Eyes the first sentences as a potential Pres Dent for the many cases to come. Theres hundreds of people charged in connection with January 6th. Here, is what he did in plain sight that day. Photos and evidence in the case says he illegally rushed the Senate Chambers and sporting a trump 2020 shirt while carrying a trump 2020 flag. A look the prosecutors say he happily showed off while posing for selfies to his friends. Hes now a convicted felon. Hes going Jail Mp in court he claimed a naivety. Claiming if he had any idea that the protest would escalate he would nef have ventured farther than the sidewalk. You can decide whether to take that as face value. He broke the law by trespassing and joining the mob and showing its disdain for the blue lives that it also like to talk about when convenient politically. Escalation or not, this January 6th rioter bragged about his actions until he got busted. Going from a want to be viral tough guy to an apologetic convict. Vince staples put it out, really spilling blood, everybody tough until they got to go and see the judge. This Maga Rioter was never tough. Certainly not to day of his felony and not today as convict headed to jail. Lets get right into it. Im joined my Melissa Murray and Staff Writer at the atlantic. Professor, your thoughts on first just big picture, the notion of accountable. This first felony sentencing. This is one that will be watched closely. As you mentioned in the opening theres a number of different individuals who were involved in the insurrection and awaiting trial. They will have lot of decisions based on whether or not to pleads guilty or to take their chances and face trial. Its worth noting and the prosecutors ask for a much longer sentence, 18 months. He got eight months in part because he has no criminal history and he pleaded guilty and took responsibility for his actions almost immediately. Theres a lot going on here. This is really important case. I think it will shape what well see going forward as more and more of those involved are brought to justice. Yeah. I think we have something on that. David, before i bring you in, lets look at that other part of the debate whether this Jail Term is enough. The Biden Doj sought year and a Half Sentence given he was part of a collective threat to democracy. His Defense Lawyer had this take. I think Judge Moss is a brilliant judge. Cancel Culture And Everybody gets upset. Were so busy Casting Stones at one another. I think his decision was that of a brilliant jurist who had a difficult job. For the record, you guys should give paul a break. Many rejecting that call to give him a break or any of the nation to take a break from accountability. Legally nothing in the case ties the hands of judges in these other cases. Some of those have more serious or violent charges than this one where the rules might double the jail time. He was charged with obstructing an official event at the capital this wasnt about harming other people. It wasnt about the use of Brute Force against individuals. Again, that plays into the nature of the sentence. The fact he has no former criminal history plays into the sentence. Does that mean that Judge Moss is a brilliant jurist as the Defense Attorney said. I think it was a brilliant outcome for this particular defendant. I dont know that we call this brilliant. I think federal judges the decisions all the time about how individuals and this was a tough case. We may see easier cases. We may see harder cases going forward. This will be a Benchmark Against which other case will be judged and other judges will take their cues. David, your thoughts on what today means. You come from idaho for this . Flew all the way here. The context and david, if you can hear me, its become now so main line or normalized on part of the right to actually just be against Law And Order. To be against the notion that people who attack police should have their day in court and if convicted should deal with the consequences. David. I think were going to hear dozens and dozens of It Rations of the jerry seinfeld, was that wrong sketch. Thats what the Defense Plea was. The defendant said, that female had any idea that assaulting Police Officers and interrupting elections was wrong, he would have never taken part in that. It was news to him. Yeah. Yeah. Professor. Again, this is a really interesting moment where were going to reflect on the political prisoners of the past. Theres other groups in our history who claim to be dissidents against social order. Im thinking of the panthers. When you go Beyond The Law youre not a political prisoner. Youre simply a prisoner. The idea of trying to wrap this January 6th insurrection in the political protest and these are right minded people who have gotten ensnared . The Governments Grasp is a bit rich given what happened on that day. David, your view of the wider discussion of whether this doj is being aggressive enough, should it be looking beyond the selfanointed foot soldiers to the people who may have helped organize or lead this. Theres some background noise. Ive been there. Professor, im going to go back to you and david is being a good sport trying to work with us. Ive been on the receiving end than this. He should reject any notion a congressman is doing his job when he foments a riot based on lies. Professor, we spent quite a bit of time focusing on the fact its not proper for politicians or others to advocate, a political indictment of this or that person. Steering from that kind of talk or the substantive side is there case for those who may not have entered that building