watched the insurrection on January 6th. Devastating to people in the capitol. Ultimately, it failed. But what is being developed right now . The next attempt to overturn the election will be more subtle, more nuanced, more legalistic and likely going to be far more dangerous for the country. Rick hassan has an article called trump is planning a more respectable coup the next time. He joins me now. Depending on you for analysis for years and years and years, and ive noticed that you have been as unnerved by the revelations about What Clark was up to as i have been and explain why that is. Well, im just saying i was worried during the period between the time we held the election and January 20th when trump should have left office, because there was so many places in which someone could try to mess with our system. Our electoral system doesnt treat all voters call. Its the mechanics we use for transmitting each states votes into those Electoral College votes. Gives lots of room for people to mess with the results. What we saw the revelations that have come out over the haas few weeks regarding Jeffrey Clark is that trump was prepared to push a wacky theory that was actually having potential to make a difference and could have been at the very least caused a stalemate in congress where we have had a president voted on on January 6th or January 7th after the insurrection. It really came a lot closer than i think any of us realized until we saw these revelations. This wacky theory, this State Legislature supremacy notion. Theres the kind of Conspiracy Theorists where the Dominion Voting machines were run by china or hacked by Hugo V chaves ghost, right. The respectable version that you get from Josh Hawley and Jim Jordan is essentially a version of this theory. They basically said we voted to block Joe Bidens electors because we believe the State Legislature is the only authority for election rules and those states violated the legislature and therefore they dont count. Absolutely. Trump himself in an interview he gave to phil Rutger And Carol leaning said the same thing. He said put aside the fraud. Even if you put that aside, you had election administers and courts and governors sending rules that were not approved by the legislature and therefore that was listen enough to throw it to the State Legislature. Even if, and i make this point, because even if courts wouldnt go along with that, if there had been a republican house, that the members of the House Couldnt have accepted it. Its not clear that the courts would have overturned it. It gives enough air of respectability that it could have been a very thin reed upon which we could say he won but he lost. The speech on January 6th. He said it wasnt particularly close. I remember Alex Preen made this observation, a sharp writer who said the these is was that theres a right way to install the president , which is to come up with legal arguments conservative judges are willing to sign on to. This is the sort of embarrassing stunts loser democrats do. Basically like you screwed this up, you did all these crazy things and you summoned a bomb to chant hang mike pence. Theres a way to do this that haunts All Of Us and informs your piece. Oh, yeah. You know, had the election turned on pennsylvania and had the election been close enough that it was within the 10,000 votes that came in in the last three days of the election as ordered to be accepted by the state Supreme Court, i have No Doubt that the Supreme Court would have thrown out those votes and potentially handed the election to Donald Trump. There was this respectable enough legal theory, this Legislature Doctrine which could have served as the basis for completely changing the Election Results. Rick hassan, whos been really, really essential reading through all this, thank you so much for joining us tonight. Thank you. Congressman adam schiffs a member of the January 6th select committee which has taken over the investigation. Hes the chair of the House Intelligence Committee and he joins me now. I got to say, i feel like we have a pretty full picture, a lot of the evidence, but theres a lot more i want to learn. It seems like theres a lot already for your committee to dive into here. Well, thats absolutely right. First of all, i very much agree with Professor Hassan about how close we came to losing our democracy and not merely on the 6th Throughout Tirch Sur Recollection but through other means. If you think about whether if park had been successful in becoming the acting Attorney General, those letters would have gone out to potentially all six states like georgia, pennsylvania, arizona, etc. Those legislatures could have acted on those letters saying the Justice Department says this is lawful. And who knows where we would be if we had, you know, lost a few more seats in the house and Tim Mckavrty had been the new speaker. They very well might have overturned the results of the election. They seem to be doing everything possible to lay the groundwork for that in the next president ial election. So look, we do have an enormous amount as a committee to look into all the efforts to overturn the election in advance of the election. The efforts after the election and the events on January 6th. None of these things are disconnected from Each Other. There are two men who, to my mind, need to be answering questions under oath at length. Jeffrey clark, who was one of the key plotters with