Rights legislation. With Majority Leader Chuck schumer bringing the for the people act to the floor this tuesday. But the bill will most definitely be filibustered Mcconnell Style despite a compromise from contrarian Joe Manchin which included a ban on gerrymandering, voter i. D. Requirement and establishing Election Day as a national holiday. While the Manchin Compromise enjoyed a key democratic endorsement from Stacey Abrams, republicans were quick to offer their fullthroated opposition. A revised version produced by one of the democrats yesterday, which has been endorsed by Stacey Abrams, equally unacceptable, totally inappropriate. All republicans, i think, will oppose that as well. Joining me now, Beto Orourke, former texas congressman, former president ial candidate will be rallying on the steps of the capital for support. Thank you very much for coming to the Sunday Show. Jonathan, its great to be with you. And thank you for mentioning well be meeting this evening 5 30 here in austin at the State Capital to rally for that bill you just told your viewers about. It is the voting Rights Act of our day. It would do anything to stop the suppression of voting in texas and across the country. Im glad to see Senator Manchin is back at the table and thats cause for hope and optimism. I want to ask you about Senator Mcconnell and what he said. But of the Manchin Compromise, if you were back in congress and that bill made its way over to the house, would you vote for it . Id push for more. I want to see automatic voter registration. You turn 18, youre registered to vote and ready to go. I want to see sameday registration. Say you moved to texas from arkansas or louisiana, you forgot to update your registration. You can do it at the Polling Place when you go in to vote. And reduce the power of corporate spending, big money in our politics by elevating Citizen Funding of campaigns. Those are pieces i see missing from the compromise. Again, im encouraged by the progress being made. A week ago the big story was Joe Manchin was a no on this bill. Hes now talking to his colleagues. As negotiations proceed, well see more progress. Among other things mitch said, in addition to relabelling it the Stacey Abrams bill, he also put out a Press Release saying he opposed it and called the compromise, same rotten core. What do you make of Mcconnells Opposition to this bill . Was there anything that Senator Manchin could have proposed that would have gotten Mitch Mcconnell and the republicans to say, yes, this is something we could vote for . Unfortunately, i dont think so, jonathan. This is the same party, this is the same senate republicans that could not muster ten votes to investigate the 6th Of January attack. It almost cost them their lives and did cost the life of a capitol police officer, an attack during which there was a gallos constructed in front of where they work to hang the vicepresident of the United States. If youre not willing to hold accountable those responsible for the insurrection, i find it hard to believe youll move forward on a bill to preserve democracy. I hope those senate democrats move forward. It would be nice to do this on a bipartisan basis. At some point were going to have to come down to this question. Will it be filibuster or democracy. I hope those who represent us in d. C. Pick democracy. Since you brought up filibuster, i was going to ask you something else. Have a listen. This is element 4 for the control room. Have a listen to this leaked audio from a talk that Senator Manchin did a little while back. He addressed the filibuster. Have a listen. Youre asked by somebody from jacksonville, florida, about the proposal to lower the threshold foreclose youre to 55 votes. You can filibuster with 55 votes. Thats one of them. Im just not open to getting rid of the filibuster. Thats all. Congressman, what do you make of that . You know, im an optimist, jonathan. The fact that you have manchin, Senator Manchin going from, in no matter or formally consider changing the filibuster, ending the filibuster to now discussing reforming the filibuster so that we have a more manageable threshold over which we can pass democracy legislation, jobs legislation, a legislation thats going to improve the quality of life for our fellow americans, thats a 0 good sign. I see progress right now. Jonathan, i dont think progress rolls of its own accord. Yolk the arc of justice bends. Were asking people to rally. At the State Capital, we might want to follow Stacey Abrams lead and call our senators, call the president for that matt effort. Let them know this is an existential priority for our country. If we dont get it right, in states like texas you will not have free and fair elections going forward. The last Election Bill would allow the state of texas overturn elections simply based on the allegation of fraud. The for the people act is all that stands between us and that conclusion. There are a lot of people who gave that cluck their lives. I want to make sure we defend it and uphold it throughout future generations. Throughout this i called you, beto, congressman. You are a former member of congress. There is word you are considering running for governor, running against the sitting governor, governor abbott. Are you seriously considering that . Will you do it . When will you make the announcement . Im going to see this fight through for Voting Rights to the finish because as i hope ive made the case, i dont think there is anything more important for us. After that i will see what it is i can do to best serve the people of this state. That might be, jonathan, as a candidate. It might be supporting candidates, it might be doing the work powered by people our organization has been doing the last year and a half, registering voters and defending Voting Rights. You are here because you were among the people who met with Senator Manchin a bit ago, maybe a couple of weeks ago, to talk about the for the people act. Given what we now know the compromise that he put out, i would love to get your reactions and if you saw this coming. Melanie, ill start with you. Thank you, jonathan. I called the former congressman governor. I was thinking the same thing. The meeting with he had with my colleagues, the conversation we had with him, i left that Meeting Thinking, okay, he was open. I know a lot was said, he was saying no. But i left that Meeting Thinking he was open. Of course, he was not the only person we were going to talk to and thats still the same issue. Meeting all the democrats as well as good republicans do the right thing. I also think the filibuster needs to be at least reformed and in that conversation. Wade, what about you . Were you surprised by the