From Nbc News in washington, im joshua johnson. Welcome to the week. President Biden Finally has a deal for an Infrastructure Package, but tonight, it could already be in trouble. Months of negotiations culminated on thursday with a an agreement between a bipartisan group of senators and the White House. But mr. Biden upset some republicans when he said this during the announcement of the deal. And i expect, i expect that in the coming months this summer, before the Fiscal Year is over, that we will have voted on this bill, the infrastructure bill, as well as voted on the budget resolution. And thats when theyll but if only one comes to me, im not if this is the only one that comes to me, im not signing it. Its in tandem. Today hes walking that back somewhat. Swla. A white House Statement reads, quote, our bipartisan agreement does not preclude republicans from attempting to defeat my familys plan. The Bottom Line is this, i gave my word to support the Infrastructure Plan and thats what i intend to do, unquote. Mr. Biden plans to travel to wisconsin on tuesday to promote the deal. His goal is to highlight its economic benefits, including creating jobs. Infrastructure was not the only thing this week that had republicans pushing back. This morning, with great solemnity and sadness, im announcing that the house will be establishing a select committee on the January 6th insurrection. Gop lawmakers went after this announcement from House Speaker pelosi, particularly among republicans who blocked legislation last month to establish an independent, nonpartisan commission. Yesterday, House Minority Leader Kevin Mccarthy was blunt about his disapproval. Well, i dont know that there is a select committee. The speaker has never talked to me about it. She hasnt set the scope she didnt tell me about it. I havent seen anything. I dont know what it is. I havent seen one thing voted on. The house could take up the bill to create the select committee next week. Well discuss who could be on that panel with Texas Congresswoman Sheila Jackson Lee in just a moment. But first, lets begin with the latest on that Infrastructure Deal with nbcs Heidi Przybyla. Heidi, what is your sense of where the deal is right now. It sounds like we just had this thing announced and now its in trouble that i guess was perhaps foreseeable, that something might come up one way or another. Its a potential sign of trouble to come down the road. I dont know that its going to throw a huge kink in it, given that the president just issued, joshua, a statement a few hours ago, trying to clean that up. Wow, what a difference a few little words can make here. Basically, what happened was that the president has always indicated that he wanted to move these two bills in tandem. But when he said and intimated that one would be dependent on the other and that he might veto his own deal, that is when you saw a lot of hyperventilation over about 24 hours, there was some Phone Calls that the president made with some of the moderate members who had been in that room with him. He seemed to kind of clean It Up and then we had It Statement which came out today where he said, let me be clear, i will vigorously pursue this deal that we have cut with these moderate republicans and democrats. So for now, it seems that its going to kind of paper this over and calm things down. However, joshua, there is just so many pitfalls and i think that thats the best way that you could explain what just happened here, is that everyone is going to really have their dukes up about protecting what s they believe is the most efficient way of getting this bill passed. At the same time you have the tensions from the progressive wing of the democratic party, which is going to feel like its getting railroaded because none of those priorities for soft infrastructure are included in this bill, which has really been pruned down and focused primarily on traditional hard infrastructure of roads and bridges. Yeah, heidi, i was just going to ask you about that, in terms of how they were able to get this deal done, that seems like one of the keys of it. They obamacare it down between conventional infrastructures, bridges, airports, roads, and what you might call social infrastructure or human infrastructure, and decided to pursue both pieces of that in two different ways. Correct. And that is the only way that this could get through with the composition of this particular congress. And frankly, its the only way it could get through in any congress that we could imagine might come, even after the midterms. If republicans gain control, the president may not get anything even close to this. So hes been working on this for quite a while. Its going to be his Marquee Achievement of his domestic agenda. And the view here in washington will be, if he cant get this done, because it is something that i know from my own tloorgt even senate reporting that Mitch Mcconnell wants to get done, then not much else is going to get done. So we have a narrow window here, given that now it looks like the one thing that is clear is that this is not going to happen immediately, right . There are all of these deadlines, selfimposed