As we come on the air down in florida, new details are breaking this morning, Nbc News showing the head of the Condo Board sounding the alarm about possible structural damage to the building just a couple of months before it collapsed. An 11th Victim found in the debris youre looking at with officials set to give an update next hour for the first time we are hearing internal Radio Calls from the first responders as they arrived to the horrific scene. Plus Capitol Hill Today the January 6th select Committee gets its first procedural vote ahead of the real Deal Vote Tomorrow as Speaker Pelosi considers a republican for the battle as one of her own picks. And Nbc News reporting on Police Reform apparently teetering on the brink of collapse, and another Decision Day at the Supreme Court, with time ticking on the term. Five cases yet to be decided. We are watching for opinions on two big ones around Voting Rights and charitable donations which could have an impact on campaign finance. A lot to watch this morning as we begin in washington. Im Hallie Jackson with you for the next hour. In surfside, florida with antonio Hilton And Ron allen. We are getting new details on the letter Nbc News obtained sounding the alarm about potential damage this year, this spring, right, bring us Up To speed on what were learning now. Reporter today as weve Reach Day six of this Search And Rescue mission here in surfside, the situation has become quite grim and the news is adding to the Frustration And Heartbreak in this story. Were at 11 people confirmed dead and 150 people unaccounted for. As residents grieve and start to lose hope many of their friends or Loved Ones could have survived six days under the rubble theyre consuming news. Nbc news obtained this letter from April Of 2021 in which the Board Of Directors reached out to residents and owners asking them to support a multimilliondollar investment in repairs and acknowledge extensive damage to the building. It says some of the damage could multiply exponentially, the Concrete Deterioration is accelerating, and so it gives you a sense what have were hearing from some of the residents they sensed their Condo Association was aware the building was not in great shape and add to that Exclusive Reporting from the Miami Herald and exclusive photographs they obtained that show extensive Standing Water and corrosion just two days before the building came down, Nbc News has not spoken to the contractor who took these photos but this has been a large part of the conversation here in surfside in the last couple of hours and adding to the Frustration And Pain as people learn more about what happened that night. Take a listen to audio weve obtained of first responders from that night of the collapse. 76, i see many people on the balconies, theres the building is gone. There are no elevators. It almost resembles the trade center. Some people are evacuating. Say they sound like they heard a bomb. Reporter what youve heard right there matches the testimony were hearing from survivors, some of whom filed lawsuits, Class Action lawsuits that target the same Condo Association and other entities they believe may have known about damage to the building prior to all of this. It may be months before we fully understand the cause of what happened but all of the residents want answers now. Understandable. Ron, youve been talking and reporting on families, friends, people who are on day six of this agonizing wait. I wonder what youve been hearing since news of this letter sounding the Alarm Back in april, the pictures were seeing that antonio talked about from the Miami Herald. How is that affecting the folks that youre talking to there . Reporter its adding to the pain and the frustration, and its adding to the feeling that maybe this could have been prevented. Of course we dont know that. Its going to take many months if not longer to sort out what may have caused this building to collapse. Its probably a combination of things and may never be clear exactly. The families are agonizing through into day six now. Theres not been any positive, good news since hours after the collapse, when the last survivor was pulled from the rubble. The Rescue Workers are going around the clock 24 hours a day looking for crevasses, cracks. Last might we went to a vigil on the beach. Dozens of people from the community, Family Members as well and you get a sense of the Range And Depth of emotions are feeling, grief, sorrow. Hope is the word you hear most often holding onto Hope Something positive will happen soon. Here is what some of the folks had to say about what they were thinking and feeling. My sister moved in there two months ago. I know shes fighting. All those people in the building we feel an afinit to all of them. Thats the Way Sushside was. Reporter individual stories are emerging from this who are Tisk Set of events. Cassie Bildeau Stranton was on the phone with her husband and said she saw the Pool Collapse into a Sink Hole and we know that some of these reports about damage the Building Point to structural damage here and around the Pool Deck which may have been a contributing factor to all of this. She was on the phone, the Phone Line went dad and we of course know what happened after that. We hear individual stories, how this community is feeling, we expect a briefing shortly where people are hoping there will be some good news. Hearing these reports suggesting