Its not anything i would look forward to doing. If i thought my voice was needed to get to the bottom of it, it would be something i would be open to. So, luke, you have at least one republican willing to serve if asked. Do you have any information on the latest in terms of who Speaker Pelosi is considering for her picks . I dont. The Speakers Office is still playing this really close to the chest. Obviously the two republicans who voted for the committee today, Liz Cheney and Adam Kinzinger would be likely options. You have five picks from the republican leader of Kevin Mccarthy that Speaker Pelosi might consider. Im not sure if hes going to put those forward, how long that will take. And then if miss pelosi will go ahead and offer up her own suggestions. It might be down to those two people who might do it. Other possible candidates have said they were unlikely to serve on the committee. It does seem even the support for the investigation is getting smaller and smaller as time goes on. You initially had 35 republicans who were in favor of the commission and now thats down to two in favor of this committee. In some ways, Sam Stein, it doesnt matter what republicans in the house say. The committee will go forward. It will have vast and sweeping Subpoena Power. It will be able to compel the kind of Document Production that the benghazi committee was able to compel and i believe one of the whitewater committees before that. A powerful investigative body will begin investigating all of the unknowns of the attacks of January 6th. Your thoughts on where the speaker goes from here . So, actually, i think the bigger question right now is what mccarthy strategizes here. I go back to the benghazi committee. When that was formed in 2016, there was a real Question Mark as to whether then Leader Pelosi would place democrats or boycott it. For a brief period of time there was a movement on the online left to put one democrat, grayson, on the committee to be a completely disruptive force. Eventually it was better to have a seat at the table to know what was coming to influence where the committee went and insight into its work than to be on the outside looking in. Arguably she made the right call. The benghazi committee did last for a while. Democrats generally knew where the committee was heading, what kind of subpoenas it was going to issue and so forth. Mccarthy faces a similar choice. Does he want to be a participate in a committee that will go on or without him . Does he want insight into what will happen . And if so, because pelosi has veritable veto power, who could get by her screening . The real Question Mark is on mccarthy. Shell find the right people to put on there. Mccarthy has to make the decision whether he wants to make it a political show trial. Claire mccaskill, theres real peril in the right making this as political as what Luke And Sams reporting suggests they are at least seriously considering doing. The american people saw an attack on the united States Capitol, saw the Vice President rushed out, his family, by the secret service. The american people saw democratic and republican lawmakers hiding and crouching and running for their lives. I think the american people would like to see a bipartisan investigation into how that came to be. I would love to be in a room with all of the republicans that voted for the independent commission but then voted against the select committee today. That shows you how trump is closing the ranks of this party many who voted against are welcoming into their tend really the seamy underbelly of america in terms of nazi sympathizers and Holocaust Deniers and White Supremacists. So if you compare and Contrast Benghazi and i hate to do this to my friend sam, the committee was actually formed in 2014. Almost two years after benghazi occurred. And there were still more democrats that voted for the select committee On Benghazi than there were today. And compare these two events. Most americans knew it was a terribly tragic thing that happened at benghazi, but they didnt live it. They didnt watch their Nations Capitol Overrun with people beating Police Officers and throwing things at Police Officers and breaking windows and trashing offices and trashing the senate chamber. They didnt they didnt have that kind of Hard Drive about what happened in benghazi. So the notion these republicans think they can get away with turning this into a Fox Echo Chamber by just denying the american people the opportunity to look at it i think is terribly naive. And if they decide to participate, as the democrats decided to On Benghazi, i think theyre forgive to look silly if they put the nut balls on the committee like the qanon folks. I want to follow up with you, claire. Not to belabor the parallel to benghazi. Its just a recent point and its useful in understanding. Not just Hillary Clintons emails but reams and reams and reams of Document Production was enforced by that committee and by their Subpoena Power. It was, though, i believe the 12th Or 13th investigation into the tragedy at benghazi. This will be the first. This will be the first investigation into an attack on the capitol. I want to read some of Liz Cheneys Statement Today on her yes vote, the two republicans to vote for Todays Establishment of a select committee. Earlier this month along with 34 other house republicans i supported the establishment of a bipartisan independent commission to investigate the attack of January 6. As ive said before that would have been the best way to address the dangerous assault on the institutions of our democracy. Although that bill passed the house it was defeated in the senate. It was right to be wary, but congress is obligated to conduct a full investigation of the most serious attack on our capitol since 1814. Our nation and families of those injured defending us or died following the attack deserve answers. I believe the select committee is our only remaining option. I will vote to support it. Claire . Yeah, benghazi had no less than six investigations just in the house of representatives. Including a select committee headed by trey gowdy, and hillary clinton, famously, sitting hour after hour being abused and calmly and patiently laying out the facts. And clearly the goal of that i mean, mccarthy said it out loud at the time, was to trash Hillary Clintons numbers. That was the goal. So the idea that they are not even willing to step up and have a hearing if you think about what actually happened on that day. They were cowering under desks. They were afraid for their lives. The same people who voted not to investigate it were the intended victims. The Vice President was being shouted about in terms of hanging him and there was a noose out there symbolically as they chanted they he wanted to hang our Vice