Rise in cases he admits in hindsight, i wish that had not become law. When all in starts right now. W. Good evening from New York im chris hayes. The coup came closer to succeeding than we ever knew. We know that Donald Trump lauded with his associates to overturn American Democracy. He tried everything he could to keep himself in power over the will of the people. Day by day we have been learning more and more about how comprehensive and dangerous that effort was. We did not learn the details of the single most damning piece of evidence yet, until yesterday. Frankly, i have to say, it is so damning and unnerving i spent the last 24 hours scratching my head in disbelief that it is not a bigger story. The document we learned about yesterday showed an infamy in american history as a completely villainous tax. If the acting Attorney General at the time had signed that document, it would have likely thrown the United States into the worst constitutional crisis since the civil war. They are persecuted actual inciting violence. The document was drafted by this man. A man you should know. Jeffrey clarks name. He is in 1 Million different ways, unremarkable. The kind of Functionary Lawyer that exist in droves in washington d. C. He went to god law school, works for big corporate firm. He worked in the george w. Bush administration and he came back to the Justice Department in 2018. In september 2020, he was put in charge of the dojs civil division. New york times reported that in december, as acting Attorney General Jeffrey Rosen and his deputy richard donahue, were pushing back on trumps attempts to use the Justice Department to undermine the election, they were unaware that mr. Clark, jeffrey clark, had been introduced to President Trump by a pennsylvania politician, and that clark had told the president he agreed that fraud had affected the election results. Basically, he auditioned for the president and let him know that he would be a Trigger Man for Donald Trumps attempt to kill off American Democracy in its present form. That is not hyperbole. Clark met with trump, he schemed with trump, and he drafted the document i talked about. Its this letter. Its still letter that the Georgia Governor and a drafted for Rosen And Donahue to sign, officially from the u. S. Department of justice. It says in part, the department of justice is investigating various irregularities in the 2020 election for the president of the United States. At this time, we have identified significant concerns that may have impacted the outcome of the election in multiple states, including georgia. While the department of justice agrees the governor of georgia should immediately call a Special Session to consider this important and urgent matter, if he declines to do that, we share with you our view that the Georgia General Assembly has implied authority under the constitution of the United States to call itself into Special Session for the limited purpose of considering issues pertaining to the appointment of a president ial elector. Basically, Clark And Trump teaming up, spell out what they want. They want the acting Attorney General and his deputy, to publicly state the election in georgia was too tainted by fraud to be trusted, and that the georgia general Assembly Need to use the Power Interest to do it by the u. S. Constitution to simply come together and send their own electors to washington. Now, this would be a violation of Georgia Law but this letter is the department of justice telling them they do have a constitutional authority to do it. It would be the violation of the Georgia Voters and the american people. It would mean the department of justice was literally signing on to the Coup Attempt in its official capacity. It would be a green light for mayhem. We know, from deputy Attorney General richard donahues contemporary notes last weekend, that trump was already pressuring acting Attorney General Rosen And Donahue literally telling them just say their election was corrupt and leave the rest to me, the republican congress. We know trump was pressured republican Georgia Secretary of state famously, telling him, quote, i just want to find 11,780 votes. His key ally in this is this guy, jeffrey clark. This guy that No One really knows, but who is effectively plotting a coup with the president. Okay, so then, Rosen And Donahue get this and they think they refused to sign this letter. And then they say clark meets with donahue on his own, and then informed mr. Rosen, the active Attorney General, the president intended to replace rosen with clark. And then try to stop congress from certifying the electoral college results. Clark apparently convincing trump to make him the Attorney General, so he can sign that letter. And again, that letter being issued at the department of justice in that that very likely would appear precipitated a crisis from which the country may not recover. It wouldve put in Order Pressure on the republicans in the georgia assembly. Dominated by republicans. A green light from the doj, and they may very well have gone ahead and appointed their own electors, send trump to washington. Maybe other states would have followed suit. They wouldve thrown us into a frenzy. A suddenly contested election, even though Theres Nothing to contest. It was a very clear electoral result. One man one, one man lost. The times report that late afternoon there was a call from remaining senior leaders, laying out mr. Clarks efforts to replace mr. Rosen should mr. Rosen be fired. And they all agreed to