deadlines that the president had put out there. And now it looks like this is really going to push into the later summer, maybe even fall. So the problem there is when you have a big deal like this, its almost better to try and wrap It Up with a bow and push it through instead of letting it be picked apart and becoming a political target for both side. Now, when the president said that, im not going to move one without the other, he sounded a lot like the House Speaker, nancy pelosi. This is more a question of how theyre going to get it through congress. Because it may be that she will be unable to get it through her chamber without doing something like this. But for biden, its best that he just takes the deal that was cut here now and tries to move that through by itself and leaves this tactical type of strategy to the House Speaker. Yeah, heidi, you got to what i was going to ask you before. We have to let you go, because we have these two parts of the bill. This physical Infrastructure Piece that would need real bipartisan support from senators to be filibuster proof. And then the human Infrastructure Piece, which is supposedly going to be able to be passed more or less through the budget reconciliation process, which the democrats and the vp can do on their own. How much is the success of this, including the way its done, directly impact other items in the biden Administrations Agenda . This would be kind of the crowning achievement right now, but clearly this is not all he wants to get done in the next four years that he figures hes going to need bipartisan support on. Honestly, joshua, when you look at his agenda, including a lot of the social issues, where he has a lot of pressure from his left flank, like Voting Rights, like gun reform, all of those things would require essentially blowing up the filibuster, because theres no way hes getting it through on 60 votes. And so this is the one thing, this is the thing, and if he doesnt get this, were going to be bumping up then on the midterm elections and a lot of these senators who were in that room are going to get Cold Feet about coming back to the table. And certainly not on any of these other things. I think that might be a good spot to pick up with our next guest, heidi. Much appreciated. Thats Heidi Przybyla starting us off tonight. Lets continue with democratic Congresswoman Sheila Jackson lee of texas. Her district include the Houston Area and she is a member of the House Homeland Security committee. Congresswoman, with regards to where we ended with heidi, what is your sense of where this looks right now, particularly because the filibuster remains such a significant potential obstacle to getting anything else in the biden Administrations Agenda done in the next four years. How does it look to you right now on this Infrastructure Package in terms of its chances becoming law . Joshua, thanks so much for having me. If i might offer my Concern And Sympathy for the people of florida and surfside, miamidade, All Of Us have been offering our prayers and concerns, but more importantly, as a member of the homeland security committee, and knowing Congressman Debbie Wasserman schultz, we have been ready to be of assistance in any way we can, which have been very much in the forefront by president biden. So we continue to pray for that community and there lies, even though its a private ownership, it emphasizes we have no other option than to work this through. And some of the senators that ive had the opportunity to speak with, even though Theres Disagreement about size, and the idea of the bipartisan deal, i believe that there will be no option other than to get it done. And heres how i think it will be done. Obviously, the discussion is that whether we take the smaller deal, which is the compromise, but weve heard speaker pelosi. Weve had a number of us in the democratic caucus and certainly part of the progressive caucus, vice chair, we have been working for a long time to tell the president that america does need a much larger deal, which would include infrastructure, just a few days ago a Pedestrian Bridge in washington, d. C. Collapsed. It didnt get a lot of news, but it did. And so we need a climate fix. And having spent a week or two in texas, where people died in the freeze, we need to be able to deal with that. So i think where were going to go is that members of congress know if their constituents want anything, its infrastructure. But the nation needs the climate change. So i think heres where were going to go. Down to the wire. Its going to go down to the wire. And i do think that theres going to be with the leadership in the house, well find the numbers we need with the president , with the Vice President , and then move on. I do hear some of the commentary about midterms, but weve got to get it done way, way before that. Let me ask you about another issue that i think in another dimension might have been very easily bipartisan. And that is the commission to investigate the attack on January 6th. Chris hayes spoke to your Colleague Hakeem jeffries of New York about that. Heres part of what the congressman said. You know, it wouldnt shock me if he