Hoping to get through some big pieces of business before leading tower for the July 4th holiday, including a vote on a select committee to investigate the January 6th riot at the capitol. And Jen Psaki saying the president will do all he can to make sure the bipartisan Infrastructure Deal reached last week reaches his desk. The president looks forward to and expects to sign each piece of legislation into law. Hes going to work his heart out getting both of them across the finish line. We also continue to follow the developmentes from florida where the Death Toll if last weeks partial collapse of a Beach Side Condo complex near miami has unfortunately risen to ten as rescuers continue their painstaking efforts to find 151 people still unaccounted for. And the u. S. Supreme court giving a much needed win to the transgender community. What it rejected a appeal by a Virginia School board to reinstate the transgender bathroom ban. Well have more on that later this hour. We begin with what is going on in the Middle East and the fallout from the usAir Strikes inside iraq and syria. Joining me now, nbc News Tehran Bureau chief in the iranian capital and our pentagon correspondent. I do want to begin with you, courtney. Bring us Up To speed on what we learned about the Air Strikes. Who was targeted and what was the message that the u. S. Is trying to send . So there were three strikes, three locations, one in iraq and two in syria. And they were targeting the iranian backed Shia Militia groups. You may remember one of the groups, december of 2019, kh as theyre called around here was lobbying a bunch of rockets and Firing Rockets in iraq. One proved deadly. A u. S. Contractor was killed near kirkuk. Of thats when the u. S. Took retaliation, struck a number of Kh Facilities and then, of course, led to a Tit For Tat back and forth. So thats one of the Militia Groups were talking about here. Of course, then the strikes were they were rockets was the target, was the threat. Now there are drones. These unmanned aerial vehicles that these Militia Groups are at times, some of them are small drones, theyre literally just crashing them into u. S. Bases with the attempt to damage property and facilities or kill or injure americans and individuals who are there on the facilities. So thats the threat that is being targeted here. It has been a problem in that area for a couple years now. But its really stepped up. We know that at least five more recent strikes by these uavs against u. S. Facilities in it iraq in the last couple of months. But the concern among Defense Officials who i spoke with is theyre getting better and better with the uavs and one could yield lead to casualties, lead to deaths of americans on onest strikes. So thats what theyre trying to work. You heard Anthony Blinken talking about how part of this is for deterence. Thats what military officials are telling us. Ultimately theyre hoping they can deter these from being carried out. They put together some of the uavs and the belief is that they didnt necessarily stop the motivation behind these uav strikes. The hope is that they were able to hold off from some of them occurring in the near future. Courtney, stay with me. Given the government is alleging the groups are backed by the iranian government. Have we had any reaction from tehran . What are they saying about the Air Strikes against these targets . He spoke about it at the Press Conference and said that united states is taking the wrong path in the Region And Washington is continuing the failed policies of the previous administration. And saying that they should quit the region. They should change their behavior and quit the region and let the security of this region be among the people that are living here. Also in a rare rebuke of the u. S. , the Iraqi Military condemned the strikes as a blatant and unacceptable violation of their sovereignty. Now the White House is saying these attacks were ordered to limit the risk of escalation. But the Militia Commanders under the patronage of iran are saying Theyll Target all u. S. Assets in the region until they force the u. S. Out of the Middle East. It doesnt look like its going to dampen any effort of revenge. It comes at a crucial time. The u. S. Just concluded with iranians and europeans, the sixth round of negotiations to try and revive the jcpoa. The question now is whether or not these strikes, whether this is escalation of some iranians are seeing it. It could impact those negotiations . There is always a chance it could impact the negotiations. There are a chance of miscalculations that things could get out of hand and people could get hit. And then the agenda would change. You would see a much bigger reaction out of tehran than just the foreign ministry spokesman. You would have seen the head of the Revolutionary Guards come out condemning the attacks and vowing revenge on the united states. They didnt do that. This was the lowest level of condemnation you could have gotten from the iranians. So i dont think its going to throw the talks off track. But if there is an increase in these attacks and something out of Control Or Calculation happens, then all bets could be off. Courtney, what is the u. S. Militarys position going forward . Are we likely to see more strikes in the future . Have they hinted at more operations that time . Not at this time. There is always the possibility. The one thing we see there is the biden administration this is the second time they approved strikes. This is a slight escalation. There was one location back in february. This is three separate places and one both in iraq and in syria. It is a one and done for now. Unless the Militia Groups continue, i think the real Game Changer here would be if there was a rocket or a uav attack, that killed an american. That would really be a point where we would definitely see response from the u. S. Military. Courtney kube and ali, Thank You. The strikes taking place as President Biden had to