resign. When presented with that ultimatum, trump seemed swayed by the idea that firing mr. Rosen would trigger not only chaos in the Justice Department, but also congressional investigations and possibly combinations from other republicans and distract attention from his ideas to overthrow the election results. So he backed off, and the Gun State holstered. We were this close to a world where the Attorney General of the United States, jeffrey clark, publicly released that letter. And the man who came that close to doing that, to meeting that act, jeffrey, clark is just out in the world, chilling. Probably going to nice dinners. He probably makes a good income. He got a new job. He landed the job as Litigation And Director of strategy at the right wing new civil liberties alliance. Those are all his colleagues, they should be proud they work with him. They do things like so universities for mandating vaccines and they try to go to court for the moratorium on evictions. Good folks. Come to think, then it makes you think with the Hiring Practices are at the new civil liberties alliance. How they all field in the office wall, maybe not in the office, but this guy who is willing to assassinate American Democracy. And he can get a job after a lot of this is already been publicly reported, this man who plunder with the president to destroy our form of government. To steal the presidency and overturn an election and to essentially install Donald Trump as a tyrant against the will of the people. That man who did that. The reason a mob of trump supporters stormed the capital, concussing police men, and beating them with their own weapons, is because the official mechanisms of power failed trump thanks to man like Jeffrey Rosen. I have to handed him. Richard donahue, they did the right thing. If the department of justice sent that letter, and the Georgia General Assembly calls a Special Session, since electors for Donald Trump to washington, then there wouldnt be a mob. The man who colluded with Donald Trump on this coup should be disbarred. No one should ever hire him again. He should face eternal public shaming, jeffrey clark. He is insane to let this man, jeffrey clark, get anywhere near any institution in this country that matters at all. He aimed a nuclear weapon at the United States democracy. There have been little to no consequences for anyone involved in this whole disgusting affair. Unless there are, they are going to try again. They came very close last time. They came very close last time. Charlie savage is a Washington Correspondent for the New York times and coauthor and suing then he plotted with trump. Charlie, maybe kills a little bit about mr. Gaetz background. Whats striking here it is this is not someone who comes from a loyalist this is someone who comes up and is essentially in the mainstream channels of republican lawyers. Thats right. Up into pieces of thick going to be established lawyer. He went to harvard underground, between the federal society conservatives appeal act. Joined his Wifes Farm Kirkland analysis, and worked on environmental issues for the george w. Bush Justice Department from that perspective. The perspective of environmental regulations. Skepticism, they inhibit economic growth and was cut back to our authority narrowly. Respective to private practice and comes back to the trump administration. Also an environmental host. Its only in the second half of 2020 that he starts to in this role youve been describing. The civil division of the Justice Department. Then immediately, he starts to go after trumps enemies in court, that sort of thing. Still what you would think of the trump Justice Department to do. After the election, hes playing this role as the guy who is extremely interested in all these Conspiracy Theories about how trump won the election, or there was fraud, and it is undermining the active Attorney General Jeff Rosen as he tries to hold the line against a White House that is cruciate in the Justice Department to say the election was corrupt to provide the alternative reality that trump and republican allies can build a stampede to overturn the election results. When striking about the lawyer the letter we now have, trump is plotting around shaking the tree wherever he can. This letter lays out a french constitutional theory, but who, knows perhaps State Legislators are endowed by the power to contribute to electors. Its a roadmap very explicitly to these states with some sort of legal rationale from the department of justice. Not a single find me the vote saying hey, heres how you can do it under the authority of u. S. Constitution. Thats right. We knew the letter existed. There was a whole story that you showed earlier in the broadcast here, and weve seen the letter its quite striking. In days a roadmap. It causes us to reevaluate what was happening in late december. During that period the trump efforts to overthrow the election was of course before january six this was, it had a comic overtone. Things were outlandish. One thing after another would get knocked down. Republican judges were laughing them out of Court Giuliani Home improvements perth conferences with the four seasons landscaping forcing his hotel by mistake. It was ludicrous up until January 6th when it became deadly serious when we saw people being sucked into it in such a way. Now, for these stories go record, some of what they were doing makes more sense. There was an endgame. The endgame was to create an alternative reload in which there was doubt and the Justice