President. And it was a republican Vice President. It is astounding to me that they think politically this is smart. And i know morally they have to know its wrong to not look and see around every corner and under every rock what actually happened that day and why. Luke, i want to put up the video of other stakeholders who have said in their public statements they feel betrayed by republicans and by the breakdown in intelligence. Officer harry dunn, officer michael fanone, officer hodges. They sat in the Speakers Box during the debate. They have become probably unwilling witnesses to the horrors of that day and the only reason theyre put in that position is because of republican efforts to white wash the horrors and refusal to investigate. Do you have any sense of where they are, where they stand on the select Committee Creation Today . Sure. Ive gotten to know these guys pretty well over the past months, and we were just texting about how theyre feeling. I think theyre very frustrated and surprised over how deep the divisions are over this. It shouldnt be about political Parties Today that everybody saw how bad this attack was, everyone knows the damages that were caused. Everyone knows how close defensemen crass came to really falling apart that day. I was there that day. They saw the trauma. The smashing of windows and storming of the halls and the siege and the assaults. We all saw it. I think theyre disenheartened and disenchanted how politics has taken this over and its a completely partisan issue and to be a democrat is to be in favor of the investigation and to be a republican is to oppose this committee. Obviously there are two republicans who supported it and so its not totally parson but it has largely gone that way. I think they find that disheartening. I think disheartening is probably their reaction on the best of days. Sam, i dont have a correction. I never have a correction for you. I have a different opinion. I dont think the republicans are the ones to watch. Its how savvy can democrats be with just how bipartisan this has been. It was a bipartisan vote to impeach, to convict the expresident. It wasnt enough. It was a bipartisan vote to create a commission and came up short in the senate. What is partisan is the obstruction. The only thing partisan has been the republican lies and refusal to get to the bottom of it. Democrats have an opportunity to have factfinding inquiries and hearings to put them on in Prime Time and to educate the american people about something republicans dont want them to see. Talk about making it impossible to look away. The only partisan approach to the insurrection has been the republicans. That was a correction, nicole. Im just kidding. I was more interested in what the democrats do than mccarthy. I take your point here. There is no lack of primary documentation already in existence and that gets to just how harrowing that day was. I will give kudos to lukes publication right now because today they produced a 40minute Recreation of that day that i sat down and i could not turn away even having watched hours and hours of footage. I found new vantage points. The question i think and this is where they need to figure out how they can maneuver is the stuff that we know thats out there that we havent seen yet. For instance, what was the tiktok happening inside the West Wing that day . What was the president at that moment saying to his aides . What was Kevin Mccarthy communicating to the president . Those types of very important communication that is were happening were some of the most critical missing pieces. Democrats need to get their hands on that. How long will it take . What type of litigation are we likely to see as, of course, Donald Fight and his lawyers will fight this. Kevin mccarthy will resist it, too. This will not be a quick process. In some ways the democrats benefit from not going the bipartisan route because there was a clear end date. They can be a little bit more flexible. They do have to strat outside strategize how to play it out. And, claire, someone said, oh, they have to really find a smoking gun. What, to put next to the other two . They found out trump extorted zelensky. I think it shows the depravity of the republicans in the senate and the house. The reason they didnt want a commission has nothing to do with any sense they werent scared on that day, any Sense Donald Trump wasnt responsible, both mccarthy and Mcconnell Have said so. Mcconnell saying he should be criminally prosecuted. They dont want to muck up whatever their message is, accuse the nsa of spying on tucker carlson, whatever it is, for the midterms. I think they have screwed the pooch. I agree and let me rush to agree with Sam Stein. I believe the most important thing this select committee can do is expose that Donald Trump thought it was fantastic what they were doing. Donald trump refused to act until it got so serious that his children and others were begging him to call off the dogs, to call them off. And the person who was maybe the most vehement about that, i believe, was probably Kevin Mccarthy. And thats why Liz Cheney keeps talking about putting Kevin Mccarthy under oath. They know, the people that were in touch with trump and the pentagon that was hesitating and the Police Departments that were hesitating, all roads lead back to the oval office. And since this party is coalescing around the former guy and coalescing around his message of grievance and darkness, it is really going to be bad for them if they can uncover the fact that when confronted with the damage that was being done on a sacred place in this nation he thought it just showed they cared more about him than the people complaining about it. Just two republicans voted with democrats to set up the committee. It comes amid a campaign by some in the gop to white Wash Everything that happened that day. Defending the insurrectionists or comparing the attack to a, quote, normal tourist visit. It is a stark and shameful contrast to the harrowing accounts of the 140 Capitol Police officers who were injured fighting to protect the very same lawmakers who are now trying to Memory Hole the insurrection itself. One is a veteran of the war in iraq. He was beaten with an american flag, called a traitor as he battled the attackers for hours and hours at the capitol. At one point he was just steps away from metropolitan Police Officer Daniel Hodges as he was being crushed in a doorway while trying to hold back the mob Of Trump supporters. Here he is after the proposal to create an independent commission failed in the u. S. Senate. I feel insulted. I feel like they dont have the courage. They demand something from us they are not willing to do which is sacrifice their livelihood. If i go to your house and bring a bunch of people or tell