that there were warning signs that may have been ignored or may not have been acted on quickly enough, because we do know that there were some repairs going on at the building, some 9 Million in repairs beginning on the roof as i understand it. So there were problems identified. They were trying to do something but just such a combination of events that led to such a horrific event. Im sure people living in this building may have been told there were problems, structural damage but im sure none thought that a building would collapse. Its just something thats unheard of and all of that adds to the grief here but again, the word that we hear more often than not, constantly is hope and that this is a Rescue Operation under way. Hallie . Antonia, the Letter And Ron points this out, there have been these warnings including one just from april and when you look at that letter specifically talks about how it is, i want to read from it because i think its important. Its impossible to know the extent of the damage to the underlying rebar until the concrete is opening up or is opened up. Oftentimes the damage is more extensive than can be determined by the inspection of the surface. Ron makes a point there was concern about this buildings but what about other buildings . Were getting new information from the mayor of miamidade county, who weve had on The Show in the last couple of days talking about they looked at inspections, status of other buildings along the similar stretch of coastline. Reporter it absolutely has been a major concern. Ive had conversations with people who live in the buildings so you can see behind me here who have been talking about that consistently over the last several days. The same architect and builders who constructed the South Tower constructed a Sister Building A Block away from where i am and many of its residents who have been under a voluntary evacuation have just up and left. I spoke to a woman who lives here and had a friend who lived in the South Tower and unaccounted tell me through tears she is going to be moving out for at least a couple weeks. Not only has this been a traumatic experience to live near so much Death And Heartbreak over the last several days but shes lives in front i a building built by the same people with a similar layout. Shes worried that building could collapse, she is not safe. Officials havent seen signs in the buildings of anything concerning but there is going to be an audit announced by the mayor of miamidade of all buildings over 40 years old over the next 2030days. When youre a resident here 30 days sounds like a long time. You want to know youre safe right now. Hallie . Antonia hylton and ron allen, thank you. Live you are looking at members of republican leadership, listening in to see what they might say about the bill that would establish a January 6th select Committee, headed for its first procedural vote, big vote happens In The House tomorrow. I bring in Garrett Haake on Capitol Hill. Less of a question on whether this will pass at all because it probably will. Bigger question is who is going to be on it, with news coming out this morning whether the House Speaker might name a republican to the Committee, there is speculation might leader mccarthy Name Somebody on his Side Margerie Taylor green, is that out of The Realm Of Possibility . I dont think it is out of The Realm Of Possibility. The drama is not whether it will be created but who will be the members, the chairperson and so on. The way the Committee is expected to break down, Speaker Pelosi has written into this bill she gets eight unilateral picks for this Committee, five picks in consultation with the minority leader, effectively republican picks. Pelosi aide has let it be known that the speaker is at least considering the possibility of appointing a republican which would shift in theory the balance to be a little bit closer to neutral and has a certain sorkinesque element to it. There may not be that many republicans interested in this. It does not seem out of The Realm Of Possibility at all when do you think well know Time Line on who these names are . Reporter not until after the vote at the soonest. The first well probably hear will be the selection of the chairman who will have some consultation with the speaker about filling out the rest of the seats on the democratic side. Republicans have pulled tactical political advantage in that they can wait and see how the democrats want to compose their side and then make their choices. Id be surprised if its this week. We have Breaking News from the White House. Weve been talking about whats happened . Surfside, florida. President biden is confirming he will go to florida as early as thursday. Hes making the remarks in the last three minutes or so as weve been on the air on the South Lawn of the White House. Mike memoli joins us live. There had been a discussion from the day after the Building Collapse happened whether President Biden in his role as concealerinchief would go doyne to the scene in florida to talk with folks there . Reporter thats right, hallie. What the White House has been insisting throughout this process is as much as the president wants to play that role thats played so often during the course of his public career he does not want to be a distraction. So many federal resources have been surging down there to assist with the Recovery Efforts and what the president did