Yasmin, its becoming more apparent here that there were significant structural issues. There is reports that was done back in 2018 of this particular Condo Complex that collapsed two days ago. The city of surfside posted these documents to their web page, they were handed over by a contractor, which outlined major structural deficiencies, including the lack of waterproof sealing. We have even heard firsthand accounts from folks whose Family Members say that they saw this very damage and were frustrated by the lack of maintenance, particularly in the garage area of this Condo Complex. That there were cracks in the cement, there were cracks in the wall, apparent rusting of cement. Do we know whether this was ultimately the cause of the implosion . No. But it could be very well a contributing factor here, especially when youre talking about the fact that this structure here was on a barrier reef here. You know, this is soft ground here and there was another report, a study that was done that this building was building sinking into the ground by a couple millimeters every single year. So when you put these factors together it has led to a lot of questions and a lot of concern as to other buildings here in the area. I want to let you hear, though, from the surfside mayor, charles burkett, who just spoke here this afternoon because this is still a very active scene at the site of that devastation. So the walls are quickly closing in on the Trump Organization with a new report from the New York Times claiming the former president s company is set to be hit with criminal charges by the manhattans das office as early as next week. The indictment is expected to be the, quote, first strike for manhattan da cy vance. At the center of this case extravagant perks, gifts and Fringe Benefits allegedly distributed to trump executives including the consider. Fo Allen Weisselberg. To break town the details for us nbc news Senior Investigative senior producer anna shecter. Walk us through what we know about the potential charges against Allen Weisselberg and company, specifically the Trump Organization, and when they could feasibly come down. So, yasmin, whats new this week is on thursday there was a meeting between prosecutors and the Manhattan Das Office and lawyers for the trump team and thats really what these news reports are written up. Weve known for a while that cy vance the Manhattan District Attorney as well as state prosecutors, even federal prosecutors before that have been looking into, pouring over troves of documents that had been handed over to investigators in part during the mueller probe. This is really part of a larger tapestry of multiple investigations looking at trump and the Trump Organization. Allen weisselberg who is front and center here, this is not the first time we have heard of him. He is the cfo of the Trump Organization, he was given immunity by Robert Mueller and passed a ton of documents over to that federal Prosecution Team and there was a general all my reporting indicates there was a general confidence that Allen Weisselberg was going to be safe. He was granted immunity. And now here the manhattan da has been swooping in and over the last year has been honing in on him and specific perks that he and other executives were given, like free rent, apartments, leases on cars and even private School Tuition for a grandchild. Now, the trump team says, well, wait a minute, this is totally unfair, its politically motivated. Theyre going after Allen Weisselberg who is an honest guy. This is just a political backlash. Right. And theres outrage, you know, because they are noting that big banks after the financial crisis, they met with prosecutors, wrote a check and moved on, so why should criminal charges come down . Because its not just Allen Weisselberg, now we know that potentially as soon as this week charges could be filed, criminal charges, against the Trump Organization itself. All right. So youre talking about the Trump Organization. What about the children of the former president . Are they at all in jeopardy here of being charged . And talk to me about anything we know, anna, about the timing of these charges. Well, eric trump is essentially running the Real Estate Portion of the business and was during his fathers presidency and don jr. Was also handed the keys. He was less hands on, he has taken a liking to politics while eric trump preferred handling properties including the trump hotel in washington, d. C. Our team has been in touch with him and he also is outraged at these Press Reports revealing that these criminal charges could come as soon as this week. In terms of timing, i think the prosecutors have been working meticulously. This is a long time coming. Its probably just when they were ready, but they have been working on this for years. This was all kind of stirring up even during the Robert Mueller probe. So like i said, this is part of a tapestry of a closing in of various prosecutors, state, federal and others, and also the Trump Foundation was a part of this. The inaugural committee was a part of this. Now theyre honing in on the cfo and potential tax evasion by the company and potentially by individual executives within the company. Johnson. You dont want to miss that conversation. What this really means, right, for the former president , thats the big question that everybody wants answered. I do want to turn now to washington where the white house is scrambling to manage the fallout over the president s comments on a bipartisan infrastructure bill. Just days after what many touted as bipartisan success on infrastructure republicans threatened to abandon the deal over the president s remarks that he would not sign the agreement without the simultaneous passage of a separate budget reconciliation package. If only one comes to me if this is the only thing that comes to me im not signing it. Its in tandem. Our monica alba is at the white house for