Structure bill for a month now after they reached an agreement on what they called the basic framework of that legislation. One month ago, in a meeting with President Biden at the white house. There they are after that meeting up there in the white House Driveway and now its not unusual at all for it to take at least a month or more to figure out the details of such legislation after youve established a general shape of it and then get all of that into precise legislative language. And after a weekend of work, it seems like today it might actually be the day that the bipartisan group could bring their bill to the Senate Floor through Majority Leader Chuck schumer and begin debate. Here is what the lead republican negotiator Rob Portman said yesterday. Were about 90 of the way there, with a legislative Language And Staff and i feel good about getting that on this week. We have one issue outstanding and were not getting much response from the democrats and its about mass transit. Our Transit Numbers are very generous. We increased transit in this proposal and we increased the formula going forward thats the one issue thats outstanding quite frankly at this point and will see progress on that today. If true and that was true than Rob Portman was right. To be confident yesterday that they would have a deal by today but the first thing this morning as democrats and republicans seem very close to reaching a deal, Donald Trump delivered a message to republican senators in a public written statement saying dont do the Infrastructure Deal. And as the day wore on with no progress in the negotiations, this afternoon senate Majority Leader Chuck schumer lied to the Senate Floor to try to energize the process. I want to be very clear, and fully committed to passing a bipartisan Infrastructure Bill. As a Majority Leader, i have the ability to move in reconsider the vote and begin debate on that bill this week. But Senator Schumer had to acknowledge the new voice in the negotiations today. Just this morning, former president released a statement urging republicans to retreat from all bipartisan negotiations on infrastructure. Until after the midterm elections in 2022. It may be longer. Again, the former president said this morning that republicans are weak fools and losers. His words, for even talking to democrats and suggested that the republicans should not negotiate it all unless there in the majority. Fox news personalities following his lead are now encouraging primaries for republican senators who support a bipartisan Infrastructure Deal. We always knew this was coming, as soon as the bipartisan general agreement was announced a month ago, we noted than that it would seem very easy for Mitch Mcconnell or Donald Trump to just pull away one or two republican senators and destroy the 60 Vote Majority needed to pass the bipartisan bill. The only surprising thing about this is that Donald Trump waited until the very last minute to try to block Joe Biden from doing with Donald Trump could not do. The Trump Presidency invented the phrase Infrastructure Week, and then they never had a single Infrastructure Week of any kind. Donald trump seems to be accurately calculating how devastating a Humiliation It will be to Donald Trump if Joe Biden manages to pass a bipartisan Infrastructure Bill of any kind. Chuck schumer has the most difficult job in the senate, which is a place filled with difficult jobs. When most senators are simply too discuss the comments about a situation, they dont have to. When a Majority Leader is stuck saying what must be said and what must be said for the record, what must be said for whoever out there and the country might Need To hear it and that means the Majority Leader sometimes has to say things that make them keto to look like a pessimist. Things like this. Republican senators must ignore former President Trump if were ever gonna make progress for the american people. Hes rooting for our entire political system to fail. Yeah. He actually saw that. Republican senators must ignore former President Trump. As if thats possible. The politics of governing require public optimism. You must always be publicly optimistic until and unless all is lost. No one knows that better than Joe Biden. Mister president , are you confident that there will be an Infrastructure Deal with a bipartisan Infrastructure Deal . Joe biden and Chuck Schumer have both known all along that the bipartisan deal could come apart and Crash And Burn at any moment and that is one of the reasons that they are moving a democrats only Infrastructure Bill on a separate track and are ready to incorporate whatever it can be salvaged from the bipartisan bill into the democrats only bill if thats going to be the only bill that will pass so the democrats have a legislative fall back position to their democrats only bill. The republican Fallback Position is nothing. They will deliver no Infrastructure Improvements to anyone anywhere in the country. They will not tighten a single bolt on a single bridge. Not one. The republican Fallback Position is to fully embrace Donald Trumps description of them today as weak fools and losers. Leading off our discussion tonight, jim mentally, a 21 Year Veteran of the senate who served as an adviser to senators Harry Reid and ted kennedy, also John Heroin an msnbc lash will Affairs Analyst and host of the Hell And Highwater podcast from the recount. And jim, at 21 years in the senate you have roughly three times my experience in the senate. So you are the senior senate voice tonight. So we deferred to you on all of this and so where do you think we are on this recognizing that whenever a bill is going to pass by just one boat its always near death until it passes and its always near death until it dies and so its very hard to tell. Here one of the problems we have is that we have too many pockets trying to have to figure out where this thing is