not want to do is all the logistics and infrastructure that accompany a president ial visit this nature would be a distraction from that. The President Wust speaking to reporters as we boarded Marine One headed to wisconsin selling his Infrastructure Plan hopes to get there as soon as thursday. Its significant we should note as we know the president s schedule for the week, thursday had been a hole in that schedule so it had been free for them to schedule this. We also had been expecting to hear him talk about Voting Rights, the president indicating next week he would be discussing that important issue, but at the moment obviously thats something thats of foremost concern for this administration being able to be able to visit with those and potentially sola as so many people are waiting to be identified. This is one of the first significant incidents that Joe Biden as president will be traveling for a moment like this, taking on this role as you say to provide some solace, to provide potentially some comfort to these families who as weve been talking about here on The Show have been in this gutwrenching wait to get confirmation of what many are increasingly coming to fear is the worst. Ive been on so many of these visits with the president , then the Vice President and also a candidate before and its that personal grief thats shared with others throughout his public career that makes him sort of the unique player in this situation, something that makes him potentially able to share with those who are really just waiting for answers. This is something he has lived through as well and so another note in terms of scheduling that we also learned from the president , he was asked if the First Lady might be traveling to the olympics, traditionally the White House would send a delegation to the opening ceremonies of an olympics. Obviously this Summer Olympics in tokyo not like any olympics before it. What the president said is the First Lady is hoping to be able to go. Its the plan, as he put it, but no details have been finalized, so certainly of interest especially to this network, what happens all things olympics. Mike, quickly on the florida situation, remind our viewers again what the federal response, how the White House has been involved in this. There have been some conversations between top officials and for example the governor of florida . Reporter thats right. We know that the governor of florida, Republican Ron Desantis spoke with the president last week, initially had spoken with local officials and weve been getting regular readouts from the White House exactly the conversations happening at a high level, especially with fema playing a Lead Role in Debbie Wasserman Schultz has been in touched with the White House. The president likes to as often as he can get down there and see things firsthand so the indication based on the president s comments just now is they feel comfortable that he can go there, get that firsthand look but not be a distraction to the kinds of Recovery Efforts that are still very much ongoing. Expected to target the company but not Donald Trump himself, according to the personal lawyer for the former president ralph fischetti. The charges against the Trump Organization and individual employees alleged failure to pay taxes on corporate benefits and perks sinks with what Nbc News has been reporting for several weeks based on our sources. Talk us through how serious the charges would be and what the implications are for trump himself. I think thats a great description, hallie, not unheard of, not super common but it does happen. As prosecutors, we are told we are instructed to try and charge individuals whenever we can, thats where you get the most deterrence. You want to hold people accountable for whatever crimes they may have committed. Corporations, organizations are artificial people under the law and they, too, can be charged. They cant go to jail, obviously but a company, organization, a corporation can be tried, can be convicted, it can be sentenced, it can be fined, it can be placed on probation, all of those things are true. While we definitely have a preference for charging individuals and holding people personally accountable for whatever Misconduct Theyve committed, it is okay, its acceptable and in fact sometimes it makes good sense to charge a company, particularly if its had a long history of misconduct or its rife with fraud, some underlying problem with the company you can charge it, even if you Cant Charge the individuals. And you talk about some of the factors that come into play, chuck. You lay out some questions that might be considered in a decision on whether to charge an organization like did it selfreport misconduct, did they cooperate . Does it have an effective Compliance Program . Whats its History And Something you say is what are the collateral consequences of charging an organization . Explain what that means, what would collateral consequences for the Trump Organization be specifically . What are the repercussions. Arthur anderson was charged with criminal conduct in the enron scandal. They were tried and convicted and went out of business. The collateral consequences for the company, for its employees were enormous, cataclysmic. If you charge a company in a highly regulated industry, say a bank, again, they could lose their license to operate, it could be cataclysmic. For the Trump Organization they are