Protecting our constitution. And saving the lives of a duly elected in the senate in the house. And their staffs. It breaks my heart, it breaks the heart of the nation, to remember that you were assaulted by thousands of violent insurrectionists at the capital of the united states of america. President Biden Today also talked about the Capitol Attack in some of the starkest terms. We have heard him. Use not even during the civil we, did insurrectionists breach the capital of the united states of america. The center of our democracy. But on January 6th, 2021, they did. They did. A mob of extremists, of terrorists, launched a violent and deadly assault on the peoples house. On the sacred ritual to certify free and fair elections. It wasnt descend, it wasnt a bid, it wasnt democracy. It was insurrection. My fellow americans, the tragedy of that day deserves the truth above all else. We cannot allow history to be rewritten. We cannot allow the heroism of these officers to be forgotten. We have to understand what happened. The honest an unvarnished truth. We have to face it. We have to face it. The president s determination there not to let history be rewritten, to face what happened that day is a determination shared by officers we have spoken out publicly in the aftermath of the insurrection. Metropolitan Police Officer Mike Feminines Cup featured on the cover of Time Magazine today. Americans have heard his descriptions and seen video of his terrifying experience on january six, of being pulled into the crowd, beaten, tased, and nearly killed. In todays article, funyun says this, quote, theres people on both sides of the political aisle that are like, listen, January 6th happened, it was bad, we need to move on as a country. Wooden arrogant thing for someone to say that wasnt there that day. What needs to happen is there needs to be a reckoning. Times molly ball says that phenomenon is, quote, not asking to be called a hero, he just wants us to remember what his sacrifice was for. Fanone believes that we cannot keep trying to outrun this. Thing we have to turn around and face, it defeated once and for all. That if all we do is turn away and hope it fades, it will just keep getting stronger until it comes back to kill us all. Which is why Mike Feminine keep speaking publicly about what he saw that day, what he went through. He testified the first hearing of the select committee of the Capitol Attack. And of course, he wasnt alone. He testified that day alongside three other officers who were at the capitol potentially eight. Ungenerous six. That includes sergeant colonel. He is a veteran hes an Army Veteran who served in iraq. And he told lawmakers that january six was scarier than any day of his deployment to iraq. Heres a bit of his compelling testimony that day, which we have put together a video, some of the scenes hes described. How i always take my word seriously. On january six 2021, i fulfilled my oath once more. The verbal assaults and disrespect we endure from the rioters was bad enough. My fellow officers and i were punched, kicked, shoved, sprayed with chemical irritants, even blinded with i damaging lasers. I was particularly shocked at the scene that the insurrectionists not only attacked us with the very american flag that they claim to protect. Joining us now is Sergeant Aquilino Gonell at the u. S. Capitol police. Sergeant, thank you so much for your time and we are happy to talk to you. I know you were at this Ceremony Today in the rose garden, and i was wondering if you could just tell us what that was like, did it help . I was very pleased for a lot of us officers who were there, a lot of us made Awe Sacrifice to be able to be recognized. Even though when we did our job, we all signed up to be a Police Officer, we all know the risks was that the job was has. But its nice to be recognized, its nice for us what was and hopefully that will change the conversation because there is still a lot of fellow citizens, including elected officials, that continue to deny what happened, continue to downplay even though some of them themselves were running for their lives or were scared that day. Well its unbelievable the lack of Room Support of what happened. Sergeant gonell, what has the last weeks been like since the testimony, your testimony, alongside officer hodges, done, and fanonne . Since the hearing, its always the same for me, i still have to go to Physical Therapy twice a week for about two hours, sometimes two hours and a half, because i am recovering still from my foot and shoulder. I still that still has not been resolved. The mental exhaustion from being called by the Department Of Defense sorry, the department of justice, the prosecutors, the fbi was. That is the ongoing i just spoke to two days ago i got another call related to a case that is a plea deal. The issue is, no matter what or how much i want to move on like so many of those people who now say nothing happened, there is nothing to see here. So therefore, we really should move on, i cannot do that still, even more than six months later, because of those things. The mental health, trauma, the Physical Therapy, my pending surgery on my shoulder. So as much as i want to, i cant get away from. It you and your fellow officers, i think, did the rest of us a favor by talking about some of which youre talking about now. I want to play some of what Officer Dunn said to his fellow Law Enforcement brothers and sisters in Law Enforcement at the hearing that day. Well