us. Monica, bring us up to date on the latest reaction that were hearing from republicans and how the white house now is trying to get them back on board after the president s comments. Reporter as soon as the president made that commitment, yasmin, republicans did express some concern and made very clear that perhaps this fragile framework would not stay intact beyond when they were able to come out and announce it here at the white house just a couple of days ago, but were now learning that Top White House aides actually spent much of yesterday on the phone talking to the Bipartisan Group of lawmakers who helped to work and really lead these discussions with president biden, assuring them that the president does want this twotrack approach to continue, but that hes also going to get out and sell this to the public directly. So thats new. We now know in the next couple of weeks he is going to hit the road and hes going to tout the substance of this 579 billion in new spending on the more traditional infrastructure, while also, of course, again, discussing the bipartisan nature of it. Thats a huge piece to all of this. The president perhaps more than anyone else after campaigning on that for so long is the one who does want to see this happen from both sides, but we also know that now democrats have expressed some concern because they are not sure about how big either in terms of size or scope to go on this other track, the budget reconciliation one, and, again, the president and the white house are saying the plan all along was to pursue both of them as he mentioned in tandem, but that is what made some republicans nervous, but we also know, again, its about keeping the Democratic Party really united here for the president. Thats the other challenge. As some progressives have said, again, they are not quite sure that the bipartisan deal goes far enough. So thats why you had the president himself working the phones yesterday also speaking with arizona senator sinema reiterating, which is was a word that appeared repeatedly throughout the readout, that this was the plan and wanted to make sure that she was on board as well as these other senators who so far have said they are, but its a way bigger question once we talk about broadening that out for these much larger votes ahead. Quickly here, if the president is saying this was the plan all along, if the white house is saying this was the plan all along, did they not discuss this with any of the republicans during that meeting . Reporter the white house says this was discussed. Remember it was a really short meeting in the oval office, only about 32 minutes before they came out and announce that had they did have a deal intact. Got it. Reporter this is not so much coming it seems from that group of the ten bipartisan senators but some of the others who had expressed interest but now are not pleased with the way the white house is playing it. So now that former Minneapolis Police officer Derek Chauvin knows his fate following his sentencing for the murder of george floyd, more legal troubles could be on the way. First talk us through how the floyd family is reacting to chauvins sentencing. Reporter hi there. Well, they clearly want to see more. You could tell that from the interviews that we heard and the comments that we heard from the family and the family attorney before yesterdays Sentencing Hearing. Even during yesterdays Sentencing Hearing when we heard from George Floyds cousins, nephews and even his daughter, the family was making clear and pleading with the judge to impose that maximum sentence against Derek Chauvin and then the judge settled on the 22 1 2 years. Its clear that they werent happy with the alternate sentence, they wanted to see a maximum penalty. Lets listen to what we heard after that sentence from a family member. I feel that he should have received a Life Sentence as well. What kind of message are you sending to our country . What kind of message are you sending to the younger kids . That you can kill a man in cold blood and get a slap on the wrist. Thats a slap in the face to all of us standing here and everybody around the world who feel what we feel and saw that video. Reporter now, this was a historically significant sentence, especially against a Police Officer in the state of minnesota. Only the second time in modern history here in the state where youve seen an officer convicted and sentenced to a Double Digit Amount of years, but you also have what you hear from activists and protesters who we did see some small protests yesterday, theyre saying that bottom line, george floyd is not coming back and this doesnt address the systemic issues that they have been calling for and have been protesting against and demonstrating against for so long. All right. So we have that, shaq. Quickly take us through, look ahead for us to the civil case. Reporter yes, this is this federal civil case, civil Rights Violations that are alleged against Derek Chauvin, hes facing dr he and actually the other three former Minneapolis Police Department Officers facing that indictment from a federal Goosh Grand Jury that accused them of violating George Floyds civil rights and Constitutional Rights effectively. We will expect to see more legal occurrences, more court cases, more hearings, more legal trouble for Derek Chauvin in addition to facing those counts and charges involving the george floyd murder, hes also facing counts and charges for potential Civil Rights And Constitutional Violation A 2017 arrest. That one involving a 14yearold boy here in minneapolis. So theres a lot more legal trouble that Derek Chauvin is facing despite that sentence and it being somewhat of closure for the state case that weve been paying attention to for the last couple of months. Attorney general Merrick Garland announcing that the Justice Department is suing georgia over a law imposing new limits on voting of First Federal action against the