chose kim jordan, marjorie taylor greene, hes got quite a collection of characters to choose from. Its not my expectation, given Kevin Mccarthys past practice that hell do anything other than bend the knee to Donald Trump. In fact, we probably couldnt expect that Donald Trump over the next few days will issue recommendations as to who he thinks should be on this committee. And Kevin Mccarthy will follow those recommendations hook, line, and sinker. But thats not going to stop us from uncovering the truth. Congressman, do you share Congressman Jeffries concerns about the future disposition of this commission . Or do you have confidence that it will be able to do its Job Credibly and accurately . Joshua, one thing i do have confidence in is that the american people, not us in congress, are demanding the truth. The numbers, i think, are over 70 . Joining with democrats who say, you must investigate this at the citadel of democracy was attacked, but they are still in shock. Theres still ptsd, tragically, not only among the american people in terms of watching what happened, but Law Enforcement officers who are actually there. My first is to applaud the leadership for not stopping. We all would rather have an independent commission. I was here for the 9 11 commission. We helped put it together, because it had not been organized under the bush administration, but i think that there will be enough ability with the tools that the commission will have, the subpoena powers, the witnesses that will come forward. The witnesses that want to come forward. The Police Officers that want to be heard, that truth will prevail over tomfoolery. And no matter who the opposition or our Friends On The Other Side of the aisle decide to appoint, and it will be a disservice to them, if they would dishonor those officers who are still in injured and hospitalized and lost their life. We will not be engaged in tomfoolery. We will be engaged in serious investigation. The select committee that the speaker will select, they will be members who will be engaged in serious deliberation with, we hope, subpoena powers, and you cannot shush witnesses. You cannot quiet truth witnesses, and as i understand it, theres a litany, a line of individuals, joshua, that want to come forward and tell truly what has happened. We need to know where the beginning strategies for that day came about. How long ago was it planned . Was there any connection to the White House . Were there buzz words or signal words said by the president s son or the president or any of the other speakers that might have empowered these individuals and what was their ultimate goal . Weve heard it publicly, but what was the ultimate goal . All of this is so crucial. And i think truth will not be denied. Democratic Congresswoman Sheila Jackson lee of texas. But he also faces federal charges of violating George Floyds civil rights. Well get into that with the former head of the Minneapolis Naacp when the week continues on msnbc. Some perspective on the end of the Derek Chauvin Murder Trial from minnesotas Attorney General, keith ellison. The County Judge sentenced the former Minneapolis Police officer to 22 1 2 years in prison for the murder of George Floyd. That was less than the maximum 30year Punishment Mr. Floyds family pushed for. This right here is a 22year sentence they gave this man, its a slap on the wrist. We are saufrg Life Sentence and that hurts me to death. But this sentence is not the end of Derek Chauvins legal journey. He still faces federal civil rights charges. Joining us now is Nakeema Leaf Leavy armstrong, civil Rights Attorney and former president of the Minneapolis Naacp. Ms. Armstrong, good evening. Welcome. Thank you for having me, joshua. What did you make of the sentence when you heard it . What was your reaction then and has your reaction shifted since you heard it first . I dont think that the sentence went far enough in terms of holding Derek Chauvin accountable. He was eligible to serve up to 40 years in prison for what he did to George Floyd, which was essentially a Public Lynching that took place on May 25th of 2020. The prosecution was asking for 30 years, the Defense Counsel was asking for probation, which, of course, wasnt served. We know has a community that Derek Chauvin should receive at least 30 years in prison for what he did. And my perspective has not changed. Talk about the community, if you would. Since you were the head of Minneapolis Naacp, give us your sense of what this has meant to communities in the color in the Twin Cities, of which there are many, especially in the time that the trial was going on. And people were kind of wondering whether or not he would be convicted and if he was convicted, what kind of a sentence he would get. Whats it been like in the Twin Cities . Its been very tense and a very racially charged community. This has been going on for a number of years since we began protesting several years ago and demonstrating to call attention to the systemic racism within the system of policing, in the state of minnesota, and particularly across the Twin Cities. Weve held a number of occupations and demonstrations. Weve shut down