Yazmin, the letter from the Westchester County District attorney asking for materials, things like transcripts, et cetera, to see if they should be pursuing some kind of Criminal Investigation. Launching a Criminal Investigation as of yesterday, this is wideranging. It is really a huge development in this story thats taken place over the last 24 hours or so, since the Attorney General revealed her investigation the 165page Report from the president on down, asking for the resignation of the governor, President Biden, Speaker Pelosi, Senators Schumer and gillibrand. The governor of states surrounding New York from the governor of New Jersey to connecticut to pennsylvania to rhode island, and then the State Assembly just yesterday holding a closeddoor meeting, hallie, to discuss the implications of this major report from the Attorney General, deciding whether or not they should move forward with articles of impeachment. I spoke to a new York State senator who would be part of the Senate Trial to ask if he felt as if the governor should resign. Heres what he had to say. He thinks the world revolves around him and when confronted by allegations like this the same behavior, deny them, saying its all politics and play the victim. Youve got twothirds of the state senate, most of the assembly, the lieutenant governor, the Attorney Generals report, President Biden, nancy pelosi, Chuck Schumer the delegation saying its time to go. The writing is on the wall. He should go. Reporter state . The State Senator melnick will be part of that. Its been just over 100 years since a governor was impeached. This could take up to a month for the State Assembly to draw up these articles of impeachment. A trial could not begin, would not begin likely until september or october. The governor continuing to deny at this hour all the allegations leveled against him so far. Yasmin, posted in albany. Rebecca, the letter that we exclusively obtained the District Attorney writes i believe it is appropriate for my office to conduct a further inquiry to determine if any of the reported conduct that is alleged to have occurred in Westchester County is Criminal In Nature Mimi Rocca Looking for allegations related to a new York State trooper, something people followed this case since it broke yesterday around this time know about, initially assigned to the Governors Detail at his home, allegations made in this report about inappropriate behavior from the governor towards this state trooper. Can you talk to us, rebecca, about the significance of this, the potential now for this investigation seeking any information about whether what the governor did was criminal. Sure, the Attorney General of New York has limited criminal jurisdiction. This is the role of local d. A. S to look into this and as Attorney General james said in her Press Conference, this is laid out, if theres any information that a District Attorney wants, we are happy to share that information. Thats whats happening here. I think the vast majority of the conduct described in that report is really civil in nature, but if the governor did forcibly touch an individual with the intent to degrade that person or for his own sexual gratification that is a misdemeanor in New York and it would be appropriate fort District Attorney to look into that. With caution its important to realize theres a reason why our criminal system is much more difficult to go through than the civil system, so that would present a lot of burden on the prosecutors to show Beyond A Reasonable Doubt that this was his intent and what actually happened. Kate, new this morning, you had a chance to speak to at least one of the governors Aus Coupers about his response to all of this. I speak with charlotte bennet, she was 23 when she joined the governors office. He handpicked her to be his assistant. At first, everything was fine but after she told him she had been a survivor of sexual assault, previously, that their relationship got more personal. He became inappropriate, she says and even propositioned her for sex. Yesterday Governor Cuomo specifically Singled Out Charlotte By name and apologized to her but also said that she misunderstood, essentially that he was never trying to be inappropriate. He was trying to help her. I asked her about those comments from the governor. He is victim blaming, and hes also making a really insulting and painfully inaccurate insinuation that someone who is traumatized from a past experience Cannot Discern the difference between mentorship and sexual harassment. Its upsetting. It is upsetting, and its disturbing that, even after months of investigations, he still cant accept the facts that he knows are true, and instead would use my background as a survivor and an advocate for survivors as if that means i cannot understand when im being sexually harassed. Im not confused. Its not confusing. Several of the accusers have said they felt outraged when the governor said things like i never touched anyone inappropriately at that famous march Press Conference earlier this year, hallie. Rebecca, Let Me Go back kate, thank you. Its important i think to hear from some of these women. Rebecca, we showed a moment ago the immense pressure