republicanbacked voting laws being passed across the country. The complaint alleges that the state enacted those restrictions with the purpose of denying or bridging the right to vote on account of race or color. This lawsuit is the first of many steps we are taking to ensure that all eligible voters can cast a vote, that all lawful votes are counted and that every voter has access to accurate information. So the georgia governor responded saying the suit was born out of, quote, lies and misinformation and goes on, they are weaponizing the u. S. Department of justice to carry out their far left agenda that undermines Election Integrity and empowers federal government overreach in our democracy. The New Georgia Law includes less time to request absentee ballots, stricter new Id Requirements and slashes the number of Ballot Drop Boxes amongst other things. Joining me now nbc news senior political reporter jane tim to talk us through this. Thanks for joining us on this. We talked a lot about, you know, this type of tactic coming from the department of justice when we saw the Voter Restriction Laws going into place in states like georgia. Why is this move by the doj so significant . I think perhaps because this lawsuit promises to be the first of many. Merrick garland has made it clear that he is staffing up in the Civil Rights Division of the Justice Department which was largely vacated a little bit during the Trump Administration and was not doing the kind of this kind of litigation and the fact that the georgia well, maybe the head liner, maybe the one people think of when they think of the state avalanche of voting restrictions. Its far from alone, there are 22 states that have enacted restricted voting bills and this makes it clear that attorney general and the entire Justice Department will be keyed in and reviewing these laws. I think you could see a number of lawsuits around the country just like this one because many of the restrictions weve seen enacted in these states have a lot of similarity. You know, i have read that bit about snacks and sort of water and polling places. Right. In numerous state laws even if its a little different and laws are a little different there are some trends here. One might be added to it obviously with whats happening in texas and the Special Session the governor called there recently. I want to read directly from the department of justices lawsuit for you, jane, this he write georgia enacted sb202 with knowledge of the disproportionate effect that numerous provisions both singly and together would have on black voters ability to participate in the political process on an equal basis with white voters. How, in fact, does the department of justice go about proving this in their lawsuit . Thats a good question. It is notoriously difficult to prove intent in Something Like this, particularly when republicans say this was entirely about just a Fair Election and they say that this improves access, this law. I think that the reason theyre doing this is in part because section 2 of the Voting Rights act the law theyre citing and saying this violates is currently being considered by the Supreme Court and it could be weakened, the protections that it typically offered previously could be weakened in a ruling as soon as monday. So i think this is because they know they have a high bar to do this in part because as he said in his own press conference, Merrick Garland, pre clearance, section 5 of the Voting Rights act is no longer something they can use as a vehicle to stop discriminatory legislation in their view. How could this, in fact, impact any efforts to get vote rights legislation passed in congress, specifically the john lewis Voting Rights act as we know Senate Republicans have blocked a vote to begin talks on hr1 . You know, i think that its no surprise this lawsuit is coming out a couple of days after the for the people act failed. If the for the people act had passed the Justice Department maybe could have prioritized Something Else because that legislation would have gutted the restrictions that were enacted in georgia. To me that legislation was never going to go anywhere, does not have the votes and its really unlikely its going to move. I think that they would be working on this either way. It does highlight, again, the importance for Voting Rights advocates for to restore the Voting Rights act to its former state. Can you just talk quickly about that, how you were pretty confident in the fact had a hr1 would not necessarily get passed. The fact that democrats would form a legislation like this, that they knew it was kind of like this dream bill, right, when it was first put together, that they knew it actually didnt have the ability to get passed. Yeah, i mean, more than 800 pages long, it sort of felt like a democratic wish list in parts of it and joe manchin was firm that he did not want to get rid of the filibuster. When he was out there and loudest about saying im not going to abolish the filibuster, especially this bill that he didnt oppose in its full form. Senator sinema in arizona dont want to get rid of the filibuster. This legislation was, you know, sort of hopeful, it was i would say advocates really their only plan to stop these laws because lawsuits are very expensive and time consuming and dont always work out the way they hope, but it was to me that legislation was not going to go anywhere. Reporter the Trump Organization bracing for criminal charges, multiple sources telling nbc news Manhattan District Attorney cyrus vance is expected to announce an indictment of the former president s company as soon as next week. The first criminal charges stemming from vances wide ranging investigation of trumps company. Long time chief Financial Officer Allen Weisselberg also potentially facing charges as prosecutors ramp up the pressure on him to cooperate. The probe according to Court Documents centers on potentially extensive and protracted