Department said the election was corrupt. Thats all they had to do with trump and the notes you talked about, say its corrupt, i will do the rest. It reminds me a little bit of the first impeachment where what they wanted from ukraine was an announcement of an investigation into biden. Perhaps more than the actual investigation, The One of the statement that they could then run with. The state of the election was corrupt to push republicans in the legislator to send different electors to washington and perhaps create momentum for an olympic to. All that dust is being kept in the air and it makes more sense chris. Charlie savage. Youve done Great Reporting on this. Thank you. Appreciate it. Thank you. For more on this over attempt to overturn the election im joined from Claire Mccaskill and Stewart Stevens Willd Stewart Steven how the Republican Party became Donald Trump. Clare, let me start with you. I read this letter a Bunch Yesterday when it came out. It kind its a my breath away, i think if it didnt come out theres odds it wouldve been such a scandal, that related precipitated a backlash, greater than its a fact. But, its a Coup Attempt in black and white. That came pretty close. Chris, as i read the letter, i kind of got sick to my stomach. Because this was a lawyer at the highest level, of the department of justice. In what he laid out, there as a lawyer, is so offensive. You have to remember, for lawyers, really the law is a slave to evidence. The law has to serve only in the context of factual evidence. Whats really stunning about this letter is theres not one drop of evidence in. There is not one solid obligation of anything. We know the bar, which is in the Hall Of Fame of trump lackeys, the Attorney General, had said clearly, there was no fraud that wouldve impacted the results of the election. You had the Attorney General, who had done everything almost that trump wanted him to do, including overturning guilty pleas, of other trump lackeys. Really bizarre outrageous things. Him saying, there is no evidence, and this guy writes this letter. I have just one question to the lawyers of america. Are we gonna let this guy to continue to practice law . Is he going to be allowed to appear in front of courts as if he has some respect for the Rule Of Law . Or for evidence. I really, it is really astounding to me that he has not been called up today, im charges in front of the bar. Stewart, i think the kind of optimistic take here, and its a serious one, is that in the end, Jeffrey Rosen in donahue, to their credit, fought against it. They created this sort of pack to resign. They went alone. This today, this was also turned over to the oversight committee. Deputy Attorney General, saying basically, this is the kind of dead man switch, that this evening, after acting Attorney General over the course of last, week repeatedly refused the president s direct instructions, to utilize the department of Justice Law Enforcement power, for improper ends. The president removed him from the department. Rich donahue and i resign immediately. They had that ready to go. And to their credit, that was whats stood between, but my concern is the admixture, in the current Republican Party. Of Jeffrey Clarkson Jeffrey Rosens. Look, im not the guy to come to if youre looking for an optimistic view of this. I think its simple when they want to do. They do want to overthrow the electoral process and as we know it. So it happens to this guy . He tries, it comes close. He fails. He goes to a pushy job. What are they going to do . Theyre going to sit there and try to refind their arguments. They try to build more legal theories. And theyre going to come back. You dont see an ounce of remorse here. No one has apologized. And its always the people you never thought about. Who are up for doing the unthinkable. Thats with this guy is. He has a completely structure that supports him, its well financed. Theyre very patient. And they think theyre going to win that Point George just made, is its so true. Theres two kinds of, schools in Mainstream Public Rip already, there are people that are embarrassed by and dont want to talk about. The mitch mcconnells of the. World to filibuster the january six commission. And then theres people who actively plotted inner just out there floating around with no repercussions. Theres a tiny group of people, lindsay cheney, adam kinzinger, say this is, wrong we shunted on. This but by and large, its either denial or cooperation. Well, first of all we have a couple of things working in our favor. I hate to inject a note of optimism here, but we have a couple of things working in our favor. One is the Republican Party is shrinking. There is a chunk of the Republican Party, that agrees with liz cheney. And agrees with Congressman King zinger. And so i do think, that electorally, we are not in a horrible position. The other thing is we have to remember here, Trump Appointed judges, laughed his lawyers out of the courtroom. When they tried to go to the courts to get redress. And so we have to remember, we have this Balance Of Power between the Executive Branch in the Executive Branch in the judicial prince. So far, on some things i dont like with the judicial branch is done. But in terms of this election, they did the right thing. And they said, you dont get anything if you dont have evidence. You know what, its interesting, whats fascinating to me about, is that Letter Isnt and run around the, courts the reason its in and run around the courts is that its a soft underbelly, State