Development the Pennsylvania Supreme Court tossed out Bill Cosbys conviction. Bill cosby is home tonight for the first time in three years. He was convicted on three counts, aggravated and Indecent Assault in 2018 of drugging and assaulting andrea constand. Today, the court said that cosby should not have been charged and barred a retrial. Today, cosby spoke about the ruling. You can see how powerful lists many of us feel. This is for all the people who have been imprisoned wrongfully, regardless of race, color, or creed. Cosby continue to deny any Wrongdoing And Rhea constant for her part called the ruling, quote, of concern in that it may discourage those who seek justice for Sexual Assault in the criminal Justice System from reporting or participating in the prosecution of the assailant. Meanwhile, the Washington Post also on the Board Tonight with a report of over a dozen new arrests in the January 6th Attack And Riot in our capital. Its the most in a single day. The feds also revealed new charges against several supporters of extremist right wing groups. This, on the same day, the house voted along largely party lines 20 22 to 1 92 indeed create a committee to investigate the riot and insurrection. Just to republicans, Liz Cheney and Adam Kinzinger cross the aisle with the democrats. It comes as the New York times released an investigation into what happened on that day. We need to make sure that the vote is protected and that we get the result that New Yorkers went to the polls or mailed in at the end of the day. And if this company were to be charged there could beat financial repercussions in terms of loans that become too that could eventually lead to bankruptcy by the company. But in importantly its the real danger for Donald Trump, weisselberg could begin cooperating with the state prosecutors in that could potentially lead to while trumps allies say this week that theyre pleased to see that the former president is not himself going to be charged as far as we know tomorrow, we know that this investigation is not over and that there could be another chapter to it and its one of the reasons we want to see Donald Trump react so strongly and his public statements tonight. Interviews with the current and former associates of weisselberg as well as a review of legal findings paints a Portrait Of A Man whose unflinching devotion will now be put to the test. Weisselberg has become so woven in the fabric that when mr. Trump moved to the White House in 17, he interested weisselberg along with the former president s adults sons with running his company. The Prosecutors Narrative will be that the Trump Organization is essentially a criminal enterprise with a consistent pattern of fraud. How is it likely to sit with members of the republican party that you cover . Well, i think that it was very clear today from a tree with Jason Miller who is step down from a position of spokesman for Donald Trump right now but is one of his most loyal insiders basically saying the politics of this are such a problem for the democrats. They thought this was about trump but instead these people are going after an 80 year old man over free parking. Something to that effect. This is a political opportunity and he always sees things this way. He has believed for months that if he continues to maintain that hes a future candidate that any kind of prosecution of him looks politically motivated and will continue to help him raise more hundreds of millions of dollars as he has done since the day he lost the election. And i think he has taught his base that everyone who is against him and anyone who brings any facts that arent favorable whether thats the law or the media or anyone, its a part of the Deep Sea and that includes bill barr. However, unfortunate people view the prospect of Bill Cosby getting out of prison and enjoying his freedom. Tell our viewers what this ruling does or does not say on the merits about Bill Cosbys alleged actions. So the state Supreme Court found that cosby and the former District Attorney made a deal that cosby would not be prosecuted, and that way, he would not be required to testify in a civil lawsuit brought by the victim. Without this deal, cosby would have taken the fifth. The former fda says he made a deal because he didnt think there was enough evidence to charge cosby in a criminal case. This is the best way for the victims to get some measure of justice. This isnt a legal technicality the court found that cosbys constitutional rights were violated when his immunized testimony was used against him. And it wasnt a closed case. Six of the seven judges agreed on the merits, although a couple of the judges put out brian, i cant imagine what they are going through but its also important to understand that the court is not finding that mr. They really dont want to learn more about what might be happening in their own membership in terms of the connections to the perpetrators that day and what went down. I wasnt at all surprised and you can continue to expect all of that as a narrative, as the committee undertakes its work. So chuck, what are you looking for tomorrow and after say 2 pm when the indictments are unsealed, whats chain of events does that then kick off . Let me take the second question first, brian. After folks are indicted or perhaps an organization. They appear in court. They are arraigned. They are presented with the charges. They plead guilty or not guilty. In this case, not guilty. And the judge will set a status the hearing or scheduled the next appearance or a Trial Date but nothing much will happen tomorrow in court if in fact they do appear. Its rather perfunctory. What will i be looking for. The first question to ask, Paul Butler referred to it earlier. I want to see the detail of the indictments. I want to see the story. There are two ways to indict a case. One is just to recite a statute, a barebones recitation of the elements of the crime. But another way to do it is what we call Speaking Indictment and which we lay out the entire Story