that the governor is facing now. We showed a bunch of headlines from New York papers, for example, from the network of Usa Today papers basically saying youve got to step down. Time for Andrew Cuomo to resign. He has made extraordinarily clear, as you heard charlotte, for example, allude to in the interview with kate, he is not going to do that. What are the next steps here . Where does this go at this point . I know you laid out the next maybe four or five things that might happen moving forward. Right, so i mean, there are a number of possibilities here. We touched on some of them. One is the impeachment process, which as you said, it is a long process, a bit arcane. There isnt much precedent. Its Time Line is a little bit hard to tell. Theres also the possibility and i think likelihood there will be civil lawsuits that he will be forced to defend against. Theres a whole trove of information in that report, and i imagine that the individuals involved will want to bring civil suits claiming that they have sexually harassed, under either federal Law Or State law or both, and you know, then of course there are political repercussions, if he refuses to resign and not impeached, will he be voted out . So there are a whole number of possibilities about where this goes, and many of them can happen at the same time. So kind of remains to be seen. Does his response so far, do you see, rebecca, have any impact on the potential legal or civil liabilities he could be facing at this point . You know, i think his defense is, as you said, and as others have said, somewhat problematic, and you know, hes in a difficult position, because these allegations are strong. They are strong because there are so many of them. They are detailed. They are consistent with one another, and with what others say about the nature of that office, and theres contemporaneous corroboration. If hes going to launch any defense, he needs to say a number of things. The problem is hes said contradictory Hodgepodge Group of things. One i didnt do many of these things. Hes trying to skirt two things, im sorry and i didnt do it, which really makes people extremely angry. Its not a truthfully apology. New this morning, lawyers are former President Donald Trump are asking a federal judge to block the release of his Tax Returns to house democrats. The Ways And Means Committee wants to see them and the Justice Department has said the treasury has to hand them over. Justice correspondent Pete Williams is here. This is developing this morning. What do we know and what does it mean . What they say is the congress had no legitimate reason for asking for the returns, that the democrats had been making it clear ever since the campaign that they wanted trumps taxes and came up with basically a reason they wanted to see how well the irs was auditing president ial Tax Returns, but they say that cant be right, because first of all, the irs has never asked for the returns of any president , former president or indeed any elected officials, nor the Trump Lawyers say has the committee on ways and means which asked for the records ever asked the irs how it audits former president s. Congress has no General Authority to go rooting around in the private papers of individual citizens, the Trump Lawyers say, so without a legitimate legislative purpose, this request must be denied. Now, just last week, the office of legal counsel, the Justice Department reversed course from an opinion it issued in 2019 and said that congress has to be respected here, coordinate branch of the government and basically you cant look too far behind the congressional stated reason behind wanting the returns. The law says if any of the three congressional Tax Writing committees ask for the Documents T must get them. The Trump Lawyers call it wobbly justifications and Shallow Reasoning and they say of course the request comes under President Biden, a democrat, who Ran Against President Trump, and made the disclosure of President Trumps Tax Returns a campaign issue. So the lawyers are asking the judge, number one, block the irs and treasury from handing over these returns and while youre at it, they say, tell the committee that it cant any more investigate President Trump or the companies for which it asks for basically six years of these returns. So the Justice Department will respond to this, and then the judge will decide what to do. Any Time Line on that, pete . The Justice Departments response is due today. Relief may be on the way this morning for millions of americans who are facing the possibility of eviction, after that big Pressure Campaign from some democrats. The cdc announced a twomonth extension to this moratorium in places with high or substantial transmission of covid19. But how long this moratorium will last might be less than that, with this Move Setting up a potential class with the Supreme Court. Still youve got some democrats celebrating this win, after a Movement Led by this woman, congresswoman corey bush, slept outside the capitol three nights and shared this moment with elizabeth warren. Does It Matter that im here instead of Somebody Else . Youve now answered that question. You see the congresswoman reacting