but crossed a criminal line in organizing. I think theres a broad range. We really are in unchartered waters at this point. Its worth noting that the airs was directed to the question of whether city Members Of Congress will be insulated from liability for what happened on the January 6th insurrection by virtue of a federal law that laws federal officers to be exempt. I think the bigger question here is whether or not supporting our encouraging an insurrection if that is what happened is within the scope of a sitting member of congresss duty. I think the oped was pretty decisively in favor of saying no, that isnt the Case And Department of justice should take strong steps here to send a message that should not be tolerated and surely outside the bounds of what we expect of our lekked officials. Right. It makes the fair point its outside of any official duties. You have a protection of official duties. If youre out doing a political thing that may or may no relate to inciting violence, theres a tough question there about whether you cross the line. Theres an easy question it was not in your official duties as a member of congress. Its an arguable betrayal of oath. Right now everything is moving forward and everybody is looking for this legislative language that they can get their teeth into fully understanding what it will cover not only for the bipartisan deal but the Budget Reconciliation Bill which we know not every democrat is on board with yet. I think schumer Will Push Everything Forward as quickly as he can. He got his Marching Orders from president biden last week in the closed Door Lunch with the democratic caucus. She is watching the Clock Tick toward the August Recess and doing everything in his power to get it done. Thats the Party Vote they need. On the Voting Rights i mentioned to you, i want to show the Voter Suppression laws around the country. You have republican legislature introducing hundreds of bills, its over 380 in 48 states as of midmay. Georgia the democrats did go to Field Hearing. Adding new restrictions on the drop boxes, prohibiting food and water. Some is under the line of what has been a Supreme Court that is letting a will the of these crackdowns fly. Whats your view politically about i think democrats have shined a light on it. I think people that watch the news have heard about this. I dont think people dont know. What do you think democrat vs to do next if some of these things will stay on the books by the mid terms. Not only does it shine the light as you mentioned but it also collect data that we hear from senators on The Hill we dont know if it will have the negative impact. This is the concrete data showing it from witnesses on the ground and recounting their experiences from 2020. That data could be helpful in terms of making the case within the democratic caucus for that carve out for filibuster to get some voting Rights Legislation passed. If nothing change, i think we have to accept that theres no way to out organize or out mobilize voters in terms of beating Voter Suppression. Its impossible to do that. Democrats are up for a massive fight and thats high the losses in the Supreme Court where you have them muddying the waters on what can be challenged in court as racially discriminating Voting Bills will make it that much harder for democrats not only in Election Cycle but out of the doj when they try to challenge the cases in court and bringing the legislations to court calling out how its targeted demographically. I want to put something on the radar of every one about how bad the polling was in 2020. This is really interesting. It may seem like that was last year but with rigorous data and with empirical science. They look at this beyond saying this or that single poll was bad. Theres a rigorous new report out. I want to read new headheadline. President Ial Polling was off by four points in 2020. Polls over stated Trump Support by three points on average. This is about the Polling Complex and the Media Opinion i did want to make sure to flag this. Im curious your view as someone who is a political analyst and in washington and all these polls get talked about. Shared with viewers before. I think theres too much oen polls. We dont air national Poll Ons The Beat because theres no national election for president. Its kind of confusing or misleading. Theres other examples. This was worst than in 20 years. What do we make of all this and how should we be literate of Theres Information out there but not letting it distort elections. I think anybody working in politics is been burned by polls whether thats 2016, 2020 and beyond. Looking at this and that report that came out, i think Theres Something interesting about the fact the under count of the margin coming potentially from the fact that trump voters were less likely to engage in pollsters. Not having them to participate will lead to a skew. I think the other thing is the electorate is expanding and with 22 Million new voters in 2020, those likely werent on pollsters radar. To how polls are conducted, they are probably not talking to the right folks to get accurate counts. That will only be exacerbated in 2024 and other president ial years. We know in midterms polls tend to be tighter but midterms are very different Electorate Audience versus 2020 president ial situation. Yeah, i appreciate all the points you raised. Some of those were touched on in this report. I think we all need to be honest and hold ourselves accountable because were talk about the power of democracy and the threats of democracy. It makes them think the race is over