a leverage company, that could mean, that could mean banks would call loans or refuse to further extend credit, and so for a company thats highly leveraged, losing a lot of money, that could be very damaging. Whether or not that happens we have to see how the banks react. We have to see what the indictment says, but as a prosecutor, you always want to be mindful of the collateral consequences, because its not just the company. Its the employees. Its the shareholders. Its customers. Its the supply chain. Maybe not all of that pertains to the Trum Organization but those are the factors deciding whether or not its appropriate to charge a company. Brand new reporting at this hour from Nbc News, now reporting those Police Reform talks on Capitol Hill that seem to be progressing are on the verge of collapse and just in the last couple of minutes we talked to one of the Lead Negotiators about this. Sources telling our team after three months of negotiations, lawmakers are tired of the backandforth, some questioning whether the other side wants a deal or if theres too much political mess involved in this. Some of the forces members of Law Enforcement themselves, lobbyists for outside groups split on the issue and instead of rallies around a bill, you have rural and urban organizations left fighting with each other. Sahil kapur is on Capitol Hill. The Lead Negotiator is confirming what weve been reporting, walk us through the latest in the last couple of minutes. Negotiations of Police Reform do appear to be on thin ice at the moment. And a big part of this as our Colleague Leigh Ann Caldwell reported is a split between Law Enforcement groups, sheriffs and police unions about police accountability, this is a problem a huge part of the Police Reform effort is to raise the standard of accountability for police officers, and potentially make them criminally liable for certain actions of misconduct and that is creating a problem in terms of getting enough congressional support from both sides of the aisle to get this done. Congresswoman Karen Bass who has been as you noted a lead democratic negotiator, i spoke to her just moments ago about this and she sounded skeptical if not pessimistic about the prospects going forward. Lets listen to exactly what she said. Karen bass did not put a hard dead line on negotiations. The time something thin. These have gone on for months and getting close to put up or shut up time. Big picture, this was one of the glimmers of hope in terms of potential bipartisan agreement on not economic issues which have to go through the 06vote threshold, economic issues covid relief and infrastructure, Safety Net can bypass a filibuster. This cannot and there are other negotiations that have collapsed things like gun control, immigration appears to be going nowhere, Voting Rights is not getting bipartisan support. This is the one issue that looked to be possible at the moment things are on thin ice. The negotiators have not fully given up but as you can see the state of plans really shifted, hallie. That is for sure. Thanks for being all over that. Sahil mentioned Infrom Structure in those talks and President Biden headed to wisconsin leaving a couple minutes ago to sell this in wisconsin after writing an oped, neither democrats nor republicans got everything they wanted in this agreement but thats what it means to compromise and reach consensus, the very heart of democracy. Still Mitch Mcconnell hitting the brakes decisions whether to back it or not. He wants to see what the math is on this thing. Let me bring in heidi, start of the national sales pitch. All of this action might be out in washington but the president is coming to the middle of the country. It might not happen in washington until the people demand it. It would matter if this bill gets done at this place. Along the Mississippi River the communities know too well the devastating effects for instance of flooding. It was just north of here in minneapolis that you had the devastating Bridge Collapse that led to a number of fatalities, huge headlines. That was 14 years ago and nothing has happened. Inequities in the northwest part of the state there is almost no broadband for a lot of these rural communities so the president s coming here to make the pitch for this broad Infrastructure Plan that is he says not partisan, All Of Us are hurt by this, republicans, democrats, and he outlined in this memo that was circulaing by his aides some of the devastating statistics on the state of infrastructure in this country. Not a single airport in the united states is in the top 25 worldwide. 45,000 bridges in poor condition, Up To 400,000 schools and Child Care facilities that Risk Lead exposure, Power Outages costing us billions, again the president to make the case that this is hurting us domestically, its also hurting us internationally, because the world is looking to us as a leader of democracy and hoping that democracy can still prove to be something that is effective, where people can get things done, so hes making a domestic and international pitch and then finally, hallie, coming to more rural Working Class Areas like this, and highlighting the fact that if this gets done, this is also a Jobs Bill and that 90 of the jobs would not require a College Degree and that this would create good middle Class Union jobs. Hallie . What have you heard on the ground from folks in the area about this . Reporter