Legislators of the Republican Party. Who are most radicalized and most for lack of better phrase, down to clown. And thats why, thats whats so dangerous about that letter to me. When i pLay Out the cascade of affects that may have happened, hadnt been released. You Cant Look at this letter in isolation. You have to look at it as one step in a process. And what else is in that process. Well what are they doing. Theyre out there trying to make it harder for people to vote. Across the country theyre doing this. In a very methodical way. This is not just a random guy who went out there and went rogue. He is supported by what is really the majority of the Republican Party, establishment now, and you see it reflected in the State Legislatures. In your one signature away, from something close to a successful coup. Claire mccaskill, and stewart stevens, thanks for getting your perspective on. This really appreciate. It if youve been watching our show it all over the last few, months you know that if we have nbc Scott Mcfarland on, there is a huge or bizarre update on the cases against the january six rioters. Scott is here tonight to explain why a jailed member of the proud boys got a sudden windfall of 1 Million in his bank account. A mysterious cash influx, and with the doj has to say about it, next. With the doj has to say abou it, next it, next detoxifies below the gumline. And restores by helping heal gums in as little as 7 days. Crest. The 1 Toothpaste Brand in america. Since the January 6th insurrection, prosecutors have filed charges of gains more than 500 people. In at least 30 of them are members, or associates of White Supremacist groups. Including this guy, a 30 year old ethan nordean, a selfdescribed sergeant in arms for the proud boys. Who goes by the elias, reveal pan man. Prosecutors say that since hes seen here inside the capitol, helped the proud boys hatch a plan, to break into the building as many points as possible. To stop the certification of the election. He is charged with six counts, including conspiracy. He has pleaded not guilty to all. He is still in jail, pending a hearing, and federal prosecutors want to keep him there. Especially because, he formally worked at his dads restaurant, has apparently come up with almost 1 Million dollars to offer as bail money. In a filing yesterday, the Justice Department warned about nordeans apparent influx of 980,000 to offer is a secure, bond and added that the defendant has not offered a Court Information about the source of this funds. In the windfall raises more questions about that it resolves. The reason we know about his million dollar offers thanks to the hard work of Investigator Reporter Scott Mcfarland who joins me now. Scott, Lay Out his case here. And then what the doj says about the fact that he now has access to these funds to bond out. Hey chris, theres been thousands of pages of Court Filings in these cases. This is why we try to read each one. It was the final paragraph, the final page of the Justice Departments latest filing, where they raised this concern, about his quote, sudden windfall of 1 Million dollars. We worked backwards, and saw a few weeks ago, he did offer 1 Million dollars secure bond, or a home, in exchange for his release from jail. The prosecutors call that offer a gilded cage offer. They say it does raise questions about his power, and his continued clout. They are asking the court, where did he get this money . So eject. We talked to his Defense Attorney tonight, who says the money was raised by family, they say the prosecutors know that, and the court soon will. They did not go into any more detail. In the Justice Department declined comment a few moments ago. But here we are. Nearly seven months since the insurrection. And even nordean is still trying to fight to get out of jail, until trial. Thats an Indication Chris of where these Farright Group cases stand. The Oath Keepers. The proud boys, three percenters. We have a few Plea Agreements, but generally speaking there is a long whiting legal road ahead. Yes, so weve talked about the categories, here in some of the dispositions of some of the cases. Please in very little jail time for folks who were in the more Spur Of The Moment category, lets say people who went into the capital, in the category of people that the government is alleging plotted, this planned this and executed it. He is in that category. According to the governments case. Yes, chris the charges conspiracy. For him. Thats the same Charge Face by other proud boys. The same Charge Faced by other accused Oath Keepers. Theres been a few Plea Agreements from Oath Keepers. To Conspiracy Counts and theyve agreed to help the investigators. The federal prosecutors. Thats what were waiting for. Earlier this week are reported that the proud boys cases might be cruising closer to Plea Agreements, according to prosecutors at hearings. Will the feds secure, or even seek Cooperation Deals . From the accused proud boys . We have some indications that maybe in beginning in reporters on monday that there are some early talks. It does not seem like we have anything is far along as the Oath Keepers were actually going to look like were gonna get some please. Scott has been doing fantastic work on this is always thank you. Let our Injury Attorneys help you get the best result possible. We have been marching the Barnes Firm Injury Attorneys call one eight hundred, Eight Million republican politicians and legislatures stir the media put the frenzy about coronavirus. Amongst the frenzy, its easy to lose sight about what critical Race Theory is about. Partly because its complicated. The way i think about, it is a debate about how central we think race, particularly anti black racism is to american life, and into today. That is the debate we are having as a society. I thought it would be a good idea to show you some data i think is useful. Is racist Side Story in america or an Essential One . This comes from a brief Publication Study in the health affairs journal. It looks to increase and mortality rates amongst people during the pandemic. Covid disproportionately infected people of color. Black people died 1. 