Manchin Compromise . I think he has his were not able to hear here he goes. Im so sorry. Good morning. Great to see you. I was a bit surprised by Senator Manchins willingness to engage in conversation. I thought we had had two meetings with him. He was civil, he was engaging. He listened to what we presented. We discussed issues taking place at the State Level and why these impediments were a serious threat to American Democracy and he took them quite serious. He convened a second meeting with some of his republican colleagues to listen to us as well. I thought both of them suggested a willingness on his part to talk about these important issues and to really take seriously this threat to American Democracy and to consider what he could do to help protect democracy going forward. So while i was somewhat surprised by the nature of his proposal, which i think is really very good and important step forward in the effort to protect democracy, i nonetheless felt encouraged he was open and willing to discuss these issues more seriously. Okay. So, surprise, not surprise on the Manchin Compromise . Yes, thats correct. Have a listen to Stacey Abrams reaction to the compromise earlier in the week. Have a watch. What Senator Manchin is putting forward are basic Building Blocks we need to ensure that democracy is accessible no matter your geography. And those provisions that he is setting forth are strong ones that will create a level playing field. Okay, melanie. I dont know about you, but i was really surprised by that from Stacey Abrams. Were you . And what impact did her support have on the issue overall, do you think . Surely time will tell. I was a little bit surprised. Also im down here in the state of florida, midflorida, as a matter of fact. The reality is on the ground, things are happening. In florida, they have already enacted Voter Suppression laws. So the critical issue that we need to focus in on, because were going to have different folks have different views. I respect Stacys Viewpoint on it. The key is how do we get it passed. So really focus on that filibuster is going to have to change because Mitch Mcconnell has already said there is no pathway for what im hearing from the leadership of the republican party. So its going to take leadership coming from the ranks of the republicans, i believe, to make the difference. And so i respect her opinion. I think that we need to push more for whatever we can get, and legislation is about, unfortunately is about compromise. I know there will have to be some. There are things happening in these states as we speak that are continually going on when it comes to Voter Suppression. It has to be addressed, otherwise whats the point . You can pass Something Nothing about the tsunami of attacks on our Voting Rights. So i say lets all keep pushing and challenge our elected officials to do the right thing. Thats where i stand on it. Right. Wade, before you give your thoughts on the Stacey Abrams support, have a List Tone what Senator Roy Blunt had to say about the Manchin Compromise. We all, i think, every One Of Us looks for opportunities to work with Senator Manchin. We found those opportunities. I actually think when Stacey Abrams immediately endorsed Senator Manchins proposal, it became the Stacey Abrams substitute, not the Joe Manchin substitute. Wade, that to me is the most ridiculous rationale for saying youre against something that we all knew, been done knew you were going to be against to begin with. So your thoughts on Senator Blunt and Stacey Abrams . Well, you know, Senator Blunts attempt to demonize Stacey Abrams support for the Joe Manchin proposal is a tactic republicans have used for years in an effort to discredit support for an important piece of legislation. The fact that Stacey Abrams gave a fullthroated support for Joe Manchins proposal doesnt mean she supports every part of the bill. She recognizes its an important Building Block to protect Morn Democracy where it is most at risk. After all, jonathan, 14 states have enacted over 22 new restrictions between january and midmay of this year making it harder for people to vote. The Manchin Proposal addresses many of those restrictions. And i should point out that those restrictions came from very partisan republican State Legislatures, recognizing that members of the National Republican Party have embraced their proposals. So the fact that Joe Manchin is willing to test the parameters of bipartisan ship doesnt trouble me at all. He is an institutionalist. He believes in the importance of the senate and its process. And the fact that hes willing to test those parameters is okay as far as im concerned. The issue is, i think, as melanie pointed out, what happens when republicans clearly turn their back on his proposals as they have done in the last several days. Is he willing at that point to consider the kind of important reforms of the filibuster that in all likelihood will be necessary to move these bills into law. Right. And you know whats really hilarious about them opposing the Manchin Compromise, after all this time saying they were all for voter i. D. Suddenly theyre against voter i. D. Its really curious. Exactly. We dont have a lot of time. I dont have time to play the Manchin Sound that i played for Beto Orourke and Senator Manchin talking about some compromise there on the filibuster, lowering the threshold from 60 to 55 votes. Melanie, and then wade, real fast, would that be a compromise you could get behind . I think compromise is whats nighted. Filibuster needs to be reformed. Ill leave it to my Expert Wade Whether 55 is good. As far as im concerned, i think any change that will allow for there to be work done in the senate. At The End of the day, this didnt just start with the biden administration. This has been going on ever since obama was elected. And so the whole notion that all of this about all of a sudden theyre going to do the right thing, i just dont believe it. The proof is in the pudding. History has shown especially Senator Mcconnell is not willing to be a leader. Hes willing to just focus on partisan game and partisan power at all cost. He doesnt care about we are over time. Lets Get Wade in here, then we have to go. Go ahead, wade. Lets give Joe Manchin some credit, jonathan. After all, his willingness to consider reducing the number needed to overturn a filibuster is a very important step. And its important we recognize his willingness to engage in conversation about how best to, from his perspective, preserve the filibuster where he believes its needed while at the same time reforming the filibuster so that important legislation protecting Voting Rights in American Democracy can proceed. This weekend americans