talk about it on the other side. Im now receiving private Counseling Therapy for the persistent emotional trauma of that day. Ive also participated in many Peer Support programs with fellow Law Enforcement officers from around the united states. I know so many other officers continue to hurt. Both physically and emotionally. I want to take this moment to speak to my fellow officers about the emotions they are continuing to experience from the events of January 6th. There is absolutely nothing wrong with seeking professional counseling. But we went through that day was traumatic, and if you are hurting, please take advantage of the Counseling Services that are available to us. Since the testimony that you all provided last monday, we have learned that two additional officers who responded to the January 6th insurrection have died by suicide. And i wonder if you can speak to what is obviously ongoing and what the public can do, how can these conversations be had in a way that supports what you are all still very much going through in realtime . Its tough. Coming forward to talk about it. I know for me in my case, what drew me to come forward and talk about the whole ordeal of january six was when i saw the sydney family, of sir fanonne, literally begging someone some of these Gong Congressman unelected leaders that they provide a promise just to get them out of the way and then the minute they turned around they deny everything, they gave those Family Members a sense of false promise. And when i saw them doing that, it broke my heart. I started crying. My wife walks into my room, because i was still recovering from my leg injury, and she saw me sobbing and i couldnt even talk. And she asked me what was wrong with me and i just pointed to the tv. And said look, look what theyre doing. When i did, that i saw my wife, my mom, and my son doing the same thing in their position, begging for a acknowledgment that something bad happen, not to, me but to the country, to our democratic process, to my fellow officers. And it takes a lot for people to come forward. For me, i waited, i waited, and waited, months, because i want to talk about this within a week or two after it happened. But i give it time, i knew that i was not in the right mind because i was so upset, and very emotional, everything happened to us. And i took my time. But i was also waiting for all the other leaders, Police Officers, and elected leaders, to acknowledge what happened when some of these people in the White House, maybe after this happened on January 6th, maybe somebody else is going to come forward and speak the truth and acknowledge that nothing was happening from the White House. Everything went as capital police and metropolitan police, went through this whole ordeal at the capitol. One was the president trying to assist us . When was he this is some of the questions that i have, even when i was battling his own supporters. When is he going to tell him to stop . When is he going to tell them to this is not what i had in mind. And later on i learned that, three hours later, into, it instead of sending the help that we needed he just send a message begging them to continue, praising Test Test Test test them, and then two hours later, well, everybody go home, we love you. How is that love when we, the Police Officers, Are Building put in a position where we can get killed when we are trying to do our job. That to me was unbelievable. Because there is no way that he did not know what was happening, there was no way that anybody in the White House at that time told him that this is bad. And something very horrible is happening in our own government, and all the branches of the government that he, including the Vice President of the united states, and were talking about if this is not a matter of national security when you have the Vice President , his own Vice President at the capitol, and everybody in the succession of the Chain Command to the presidency is there at the same time, when are you going to send help to help those members, including the Police Officers which, we were left on our own just to as a sacrifice for his ego . I remember that video coming out in the same way as you, do it stunning where he said to the insurrectionists, we love. You sergeant this kind of. It was kind of like have a good day, we had a good, time come back next monday. Meanwhile, we still remain with the under injuries. Im still dealing with all these things. It was not a Love Fest like certain people want you to believe. You see the footage of the it was not a tour. It was not like a tour either. This was horrible and people need to acknowledge that because the danger and the severity of that moment to our democracy, to the capital, to lawmakers, to his own Vice President , that was a sentenced to death that he sent his supporters to do that. Where and when he says, ill be right there with you after his speech and then he wasnt there, he literally sent them over to do whatever he wanted them to do. Now he wants to change the narrative, now that there are people who want to change Whitewash Everything . It is a complete betrayal and via violation of office, in my opinion. Sgt. There is new reporting from Politico Today that indicates that the select committee investigating the January 6th insurrection has taken over the house Committees Probe of Trumps Pressure Campaign on the Justice Department in his final weeks of office. Specifically, politico is reporting that sources said