Donald Trump of what would have been a coup, and Mark Meadows, who reporting shows, played a close role in fomenting all this as well. Theyre both private citizens. They dont have any executive privilege protections. They may try to claim them, but dont you think we should hear from them under oath . Well, i do. Ultimately, the chairman make the decision in consultation with all this about witnesses but i think their testimony would plainly be relevant. They are participants in the effort to overturn the results of the election, you know, in the case of Mark Meadows, he was an active participant in pushing out the big lie, which led to the attempted insurrection and the attack on the capital. Hes already in the know of what the president was doing on that day or failing to do on that day, what the White House knew in advance of January 6th. These are two very important witnesses but ultimately well make that decision as a committee. This question might be a bit out of your portfolio. I dont want to step on anyones toes, but as i keep watching this, theres enough for a department of Justice Investigation at this appointment. There is a call called judicious conspiracy in the u. S. Code. I said this before, if a Chicago Alder Map was caught on tape saying the exact same thing, the u. S. Attorney would probably indict the dude by The End of the week. Thats just one data point. What we have is a coordinated attempt to steal an election fraudulently. It seems like if this does not lead to criminal exposure, i guess i dont understand the law. Well, chris, im very much in agreement. I also look at that Phone Call between the former president and the Georgia Secretary of state where the president is saying cant you find 11,7870 votes, a clear recorded appeal overturn the results of the election and that is the gravamen of the defense and the investigation. The other things were talking about, the efforts to get the Justice Department to weigh in, all of these things, i think, are evidence of the president s intent to overturn the election that would be relevant in the case of georgia. So yes, i have the same question about is this something the Justice Department is investigating . If they arent, why arent they . If it were you or me or any other city council, state race, etc. , and you have someone on the phone recording, Trying To Jin Up A Phony 11,000 votes. You really have your work cut out for you. Hope youll come back very soon. Thank you very much. Thank you. Conservative movement is being urged on my prominent voices on the right who are prop began diesing for a liberal ah their tarrin government and that tropes refuse the rhetoric the most popular and powerful right wing media outside let in this country. On one side you have the enemies of everything this nation has been. On the other you have the patriots, The Americans, the men and women who will do anything to preserve it. Ive noticed in the last few nights in budapest ive run into a number of americans who have come here because they want to be around people who agree with them, who agree with you. Do you see budapest as a kind of capital of this kind of thinking . The capital of that kind of thinking or one of the capitals because the other central European Countries are also very competitive and producing very nice ideas and organizing, that kind of communities, conservative and christian democrats, thinkers as we do. I asked hungary, the shining city on a hill that americans are fleeing to away from the battled u. S. , i guess . This is a proffer, author of strongmen. She wrote about Tucker Carlson and victory tor orban. I know this is your area of expertise. You began your academic study on mussolini. First i want to start with this rhetoric that youre hearing about, domestic enemies, a lot on the right. I found it awful unnerving rhetoric. I have a platform, too, and im careful about the words i say. Am i right to be wigged out by the enemies youre now awaken. What are you going to do to take the country back from the enemies . Polarization is just the start. What we see from so many areas of the right in america now is trying to get people into a kind of survivalist mode. Its our way or the apocalypse. So when the speaker says what are you going to do about it, this is baiting people, right. And so we see it from retired military who start talking about our nations in peril and this is kind of crew talk. Right. Every crew ive studied and a third of my book they were all justified in saving a nation. So getting people to buy into the idea of violence and especially assigning violence of patriotic value that you are a patriot if youre going to do anything necessary to save the nation, its part of this. I find the hungary sort of flirtation al parts, you know, unnerving and pathetic. And i should note that, you know, american conservatives have a long time long history of humping the leg of various authoritarian governments. They loved franko. They were very into the south african Apartheid State for a while, defended them, were going down there for conferences, they were super this isnt that new. And yet the biggest voice in that universe saying, hey, look, this is the model, strikes me as significant. Its really significant, because heres the thing. Orban is like the Poster Child for being a strongman. Today you dont shut down elections. You just manipulate elections so you get the results you need to stay in office. You need