freeways. Weve just swept the government meetings, all to bring attention to our pandemic that were experiencing of police violence. Since George Floyd was killed, it has caused such a great deal of Trauma And Distress in our community, particularly amongst the africanamerican community, but also our young people, several of whom witnessed the murder of George Floyd, but also, young people who have heard about or seen the video of what happened to George Floyd. Throughout the trial, we continued to demonstrate, we continue to show up and demand justice and we were relieved when the jury returned a guilty, guilty, guilty verdict on April 20th of 2021. Now, yesterday, we didnt know what to expect from Judge Cahill in terms of the sentence that he would announce against Derek Chauvin. I was cautiously optimistic, but in some ways disappointed that the judge did not give him the maximum sentence that was being requested. I wonder what your sense is of the message that this sends going forward both to Law Enforcement and to communities, both of color and not. Jacob blakes father spoke to us soon after the sentence was announced. Heres part of what mr. Blake had to say. I dont think i dont think people understand the pain that the families that they go through. And we never get justice, man. We never get justice, man. We do everything were supposed to do, man. And we cant find justice, man. Why does it elude us . Why does it elude us, man . We also heard before the sentence was announced from Derek Chauvins mother, who pleaded for mercy for her son. Heres part of what she said. Derek has played over and over in his head the events of that day. I have seen the toll it has taken on him. I believe a lengthy sentence will not serve derek well. When you sentence my son, you will also be sentencing me. Ive got to let you go, but i wonder if maybe from your view this moves us a little closer beginning to see the importance of dealing with Law Enforcement accountability. That it doesnt just rip communities of color apart, but it rips families apart. On all sides of these encounters with police. I would say, unfortunately, no. The testimonile given by Carolyn Polenski was the moment i almost lost it, seeing her white woman tears crying for her son and the harm that he caused and inflicted upon George Floyd, but she had no empathy for the family of George Floyd. She did not express any empathy for what her son had done and the fact that she created a monster, instead of acknowledging that, she went on to say he was her favorite son. That sets us back in Race Relations when you see a white woman who had an opportunity to express remorse and acknowledge harm that her son caused, looking for empathy for herself. That was unconscionable from my perspective. And you contrast that perspective to the father of jacob blake, who had genuine tears and genuine sorrow for seeing that there are two systems of justice in this country, one for white people and one for black people, and that has not changed. Critic of georgias new voting law, the u. S. Department of justice. Its taking the state to court over these restrictions. This year, the republicanled State Legislature made an array of changes to how people vote there. They include reducing the number of Ballot Boxes and more restrictive rules around absentee ballots. The Gop Lawmakers say these were not meant to be discriminative. Making it harder for voters of color to vote. Georgias Governor Brian Kemp remains defiant. He says he will not back down and says, quote, Joe Biden and Stacey Abrams and Merrick Garland dont scare me. Unquote. But its not just about georgia. States have passed more than a dozen laws this year to restrict voting across the country. What can be done to protect the right to vote . Lets discuss it with latasha brown, cofounder of black votes matter. Ms. Brown. Good to see you again. Good to see you. Thank you for having me. Whats it been like in georgia these last few months . I remember we had a conversation on this program with gabriel sterling, who talked about some of the effects of the law. Even he conceded that some of it was pure politics. He has argued that there are pieces of this law that had been misconstrued or would turn out not to be as damaging or even as impactful as some of its critics had claimed. What have you seen in the last few months . Let me say what weve seen even in the last week. On friday, the republican Secretary Of State announced that he was going to purge over 100,000 voters from the Voting Rolls in georgia, which is one of the things that we have been talking about all the while in the last few months, in the last few years. That has been just an overly egregious way to purge the list and to minimize the impact on black voters. In addition to that, this saturday, today, there are several members on the local Election Boards that are being taken off the boards for no apparent reason, other than the republican party thinks that they shouldnt be there, and theyve been empowered, where they actually can replace local Election Boards with sb202. So theyre moving very quickly, expeditiously, around making sure that they create an administrative