celebrated Juneteenth As the countrys newest federal holiday, commemorating the last day the enslaved in the United States learned they were free, except the 13th Amendment abolished most but not all slavery. It reads, neither slavery nor in voluntary servitude, except as a punishment for crime whereof the party shall have been duly convicted shall exist within the United States. Except as punishment for a crime. That loophole allowed another form of slavery, forced Prison Labor to thrive and helped create the Mass Incarceration Crisis we have today. But my next guest is trying to change that. Joining me now is the cosponsor of legislation to revise the 13th Amendment, Senator Jeff Merkley of oregon. Senator, welcome back to the Sunday Show. Thank you very much, jonathan. Good to be with you. So, when i saw the announcement that you put out about trying to fix this loophole in the 13th Amendment, it sort of took me by surprise, sort of like the fact we had Juneteenth As a federal holiday. Why are you focused on that and why must this loophole be closed . A few years ago i watched a documentary, the 13th. When we grow up in grade school, high school, even in College Learning that slavery ended with the Emancipation Proclamation and with the 13th Amendment, it turns out thats not the case. Within days of the 13th Amendment being passed, many states were passing laws that made it possible to arrest, Convict And Reenslave black americans. In fact, alabama at One Point produced some 75 of its revenue convicting and reenslaving black americans. And these were, these were not crimes that you and i think of as crimes. These were fake crimes. These were you changed employers without permission. Youre unemployed, youre loitering, youre speaking too loudly. You didnt yield the sidewalk. These were called, in retrospect later, they were called the black codes. They were there for one reason. To arrest any black individual at the whim of the state. Of course, that terrorized people. It broke up families. It destroyed generational wealth. It created Mass Incarceration, and that Mass Incarceration reverberates to this current day. So here we have this clause that is a source of huge systemic Racism Right in the middle of our constitution, and it needs to come out. You know, and im glad you brought up all of those examples of how basically black life was criminalized. Vagrancy laws are also just standing, just standing on the street or just standing out in public could have gotten you arrested, and anyone who wants to understand Mass Incarceration needs to go back to that. Whats the likelihood of your loophole getting closed, your legislation actually getting passed by the senate . Its been a long time since we actually did a constitutional amendment successfully, so its very hard path. But when i first introduced this idea last year, people just looked at me like i was crazy, what . They never heard of the slave have i clause. They never heard of this history. Ive reintroduced it and i have a capable team, chair of the judiciary committee, Cory Booker who is leading the effort for criminal Justice Reform. And the word is spreading. In fact, we now have three states that have repealed the Slavery Clause out of their constitution. And to everyones surprise, thats not three blue states. Youre talking about two red states and a purple state. Nebraska and colorado and utah. All right. Let me get you on a couple of other things since i have you and youre a member the senate. Youre also on the rules committee, if memory serves. The voting Rights Act, the for the people act thats going to come to the floor for a vote, i think its on tuesday. Its most likely going to go down, its going to get filibustered by mcconnell, isnt it . Well, it wont even get to the floor. Its a motion to proceed to it. There will be debate over whether to debate the bill will be blockaded, which is an abuse of the super majority. Youre correct. So, i anticipate well have 50 individuals supporting debating it and 50 opposing it, but it will take 60 to get to the floor. We dont have that. And then ive been playing the sound of Senator Manchin on a Phone Call in a meeting talking about, you know, hey, hed be fine lowering the threshold for filibuster from 60 to 55. Does that have any traction . Would that gain any traction if when the for the people act fails on tuesday . To understand the possibilities there, the social contract of the senate has to be understood. And that is that they Cant Run over the minority. They get a chance to delay, protest, offer amendments. But in The End the Minority Cant paralyze the senate. Its the second half of that contract missing. Reducing the number, require to close debate, that could be helpful. Reducing every couple votes, every couple days would be a possibility. Thats Something Senator Har kin proposed when he was in the senate. The 1975 Rule Change meant you could obstruct with no time, no effort spent, no show. That no show, no Effort Obstruction was perfect for mcconnell who wants to obstruct with no effort. So the senate is a Deep Freeze now. So going back to the talking filibuster would be another possibility. And one more question in the less that 30 seconds we have left. The new Infrastructure Plan for the g20. Youre not part of the g20. As someone who is not part of the g20, is the Infrastructure Proposal Something you could get behind . It is not sufficient because it leaves energy on the dock as the Infrastructure Ship sails. So if there is an understanding that we will do the Energy Infrastructure to go to Renewable Energy in reconciliation, then i can probably get behind the first bill, but we havent seen all the details. As america continues to confront racial in equity, this week Chicago Mayor Lori Lightfoot declared racism a public Health Crisis and pledged nearly 10 Million in covid Relief Money to fight it. According to a new study by the Chicago Department of public health, black risk identifies in the windy city have a Life Expectancy nine years shorter than nonblack chicagoans. Joining me now is the mayor of chicago herself, Lori Lightfoot. Mayor lightfoot, thank you very much for coming to the Sunday Show. My pleasure. And happy Fathers Day to everyone. Thank you very much. So, mayor lightfoot, youre calling systemic racism a public crisis is no surprise to me because in the conversations weve had over these years, you have said that flatout. But this declaration makes it official. Talk about why you feel so strongly that this declaration be made. Well, jonathan, i think one of the big narratives coming out of the pandemic is that the Cost And Consequence of in equity and in justice simply can no longer be ignored. Youre right, we have known that racism is a public Health Crisis. I think naming it and saying it gives us the opportunity to address it once and for all. The consequence of this, the Life Expectancy gaps, absence of high Quality Health Care by so many residents, Gun Violence, Root Causes, you can trace a lot of that to racism, systemic poverty, all those other consequences. So naming it and making it an official declaration of the city gives us to have a chance to have the Conversation And Address Root Causes. We have a bunch of statistics we can show from the control room. Lets start at the first one. Opioid deaths among blacks in chicago is three times the rate of nonblacks. We go to hiv. Blacks account for half of the people living with hiv. Now lets go to Gun Violence. 