to talk about position. So the conference at which Tucker Carlson spoke had a couple of orban critics. He says im not a dictator. I have elekings, i let critics but in fact, the nice ideas that the hungarian person quoted, antisemitism, antiimmigrant, you know, in 2020, the year that organ leads by decree so he is a Deck Tatdor formally in that sense. Its a repressive state. He doesnt poison people like putin. In fact, Tucker Carlson is the perfect propagandist for this because his positions line up with a century of fascist thugs. He always wears a suit and a tie and looks very clean cut. Its all very dangerous. Theres also this, i mean, the sort of the idea of moving to the Fore Front of this argument against democracy, against even liberalism. Right. Again, this has always been a strain on right wing thought. To the extent that you could identify a modern right, it is literally born in opposition to democratic revolutions, but to sort of revive and resuscitate that and to cultivate it at this moment, seems like there is a thing happening in a small part of the the intellectual sphere of the right if you can call it that that is pushing on that door. Well, absolutely. And orban says, as has putin and back to mussolini, that Liberal Democracy has failed. Everybody said that. I have the solution, they say. Right. But were seeing this now from many, many quarters in our country, and what theyre trying to do which is so dangerous. Lets be frank. Its democracy has embraced this culture so that all of the values of democracy from challenging political opponents, having a free elections, all of that is going out the window. What they need to do now after January 6th is get people to buy in to violence. That violence is patriotic. Then thats why theres the uptick in this kind of lastditch survivalist rhetoric. Its us or the apocalypse. Thats why i say its a dangerous moment. Well, ruth, call me oldfashioned, but i think americas a great country. I dont like political violence and i like Liberal Democracy. Those are my takes. Ruth, thank you very much. I appreciate it. Its been a year since one of the most infamous Super Spreader events in 2020. Guess whats back and bigger than ever. Oof. Expect rising Covid Cases and the very transmissible Delta Variant. 70,000 people are expected to attend. The Associated Press interviewed one enthusiasts that made the Trek All The Way from hungary, who said he managed to evade rules. Nearly half A Million people said to hell with masking and social distancing. They made the trip to sturgess. Perhaps because the republican government basically told everyone they had nothing to worry about. Weve had several big events in South Dakota already. We had the first spectator attended professional sport, the professional Bull Riding was held in South Dakota. We had the July 3rd event, and saw no increase in cases because of the crowd that gathered to celebrate our Countrys Freedom and independence. Weve been back to normal for over three months here in South Dakota. We know we can have these events. Give people information, let them protect their health but enjoy their way of life and enjoy events like the sturgess midatlantic rally. We hope people come. Our economy benefits when people come and visit us. Theres some good data to suggest that Sturgess Wound up being one of the most catastrophic Covid Cases event. What happens when hundreds of thousands of people gather in tight spaces like bars and restaurants and Concert Venues in a small town over the course of ten days amid a once in a century pandemic. There was a spike in cases after sturgess. A majority of the cases were Konz Traited in the upper midwest. The dark areas on the map show the places like The Dakotas along with wyoming and minnesota, Saw A Spike in cases after sturgess. The dakotas became a kind of epicenter for the pandemic in a way that made no sense except when you remembered sturgess. So what do you thinks going to happen this year with the highly transmissible Delta Variant. Last week, more than A Thousand tested positive after partying in a small town. The cdc studied that and fount found that three fourth of the folks were vaccinated. They were overwith Whemgly Mimed and asymptomatic and crucially No One died. Its also testament to how dangerous the Delta Variant is. It happened in a county where 67 residents were vaccinated. Compare that to 37 of residents being fully vaccinated. Again, what do you think is going to happen . If you have an outside event thats a moderate number of people, youre having a large gathering, you know, maybe 50, A Hundred people outside, no problem. But when you have a half A Million motorists coming into a town in The Dakotas, then youve really got to be careful because youre probably walking all over Each Other and are very, very close. Lets Hope Everyone gets lucky here. The future is uncertain and Covid San Diegos sometimes when you think its going to zag. The governor doesnt seem concerned. Shes planning to attend herself. She has been out there touting her pro Covid Bone Fights for months. Republican governors across this country saying she didnt close down their beaches, that they didnt mandate masks. Im not picking fights with republican governors. All im saying is we need leaders with grit. Demand honesty from your leaders and make sure that every one of them is willing to make the tough decisions. We trusted our people, issued and told them that personal