a bunch of people to, hey, lets go to Lemons House and break everything and threaten your wife, your kids, threaten whatever, whoever is there, and then leave everything damaged, wouldnt you want to know who did this, who coordinated this . I know that this is probably the very last thing you want to do, but tell me what people need to know about what really happened now on the sixth month of republican efforts to have us not know the truth. Well, during that day it was not peaceful. It wasnt like a tour like some people make it to be. There were going to be people killed that day because thats what most people were saying they were going to do, and we stopped them. We stopped them though the president at that time left us on our own as a sacrificial part of what we were doing there. It felt like we didnt have the support from the president even though he was watching everything on tv and the Security Situation was degrading. We felt abandoned by him. He didnt fulfill his oath of office. And im still recovering from those hugs and kisses like he claimed was happening that day and for those Members Of Congress will continue to propagate that lie that it was peaceful, the person who died, who was shot at the capitol, was executed. If we let those people go through and not secure their safety, would he be calling them or calling it a murder . It doesnt make sense. What would it take . Would it be one or more Members Of Congress or senators or the Vice President that day had died . Then what would it be called . A Terrorist Act or a tour . Again, most of the people that were there, they were telling us, they were telling me what their intentions were and thats why we held out the line at the lowest entrance that day in the tunnel. Sergeant gonell what do republican lawmakers say to you or your colleagues when they see you facetoface about the turn this has taken . I have not met any of them yet. I spoke out about a month ago right after they voted against the independent committee to find out or begin the process of try to find out what happened and what led to this. Riot or insurrection. I have not spoken to anyone on the other side, maybe because i dont fit the narrative this was peaceful or they dont care or were complicit themselves in terms of trying to cover because, to me, it seems like they are covering for what happened. They dont want to know what happened. They dont want to deal with it. They are pretending it will go away. We feel that betrayal. We feel that the lack of support from them, even though they are claiming to be the party of law and order, the party of fiscal responsibility. When they had a chance to actually do something about finding out what transpired and who did what, when you had the president himself just watching tv and three hours later he, four hours later all he does is put a statement on twitter or on video, its unamerican because if we had not done what we did with the help of some of the other agencies like mpd and the other area Law Enforcement agencies and what not, a lot of people would have died, either Members Of Congress, ourselves, and also some of these rioters. And for some people January 6 happened one day. For me, for those responding officers, is nonstop because we still have to get Phone Calls from the department of justice, from the fbi. Do you know this person . Can you identify this officer your coworker . Was this an individual that assaulted you . So its nonstop. And for people to try to move on from this day, some of them already have from the others politically they have. But for us, the people who suffer, im still recovering. Today i had physical therapy from those injuries still almost six months later. And its indefensible what they are doing and betraying the oval office. Im sorry. It just seems like we are living in another country, not the united states of america, as i hold this country very dear to me. Just listening to you and im so sorry that youve been let down. You have been let down. I have interviewed a lot of lawmakers who told me accounts of telling their spouses where their wills were the night before or wearing sneakers or sending their Staff And Family home. What were you expecting the day before January 5 or the morning of January 6th . What did you think was possible that day . Did you feel blind sided by the size of the crowd and the violence of the crowd and their determination to take the capitol . Well, the day before i was kind of like at ease. I didnt think much of it in terms of what would happen. We knew there were reports on Social Media of people gathering more than usual and also reports of people bringing weapons to the capitol. But we didnt know who those people were. So when we are fighting those people on the lower stairs area, we didnt know who had weapons. We tried to arrest some of the people in the beginning but, unfortunately, we couldnt because we continued to get overwhelmed, and we were not going to use those resources to be tied up to just make an arrest when we had to defend the whole complex and what not. Im sorry, what was your other question . One of the things that a select committee could arguably get to the bottom of is what was known ahead of time, and you described yourself as feeling sacrificial, sacrificed to the mop and the violence. Who knew what ahead of time could be an important piece in making sure this never happened again. Im curious what your sense was ahead of time. We knew it was going to be a long day. I worked civil Disturbance Unit for a while now, and this was not going to be the first time that i was activated, but given the report that some of the rioters may turn against us, we did what we were trained to. We stopped them. We held our own. As far as i know none of the Members Of Congress or senators or staff were injured. Sadly we may the ultimate sacrifice, the Capitol Police officers and what not. Again, i find the obstructions not to at least have this investigated as a desecration of the sacrifice. Thats what led me to come forward and speak about this. When i saw the vote that day and one Side Vote against, that put me in that situation when i saw the news and literally saw my family when they were talking on tv, getting some promise from some of the congress representatives, and i literally saw myself, my family, in that situation because that could have been myself. Paying the ultimate sacrifice. And, yes, i did sign up for it. But it doesnt make sense that you dont want to at least try to find out on how to prevent this in the future. And i will do my job, what is required of me doing every single time no matter what. I know thats what i signed up for and i like my job. But i shouldnt have to take any extra risk for something that is preventable. And for them not to try to at least find out