do Damage Control on domestic politics, the bipartisan Infrastructure Deal. The president issued a statement, a long statement on Saturday Clarifying that he didnt mean to suggest he wouldnt sign the bipartisan bill without any or another larger bill that includes other democratic priorities including his familys plan. That piece of legislation would likely have to be done through the budget reconciliation process. It would require 51 votes in the senate. The president s statement seemed to ease the worries of some republican senators involved in that agreement. Is the deal still in jeopardy . Is that enough to calm the waters . Is. I sure hope enough. Well see going forward. But ill continue to work for the bill. I am totally confident that president will sign it if it comes to his desk. Joining us now is kelly odonnell. We were hearing from some senators, Senators Cassidy and romney. They appear to be okay with the president s statement. One person who is not and the powerful one that is, republican leader mitch mcconnell. He wants House Speaker Nancy pelosi. He wants senate democratic Leader Chuck Shumer to do the same. So walk us through this. What is mitch Mcconnells Strategy . What could the comments mean for the efforts to get this plan through congress and to the president s desk . He is trying to exploit a misstep by President Biden when he suggested he wouldnt sign the Infrastructure Deal unless that multitrillion dollar economic package came to him now. Of course, President Biden walked that back. He said he is fully committed to this deal and as you note, a number of republican negotiators say that is enough. Mcconnell says that is not enough. He wants Speaker Pelosi and Senator Schumer, the democratic leader, to make that promise to explicitly delink those two things. He is trying to see how far he can push democrats and what kind of concessions he can get out of them as a result of this situation. Notably, mcconnell asked where he stands on this bipartisan deal. He said he was undecided. Take a listen. I havent decided yet. Im certainly encouraged our members to talk to the democrats. We need to get a score. So we need to see whether the proposal is credibly paid for. I think its fair to say id like to see us get there. And i do think the only way we can get there is to delink the two issues. Theyre really separate issues. Now mcconnell has a couple of competing imperatives here. Number one, he doesnt want to pull the rug out from under the republican members who have worked hard to negotiate this deal. And there is a silent contingent of republicans who secretly want this deal to pass even if they vote no. They dont want to be seen as collaborating and working with the biden administration. But mcconnell doesnt like to give democratic president s lektive victim eyes. Hes going to be watching to shape and develop this and see how far he can push democrats in terms of concessions. Lets talk about another thing working through congress, the house expecting to vote this week on forming a select committee to investigate those January 6th riots after senate republicans blocked debate on a bill that would have established an independent commission. You had 35 house republicans who voted for the bill to establish an independent commission. That is unclear. It is possible that they will vote for him. Keep eyes on Liz Cheney and kinsinger. Theyre outspoken critics of president trump. Almost all republicans if not all of them will vote against this bill. This is likely seen as more of a partisan effort after that bipartisan independent commission went down. Were expecting this vote In The House on wednesday, ayman. Lets cross over to 1600 pennsylvania avenue. Kelly, the White House facing a lot of Questions Today about Sundays Air strikes in iraq and syria. Is the White House worried that these strikes could lead to bigger problems for this administration . The broader Middle East . Well, there are concerns in a few areas, ayman. One of that is concerns about the use of force that the president relied on here which is article two of the constitution protecting u. S. Interests. And there is some debate on Capitol Hill whether the president needs to solicit and get support from congress for any kind of Military Action in this new era, especially as iran has been a more aggressive actor. Another concern is the strikes themselves could they potentially trigger some additional pushback and more violence by having retribution coming this way . The u. S. Certainly weighing those factors as the president had to make this decision. I asked Jen Psaki how he considered the Pressure Points and the response about iran was this we continue to believe that and have never held back from noting that iran is a bad actor in the region. And they have taken part in it and supported and participated in problematic extremely problematic behavior in our view. At the same time, we feel that were moving forward and seeking the opportunity to move forward on negotiations to prevent iran from acquiring a nuclear weapon is in our national interest. Thats how well evaluate. So at this point the White House believes the action taken by the president is not in and of itself likely to escalate the tensions. That is, of course, a Concern And Theyll have to measure that and weigh it. I also asked if the decision to do this strike over the weekend had anything to do with the planned visit of the out going president and the White House said there is not a connection between the two things. As you know, the relationship between the u. S. And israel is in a bit of a reset moment now as governments are changing, as well as israels long standing concerns about i rise of power of iran and the on going talks to try to have some sort of nuclear agreement restored. You sponsored a bipartisan bill In The House to repeal the 2002 authorization for use of military force. That bill passed the house but is actually delayed in the senate. The pentagon said the