there is a mix. A number of conservatives on the Outline Parts of lacrosse who did not vote for President Biden but it seemed theyre willing to give him a shot on this to see what hes going to do with infrastructure, something republicans want as much as democrats. Lacrosse is more democratic but the calculation by the White House is that if they can get something done here on infrastructure, maybe, just maybe some of these folks who had voted democrat in the past may take a second look at Bidens Agenda and may have a more favorable opinion of him. Again, going into the next election theres no other state that is more critical, thats one of the midwestern states like wisconsin where President Biden only won by a sliver, less than a percentage point. Talk to us about conversations Behind Closed Doors how serious is the threat to foregoe the bipartisan deal if you dont get the Reconciliation Deal done . Well focus on passing Infrastructure Deal right now. I think the bipartisan Policy Framework that we have is a good one. Id like to see the Houses Infrastructure Bill be the nucleus, clean water, clean energy and broadband round out the package. We are going to pass an Infrastructure Bill in congress and going to deliver for the american people with it. Whats the number, let me ask you about the reconciliation bill. There are a lot of different numbers depending on the lawmakers you talked to where theyd like to see that. Do you get the sense theres a behind the Scenes Consensus forming on whether were talking 6 Trillion or 2 trillion, and what would you be comfortable with or do you think that is weeks and months away . I think were in for a busy summer of negotiations and Backandforth And Weve got President Biden and Speaker Pelosi and Leader Schumer who are expert hands at these negotiations. The focus is on delivering for my district for massachusetts, for the country on issues that are bipartisan in their very nature, clean water, fixing roads and bridges, upgrading our public transit, providing broadband to rural areas and other underserved populations, these are areas that have broad support with both republicans and democrats and were going to pass them with or without republican votes. Let me ask you about Something Else thats happening on The Hill that is relevant to you over the next 24 hours, this vote to create the January 6th select Committee. 13 members, eight picked by her, five in consultation with the House Republican Leader kevin mccarthy, note its not a unilateral mccarthy pick. Im wondering, do you believe as we have heard discussion about that Nancy Pelosi should pick a republican as one of her choices, one of the eight and who should it be . And before you answer, i know, you know, its going to be Up To the speaker, i know youll say i defer to the speaker on this. Who would you want to see, understanding youre not making the pick and she would. What do you think would be best . I think Speaker Pelosi has been doing this since i was in Middle School and ive got great confidence in her putting this commission together. The american people deserve transparency and accountability. This was an attack on our democracy and should be as apolitical as possible and we need to get answers and set up some recommendations how to prevent it from happening again in the future. Given that youd like to see it be apolitical would it make sense for the balance to be a little more less lopsided and for the speaker to pick a republican . The republicans had their chance to make this a truly apolitical and bipartisan commission and chose trump over truth. Well leave it on that. I understand your reluctance to get into it, congressman. Let me ask you about Something Else, another vote on a resolution that would remove confederate statues from the Statute And One that honors thurgood marshall. A similar resolution passed In The House last year, stalled in the senate. Do you think it will be different this time around . How much do you think the needle moved on this . The dred Scott Decision was one of the low points in american history. Its highly appropriate we take a hard examination of these issues and decline to celebrate those who made decisions that were, that undermine racial justice in our country. First the highest profile stars, somebody the next michael jordan, whatever, also female athletes who have big and loyal audiences but significantly less opportunities to compete and earn money once they graduate. We had one College Athlete on The Show three weeks ago pushing the ncaa to make this change. Watch. Were at the point where all these athletes are tired, weve seen countless athletes speaking out about in important issue and its time for the ncaa to do something. That player, jordan, joins us now, plays for the university of Iowa And Member of the national college players association. Good morning, thanks for being back on. Good morning, thank you for having me. To your point the last time you were on the ncaa has done something. So your reaction here to these restrictions getting loosened up . Really excited and i want to give a lot of Shout Outs to the athletes that spoke up during the Ncaa Tournament during the aetna movement. One of the requests we made was a waiver, whats going to be essentially made here with the ncaa, which is what you see with the council proposing the last couple of days. Hopefully the Board Of Governors release the waiver and