what was happening and investigate this, it should be investigated because we have people that are complicit, i think, and maybe thats why they dont want to investigate it because they could be complicit. I have one last question. You have also signed up to serve your country in the military. You served in iraq. One of the most shocking and disturbing things as we watch the Justice Department File charges against the insurrectionists is that a number of the insurrectionists are veterans of the military. Did you have a sense of that on the day of the attack . And what do you think about that upon learning that . I just think that a lot of people continue to be misled. Continue to not make their own decisions about what is true and whats not. If im telling you right now that i got attacked and you tell me it was black lives matter, no, it wasnt. It was not black lives matter. It was not antifa. It was not the fbi. These were trump supporters from across life. All kinds of people were here that day, military, Police Officer, former firefighter. You name it. And for a country that is very education is high and for them to claim they were educated and cannot make their own decisions based on what it is true to them because they want to continue to believe something that did not happen is uncalled for. For them to continue to believe the president , the lies, when the majority of the people who were elected officials or are elected officials arent saying this lie did not happen, that the election was fair and square and what not. And they continue to listen to all of this stuff. I think the president instead of being reinstated like he claimed he should, he needs to be indicted for to fulfill his constitutional office which is to protect the united states of america. He left us fending for ourselves. He did not do anything for three hours yet he claims he knows more than all the generals and what not. How come he didnt know about this happening . How come he took so long to respond to even make a Phone Call to say send help . If this was happening from another group, im sure he would have had committed. Last year, over the summer, we had so much mutual supports. And for this one, we just literally had it not been for mpd would have, god know what is would have happened that day. He left us on our own as sacrificials. For me, for them to continue to elevate his lie, continue to believe him when he, under his command, there was an attack on the united States Capitol, he lost the house, he lost the senate and he lost the presidency. So what is it they find a champion of him, what is it they continue to believe in his i dont under why they continue to do this and sacrificing the country only to feed somebodys ego. We are following this other story, this stunning news this afternoon that Bill Cosby is now a free Man Back in his home after a dramatic reversal from the Pennsylvania Supreme Court overturning his 2018 sex Assault Conviction in which a jury found him guilty of drugging and sexually assaulting Andrea Constand. He had relied on a previous prosecutor who told him he would not be charged. He was driven off from a maximum Security Facility near philadelphia. Now 83 years old. He served nearly three years of his three to tenyear sentence. The court says Cosby Cannot be retried on the same charges. Joining us now Christine Gibbons who served as a Special Prosecutor on the team that sent cosby to prison in 2018. Lucky for us she is now an msnbc legal analyst. Also harry litman. Claire is still with us. First, take me through how this happens. How does it happen, harry, that someone just walks free like this today . Its the constitution. So in 2004, the previous District Attorney unable to charge cosby said i wont charge him because i want the best justice we can get and that will be several suits. He told him and he testified in these proceedings. I meant it absolutely and for all time. The successor to that guy ignored it. They said it wasnt stitched up enough, not formal enough. But the Pennsylvania Supreme Court understandably under the constitution said, look, the prosecution told cosby he wouldnt have to have any Fifth Amendment implications. He waived. It was reasonable. And then they took that evan used it to convict him. No fair. It has to be thrown out. They made a deal, a loose one, the production has to be sure that the doubts have to go against them when they make that sort of deal and they didnt do it right here. Christine, i am dying to know what is going through your mind. This shot, we expect Bill Cosby to make some remarks in a few moments. First, your thoughts and analysis of today. Sure. As a Practicing Attorney in pennsylvania, i always respect the decisions and the opinion of our great justices. I have to disagree with Harrys Recitation of the facts. Of course as a prosecutor we would be asserted and they found there was no agreement. When these nonprosecutorial agreements are made they are in writing and they are approved by the court. In addition to that, shortly after declining charges Bruce Cass tore made clear in a public statement that he would revisit the decision. Why would an individual do that if he said i promise ill never prosecute you . In addition to that Bruce Castor testified during a hearing stating he not only told Bill Cosby that but the civil attorneys that. And the civil attorneys made very clear during their testimony that never happened. When you look at those facts coupled with additional things sup as Bill Cosby made no incriminating statements regarding the jurisdiction by which Bruce Castor would be able to immunize him. He was only the District Attorney of the county. Bill cosby testified in his deposition that he never sexually assaulted Andrea Constand. Incriminating statements were made regarding other women in other Jurisdictions None of which he would have had the ability to immunize him from because he was not the d. A. Of those other counties of those other states. I have to respectfully disagree. Nicolle, very quickly go ahead, harry. Very quickly, sure, i understand the factual dispute and im not and the different facts that say it wasnt a real agreement. The supreme court says if you make that kind of even informal agreement it needs to be honored. I understand the point, well, it wasnt really stitched up and the supreme court says the burden lies on the prosecution. I want to note thats the principle. Nothing that in any way takes away from the me, too movement or important legal tools that people are now developing to go after injuries that Lay Unredressed for so long. Nowhere in anything i read is there any suggestion Bill Cosby is not guilty of that which he was accused. This seems to be a question of the prosecutors conduct. Can you, one, tell me if that is correct