2020 versus 2021, as you see there im sorry, we dont have it, but 5 homicide, 17 shootings. But The Key thing here in the report that you put out, homicide is the number 5 cause of death, leading cause of death among All Blacks in chicago, and number 3, homicide, number 3 for black males. Gun violence in chicago has been something we have been talking about and fretting about for years now. Why is it so hard to get a handle on the Gun Problem in chicago . I mean, i think there are a number of reasons. Excuse me. First and foremost, were surrounded by states that have extraordinarily lax gun laws. Weve been calling on the federal government to do what is necessary to have multijurisdictional Gun Trafficking Task forces. The Police Department takes more guns off the street than l. A. Or New York combined year after year after year. We cant stop the flow of illegal guns into our city without the federal governments support. But going back to the Root Causes, too many of our young men believe that their destiny is pure gain, that they have no future, no hope. What we have been working on the last two years and will continue this Work Postpandemic is building that village of support among young black and brown males to let them know that their future is limitless if they take advantage of the opportunities in front of them. And weve got to continue to create those opportunities. But where you see this violence raging in certain neighborhoods, its where there is systemic racism, poverty, and a lack of hope and desperation. Thats really at the Root Cause of a lot of this violence. Too many of our young men do not believe that the future lies in education, in career. They think its jail, early death, or minding somebody elses corner spot. We have to disrupt those systems and replace them with positive productive activities for our young men. Mayor lightfoot, i hear what youre saying, and it all makes sense and it is true and it is a longterm project that youre talking about. But what do you say to folks in chicago for whom homicides and Gun Violence is an immediate thing . What do you say to chicagoans who are looking for you and your administration to do more . We are doing more. We have been very focused on 15 areas of our city that drive over 30 of the violence. We are present in those communities both with law enforcement, of course, but also with using our soft power, our libraries, our parks, our schools, our afterschool programs, our community organizations, really coming together and focusing, using data to be literally on a block by Block Basis and were starting to see some traction. Again, i dont want to take a Victory Lap because were far from where we are. But were seeing a Down Trend from June Over june last year. Were seeing a downturn certainly in may in homicides and shootings. Some of the areas in the city most plagued by Gun Violence. To be clear, the violence were seeing in chicago, the uptick, same in New York and Los Angeles and other places across the country. We are all suffering and weve all got to have a whole of government, whole of community approach, otherwise were not going to make measurable difference. But again, yes, we have to deal with the immediate for sure, but we will never get beyond this if we dont plant the seeds now for the longterm problems. That is a what we have to do, be immediate, be present and make sure we are holding those accountable who are driving the violence, but weve got to get at the Root Causes so we can turn the page from this violence because our young people are moving at a different direction. Brian simms is one of only three openly gay State Legislators in pennsylvania. This week, alongside his two lgbtq colleagues and the governor, simms announced a bill that would provide sweeping antidiscrimination protections for queer pennsylvanians. Joining me is pennsylvaniian State Council for government, welcome to the Sunday Show. Good morning, jonathan. Thank you for having me. So, talk about the bill that you propose and that was in the last clip that we heard. Why is it important for pennsylvania to have an antidiscrimination law like the one youre proposing . The quick answer is because discrimination against lesbian, gay, buy sexual, transgender, queer, people like the community i come from is still legal in the commonwealth of pennsylvania. Every single state and the federal government protects categories of people from certain types of discrimination. Because of the gerrymandered republican leadership we see, lgbtqia have been allowed to be discriminated against in the commonwealth. Would you even have to introduce this bill if the Equality Act, which is sitting in the United States senate, if that had already been passed . Yes is the quick answer. Theres a lot of overlap between State Laws that impose Nondiscrimination Legislation and the federal laws that do the same, there are places where theres not overlap. Its critically important even with the Equality Act that we do see the fairness act pass, as well, for sure. So in that montage that weve played at the beginning of this, you made reference to getting your mic Cut Off. I want to show the audience what you were referring to. An agenda for pursued by a party that is 100 white in a chamber that is 70 male. Oh mr. Baker, thats enough. It means nothing to me. It was an abortion registry system. Registry defining system. In pennsylvania, just a little bit more than half of the abortions that happen in the commonwealth, for example, occur of women of color. In a party that as i pointed out 100 white in a room that is 70 male has no business attacking the reproductive rights on anybody, let alone women of color. You are, as i mentioned before, you are running for Lieutenant Governor in the commonwealth of pennsylvania. You have been endorsed by the Victory Fund for Lieutenant Governor, as they said, if elected. You would be one of the first lgbtq Lieutenant Governors in the united States