to the senator telling her It Matters that you were here. Right, we had been hearing for days from the administration, from the White House that their hands were tied. There was nothing else they could do based on the Supreme Court ruling, that said you cant indefinitely extend this Eviction Moratorium, we need action from congress. Backandforth days of finger pointing. What we heard Last Night, late Yesterday Afternoon was the administration Coming Up with what they think might be a legal workaround for that, saying that this would be a more targeted Eviction Moratorium that would only apply to areas that are seeing substantial or high spread of the coronavirus, but because of how widespread the Delta Variant is right now, that essentially applies to about 90 of renters who would have been affected by this. So essentially extending this for millions of people. You raise a question about whether or not all of this is legal, and there was an interesting admission from the president yesterday, when he addressed this. Yes. Reporter saying it might not be and a lot of legal scholars who say this Workaround Wont be upheld by the courts but essentially, it will buy people some time to stay in their homes, and longterm, the White House says the solution here is not just a chipbychip of extending out the Eviction Moratorium but the rental Assistance Part of the covid relief packages, want those billions of dollars to get to actual renters or landlords, and theyve been trying to increase pressure on state and local governments to help release those funds. Theres a lot of bureaucratic processes that are holding that up. Theyve been trying to make it simpler for renters to qualify for those. Thats the longterm solution theyre pushing for. Full approval, rather than emergency authorization, could be a big deal for these efforts to get more people vaccinated. Health experts say it could kick off a wave of Vaccine Mandates across the country. Some places are not waiting for even that. Talk about whats happening there . Reporter so the governor has been very clear that there will not be any sort of Vaccine Mandate in this state, even though you have obviously a large employer in tyson, making that decision for their employees, but the governor here, Governor Asa Hutchinson is calling a Special Session to try to reverse legislation he signed just a couple of months ago that largely banned Mask Mandates and asking the general assembly to amend that to make it possible for schools to enact Masking Rules if they want to. The governor has been holding these town halls, he calls them covid conversations, all across the state, trying to get people to get vaccinated. He had one in Northwest Arkansas not far from where we are, just a couple of days ago, and when he was talking to residents in asylum springs, the hospitalization in the state is very real and serious and urging them to get vaccinated. Through all of that, he was mocked, he was heckled, he was called a liar. Vaccination rates in this state, they have started to pick up of late but it is not as high as the national average, only about 40 of people 12 and up in this state have been fully vaccinated. This week, on monday, they saw the largest increase in covid hospitalizations since the pandemic began. Hospitals here are really starting to feel the pressure. There are a number of hospitals in this area that are at capacity, or very close to it. The nurses, the doctors, the respiratory therapists, they are working overtime to try and keep up with the influx of Covid Patients, in addition to their normal patient load. I want to you listen to what one of the local doctors had to say and specifically what she is trying to tell members of her own community. We love our patients. We still want the best for our patients. We want the best for our community, but we are tired. I dont think any of us know the right words to convince those that will not get the vaccine. Please trust us. We only want to help you. We do not want to harm you at all. Reporter hallie, i spoke to the ceo of one of this states largest ambulance providers, and he told me normally they maybe would have one ambulance diverted from a hospital in a day, statewide. When i talked to them in the two hours before, he had to divert ten ambulances. Hospitals here are at capacity, and officials say if something doesnt change soon, they are very worried about where things could go in the coming days and weeks. Hallie . Ellison, thank you. Dr. Patel when it comes to the fda, dr. Ashish zha said he hasnt sensed a sense of urgency. Do you think the fda could be moving faster and what kind of a difference would full approval make . Its the right question to ask. Full approval will make a difference. I dont think it will be as much as some expect. I dont think well see 50 Million americans wake up and decide to get vaccinated but it helps with the mandates and local officials, et cetera, even the federal government to keep a tailwind behind the emphasis on vaccines. To dr. Jas Point I Cant think of a more emergent time for the fda to act. While i would have loved to seen approval yesterday, i dont think theyre sitting around debating issues. I think they have