and, two, to speak to the Gut Punch this is to his survivors. A good prosecutor, as the prosecutor just indicated, would never have given immunity by a Press Release. And thats what the supreme court decided. That Press Release signed by the d. A. Saying he wasnt going to prosecute Bill Cosby was enough for that defendant to rely on and, therefore, gave incriminating evidence and didnt take the Fifth Amendment going forward. Now the other thing that complicates this, nicolle, without making it too complicated for everyone listening, there were civil lawyers involved of the victim. And so as they saw the prosecutor looking towards a denial of filing charges, they were focused on trying to make sure that Bill Cosby could not hide behind the Fifth Amendment. And so thats really the point the supreme court was trying to make. Is that Bill Cosby might have been advised differently in the civil case to not talk so much and just use the Fifth Amendment to protect himself. He did not do that, and they are saying that that is what is unfair about this case and denied him due process. But at its essence is the very bad precedent that future prosecutors can be bound by a Press Release of a previous prosecutor that frankly didnt comply with the Immunity Statutes of pennsylvania. Did that make sense . I hope so. I tried to keep it simple. No, its its complicated, but i think one of the emotional reactions was articulated by e. Jean carroll. I want to ask you about this, this is why victims of Sexual Assault dont come forward. Some of the statements that Bruce Castor made such as delayed disclosure, no corroborating evidence, that she was making inconsistent statements actually hit me the most as to why he did not prosecute. As we look forward now, we understand that delayed disclosure is the norm, not the exception. Thats because theres a lot of trauma and it takes survivors a while to process what happened to them. Specifically here where Andrea Constand was the manager of operations at Temple University where he was a major benefactor, where you had that power dynamic imbalance. You also had to weigh up against the fact that he is a largerthanlife individual. So delayed disclosure is not only normal in most cases of Sexual Assault but it was specifically prevalent here. And i think those myths are what consistently hold victims and survivors back from being able to obtain justice. I think paper documents, such as whether it be a Nondisclosure Agreement or even a nonprosecutorial agreement also impair the journey or the road by which victims can walk in order to obtain justice. Another thing i want to highlight which also was stated is this is a mere technicality. This has no bearing on the merits of the case. Those 12 jurors who were peers of mr. Cosby and Andrea Constand looked him in his face after hearing her testify and said guilty, guilty, guilty. Yes, while the guilty conviction no longer stands, behind that guilty conviction is their finding that he drugged andrea to the point that she was incapable of consenting and then sexually abused her. Were going to turn to one more story this hour. Sources are telling Nbc News that tomorrow is the day. Tomorrow in New York city the manhattan d. A. s office is expected to charge the Trump Organization with taxrelated crimes. One person has told Nbc News that the charges are expected to be filed around 2 00 p. M. Eastern. It is unclear whether or not the Trump Organizations Chief Financial Officer and longtime trump associate, allen weisselberg, will also be charged criminally. Weisselberg and his attorneys have not commented on the investigation or the impending charges. Harry and claire are still here. Harry, reading the tea leaves, what are you expecting tomorrow . Weisselberg will be charged. It wont be the kind of thunderous things weve been talking about the last few weeks but they went to him and said, look, cooperate or were coming at you right now. He said no, come at me. They will charge him in the scheme of things. Its relatively modest but a serious felony and could lead to at least some jail time. More importantly, Grand Jury continues to sit until november. They have made it clear its just a first step. But i anticipate it will be weisselberg and some entity within the organization. Maybe not the organization itself, maybe a holding corporation, but that also will be charged with knowingly being fraudulent on the taxes. Claire, i only raise this because its a play thats been run before by the twiceimpeached, disgraced expresident who happens to be named individual Number One in michael cohens charging documents. Total and complete exoneration, that was his reaction to the Mueller Report which found six acts of Criminal Obstruction Of Justice and found a shared mission between americas adversary, russia, and the trump campaign. What do you expect the gap to be between the reality, which is that his company is expected to be charged criminally tomorrow, perhaps his top Money Man and closest confidant, and what we expect the disgraced expresident to say and do . The times writes about how they compile their video which clocks in at over 40 minutes. The times visual Investigation Team spent several months reviewing thousands of videos, many filmed by T Rioters themselves and since deleted from Social Media. We filed motions to unseal Police Body Camera footage, scoured Law Enforcement radio communications and synchronized and mapped the visual evidence. Heres some more from their chilling video. Its now that protesters all along the east barricades surge forward. Officers are overwhelmed from several directions. And retreat to guard capitol entrances. But these rioters believe they have been deputized by their president to stop a crime. And now they start trying to get into the building itself. The capitol is now surrounded. The frightening picture painted by The Times piecing together of videos and communications from that day just serves to reinforce the urgent need to have investigators look into how this assault was able to unfold. An action only two republicans joined their democratic colleagues in voting for today. Congresswoman Liz Cheney and congressman Adam Kinzinger were the sole republicans to vote to have a select committee to investigate the attack. The attack has over 500 rioters charged for their roles that day. One of the rioters streamed a video on youtube after he left the Court House Yesterday calling himself, quote, a political prisoner and said this. Quote, Donald Trump, please pay for my legal fees. This all happened because of you. Still uncovering the horrors of the insurrection six months ago is where we start this hour with some of our favorite reporters and friends. Eugene daniels is here, white House Correspondent for politico, Playbook Coauthor as