going to land and im trying to figure out a way to say that this Bill Isnt dead, and its not dead but its got a lot of work to do to get ready from Prime Time and as you know just as well as anyone else, theres a real problem with the clock ticking up because once we go down this process, assuming that they can its going to take a week and two weeks to finish up the process before getting to the Budget Bill which schumer has not chance to do before the senate gets into recess so if i was a sad staffer i would be looking really concerned about my Vacation Plans for the end of august. And john, John Tester whos in the sick of the bipartisan negotiations said tonight that he actually expects a deal tomorrow morning. Yes, and lawrence i think its awfully hard to tell in these situations when something is just on the brink of death just before it passes or just before it fails, its hard to tell which is which. Its also the case that its often is hard to tell for some of the people inside the room as for those outside the room and i know youve been in those rooms to and i know jim has where you sit there and you get reads that are honest reads from people who are inside negotiations like this who are not trying to spin you and often they are but sometimes theyre not, and you get on his sources who come back and say i think its doomed, and those who say i think were gonna have a deal tomorrow morning. And the read in this tight negotiation can go in different directions. I think the main thing should talk about the difficulty of the clock if this thing gets done. I think the other difficulty through the clock which is ticked urban who said today which is something that you and i had talked about months and months ago which is the longer this process takes, the more difficult the politics get for democrats in the more opportunities that Mitch Mcconnell has to pick off the republicans and i think if theres a cause for pessimism, the biggest cause for pessimism is that this deal is not already done and the fact that its still sitting here even tonight with Donald Trump now leading in is the thing that puts it in jeopardy and its less likely that is going to get done in an exponential way not just in a litany are way. If that bipartisan deal falls apart and Donald Trump men just pick off one or two senators and whatever he needs to kill this thing than the republicans will have failed completely at what they appeared to agree to with the president and the white House Driveway a month ago. And Joe Biden and Chuck Schumer it seems have publicly positioned that republicans as the people who destroyed this bill. Absolutely i mean itll be fascinating if it plays out like that to watch Donald Trump and or Mitch Mcconnell undercut their fellow republicans, including someone who is close to Mitch Mcconnell. I have to tell you, lawrence, hes perfectly willing to do so if he thinks its for The Greater Good and hes more willing to undercut if he thinks he can score some political points heading into the next election cycle. And john ham, an infrastructure used to be the oldfashioned way of getting reelected. Whether you individually got an earmark to get that bridge of that project in your district or just in general you delivered your party and your congress delivered massive Infrastructure Spending and fusions around the country. That was always thought of Stage One Reelection campaigns for congress. So if the democrats managed to say, do the democrats only bill eventually and the republicans participate in none of that, how does the republicans go into the next congressional election with zero contribution on infrastructure . Well, i think number one, lawrence, its not clear to me that the politics of this if this bill fails, the bipartisan bills that the politics dont favor democrats for the reasons that we know. Joe biden is still sitting on a 55 Approval Rating with infrastructure. I think that theres a way in which this could still play to Democrats Advantage and its the way that you are now suggesting where the infrastructure is probably not going in the country. Democrats fail on the bipartisan front and they planted all on mcconnell and trump. They passed the democrat only bill, they take credit for it. I think that the only way that it works for republicans is they sit down for inflation which is really with the parties doing at this point anyway. Theyre praying that the beginnings of a significant Inflation Spike by the time he gets to the midterms and then they ride fear of inflation and all the traditional dynamics of the outer Power Party to be able to take control of the house for sure and the house likely but eventually the senate and theyre basically just saying theyre not gonna get reelected on the basis of what weve delivered and were doing this based on how we can scare the voters and how democrats are managing the economy. We have a Report Tonight saying that the bipartisan group has basically handed over the Negotiations Tonight to Rob Portman basically went on with Steve Machete and you couldnt ask for more experienced and Steve Machete in a situation like this to deliver this deal. Those to people if theres going to be a Deal It might be the ones who come up on it. Yeah i saw that lawrence and while i agree with machete, the problem i see and my initial reaction is that that does not leave any republicans with the exception of Senator Portland so in my opinion that allows republicans to walk away if theyre not at the table trying to negotiate this kind of deal. And again, Senator Portman is trying to negotiate deals in the Past And Theyve never really worked out so as they indicated earlier, hes very close to mcconnell and so if mcconnell wants to pull the plug on this thing, this is a pretty easy way to do it. The way i read the important thing and will find out tomorrow or maybe never find out which way this works is the other republicans