4 times at a rate to white people. Indigenous and hispanic people that are the high rate of white people as well. New data breaks it down further. This graph shows the increase in death all coaxes mortality from the second quarter of 2019 to the second quarter of 2020. Thats about three months into the pandemic, right . The first grouping up bars on the left side of the screen shows the increase in deaths for 100,000 people among uninsured people. People who dont have Health Insurance who you think would have a high rate. You have Uninsured Hyundai hispanic people, yellow. Barr Numbness Pennock others, nation, islanders, and nonhispanic white people in blue. Hispanic, asian, indigenous people, and now youve added in the last group. Black americans. Its represented by the Teal Bar. Look at that. Deaths among uninsured black people went up three times more than uninsured white folks. Lets look at injured people. See that . See the Teal Bar again . Similar. Does some ensured Black Americans increased five times more than a month ensured white people. You were better off being an uninsured white person, then being a black person with Health Insurance. What about income . Maybe this is an income proxy effect. How about when you break down income . This is for families who are below the federal poverty level. 26,200 for a family of four last year. You see the Teal Bar . Way above the others. They asked increased six times more among poor black families, then poor white families. When you look at families making up to four times the federal poverty level, that is middle class families. Guess what . Basically the same story. Thats up five times more among black people than white folks. Even in the middle, class families making over 100, 000, more than four times the federal poverty level, there was a five times greater increase in deaths a meng black people than white people. You are better off being a very poor white person then a middle class black person in terms of your risk of death during the pandemic. Another way to break it down is whether or not you can work from home. There is a bigger increase in deaths among people who could work in person versus people who could work from home. Look at what happened to mortality. Black folks who could work from home, eight times greater increase among white folks who could work from home. For people who have to go into their places of work, thats among black people increased more than three times. Once again, you are better off being a white person who had to go to an Inperson Job every day, for the first two months of a pandemic, then a black person in the option to work from home. N the option tacross all these b categories, one thing remains constant all those really tall Teal Bars, towering over a bunch of small ones, those are Black Americans dying at higher Rates Snowman or how you slice a day. What you are looking at there on your screen, when you look at these grass, if the ubiquitous of race, particularly structural racism against black people that has existed in this country since before its founding. Thats produced the conditions of the population in this country with a more no idea wet any races. Because of all the population has been subjected to through the years with segregation, disposition, leading to black people living in places with worse Air Structure and having higher cases of morbidity. This is what it looks like when antiblack racism is the central story in this country. These Craft Show what that means, in a tangible sense, for arguably the most important thing we have for all of us. Which is how long we get to say on this planet. Boom. Boom scott aptly was the kind of person who makes up the backbone of state political parties across the country. You can find him in any. State Hes Estate member of dickinson county. An official in the galveston county. He was active in local politics. He frequently we posted bible versus and sunday, Scott Amply was admitted to the hospital he was diagnosed with covid. He said come to the disease earlier this morning. He was 45 years. Old he leaves behind a wife and an infant son. Texas Republican Party put out a statement celebrating our Pleas Life offering prayers for his family. It is notable the statement doesnt mention the circumstances of his death. Thats because, in this bizarre ultimate reality thats been constructed in some corners of the american right in the pandemic age, you cant admit that covid is out there and that is dangerous, deadly, and leads to awful tragedy. Weve seen this before. Former republican president Herman Cain died from Covid Complications after we talking about talking during trumps campaign. Trump never talked about his death online. He Cant Talk about. It Ron Wright died when he contracted the virus at the age of 67. The texas gop announced a statement on his desk of death i didnt talk about covid. There was also lucas letlow who