im excited for athletes across the country. There is still gray area. The responsibility falls on each individual school to set rules as they see fit. I wonder how you see the challenges, right, for like your school. Iowa might do something different than a Neighboring School in a nearby state. What do you see is the biggest hurdles on this . The biggest hurdle is a lot of the state legislators havent passed a bill yet so that creates a little confusion on what the laws will be, but a lot of it comes down to Nbc And Mark emerit on the Board Of Governors not reacting mick enough. They had the last two years and refused to get something done, waited literally until the last exact date for them to pass something. Its just a lack of leadership, its embarrassment to be a part of the ncaa and im ashamed for the female athletes and male athletes that could have profited off of it during the time being. Female athletes have a large Social Media following that will make a lot of money off their own name. Right, one of the things we were talking about. There is a bright line that you cannot as far as the policy says you still cant get paid to play. That is still a distinction thats being drawn here. Im curious as you think about sponsorship, does this in your view open the door to pay for play for does it shut it . I think down the road that will come up into fruition, as you see with the Supreme Court, Brett Kavanaugh had an opinion that stated about Price Fixing and what ncaa has been doing is illegal in any other business across the entire country, so at some point its going to get there based off of what was already said by some justices, and right now its all about name, image and likeness. I dont believe that will conflict anything and the gap that people are saying that will continue to grow i think will only shrink between these low majors and high majors as Theres Money made for the player as well. It says it will announce the last remaining cases ready to be announced always reserving the possibility they might not finish their homework, and they can be argued cases be reargued and held over to next term. The big Citizens United Case is an example where they did not announce it and had to have it reargued. And if a justice is going to leave a court they typically say so on The Last Day, and we just dont know what Justice Breyer is going to do. If i have to guess, and i dont have to, but i dont think he will i didnt ask for the record, pete. I did not pose that question to you. You are right. This is self imposed. Its just the sense i get from all the vibrations, if you will. Olympic trials that featured breakout stars and broken records and one athlete is now getting attention mostly from conservatives, not for her performance on the field. I want to request you about the hammer thrower. We dont need any more activist athletes. The entire point of the olympic team is to represent the united states of america. Coming in third in the hammer throw, and some conservatives want her off the team. When she reached the podium she turned her back on the flag during the national anthem. This is now turning into basically the latest front in Washingtons Culture wars, if you will, with the White House asked to weigh in. Part of that pride in our country means recognizing there are moment where we are as a country have not lived Up To our highest ideals. Joining me now is the sports and Culture Writer for the athletic. You her Dan Crenshaw saying he doesnt want activist athletes on the u. S. Team. Is that a reasonable expectation . Its not a reasonable expectation. In 2019 she had a similar demonstration during the Pan Am games, and there was significant backlash, and they said they would allow demonstrations in the olympic trials. The fact that its acknowledging to give their Athletes Space to demonstrate these things. Its a little rich that the politicians that we are seeing like Dan Crenshaw and Tom Cotton calling for Gwen Barry to be banned against the olympics, and they are against cancel culture. Yeah, it happened to be during the Podium Ceremony for barry, and she said she feels like she was set up. Talk us through some of the fallout on that front. Its a little complicated, like you said, during the paedz. Its scheduled for a certain time every day, and because of natural delays the Podium Ceremony did not happen until 5 25, and if you watch that go down, shes not planned to do anything, and shes trying to make a decision to react when the anthem was being played, and it started this entire controversy. Its not like the olympics dont have a history of athletes using that international stage to draw attention to issues important to them, and you were thinking about 1968, for example. Right. If you go back and look at the rhetoric used back then, its the same language, and shes come out said i never said i hate the united states, but that she thinks that sports are kind of a distraction and she wants to use her platform to talk about these things. This backlash is out of a playbook that has been frankly successful from a conservative side for more than 60 years now. The kinds of things Gwen Barry is trying to Shine A Light On is Police Reform. A Police Reform negotiation that has been going on for three months basically crumbled and thats really what we need to be talking about, instead of whether or not Gwen Barry is a patriot when shes exercising her right to protest.