just decided, you know whats . Rob is the one who knows the details im going home. You negotiated and then its more a matter of basically limits to Attention Span and lets just handed over to rob and look at over on the other side. Well that certainly the way that some of the psychic psychologists in this meeting works because sometimes you know i think jim is not wrong about this because not only does it make it easier for mcconnell will happily roll importantly and hes going to retire and theres no personal politics there, you can cut portman off at the knees and even on his own personal politics, nobody has any reason to care in some sense what happens to Rob Portman and so i think that he may be the best republican to deliver a deal. Hes also the easiest republican from the rest of the party to cut loose at this point. Hes a rhino and Donald Trumps eyes and one whos not running for reelection. Frankly, Who Cares . Now, you are in the Infrastructure Committee and the house. Youre watching this bipartisan Infrastructure Attempt in the senate which might be near death or might be near passing, we dont know which. Lets for the moment assume that republicans kill the bipartisan deal in the senate. What does that do to the democrats only process and the house and how much could you take from what is in the bipartisan bill and move it into the democrats only bill to get done within that bill . Well first of all, obviously hope the bipartisan deal is not dead. I hope that it goes through. Theres a lot in there that i do support and theres a lot that we agree on in our committee. And when we talk about when we push ourselves, so to speak, theres a lot that we agree on. And so i think the american people want to see is region bipartisan agreement. But if they dont, then were going to have to take it up as much as possible in the Reconciliation Package because this is really not an option for us, for infrastructure has been given a C Minus in terms of the greats have now. With the richest country in the world and we Need To have an enormous investment infrastructure. And some of these things, lawrence, as you know will not have been invested since the eisenhower administration. And so its time for us to play our role at the federal level of trying to create jobs, spread the economy, its the right thing to do. And its not really a want to, its a Need To. You would get the feeling watching the senate that infrastructure in texas is perfect and there are no needs whatsoever because i did not see the texas senators and the texas republican senators making any attempts to work on this bipartisan plan. No, theyre not. Its strange given that we just spent a week in the Stone Age here in texas with texans having to burn parts of their fences and breaking down their furniture and texans dying from Hypothermia And Carbon monoxide poisoning. So we obviously have to fix our brit. Up were on the fastestgrowing states and the country, lawrence. We have to invest in infrastructure. Here in North Texas, where one of the fastestgrowing cities in the country and you think thats not a bigger draw on our water systems, on our roads, on our Electrical Grid . We need that federal investment and as you said we should be running on it. We should be saying hey, i brought home the bacon for my folks. Im taking care of our state. Our next guest, dr. Zeke emanuel organize a joint statement released today by 50 major medical organizations, calling for all Health Care workers to be required to be vaccinated against covid19. Their statement said, our Health Care organizations and societies advocate that all Health Care and long Term Care employers, require their workers to receive the covid19 vaccine. This is the logical fulfilments of the ethical commitment, of all Health Care workers, to put patience as well as residents of long Term Care facilities first. And take all steps necessary to ensure their health and wellbeing. Nationwide, only 58. 7 of Nursing Home employees, have been fully vaccinated. According to the centers for disease control. And fewer than 9 of hospitals, have required their workers to get vaccinated, according to the american Hospital Association. Today the Department Of Veterans Affairs became the first federal agency, to require some of its employees to be vaccinated. The department of Veteran Affairs will require 115,000 of its Front Line Health Care workers, to get vaccinated in the next two months, or face penalties, including possible removal. Today new York City mayor announced the cities roughly 340,000 municipal workers, will be required to be vaccinated by the time schools reopen in mid september. Or face weekly testing. Dr. Zeke emanuel, most of us are just shocked, that it would come to the point where you have to advocate, for medical workers, to be fully vaccinated. How did it come to this . Well i think medical workers reflect the country. And i agree with you. Its pretty shocking that Health Care workers would not be the first in line, and every person in Health Care would not get vaccinated. I have been calling for a mandate, ever since april 14. When i row an oped in the New York times, i think we Need To get all the Health Care workers vaccinated. They should not infect other people, putting them in danger. Unfortunately, because of misinformation, because of access problems, people have just stopped getting vaccinated. And we Need To get them over that little barrier that they have. And get them vaccinated. The american Hospital Association is saying the only 9 of hospitals, have fully vaccinated personnel. Its rather frightening. Is there any way for us to know if the hospital we might choose to use, or be taking to emergency, has fully vaccinated personnel . No there really isnt. I am proud to say that my University Of Pennsylvania health system, which is a fides hospital Health Care system, has mandated that all workers get vaccinated. But