passed away from covid at the age of 41, and it was weeks before he was eligible for the vaccine. Just days before he shouldve been sworn into congress. His widow, Julia Le Clos took a seat in congress and now, seven months after his death, she is urging others to get the shot. Someone asked me, would you tell somebody who is on the fence about possibly receiving the vaccine . I said, i would tell them about loop. I would tell them my story. I wouldve given anything i wouldve given and everything for that shot to be available for us. Looking back now, and for someone to turn in a way its just heartbreaking to me. It is a horrific way to leave this world. I dont wish it on anyone else. We have the answer. Lets use it. Its so important for folks like Congressman Letlow to come out and to tell her story and endorsed the vaccines. We are seeing more of that. A lot of it from political leaders has been put out with regrets. They didnt say anything for a long time some of them and are now staring into the abyss. That includes Whats Congressman Asa hutchinson. The quandary for him coming up next. Next sadly, not anymore. Wow. So sudden. Um, were not about to have the we need Life Insurance Conversation again, are we . No, were having the were getting coverage so we dont have to worry about it conversation. Thats cute, but my internet streams to my ride. Yeah, well mines always got my back. Okay chill, cuz mines so fast, No One can catch me. Speed . Well show you speed. Wow thats nothing. Because my internet gives me a flex 4k Streaming Box for free. Impressive thats cuz you all have the same internet. Xfinity xfi so powerful, it keeps oneupping itself. Arkansas just reported its can your internet do that . Largest daily increase in covid cases since the start of the pandemic. A nearly increase of 70 Cases Percent encases. They have regrets that they hadnt last man needs a neighbor. I sided at the time because our cases right a very low point. I knew it would be written by the legislature if i didnt sign it. I find it because our cases were at a low point. In hindsight, and with that it had not become law. It is belong on the only chance we have is either to mended or for the court to say it has an unconstitutional foundation. Governor hutchinson is now asking State Lawmakers to reconsider the Mask Ban to their local School Districts can require masks for kids when classes start up in a few weeks nearly 20 of the state of arkansas covid cases are among children under 18. You would think with numbers like, that Governor Hutchinson could convince the State Legislature to overturn a band but, its easier said than done when you look at the kind of response the governors getting when he goes to Town Halls across the state. I would love to have one person who wishes to speak from the corner. Whats in the vaccine . Give me the sheet . So, you tell me what you put in my body. If mr. Doctor gives me a violence is trust me. You give me a while, you trust me. Whats saves lives, governor . Its not the vaccine. We know about therapeutics. Thats a pocket cal challenge, brought about a large mound of people on the right to pedal Disinformation Whove been pushing for eating freedom over paul, you are about florida. And something im thinking about a lot. Theres two ways of viewing the response to covid and ideological terms. Id like to get your feedback. The best response in the state, the country, arguably, is other republicans doing. Well is there an inherent part of conservatism and its skepticism of regulation of negative externalize that have made it so wedded to this bizarre freedom of the grave on things like masks and social distancing . Or is it a kind of Fluke Disorder Version of conspirators and we have now . Which do you think it is . Actually, neither. The lesson im taking, the revelation for me has been, it is not even an opposition to regulating negative externalize that ventral of something like climate change. Whats striking about the republican response here, in places like florida, is that in fact, they are oh into regulation. Whether it has told us for decades, businesspeople should have the right to make their own decision. If they want to deny service to someone based on whatever criteria, sexual preference, race free marketing they have the right to do that. It turns out suddenly that its not okay. Its illegal for business to do lie services to someone who refuses to wear a Mask Or Someone who refuses to provide evidence of vaccination status. Its this whole freedom free Market Thing that is not whats kerber. These words then dont mean what we think it does. Theyre talking about something different and my guess is its privilege. Thats the most amazing thing the free Market Rhetoric and suddenly when businesses choose to do something responsible about a pandemic, all of a sudden no, were gonna crack down a business and force them to go the way we want them to. It has been a kind of problem and impeachable moment. Its been a fraud all alone. Good point when they had far worse then desantis signed an Order Banning Cruise Ships from requiring vaccination. This is a purely logical thing. You will pack vaccinated people on your cruise ship. This is a twofer. Its hard to think of anything more them and not taking precautions on a cruise ship. You Cant Think of a worse environment to not taking proper precautions. Whatever happened to the right businesses of the private sector to make its own choices . All of a sudden you have this draconian service of death which is an amazing thing.