responsibility was the best answer and what we did in South Dakota is what conservatives have always said they believed. We just did it. And we proved that It Works. That It Works for families, It Works for diss and It Works for this country. We will continue to make the tough decisions to make sure that were an example. Now, permanently, having covered this for over a year and a half, i think its clear we have to do whatever we can to get kids Back To School in person. That seems a consensus, thankfully. What that means is Adults Work Manager the schools need to get vaccinated. The schools need to take steps to minimize transmission among the children. Despite a recommendation by the cdc that kids wear masks were seeing Pressure Groups raging against School Masking across the country. In fact, it took a judge to stop a Ban On Mask Mandates on schools in arkansas because the republican Legislature Wouldnt Repeal the law despite pleas from their own governor. He said he regretted it. Thanks to an Executive Order from governor desantis. Governor abbott banned Mask Requirements in texas school, too. And then just took their covid policy to a whole other level. They issued new guidelines saying that schools are not required to notify parents if theres a Covid Case in the classroom. For context, texas schools are required to notify parents within 48 hours if a kid in the Class Room gets lice. Judge, its great to have you. Lets start on this one. I mean, i want to say this is an innocent mistake or something, but i saw the Texas Education Agency put this out today on twitter and i couldnt believe what i was seeing. Am i nuts . Am i missing something . How can it not be a requirement you let parents know if a kid in the class has covid . Its not a puzzle just to you and me. Its a puzzle to the superintendents across the state. Ive been in touch with the 20plus septs of the School Districts we have here in Harris County and theyre very concerned about the way the state is making it hard for them to keep kids safe. Theres something of an unwritten contract with every parent of every child that says that School Districts and teachers and administers will do everything they can to protect kids under their care. Certainly, that they will do no harm, and this is the opposite of that. Especially for the children under 12, who arent even eligible for the vaccine. Theyre defenseless. There is a huge sense of Frustration And Confusion that then turns into tragedy, really. Yeah. I just got to say as a parents, like you damn well better sure let me know if theres a Covid Case in my kids class. Just going to say that as a parent, like i think most parents probably feel the same way. In this case, i know the superintendent oversees schools and this is sort of the floor, not the ceiling, right, of president obama. Its not like theyre banning schools from telling them but on the mask question, Governor Abbott has attempted to stop schools from requiring it and houston independent School District says this last night. During tonights meeting, superintendent announced he will oppose a mask mandate, to be voted on next week by the word of education. That is not within your governoring purview, but do you support that decision . Absolutely. I absolutely support superintendent in that decision, Superintendent House and in any other School Districts in Harris County across the state that are considering doing this. You have to ask yourselves what is the point of banning masks in public schools, what is the point . There is certainly no medical reason for it. It has to be purely political. And we were just hearing, you know, there seems to be a competition among the republican governors to see who can politicize this the most ahead of the 2024 president ial elections at the expense of our children, and i think were putting these superintendents in a very difficult position. They receive funding from the state. They receive guidance from the tea, the Texas Education Aelgt agency but unfortunately theyre going to have to step up and All Of Us are working, doing everything we can to keep these kids safe. What tools i mean, texas does h has not seen the Spike Weve seen in, say, louisiana and florida, but weve seen elevated cases there. What tools do you have on a Policy Level at your disposal trying to stop or mitigate the levels of Community Transmission in Harris County . Well, we are seeing very concerning numbers and the good news in texas is we started at a low level. But in terms of increases in cases, hospitalizations, Positivity Rate theyre increasing faers than at any. Announcer the up and down ib. Very quickly, for example, my public Hospital System in Harris County, were having to make decisions about which patients to treat. The private hospital ceos are telling me if things keep going in this direction, they could run out of space, so it is a concerning situation. My hands as a local official are tied. I can no longer require masks, i can no longer implement any kind of prevention. Im communicating directly with the community. Just yesterday i ordered a Threat Level to go to red. The highest Threat Level. The clear recommendation, everybody needs to get vaccinated. Were doing everything to lower the various vaccinations, sending teams all over the county, incentives, scholarship programs, you maim it. Those who are unvaccinated, just stay home and avoid contact. Youre putting the entire community at