strikes against iranian backed militias were designed to limit the risk of escalation but also to send a clear and unambiguous deterrent message. Do you agree with that assessment . Do you think the strikes will deescalate the situation . Ayman, Thank You for that question. Let me say, of course, our first concern is our troops. Keeping them out of Harms Way and doing everything we can do to protect our troops. Secondly, the authorization what is taking place now is the president is Circumventing Congress once again. Congress is required in any Military Action or being considered by the president. He should come to congress and we should debate this and we should decide whether or not we authorize or not any form of Military Action. And, of course, im concerned that it may escalate. Im looking forward to hearing more of the details. But i think long term, weve got to know what the plans are. We have got to know how we achieve our goals in the region without causing more violence and more escalation. And so i think that its important that congress be more involved. Weve been listening. Now is the time to step up and say to any administration that we want to make sure we exercise our constitutional responsibility and authorize or not the use of force. They will investigate the January 6th attack on the capitol. Who you would like to see Place Ond that committee . What do you think the top priority should be . Im curious to get your thoughts if youre at all concerned that the partisan nature of the committee means that any of its findings can be dismissed by republicans as partisan ranker. The way weve seen in the past with the republicans with their benghazi committee. We have to move forward. Its unfortunate they did not support the establishment of the commission. Which would be very close to the 9 11 commission. But having said that, the speaker is absolutely correct in establishing the select committee. And i hope that it is bipartisan. That is Up To the gop leadership. But we got to get to the bottom of this. Our democracy was at risk. These were insurrectionists who actually caused the death of many, many people. We need to know what has taken place. We need to dig deep into an investigation. So that it will never happen again and lay out the facts. So its Up To the republicans whether or not theyre going to make a bipartisan factual and come up with the truth about what took place on January 6th. But im confident that were going to have the people who have the experience and the knowledge and who really want to understand what exactly took place because this is not over. And we cannot afford to allow this to go on because these militias and these very dangerous organizations are still out there. And we must protect our democracy. We must protect everyone in our country. I was sitting on the floor on January 6th. I know how dangerous these groups are. I want to turn to infrastructure for a moment. Will you vote for the bipartisan Infrastructure Bill if there is no guarantee that an additional package will be passed by democrats via reconciliation . Well, i think that is premature. I think both of the bills are going to have a Duel Track. And our speaker and Senator Schumer are working on the strategy now. Im convinced the president will sign the american families plan. Thats Up To us to make sure that reconciliation is the appropriate process to get the bill to the president. I mean we have to have provisions and a bill that really address the needs of this country including the economy, including all the issues around the green economy. And so we have to have both. And i think were going to have both. And i think that its going to be a Duel Track process and so were going to have, i think, the opportunity to vote for both. All right. Now all this has new reporting reveals a 2018 inspection found there was major structural damage to the concrete below the Pool Deck and abundant cracking in the concrete columns, beams, and walls. Joining me with more from Surf Side, florida, our reporters. Allison, what are we learning about some of the victims and those unaccounted for . The main thing is they were loved immensely. We know eight of the ten. Stacie fang was the first one pulled from the rubble. Her family said there are no words to describe the tragic loss of our beloved stacie. Then there is antonio and gladys lozano. And Friends And Family say Manny Lafo in. T just start the a new job. Anna ortiz and her son Luis Bermudez lost their lives. A teacher that worked at luis High School said he was unforgettable. Then there is christina elvira. There are 151 people still unaccounted for. It has been five days since the South Tower collapsed. But despite that rescuers are adamant they have not given up hope that they could still find someone alive. Family members are holding on to hope as best they can that the rescuers are right. Ayman . People are allowed to visit the site of the collapse. What you are hearing about how theyre feeling as they await news about Loved Ones . More have been able to visit the rubble today. Obviously, its a little tricky given the weather. I just spoke to the mayor of Miamidade County and she told us that buses carrying family members, they made trips to the site today. Not only to be close, perhaps, to their Loved Ones to see and to breathe and also maybe get some butt of hope but to see that rescuers are still working hard and still trying to find anyone who might be alive. Listen to more of what she told us. Its extremely sobering, i think, for the families, to visit and see it being conducted. One of the Rescue Workers tumbled during the course of their visit. They saw that. Fortunately he was not injured. They see the dogs on the pile. The cameras. They see the trench thats been dug. So it brings it very much into reality for them. We have the best, the best Rescue Crew in the world. Theyre here searching. They live to they live to save lives. As long as they hold out hope, i hold