History and one of the first, if not the first, Out Lgbtq Person elected statewide in pennsylvania. Why do you want to be lg of pa . I think the quick answer is that my ten years in the general assembly, serving in the most gerrymandering general assembly in the country, under many of the most radical elected officials in the country, combined with my experience as a civil Rights Attorney and activist, i think i can do good work for the commonwealth of pennsylvania. I think we need a lot of help in our general assembly and a lot of people saw across the country what pennsylvanias politics look like as we worked our way through this last election. I think i have the experience and unfortunately i think i have the temperament to deal with both republicans in the general assembly and pursue the progressive ideology i think pennsylvania wants. Last question, to get your reaction to the supreme Court Decision on catholic Services Agency, the philadelphiabased catholic Services Agency being able to deny Foster Care Services to samesex Couples. 30 seconds, your response to this supreme Court Decision. I think its really important for people to understand that the Supreme Court did not rule that Adoption Agencies are now allowed to discriminate against lgbtq people. It was not a sweeping decision that created precedent. It was very much limited to the facts of this case and, frankly, speaks more to the bad operation, i believe, of Philadelphia Government that it does to allowing any degree of lgbt nonstrimgs. This week many of the republican partys biggest stars took to the Sunshine State to attend the conservative Conference Faith and freedom coalition. As youve heard, Senator Marcia Blackburn of tennessee, there was no shortage of love for Donald Trump. The voices in my head are driving me crazy. They found time to decry the greatest issues facing america today. No, not systemic equality or the shrinking Middle Class or even the crumbling infrastructure they claimed to care about. Trumps significant army travelled to florida to instead bemoan the dangers of critical Race Theory which they swear they understand. I had a Reporter Run up to me. What is critical Race Theory. I Plaex Ined its a theory that derived from marxism. A conflict between classes and the working men and women, the fundment tal battle in society. Its the same Marxism Concept except for race. Nothing spells privilege quite like comparing an academic theory to the kkk. Senator cruz wasnt the only republican to invoke marxism. The old Marxism Used Economics to gain control. The new marxism uses identity politics. And the result is something that looks nothing like america. Theres no reason to believe that this new marxism will result in anything but what the old marxism resulted in. While the gop has been swept away in a flood of delusion and racism, leaving the rest of us to scratch our heads while we try to pick our jaws up off the floor, the question is could the latest installment of faux outrage from republican Grievance Theater actually help republicans retake the House And Senate in 2022 . Look, the gop has become masters of of analysis. So what they do is tell people a bunch of lies and make it seem like theyre from a pattern that makes sense. None of that is true. Critical Race Theory does not derive from marxism. It comes out of [ inaudible ] which is a broader of our legal structure. More than this, what they know is they are losing the Information War and so now they are trying to start a culture war. When i look at them and particularly look at them at a Faith And Freedom conference, right, what theyre essentially doing is having the impish kinds of parities of evangelical rivals. Nobody should believe anything theyre talking about and again just remembering that really they are arguing about critical Race Theory. They are saying they dont Want Americans to have an accurate accounting of American History. What they want is a white accounting of American History that would allow them to retain power. And so, charlie, given that, i mean, do you think that this will actually work that this hammering away at critical Race Theory and, you know, touching that button that brittany was talking about that will actually help republicans succeed in the midterms next year. Well, its an interesting question. Look, theres an interesting academic debate over critical Race Theory. We can have a back and forth but thats not what respects want. They want to to be a stand in for any discussions about rates. If theyre concerned about critical Race Theory being the new marxism, why not have why are State Legislators not passing laws banning the teaching of marxism . Why are they not passing laws banning the teaching of critical legal theory or radical Feminism Or Post modernism . All these things they dislike. They focussed on critical Race Theory. First of all, they dont understand what it means. They know that voters dont but what they do know is that this is a way for them to push back on the racial debate so any concern about the history of Racism Or Police violence now is see what youre doing is critical Race Theory. Now you asked the question is it going to work . Republicans, obviously, think playing the Race Card will work. What is interesting is the cynicism here is how much of their energy they are putting behind pretty direct racial politics going to their base and saying, look, we will protect you from black lives matter, from these radicals, from these socialists and theyve calculated this will give them an edge in the Swing Stricts and given the Structure Problems that we have, including gerrymandering, i dont think you can eliminate the possibility. There might be one last spasm for this kind of racial politics that weve seen in the past. Rachel, ill get you to talk about that last point that charlie made. Have a listen to what Senator Lindsey Graham had to say at the Faith And Freedom event. We had a chance to reset america. It comes in 2022. If we can pull this off, take back the house and the senate, then 2024 becomes ours to lose. Imagine four more years of Donald Trump policies. Oh, my gosh. Its like a threat. Rachel, what do you make of Senator Graham . Does he have a point if republicans retake the House And Senate in 2022 and next years Midterm Elections, doesnt he have a point they set it up for republicans to retake the house, the White House in 24 . Yeah, you know, im building a reputation ill tell you how it is and not what they want it to be. The Midterm Elections, the election in the Virginia Cycle of california recall, these Ared A Advantageous to the gop because turnout will not be president ial level. In 2018 midterm, We Saw a president ial turnout and that