process to marginalize voters in the state of georgia, as i think a punitive measure for black voters showing up and showing out in record numbers last year. And so it has already began, which is why part of what we are very im very, very hopeful about the lawsuit that the department of justice has filed and the lawsuit in georgia. You know, within a matter of minutes, that we along with new Georgia Project and several other organizations filed a lawsuit based on the same premise on section 5. Saying that this is quite frankly unconstitutional and the vote i said. So what weve been seeing is an ongoing onslaught of Voter Suppression in the state of georgia. And theyve been empowered to do so by sb202. I dont want you to have to do too much handicapping of the doj case, because well see how that goes, but there are other similar laws around the country, arizona, pennsylvania, texas, where either similar measures have been proposed or are being considered, have passed, have been signed into law. What are your, whats your sense of how all of this is moving across the country . Im not sure at least in the legislatures themselves, depending on the balances of power there, that theres enough legislative juice to push back against some of these measures and prevent them from becoming law, unless you do what democrats in texas did, which is just walk out and prevent there being enough people to pass anything. I think we have to use every tool available to us. I think it was very courageous, what the democrats did in texas, and nobody expected that. But what it did do is it stopped it and we have to be able to go through extraordinary measures to meet this extraordinary moment. But what we know we need is federal legislation to protect the right to vote. We need federal legislation that will expand the right to vote and access to the blot since there are so many measures that have been put in place and make sure that were protecting that precious right. So for that reason, i think we desperately need the for the people act and the John Lewis Voting rights Advancement Act. We need both pieces of legislation, because the for the people act, what it does is it gives a national standard. Will youre in idaho or alabama, it eighties a national standard where you can have automatic voter registration, where you can have absentee ballot voting, it also deals with gerrymandering and dark money, some of the issues that have literally been abused and have led to the abuse of power. And the John Lewis act, it was the eighth anniversary of the Shelby Versus Holder decision, and that decision ripped out section 5. So having the John Lewis Voter Rights Act will actually restore, creates a new formula and stores some of the expanded protection on the right to vote. Just so people are clear, that piece of the voting Rights Act required parts of the country that have a history of discriminating against people unlawfully at the Ballot Box from getting clearance. Its called preclearance, before they change their rules any further, and that ruling in the supreme Court Kind of pulled out what many would consider the teeth of the voting Rights Act. Before i have to let you go, what would you make of this possible compromise . It seems like there might be some kind of a plan that got Joe Manchins approval. Do you have hope for a compromise in congress if, lets say, these two pieces of legislation dont pass as they are currently written that we could reach some other sort of compromise . The quick version is on tuesday, we saw senators that not even the republicans didnt even want to debate. So in terms of having a valid compromise, i am not in support of compromising Voting Rights of black citizens or people in this country. That essentially this is a punitive measure against people coming out and using their civil rights. And so we need hr1, which is for the people act and the John Lewis Voter Advancement Act as it stands and as it was written. Latasha brown of black voters matter, always good to talk to you. We are learning more about the victims in the partial collapse of a condo in surfside, florida. Our Top Priority continues to be Search And Rescue. And saving any lives that we can. Today, our Search And Rescue teams found another body in the rubble. And as well, our search has revealed some Human Remains. Surfside is just north of Miami Beach and that is where we find Nbcs Sam Brock joining us live. Sam, good evening. Joshua, good evening. You know, the mayors comments there require a little bit of clarification. Heres what we think is going on in this devastating picture here. The Death Toll was at four. Its now at five, although you heard a second ago that the mayor did say there were Human Remains found. The official number of unaccounted for went from 159 to 156, so we think we were able that police were able to confirm a body, but the Human Remains of two other bodies were sent to the medical examiners office, leaving us with a situation of 156 people still unaccounted for. But the Death Toll at five could realistically by at seven by the time we wake up tomorrow morning. In terms of the scale of the Search And Rescue effort