risk, making it vulnerable to variants and our children, you have to picture the classrooms in schools with A Thousand, 2,000, 3,000 students, nobody wearing a mask or few wearing a mask. These kids that cant have a vaccine, as sure as you and i talking, theres going to be cases and all of those can be avoided. We should say that texas has seen vaccinations go up, the Texas State Department of Health Today saying the daily vaccinations are up 15 from last week, 30 from two weeks. They administered over 512,000 doses. You oversee a county that is extremely diverse and large. Dozens of languages are spoken. You have all kinds of different communities in Harris County. What are you finding success in in getting the Vaccination Numbers out . Most importantly, going into each community. Partnering with organizations, leaders in the community that know sort of what works, whats a convenient place in terms of vaccinations, but definitely, you know, were seeing africanamerican communities having a lower rate. We have seen an increase in the past two weeks and were going to continue to could can everything we can. Lina hidalgo, the County Judge for Harris County, texas. Thank you so much. Thank you. S. Womens national team and about this rejection of woke olympians. I have to say, olympians are olympians no matter their politics, they all represent their Country And Theyve done a phenomenal job. Its bizarre to see people on the right wing denigrate people who have worked their entire lives to represent their country. This is part of a broader thing, david, weve seen the idea that like wokeness has infected everything from the u. S. Military is a bastion of wokeness, to the olympic games. It just seems paranoid. But its like, everything that used to be the things i thought were like Flag And Apple pie have now in the minds of its critics been turned into some symbol of leftism. Theyve ruined the word woke and theyll probably ruin Apple Pie too before its all said and done. Yes. Whats so hilarious about this whole thing is theyre really talking about the united states womens Soccer Team which has been such an inspiration to people across the World And Megan rapinoe, this person who grew up working class, redding, california, 26 years old, who now seems to live rent free in the head of Donald Trump at all times. If you dont think thats because shes a woman, proudly lgbtq, then if you dont get that, then i dont know what to say to you. But what i find about this thats particularly galling and hilarious in its way is that the u. S. Womens Soccer Team, you know, they were in the Bronze Medal Game because in the main game, canada was playing, that famously unwoke nation, they were taking a knee before the game. So what are we really talking about here . Its not about wokeness or politics. Its about trying to take down these incredibly brave women who have inspired people politically in the united states. You know, my favorite part of the games is watching obscure sports, listening to commentators talk about those sports with incredible sophistication and talk about technique. But i thought of that, in the arc of the simone biles narrative which i felt like was one of the main stories of the games. Of course simone biles, you know, she has a really almost catastrophic vault, she takes herself out of the all around team competition, she then sits out all the events until doing the Balance Beam at The End. And, you know, at first the story was Mental Health, Mental Health is important, which was true, but also not really the story, kavitha. I found the actual story about the complex connection between physical and mental performance in a gymnast and the danger of not being locked in and the way she described what happened, i learned so much and appreciated so much more what she and other gymnasts do from that episode than i would have if it had never happened. Absolutely. And im with you on loving the obscure sports, every four years we all suddenly become dressage experts. With simone biles, it has been interesting to see the education The American public has gone through over the intricacies of gymnastics, the way you described, the way the physical and the mental are so connected. We all learned what the twisties actually are, theyre not just the yips. Gymnastics is such a dangerous sport and the only reason we dont give it its credit as being as danger and you say physically tough as it is is because the faces of gymnastics that we know in the united states happen to be Pretty Women Whootards and makeup. Chris, simone biles is the greatest athlete in the history of the united states. Boom. Full stop. Wow. Wow. Thats a bold claim. We can do three hours on talk Sports Radio Tomorrow on that. So item put a pin in that one. Thank you so much. Thats All In for the week. The Rachel Maddow Show starts with Ari Melber. Good evening, ari. Thank you, chris. Im Ari Melber in for rachel during her much deserved vacation. I have some good news on that and her return which well share with you later tonight. It involves actually some of you or at least one of you, an Msnbc Viewer who happens to be a wonderful grandma. This is real and well get into it later after some of the news. Now, as for the kind of good news that usually leads the actual news, today the White House announcing 50 of americans are fully vaccinated against covid. A key Milestone Thanks to the quickening rate of vaccinations, up 11 in the last we,