well as at Msnbc Contributor. I want to start with you, Frank Figliuzzi, and understand if this is the kind of recreation that prosecutors and investigators are undergoing to reach their Charging Decisions . The short answer is yes. First, let me commend the team at the New York times who put this together. It is worthy of watching. I would urge every american who wants to try to get their head around exactly what that day was like to watch this. For those americans who think the day was not a violent day, was not an unlawful day or an attack on our system of democracy, please watch this. Youll come away with your own opinion, but you have an obligation to watch this. Yes, investigators are doing this. Theyre going to do it in kind of a computerassisted Design Way and theyre going to do this from reality. Todays investigative world is Body Cams and Security Cameras and geolocating Cell Phones and putting it altogether. But here, i have three key takeaways from this product. Number one, the influence Of Trump that day and leading up to that day. As you watch this video, you see people literally echoing, regurgitating the language they heard moments ago, moments previously on the ellipse and theyre telling the Police Officers the exact words used by trump and other speakers. So Number One, influence Of Trump. Number two, the power of the crowd. The New York times analysis comes out with an opinion that this was not some highly sophisticated, highly organized and coordinated event, but rather the presence, the small enough presence of some Oath Keepers, some proud boys and some 3 ers was enough to incite this crowd to extreme violence. So if you ask yourself if you say this is great that were arresting all these proud boys and Oath Keepers, watch this video and understand it didnt take more than a handful of them to incite hundreds if not thousands of people to enter and breach security. And then number three, the cops, the police. The New York times finds eight different locations of breaching the security at the capitol. They also note with great interest how quickly they were able to dispatch this crowd once they had enough equipment and resources on hand. What does that mean . It means if they had had those resources there in the first place, they would have repelled this crowd. So just a compelling piece, worthy of watching. Power of the crowd, power Of Trump, failure by the police that day. I always listen to what Frank Figliuzzi says, and i had a sense he would tell us to watch some more. Let me play some more of this times video journalism. I want to play the part. Officer Eugene Goodman is a known hero, known for his heroics that day. Let me play some more of just how close we came to something much worse that he saved us from. Lets watch. In this hallway directly overhead the rioters, Officer Eugene Goodman is sprinting to overtake them. He passes mitt romney, who he warns to turn around. Reinforcements are following behind. Goodman overtakes the mob, goes downstairs and intercepts them. He holds them off while backup arrives upstairs. Where are they counting . Where are they counting . Behind these rioters and just feet away is an Escape Route where lawmakers and Senate Staff are now fleeing. Just one officer stands guard. Keeping his composure, goodman draws the mob away from that Escape Route to where reinforcements are waiting. Hes one person. Were thousands. He glances towards the senate and realizes the door is unguarded. Goodman shoves the protester again, lures the mob away and brings them into that line of fellow officers. Frank, i watched this ive seen a lot of this, and this was part of the impeachment trial. For some reason watching this again, i felt all of the horror of watching these events in realtime on January 6 and trying to cover them in realtime because it just felt so close to something so much worse. What do you see with your background in Law Enforcement and counterintelligence . Well, even though i have that background, it is difficult for me to watch again. And i you know, i had to make a personal decision as to whether or not i was going to go through this whole thing today. And i did, because i was going to comment on it. Ordinarily, ive had enough of the violence depicted from that day. But i ask myself this. Are we in a position to do better next time . Has anything changed that means this wont happen again, right . And youve been reporting, the network has been reporting that we have now a select committee thats going to come together and look at what happened. But is it going to be taken seriously . Are the republicans going to take it seriously . Is everyone going to show up who gets subpoenaed . Are we going to get to the Root Cause of what happened . Is there a national willingness to do that . When i look at this, thats what i keep asking myself is what has changed, what is going to stop this from happening again . Just in the last 24 hours, dhs has released another alert talking about kind of a long, hot summer, a perfect storm this summer. Were looking at a former president and his organization perhaps being indicted tomorrow. The organization as far as we know. We have a President Today whos a former President Today whos on the Mexican American Border with a governor talking about chaos at the border. What has changed that ensures us this wont happen again . Im hard pressed to tell you what has changed. Let me be a little more blunt than frank. Nothing has changed. Eugene, let me show you a little bit more of this. This is Speaker Pelosis staff and just how close they came to the violence. Here we come, nancy. Are you in there . Huddled together under a table, Pelosis Staff record whats happening. We need Capitol Police i think to come into the hallway. Theyre poundsing on doors trying to find her. One rioter tries to break into that same room. Inside, staffers are silent as they record him pounding. He gets through the first door but the second door keeps him out. Its a scene that again shows just how compromised the u. S. Government has become. Eugene, let me do one more thing. Let me play one more piece of sound and i promise to turn it over to all of you. This is Speaker Pelosi today during the House Debate on the floor about the republicans refusal to acknowledge this day. Many across the Aisle Refuse to admit the truth. They refuse to admit the truth when they voted against certifying the president , president Bidens Election that night. They refused to admit the truth when they voted against the creating of a bipartisan commission to investigate the attack. They refused to admit the truth when they called that day a normal tourist visit. And today when many will vote against establishing a select committee to investigate that day, they will again refuse to admit the