out hope. Theres a Make Shift Memorial not far from here with pictures of the unaccounted for and also stuffed animals, Teddy Bears brought there by rescuers after they found them in the collapsed rubble. Ayman . Antonio, lets talk about the investigation. Can you give us any more details about where the investigation into this incident stands and more importantly, what are the outstanding questions they have about the Building Collapse . Right. Ayman, a seem of Veteran Engineers who have worked on crisis of a similar scale have been tapped to come here to Surf Side and investigate all this. I should mention right from the top that this may take a while. And that officials and Community Members and reporters like me have been told that it may take many months, it may be a year before we have a full understanding of what happened that night and why the South Tower came down. But what this work for the engineers is going to look like. I know theyre going to assess the foundation of the building. Theyre going to look at the materials at the concrete. Theyre going to investigate if there was a leak of any kind. Or if Salt Water had an impact or there was erosion. St this say beach front property. People have had questions about that. But the other thing that is important that theyre emphasizing here is that this may not be a straight forward story. And what i mean by that is that there may not be a single villian, a single Person Or Entity accountable for this tragedy. It may be more likely that this is an accumulation of factors of impacts over time. That all came together over the course of a period of years to create this perfect storm and tragedy. While that may not create the easy quick straight forward answer that many of these families so desperately hope and deserve to hear soon, they are committed to seeing this investigation all the way through and officials are committed to taking actions on reforms if that is what the investigation finds is necessary. Antonia, are officials concerned aboutive in the buildings in the surrounding area . Do they know if the company responsible for building that Surf Side condo had any other projects nearby they should be concerned about . There are a ton of questions around. This no other issues have been found in nearby buildings. But engineers have been here right along these blocks already assessing the nearby buildings. And serious questions have been raised because of the 2018 report that you already mentioned. Residents have been talking about. That engineers knew there was damage to the parking garage, Pool Deck and this South Tower that collapsed is almost identical to a building about a block behind me here. The North Tower here. Built by the exact same builders and architect. So the people living in that building are asking that question. Is it unsafe for me to live here too . Could some of the damages exist in the same building that ive been living in right now . People have been voluntarily evacuating i met a woman that lived in front of this site just yesterday who told me shes going to move into a hotel for the next two weeks because she doesnt feel safe. We have about 200 new covid19 cases every day in israel. A few dozen of those are the Breakthrough Cases. People that receive two doses of the Pfizer Vaccine when is what they hughes ear and what theyre also using in the u. S. That sounds extremely worrying. But, remember, the Pfizer Vaccine, 90 effective at stopping infection. That is a great number. Its not 100 . And so we always knew this was going to happen. Sooner or later, there would be people who were fully vaccinated but are getting infected. And the numbers were seeing in israel are in line with those expectations. Now as you said, doctors in israel are very focused on the question of how many people are actually getting sick. And the answer to that is not many. There are 23 people across all of israel right now who are in hospital with severe covid19. Most of these Breakthrough Cases are people who got infected and are now having asymptomatic situation or very, very few cases, very to you symptoms are showing. So in terms of what the u. S. Can learn from this situation, israeli experts are saying vaccinated americans have very little to worry about. In the same way that vaccinated israelis do. But as the Delta Variant president in the u. S. , as it becomes the dominant variant, it is unvaccinated americans that are potentially exposed. And this are foor more of them as a proportion of the population than there are israelis. Is czys one of the most vaccinated countries in the world. About 85 of them fully vaccinated. In the u. S. , that number only about 56. So a much larger proportion of people unvaccinated, potentially still at risk from the Delta Variant. For now, Israels Government has reimposed a national Mask Mandate indoors. They have delayed the return of tourists to israel. But the socalled Coronavirus Cabinet stopped short of taking any further measures. They say they will keep the situation under review but right now they are not talking about new lockdowns or anything like that. Ayman . Thank you. Today is the deadline for attorneys for former president Donald Trump to make their final arguments as to why the Trump Organization should be spared criminal charges over the financial dealings. That is according to the Washington Post. This as former Attorney General Bill Barr is opening up about his split from trump in the final months of his presidency. Joining me now georgetown school of Law Professor Paul butler. Paul, great to you have back on the show. Lets start with the Trump Organization news. Walk us through this reporting. Is it unusual to see this kind of meeting between trumps lawyers and new York Prosecutors . Why would this even be a big deal . Ayman, this is the Trump Organizations last Chance Toer is suede the d. A. Not to prosecute. This is routine and white collar criminal cases and almost never works. When an investigation