this came home to me very vividly, frankly when my brother was delivering a baby, and she said, i dont want to question whether that nurse or the person coming in cleaning the floor has been vaccinated. I should just assume that theyre vaccinated because theyre working in a Health Care setting. And i totally agree with her. I dont think that any of us should have to doubt or question or worry that we might get covid from a Health Care worker. Have you personally had conversations with unvaccinated Health Care worker, or has your group come up with any reports about what they say, about why they are not vaccinated . I think a lot of it is local lawrence. I think a lot depends on the local dynamics on the floor, or the local dynamics in a department of a hospital. Typically what you are hearing over and over, its as if the leader of that group says, they are not for it for whatever reason, political reason, disinformation they may have gone, and that tends to influence other people around them. A lot of this like the military, like sports teams, a lot of this is local. The thing that we dont get, who live outside the medical community is, we think of nurses as medical scientists. We think of physicians as medical scientists. We think of everyone working with the medicine, in the hospitals as medical scientist, sure theres people in maintenance who are, theres executives in hospital who are medical scientists, but its the people who are involved we working with medical science every day. Deciding exactly how much of a drop of this particular medicine can this position take, its people in that section of it, that astound us, that they are not vaccinated. Health care is not hermetically sealed from the larger society. I think thats whats your perplexed by. It just isnt. The same kind of disinformation that happens in society, can happen in medicine. And unfortunately, that it has happened extensively on this. Vaccines used to be seen as a godsend. Saving us from serious illness. I remember when i took my Polio Sugar cubes in school. And the relief parents had. But now we have made vaccination this ideological badge of the in group in the out group. And that is really what the source of the problem is. She would not make this key lifesaving elements, a badge of a member of our tribe are here against our tribe. And that has been the most serious problem here. This weekend, House Speaker Nancy pelosi appointed Adam Kinzinger to the house select committee, investigating the January 6th attack on the capital. Congressman in voted to impeach President Trump, for inciting the insurrection on the capitol that day. He is the second republican on the committee, appointed by nancy pelosi, along with congressman women liz cheney. Speaker pelosi appointed kinzinger after Minority Leader mccarthy pulled all of his choices, from the committee, because Speaker Pelosi rejected mccarthys, two of mccarthys choices, Jim Jordan and jim banks, who both voted to overturn the president ial election, after the Trump Mob Attacked the capital, to try to overturn the election. Today Kevin Mccarthy told reporters that the two republican members of the select committee, are quotes, pelosi republicans. Here is how congresswoman Cheney And King zinger respond. Its very serious business year. We have important work to do. Its childish. Were doing big things right now, were getting to the answers of the worst attack on the capitol, since the war of 1812. You can call me whatever name they want. I just believe the, bottom line, Amen Elected member of congress, im a republican. And we are now less than 12 hours away of the committees first hearing, the committee will hear from four Police Officers, two from the capitol police, and two from the d. C. Police, they will describe what they experienced when the Trump Mob Attacked the capital, our next guest, former u. S. Attorney Barbara Mcquade has suggestions for what the Committee Members should be focusing on. In an article, she coauthored for justice security, Barbara Mcquade writes. The committee should consider the acts and admissions of executive and legislative branch, entities and individuals, up to and including former President Donald J trump. His associates, and others involved in the run up to the events of January 6th, in the use of disinformation, to incite violence. Suggesting, collection of this evidence is not to presuppose liability, but the country needs an accurate record collected at only by understanding all of the factors that did or did not contribute to the attack can we hope to prevent similar attacks in the future. Joining us now is Barbara Mcquade, former u. S. Attorney in michigan, and Law Professor at the university of michigan law school. She is an msnbc legal analyst. Barbara, as a member of the committee, what would be the focus of your questions . How would you go after what youre looking for . Well tomorrow of course lawrence, we will hear from four of the Police Officers who were there that day. I think thats a wonderful way to start. We want to hear about what they saw, what they heard. The injuries they suffered. And continue to suffer as a result of this. I think its important to debunk some of the myths that have formed up already around january six. That the people there were just ordinary tourists. I think hearing firsthand from them will be very important. But then moving on i think its important to understand about the intelligence failures. Why we did not collect information. And share to the right representatives. And the response when it came, why was it there was such a lengthy delay, well we waited for the National Guard to show up. I think those are important. And of course the role that Disinformation Campaign about the big lie, that trump actually won the election. Played in motivating those who are there that day. Lets listen to what Adam Schiff said about this today. He will be a