when its not. Thats major deal. I think the polling has become a part of that problem. Amidst all of this one online petition is just saying, maybe Bezos Shouldnt be allowed to return to earth. Over 160,000 people signed that. Whats going on here. Part is due to sense that things are not good here on earth. Specifically, right now. Europe is under water. Many participant of the world are on fire. The climate crisis rages, covid surging. People are poor and without food. Jeff bezos has gotten richer than ever. His total wealth growing over 90 Billion during the pandemic. The billionaires can live in their own bubble, they dont have to respond to anyone in politics or journalism. They dont have to take interview requests. He did see the need to speak out. Take a look. Are are critics who say rich guys on a joyride. What will come out of this. People say, we have so many problems here on earth and they are right. We need to do both. We have always done both. We need focus on the Here And Now and look to the future. Thats his answer to what he says hes doing. Theres a larger history here be there was a lot of turmoil during the 1960s over many issues and people did question whether the government should be spending so much on space given the problems on earth. If that were dollar bills, you could stack them and they would reach twice the height of his of the elevation that his rocket will obtain. Just put that in context. You can say he shouldnt do that. Hes got plenty of Money Pm complain hes not helping the poor or the hungry or his workers but that specifically wouldnt have to directly address the fact that he wants to go into space and create an entire new, along with branson, entire new economic branch of what people might do on their vacations, space tourism. Now its just for rich people. Lets talk about that part. Youre getting us to that next larger question. New things are attacked by virtue of being novel and not for any substantive reason. Things that were thought of as for the 1 whether that was the initial Air Travel or other technology then has democatized. Is there value to a potential private Space Market . If it becomes a Luj Tourist Industry then theres value. You enjoying yourself. Youre not saying why you doing that when you could be feeding the poor. Big picture, what is important to understand what is happening with covid right now starting in the u. S. . Im so glad you tied those stories together because the emerging disinformation that im now seeing is, oh, vaccines dont work so you dont need to get them. T thats because people are hearing about these break threw breakthru infections because no vaccines are 100 . They are protecting you from hospitalization and numbers. When you see the isolated numbers it is important to it understand, that the majority of the burden is among the unvaccinated. 99 of the people who died last month of covid were unvaccinated. 90 of the people hospitalized were unvaccinated, and the majority of increased cases and deaths are happening in those communities where theres under vaccination. When you heare isolated numberi want people to step back and say, okay, during that same period of timey, in that communy how many hospitalizations, infections and deaths did we see in the unvaccinated. That would be the correct way to compare the two numbers. I think thats where some of the disinformation is coming and what we need to work on. Lets get into that because you are the doctor. Im going to make a very simplistic analogy. Im not saying it is covering the entire complexity. But if you go bike riding, helmets are a really good way to protect your head and so you wear them. You can have studies that show that helmets, properly worn, will save peoples lives most os the time. Yet you can still read about cases where someone is in a helmet and unfortunately it doesnt save their lives if something really bad t happens. It seems people, some who are arguing obviously in bad faith, are trying to say, well, oh, my gosh, i found out about a case where someone was in a helmet and still got hurt or worse. Thus, whats the point of helmets . Yeah, it is like that. And, you know, i think another example ill give, i saw a skit from someone on fox, a medical person they had on who said, well, what if the efficacy has gone down to 70 , which it hasnt by the way. Thet data from scotland and Uk Saysot we still have very good efficacy, but it might evolve with new variants, but lets say it went down to 70 . I never heard anybody say this parachute has 70 of protecting me so i would rather fall out of the plane without a parachute on. Thats the equivalent. The question of whether people areti making their own choice i they are led astray with the misinformation, are they making the right choice about their health. Thats where the a misinformati comes in because the personal choice guided on purveyors of disinformation and on amplification of misinformation. Thats why i thinkn it is justo heartbreaking for somebody who is in public health and in medicine. Understood, all of it. It is something we want to continue to shine as light on make sure people understand. Again, i always make a point of saying people can make up their own mind about their health decisions, boright. It is not the government has an obligation to make some rules of the road. The press is not here to tell you what to do, but we can report what is ig tworking, wha safe, and certainly try to crush Badfaith Misinformation for political or othernf reasons th might give people the wrong baseline facts to use when they make their own decision.