Criminal Conduct, including falsifying business records, Insurance Fraud and tax fraud. With prosecutors focused on Fringe Benefits allegedly awarded to people like weisselberg, including thousands on rent in apartment and car leases according to the New York Times. An attorney for the Trump Organization telling nbc news they will plead not guilty and want the case dismissed, calling the charges completely outrageous and describing mr. Trump as outraged. But some lawyers see this as only the beginning. Its first inning of this phase of going after the Trump Organization and trump and his employees on the taxes. On tuesday Governor Ron Desantis signed into law a bill requiring Florida University students and faculty to register their political views with the state. What . Just two weeks after banning the teaching of Critical Race Theory in Public Schools Governor Desantis called the bill a push getting, quote, indoctrination and hinted that universities may lose funding if their staff and students political beliefs do not satisfy the states gop led legislation tour. Following weeks of criticism from republicans Vice President Kamala Harris has made her first trip to the southern border in el paso, texas. I really appreciate t i want to play a little bit more for you of the Vice President upon her visit on friday. It is important to be clear, it is work to go build a fair and a functional and a humane Immigration System. As you know, we inherited a tough situation, in fact, right here in el paso was the launch of the child separation policy. You saw it as it rolled out on the ground in realtime. We have looked at a system where people have been housed in inhumane conditions over the last many years, an Asylum System that has been broken and that needs to be reconstructed. The system is very much, in fact, broken, i dont think anybody can argue with that point. You got a bottleneck at the border. You have an Immigration Backlog as well when it comes to visas. Talk me through here the Vice President s approach, especially after all of the criticism and heat she has received about her approach to the immigration crisis. So a few things. First i just want to say i actually thought this was a very strong trip. I thought she was able to accomplish three goals on this trip that are really important. First, able to remind people of the cruelty and the chaos of the Trump Administration, of policies like Family Separation. The type of conditions that the Trump Administration imposed on children and families. Also she was able to, second, distinguish that from the progress that the Biden Administration is making in undoing those policies. Theyre starting to reunify families, theyre rolling back the mpp program. Third, she was able to relate it back to her root causes work in the northern triangle and i think thats really important, hearing the stories from these young girls. Also talking with legal and Service Providers about the work and the services that they provide to these families and these children, which is really important because the Immigration System all these different elements the work that shes doing in Central America is directly linked of course to migrants who are arriving at the border and so all of these challenges need to be addressed together in a comprehensive way and i think this trip was able to tie all of those elements together. And in order for her to be able to move forward her agenda, which is in addressing the root causes work despite the misinformation coming from the gop and republicans. Talk me through how the decision right side made here, right, because the Vice President was criticized for not visiting the border wall, which you could understand why she wouldnt necessarily do that seeing that the border wall was a signature of former President Donald Trump. She was also criticized for not visiting a Holding Facility in which children are being held to view sort of the circumstances that these people that are being held in these Holding Facilities are facing. Do you think that was a mistake on her part not visiting those Holding Facilities that were just a few miles away from where she today . I guess i just want to say, you know, point out that republicans have been attacking her and theyve been scrambling to find the next way to attack the Vice President on this issue after criticizing her for months for not visiting the border and doing you know, theyve been doing photo ops at the border for the last several months. I just want to point out like President Trump and mike pence both did photo ops at the border many times. Right. And that improved nothing. The system was still completely broken then, its still broken now and we actually saw apprehensions go up during the Trump Administration despite all the photo ops. So i just would like to call into question that going to the border is important and able to understand the new challenges. The Vice President as she pointed out during this trip has been to the border many times. She was a senator, she was attorney general from a border state from california. So she knows these challenges. This is an area where she has a lot of expertise. She was one of the first senators to actually start asking questions on Family Separation in march of 2017. That was like a full year before Family Separation really broke into the public eye. So i just would say like she does understand these issues. Going to the border, talking with advocates, talking with people that work on these issues is very important to inform her work, but it is not the only thing. Its actually moving forward policies and instead of going to the border, and final point, republicans should be working in congress to pass legislation to deal with this issue. Yeah. According to new analysis from the Associated Press deaths per day which have fallen below 300 could be practically zero if everybody eligible received their vaccine. That news arrives at a very