Today tHe trump lawyers had a relatively short less than an Hour Video Call with Manhattan Prosecutors, And tHen trumps criminal defense lawyer, ron frascHetti, told politico about it. Quote, according to fiscHetti, members of Vances Team said tHey were considering bringing charges against tHe Trump Organization And its individual employees related to alleged failures to pay taxes on corporate benefits And perks. We will know what this entails wHen tHe d. A. s office files tHe indictment. I would find it hard to believe that an effort that has taken this much time And tHe resources tHe manhattan d. A. s Office Ha put into this case, tHere are lots of people working on it, amounts only to wHetHer or not freebees And apartments are on tHe tax returns. That may not be tHe case, but i would doubt that. And im sure tHeyll be strategic about who tHeyre going to indict as tHey try to move up tHe Food Chain in tHe Trump Organization. Its pretty remarkable that fiscHetti is being this declarative And this robust in his almost baiting tHe manhattan d. A. To up tHe ante Here. Dan, based on tHe reporting we have on this, And thanks to Donald Trumps lawyer for telling us as much as He has about it, what is your expectation for this week . First, let me agree And disagree with tim. I agree mr. FiscHetti shouldnt be out tHere thumping his cHest because He doesnt know whats coming down tHe road. But i disagree that mr. Trump only gets lawyers that He doesnt pay tHem. I dont think Hes actually so bad. Hes actually talking to every reporter who will listen, but Hes reiterating what He Heard from tHe office. I dont think by saying maybe trump will get indicted down tHe road, Hes not necessarily saying He will, Hes just saying tHeyre not ruling it out. In terms of what happens this week, we take reporting at its word, which is tHeyll do interim charges. Its unusual, its not something that happens all tHe time in state court, it happens more frequently in federal court. But its not unHeard of so it sounds like Heyll-file'>THeyll File tHe charges And tHeyre serious in that we dont want Taxpayer Fringe benefits for organizations like tHe Trump Organization, so it need to be prosecuted, its just not as serious as a lot of tHe Accounting Fraudtype issues that have been tossed around. I suspect well see interim charges, well see weisselberg charged, well see more than one Trump Organization corporations charged, And i assume it will happen this week because thats what were Hearing, but well have to see. Let me just refine my point about Donald Trumps new criminal defense lawyer. Being great in tHe courtroom which i take your word, dan, im going to take it just for granted that Hes a great litigator in tHe courtroom. That tells me nothing about how a lawyer is capable of managing tHe press. And so far this lawyer is facing a press like Hes never faced before in his life And never will face again, And so far not doing a great job. Ti obrian, let me read to you about something from tHe Defense Lawyers. Defense lawyers pointed to tHe harm that He-business'>THe Business, tHe Trump Organization, could face if it were indicted, including damage to its relationships with And-business'>Bank And Business partners, tHe people said. What is tHe danger of that . It could potentially put organizations out of business. We saw this with enron in tHe paths. Banks dont want to lend money to organizations that have criminal charges hanging over tHeir Heads. Donald trump is a developer who has always borrowed a lot of money to do business. He relies on Bank Debt for tHe leverage He needs to do business. If banks of any Stripe Wont extend him loans or continue to do business with him, that could be a death knell. OtHer vendors And Business Partners who may no longer want ton in bed with tHe Trump Organization for both reputational And legal reasons. So its a real it is going to be a Heavy blow on tHe Trump Organization And it could be extremely existential. Dan, so Hen'>Michael CoHens point that wHen this first indictment comes down, it will put pressure on presumably weisselberg, his sons, whoever might actually be named as defendants in this thing, And that creates tHe next chapter of tHe story. We dont know enough, lawrence, to know if tHere are enough charges to put serious pressure. If its what we think it is, over A Million Dollars in evaded income that should have been claimed, should have been withHeld, thats over 100 Million in tax loss, thats not something normal in manhattan with people in jail. That by itself is probably not enough to get people like weisselberg to flip. Certainly tHe ongoing investigation can be. As tHey start compelling people to testify, people who actually have inside knowledge And tHeres really nothing tHey can say. THey have to testify because tHeyre getting immunity, And tHeyll try to do midlevel people first, And that could put pressure on tHem, And It Epends really, ultimately, what tHe substance of tHe charge is, And i think Hen'>Michael CoHen knows better than most of us, but well see if his information is provable. I take him at Face Value that it happened, but lets see if its provable in a court of law, particularly not necessarily relying on him as a witness. Is that a fair understAnding of tHe sequence . I think you pretty much nailed it tHere, lawrence. You know, tHere is going to be a whole bunch of come to Jesus Moments between now And september or october. THe first one is going to be wHen tHey take this Budget Resolution to tHe senate floor. As a veteran of tHe senate, you remember tHere is nothing worse than tHe socalled votearamas wHere tHey vote on one amendment after anotHer, all of which is designed to inflict an amount of political pain. Thats after democrats negotiate with tHemselves about how large tHe budget is going to be. Senator sAnders is looking at 6 Trillion And thats just not going to happen.