that he cancel plans to interview former Richard Donahue passing Rosen And Donahue are particular interest right now because of two developments recently. First there is the revelation that trump called acting a. G. Rosen almost daily in the days leading up to the insurrection, pushing open an investigation that would cast doubt on the 2020 results. And second the proof that backs up those revelations. Notes, contemporaneous notes, taken by Rosens Number two, Richard Donahue, showing that rose, unquote, just say the election was corrupt and leave the rest to our republican congressman. Now that trump is no longer president and not protected by the justice rules against indicting a president , might a criminal investigation against the former president come next . Two former u. S. Attorneys and a constitutional Law Professor argue that it should be. They, test the time has come for the Justice Department to begin, if it hasnt already, a criminal investigation of the former president s dangerous course of conduct. If we are to maintain our Democracy And Respect for the rule of law, efforts to overturn a fair election simply cannot be tolerated, and trumps conduct must be investigated. Joining us now is one of the authors of that piece, Barbara Mcquade, the former u. S. Attorney for the eastern district of michigan, currently Law Professor at the university of michigan. And devlin merits here, a Law Enforcement reporter. Thanks to both of you for time tonight. Barbara, its a great piece, but for our viewers, detail the crimes that Donald Trump could or should be investigated for . At this point, of course, doj should just begin investigating. There is enough evidence in the Public Domain to suggest any number of crimes that have been committed. Number one, conspiracy to defraud the united states. This sometimes as you referred to as a client conspiracy, and its one of the things that Robert Mueller charge against the internet research agency, obstructing the administration of government, in this case, congress and certifying the vote. Number two, conspiracy to obstruct an official proceeding. That is a charge that has been laid against some of the protesters there that day. A possibly even rico which is the organized crime statute, using the president s office as the machinery to engage in other crimes that are called racketeering acts, those could include extortion and the Rico Statute involves both federal extortion acts, pressures on rosen, as well as state crimes, so it could be these pressures extended against the secretary of state of georgia. The Big Kahuna would be Seditious Conspiracy or inciting insurrection, i dont know whether the evidence will go that far. And then theres some smaller charges like Voter Fraud and commanding a federal employee to violate the hit check. But all of those things have to be investigated so that in prosecutors can decide whether the evidence is there. And to let it go for political reasons, we argue, would be a grave mistake. You know, dublin, its such a sign of the ethical and legal potential monstrosities of the Ex President that Barbara Mcquade mentions illegal Voter Fraud and had checked violations, the smaller things in the last. I wonder if you can speak to the fact that Donald Trump has blazingly flouted norms, slash, laws for five years. And the impediment was always that you cannot indict a sitting president. Robert mueller describes five or six acts which sound like criminal Obstruction Of Justice and a lot of joint missions with the russians, but there was never a serious conversation about investigating and charging him because he was president. Has that changed Behind Closed Doors at the Justice Department . To my knowledge it has not changed yet, but you have to remember, there is a constant collection of evidence and, in theory, could that View Change . I think we have to see, i think one of the things we have to see is what does Jeffrey Rosen say specifically about this conversation. We have the notes and obviously theyre quite barren. But it matters are not what Jeffrey Rosen says in front of a microphone. And i think the same holds true for Richard Donahue. And a handful of other senior Justice Department officials who wrestled with this in realtime. So i understand Barbs Argument here, shes a smart lawyer, but i do think there is a lot more to the picture that needs to be understood before you can make any determination about criminal activity here. Barbara, im sure its your understanding as well that as we start to see these pieces come into public view, it makes your argument stronger. Yes of course, and i agree with devlin, i dont think that theyre ready to indict today. But there isnt enough already in the Public Domain to service whats known as predication. That is, non frivolous facts. That there was a crime that occurred here. So i think that would merit those additional investigative steps. And when prosecutors investigate, they can get text messages, they can get emails, they can put people into the Grand Jury and asked them what happened. I think one of the most damning things that has come out in addition to those quote notes you mentioned, nicole, is the Draft Letter from Jeffrey Clark that we saw that, in my, mind lays out the roadmap of what the endgame here was in the conspiracy. That letter was to be addressed to the state of georgia, telling them what to do about their own election. Telling them, you know the legislature under federal law can come in and substitute its own vote for the vote of the people, here it is. It seems to me that he lays out what could be the Game Plan if congress could throw out enough of these Election Results and failed to certify the election. It thank gets thrown to the house with a majority of delegations are republican. There was a path for Victory A for Donald Trump as long as people believe the big lie. The Department Of Defense employees 1. 