And Scheme right, . Who was involved, how are they involved, what do they do . The elements of the crime have to be there as a matter of law. But Speaking Indictments tell a story and i will be looking for the story. No offense, check, but were all around here glad youre in our lives in never want the feds in your life as a general rule and a practical matter. So lets talk about Allen Weisselberg. What is it like when you are the focus of the feds . What is going to happen in his life . No offense taken, i get it because nobody wants to wake up with the fbi at their door. Allen Weisselbergs Life if he is charged tomorrow will change dramatically. Now, its really important to look at what hes charged with and with a possible penalties are, and often on television we talk about the maximum statutory penalty which is not really the wait cases are sentenced, assuming a conviction. We also have to look at the sentencing guidelines according to the state of law and the amount of money involved so its very possible that while Allen Weisselberg could be charged and tried and could be convicted and sentenced, he might not be looking at long time in prison. And how much time hes looking at might determine whether or not he decides to cooperate. That will give us some indication of the leverage that the new York State authorities have over him and how persuadable he might be to turn or flip on others. If the company ends up getting nicked in this case its been theorize that of course all Bank Loans go away. How damaging, how detrimental could this be to what is, and i repeat, at the end of the day a fairly small Family Run Enterprise . Right. Really good question and it goes to the heart of something that prosecutors call Collateral Consequences. Something that we have to think about before we charge an organization or a company or a corporation, brian, are the Collateral Consequences. I know youll remember back in 2001 when the accounting giant, Author And Thurston was charged. The organization and the company was charged with the and run scandal. Also, 30,000 people lost their jobs when he was convicted ironic side note, his conviction was overturned by the Supreme Court based on faulty charlie instructions. But for a small privately held company, there are still Collateral Consequences. There are employees, fewer than Arthur Anderson but nevertheless employees. There are creditors, there are banks that have loaned money to the Trump Organization and to your point make all those loans a highly leveraged company could be at risk. I dont know that it will go out of business. I dont know that it will declare bankruptcy. I dont know with the banks, and creditors will do. Prosecutors have to think about those Collateral Consequences when deciding whether or not to charge an organization. I am sure that they thought of that here. And i think as we keep going forward, even if Donald Trump was to leave the planet and we never heard from him again, this is who the republican party is today. They wouldnt only be doing this because of what Donald Trump is doing. They would be doing it because the vast majority of their voters have been told this and lied to and also acquiesced to it. But then we participated in this and i think that is whats where all of us, whether were voters or active in politics or whether were in the media, have to really fundamentally call this out. Theres only one actual democratic party today. A party that leave believes in Democracy Today and thats the democrats. I want to political parties that believe in democracy. We dont have them today. We have one thats a Talker See and one that is democracy. One that doesnt care about holding an insurrection accountable and one that wants to hold it accountable. And those two things at that point have nothing to do with Donald Trump in 2022 and 2024. Eugene, i want a sample of some very powerful Remarks Today in the well of the House Of Representatives by, lets put it this way, the only sitting member of congress with five bullet wounds. My hearts racing right now and i am trembling. In part because im recalling what happened to me on January 6th. The same gallery that was evacuated on one six, more members of metropolitan Pd And Capitol police who were there that day to protect the lives in that chamber. That is a lot to ask for it to vote against all of that. And yet republicans have heard the stories told by police officers. Theyve heard how they were beaten within inches of their lives and many of them seriously injured, suffering ptsd from what was really an unprecedented and awful changing events. January 6th was a very very big Deal And Pub beacons want to pretend either didnt happen and without even bothering to find out exactly what it was. How it was organized, how it was financed and exactly what happens. Thats appalling and with that said that is the fault of the republican party of Donald Trump. It was not no office now. And democrats have to deal with that and so we have to proceed with a select committee that will investigate to the best of its powers, and that is what were left with. It shouldnt be this way but this is where we are. So matt, i have an impossible task for you in all of 60 seconds, what concerns you most about these immediate months ahead of us . What concerns me most is that this is going to get worse than what happened on January 6th. Because we have people that have been pushed and instigated and lied to and believe some crazy stuff and theres 300 Million guns in america that we have spread across the country and that really concerns me. I think we can get through this but i think its going to take a series of losses on the republicans part but in the immediate i am concerned that january six was just a preliminary events for worst things that can happen then loss of life in the course of this. Its just so out of whack but it has to do with the changing diversity of the country in a layer of white populations that is aggrieved by that. And that is what fundamentally the republican party.