member of this committee. We will follow the evidence wherever it leads into whom it leads. I think once we are composed and were getting close, we will be defining the scope and the order in the priority of our witnesses. And i dont want to get ahead of that process. Do you expect to have to issue subpoenas . Yes i do. We want to make sure for example when we request documents that we get all of them. Then we do not have people withholding information because its a voluntary request. So yes i think we are going to subpoena and we will do that early. And with witnesses i expect that some of them will be reluctant to testify and they will Need To be compelled. That certainly my expectation. Barbara, thats a big strategic points for any congressional committee. To subpoena or not to subpoena. If you subpoena, you run into the possibility of a protracted legal battle trying to enforce that subpoena. Which is why congress always prefers to get the witnesses without going through the subpoena process. But it seems like adam shift, possibly has learned his lesson about dealing with the Trump Side of the world. And that its going to take subpoenas. I think one of the lessons learned from the Trump Administration is, if youre going to use subpoenas eventually, you should serve them early. Because as you mentioned, it can be a protracted process going through the courts. One of the things our cords are not angry as moving quickly. So if the committee is serious about getting these documents in time to be able to use them to question witnesses, they probably should be serving those subpoenas right at the front, and so if they have to go in courts use in force them, they can do that sooner rather than later. That seems to be what Congressman Shift is saying, its probably a consensus of this committee at this point. How would you see it in terms of scheduling, they will begin with, this is what we saw on that day. Tomorrow by Police Officers who were there, who were being attacked. They will establish this was full violence, this was a real attempt to change the actual process that was going on in the senate and the house. They were trying to change the election. They were talking about hanging the vice president. All of those things, which will be necessary Fact Base for someone like Donald Trump who will be saying whether or not he testifies to this committee, he will be saying during this investigation that those people were there in love as weve heard him say. That they were there peacefully. That they were full of love. That message is going to be Coming Up constantly from Donald Trump during this investigation. Yes and thats why i think its important to get the facts on the record in debunk some of those myths. In the series of questions that we put together in the piece that you mentioned, we use the 9 11 Commission Report as our template, and that is certainly a lot about what happened on 9 11, but then went back in time to look at the origins in the planning that occurred. I think it will also be important for this select committee, to go back. They may start with january six, but i think its important to look at the planning in conversations and groundwork, that may have been laid leading up to that, to trigger people to be there that day. We know Donald Trump for example sent out a tweet urging people to come to washington on january six. He will be wild he said in that tweet. What did that play in radicalizing some of those people to actually show up on January 6th . And like the 9 11 commission, its also important to look forward. What have we learned from this episode, that we Need To change to do differently in this country. With respect to violent extremism, the use of Social Media to facilitate and regroup people. And the use of disinformation to motivate people to acts of violence, because they believe their country has been stolen from them. I think all of that is important to chronic and then a success so we can go forward. This is one of those congressional investigations that intersects with criminal investigations, including the now hundreds of people who have been arrested in criminally charged. With invading the capitol. Some of those people, may at some Point Give evidence. Actually say under oath, what they believed Donald Trump wanted them to do. And what they believed Donald Trump meant when he said we are all going to walk down to the capital together. And so, this is one of those things that may at some point get lucky. Because that testimony comes out in judicial process on time. Or they might have to wait a while to here with those kinds of witnesses might actually say. As these tracks are proceeding in parallel fashion, you are right in that sometimes one canisters the other. You might learn about something in one form that can be used in the other. But there is also the risk that you could interfere with the criminal process. One of the most famous example of that is when congress immunized oliver north. Heard his testimony and then later ruled that his prosecution was tainted, because the prosecutors had heard his testimony in that congressional hearing. They have to be mindful of not immunizing people who may be facing criminal charges down the road. Barbara what do you see as the reasonable time table, for a congressional investigation like this . I think it will take many months to hear from all of the different witnesses. I would put them in several categories. Tomorrow some of the first responders. I think we Need To hear from the intelligence community, i think we Need To hear from the Defense Department as to why the response was so slow. I think we Need To hear about officials at the white house. And probably some expert witnesses about domestic extremism. About disinformation, and about Social Media. Pulling all those groups together, i think will take several months. Thank you very much for joining us tonight.