4 million active duty Men And Women, plus a civilian workforce of more than 700,000. President biden has required that federal employees get vaccinated, and Service Members are already required to receive certain vaccines. But the u. S. The Defense Secretary has been asked to study whether the Covid Vaccine should be mandatory. The New York Times is reporting that the Defense Secretary Lloyd Austin will make his recommendation in the next few days. Courtney, tell me first where this stands and if you have any Tea Leaves that you can read, about what the Defense Secretary Lloyd Austin is inclined to recommend. Hes inclined to make this mandatory for u. S. Service members, and i think we will see this in the next couple of days, that that announcement will come out. Hes already telegraphed that by the way. And President Biden said last week, he wanted the Defense Department to look at this. You mentioned that the d. O. D. Has a complicated history, and thats the deal with the issue, the crux of the issue. We have been hearing from people close to Secretary Austin that they did not want to make this mandatory, because of the Militarys History with these mandatory vaccines, like the anthrax vaccine. There has been reticence to make this mandatory for military, because they do not want to look like they are using the military as guinea Pigs Guinea pigs for experimental medicine. We already have millions of people around the world who have taken these vaccines, including many military members themselves, more than 65 of them have gotten two doses, when you look at it across services. So thats what i think change the calculus here for the military. We know know that the secretary is open to this, they have looked at this, we have been told that it would happen very quickly. So we should expect that announcement to come very soon, nicole. Paul, i was trying to find a tweet that you put out tonight, youve listed all the vaccines that are required for Men And Women in the military already, and id ask you to do that again for us. Obviously, Anthrax History is recent, and i believe we should give credit where credit is due, i believe right now today, as of august, where are we, the fifth . The military is vaccinated at slightly higher levels than the general population. But come at this however you see fit. This is coming, this needs to happen and it should happen, it should have happened already. We cant afford to have 30 of the military unvaccinated. We cant afford to have fighter pilots, people on the front lines, on our global conflicts, coming down with covid. Theyre on barracks and on ships. Weve already had the uss roosevelt, an aircraft carrier, have to come back to shore because they had a Covid Outbreak Last year. This is a national security issue, it really cuts to the core of how dangerous this antivaccine rhetoric is and has become. It endangers our national security to have our Service Members at risk for a virus. Its something our enemies are celebrating, isis loves this, putin loves this. Every day that biden waits, our enemy celebrate. I hope it happens soon. Well, you and i have had frank conversations about the military as a reflection of what is going on in the rest of our broken and badly damaged politics. How much of this is a reluctance to step in and something that we know is highly politicized . Oh yeah biden needs to bite the bullet, do whats right for our military. I got more Stuff Put in my arm when i was in the military, more than i can remember. I never got an action. You cant decide you are not going to wear body armor, these things are designed to protect you, if you dont want to take the vaccine, get out of the military. It means you are not willing to be a little, it means you are putting other people at risk, this is about the core of not just the Vaccination Effort across the country but our national security globally. So i hope biden will bite the bullet here, take whatever flak he has to take, because lives are at stake. And courtney, it seems your reporting suggests that that is the view of the top of the pentagon. What is the process, is simply Due Diligence . Is it simply looking like they have had a chance to ask internally, how this would happen . Is it because of the political moment . So, the secretary did he wanted to consult with medical professionals, before he made this mandatory, and there is a process they have to follow. President biden has to issue a waiver because, again, this is Emergency Use Authorization medication. He has to issue a waiver before they can make it mandatory for the military, so its expected that that will happen. I think what we will hear, when we make this an ounce meant, that it will be mandatory for all active duty Service Members, i think we will hear the Word Readiness a lot. And thats going to be, the military needs to remain a ready for, so its exactly what paul was talking about. We have these people who are deploying all over the world, in places, where there are a lot of vaccines, those places. Where there are a lot of outbreaks. Its a matter of