was because Donald Trump, the specter of him, drove so many democrat and left many independents to the goals and able to overwhelm the gop. What were looking forward this is the major concern because as you have been discussing, the gop is very inept at choosing their turnout. Im here to tell you studies were done extensive political science studies, quality studies, on the world of economics and populism in 2018 versus Race And Race and sexism motivated voters. Right. They know what theyre doing. Its all strategic and the question is what do we do about it to fight back on our side . We dont have the natural fear and emotive cat lymphs. Were focussed on getting our side to understand that the gop is playing for keeps. Ill tell you this, demographics are destiny. Not if People Cant Access the ballot box. And, you know, races, as you pointed out, Racism And Sexism is what is juicing the on the republican side. Thats why you had strike pac, rachel, those the ads you have out are rather bracing in a lot of ways sort of undemocratic party like theyre, very, like, reminiscent of Lincoln Project Ads Everyone was swooning over in the 2020 election. Brittany, to you, is there is there still enough anger in the country among the democratic Party Base that would get them to come out to the polls in an off Era Election at president ial Election Year levels . Absolutely. I think the one challenge and i believe in factbased analysis, unlike my republican counter parts, but i think that were using old studies and one of the things that 2020 taught us, were in unprecedented waters. We have an unprecedented trauma over Donald Trump. We saw, you know, were still in the, you know, in the aftermath of George Floyd. Were still in the aftermath of, you know, juneteenth being a federal holiday. People are basking in what it means to have a difference in biden and we want to keep that. People are still recovering from what covid19 meant. Not just socially but economically. And so i think that people are incredibly tuned in. And i also think a lot of demographic studies that are used to make the political repredictions are not thinking about a black Voter Turnout or black electorate or people of Color Electorate who understand in stark terms what the likes of a fascist republican party can do. I think that the wind is at the back of democrats. I think the other thing that we have in our, you know, in a feather in our cap, we have Stacy Abrams. Unlike in the past where the republicans where engineering the republican State Controlled Legislatures over the period of 30 to 40 years, we came into this knowing it was going to be the assault. They were going to try to gerrymander. They were going to try to, you know, engage in massive Voter Suppression. Were more prepared than we were before. And so, charlie, i mean, from your advantage point, what do you make of what brittany said and do you think that theres still enough anger out there at Donald Trump and what he did in the past four years to swamp the historical advantage that the republicans have in off Era Elections . Well, we dont the answer to that. It is interesting, you know, remember when republicans ousted liz cheney. They said they didnt want to keep relitigating the 2020 election. They wanted to move ahead . Well, they havent moved ahead. And the stronger they embrace Donald Trump and Donald Trumps lies, the more likely 2022 might be an outlier. Yes, there are structure advantages that the republicans have. But if republicans continue to double down on the crazy, on the most extreme elements, i think there is a chance that they will keep that alive. I mean, the fact weve been talking about this Donald Trump want to be speaker of the house of representatives. You have republicans floating ideas that seem almost designed in a laboratory to motivate democratic voters to come out because they seem like theyre the ones who want to make 2022 into a referendum on Donald Trump, which is an interesting choice. If they lose, it will be because of that choice. When you say, charlie, that next year could be an outlier, an outlier because the party in power in the White House usually looses seats in congress in the Midterm Elections except in 2002 was the most recent time. This week the senate confirmed ketanji Brown Jackson. An influential court that often leads a judge straight to the Supreme Court. Shes one of 11 women of Color Biden has nominated to be a judge. A Feat Biden achieved in four months but notedly took his predecessor four years. More over, biden seems to be setting himself up on good on a promise he made last year on the campaign trail. If im elected. I have an opportunity to appoint someone to the courts. Ill appoint the first black woman to the courts. Its required they have representation now. Its long overdue. Joining me now is ruth marcus, Column Nist at the washington post. Welcome back to the Sunday Show. Thank you for having me back. Okay. So were talking about ketanja Brown Jackson. The subject of the column you wrote earlier this week with the headline ive urged Supreme Court justices to stick around but never to retire until now. Right there on the screen is justice breyer. You write an entire column saying i think its time for him to retire. Why did you feel its so important to go on the record to say this . Justice Ruth Bader Ginsburg. Thats the answer. Well, theres actually two answers. Justice Ruth Bader Ginsburg and the tragic example of the bets she made that Hillary Clinton would be elected president and that she would be able to retire and have her successor named by the first woman president. It didnt work out that way. The second reason is Mitch Mcconnell. Mitch mcconnell not only, obviously, denied merrick garland, now the Attorney General a seat on the Supreme Court or a hearing about the seat on the Supreme Court but rushed through Justice Barrett as justice ginsburgs replacement. He had a thing that pushed me Over The Edge to writing this was really two things. First of all, Senator Mcconnell had an interview with our colleague ah. Ruth, ruth, actually, we have some sounds. Lets play it and then well pick it up on the other side. But it the rule you applied in 2016 to The School Ya Va Scalia Vacancy apply in 2024 to any vacancy there . Well, i think its in the middle of a president ial election. If you have the senate of of the opposite party of the president , you have to go back to the 1880s to find the last time the vacancy was filled. I think its highly unlikely. In fact, no, i dont think that either party, if it controlled, if it were different from the president , would confirm a supreme Court Nominee in the middle of an election. I mean, ruth, just think here the actual words