critical moment for the Biden Administration which Just Announced it will, in fact, fall short of its goal to vaccinate at least 70 of American Adults by july 4th. This is happening amid growing concerns over the strength and severity of the Delta Variant by dr. Anthony fauci warned this week is quickly becoming the nations dominant variant now accounting for 20 of Covid Infections in response to the variants spread the w. H. O. Issued this urgent warning to fully vaccinated individuals, vaccination alone will not, in fact, stop community transmission. We must continue to protect ourselves. First, what do you make of this this new announcement from the w. H. O. Saying n fact, that fully vaccinated individuals arent necessarily fully protected from this new variant . Yeah, yasmin, i think its just a reflection of the fact that this is despite mutations being slow a fastmoving problem. Weve seen a doubling of cases with the Delta Variant just in the United States. I think the w. H. O. Is signaling caution when lets face it the majority of the world is unvaccinated and there is not just the Delta Variant, there is the delta plus variant. A variant, mutate it more. Make it even more infectious. Of course, were going to see vaccinated people get infected. About a third of the deaths in the uk, in one week, were estimated to be from the Delta Variant. And attributed to, actually, fullyvaccinated people. So you are seeing israel, australia, and the w. H. O. Putting back a little bit of that concern that, if you are going into an indoor place or if you are actually with crowds, you should mask. Or think about not necessarily keeping your mask off in all situations. So why wouldnt the cdc adopt this, as well . Yeah, thats a very good question. I think there are a couple of reasons. Number one, we have, unlike the rest of the world, we have had three highlyeffective vaccines that so far, in lab studies have been shown to be effective against the Delta Variant. Decreased efficacy but still, way more than we would expect from any vaccine so we know our current vaccines work and i think that is why you are seeing a push to try to just vaccinate the unvaccinated. But i think this is going to play out locally and regionally. You might see parts of the country, especially undervaccinated ones, missouri, for example, where the hospitalizations are crowding out localarea hospitals. You might see parts of the state actually putting back in mask i dont want to call it even mandate because thats too political talk to me about what we know about delta plus. Yeah. So the deltaplus variant is just a mutation on that spiky protein of the virus of the Delta Variant. That we believe and some early studies coming out of india show that it might lead to more hospitalizations. And we are not sure if it leads to more deaths. But it certainly speaks to the the virus, delta plus, could be more kind of infectious and easy to stick into the linings of your lungs. And thats what we had worried about a year and a half ago when this started. And i think, the other part, the deltaplus variant, we dont have the lab studies. But there is worry that every time this virus mutates and becomes more infectious and more threatening, that our current immunity just gets taken down a notch. Not anywhere near where i would worry, as an american. But certainly, anybody who is not vaccinated is at much higher risk of hospitalization and, of course, yasmin, unfortunately, of death. Dr. Patel, i want you to weigh in on what we are seeing take place in florida. You got 159 people still Unaccounted For. We know the searchandrescue operation is ongoing. It is day three of a searchandrescue operation. They are trying to find signs of life buried amidst the rubble. How long could a person feasibly survive, in a situation like that . Yeah. Its a great question. If they can find a pocket of oxygen. There have been reports, we have had in Building Collapses and other kind of situations, coalmining industry, as well. Where we have seen people be able to survive for days. So if you can find the critical piece is being able to find a pocket of oxygen and being able to breathe. And and then, even things like water and food. The human body can go days without that. So it really comes down to having that access. And every minute that goes by is, i know, kind of wrenching on the hearts of the people. So, i really feel for them. It breaks my heart. But there is, still, hope. Dr. Kavita patel. There they are, once again, in surfside, florida, as they are in a searchandrescue mission with 159 people still Unaccounted For. Want to bring in Vaughn Hillyard, whos been following this for us. Vaughn, take it away. Yasmin, as spoke continues to permeate from that collapsed site. Just a mile down the road is where the families of 159 unaccountedfor individuals continue to wait for updates. In the morning and the evening, the governor and local officials are providing these updates. But the hard part is that for the last34 hours, there has been no update that has included information that a body has been recovered. This is a slow, very deliberate, process that has not been fruitful here, at this point. And this is tough, as these families wait. Now, i met, yesterday, louise, whose son is 26 years old with muscular dystrophy. He stood outside waiting here on this collins avenue, waiting for folks to just look at his son. Hoping that he gets news of his whereabouts. And actually, our producer colleague charlie, just a bit ago, met more of louiss family. Calling around to one another, desperate for information about where this rescue is headed. Family members are now being asked to provide dna samples, in the situation that bodies are recovered and they are trying to identify who those individuals are. This is a Neighborhood Community that has really come to a standstill over the last48 hours, as folks can do nothing but wait and hope and pray, yasmin. Dna samples.