reach this is stage, prosecutors think that they have enough evidence to get a conviction and so theyre unlikely to drop charges and the stakes could not be higher for Donald Trumps businesses. Just getting charged could be devastating, even before any potential guilty verdict. What an organization with a lot of debt gets charged with a crime, banks can recall the loans. They can require all the outstanding debt to be paid back immediately. If the Trump Organization doesnt have enough assets to pay off the loans, it would have to consider bankruptcy. And so this could be the beginning of the end of Donald Trumps business empires. If the charges are not dropped against the Trump Organization, walk us through the next step in the process. How does this case proceed . So what the investigation seems to have focused on is whether the Trump Organization paid taxes on fringe benefits like when they purchase a condo for an employee or paid somebodys tuition. Even when theres a lot of money at issue, prosecuting The Corporation is quite rare. The issues are usually resolved through a lawsuit where the company just has to pay back the money it owns. So i think what this Development Signals is either the manhattan d. A. Has evidence about other crimes by the Trump Organization that we dont yet know or more likely they want to use this prosecution as leverage, as a way to get people like the cfo of the company to force him to cooperate. So lets turn to this bombshell quote, if you will, from Bill Barr in the atlantic. He said, if it there was evidence of voter fraud, i had no motive to suppress it. But my suspicion all the way along was that there was nothing there. It was all b. S. So what do you think Bill Barr is trying to do here . This is one of the president s most loyal appointments. He is making a record of his actions or simply trying to rewrite his own Legacy And Distance himself from trump . Its the latter. Barr is trying to salvage his reputation for the history books. But its too little, too late. Last december might seem like ancient history. Remember, trump was claiming that he won the election and the Attorney General legitimatized that lie but opened up an investigation. And that want just antidemocratic, ayman that, is against the justice departments own regulations which say that allegations around elections should not be investigated until the vote is certified. So its actually worse. That barr allowed this investigation to go forward when he knew it was all based on a big lie. And, of course, this reporting reveals that he was privately urging barr to contradict the president s baseless fraud claims even as he maintained public silence. How significant is this revelation you think . I mean, its huge. This is a classic example of a person putting party above country. And he knew that trump was telling this lie that destabilize the country and ultimately led to the Violence And Insurrection of January 6th. He didnt care. Of he was more concerned about keeping the Gop Senate Majority than he was about the safety of the country and then he was about our democracy. I think that thats reprehensible. All right. The court decided to leave a lower Court Ruling in place which found the Schools Policy to be unconstitutional. The case is centered on a young man Named Gavin who was born female but identified as male after his Freshman Year of High School. While his principal initially gave him permission to use the boys bathroom, the School Board fired back with a policy to limit bathrooms to what they called corresponding biological genders leading to a Lawsuit Gavin joined my colleague, hallie jackson, immediately following the ruling to share his thoughts on the news. Good to have you with us. What does Todays News Mean for transgender Students Atlarge . Reporter for the rest of the country the simple answer is nothing. It is a victory for Gavin Grimm and is uniformly among the federal courts of appeals that have looked at this issue, which is this, does a School Boards policy saying that students cannot use the bathrooms that match their Gender Identity violate the federal law called Title Ix which says schools cant discriminate on the basis of sex in their School Programs . Theyve all said, yes, it is a violation of Title Ix. Thats what happened in Gavin Grimms case. So all the Supreme Court has done today is leave his lower Court Rulings intact. This doesnt set a national precedent because the Supreme Court is basically not done anything, its not taken the case. Its saying, no, were not going to take the case. The lower Court Ruling stands. Its not a decision on the merits. I think this issue will come back to the Supreme Court because there are lower court challenges over the issue of transgender athletes in school sports. So the court is probably going to have to encounter this yet again. You may recall last term the Supreme Court said title 7, a separate law, does Ban Discrimination against transgender people in employment. And the biden administration has said that same logic applies to title 9 but the Supreme Court didnt enter into the fray on that. Pete, real quick, there was another news making moment today, if you will. The Supreme Court Justice Clarence thomas stating that federal laws against marijuana may no longer be necessary. What prompted these remarks . What might their significance be . Reporter well, he chimed in and the court declined to take up an appeal from a Marijuana Dispensary that said, look, we cant deduct normal Business Expenses like any other business does because the irs wont let us do that because were a marijuana business. And what thomas said the federal law is all over the map on this, that the Justice Department Isnt enforcing the law, Congress Wont give it the money to. Here is the irs enforcing this. He called it a hodgepodge and said maybe the Supreme Courts ruling of, what, 16 years ago, upholding federal Marijuana Laws was time to take another look at it. Interesting.