its maddening. But pick up what you were saying before we played that well, that is done before. What sent what Senator Mcconnell went on to say which is what about 2023, if there were 18 months in a president ial right. The 2023 Term And President biden were to appoint a regular Run Of The Mill liberal justice. Senator mcconnells comment wasnt, well, we would proceed as normally. He said well have to wait to see. My translation was i have to count the votes to see if i can block somebody, as well. I understand a piece of justice Breyers Reticence he doesnt want to look and more importantly he doesnt want to make the court look like another political player. Lets get serious, if e were if he were to refrain retiring at The End of the month or in early july, and were to retire next year, how political would things look if a process launched with republicans trying to block after the midterm if, i mean, after the Midterm Elections. It could be just a mess. A mess for the court and a mess for the country. Right. It could be a mess. I just think its going to be a mess no matter what happens because of the characters involved. In the minute we have left, i want to talk about potential replacements. I mean, were focussed on judge Brown Jackson. We do know in terms of fulfilling the promise four of the 179 Appeals Court judges are black women. Of the 800 federal District Court judges, 35 are black women. Brown jackson was just confirmed to the d. C. Circuit court of appeals, which i said in the intro it puts you on the glide path to being a Supreme Court justice. Is It Fair is It Fair to say that judge Brown Jackson is a frontrunner if and when a seat opens up on the court . She is definitely a frontrunner in addition to really quite stellar resume. Its something as you point out very few black women have, which is experience on the federal bench or, in fact, on any bench. As a bold Promise President biden made. Shes also, by The Way, a former Law Clerk to justice stephen breyer. Thats right. I suspect her weighing the pluses and minuses. Justices get tickled when their Law Clerks make good. Ill throw another name out there in terms of federal justice courts. Willamina wright. Appointed in 2016 by president obama. Put that name in a Back Pocket somewhere. Ruth, youll be back shortly. In a unanimous decision, the court ruled in favor of a philadelphia catholic social Services Group that refused to allow samesex Couples to foster children. It was a narrow ruling but still a disappointing step back for equality. Given the nations High Court is now the most conservative its been in 70 years, is the future of Gay Rights in jeopardy . Here to talk about the state of the lgbtq movement, Sasha Eisenberg Author of the Engagement Americas Quarter Century Struggle over Samesex Marriage and alfonso david. Thank you for coming to the Sunday Show. Sasha, ill start with you. Talk about the premises of your book and how conservative opposition to Samesex Marriage actually kind of helped Samesex Marriage. In the early 1990s there was no corner that made winning Marriage Equality a priority. There wasnt a gay Rights Group that endorsed it. What happened is theres a Court Case in hey that leads to a favorable ruling in New York and opponents of Gay Rights stopped gays and lesbians from marrying. Within a few years, it broken the divides. And all of a sudden you see that the gay right the movement becomes united behind something that was never one of the priorities before. And, i mean, your book your book is is is big. Its several hundred pages long. Umm, umm, is there anything in the reporting that actually, in your reporting, that surprised you that you didnt already know about the movement, and particularly the push for Marriage Equality. Yeah, i mean, the origins of this, this grows out of a, frankly, petty and parochial fight over control of a pride planning committee, which in honolulu, hawaii. Anybody on any sort of Event Planning Committee will recognize some of the Smallscale Pettiness of this. Yeah. It spirals Out Of Control and the local activist launches a Pr Stunt in December Of 1990 to force the hand of local aclu. He thinks they havent taken seriously the desire to win marriage rights. That leads to a lawsuit in hawaii and some really crazy things happen in hawaii Supreme Court. And i think when we, you know, we get to 2015, obviously, and we see the result of this at the decision and assume because it ends in justice it had to be inevitable and what is clear from my reporting into the origins of it is no part of the conflict over marriage was inevitable. So, alfonso, as the president of the human rights campaign. The largest lgbtq Rights Organization in the country, your job one of many of your jobs, is to ensure that legislation and other things that would be helpful to the community get over the Finish Line whether its in towns, states, or federally. And you know where im going. The Equality Act. Where is it . Why is it important that the senate actually vote on it and get it passed to the President S desk . Well, thank you, jonathan. Thank you for writing this book, sasha. I think the book highlights that the conservative opposition to lgbtq rights will fail. It failed before and itll fail again. Jonathan, to your question, more than 70 of voters support equality. One in six Youth Adults identify as lgbtq. We need the Equality Act because lgbtq people face discrimination every day. Twothirds of lgbtq people report experiencing some type of discrimination. So if we live in a democracy, we should make that democracy works for all of us. Unfortunately, were seeing an avalanche of opposition from conservatives and serious and real collateral consequences for lgbtq people and their families. More than 250 bills have been introduced in State Legislatures around the country. 