truth. So, eugene, here we are. The republican party addicted to their own disinformation at this point and incapable of even coming together in an evenhanded, bipartisan commission to investigate the insurrection. Thats why were here. Thats why Speaker Pelosi today appointed a or is set to appoint members to a select committee to investigate. Absolutely. I mean just shoutout to the New York times for some amazing journalism with this 40minute Video, kind of taking us through this really disturbing, seeing just how close a lot of bad really more bad things could have happened that day. I mean youre right, nicolle, one of the things weve been hearing from republicans is that now this is going to be led by democrats, that this should be an Equal Opportunity Commission committee, which is what they voted down just weeks ago. And so that part of it is a little bit confusing, right . They had the chance. Basically they sent representative katko in, mccarthy did, to have these conversations, to negotiate with House Democrats and how democratic leadership to figure out what this the 9 11style Commission would look like and basically got almost every single thing they wanted. So now were going to move forward, like frank was saying, people are probably not going to have a lot of faith in it, republicans wont, because of what weve already seen. One, the fact that they have voted they have already started to kind of talk about how much they dont think this is a good process, a fair process. They have also spent a lot of time for weeks and months, months i guess were in july or june here, months talking about and whitewashing what happened on January 6th, and that aspect of it has been confusing for the people that were there who werent just it wasnt just Nancy Pelosi. They werent just looking for aoc, right . According to them, the rioters, the insurrectionists, to hang the Vice President of the united states at that time, right . And so this wasnt about them just looking for democrats, this was about disrupting this process and possibly getting their hands on lawmakers. I think the fact that it seems that this country may never get to the bottom of this in a way that we can all move forward and continue to have a discussion about how this wont happen again is something that people on The Hill, even republicans, are pretty disappointed about. So, matt dowd, i have two thoughts, i wonder if you agree and then ill just turn this over to you. One, everything about the response to the insurrection and Donald Trumps role in inciting it has been bipartisan. Both the decision to impeach him, the decision to convict him, the decision in the house to have a bipartisan commission to investigate and even the vote in the senate. Now, it all came up short for that to come to pass. But the only thing, the only thing thats partisan is the coverup. The only thing that has one party involved is the coverup and that party is the republican party. So i actually think the politics of a select committee for the democrats are fantastic. I think they should start tomorrow and those hearings should be in Prime Time. I completely agree with you, nicolle. I mean i have to say just sounding off something that frank said, watching that video, you know me, nicolle, im a Pretty Zen person. I do all my stuff, im Pretty Zen. It makes me so angry. It makes me so angry. Not only just angry at Donald Trump and all of that and obviously the people that did it and everything they were involved in, which they should be held accountable. But these people were lied to, incited, encouraged to do this, right . They were lied, to incited, encouraged to do this by our leaders, by our leaders in this country. And every other moment in our history when weve had an attack on our democracy like this was, the country united, the leaders came together, whether it was World War ii, whether it was after 9 11 as you fully know well, all of those things. That is the exact opposite thing thats happening in this case. And its fully the person and the people that im most angry at, Donald Trump is gone and we have to deal with him and all of that, but its the republicans in office today, not only in washington, d. C. And around the country that are just looking away from this, either explaining away or looking away not wanting to talk about what just happened. Watching that 40minute Video and watching all of this happen, it makes you so angry that we have a political party in our country that does not care. And not only do they not care about finding out the truth, they dont care about finding out the truth, they actually dont care about their own voters. They dont care about their own voters. Theyll cut them loose as quickly as they got into trouble. Ive said this before. If somebody is willing to lie to you, not share your values and not care about you, they think youre a yahoo. All these republicans think all these voters that they have as their base are yahoos and theyre just fully willing to go along. The only people trying to actually stand up for the rights of these voters is the democratic party. The democratic party is the only party trying to defend democracy in this moment and stand up for trump voters and at some point i hope in the course of these elections we realize this. But the fact that were at this point and i agree with you completely the select committee should be Prime Time. I think the country wants to know what happened and whos responsible. I hope we hold people more accountable than the 400 or 500 people arrested at the capitol. I hope we hold people who hold offices and get federal paychecks responsible. I want to follow up with you, matthew. I want to read you what Liz Cheney said. Shes one of the two republicans who voted for the select committee. Adam kinzinger went so far as to say that if Speaker Pelosi asked him to serve on it as one of her picks he would serve if asked. Heres Liz Cheneys statement. Our nation and the families of the brave Law Enforcement officers who were injured defending us or died following the attack deserve answers. I believe this select committee is our only remaining option. I will vote to support it. There is this thing thats taken hold, matt dowd, and its from the sort of Success And Sort of well ironed out Propaganda Machine on the right that im ashamed to say i was a part of for some of my career in republican politics. But they have, i think, gotten into democrats heads that this is going to be partisan and, therefore, not credible. The benghazi committee is not the right historical parallel because it was the 12th Or 13th investigation and the committee was appointed in 2014. Senator mccaskill corrected Sam Stein last hour. But it had vast power. I mean the reason they got ahold of all of Hillary Clintons emails because the committee