right now, which has brought in people as far away as Israel And Mexico we found out last night. And the expert teams near mexico, they have more access than they did earlier, largely because there was a fire in the belly of this building that they could not locate. It was creating a lot of smoke and providing problems in terms of access. But youve also had falling debris, weather at times has been incredibly disruptive. Weve been Dodging Downpours all day. If were doing that here, you can only imagine how more difficult it is for Search And Rescue teams there to be doing that. And lastly, that building that looks fairly normal for this Vantage Point but was completely destroyed on the other side, that could still collapse in its entirety at any point in time. All of these folks that are going into harms way right now and going through and sifting through that rubble to try to find signs of life or potentially remains are dealing with that in the back of their mind, that they could go at any moment. The nfl has been playing football 102 years and hes going to be the first Gay Player to come out while being active. And the reaction was kind of what i had expected. The Raider Owner was very nonchalant about, hey, fine by me. Hes a member of our family. The raiders players and teammates were great. Commissioner roger goodell, wloz who has a gay brother hes proud of, he was fantastic. So ive not heard a single negative thing from anyone, which is to me a total sign of progress, because there are still homophobes out there, but they know they cannot say that stuff and get away with it. So the reaction has been universally positive. And i know its inspired a lot of young kids. We had a 17yearold high School Football Player come out two days later. I was working him before carl came out, but he was a little nervous. And as soon as carl came out, he said, im ready to do it. Hes given me the strength to come out myself. So hes made an impact already. Talk to nfl fans who could care less one way or the other. Who would just like football to just be a game that they enjoy on mondays and thursdays and sundays and probably other days of the week, too. It seems to be on nine days a week these days, and can be free of some of the cultural and political and social issues that permanent nate society, that it can just be a game that they can sit back and enjoy regardless of who the players are. Talk to them. Why does this matter . Well, it matters because its not political. Carl did not make a political statement. I do not know his political affiliation. Hes simply being who he is. There are Gay Players in the nfl, but they for various reasons have not felt comfortable coming out. So they have to hide and censor themselves. Imagine going through your lives if youre married to someone of the opposite sex, having to hide it your entire life. It matters because hes able to be who he wants to be, and its as simple as that. Theres nothing beyond that in terms of being a political statement and its certainly not part of the culture wars, because hes simply saying im gay, and thats basically it. There are gay people who are conservatives and liberals and progressives and, you know, nonaffiliates. So to me its not a political issue at all. And i think anyone who says, why does Anyone Care . Well, they obviously care to make that comment . The human Rights Campaign says that there have been 17 bills signed into law this year, 17 forms of antilgbtq legislation at the State Level this year that seems to be the Flip Side of all of this, including bills that prevent transgender girls from competing in Girls Sports and that force them into the sex on their Birth Certificate rather than their Gender Identity now. Whats your sense on balance of how were doing with sports and coming out . Sports and acceptance . I think on the lgbtq part, were doing fine. Lesbian, gay, bi athletes are being accepted. At all levels. Transgender athletes, especially girls, theyre facing so much bigotry and discrimination. And these bills being passed are nothing but political stunts to gain votes and theyre demonizing a group of people who simply want to play the sports they want to play. Its really disgusting and just pure bigotry. In that area, theyre trying to use that, reminds me of the 2004 campaign where the republicans used antisamesex Marriage Ballot initiatives to gin up turnout. Theyre doing it as part of their culture wars. For the gay and lesbian athletes, its a lot more of a accepting society. For trans athletes, especially trans women and girls, its a real struggle and a shame. And they deserve the kind of respect and should be able to play the sport they want to play. I wish we had more time to talk to you about that and the inherent chauvinism built into some of these measures, this idea that, oh, if theyre men playing with girls, theyre going to have an unfair advantage, feeds the Chauvinistic Notion that men are inherently better at sports than women are. None of these can find what matters anyway. There are no actual examples of how this has made a difference to anyone. But its great to have you jim, to talk about this historic coming out in the nfl.