an acting commissioner, incredibly smart people who have been there for decades, but theres no question, this is also a novel process for the fda, and what we need to do is probably think about what do future approvals for boosters and for different formulations of an Mrna Vaccine Look like. We need to think about future approvals, what the implications are and hallie, i got news for you. As soon as the approval comes through well see a flood of americans showing up to my office, to pharmacies around the country asking about booster. Joining me now, somebody that doctor treated, Kristy Carpenter and daughter kayla carpenter. Kristy, you yourself contracted covid, your son, kurt, also did, and passed away from the virus. Thank you both for being here. Im so sorry for your loss. Kristy, tell me more what happened when you realized both of you had covid . My daughter contracted it, too. She was diagnosed on march 3rd, i was diagnosed on March 4th and son march 5th. A week later, kayla started feeling better and she, we decided that i needed to go to the Emergency Room to get fluids to pick me up. I felt dehydrated, since i had been so nauseated and we went from the time that i walked from and not had any kind of shortness of breath at all, from the time that they arrived and took me from the Waiting Room to the triage room, which only took about 20 minutes to wait, i couldnt catch my breath and My O2 was down in the low 80s. Wow. So they decided to admit me. My daughter came home that Friday Morning from the hospital had to get sleep because she had been released to go back to work that night. She woke up a little bit later and to get ready for work and check on her brother and found him laying on the sofa. He couldnt really speak. He just kind of moaned, and he had been walking around talking to her that morning when she got home. Right. She called 911, when the firefighters and paramedics got here, his o2 was in the 50s. It can literally happen that fast. He was taken immediately by ambulance to the Emergency Room and i was in the hospital on the 12th Floor and they admitted him to icu on Friday March 12th. By that saturday, they had to put him on a ventilator, and after being in the hospital 51 days, he passed away may 2nd. Im so sorry, kristy. I cant imagine the pain and im sure the anger that youre feeling and kayla, you as well. Can you talk a little, i know with this time lin, early march, vaccines had been starting to roll out. Kayla, talk about why you and your family were hesitant to get vaccinated. I know its been said to kurt in his final moments said something like, this is not a hoax. This is real. Right. So vaccines coming out recently right before we were diagnosed positive. We were hesitant because on the outside it looked like the vaccines were developed very, very quickly. However, after research, after we became positive and now we know they have working on something for years that they had to find the right things for covid to add to that vaccine. It wasnt available to us quite yet especially kurt. Im only 22 years old. He was 28, so we were considered the healthy ones anyways. So none of us were even eligible to get the vaccine by the time we were diagnosed positive. Kristy, i wonder what your message is to others who may be feeling some hesitation now and whether if kurt were still with us today, you would be vaccinated at this point. Right. I had to wait until the Mull Mondayologist released me to be able to be vaccinated because of the damage from my lungs and my daughter just recently had some surgery herself, so she had to wait from having covid and from surgery, to be released. So we actually had our first vaccine a week ago, so that was an exciting day. You see the pictures. But if kurt had been eligible to get the vaccine, then we would have. We were still hesitant but the timing was bad. We werent the fortunate ones able to get the vaccine before we were diagnosed, and that now that it is available and so easily to get, thats why we encourage everybody to get the vaccine. Were not judging anyone for their choices. It is a personal choice and we totally understand that, but knowing it now and seeing everything that we have been through, and watching my son suffer, why wouldnt you want to get the vaccine and try to keep that from happening. You know, were on this mission. Im calling it kurts mission, to encourage everyone, because we dont want anyone to have to go through what weve been through, and what kurt went through, especially being a healthy 28yearold, no underlying Health Conditions when he went into the hospital, none. I mean, you see that smile. Yes, thats right. Huge smile. Very happy. His hugs were just as big. Kayla, i want to ask you in the time we have left here, in a sentence or two, how do you want your brother to be remembered . I want to be remembered as a person that would go out and live life to the fullest. He was the biggest social butterfly i knew, so i want everybody to remember to think like kurt and be positive like kurt was. Kurt was a very positive person on life and always did everything to the fullest. Kayla carpenter, Kristy Carpenter, i appreciate you for coming on and sharing your story.