keeping people ready to fight, at all times. Thats going to be the argument that i expect, according to defense officials, to make here. And we will keep watching, with your help. I admit that i now search twitter for whatever you have said and waiting on, because its not a spin on the days news, but you do get right to the bone, cut through, and i wonder if you can do that with what seems to be happening as the Delta Variant has made clear that it sees simply unvaccinated states, right . Now blue states, not red states. But they happen to be red states. If we move toward vaccine mandates, are we simply going to get less covid in the places that are doing wearing our masks and getting mandates . If the rest of the country doesnt follow suit, will it really help the whole country . Nikole, thanks for having me, first of all. Its a great question. I would say two things, first of all. Even in the blue states, there are pockets of unvaccinated people so everybody has work to do. This is not just a red or blue state problem. There are seven states where they are driving infections across the country, really. Second, i think this is a time for people to step up, people who are apolitical, University President s have to stand up and mandate back scenes. The American Medical Association has come out and said that every hospital needs to mandate vaccines. That should happen everywhere in america. If we see civil Society Step up we can get rid of the blue state red state stuff, and just get people protected. Can you tell me a lot of people whats flock to your feed to four is the science. Can you explain what is happening with the Delta Variant . It feels like we have an out of whack and i know the White House feels like this to, that we have a disproportionate reaction to the phenomenon of Breakthrough Infections, while most of the danger is in the unvaccinated, eligible young people. Absolutely. These vaccines really are terrific. They have great efficacy at preventing any kind of infection. And then they have superb efficacy in preventing deaths and hospitalizations. But when you have this much to Hospitalisation Infection spreading in the country, you would not be surprised, even if it is a 90 effective vaccine, if five or 10,000 americans are having Breakthrough Infections every day. Why that many . Because they are surrounded by so much virus, because of the outbreak, it really focuses on unvaccinated people, its spilling over into the vaccinated. Thankfully, most vaccinated people are not dying or getting sick, so while Breakthrough Infections are problem, they are not driving the pandemic. At this point, it is a pandemic of the unvaccinated. And unvaccinated people are doing most of the suffering unfortunately as well. Can you look at any other country that had the Delta Variant, attack there unvaccinated populations before we did, and project whats the next few days and weeks are going to look like for our country . Absolutely. There are a lot of countries that have dealt with the delta wave. The uk started about two months before we did. They gave us a head start, they gave us a peek into our future. And in june in july, many of us were warning that this wave was coming. Unfortunately, a lot of governors and leaders ignored it. The good news from the uk is that Infection Numbers have really turned down after two months of pretty horrendous increases. I think that will happen here in the united states as well. If that holds, as we get to the end of august, into september, i am hopeful that we will see Infection Numbers turn, more quickly in the vaccinated states. Because there is immunity. So much immunity. But im hoping we will see more of that. One of the most compelling things that i see, as i am consuming news in my regular life, are the horrific tragedies of Deathbed Pleas for people to get vaccinated. Just on the messaging side, or just anecdotally, and your own life, do you hear those messages, from people who were in the camp of vaccine skeptics, having terrible sicknesses or losing Loved Ones . Is that breaking through . I think it is breaking through. And it is heartbreaking to see those. Because i know people love to sort of beat up on the unvaccinated. I have a lot of sympathy for people who have been bump ordered by misinformation, and it is only their most critical moment of their life, when theyre very ill, that theyve come to realize that theyve been fed disinformation, and theyre suffering because of it. So we have to keep up our work on countering that misinformation, and getting in good information out there to people. Its a very tough situation. But i hope political leaders also step up and amplify the good signs that we have here. Democrats say they expect the deal within days. They could set up another vote before the Summer Recess next week. Meanwhile, more than 100 State Legislatures from across the country are in the nations capital, they are joining texas democrats who spent the last three weeks and d. C. Pushing members of congress to pass federal Voting Rights registration. They said they would stay out of texas until the end of the special legislative session there to block republicans and their State House from Passing Texas is restrictive voting bill. Joining us now is texas State Representative Trey martinez, representative martinez fischer, thank you for spending time with us tonight. First i want to get to the u. S. Senate and the legislation there, i think it seems like you have really helped focus