24 have been signed forcing families to leave their homes. This is real for lgbtq people. We need the Equality Act. Where it is, its in the senate. Were engaging with senators on both sides of the aisle to advance this bill. And our biggest obstacle is stigma and misinformation. That is what we are addressing. So, Al Fan sew, i dont have time to play the actual clip from chuck schumer, but back on may 28th, he said i may also ask the senate to consider Gun Legislation and Lgbtq Equality Legislation in the June Work period. Have you heard anything from the Majority Leader about the Equality Act getting a vote . We have engaged with the Majority Leaders office and himself to make sure that we are able to identify all of the votes we need to pass the bill. We want to make sure this bill becomes law. We dont want to engage in an academic exercise. Were engaging with the Majority Leaders office to make sure that the Equality Act can pass. Were utilizing a variety of strategies to advance the bill forward. It sounds like you dont have a debate. No. For us, The Key is passing the bill. Not necessarily identifying a date. We have work to do to make sure that the bill can get through the senate. So in your book, sasha, to close out the interview, you write this is element two. There was when i saw this excerpt, i immediately thought of the philadelphia case. The catholic services case. I think we must pause in that moment. When he was peddling to the american people he doesnt support sr 1 and conflating it with what Joe Manchin actually proposed, that should make everybody bothered. Because what Joe Manchin is saying the legislation oftentimes arent perfect. Bring it to the table and start negotiating. What Joe Manchins bill actually does, it makes automatic voter registration, it also makes sure that there is a national Voting Holiday so people can exercise their franchise and it goes from there. The Joe Manchin piece is perhaps not perfect for the democratic side but its also not imperfect for the republican side. Its very clear that at The End of the day what Lindsey Graham is trying to do is on few skate and say we dont want the enfranchisement of the majority of the american people. Regardless of your political stripes, it shouldnt sit well with you. And, jennifer, the thing i find most fascinating but all of this, by the Manchin Comprise is he gave them Voter Id put it there in his comprise and they come back and say, no, were good. So theyre now, after decades, saying we need Voter Id. Theyve come out against the bill that would actually institute Voter Id. Please explain. Yeah, this is the Joe Manchin. He has ten imaginary friends. Out there are going to join him if hes only reasonable. I think what he did was reasonable. Take a very big, very sprawling bill with a bunch of other stuff, including ethics, Campaign Finance and bring it down to address, in particular, the biggest threats, which we see around the Country State legislatures chipping away at ballot access. It basically is a fundamentally sound centrist bill. There are not ten republicans for this. Just like there arent ten republicans to investigate the January 6th insurrection. So at some point, Joe Manchin has to make a decision whether some fundment tal protections of democracy should take precedence or the phil butt filibuster. Getting to that point is what were going through now. He has to see how unreasonable the republicans are. Just how unwilling they are to make any reasonable comprise, and then its going to be on his shoulders to allow in this bizarre system we have that come down to one senator and get comfortable with some comprise or reform of the Filibuster Rules. All right. So, ruth, lets talk about filibuster. Where are you on this . I seem to recall, you werent there yet in terms of reforming the filibuster. Given everything we see now and, you know, all Joe Manchins efforts in a bipartisan bill are Coming Up empty, is it time to reform the filibuster at least for the for the people act, do you think . I think its time to talk about ways to reform the filibuster. I am very reluctant, as ive said in the board meetings and as i also wrote in an oped for the washington post, im reluctant to end it entirely. I know theres a lot of viewers screaming out there no, no, youre wrong. The reason is, its easy to look ahead to republican President S and republican Senate Majority and think about all the things that democrats would want to stop in that circumstance. Many, many things they use the filibuster to stop in advance. I hear Jennifers Pain and understand the frustration and the absolute inact to take yes and cut back the bill and well give you Voter Id and it was just remarkable. What would satisfy Lindsey Graham . What would satisfy Mitch Mcconnell . The problem is, Senator Graham put it absolutely correctly. Republicans and democrats have a completely different idea of the problem. Republicans think that the problem is too many people are voting. That is not the problem that were facing. Right. Right. Or as one viewer who heard me say that said, no, actually, republicans are, to their minds are fixing a problem. The problem is they think too many people are voting. You are a great strategies so im hear me out on this, it seemed to me when manchin put out his comprise that no one saw coming and the stuff that he had in it and then Stacy Abrams coming out and say, hey, im for it. And before democrats had a chance to react to Stacy Abrams, Mitch Mcconnell comes out and says, nope, were not for it because its the stacy Abrams Bill now. Now democrats are circling the wagons. I just wonder is Senator Manchin Crazy Like A Fox . Did he actually set up the republicans to show theyre not interested in a bipartisan deal as a means of making it easier for democrats to reform the filibuster and do it in a way allowing him to sign on and or a reform of the Filibuster Rule so that the for the people act can get passed . I have to share with you, i dont think the republicans realized how Upset Manchin was after they decided not to investigate the insurrection that took place on sacred soil of Capitol Hill. The fact im going to walk you through this, make sure were investigating. Its something that was incredibly, you know, it hit our democracy right square center. Put nation over party. He was surprised he couldnt get the commission. Hes saying were going to make sure were putting our cards on the table and we need to make sure that were Scaffolding Democracy to the best of our abilities. Because little d. Democracy our infrastructure is being assaulted every day and now manchin is creating an a possibility for the people for West Virginia to come with him so he can do the right thing to ensure that there is for the people act. Will it happen immediately in the next week . Im not so convinced it will happen. But i think that there will be other opportunities that he is allowing for the people of his voters, of his community to come with him when he performs the filibuster. I dont think hell eliminate the filibuster but a reform he puts forward. Wow. Im not crazy. We have a minute left. I dont have time to play the clip. Im sure you have seen it on the air many times. Mike pence getting heckled as a traitor at the conservative conference. Does that mean anything . Does it mean that everyone is still super loyal to trump . They make out Mike Pence, who Vice President to be the evil dougher of the opponent of democracy whatever it is. So this just shows you at least with that portrait of the republican party, which is substantial, there is no logic. Theres no reason.