had vast Subpoena Power. You couldnt deny a subpoena. This committee will have credibility. Liz cheney has said its the only option. Adam kinzinger has said hell serve on it. And they will have the Subpoena Power to seize documents and Phone Records and testimony. What is your advice as this first investigation commences for the democrats . I would say the truth is your goal. Forget about the goal being bipartisanship or being measured. The truth is the goal in this, right . You can harken back to me were at the most perilous moment in our Countrys History since 1861. In the aftermath of 1861 and the civil war, the republicans didnt worry about, oh, lets cut a deal on civil rights or on Voting Rights for former slaves. They were just like were going to do the right thing and were going to establish Justice And Equality and we dont care if we get a single democratic vote. The democrats need to focus on this and i think they actually every day if they talk about infrastructure on highways, they should be talking about democracy and the sa all the on democracy and the continued assault on democracy, because the assault on democracy is not just captured in that video. The assault on democracy is getting done in almost every State Capitol in the country right now. For me democrats go full bore partisan on this. Go full bore partisan on this and make the truth your north star. Eugene daniels, whats the likelihood that that is the governing principle behind how democrats approach this moment . I think it depends on who you ask. I think there are going to be some democrats who are going to go full tilt on this. But i do think that Nancy Pelosi for one, she wants this to be seen as much as she possibly can at this point in the world that we live in to be seen as credible in the bipartisan sense, right . Making sure that republicans dont have a reason to continue to call this partisan even though they kind of created this as a partisan endeavor. So i think thats what were going to see. Shes a little bit more careful. But shes also said and other leaders on The Hill and in the White House have said they dont think this is the only investigation that can happen. They have even talked about Holding Out Hope for the 9 11style Commission. I think Thats Something thats really interesting. Will that happen . Hard to see. Its hard to see how republicans would jump on board all of a sudden. But like you said, nicolle, we are going to find a lot of things out. Like matt is saying, were going to have to reporters, people in the media are just going to have to be honest about what were hearing and what were seeing and whos to blame for these things. Matt dowd is still with us. Paul, i read this with horror. I read it and said we need paul to come on tomorrow and talk about this. But is this Flashing Red . Not to overuse that term that ive come to use for the threat of domestic violent extremism. Is it Flashing Red inside the military . Yes, and it was Flashing Red a year ago, two years ago. This is the Number One national Security Threat in america. Ive been saying that for years, others have been saying that for years. Domestic extremists who can plan to attack not just the federal government, but local government and american citizens. This is the new war on terrorism. We used to fear Al Qaeda or isis bombers. Now we fear guys like this. It only takes one. It just takes one Timothy Mcveigh, it takes one active Duty Marine to inflict mass casualties and serious damage. So this is something the military was slow to recognize. Policies were slow to change. And folks have fallen through the cracks. Well never know how many others we dont know about. The fbi, cia, whoever else has caught some of these guys and gals, maybe theyre behind bars somewhere else, it only takes one. The fbi is still hunting many of them that were part of January 6th. This is the Number One Flashing Red light for the pentagon, for the president and i hope for all americans. Paul, what can be done to kind of loosen lines of communication to sort of i mean if after 9 11 it was if you see something, say something. What does that look like inside the military . Well, i always think it starts at the top with a command climate. We had a president who was stoking this, continues to stoke this for a long time in President Trump that i call president mayhem. He politicized the military, weaponized the military, and that Legacy And Playbook is continuing now with everything from the attacks on general milley to Governor Noem in South Dakota sending the National Guard down to the border because she wants to. So it starts at the top and creates an environment where people feel like this is acceptable, welcomed and encouraged. But then at the tactical level within the units, weve got to screen more aggressively for extremist connections, weve got to kick people out and weve got to really get in their business. Weve been hands off for a long time. Ive said this over and over again. Last year you could fly a confederate flag in the Army Barracks barracks. That was allowed. Now theyre playing catchup. America has to be involved. This is not just the militarys problem, this is americas problem and the military is a reflection of that. But extremists will actively recruit, anyone who can cause damage. Thats what isis does in the Middle East and thats what extremists are going to do back here. Matt dowd, we are in so many ways hindered with this mission of rooting out extremism in our own country and especially in the military. It seems that foreign adversaries have exploited those structural challenges. But now enemies within seem to be doing the same thing. What in your view is that sort of whole of Society Solution Look like . Well, first, a shoutout to my friend, paul. My oldest son daniel did two tours in iraq, went to work for paul after he got back. A great organization. So shoutout to paul for all hes done and everything and his friendship he gave to my oldest son. I think this is all part of what we were just talking about before. And i think that part of the the biggest part of the problem is you have a political party right now and a major Cable News Network that is Feeding White grievance, thats Feeding White grievance. I think one of the biggest tragedies and one of the biggest horrific things of the Trump Presidency was the permission structure, permissiveness he gave for White Supremacists to act out in the course of this. And keep in mind, its not only the military who are legally allowed to carry guns and use guns and Law Enforcement whos legally allowed to carry and use guns, but theres a lot of people in america. We have over 300 Million guns in this country. So you look at the combination of the white supremacy. I dont think its risen, i think its just evidenced itself.