and narrow. But i want to ask you what is happening in texas, are you guys going back or are you staying . You know, but i am not going back. And as long as congress is working, and it looks like theyre working very hard, i will be here. And were gonna see this come to a head and hopefully we can see a vote in the u. S. Senate before the end of next week. , i have first heard your Colleague Jasmine Crock in talk about loving but was in the federal legislation but just needing an inch. Saying making the argument publicly that something, albeit narrow, would be better than nothing. Tell me how those conversations have changed the conversations in washington. Absolutely, well first and foremost, nicole, i dont think the u. S. Senate really understood just how high the hurdles are in texas when it comes to voting. Texas republicans have made a good job of making voting a crime in the state of texas. And i can recall my conversations with senator Manchins Team just understand how easy it is to vote in West Virginia, and how hard it is to vote in texas. At some point i, said you know will take the West Virginia standard because its a lot easier to vote in West Virginia than it is to vote in texas. But as it relates to the national conversation, anything can be done to make voting easier, anything that can be done to almost no Excuse Absentee Program would be. Good expanding voter i. D. To provide you are who you are. There are a number of things in this federal proposal that would really open up voting in the state of texas and it would be refreshing that to recognize that when it comes to Voting Rights in america, that we should have won voting, standard that the american standard. When you look at the its hard to describe it as successful because its still the republican backed Voter Suppression and Voter Nullification Campaign has been one of its most widely successful State By State Pushes in my career. They have proposed, i think almost 400 several precious laws in 49 states, 22 of them have been passed into law. Do you feel like at the national level, the democrats are on their high game to meet that lethal threat to Voting Rights . I think its become an increasingly clear that republicans want to hijack elections. We saw with the big lie, and now were seeing states moving to change the way you vote in your state. And this is a tremendous effort, the 2022 elections, where you can lose and affection an election but you can have it reprocess through republican lawmaking that might nullify or overturn results. So yes, i think democrats are waking up. Here in texas, we saw this coming when we saw the voices being silenced in georgia, and we saw viruses being silenced in florida, and when we spend a lot of time with lawmakers and other states these last couple of days, while they were giving us praise an encouragement for our stan, we made it very clear that we will prepared because we saw what happened in their states. So yes, State By state, republicans are just rolling oversaw listen silencing the voices of voters and somebodys Gonna Have To Push back, somebodys got have to say no, and front now its us here in texas. And we know that rallying this nation and making Voting Rights a top Talking Point in the policy agenda, that we will pass it and see it in the senate before the end of next week. What is the Coverage Centers around the debate of the filibuster, Senator Manchin and Senator Sinema are quite devoted to it, as is the president. Do the conversations Behind Closed Doors just have that baked in the cake or are you pressing Joe Manchin to reconsider his position on the filibuster in private meetings . Sure, its a great question. I have been a lawmaker for 20 years and i understand my house practice, i understand our rules and our procedures. And there is an identity to the institution. And you want to be loyal to the institution. But at some point, there comes a time when you recognize that you may have a Rule Or Tradition that is actually impeding on our constitutional right and, really, we should not have a tradition or rule, or relic of jim crow, actually take Center Stage for a Voting Rights in our u. S. Constitution. So, look, i understand the need to work and try to find a pragmatic and bipartisan response. I understand if and when this bill is filed that theyre a number of provisions that may have been put in and taken out to invite bipartisan support. And i hope that there is one. But in the event that there is not, we have to recognize that the democrats have done all that they can do in our democracy is on the line. So republicans are fighting like they have everything to lose and i think we have to do the same thing because its that important to our country. O do what awaits you in texas, do you fear retribution or charges, do you know . I hope for me its i have a beautiful wife and two beautiful daughters im looking for. Two and yes there is a fear of arrest and retribution. Listen, i take it seriously, but i also take this job seriously. The governor can call as many Voter Suppression sessions as he wants. Were gonna stand here and defend democracy. And at this juncture, people know that we will put all our clothes on the table, weve used, before we fuse them effectively. We are not going to bow down when it comes to taking Voting Rights away from her fellow texans. So, come with may, we were here to defend our country and we are here to defend Voting Rights and we are not going to be intimidated by fear of arrest.
